		<section display-inline="no-display-inline" id="H010407873D23434BBF6B391676D5057" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Institute of Food and
			 Agriculture Act of 2006</short-title></quote>.</text>
		</section><section id="H3D469BC476B943CFB3A4B64286E26CAF"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection id="H1D748DD8F72F4C668CB4FA701C45ADF"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="H944D37DAFEF54DC29B8C54D71B50C284"><enum>(1)</enum><text>the task force
			 established under section 7404 of the Farm Security and Rural Investment Act of
			 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/3101">7 U.S.C. 3101</external-xref> note; 116 Stat. 457)—</text>
					<subparagraph id="H8DF59978E1554813AFBD05F1DA404500"><enum>(A)</enum><text>conducted an
			 exhaustive review of agricultural research in the United States; and</text>
					</subparagraph><subparagraph id="H2E4370013FD548FB885EDF00D615AFB8"><enum>(B)</enum><text>evaluated the
			 merits of establishing 1 or more national institutes focused on disciplines
			 important to the progress of food and agricultural science; and</text>
					</subparagraph></paragraph><paragraph id="HD448D1B00BF540DEA7983B00AC94D664"><enum>(2)</enum><text>according to
			 findings and recommendations provided to Congress by the task force—</text>
					<subparagraph id="H91EE7DEAC69B49709128B646E4EDA3B2"><enum>(A)</enum><text>agriculture in the
			 United States faces critical challenges, including impending crises in the
			 food, agricultural, and natural resource systems of the United States;</text>
					</subparagraph><subparagraph id="H01A74EEB3DD14874A4EAC8B1C9B8E469"><enum>(B)</enum><text>exotic diseases
			 and pests threaten crops and livestock;</text>
					</subparagraph><subparagraph id="H2A33CD1AF7E940F3B64333B20499878D"><enum>(C)</enum><text>obesity has
			 reached epidemic proportions;</text>
					</subparagraph><subparagraph id="H4BE43DDE30044B0300BE929FC940EEA2"><enum>(D)</enum><text>agriculturally
			 related environmental degradation is a serious problem for the United States
			 and other parts of the world;</text>
					</subparagraph><subparagraph id="H0FCA1B29961A41EB97E02968BF3C00D"><enum>(E)</enum><text>certain animal
			 diseases threaten human health; and</text>
					</subparagraph><subparagraph id="H9630DD453DCF49C88B20DDDD735D732"><enum>(F)</enum><text>agricultural
			 producers of several primary crops in the United States are no longer the
			 world’s lowest-cost producers.</text>
					</subparagraph></paragraph></subsection><subsection id="HF143DE3843B748629ED8C7CE3B3DC0B0"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to establish a national institute—</text>
				<paragraph id="HAA0EEE27E90D43FB00DF9CF880F692EA"><enum>(1)</enum><text>to ensure that the
			 technological superiority of agriculture in the United States effectively
			 serves the people of the United States in the coming decades; and</text>
				</paragraph><paragraph id="H523863C1D0C546B4A983F4C83BD44DF4"><enum>(2)</enum><text>to support and
			 promote fundamental agricultural research and science of the highest caliber to
			 achieve the goals of—</text>
					<subparagraph id="H899F011490534E649B9E6769818F7024"><enum>(A)</enum><text>increasing the
			 international competitiveness of agriculture in the United States;</text>
					</subparagraph><subparagraph id="H5EB8B39C2D2742949B50AD6F4C32E52B"><enum>(B)</enum><text>developing foods
			 that improve health and combat obesity;</text>
					</subparagraph><subparagraph id="H80BBAFCEB4D245C4920781D4452FE7F8"><enum>(C)</enum><text>creating new and
			 more useful products from plants and animals;</text>
					</subparagraph><subparagraph id="HF5C7D090D3154E3FB351E0D0EDB75760"><enum>(D)</enum><text>improving food
			 safety and food security by protecting plants and animals in the United States
			 from insects, diseases, and the threat of bioterrorism;</text>
					</subparagraph><subparagraph id="H8722B86C4B2B4989943E2178907189F6"><enum>(E)</enum><text>enhancing
			 agricultural sustainability;</text>
					</subparagraph><subparagraph id="H5DFBAAB3318C44C788243D04D26C549E"><enum>(F)</enum><text>improving natural
			 resources;</text>
					</subparagraph><subparagraph id="H3B56B97557224457B1A79D315879D7B6"><enum>(G)</enum><text>strengthening the
			 economies of rural communities in the United States;</text>
					</subparagraph><subparagraph id="HCB9333FC822644579B7E00C191575BD2"><enum>(H)</enum><text display-inline="yes-display-inline">decreasing dependence of the United States
			 on foreign sources of petroleum by developing biobased fuels and products,
			 enhancing methods of production at biobased fuels refineries, reducing energy
			 consumption at biobased fuels refineries, and increasing the use of co-products
			 of biobased fuels production;</text>
					</subparagraph><subparagraph id="H73CC5A1720494824BBB85F57E404DE55"><enum>(I)</enum><text>strengthening
			 national security by improving the agricultural productivity of sustainable
			 farmers in developing countries to combat hunger and the political instability
			 that hunger produces;</text>
					</subparagraph><subparagraph id="H4EDF2FF8F7674DE4A094D2169B9896C2"><enum>(J)</enum><text>assisting in
			 modernizing and revitalizing the agricultural research facilities of the United
			 States at institutions of higher education, independent, nonprofit research
			 institutions, and consortia of those institutions, through capital
			 investment;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HABDE29CE99514B1EBEAEF14F45D0A024"><enum>(K)</enum><text>achieving such
			 other goals, and meeting such other needs, as the Secretary or the Institute
			 determines to be appropriate; and</text>
					</subparagraph><subparagraph id="HA255492D138744C79BBAADDBCCAB129C"><enum>(L)</enum><text display-inline="yes-display-inline">ensuring the ability of United States
			 producers to successfully combat sanitary and phytosanitary nontrade
			 barriers.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H00883FDC87B54013989D21215FA3E247"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HB192F807DEF046C6893FBE9C34008C95"><enum>(1)</enum><header>Council</header><text>The
			 term <term>Council</term> means the Standing Council of Advisors established in
			 section 4.</text>
			</paragraph><paragraph id="HFD4278E04A564E848C67FF6FC1363D48"><enum>(2)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Agriculture.</text>
			</paragraph><paragraph id="H5C8FABD4D6A5416083F371DF8BBB1D41"><enum>(3)</enum><header>Director</header><text>The
			 term <term>Director</term> means the Director of the Institute.</text>
			</paragraph><paragraph id="HF44339D13EBF4AD6B9FE6659EEA1C800"><enum>(4)</enum><header>Fundamental
			 agricultural research and science</header><text>The term <term>fundamental
			 agricultural research and science</term> means research and science that, as
