			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>MARPOL Annex VI Implementation Act
			 of 2006</short-title></quote>.</text>
		</section><section changed="added" id="H005C2A1F7E11499CBC6DE7BA5BBFF95C" reported-display-style="italic"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Wherever in this Act an amendment or repeal
			 is expressed in terms of an amendment to or a repeal of a section or other
			 provision, the reference shall be considered to be made to a section or other
			 provision of the Act to Prevent Pollution from Ships (33 U.S.C. 1901 et
			 seq.).</text>
		</section><section changed="added" id="H777CE90F0AE642C7BA6C3BA74BE9A6E0" reported-display-style="italic"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1901">33 U.S.C. 1901(a)</external-xref>) is
			 amended—</text>
			<paragraph id="H9FEC2942309B486095322B425FF6AB4D"><enum>(1)</enum><text>by redesignating the
			 paragraphs (1) through (12) as paragraphs (2) through (13),
			 respectively;</text>
			</paragraph><paragraph id="H49B79B6CB1F84F8D9F8EA6ED576C29E0"><enum>(2)</enum><text>by inserting before
			 paragraph (2), as so redesignated, the following:</text>
				<quoted-block id="H807F736FEF9A4FDAB060C4A783927D68" style="OLC">
					<paragraph id="H34D750DD86C444A3B220DC4DA800E931"><enum>(1)</enum><text><quote>Administrator</quote>
				means the Administrator of the Environmental Protection
				Agency;</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="HB295314AF5204F4B8FCD3202CCB0DE56" reported-display-style="italic"><enum>(3)</enum><text>in paragraph (5), as so
			 redesignated, by striking <quote>and V</quote> and inserting <quote>V, and
			 VI</quote>; and</text>

			</paragraph></section><section changed="added" id="H896602A472694BF0AC7CE7FCB413A582" reported-display-style="italic"><enum>4.</enum><header>Applicability</header><text display-inline="no-display-inline">Section 3 (<external-xref legal-doc="usc" parsable-cite="usc/33/1902">33 U.S.C. 1902</external-xref>) is
			 amended—</text>
			<paragraph changed="added" id="H0C6B93CCAA8649988D49CE7D26E80095" reported-display-style="italic"><enum>(1)</enum><text>in subsection (a)—</text>
				<subparagraph id="H71030003A1A74F8FB09901FD6BD087E0"><enum>(A)</enum><text>by striking
			 <quote>and</quote> after the semicolon at the end of paragraph (3);</text>
				</subparagraph><subparagraph id="HD30582DAB8244F2600FF9B63FBF94360"><enum>(B)</enum><text>by striking the period at
			 the end of paragraph (4) and inserting <quote>; and</quote>;</text>
				</subparagraph><subparagraph id="HFB7A3CEC5F80426F8E08657DC4D13BF6"><enum>(C)</enum><text>and by adding at the end
			 the following new paragraph:</text>
					<quoted-block id="H7CD67177CEDC4412B6C8CB34B188A9BF" style="OLC">
						<paragraph id="H2605C1C765114BD5A66384022F2F7E4E"><enum>(5)</enum><text>with respect to
				Annex VI to the Convention, and to the extent consistent with international
				law, to a ship, other than a ship referred to in paragraph (1), that—</text>
							<subparagraph id="HC8CE410F0F58407CB27B31757BDA8632"><enum>(A)</enum><text>is in a port,
				shipyard, offshore terminal, or the internal waters of the United
				States;</text>
							</subparagraph><subparagraph id="H28B63A3F708C4B35AE588C260266455C"><enum>(B)</enum><text>is in the
				territorial sea of the United States as defined in Presidential Proclamation
				5928 of December 27, 1988;</text>
							</subparagraph><subparagraph id="H2FC97BA54DA64F578C0968CDB763D92C"><enum>(C)</enum><text>is in an emission
				control area designated pursuant to section 4; or</text>
							</subparagraph><subparagraph id="H4239C32DF6DF457B8600E8079B99AF88"><enum>(D)</enum><text>is bound for, or
				departing a port, shipyard, offshore terminal, or the internal waters of the
				United States; and is in any other area that the Administrator, in consultation
				with the Secretary, has designated by regulation and based on the best
				available scientific data as being an area from which emissions from ships are
				of concern with respect to protection of public health, welfare, or the
