2.The Congress finds as follows:
(1)Each year approximately 9 million people
become ill with active tuberculosis (TB
) and 2 million of those
people die. This is a direct result of the disease having the ability to
develop resistance to treatments and to travel easily across borders.
(2)In 2005, there
were 14,093 cases of active TB reported in the United States. However, the
decline of 3.8 percent in the national TB case rate from 2004 to 2005 was one
of the smallest declines in more than a decade.
(3)In addition to
those with active TB, an estimated 10 to 15 million people in the United States
have latent TB.
(4)The increasing
occurrence of multidrug resistant TB, including extensively drug-resistant
TB—which is resistant to at least two main first-line drugs and additionally to
three or more of the six classes of second-line drugs—raises concerns of a
future epidemic of virtually untreatable TB.
(5)New tools are
needed to more effectively prevent, diagnose, and treat TB. The standard method
of diagnosing TB is over 100 years old, and fails to adequately detect TB in
children and those coinfected with HIV/AIDS. The newest class of anti-TB drug
is 40 years old, while rates of multidrug resistant TB are rising
globally.
<enum>I</enum><header>Centers for
Disease Control and Prevention</header>
<subtitle id="H4C79CE8B62AA48F0917FD608C2A82C"><enum>A</enum><header>National program for
elimination of tuberculosis</header>
<section id="H43DA7F0FC0F64600B3D2C9734F33232"><enum>101.</enum><header>National
program</header><text display-inline="no-display-inline">Section 317E of the
Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-6">42 U.S.C. 247b-6</external-xref>) is amended—</text>
<paragraph id="HF1DD95FE0D1147D788AF572CE5D612AD"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the heading for the section and
inserting the following: <quote><header-in-text level="section" style="OLC">national program for elimination of
tuberculosis</header-in-text></quote>; and</text>
</paragraph><paragraph id="H9D47C88F9D3E4D7F95CBDADB5BAA1D2"><enum>(2)</enum><text>by
amending subsection (b) to read as follows:</text>

<subsection id="H5B3BC388E09F455AA41BD33C26FD112"><enum>(b)</enum><header>Research and
development; demonstration projects; education and training</header><text display-inline="yes-display-inline">With respect to the prevention, control and
elimination of tuberculosis, the Secretary may, directly or through grants to
public or nonprofit private entities, carry out the following:</text>
<paragraph id="HC87712E65D97438EBA631B4E62C70796"><enum>(1)</enum><text display-inline="yes-display-inline">Research, with priority given to research
and development concerning—</text>
<subparagraph id="H8257B8ADA4914DED83A21FC2C5F802C"><enum>(A)</enum><text>clinical trials to
evaluate the safety and effectiveness of new drugs, diagnostics, and vaccines
for latent tuberculosis infection and active tuberculosis;</text>
</subparagraph><subparagraph id="H64E3384FC5044B71BE3CF926C504601D"><enum>(B)</enum><text>epidemiological
studies of populations at risk of tuberculosis; and</text>
</subparagraph><subparagraph id="HF7CECF533FA941858B26F56EF853955B"><enum>(C)</enum><text display-inline="yes-display-inline">field studies to evaluate the effectiveness
of new drugs, diagnostics, and vaccines, and evaluation of efforts to eliminate
the disease.</text>
</subparagraph></paragraph><paragraph id="HF2C53E0929F745149BE7311453B217D7"><enum>(2)</enum><text>Demonstration
projects for—</text>
<subparagraph id="HDC647351F206487FBDEA78B100BA831"><enum>(A)</enum><text>the development of
regional capabilities to prevent, control and eliminate tuberculosis;</text>
</subparagraph><subparagraph id="HBDB46E8854BB43C1008131D9D0598CBC"><enum>(B)</enum><text>the
intensification of efforts to prevent, detect, and treat tuberculosis among
African Americans and reduce or eliminate the racial disparity in the incidence
of tuberculosis in that population;</text>
</subparagraph><subparagraph id="HF2E27651F66445EBAA449CB98400B3E"><enum>(C)</enum><text display-inline="yes-display-inline">the intensification of efforts to control
