<official-title display="yes">To amend the Public Health Service Act to provide for demonstration projects to carry out preventive health measures with respect to colorectal cancer.</official-title>

<section id="H5EB69C717C234688B600E69CB3108552" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Colorectal Cancer Early Detection, Prevention, and Treatment Act</short-title></quote>.</text></section> 
<section id="H7EB96AA6B1094CB2B500FCA3510042DE"><enum>2.</enum><header>Preventive health measures with respect to colorectal cancer</header><text display-inline="no-display-inline">Part B of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/243">42 U.S.C. 243 et seq.</external-xref>) is amended by inserting after section 317S the following section:</text>

<section id="HC99CD7AA920B4F528E9BE4E047C1B0BA"><enum>317T.</enum><header>Preventive health measures with respect to colorectal cancer</header> 
<subsection id="H15B0A244D87748450037DF18F302CD99"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, may make grants to public and nonprofit private entities for the purpose of carrying out not fewer than 20 demonstration projects for the following:</text> 
<paragraph id="HD63535FCE12547E186AB06CB9C68223D"><enum>(1)</enum><text>Providing screenings for colorectal cancer to individuals who—</text> 
<subparagraph id="H053E62A0335544ECB0E1DCF7FAD70000"><enum>(A)</enum><text>are 50 years of age or older; or</text></subparagraph> 
<subparagraph id="H2402A88169084ED99EC94E890886D300"><enum>(B)</enum> 
<clause id="HF19CDE64A0104DD2B9793C22FC1151FE" display-inline="yes-display-inline"><enum>(i)</enum><text>are under 50 years of age; and</text></clause> 
<clause id="H94A6CAED536C4CDFA81461F6C5B7763E" indent="up1"><enum>(ii)</enum><text>are at high risk for such cancer.</text></clause></subparagraph></paragraph> 
<paragraph id="H5041798EEF794EECA47B63DC5E84CB6F"><enum>(2)</enum><text>Providing appropriate case management and referrals for medical treatment of individuals screened pursuant to paragraph (1).</text></paragraph> 
<paragraph id="H1DC35A58B1394CE599D2E8EAE12C03F"><enum>(3)</enum><text>Ensuring the provision of the full continuum of cancer care for individuals so screened, including appropriate follow-up for abnormal tests, diagnostic and therapeutic services, and treatment for detected cancers, which continuum is, as necessary, but subject to subsection (e), provided for through the use of amounts appropriated under subsection (h).</text></paragraph> 
<paragraph id="HEE7F66DE9AE34987B75BE2331275177E"><enum>(4)</enum><text>Carrying out activities to improve the education, training, and skills of health professionals (including allied health professionals) in the detection and control of colorectal cancer, which activities are carried out pursuant to the participation of the health professionals in the projects.</text></paragraph> 
<paragraph id="H56D876B20A984498AABC319C7C52FD8E"><enum>(5)</enum><text>Evaluating the projects through appropriate surveillance or program monitoring activities.</text></paragraph> 
<paragraph id="H2B354097B32C4F32B9F6D79F0681BD56"><enum>(6)</enum><text>Developing and disseminating findings derived through such evaluations and the collection of data on outcomes.</text></paragraph> 
<paragraph id="HF0513CF105C345ACB79F72D5DB004662"><enum>(7)</enum><text>Promoting the benefits of receiving screenings through the projects.</text></paragraph> </subsection> 
<subsection id="H014D4B3D048F4F2CA1E600F317793373"><enum>(b)</enum><header>Priority for low-income, uninsured individuals</header><text display-inline="yes-display-inline">A grant may be made under subsection (a) only if the applicant involved agrees that, in providing screenings under paragraph (1) of such subsection, the applicant will give priority to low-income individuals who lack coverage under health insurance and health plans with respect to screenings for colorectal cancer.</text> </subsection> 
<subsection id="H761E77A26D4A49038C751EFDDE47E071" commented="no"><enum>(c)</enum><header>Special consideration for certain applicants</header><text>In making grants under subsection (a) for a fiscal year, the Secretary shall give special consideration to the following applicants:</text> 