			 determined by the Secretary—</text>
				<subparagraph id="HA01FE3F9B92F498FB57D2441E69F8F3E"><enum>(A)</enum><text>advances the
			 frontiers of knowledge so as to lead to practical results or to further
			 scientific discovery; and</text>
				</subparagraph><subparagraph id="H4C3140B77B494FC3841E79D206ABA324"><enum>(B)</enum><text>has an effect on
			 agriculture, food, human health, or another purpose of this Act as described in
			 section 2(b).</text>
				</subparagraph></paragraph><paragraph id="HE14E02B872AB4D1D94BCE901B5B52468"><enum>(5)</enum><header>Institute</header><text>The
			 term <term>Institute</term> means the National Institute of Food and
			 Agriculture established by section 4.</text>
			</paragraph><paragraph id="H906613E42B584D5FA9C8A6F800355B17"><enum>(6)</enum><header>Multidisciplinary
			 grant</header><text>The term <term>multidisciplinary grant</term> means a grant
			 provided to 2 or more collaborating investigators to carry out coordinated,
			 multidisciplinary research programs involving multiple disciplines that have
			 been approved by the Institute.</text>
			</paragraph><paragraph id="H78B7A7E7C3F542058E41C08C214DDA92"><enum>(7)</enum><header>Project
			 grant</header><text>The term <term>project grant</term> means a grant provided
			 to 1 or more principal investigators to conduct research that has been approved
			 by the Institute.</text>
			</paragraph><paragraph id="HA640DA600AB64176B8B039A2C46E55F4"><enum>(8)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph><paragraph id="HF5CD76878A7A4234B9C9D584D8A88C7E"><enum>(9)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
				<subparagraph id="H4C40A091452A48FA9278E700A000FBB5"><enum>(A)</enum><text>each of the
			 several States of the United States;</text>
				</subparagraph><subparagraph id="HDE0C2D5A6F1F4245806E26A3EE9D5948"><enum>(B)</enum><text>the District of
			 Columbia;</text>
				</subparagraph><subparagraph id="H6CDEAAD276A04D938296A54D6487A842"><enum>(C)</enum><text>the Commonwealth
			 of Puerto Rico;</text>
				</subparagraph><subparagraph id="H8EF8549AC73E4B4D83EE35E128E44EB2"><enum>(D)</enum><text>Guam;</text>
				</subparagraph><subparagraph id="HA5D0D6DB6C0C4D1D00E363733915B099"><enum>(E)</enum><text>American
			 Samoa;</text>
				</subparagraph><subparagraph id="HACD1A9FF8B6D427993CD78CCCBBDE428"><enum>(F)</enum><text>the Commonwealth
			 of the Northern Mariana Islands;</text>
				</subparagraph><subparagraph id="H729FF0DAFC5F4C3B8F2C3C6D07D99004"><enum>(G)</enum><text>the Federated
			 States of Micronesia;</text>
				</subparagraph><subparagraph id="HF34371A8DBBD4D58A9EFDEB40292B602"><enum>(H)</enum><text>the Republic of
			 the Marshall Islands;</text>
				</subparagraph><subparagraph id="H29B541625E6942E48FA75F9499907720"><enum>(I)</enum><text>the Republic of
			 Palau; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAE56C652466B4B00AB7529445C700089"><enum>(J)</enum><text>the United States
			 Virgin Islands.</text>
				</subparagraph></paragraph><paragraph id="HED49DB42AE414FE19866D2B15E00F038"><enum>(10)</enum><header>United
			 States</header><text>The term <term>United States</term>, when used in a
			 geographical sense, means all of the States.</text>
			</paragraph></section><section id="HECED1075BFF744C6B68D34C612EECAF4"><enum>4.</enum><header>Establishment;
			 composition</header>
			<subsection id="H72F77E23F2E44C30B2349B6849FF8F72"><enum>(a)</enum><header>Establishment</header><text>There
			 is established within the Department an agency to be known as the
			 <quote>National Institute of Food and Agriculture</quote>.</text>
			</subsection><subsection id="H125E93A2E7144D4FBF837135637FEBEA"><enum>(b)</enum><header>Composition</header><text>The
			 Institute shall be composed of the Council (including committees and offices
			 established under section 5) and the Director.</text>
			</subsection><subsection id="HBEDC7888FBDE485F00F4002688B81DF7"><enum>(c)</enum><header>Standing council
			 of advisors</header>
				<paragraph id="HA2A26956CC4D4D3BAA3ED222AB25EA1F"><enum>(1)</enum><header>Establishment</header><text>There
			 is established a Standing Council of Advisors.</text>
				</paragraph><paragraph id="H5FFC018A188A4B868B137610673F849C"><enum>(2)</enum><header>Composition</header><text>The
			 Council shall be composed of 25 members, including—</text>
					<subparagraph id="HF2319C74E70C415DBBF21FA4E39F5F88"><enum>(A)</enum><text>the Director;
			 and</text>
					</subparagraph><subparagraph id="H5FCFC39F5876455F9F56A2BD18DC65BB"><enum>(B)</enum><text>18 members
			 appointed by the Secretary, with the concurrence of the Director, 3 members
			 appointed by the Committee on Agriculture of the House of Representatives, and
			 3 members appointed by the Committee on Agriculture, Nutrition, and Forestry of
			 the Senate, of whom—</text>
						<clause commented="no" id="HEFEDE762FE5C4C93AF6861A9ECE3463"><enum>(i)</enum><text display-inline="yes-display-inline">12 members shall be highly-qualified
			 scientists who, 6 as determined and appointed by the Secretary, 3 as determined
			 and appointed by the Committee on Agriculture of the House of Representatives,
			 and 3 as determined and appointed by the Committee on Agriculture, Nutrition,
			 and Forestry of the Senate—</text>
							<subclause commented="no" id="HA067CADE3E7249C49F9F336892BC204B"><enum>(I)</enum><text>are not employees
			 of the Federal Government;</text>
							</subclause><subclause commented="no" id="HC2692FDD2AB14D0D8C97E79067F43091"><enum>(II)</enum><text>have expertise in
			 the fields of agricultural research, science, or related appropriate
			 fields;</text>
							</subclause><subclause commented="no" id="HE0851DB0DE9041DB9B03B834AD9D60B6"><enum>(III)</enum><text>are appropriate
			 for membership on the Council solely on the basis of established records of
			 distinguished service; and</text>
							</subclause><subclause commented="no" id="H77C60F60B9DA44C79639C8B713A63558"><enum>(IV)</enum><text>collectively
			 represent the views of agricultural research and scientific leaders in all
			 regions of the United States; and</text>
							</subclause></clause><clause id="HF4F22E999C3542E3B4ECB088D292A63"><enum>(ii)</enum><text>12
			 members shall be distinguished members of the public, as determined by the
			 Secretary, including—</text>
							<subclause id="H70AE4A6F46C34E11AD9417E203C08554"><enum>(I)</enum><text>representatives of
			 agricultural organizations and industry; and</text>
							</subclause><subclause id="H4B40DE40C5354D61A462F00CC89F416"><enum>(II)</enum><text>individuals with
			 expertise in natural resources, sustainable agriculture, energy, and human
			 health and disease.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H7BE8DA83498A478E87B57410706B548C"><enum>(3)</enum><header>Term</header><text>The