				environment.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph changed="added" id="H21B2EABBB8D24F27969553F5EF15DE82" reported-display-style="italic"><enum>(2)</enum><text>in subsection (b)(1) by
			 inserting <quote>or (3)</quote> after <quote>paragraph (2)</quote>;</text>
			</paragraph><paragraph changed="added" id="H5E50AD714BAF49A5A42BFF34B00011B" reported-display-style="italic"><enum>(3)</enum><text>in subsection (b) by
			 adding at the end the following new paragraph:</text>
				<quoted-block id="H24DE8CF1D468436ABDC3C500288701A3" style="OLC">
					<paragraph id="HFEB5AF5FBF5243D8AC26DFD7E1A300B3" indent="up1"><enum>(3)</enum><text>With respect to Annex VI to the
				Convention, the head of a Federal department or agency may determine that some
				or all of the requirements under this Act shall apply to one or more classes of
				public vessels operated under the authority of such department or
				agency.</text>
					</paragraph><after-quoted-block>; and
				</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="H1AC4317D7A9746C8B301568B452DA02D" reported-display-style="italic"><enum>(4)</enum><text>in subsection (d)—</text>
				<subparagraph id="H406B6B82F3814AA6B500DD7269E4E38"><enum>(A)</enum><text>by inserting <quote>, or
			 the Administrator as authorized by section 4,</quote> after
			 <quote>Secretary</quote>;</text>
				</subparagraph><subparagraph id="H8EA335A9C48C4A2FAFD733ACAF3E92C5"><enum>(B)</enum><text>by inserting <quote>(or
			 an applicable Annex)</quote> after <quote>MARPOL Protocol</quote> the first
			 place it appears; and</text>
				</subparagraph><subparagraph id="H5C53ACD24E6F471DBD78764358FAB6C9"><enum>(C)</enum><text>by inserting <quote>and
			 Annex VI</quote> after <quote>Annex V</quote>.</text>
				</subparagraph></paragraph></section><section changed="added" id="H2DB0B8343EAC4ADBB508D9148DC958B8" reported-display-style="italic"><enum>5.</enum><header>Administration and
			 enforcement</header><text display-inline="no-display-inline">Section 4(b) (33
			 U.S.C. 1903(b)) is amended—</text>
			<paragraph id="HA22F7C678EE543449E6233B092D5FBB2"><enum>(1)</enum><text>by redesignating
			 paragraph (2) as paragraph (4);</text>
			</paragraph><paragraph id="HE8E19E61BE014305A4197CC1B1F44964"><enum>(2)</enum><text>by inserting after
			 paragraph (1) the following new paragraphs:</text>
				<quoted-block id="H99BEFD9FB9074A958D3DBDB93137681F" style="OLC">
					<paragraph id="H456D2673308E4C728743CCDB77B6B998" indent="up1"><enum>(2)</enum><text>In prescribing regulations under this
				section to carry out the provisions of Annex VI to the Convention, the
				Secretary shall consult with the Administrator with respect to Regulations 12
				and 16 of such Annex and with the Administrator and the Secretary of the
				Interior with respect to Regulation 19 of such Annex.</text>
					</paragraph><paragraph id="H9FA3A5F6B1DB4B54B800D327682DA493" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In addition to the authority the Secretary
				has to prescribe regulations under this section to carry out Annex VI to the
				Convention, the Administrator, in consultation with the Secretary, shall
				prescribe any necessary or desired regulations to carry out Regulations 13, 14,
				15, and 18 of such Annex.</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="H7BB0D835A48344A5BCAD8589E35F72D" reported-display-style="italic"><enum>(3)</enum><text>by adding at the end the
			 following new paragraph:</text>
				<quoted-block id="H8FDA94F6FEF4485C9FA8254BD5C0C336" style="OLC">
					<paragraph id="H76DB02D64351437C999F036CFA94F342" indent="up1"><enum>(5)</enum><text>No standard issued by any person or
				Federal agency regarding emissions from tank vessels that are subject to
				Regulation 15 of Annex VI to the Convention shall be effective until six months
				after the date on which the Secretary submits a notification to the
				International Maritime Organization that such standard has been
				established.</text>
