		<section id="H6E5559740F25488FBD474700CD43154E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>At-Risk
			 Youth Protection Act of 2006</quote>.</text>
		</section><section id="HFC6384B3C1AC4AF79298192795BD94FD"><enum>2.</enum><header>Grants to reduce
			 youth and gang violence</header>
			<subsection id="H5BA576119C2E43F9B2BA38CA7CF89B4"><enum>(a)</enum><header>Grants to
			 SEAs</header>
				<paragraph id="HBD67C0CC0BFA4AAE9C1C928C3D4E48E3"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Education may make grants to State
			 educational agencies for the purpose of making subgrants to alternative schools
			 or programs that agree to implement a community service requirement and thereby
			 reduce youth and gang violence.</text>
				</paragraph><paragraph id="HE53100EBE5FC40CAAD297B2F8622F6E3"><enum>(2)</enum><header>Application</header><text>To
			 seek a grant under this section, a State educational agency shall submit an
			 application to the Secretary at such time, in such manner, and containing such
			 information as the Secretary may require.</text>
				</paragraph></subsection><subsection id="HEE6A0AA257554295AE72776D201D5526"><enum>(b)</enum><header>Subgrants to
			 alternative schools or programs</header>
				<paragraph id="H99056C0E43C44EB981A7DC68E4AF37FC"><enum>(1)</enum><header>In
			 general</header><text>A State educational agency receiving a grant under this
			 section shall use the grant to make subgrants to alternative schools or
			 programs that agree to require each secondary school student enrolled in the
			 school or program—</text>
					<subparagraph id="HDB31D8DFA6C84BA58FA02D14D4B8EB7"><enum>(A)</enum><text>to perform not less
			 than 100 hours of community service each school year; and</text>
					</subparagraph><subparagraph id="HA19E43D16CD54D9DA5F82CAADA64DD9E"><enum>(B)</enum><text>to receive
			 training or counseling on conflict resolution as a prerequisite to performing
			 such community service.</text>
					</subparagraph></paragraph><paragraph id="H3D21FD8C0B0949DD9507DC06A738CA00"><enum>(2)</enum><header>Application</header><text>To
			 seek a subgrant under this section, an alternative school or program shall
			 submit an application to the State educational agency at such time, in such
			 manner, and containing such information as the Secretary may require.</text>
				</paragraph></subsection><subsection id="H3E5FB7E9868E4C0B93F27EC9BBC30000"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H8666EC99DC5347B7886BC570C49B1961"><enum>(1)</enum><text>The term
			 <term>alternative school or program</term> means a public school or program
			 designed to address student needs that typically cannot be met in regular
			 schools because the student is at risk of education failure (as indicated by
			 poor grades, truancy, disruptive behavior, pregnancy, or similar factors
			 associated with temporary or permanent withdrawal from school).</text>
				</paragraph><paragraph id="HDB524B6E32444105AC82009F7408B561"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>community service</term>
			 means a method of service learning—</text>
					<subparagraph id="H59F52A090CDA46B3AF4CCB8800685EC0"><enum>(A)</enum><text>under which the
			 student involved learns and develops through active participation in
			 thoughtfully organized and adult-supervised service that—</text>
						<clause id="H0DFD0A0CE2C344A2BE859DE91865665E"><enum>(i)</enum><text>is
			 conducted in, and meets the needs of, a community;</text>
						</clause><clause id="HCFDC0DB17F1640A497457270A5AE18E7"><enum>(ii)</enum><text>is
			 coordinated with the student’s alternative school or program, and with the
			 community; and</text>
						</clause><clause id="H8335D88B87F24FB6AF01203643CF00C5"><enum>(iii)</enum><text>helps foster
			 civic responsibility; and</text>
						</clause></subparagraph><subparagraph id="HD7F078A776C04D2EB4CBA244EB801527"><enum>(B)</enum><text>that—</text>
						<clause id="H467553FCA7084AC5A00083645D28E1AB"><enum>(i)</enum><text>is
			 integrated into and enhances the academic curriculum of the student, or the
			 educational components of the community service program in which the student is
			 enrolled; and</text>
						</clause><clause id="H766DD1F6A9B0485C9B6FFB21FFC6F77"><enum>(ii)</enum><text>provides
			 structured time for the student to reflect on the service experience.</text>
						</clause></subparagraph></paragraph><paragraph id="HC1A0E93E0A1A422CA0C0C065CE0D0DE"><enum>(3)</enum><text>The term
			 <term>institution of higher education</term> has the meaning given to that term
			 in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text>
				</paragraph><paragraph id="HBA78AD0051C44F5DBBE2EF1E6B3DC63E"><enum>(4)</enum><text>The term
			 <term>secondary school</term> has the meaning given to that term in section