tuberculosis along the United States-Mexico border and among United
States-Mexico binational populations;</text>
</subparagraph><subparagraph id="H01D94804995246A0817FE48C053C1A5"><enum>(D)</enum><text>the intensification
of efforts to prevent, detect, and treat tuberculosis among foreign-born
persons who are in the United States; and</text>
</subparagraph><subparagraph id="H0CC5A999149E43599F7C0034C8576E79"><enum>(E)</enum><text display-inline="yes-display-inline">collaboration with Immigration and Customs
Enforcement to identify and treat immigrants with active or latent tuberculosis
infection.</text>
</subparagraph></paragraph><paragraph id="HDF3CE4227ECB4A1AB000A6D6CE1C98BC"><enum>(3)</enum><text>A public
information and education program.</text>
</paragraph><paragraph id="H5704C35B240445FF9FB964EF42B4449D"><enum>(4)</enum><text>Education,
training and clinical skills improvement activities for health professionals,
including allied health personnel and emergency response employees.</text>
</paragraph><paragraph id="H4B2F3350148B47D3A01552B1C7007F83"><enum>(5)</enum><text display-inline="yes-display-inline">Provide support for the Tuberculosis Trials
Consortium, the Tuberculosis Epidemiologic Studies Consortium, and Regional
Training and Medical Consultation Centers to carry out activities under
paragraphs (1) through (4).</text>
</paragraph><paragraph id="H00314BD421564A6FA36165F296CEB165"><enum>(6)</enum><text display-inline="yes-display-inline">Collaboration with international
organizations and foreign countries in carrying out such
activities.</text>

collaboration</header>
<section id="H694DA87F85B4481C84ED26CB0196F400"><enum>111.</enum><header>Advisory
council for elimination of tuberculosis</header>
<subsection id="H14BA4A6DC2FD4A51A745CDE6FA1516B3"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Section 317E(f) of
the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-6">42 U.S.C. 247b-6(f)</external-xref>) is amended—</text>
<paragraph id="H1805530D5711410B85B4FEA34CECFBD1"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (5) as paragraph
(6); and</text>
</paragraph><paragraph id="H9ED971D11CCB4B0496494FC39A37B67"><enum>(2)</enum><text>by
striking paragraphs (2) through (4), and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="HDEB8839EF7864DD2A177C19D04F979AD" style="OLC">
<paragraph id="HB3907C85B3BF4AECABB7762D54801BBE"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">The Council shall provide advice and
recommendations regarding the elimination of tuberculosis to the Secretary, the
Assistant Secretary for Health, and the Director of the Centers for Disease
Control and Prevention. In addition, the Council shall, with respect to
eliminating such disease, provide to the Secretary and other appropriate
Federal officials advice on—</text>
<subparagraph id="H4E5AE506B18B49088F284D0479B42442"><enum>(A)</enum><text>coordinating the
activities of the Public Health Service and other Federal agencies that relate
to the disease, including activities under subsection (b); and</text>
</subparagraph><subparagraph id="HCE3E1BFA7D6D4F21A3B9A0BDBD0600BC"><enum>(B)</enum><text>efficiently
utilizing the Federal resources involved.</text>
</subparagraph></paragraph><paragraph id="H5462184A9AAF4B1E932C8DF4659EB82"><enum>(3)</enum><header>National
plan</header>
<subparagraph id="H385534BA92CC4DED8B2EB4A61FA6D25F"><enum>(A)</enum><header>In
general</header><text>In carrying out paragraph (2), the Council shall make
recommendations on the development, revision, and implementation of a national
plan to eliminate tuberculosis in the United States.</text>
</subparagraph><subparagraph id="HD71AF053E6C14AC88775D86BA4DBB2AC"><enum>(B)</enum><header>Consultation</header><text>In
carrying out subparagraph (A), the Council shall consult with public and
private entities, including—</text>
<clause id="H70F52E9E671F46C7A90023D53500A3FF"><enum>(i)</enum><text>individuals who
are scientists, physicians, and other health professionals, who are not