			 members of the Council shall serve staggered, 4-year terms, as determined by
			 the Secretary and Congress .</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF27329C84ABD4D83BD35C6E23E05CC94"><enum>(4)</enum><header>Meetings</header><text>The
			 Council shall meet at the call of the Director and the Secretary, but not less
			 often than annually.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H64A7AA41FA0B433883AADD6836D8E236"><enum>(5)</enum><header>Chairperson and
			 vice chairperson</header><text display-inline="yes-display-inline">The Council
			 shall elect to 1 year terms a Chairperson and Vice Chairperson from among the
			 members of the Council. One shall be elected from among the members described
			 in paragraph (2)(i) and one shall be elected from among the members described
			 in paragraph (2)(i)</text>
				</paragraph><paragraph id="H56B5AC564A9F48B6891E2CF9C236F280"><enum>(6)</enum><header>Duties</header><text>The
			 Council shall—</text>
					<subparagraph id="H2490AF4401F44F8BBB96A48500D71138"><enum>(A)</enum><text>assist the
			 Director in—</text>
						<clause id="H8C1669B9A52446D2B03D4D0000D06588"><enum>(i)</enum><text>establishing
			 research priorities of the Institute; and</text>
						</clause><clause id="HA3DA0EB8B6F94E9B9852E419A5AAE7CF"><enum>(ii)</enum><text>reviewing,
			 judging, and maintaining the relevance of the programs of the Institute;</text>
						</clause></subparagraph><subparagraph id="H01DE2DD8C5A948F28CA2AA737EDC8665"><enum>(B)</enum><text>review all
			 proposals approved by the scientific committees established under section
			 5(a)(1) to ensure, to the maximum extent practicable, that the purposes of this
			 Act are being met; and</text>
					</subparagraph><subparagraph id="H425857AE734748BF965D63002B00ABC8"><enum>(C)</enum><text>through the
			 meetings described in paragraph (4), provide an interface between scientists
			 and stakeholders to ensure, to the maximum extent practicable, that the
			 Institute is coordinating national goals with realistic scientific
			 opportunities.</text>
					</subparagraph></paragraph></subsection><subsection id="H47FF3BE824134404BB6FDED639008FF"><enum>(d)</enum><header>Director</header>
				<paragraph id="H063ADA66B0014E0200657BE669DA2BE8"><enum>(1)</enum><header>In
			 general</header><text>The Institute shall be headed by a Director, who shall be
			 an individual who is—</text>
					<subparagraph id="H4663EECD975043D9959764A9C800388D"><enum>(A)</enum><text>a distinguished
			 agricultural researcher and scientist; and</text>
					</subparagraph><subparagraph id="H34AC66D474D141FC91F87184BC35591D"><enum>(B)</enum><text>appointed by the
			 President (after taking into consideration recommendations provided by the
			 Council), by and with the advice and consent of the Senate.</text>
					</subparagraph></paragraph><paragraph id="H31CEBC66E6B24C1F0047489F457CF799"><enum>(2)</enum><header>Term</header><text>The
			 Director shall serve for a single, 6-year term.</text>
				</paragraph><paragraph id="HF06DCA87A6ED42CB9BDB26C5486500C6"><enum>(3)</enum><header>Compensation</header><text>The
			 Director shall receive basic pay at the rate provided for level II of the
			 Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5513">section 5513</external-xref> of title 5, United States Code.</text>
				</paragraph><paragraph id="H30DDF2E38F6A42CAB2B3D656F6CA22E9"><enum>(4)</enum><header>Supervision</header><text>The
			 Director shall report directly to the Secretary.</text>
				</paragraph><paragraph id="HB0AF12B4D4154BE8A4A5F828EFA387EF"><enum>(5)</enum><header>Authority and
			 responsibilities of director</header>
					<subparagraph id="H509DB2141F854022B4F0083F5B9F2BB8"><enum>(A)</enum><header>In
			 general</header><text>Except as otherwise specifically provided in this Act,
			 the Director shall—</text>
						<clause id="H596E084C3D734E5D991700372213F467"><enum>(i)</enum><text>exercise all of
			 the authority provided to the Institute by this Act (including any powers and
			 functions delegated to the Director by the Council);</text>
						</clause><clause id="H9167E74C14EC43A8A34F3853BD2B9FC"><enum>(ii)</enum><text>in
			 consultation with the Council, formulate programs in accordance with policies
			 adopted by the Institute;</text>
						</clause><clause id="HD715D53EC8664CDD82CF1CD2E6D4F59E"><enum>(iii)</enum><text>establish
			 committees and offices within the Institute in accordance with section
			 5;</text>
						</clause><clause id="H7AD0F81D6BA5403C00C614D3339F3062"><enum>(iv)</enum><text>establish
			 procedures for the peer review of research funded by the Institute;</text>
						</clause><clause id="HDBC0D0ED8FDF4A3BAD69F8998EB27308"><enum>(v)</enum><text>establish
			 procedures for the provision and administration of grants by the Institute in
			 accordance with this Act;</text>
						</clause><clause id="H9726C39AF9F9474E971FA26D59A8FAA5"><enum>(vi)</enum><text>assess the
			 personnel needs of agricultural research in the areas supported by the
			 Institute, and, if determined to be appropriate by the Director or the
			 Secretary, for other areas of food and agricultural research; and</text>
						</clause><clause id="H2F2273CB64C84092B768CF50BA188884"><enum>(vii)</enum><text>cooperate with
			 the Council to plan programs that will help meet agricultural personnel needs
			 in the future, including portable fellowship and training programs in
			 fundamental agricultural research and science.</text>
						</clause></subparagraph><subparagraph id="HC06436C636F84F32A775C200FC48DE3C"><enum>(B)</enum><header>Finality of
			 actions</header><text>An action taken by the Director in accordance with this
			 Act (or in accordance with the terms of a delegation of authority from the
			 Council) shall be final and binding upon the Institute.</text>
					</subparagraph><subparagraph id="HF819B51B3EED401B91A679496CC7118C"><enum>(C)</enum><header>Delegation and
			 redelegation of functions</header>
						<clause id="H2FB6A1920E9A4651B0D7467863EADCA"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in clauses (ii) and (iii), the
			 Director may, from time to time and as the Director considers to be
			 appropriate, authorize the performance by any other officer, agency, or
			 employee of the Institute of any of the functions of the Director under this
			 Act, including functions delegated to the Director by the Council.</text>
						</clause><clause id="HB6E74E47B20240AABD0663DC463311C4"><enum>(ii)</enum><header>Policymaking
			 functions</header><text>The Director may not redelegate policymaking functions
			 delegated to the Director by the Council.</text>
						</clause><clause id="H1CE6BA173DAD4AEEA83186DBEF711BDA"><enum>(iii)</enum><header>Contracts,
			 grants, and other arrangements</header><text>The Director may enter into
			 contracts and other arrangements, and provide grants, in accordance with this