			 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7801).</text>
				</paragraph><paragraph id="H4096FA44AEBC443F9B57979BEDFABA52"><enum>(5)</enum><text>The term
			 <term>Secretary</term> means the Secretary of Education.</text>
				</paragraph><paragraph id="H7E8FFECDEF854561B25C16DC8084A686"><enum>(6)</enum><text display-inline="yes-display-inline">The term <term>State educational
			 agency</term> has the meaning given to that term in section 9101 of the
			 Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
				</paragraph></subsection></section><section id="H64DA22AB81FC4D1AB89FD7B21BCCC152"><enum>3.</enum><header>Community service
			 deduction</header>
			<subsection id="H6BA4A6C9F1674473829DB9DB4E32A00"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part VI of subchapter
			 B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to itemized
			 deductions for individuals and corporations) is amended by inserting after
			 section 181 the following new section:</text>

					<section id="H93941181DF6E416F8F3F00E9169E41EE"><enum>182.</enum><header>Community
				service deduction</header>
						<subsection id="H8E9E6DA98E154A44A01C00B11DE42E1D"><enum>(a)</enum><header>Allowance of
				deduction</header><text>In the case of a business, there shall be allowed as a
				deduction an amount determined in accordance with subsection (b).</text>
						</subsection><subsection id="H9FD5BD92858C4EF1BA8243851F73F842"><enum>(b)</enum><header>Amount of
				deduction</header><text>In the case of a business, the amount determined under
				this subsection, with respect to a taxable year, is the sum of—</text>
							<paragraph id="HBF71AD96ADE64F0CABDFA2AEFA5C016E"><enum>(1)</enum><text>$750 per 100 hours
				of community service completed by a qualified student through such business
				during such taxable year, plus</text>
							</paragraph><paragraph id="HE7670488333F412B9637F841E1DEEA3E"><enum>(2)</enum><text>$2,000 per
				qualified employee employed through such business.</text>
							</paragraph></subsection><subsection id="H660814979C0C4E7C90F70900D2DD7CA9"><enum>(c)</enum><header>Dollar
				limitation</header><text display-inline="yes-display-inline">In the case of a
				business, the amount determined under subsection (b)(1), with respect to each
				qualified student completing hours of community service through such business,
				shall not exceed $1,500.</text>
						</subsection><subsection id="H7455E84749FC4F38BA48D2A6D3E27178"><enum>(d)</enum><header>Definitions</header><text>For
				purposes of this section, with respect to a taxable year—</text>
							<paragraph id="H59DAF9A8EE3D413393DFFB3808DE6778"><enum>(1)</enum><header>Qualified
				student</header><text display-inline="yes-display-inline">The term
				<term>qualified student</term> means a student enrolled in an alternative
				school or program (as defined in section 2(c) of the At-Risk Youth Protection
				Act of 2006) who performs community service through a place of business located
				not more than 20 miles from the location of the student’s alternative school or
				program in order to comply with such school or program’s community service
				requirement.</text>
							</paragraph><paragraph id="H9CD724F71A7742B89922B8FB02001047"><enum>(2)</enum><header>Qualified
				employee</header><text display-inline="yes-display-inline">With respect to a
				business, the term <term>qualified employee</term> means a graduate of an
				alternative school or program (as defined in section 2(c) of the At-Risk Youth
				Protection Act of 2006) who completes 1 year of employment through such
				business during such taxable year.</text>
							</paragraph><paragraph id="HE2B2036BAEEC497EA0CA55CEDA621D8"><enum>(3)</enum><header>Community
				service</header><text display-inline="yes-display-inline">The term
				<term>community service</term> has the meaning given to such term in section
				2(c) of the At-Risk Youth Protection Act of 2006.</text>
							</paragraph></subsection><subsection id="HD6680A0DB7BD4F93A322C41915F9F13"><enum>(e)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe such
				regulations as may be necessary or appropriate to carry out the purposes of
				this section and to ensure that the community service completed by a qualified
				student through a business that is allowed a deduction under subsection (a)
				meets the requirements described in section 2(c) of the At-Risk Youth
				Protection Act of
				2006.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD36E3109F525436FBE2301DE248E3C55"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for part VI of subchapter B of chapter 1 of such Code is amended by
			 inserting after the item relating to section 181 the following new item:</text>

			</subsection><subsection id="H61734B4FA2B34E07972CA88989F6893E"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2006.</text>
