			</paragraph></section><title id="HC743385650454B0E8E10CA3B5790AD9"><enum>I</enum><header>LAND
			 DISPOSAL</header>
			<section id="H625652C378A4494F88D6C125301CE3C"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="HDD2B02CB1CA448D298CDCE21F0F2AD08"><enum>(1)</enum><header>Management
			 plan</header><text>The term <quote>management plan</quote> means the Bureau of
			 Land Management St. George Field Office Resource Management Plan.</text>
				</paragraph><paragraph id="H917631671A3845EC9C9B6CDC56BD9D8"><enum>(2)</enum><header>Special
			 account</header><text>The term <term>special account</term> means the special
			 account established under section 103(a)(4).</text>
				</paragraph></section><section id="HFB41C823B9674842A8FACCEBB2ED19F6"><enum>102.</enum><header>Conveyance of
			 public land in Washington County</header>
				<subsection id="HC13EFA1D38214F2A849965D8B678A207"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Notwithstanding
			 sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (43
			 U.S.C. 1712, 1713), the Secretary, in cooperation with the County, in
			 accordance with that Act, this title, and other applicable law and subject to
			 valid existing rights, shall—</text>
					<paragraph id="H4EFE8588CB0E444283944FC5AD308EAD"><enum>(1)</enum><text>conduct sales of
			 the land described in subsection (b)(1) to qualified bidders; and</text>
					</paragraph><paragraph id="H95EE39DB80504A839EDE891DCC05004B"><enum>(2)</enum><text>with respect to
			 the parcels of land described in subsection (b)(2)—</text>
						<subparagraph id="HA1B797DAC9E9491D9075001E06E1DE62"><enum>(A)</enum><text>conduct sales of
			 the parcels to qualified bidders as the parcels becomes available for disposal;
			 or</text>
						</subparagraph><subparagraph id="HCE31E4347FE744A491468026B5EE53BD"><enum>(B)</enum><text>at the election of
			 the Secretary, exchange the parcels of land for parcels of non-Federal land or
			 interests in non-Federal land in accordance with section 206 of the Federal
			 Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>) and other applicable
			 laws.</text>
						</subparagraph></paragraph></subsection><subsection id="H35296644E1034E73AFF76236C81C5463"><enum>(b)</enum><header>Description of
			 Land</header><text>The land referred to in subsection (a) consists of—</text>
					<paragraph id="HE2BF7D0687D445679798CFD3D5CB3234"><enum>(1)</enum><text>the land
			 identified on the Central Map as <quote>Directed Sale Lands</quote>, totaling
			 approximately 4,300 acres; and</text>
					</paragraph><paragraph id="HDCFE83080EF04298AB90023D60AC1014"><enum>(2)</enum><text>not less than
			 20,000 acres of land from the land that is identified on the Central Map and
			 the Eastern Map as <quote>Lands Eligible for Consideration Under Section 102
			 Disposal</quote>, excluding any land that is—</text>
						<subparagraph id="H7A76D4CA856A47788540E94DA38314DF"><enum>(A)</enum><text>designated as
			 wilderness by section 201(a);</text>
						</subparagraph><subparagraph id="H90BDB1FBC6B74410935732C161BCD500"><enum>(B)</enum><text>an area of
			 critical environmental concern; or</text>
						</subparagraph><subparagraph id="H381E9DDF3310490F00EC5D4447BE1935"><enum>(C)</enum><text>in the Red Cliffs
			 National Conservation Area established by section 604(a).</text>
						</subparagraph></paragraph></subsection><subsection id="HC81E1D53D35A4BE2A69339FD50402362"><enum>(c)</enum><header>Availability of
			 map and legal descriptions</header><text>The Central Map and Eastern Map shall
			 be on file and available for public inspection in (as appropriate)—</text>
					<paragraph id="H49A684B698734D649612994E00E91C88"><enum>(1)</enum><text>the Office of the
			 Director of the Bureau of Land Management;</text>