			 Act—</text>
							<subclause id="HB38E1DA3511D4C33BBF3E656FD692FE4"><enum>(I)</enum><text>only with the
			 prior approval of the Council or under authority delegated by the Council;
			 and</text>
							</subclause><subclause id="HE39C4EA34446436F97AABAECBB8CB372"><enum>(II)</enum><text>subject to such
			 conditions as the Council may specify.</text>
							</subclause></clause><clause id="HC0E139F42B144BD8B66305F12B52B8D1"><enum>(iv)</enum><header>Reporting</header><text>The
			 Director shall promptly report each contract or other arrangement entered into,
			 each grant awarded, and each other action of the Director taken, under clause
			 (iii) to the Committee on Agriculture, Nutrition, and Forestry of the Senate
			 and the Committee on Agriculture of the House of Representatives.</text>
						</clause></subparagraph></paragraph><paragraph id="H8C379B2E4E01417D8874439DAE2585DE"><enum>(6)</enum><header>Status on
			 Council</header>
					<subparagraph id="HCE89220AF8AC4AA3A42EF3D655F8CD1"><enum>(A)</enum><header>In
			 general</header><text>The Director shall be an ex officio member of the
			 Council.</text>
					</subparagraph><subparagraph id="H13CE518BE5984488948239F25BD07444"><enum>(B)</enum><header>Compensation and
			 tenure</header><text>Except with respect to compensation and tenure, the
			 service of the Director on the Council shall be coordinated with the service of
			 other members of the Council.</text>
					</subparagraph><subparagraph id="H791EEF66733547BE9992C536E8705730"><enum>(C)</enum><header>Voting;
			 election</header><text>The Director shall be—</text>
						<clause id="H2D309F6D2BDC45AAB31D9CC69D8FB7B6"><enum>(i)</enum><text>a
			 voting member of the Council; and</text>
						</clause><clause id="H47B8548A664842DB97019BECDA504DA"><enum>(ii)</enum><text>eligible for
			 election by the Council as Chairperson or Vice Chairperson of the
			 Council.</text>
						</clause></subparagraph></paragraph><paragraph id="H9D1AA041D0404C118DE9875E32D4477"><enum>(7)</enum><header>Staff</header>
					<subparagraph id="HD725D89D40254124A712F89D2FAD27BA"><enum>(A)</enum><header>In
			 general</header><text>Subject to this paragraph, the Director shall recruit and
			 hire such senior staff and other personnel as are necessary to assist the
			 Director in carrying out this Act.</text>
					</subparagraph><subparagraph id="H1998BA45A0AD4625B07250D9B6396592"><enum>(B)</enum><header>Senior
			 staff</header><text>Each individual hired as senior staff of the Director
			 shall—</text>
						<clause id="H7629D16AE6B3403FA84905C8D800A968"><enum>(i)</enum><text>be a
			 highly accomplished agricultural researcher and scientist, as determined by the
			 Director;</text>
						</clause><clause id="HE0E302A0405F48DEB5824D50D2CC1400"><enum>(ii)</enum><text>be
			 recruited from the active agricultural research and science community;
			 and</text>
						</clause><clause id="H51B25E319040429BACB248269312A373"><enum>(iii)</enum><text>be
			 appointed and serve on the basis of 4-year, rotating appointments.</text>
						</clause></subparagraph><subparagraph id="HCEEAD2A843DB4DFD8D3BBDCE8482EA2F"><enum>(C)</enum><header>Temporary
			 staff</header><text>Staff hired by the Director under this paragraph may
			 include agricultural researchers and scientists and other technical and
			 professional personnel hired for limited terms, or on temporary bases,
			 including individuals on leave of absence from academic, industrial, research,
			 or science institutions to work for the Institute.</text>
					</subparagraph><subparagraph id="H1AF5A08DA8D04C2E81CE2DEB3D2F8DA2"><enum>(D)</enum><header>Compensation</header>
						<clause id="H5BA332F5A0F84557B218044D3905E1A1"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in clause (ii), subject to such
			 policies as the Council shall periodically prescribe, the Director may fix the
			 compensation of staff hired under this paragraph without regard to the
			 provisions of chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United
			 States Code, relating to classification of positions and General Schedule pay
			 rates.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HC551D9608E934B63BD007B8180E52F7F"><enum>(ii)</enum><header>Maximum rate of
			 pay</header><text>The rate of pay for an individual hired under this paragraph
			 shall not exceed the rate payable for level V of the Executive Schedule under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text>
						</clause></subparagraph></paragraph><paragraph id="H837728805ECC415AB0FA16E319DF4C"><enum>(8)</enum><header>Reporting and
			 consultation</header><text>The Director shall—</text>
					<subparagraph id="HA15D61EA0AFF4FD3BE66C696E8A1BF0"><enum>(A)</enum><text>periodically report
			 to the Secretary with respect to activities carried out by the Institute;
			 and</text>
					</subparagraph><subparagraph id="HB408EBA3769042708C80A29383864F1C"><enum>(B)</enum><text>consult regularly
			 with the Secretary to ensure, to the maximum extent practicable, that—</text>
						<clause id="H6F4DC1191BBF445098DFD9CD00BD7699"><enum>(i)</enum><text>research of the
			 Institute is relevant to agriculture in the United States and otherwise serves
			 the national interest; and</text>
						</clause><clause id="H6774B59C246344929C7C5B6FA12934A8"><enum>(ii)</enum><text>the
			 research of the Institute supplements and enhances, and does not replace,
			 research conducted or funded by—</text>
							<subclause id="HAE7F97800D57415299EE6E50A8F370C5"><enum>(I)</enum><text>other agencies of
			 the Department;</text>
							</subclause><subclause id="H0394843141FF42B585B495BBAB3FDEFB"><enum>(II)</enum><text>the National
			 Science Foundation; or</text>
							</subclause><subclause id="HFC77ACA290404A29904F76BA3D896CE"><enum>(III)</enum><text>the National
			 Institutes of Health.</text>
							</subclause></clause></subparagraph></paragraph></subsection></section><section id="HB79F0953656940D1AC71BE24D1A1A47D"><enum>5.</enum><header>Committees and
			 Offices of Institute</header>
			<subsection id="H5FD1F732775A40B5B3DE59766327F5A6"><enum>(a)</enum><header>Standing
			 Scientific Committees</header>
				<paragraph id="HB1DAFA2B737146FDA14490F159BDC42"><enum>(1)</enum><header>In
			 general</header><text>The Director may establish such number of standing
			 scientific committees within the Institute as the Director determines to be
			 appropriate.</text>
				</paragraph><paragraph id="H47D94FDC0EFA46E685F2443C9EA6500"><enum>(2)</enum><header>Composition</header><text>A
			 standing scientific committee established under paragraph (1) shall consist of
			 such members of the Council appointed under section 4(d)(2)(B)(i) as the
			 Director may select.</text>
				</paragraph><paragraph id="H8E519389C7884B1EAA98856257ACBB3B"><enum>(3)</enum><header>Term</header><text>Members