officers or employees of the Federal Government and who represent the
disciplines relevant to tuberculosis elimination;</text>
</clause><clause commented="no" id="H0515A9D188174DEA8ED2380091F80123"><enum>(ii)</enum><text>members of
public-private partnerships established to address the elimination of
tuberculosis ;</text>
</clause><clause id="H09D41E8C780541E391B2DB2E5952F69C"><enum>(iii)</enum><text>members of
national and international nongovernmental organizations established to address
tuberculosis elimination; and</text>
</clause><clause id="H432F7D10875A41E58C2063FB74A80663"><enum>(iv)</enum><text>members from the
general public who are knowledgeable with respect to tuberculosis elimination
including individuals who have or have had tuberculosis.</text>
</clause></subparagraph><subparagraph commented="no" id="H1C81B53F21E7464788A668BB257750C7"><enum>(C)</enum><header>Certain
components of plan</header><text display-inline="yes-display-inline">In
carrying out subparagraph (A), the Council shall—</text>
<clause commented="no" id="H1BEFD12EA0D4418694461EFC00A0D75D"><enum>(i)</enum><text>consider the
recommendations of the Institute of Medicine regarding the elimination of
tuberculosis;</text>
</clause><clause commented="no" id="H84A687C561B64DA1B28F8EA95BD3888D"><enum>(ii)</enum><text>consider
recommendations for the involvement of the United States in continuing global
and cross-border tuberculosis control activities in countries where a high
incidence of tuberculosis directly affects the United States such as Mexico;
and</text>
</clause><clause commented="no" id="HD48E04466F3642A8999C522F7CED2485"><enum>(iii)</enum><text>review the
extent to which progress has been made toward eliminating tuberculosis.</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="H481609B80CAB4251A65FF4C6EFF3F82"><enum>(4)</enum><header>Annual
report</header><text>The Council shall annually submit to Congress and the
Secretary a report on the activities carried under this section, other than
subsection (g). Each such report shall include the opinion of the Council on
the extent to which its recommendations regarding the elimination of
tuberculosis have been implemented, including with respect to—</text>
<subparagraph commented="no" id="H214472F34E3145A8B6CA3700418E68F9"><enum>(A)</enum><text>activities under
subsection (b); and</text>
</subparagraph><subparagraph commented="no" id="H078AA4DD07A74DF199FD61F39BB96810"><enum>(B)</enum><text>the national plan
referred to in paragraph (3).</text>
</subparagraph></paragraph><paragraph id="HA76737DFC0BD42CD90B5E6BEC1534AE"><enum>(5)</enum><header>Composition</header><text>The
Council shall be composed of—</text>
<subparagraph id="HE4503A109DE347219DE34207E75379B5"><enum>(A)</enum><text>representatives
from the Centers for Disease Control and Prevention, the National Institutes of
Health, the United States Agency for International Development, the Agency for
Healthcare Research and Quality, the Health Resources and Services
Administration, the United States-Mexico Border Health Commission, and other
Federal departments and agencies that carry out significant activities related
to tuberculosis;</text>
</subparagraph><subparagraph id="H9A3BADF2E25F42D48CBA189FA0CF57BD"><enum>(B)</enum><text>State and local
tuberculosis control and public health and officials;</text>
</subparagraph><subparagraph id="HD338063626604BBFA174AAFAD4381F21"><enum>(C)</enum><text display-inline="yes-display-inline">individuals who are scientists, physicians,
laboritorians, and other health professionals who represent disciplines
relevant to tuberculosis elimination;</text>
</subparagraph><subparagraph id="H9036CF06A76B4200A91B49C824E117BE"><enum>(D)</enum><text>members of
national and international nongovernmental organizations established to address
the elimination of tuberculosis; and</text>
</subparagraph><subparagraph id="HD9C6D86D99234851A46606C853BCABF"><enum>(E)</enum><text>members from the
general public who are knowledgeable with respect to the elimination of