<paragraph id="H5B4E54B160BA415D8476B7C4EB1DA92" commented="no"><enum>(1)</enum><text>In the case of services under such subsection for women, to applicants that, for such year, are grantees under title XV.</text></paragraph> 
<paragraph id="H7CECE3E73F6241FC8206D238C2F3B915" commented="no"><enum>(2)</enum><text>In the case of services under such subsection for men, to applicants that, for such year, are grantees under section 317D.</text></paragraph></subsection> 
<subsection id="HF562EE6E6549489FB7B41B90B0EA8083"><enum>(d)</enum><header>Use of certain standards under medicare program</header><text>A grant may be made under subsection (a) only if the applicant involved agrees as follows:</text> 
<paragraph id="H24B9EC169E684A958744417BD32FDB2"><enum>(1)</enum><text>Screenings under subsection (a)(1) will be carried out as preventive health measures in accordance with evidence-based screening procedures as specified in section 1861(pp)(1) of the Social Security Act.</text></paragraph> 
<paragraph id="H66CA308F8E5B42AEB680E86FCCAC3194"><enum>(2)</enum><text>An individual will be considered high risk for purposes of subsection (a)(1)(B)(ii) only if the individual is high risk within the meaning of section 1861(pp)(2) of such Act.</text></paragraph> 
<paragraph id="H22A8B84A0DE34EBF8FC2E063BC3FD6BD"><enum>(3)</enum><text display-inline="yes-display-inline">The payment made from the grant for a screening procedure under subsection (a)(1) will not exceed the amount that would be paid under part B of title XVIII of such Act if payment were made under such part for furnishing the procedure to an individual enrolled under such part.</text></paragraph> </subsection> 
<subsection id="H7EAE150836E74FFEA9989E015FBA8D42"><enum>(e)</enum><header>Relationship to items and services under other programs</header><text>A grant under subsection (a) may be made only if the applicant involved agrees that the grant will not be expended to make payment for any item or service to the extent that payment has been made, or can reasonably be expected to be made, with respect to such item or service—</text> 
<paragraph id="H5F8E4FBCCA564E1CB7D4287C40B4A0C8"> <enum>(1)</enum> <text>under any State compensation program, under an insurance policy, or under any Federal or State health benefits program; or</text> </paragraph> 
<paragraph id="H578043385FF348FEAEBBFF6B7273AD94"> <enum>(2)</enum> <text>by an entity that provides health services on a prepaid basis.</text> </paragraph></subsection> 
<subsection id="H131424AAE8DA4330BAEAE4EC6FFCBF"><enum>(f)</enum><header>Records and audits</header><text display-inline="yes-display-inline">A grant under subsection (a) may be made only if the applicant involved agrees that the applicant will—</text> 
<paragraph id="HE1DB3A70FB4A4F8BA0E14923A400C3ED"><enum>(1)</enum><text>establish such fiscal control and fund accounting procedures as may be necessary to ensure proper disbursal of, and accounting for, amounts received under subsection (a); and</text></paragraph> 
<paragraph id="H0E480F60E6F24848831F79466299AAE3"><enum>(2)</enum><text display-inline="yes-display-inline">upon request, provide records maintained pursuant to paragraph (1) to the Secretary or the Comptroller of the United States for purposes of auditing the expenditures of the grant by the applicant.</text></paragraph></subsection> 
<subsection id="H950EAF5C3F1A476696E94D4FBEFB400"><enum>(g)</enum><header>Reports</header><text display-inline="yes-display-inline">A grant under subsection (a) may be made only if the applicant involved agrees to submit to the Secretary such reports as the Secretary may require with respect to the grant.</text></subsection> 
<subsection id="H4AF7EA4536EC49C69960A78C4E8E06C9"><enum>(h)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out this section, there are authorized to be appropriated $50,000,000 for fiscal year 2007, and such sums as may be necessary for each of the fiscal years 2008 through 2011.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section>