			 of a standing scientific committee established under paragraph (1) shall serve
			 for staggered, 4-year terms, as determined by the Director.</text>
				</paragraph><paragraph id="HAD581A3CD9B6414E9E46342FE94C2D01"><enum>(4)</enum><header>Review of
			 proposals</header>
					<subparagraph id="H7F7C8D6F76374088822EC582A82C13A1"><enum>(A)</enum><header>In
			 general</header><text>A standing scientific committee shall apply rigorous
			 merit review to research proposals received by the Institute to ensure, to the
			 maximum extent practicable, that research funded by the Institute is
			 scientifically of high quality.</text>
					</subparagraph><subparagraph id="H80FC0A85B1684A38B24FBF9EBDF49982"><enum>(B)</enum><header>Determination of
			 scientific merit</header><text>A research proposal received by the Institute
			 and reviewed by a standing scientific committee under subparagraph (A) shall
			 be—</text>
						<clause id="H59838245AC3A4C618EB746A839F70099"><enum>(i)</enum><text>assigned a score
			 based on the scientific merit of the proposal, as determined by the standing
			 scientific committee; and</text>
						</clause><clause id="H89A2842666ED456B9DEF316B9EDD08D0"><enum>(ii)</enum><text>if
			 approved by the standing scientific committee, forwarded, along with the score,
			 to the Council for final review.</text>
						</clause></subparagraph><subparagraph id="HC4DF2C9CF6E140D2BAEAD9C247B8CD97"><enum>(C)</enum><header>Declination of
			 proposals</header><text>If the Council determines that a research proposal
			 forwarded under this paragraph does not meet standards of scientific review
			 established by a standing scientific committee or any similar standard
			 established by the Director, the Council shall decline to recommend the
			 research proposal for funding by the Institute.</text>
					</subparagraph></paragraph><paragraph id="H0A494E73B35842F991FE87CF8C4D8100"><enum>(5)</enum><header>Ad hoc review
			 members</header><text>The Director may supplement a standing scientific
			 committee under this subsection with 1 or more ad hoc reviewers in a case in
			 which a research proposal received by the Institute requires specialized
			 knowledge not represented on that or any other standing scientific
			 committee.</text>
				</paragraph></subsection><subsection id="H337F053359914946A02DD56E04719435"><enum>(b)</enum><header>Offices</header>
				<paragraph id="HB4FF556AEF5E4BC585BD40B41BFAC359"><enum>(1)</enum><header>Office of
			 Advanced Science and Application</header>
					<subparagraph id="H4AC9B9AFEC4A49E700DC557ECAC76738"><enum>(A)</enum><header>Establishment</header><text>The
			 Director shall establish within the Institute an Office of Advanced Science and
			 Application (referred to in this paragraph as the <term>Office</term>).</text>
					</subparagraph><subparagraph id="HC26701EFA6D24C7C9E03035492E4E6BB"><enum>(B)</enum><header>Duties</header><text>The
			 Office shall—</text>
						<clause id="H5B989799ED2F40F9A681DA86CCEF6E91"><enum>(i)</enum><text>closely monitor
			 national needs and advances in fundamental agricultural research and science
			 with the goal of identifying pressing problems for which solutions are
			 realistically achievable through fundamental agricultural research and
			 science;</text>
						</clause><clause id="HAEC7AA86A2604C32A9C3D1BC2B3CAD00"><enum>(ii)</enum><text>coordinate
			 creative talent from diverse disciplines to bridge potential gaps between
			 fundamental agricultural research and science and high-priority, practical
			 needs; and</text>
						</clause><clause id="H7038D146922B4ACCB5C002ED3D972598"><enum>(iii)</enum><text>recommend to the
			 Director ways in which existing fundamental agricultural research and science
			 may be applied to the most urgent problems addressed by the Institute.</text>
						</clause></subparagraph><subparagraph id="H4E2448FF516E4B448D52C4A12500FE81"><enum>(C)</enum><header>Staff</header>
						<clause id="HD71E2006AAB14CD0A86698FC71A1C300"><enum>(i)</enum><header>In
			 general</header><text>The Office shall employ a small, focused staff of
			 rotating experts in agricultural research and science.</text>
						</clause><clause id="HB10CD5F2B41C48809F42C475AB25A5D5"><enum>(ii)</enum><header>Talent pool;
			 term</header><text>Primary staff of the Office—</text>
							<subclause id="H308BFFD82B3144629274D0A11BAB1EA3"><enum>(I)</enum><text>shall be appointed
			 from the ranks of active agricultural researchers and scientists; and</text>
							</subclause><subclause id="H5358B4FCA5274CCA9704D1BF09F69D10"><enum>(II)</enum><text>shall serve terms
			 of not to exceed 3 years.</text>
							</subclause></clause></subparagraph><subparagraph id="H22F06054D6554231AA969311A04D52CB"><enum>(D)</enum><header>Intensive study
			 groups</header><text>The Office shall—</text>
						<clause id="H5D7221B8D4A74459982800EB9CD83058"><enum>(i)</enum><text>focus primarily on
			 the most urgent problems addressed by the Institute; and</text>
						</clause><clause id="H39F2866BC1ED4BAB8269EE9C37B7D35F"><enum>(ii)</enum><text>assemble such
			 intensive study groups as are necessary to address those problems.</text>
						</clause></subparagraph><subparagraph id="H07FE5109B7B844428796B9CD87A1C12B"><enum>(E)</enum><header>Reports</header><text>The
			 Office shall submit to the Director and the Council periodic reports
			 that—</text>
						<clause id="H2230A8E09ED0480D9DA5BAEF14773CF7"><enum>(i)</enum><text>describe the
			 activities being carried out by the Office; and</text>
						</clause><clause id="HC77A17F624B5429AA0A58BA66FAED154"><enum>(ii)</enum><text>recommended new
			 research priorities for the Office, as appropriate.</text>
						</clause></subparagraph></paragraph><paragraph id="H5ACBA81BBFC84D6B8B895B22E83BFF07"><enum>(2)</enum><header>Office of
			 scientific assessment and liaison</header>
					<subparagraph id="HBEE8A68D1E7A4D62BFCC5B7B804402C6"><enum>(A)</enum><header>Establishment</header><text>The
			 Director shall establish within the Institute an Office of Scientific
			 Assessment and Liaison (referred to in this paragraph as the
			 <term>Office</term>).</text>
					</subparagraph><subparagraph id="H695941D6B0A64A85B064B1F19F5D12F9"><enum>(B)</enum><header>Duties</header><text>The
			 Office shall—</text>
						<clause id="H540CBA0B1F4F4975B19086F01009B37B"><enum>(i)</enum><text>monitor the
			 effectiveness of the scientific expenditures by the Institute;</text>
						</clause><clause id="H5C3D60798F60495DB86C67ECF74F82C9"><enum>(ii)</enum><text>oversee the
			 coordination of research efforts of the Institute with those of other
			 programs;</text>
						</clause><clause id="H75C2807E79A04AC2BEB5CC71BCF4F957"><enum>(iii)</enum><text>assess the
			 effectiveness of programs of the Institute by evaluating—</text>
							<subclause id="H07B26B652B8B4F4FABCEEBB9E6205EE5"><enum>(I)</enum><text>the quality of the