tuberculosis, including individuals who have or have had
tuberculosis.</text>
</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection id="HCE21121E45A64A7E90C68DDBCF1FC72"><enum>(b)</enum><header>Rule of
construction regarding current membership</header><text>With respect to the
advisory council under section 317E(f) of the Public Health Service Act, the
amendments made by subsection (a) may not be construed as terminating the
membership on such council of any individual serving as such a member as of the
day before the date of the enactment of this Act.</text>
</subsection></section></subtitle><subtitle id="H95992931738C4B299DAE139E3B2B7BF8"><enum>C</enum><header>New tools for
tuberculosis elimination</header>
<section id="HA8746667511A4045859783DC002B083C"><enum>121.</enum><header>New
tools</header><text display-inline="no-display-inline">Section 317E of the
Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-6">42 U.S.C. 247b–6</external-xref>) is amended—</text>
<paragraph id="H1B43C8AD76604B7F004EB5009C085E49"><enum>(1)</enum><text>by redesignating
subsection (g) as subsection (h); and</text>
</paragraph><paragraph id="H6EAE870AA46C4867AACBAD98916CBB35"><enum>(2)</enum><text>by inserting after
subsection (f) the following subsection:</text>
<quoted-block display-inline="no-display-inline" id="H83192299B23B4A97844B061CAC6FE31D" style="OLC">
<subsection id="H1D164460622C4672A879343C49D4786E"><enum>(g)</enum><header>New tools for
elimination of tuberculosis</header>
<paragraph commented="no" id="HE29AFEC0063E4619BAE1AF93E23EC100"><enum>(1)</enum><header>Research and
development on drugs, diagnostics, and vaccines </header><text>The Secretary,
acting through the Director of the Centers for Disease Control and Prevention,
shall expand, intensify, and coordinate research and development and related
activities of such Centers to develop new tools for the elimination of
tuberculosis, including drugs, diagnostics, and vaccines.</text>
</paragraph><paragraph id="H6694AFD84BFD4F63A600E98B1D10969D"><enum>(2)</enum><header>Federal
tuberculosis task force</header>
<subparagraph id="HA7A4B225FF424EA790C9B73C00088EE"><enum>(A)</enum><header>Duties</header><text>The
Federal Tuberculosis Task Force (established in December 2001 as part of the
Centers for Disease Control and Prevention) (in this subsection referred to as
the <quote>Task Force</quote>) shall provide to the Secretary and other
appropriate Federal officials advice on the implementation of paragraph (1),
include advice regarding the efficient utilization of the Federal resources
involved.</text>
</subparagraph><subparagraph id="HBA5709A856CD4D89B96DDE7FA2EDE490"><enum>(B)</enum><header>National plan
for new tools development</header><text>In carrying out paragraph (1), the Task
Force shall make recommendations on the development of a national plan for the
development of new tools for the elimination of tuberculosis, including drugs,
diagnostics, and vaccines.</text>
</subparagraph><subparagraph id="H1C4F3691C8EA462D8110DB8184BB2DCC"><enum>(C)</enum><header>Consultation</header><text>In
developing the national plan under paragraph (1), the Task Force shall consult
with—</text>
<clause id="H1C0C61E63860454AA782C27499CCC127"><enum>(i)</enum><text>scientists,
physicians, and other health professionals and who represent the specialties
and disciplines relevant to the research under consideration;</text>
</clause><clause id="H546E5AD303D54622A717346BB8CF2F31"><enum>(ii)</enum><text display-inline="yes-display-inline">members from public-private partnerships or
foundations (or both) engaged in research relevant to research under
consideration;</text>
</clause><clause id="H89A9CD9910854DFEB8D15091709DDD63"><enum>(iii)</enum><text>members of
national and international nongovernmental organizations established to address
tuberculosis elimination;</text>
</clause><clause id="HFF09F6D789B842EEA3BC46E5927BAB"><enum>(iv)</enum><text>members from the
general public who are knowledgeable with respect to tuberculosis, including
individuals who have or have had tuberculosis; and</text>