					</paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</paragraph></section><section changed="added" id="H8C2F54ED7AAB4D24002EA10091D900C6" reported-display-style="italic"><enum>6.</enum><header>Certificates</header><text display-inline="no-display-inline">Section 5 (<external-xref legal-doc="usc" parsable-cite="usc/33/1904">33 U.S.C. 1904</external-xref>) is
			 amended—</text>
			<paragraph changed="added" id="H140C2E2791984C81A412097CEB436E8D" reported-display-style="italic"><enum>(1)</enum><text>in subsection (a)—</text>
				<subparagraph id="H4270750A39B94464ABFD3CF8461D14F8"><enum>(A)</enum><text>by striking
			 <quote>The</quote> and inserting <quote>(1) Except as provided in paragraph
			 (2), the</quote>; and</text>
				</subparagraph><subparagraph id="HA051016479B84B3C9442BE32E42F9CE3"><enum>(B)</enum><text>by adding at the end the
			 following new paragraph:</text>
					<quoted-block id="H8F46848FED724A9D995200C99BCBCCF6" style="OLC">
						<paragraph id="HB14D960BE83947C9B88400E73E54BB8" indent="up1"><enum>(2)</enum><text>The Administrator shall, and no other
				person may, issue an Engine International Air Pollution Prevention Certificate
				in accordance with Annex VI to the Convention and the International Maritime
				Organization’s Technical Code on Control of Emissions of Nitrogen Oxides from
				Marine Diesel Engines, on behalf of the United States. The issuance of such
				certificates shall be consistent with any applicable requirements under the
				Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) and regulations promulgated
				thereunder.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph changed="added" id="H43ED8AE8C3304785A018A522EDD8D519" reported-display-style="italic"><enum>(2)</enum><text>by striking subsection
			 (b) and inserting the following:</text>
				<quoted-block id="H549C099C649B4D8D9604F8FEDBDFEE5E" style="OLC">
					<subsection id="H3877BAABC5E0477CB3F4B3539AB49F"><enum>(b)</enum><text>A certificate issued
				by a country that is a party to the MARPOL Protocol has the same validity as a
				certificate issued by the Secretary under the authority of this Act, or by the
				Administrator under the authority of subsection
				(a)(2).</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="HC78A3F03C89340F08796B0AD977CFDF9" reported-display-style="italic"><enum>(3)</enum><text>in subsection (e) by
			 inserting <quote>or the public health or welfare</quote> after <quote>marine
			 environment</quote>.</text>
			</paragraph></section><section changed="added" id="H1CD7AF4DE9084BCAAF839EC600AF9226" reported-display-style="italic"><enum>7.</enum><header>Reception
			 facilities</header><text display-inline="no-display-inline">Section 6 (33
			 U.S.C. 1905) is amended—</text>
			<paragraph id="H2709E86C5AD74747AA9D95EF5082BA00"><enum>(1)</enum><text>in subsection (a) by
			 adding at the end the following new paragraph:</text>
				<quoted-block id="H2DFCD40C689C41219F003F11974C4857" style="OLC">
					<paragraph id="HA9FD5747E8944E9E8EB262D5BD37D4F2" indent="up1"><enum>(3)</enum><text>The Secretary, after consulting with
				appropriate Federal agencies, shall establish regulations to require that ports
				and terminals provide reception facilities for receiving ozone depleting
				substances, equipment containing such substances, and exhaust gas cleaning
				residues or ensure that such facilities are available. The regulations shall
				establish criteria for determining the adequacy of reception facilities for
				receiving such substances, equipment, or residues at a port or terminal and
				such additional measures and requirements as are appropriate to ensure such
				adequacy.</text>
					</paragraph><paragraph id="HF507D13B731943858C00AE8C8310CDAE" indent="up1"><enum>(4)</enum><text>The Secretary may establish
				regulations to certify, and may issue certificates to the effect, that a port’s
				or terminal’s facilities for receiving such substances, equipment, and residues
				from ships are
				adequate.</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="HC2D3AE426D674276A4124FC71CD7ACD5" reported-display-style="italic"><enum>(2)</enum><text>in subsection (c)(2)(A)