			 science funded by the Institute, using such tools as are readily available;
			 and</text>
							</subclause><subclause id="HDB192C6F89F140F8B979BC60A07EF309"><enum>(II)</enum><text>the contributions
			 of the Institute to the national research effort, including ways in which the
			 Institute collaborates and cooperates with the Department and with other
			 Federal agencies; and</text>
							</subclause></clause><clause id="HAA1CA991BE334D158DF2FDB7C9516228"><enum>(iv)</enum><text>encourage
			 cooperative approaches among various research agencies within the Federal
			 Government.</text>
						</clause></subparagraph></paragraph><paragraph id="HBEF3D55E8D234332A3D7C53BAC41769"><enum>(3)</enum><header>Office of
			 Scientific Personnel</header>
					<subparagraph id="H250A1F4E6AD54C4EA25F53EEC51700CE"><enum>(A)</enum><header>Establishment</header><text>The
			 Director shall establish within the Institute an Office of Scientific Personnel
			 (referred to in this paragraph as the <term>Office</term>).</text>
					</subparagraph><subparagraph id="HEAA519E8889D4D1EBBD3D4ED18F52BC"><enum>(B)</enum><header>Duties</header><text>The
			 Office shall—</text>
						<clause id="H5CE51447EB0A4A6081B49900C26B1D91"><enum>(i)</enum><text>cooperate with
			 scientific and agricultural experts to assess—</text>
							<subclause id="H4A7D924166254DB0846FD003611D700"><enum>(I)</enum><text>the number of
			 scientists in agriculture and related fields in the United States; and</text>
							</subclause><subclause id="H38A0C9174B0D498F829E340431EA5C80"><enum>(II)</enum><text>how many
			 additional scientists in agriculture and related fields are needed to meet the
			 purposes of this Act; and</text>
							</subclause></clause><clause id="H7169958EE56041EEAA4EC6762C14CF42"><enum>(ii)</enum><text>generate and
			 maintain data that may assist the Director and the Council in planning
			 appropriate Institute fellowship and training programs.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H71657078228D4BF1A21D4C78F941ADAE"><enum>(4)</enum><header>Additional
			 offices</header><text>The Director may establish such additional offices within
			 the Institute as the Director or the Council determines to be necessary to
			 carry out the duties of the Institute under this Act.</text>
				</paragraph></subsection></section><section id="H9B04C2FC5CFF4B649300DCC8B8575513"><enum>6.</enum><header>Duties</header>
			<subsection id="HAA991865FE9D49C7B5916C980414C050"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Institute shall
			 provide competitive, peer-reviewed grants in accordance with section 8(b) to
			 support and promote the highest quality of fundamental agricultural research
			 and science, including grants to fund research proposals submitted by—</text>
				<paragraph id="H06BDF0C7154F419A953363E156D97128"><enum>(1)</enum><text display-inline="yes-display-inline">individual scientists;</text>
				</paragraph><paragraph id="HFD46F143B0E7477D9EB5967CCF9C776"><enum>(2)</enum><text display-inline="yes-display-inline">research centers composed of a single
			 institution or multiple institutions; and</text>
				</paragraph><paragraph id="H26D83052F20749AF9D25DE6C0612A3D"><enum>(3)</enum><text display-inline="yes-display-inline">other individuals and entities from the
			 private and public sectors, including researchers of the Department and other
			 Federal agencies.</text>
				</paragraph></subsection><subsection id="H26185278EA3E47A097B5274055CA45D9"><enum>(b)</enum><header>Report to
			 Congress</header><text>Not later than December 31, 2007, and biennially
			 thereafter, the Institute shall submit to the Secretary, the Committee on
			 Agriculture, Nutrition, and Forestry of the Senate, and the Committee on
			 Agriculture of the House of Representatives a comprehensive report that
			 describes the research funded and other activities carried out by the Institute
			 during the period covered by the report.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H542BF453412949F592A1E5EB26ABC62B"><enum>7.</enum><header>Powers</header>
			<subsection id="H6DED8D67A568468E81E9B83B39273C43"><enum>(a)</enum><header>In
			 general</header><text>The Institute shall have such authority as is necessary
			 to carry out this Act, including the authority—</text>
				<paragraph id="HCCC3C74B7A3745C19323A6B754A617A"><enum>(1)</enum><text>to
			 promulgate such regulations as the Institute considers to be necessary for
			 governance of operations, organization, and personnel;</text>
				</paragraph><paragraph id="HF567139DB33545F9BFBD45821781CC96"><enum>(2)</enum><text>to make such
			 expenditures as are necessary to carry out this Act;</text>
				</paragraph><paragraph id="H29CF96A4E80B4C5D8F46C0B35774889"><enum>(3)</enum><text>to
			 enter into contracts or other arrangements, or modifications of contracts or
			 other arrangements—</text>
					<subparagraph id="H3844C038553A4CF3A9666B16078061C7"><enum>(A)</enum><text>to provide for the
			 conduct, by organizations or individuals in the United States (including other
			 agencies of the Department, Federal agencies, and agencies of foreign
			 countries), of such fundamental agricultural research and science, or related
			 activities as the Institute considers to be necessary to carry out this Act;
			 and</text>
					</subparagraph><subparagraph id="HED059FD88D0540CAB47BA16C48B2399B"><enum>(B)</enum><text>at the request of
			 the Secretary, for the conduct of such specific fundamental agricultural
			 research and science as is in the national interest or is otherwise of critical
			 importance, as determined by the Secretary, with the concurrence of the
			 Institute;</text>
					</subparagraph></paragraph><paragraph id="HB1AFC9F7B84F413AAD4C213C8D0200C"><enum>(4)</enum><text>to
			 make advance, progress, and other payments relating to research and scientific
			 activities without regard to subsections (a) and (b) of section 3324 of title
			 31, United States Code;</text>
				</paragraph><paragraph id="HC90497049A0142D2BF1E14A7C1002D8D"><enum>(5)</enum><text>to acquire by
			 purchase, lease, loan, gift, or condemnation, and to hold and dispose of by
			 grant, sale, lease, or loan, real and personal property of all kinds necessary
			 for, or resulting from, the exercise of authority under this Act;</text>
				</paragraph><paragraph id="HA9271D278DE64EA1982E43A3B61CBE9"><enum>(6)</enum><text>to
			 receive and use donated funds, if the funds are donated without restriction
			 other than that the funds be used in furtherance of 1 or more of the purposes
			 of the Institute;</text>
				</paragraph><paragraph id="H080355BF6CBE4F93B08184A436784030"><enum>(7)</enum><text>to publish or
			 arrange for the publication of research and scientific information to further
			 the full dissemination of information of scientific value consistent with the