</clause><clause id="HA113CC6695064E57005659B3D2639DDA"><enum>(v)</enum><text>scientists,
physicians, and other health professionals who reside in a foreign country with
a substantial incidence or prevalence of tuberculosis, and who represent the
specialties and disciplines relevant to the research under
consideration.</text>
</clause></subparagraph></paragraph><paragraph id="H6C121F297E7142EC9068B31C04F1CD8"><enum>(3)</enum><header>Grants and
contracts</header><text>The Secretary shall carry out paragraph (1) directly
and through awards of grants, cooperative agreements, and contracts to public
and private entities, including—</text>
<subparagraph id="H2E7111535D9649A6A1F1972E7E2D867B"><enum>(A)</enum><text>public-private
partnerships;</text>
</subparagraph><subparagraph id="HEF8556CBF60D4B9F9124ED3F3E52C945"><enum>(B)</enum><text>academic
institutions, including institutions of higher education;</text>
</subparagraph><subparagraph id="H38B5337ACEF2454EBBCB05A88FCEFD98"><enum>(C)</enum><text>research
institutions; and</text>
</subparagraph><subparagraph id="H5D0FBE717BD7424EB7039562649301B5"><enum>(D)</enum><text display-inline="yes-display-inline">the Tuberculosis Trials Consortium and the
Tuberculosis Epidemiologic Studies
Consortium.</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section></subtitle><subtitle id="HD73C23294C6F48EB9DD73E6096A2DDB"><enum>D</enum><header>Authorizations of
appropriations</header>
<section id="HC7F0F54EF78847318FF5D4B87DC2EA1"><enum>131.</enum><header>Authorizations
of appropriations</header><text display-inline="no-display-inline">Section 317E
of the Public Health Service Act, as amended by section 121(1) of this Act, is
amended by amending subsection (h) to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="H2ECE5555D9C74AA69F005E00AD4E913" style="OLC">
<subsection id="HCCC2BB00D2CF46488893A82001CAF1"><enum>(h)</enum><header>Authorization of
appropriations</header>
<paragraph id="H320F86D7AA1045B283C3DFA0138BE6C"><enum>(1)</enum><header>General
program</header>
<subparagraph id="H1142A36FB7A74007A9B72953F24973BA"><enum>(A)</enum><header>In
general</header><text>For the purpose of carrying out this section, other than
subsection (g), there are authorized to be appropriated $528,000,000 for fiscal
year 2007, and such sums as may be necessary for each of the fiscal years 2008
through 2011.</text>
</subparagraph><subparagraph id="H824BDA70AF774302BA5161E32FAB32AE"><enum>(B)</enum><header>Priority in
expenditure of funds</header><text display-inline="yes-display-inline">In
expending amounts appropriated under subparagraph (A), the Secretary shall give
priority to making grants under subsection (a) to States, which Core grants to
States and local tuberculosis programs shall be distributed on the basis of a
formula developed by the Secretary that takes into account the level of
tuberculosis morbidity in each State, and other relevant factors in each State
regarding the disease. The preceding sentence does not require the Secretary to
modify the formula that was used by the Secretary for such grants for fiscal
year 2006.</text>
</subparagraph></paragraph><paragraph id="HF107F78D8BB747DE8394CE3D18F8AE33"><enum>(2)</enum><header>New
tools</header>
<subparagraph id="H8C8D21FF8A144638AC0021C7F4DED9E0"><enum>(A)</enum><header>In
general</header><text>For the purpose of carrying out subsection (g), there are
authorized to be appropriated $100,000,000 for fiscal year 2007, and such sums
as may be necessary for each of the fiscal years 2008 through 2011.</text>
</subparagraph><subparagraph id="H2B0425E7E75141758B2FE161B3D7408"><enum>(B)</enum><header>Limitation</header><text>The
authorization of appropriations established in subparagraph (A) for a fiscal
year is effective only if the amount appropriated under paragraph (1) for such
year equals or exceeds the amount appropriated to carry out this section for
fiscal year
2006.</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section></subtitle><enum>II</enum><header>National
Institutes of Health</header>