			 by inserting <quote>or (a)(3)</quote> after <quote>subsection
			 (a)(2)</quote>;</text>
			</paragraph><paragraph changed="added" id="H0A22EC734B4B4CBCBC05C4207DB31DAA" reported-display-style="italic"><enum>(3)</enum><text>by striking subsection
			 (e)(2) and inserting the following:</text>
				<quoted-block id="H1D1DF60B31D34C558FF1D0CC8D543C84" style="OLC">
					<paragraph id="H9A0D13551F6F419F810251A6C57578CE" indent="up1"><enum>(2)</enum><text>The Secretary may deny the entry of a
				ship to a port or terminal required by regulations issued under this section to
				provide adequate reception facilities for garbage, ozone depleting substances,
				equipment containing such substances, and exhaust gas cleaning residues if the
				port of terminal is not in compliance with such
				regulations.</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="HDA1ED4385FCA4D82872431F917CB15C4" reported-display-style="italic"><enum>(4)</enum><text>in subsection (f)(1) by
			 striking <quote>MARPOL Protocol or the Antarctic Protocol</quote> and inserting
			 <quote>MARPOL Protocol, the Antarctic Protocol, or this Act</quote>.</text>
			</paragraph></section><section changed="added" id="H7C6B88685AAC4D2F99E93817DFAC6AD" reported-display-style="italic"><enum>8.</enum><header>Inspections</header><text display-inline="no-display-inline">Section 8(f) (<external-xref legal-doc="usc" parsable-cite="usc/33/1907">33 U.S.C. 1907(f)</external-xref>) is amended
			 to read as follows:</text>
			<quoted-block id="HDEACF9894AD64470A2FDACB7BB740000" style="OLC">
				<subsection id="H825F940C9F0F41138F15E0A357F661F4"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H38090693069C40B5A18BEE8B2FCA92A6"><enum>(1)</enum><text>The Secretary may
				inspect a ship to which this Act applies as provided under section 3(a)(5), to
				verify whether the ship is in compliance with Annex VI to the Convention and
				this Act.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="H3F4B5DBA0A124769A955AC6FCDD2BCA0" indent="up1"><enum>(2)</enum><text>If an inspection under this
				subsection or any other information indicates that a violation has occurred,
				the Secretary may undertake enforcement action under this
				section.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" id="H7073E6EB1E6A4BBA916844A64B47CE8E" reported-display-style="italic"><enum>9.</enum><header>Amendments to the
			 protocol</header><text display-inline="no-display-inline">Section 10(b) (33
			 U.S.C. 1909(b)) is amended by striking <quote>Annex I, II, or V</quote> and by
			 inserting <quote>Annex I, II, V, or VI</quote>.</text>
		</section><section changed="added" id="H1EB206F86C4E41EA81A356D344C758ED" reported-display-style="italic"><enum>10.</enum><header>Effect on other
			 laws</header><text display-inline="no-display-inline">Section 15 (33 U.S.C.
			 1911) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H219224EC73954BA8B5D0678223E44648" style="OLC">
				<section id="H64B51211DD6E47F28B4CA1CB04D3A36D"><enum>15.</enum><header>Effect on other
				laws</header><text display-inline="no-display-inline">Authorities,
				requirements, and remedies of this Act supplement and neither amend nor repeal
				any other authorities, requirements, or remedies conferred by any other
				provision of law. Nothing in this Act shall limit, deny, amend, modify, or
				repeal any other authority, requirement, or remedy available to the United
				States or any other person, except as expressly provided in this
				Act.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" id="HB93ADADC3A39465B9416B9A97CBC97FD" reported-display-style="italic"><enum>11.</enum><header>Technical
			 corrections</header><text display-inline="no-display-inline">Subsections (a),
			 (b), and (d) of section 9 (<external-xref legal-doc="usc" parsable-cite="usc/33/1908">33 U.S.C. 1908(a)</external-xref>, (b), and (d)) are amended by
			 striking the second comma after <quote>MARPOL Protocol</quote> each place it
			 appears.</text>