			 national interest, without regard to <external-xref legal-doc="usc" parsable-cite="usc/44/501">section 501</external-xref> of title 44, United States
			 Code;</text>
				</paragraph><paragraph id="HFCCBD5199D9F48A8AC73F4DFE3E2E0A"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H1C85EFABEDEB4A1192C651D65C8B5768"><enum>(A)</enum><text>to accept and use the
			 services of voluntary and uncompensated personnel; and</text>
					</subparagraph><subparagraph id="H4B26D62998F34F89BF81D6BDDDEE7D" indent="up1"><enum>(B)</enum><text>to provide such transportation and
			 subsistence as are authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United States Code,
			 for individuals serving without compensation;</text>
					</subparagraph></paragraph><paragraph id="HC3612A40084E4039B8457700671754B5"><enum>(9)</enum><text>to prescribe, with
			 the approval of the Comptroller General of the United States, the extent to
			 which vouchers for funds expended under contracts for scientific or engineering
			 research shall be subject to itemization or substantiation prior to payment,
			 without regard to the limitations of other laws relating to the expenditure and
			 accounting of public funds;</text>
				</paragraph><paragraph id="HAD74B78CE3424286A9F45DB77BBAAF3"><enum>(10)</enum><text>to arrange with
			 and reimburse the Secretary, and the heads of other Federal agencies, for the
			 performance of any activity that the Institute is authorized to conduct;
			 and</text>
				</paragraph><paragraph id="H1B9918257BBB44ADA7DBA6782EB08C4B"><enum>(11)</enum><text>to enter into
			 contracts, at the request of the Secretary, for the carrying out of such
			 specific agricultural research as is in the national interest or otherwise of
			 critical importance, as determined by the Secretary, with the consent of the
			 Institute.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFE934EF2643E47A4B1D029B65F6CE63B"><enum>(b)</enum><header>Transfer of
			 research funds of other departments or agencies</header><text display-inline="yes-display-inline">If the Committee on Agriculture, Nutrition,
			 and Forestry of the Senate, the Committee on Agriculture of the House of
			 Representatives, and any other Committees of jurisdiction are notified not less
			 than 30 days in advance of any transfer, funds available to the Secretary, or
			 any other department or agency of the Federal Government, for agricultural or
			 scientific research shall be—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H26CF9968B5FD4183816C24D0238CD7F8"><enum>(1)</enum><text>available for
			 transfer, with the approval of the Secretary or the head of the other
			 appropriate department or agency involved, in whole or in part, to the
			 Institute for use in providing grants in accordance with the purposes for which
			 the funds were made available; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD39E545B0AD844FAA245E13ECA39003C"><enum>(2)</enum><text>if so transferred,
			 expendable by the Institute for those purposes.</text>
				</paragraph></subsection><subsection id="H2DD2BE1AC9FD4DB5A92EEC2D01004558"><enum>(c)</enum><header>Restriction on
			 activities</header><text>The Institute—</text>
				<paragraph id="HB232680F8507453C00E1D4BC00C53DD3"><enum>(1)</enum><text>shall be a
			 grant-making entity only; and</text>
				</paragraph><paragraph id="H1AA8D5FF435D4C8A9F24D496F0457000"><enum>(2)</enum><text>shall not—</text>
					<subparagraph id="H0099BC3F9C854065A3CE202B09528B76"><enum>(A)</enum><text>conduct
			 fundamental agricultural research or research relating to fundamental science;
			 or</text>
					</subparagraph><subparagraph id="HFAF5F9741A3145FBA72EB0001DADD1A4"><enum>(B)</enum><text>operate any
			 laboratory or pilot facility.</text>
					</subparagraph></paragraph></subsection></section><section id="H5D9BD69520E7456EB3990915A3515745"><enum>8.</enum><header>Budget
			 considerations</header>
			<subsection id="H0DAEC9359867413FB4E51D025FAB61A5"><enum>(a)</enum><header>Budgetary
			 management goals</header><text>The Director, in coordination with the
			 Secretary, shall manage the budget of the Institute to achieve the goals
			 of—</text>
				<paragraph id="HF6FBBCC6A85C4B758DCF33AE67D6009E"><enum>(1)</enum><text>providing
			 sufficient funds over a period of time to achieve the purposes of this
			 Act;</text>
				</paragraph><paragraph id="H09A12FCC503E41E48366BCA05022AA56"><enum>(2)</enum><text>fostering
			 outstanding scientific talent, and directing that talent toward work on issues
			 relating to agriculture; and</text>
				</paragraph><paragraph id="H8FCFAA36DFBE4451875E86EDE7D4CEB"><enum>(3)</enum><text>adequately
			 reimbursing grant-receiving institutions for costs to encourage the pursuit of
			 fundamental agricultural research and science.</text>
				</paragraph></subsection><subsection id="H339FBC7B05874E20BFF4CF7C7480641B"><enum>(b)</enum><header>Budgetary
			 guidelines for grants</header>
				<paragraph id="H160B1730545F4082976D6EDA538347AF"><enum>(1)</enum><header>In
			 general</header><text>To achieve the goals described in subsection (a), the
			 Institute shall, to the maximum extent practicable, ensure that grants awarded
			 for each fiscal year comply with the guidelines described in paragraphs (2) and
			 (3).</text>
				</paragraph><paragraph id="H7D00F29C45B548F5958149106D60C899"><enum>(2)</enum><header>Project
			 grants</header><text>With respect to project grants, to the maximum extent
			 practicable—</text>
					<subparagraph id="HC6AC117F72024EC9823483644BEBF6EC"><enum>(A)</enum><text>the Institute
			 shall award approximately 1,000 new project grants annually;</text>
					</subparagraph><subparagraph id="H256D22F0463146DE9245FB4DFDE26680"><enum>(B)</enum><text>the average
			 project grant amount, including overhead, shall be approximately $225,000 for
			 each fiscal year, as adjusted in accordance with the Consumer Price Index for
			 all-urban consumers, United States city average, as published by the Bureau of
			 Labor Statistics;</text>
					</subparagraph><subparagraph id="HF4E768FD00E14FCFA4003699E5D0F0A8"><enum>(C)</enum><text>a project grant
			 shall be provided for a maximum period of 5 years, with an average award
			 duration of 3.5 years;</text>
					</subparagraph><subparagraph id="HE18081B97E4B4440B344FB9144E81A0"><enum>(D)</enum><text>the Institute shall
			 require the recipients of a project grant to submit appropriate reports on
			 research carried out using funds from the project grant; and</text>
					</subparagraph><subparagraph id="H5C35AB6491DE4CF5BE66728973C2009F"><enum>(E)</enum><text>the Institute
			 shall provide such number of training project grants as the Director or the
			 Institute determines to be appropriate.</text>
					</subparagraph></paragraph><paragraph id="H19DD91E58D634B1EB5A0FE20A0FB0933"><enum>(3)</enum><header>Multidisciplinary