<section id="HB536164CB9784BFF945CEAA9A16E7414"><enum>201.</enum><header>Activities of
National Heart, Lung, and Blood Institute</header><text display-inline="no-display-inline">Subpart 2 of part C of title IV of the
<act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
285b et seq.) is amended by inserting after section 424B the following
section:</text>
<quoted-block act-name="Public" id="HA6817B379E67484698B985698F82BF59" style="OLC">
<section id="HC5415FA277484457A813CE8E60777E54"><enum>424C.</enum><header>Tuberculosis</header>
<subsection display-inline="no-display-inline" id="HE3BDEA2531FB4576B1001548D6AF46E"><enum>(a)</enum><header>In
General</header><text>The Director of the Institute shall expand, intensify,
and coordinate research and development and related activities of the Institute
with respect to tuberculosis, including activities toward the goal of
eliminating such disease.</text>
</subsection><subsection id="H1EE77907A98B43C28426B4EBC7A85BE4"><enum>(b)</enum><header>Certain
Activities</header><text>Activities under subsection (a) shall include—</text>
<paragraph id="H0B268962718F47DAAB162EB3EFE2D700"><enum>(1)</enum><text>enhancing basic
and clinical research on tuberculosis; and</text>
</paragraph><paragraph id="H732279B727124976907CE200A665C3FE"><enum>(2)</enum><text>expanding research
on the relationship between such disease and the human immunodeficiency
virus.</text>
</paragraph></subsection><subsection id="H5179CD1B11514D068949C83DC29FAE37"><enum>(c)</enum><header>Research
Education</header>
<paragraph id="HF500F0735F034769BB9218E2BD2B6BF"><enum>(1)</enum><header>Tuberculosis
academic awards</header><text>The Director of the Institute may provide awards
to faculty of schools of medicine or osteopathic medicine to assist such
faculty in developing high quality curricula in such schools designed to
significantly increase the opportunities for interested individuals, including
students of the school and practicing physicians and nurses, to learn the
principles and practices of preventing, managing, and controlling
tuberculosis.</text>
</paragraph><paragraph id="H90781D05D440464D88E26071103EBFBD"><enum>(2)</enum><header>Tuberculosis/pulmonary
infection awards</header><text>The Director of the Institute may provide awards
to support the career development of clinically trained professionals who are
committed to research regarding pulmonary infections and tuberculosis by
providing for supervised study and research.</text>
</paragraph><paragraph id="HCC260F2CA7CA4AFDA326DD808543AF57"><enum>(3)</enum><header>Authorization of
appropriations</header>
<subparagraph id="H941288B1E7014BF5B2BCA700977C7507"><enum>(A)</enum><header>Tuberculosis
academic awards</header><text display-inline="yes-display-inline">For the
purpose of carrying out paragraph (1), there are authorized to be appropriated

Tuberculosis, the Director of the National Vaccine Program, and the Director of

activities of the Center for research and training.</text>

training program</header><text>In carrying out paragraph (1), the Center shall
carry out an international training program regarding tuberculosis. Such
program shall be modeled after the international training program carried out
by the Center with respect to the human immunodeficiency
virus.</text>

programs regarding research on tuberculosis</header><text display-inline="no-display-inline">Part G of title IV of the
<act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
288 et seq.) is amended—</text>
<paragraph id="H2AEB9EE2B3E541309210079151FC18B0"><enum>(1)</enum><text>by redesignating
the second section 487F as section 487G; and</text>
</paragraph><paragraph id="HF037D38A27C74BF0B54B5F59A07590F4"><enum>(2)</enum><text>by inserting after
section 487G (as so redesignated) the following section:</text>

fiscal year 2007 and subsequent fiscal years, a portion of amounts appropriated
to carry out such sections is reserved for the purpose of entering into
contracts under which (in accordance with the section involved) individuals
will conduct research on
tuberculosis.</text>