			 grants</header><text>With respect to multidisciplinary grants, to the maximum
			 extent practicable—</text>
					<subparagraph id="HD696D4B616FF41568800D9F3DAE496BC"><enum>(A)</enum><text>for each of fiscal
			 years 2007 through 2010, the Institute shall provide 10 multidisciplinary
			 grants;</text>
					</subparagraph><subparagraph id="HC81B2B111E89443CB3E348C067564369"><enum>(B)</enum><text>for fiscal year
			 2011 and subsequent fiscal years, the Institute shall provide multidisciplinary
			 grants to fund not fewer than 40 research centers, on the conditions
			 that—</text>
						<clause id="H047CCCF8C87E4BD790F9043FAA89F2C"><enum>(i)</enum><text>sufficient funds
			 are available; and</text>
						</clause><clause id="H666D0A2168C04A149C096B935859ADD2"><enum>(ii)</enum><text>a
			 sufficient number of qualified research proposals are received;</text>
						</clause></subparagraph><subparagraph id="HD498EC2480D24E6FA0D43B55DFB1F3D1"><enum>(C)</enum><text>the research
			 centers provided multidisciplinary grants may be composed of a single
			 institution or multiple institutions;</text>
					</subparagraph><subparagraph id="HA054C784F44241828BA62BCCED91A46"><enum>(D)</enum><text>the average
			 multidisciplinary grant amount, including overhead, shall be approximately
			 $3,000,000 for each fiscal year, as adjusted in accordance with the Consumer
			 Price Index for all-urban consumers, United States city average, as published
			 by the Bureau of Labor Statistics;</text>
					</subparagraph><subparagraph id="H19E20B695EB4427F9E9E35AA7C4B3951"><enum>(E)</enum><text>a
			 multidisciplinary grant shall be provided for a maximum period of 5
			 years;</text>
					</subparagraph><subparagraph id="H34236116C99F47359B1E90329E3700E"><enum>(F)</enum><text>in the aggregate,
			 multidisciplinary grants provided under this paragraph for a fiscal year shall
			 represent approximately 15 percent of the total grants provided by the
			 Institute for the fiscal year, on the condition that a sufficient number of
			 qualified research proposals are received for the fiscal year; and</text>
					</subparagraph><subparagraph id="H47731BE8100941AF961EC79627502EEF"><enum>(G)</enum><text>merit review of
			 the research proposal relating to the multidisciplinary grant is conducted to
			 ensure, to the maximum extent practicable, that only quality research proposals
			 are funded.</text>
					</subparagraph></paragraph></subsection><subsection id="H6595B0C9307C4277B2A6B0E981BE827"><enum>(c)</enum><header>Indirect
			 costs</header><text>As part of a project grant or multidisciplinary grant
			 provided under this Act, the Institute shall pay indirect costs of conducting
			 research, including the costs of overhead, to the recipient of the grant at a
			 rate that is not less than any standard negotiated rate applicable to similar
			 grants made by the National Institutes of Health or the National Science
			 Foundation, as of the date of enactment of this Act, as determined by the
			 Secretary.</text>
			</subsection></section><section id="H31DF0346837640A5B7F2BF46876B154E"><enum>9.</enum><header>Funding</header>
			<subsection id="H8929BD0F0443469790AACC17CDB42BE"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The following funds, facilities, and
			 authorities of the Commodity Credit Corporation are authorized to be used to
			 carry out this Act:</text>
				<paragraph id="H02EB79A319254F8EBFA31F9942692350"><enum>(1)</enum><text>For fiscal year
			 2007, $245,000,000 for project grants, of which not more than $20,000,000 shall
			 be made available for administrative expenses incurred by the Institute.</text>
				</paragraph><paragraph id="HACD7F4227AE04A3FB7DCBE651F8F3171"><enum>(2)</enum><text>For fiscal year
			 2008, $515,000,000, of which—</text>
					<subparagraph id="H57E3647E9BB6412BA8BA07CA55ABB52"><enum>(A)</enum><text>not less than
			 $450,000,000 shall be made available for project grants;</text>
					</subparagraph><subparagraph id="HB0C4C32767F64A7DB4F37258F400286E"><enum>(B)</enum><text>not less than
			 $30,000,000 shall be made available for multidisciplinary grants; and</text>
					</subparagraph><subparagraph id="H6D9CF3D378A84E7689A6CC7CFAF73E51"><enum>(C)</enum><text>not more than
			 $35,000,000 shall be available for administrative expenses incurred by the
			 Institute.</text>
					</subparagraph></paragraph><paragraph id="H1294078BD50D475B8CF6EEA74CF90525"><enum>(3)</enum><text>For fiscal year
			 2009, $780,000,000, of which—</text>
					<subparagraph id="H3F5E677ED23D473D9EE0F826F9004D9B"><enum>(A)</enum><text>not less than
			 $675,000,000 shall be made available for project grants;</text>
					</subparagraph><subparagraph id="HB5012EA6456D40F296C900D46CD9E563"><enum>(B)</enum><text>not less than
			 $60,000,000 shall be made available for multidisciplinary grants; and</text>
					</subparagraph><subparagraph id="H3A35C4F9060043CFBCC0D63B4E2BF1FC"><enum>(C)</enum><text>not more than
			 $45,000,000 shall be made available for administrative expenses incurred by the
			 Institute.</text>
					</subparagraph></paragraph><paragraph id="H8020E73A4C8F4FDE963F2275DAD66316"><enum>(4)</enum><text>For fiscal year
			 2010, $935,000,000, of which—</text>
					<subparagraph id="H181AEBB858344B01BB29AB723D7B36BA"><enum>(A)</enum><text>not less than
			 $800,000,000 shall be made available for project grants;</text>
					</subparagraph><subparagraph id="HEE753BAD696241F681172F8F00F17291"><enum>(B)</enum><text>not less than
			 $90,000,000 shall be made available for multidisciplinary grants; and</text>
					</subparagraph><subparagraph id="H00E0F84CE1314BC0BB691FB56B3408A6"><enum>(C)</enum><text>not more than
			 $45,000,000 shall be made available for administrative expenses incurred by the
			 Institute.</text>
					</subparagraph></paragraph><paragraph id="H7A9EC91B522E448CB8941F39F304C95C"><enum>(5)</enum><text>For fiscal year
			 2011 and each fiscal year thereafter, $966,000,000, of which—</text>
					<subparagraph id="H130AA8A1FDCF42579541082300352700"><enum>(A)</enum><text>not less than
			 $800,000,000 shall be made available for project grants;</text>
					</subparagraph><subparagraph id="H9076CC7910AE448BBDC594043BC42B97"><enum>(B)</enum><text>not less than
			 $120,000,000 shall be made available for multidisciplinary grants; and</text>
					</subparagraph><subparagraph id="HB7A9E23F98C34905A91DFA835071D246"><enum>(C)</enum><text>not more than
			 $46,000,000 shall be made available for administrative expenses incurred by the
			 Institute.</text>
					</subparagraph></paragraph></subsection><subsection id="H83B4F02AEBAE49F98295712BA8BC1BAB"><enum>(b)</enum><header>Limitation</header><text>For
			 fiscal year 2011 and each subsequent fiscal year, administrative expenses paid
			 by the Institute shall not exceed 5 percent of the total expenditures of the
			 Institute for the fiscal year.</text>