					</paragraph><paragraph id="HB382E87D1C4C4ABB99C45B44DE978403"><enum>(2)</enum><text>the Office of the
			 Utah State Director of the Bureau of Land Management; and</text>
					</paragraph><paragraph id="HB75D18DAF820404F8FFA5D7432C5BF64"><enum>(3)</enum><text>the St. George
			 Field Office of the Bureau of Land Management.</text>
					</paragraph></subsection><subsection id="HFF2BB46C3E11487C9C83965D8EF39C4B"><enum>(d)</enum><header>Joint Selection
			 Required</header><text display-inline="yes-display-inline">The Secretary and
			 the County shall jointly select which parcels of land described in subsection
			 (b)(2) to offer for sale or exchange.</text>
				</subsection><subsection id="H59EDDDFCD1464056ADC9C9E8F7FC3D1D"><enum>(e)</enum><header>Compliance With
			 Local Planning and Zoning Laws</header><text>Before a sale or exchange of land
			 under subsection (a), the County shall submit to the Secretary a certification
			 that qualified bidders have agreed to comply with—</text>
					<paragraph id="H365F24C94C45452C8DC01CB7B37FAD10"><enum>(1)</enum><text>County and city
			 zoning and other applicable ordinances; and</text>
					</paragraph><paragraph id="HD2FC4B91E67040738B59D3E789BA6EC2"><enum>(2)</enum><text>any general plan
			 for the area approved by the County, including any revisions to the general
			 plan that are adopted by the County after the date of enactment of this
			 Act.</text>
					</paragraph></subsection><subsection id="HDB858D55105146C88DA7E585A81E7E64"><enum>(f)</enum><header>Method of Sale;
			 Consideration</header><text>The sale of land under subsection (a) shall
			 be—</text>
					<paragraph id="H3703D578D6A44813AE6928B47FB00D7"><enum>(1)</enum><text>consistent with
			 subsections (d) and (f) of section 203 of the Federal Land Management Policy
			 Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1713">43 U.S.C. 1713</external-xref>);</text>
					</paragraph><paragraph id="H54C199FFD33A4F30B7FD5CCCABF64B00"><enum>(2)</enum><text>through a
			 competitive bidding process unless otherwise determined by the Secretary;
			 and</text>
					</paragraph><paragraph id="H39D65D55222148E98017E419208190FC"><enum>(3)</enum><text>for not less than
			 fair market value.</text>
					</paragraph></subsection><subsection id="H030C651419D545FDA99FA3C2BE8DFAD7"><enum>(g)</enum><header>Withdrawal</header>
					<paragraph id="HEFB249F2EFD04C9291F800C8F97E777B"><enum>(1)</enum><header>In
			 General</header><text>Subject to valid existing rights and except as provided
			 in paragraph (2), the land described in subsection (b) is withdrawn
			 from—</text>
						<subparagraph id="H0CC413B7907342650019BB73FFF7D4E"><enum>(A)</enum><text>all forms of entry
			 and appropriation under the public land laws, including the mining laws;</text>
						</subparagraph><subparagraph id="H63763FF0F4204B0DB2BB9C29022313F0"><enum>(B)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
						</subparagraph><subparagraph id="H45FAFF31A506485981C911ED4E002090"><enum>(C)</enum><text>operation of the
			 mineral leasing, geothermal leasing, and mineral materials laws.</text>
						</subparagraph></paragraph><paragraph id="HE65805ABAE214707B6B677CBCB598C9D"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
			 (1)(A) shall not apply to a competitive sale, a land exchange between the
			 United States and a non-Federal party, or an election by the County to obtain
			 the land described in subsection (b)(2) for public purposes under the Act of
			 June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes
			 Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869 et seq.</external-xref>).</text>
					</paragraph></subsection><subsection id="H0759E050B20E41389E16AB9169BC82CB"><enum>(h)</enum><header>Timing of
			 sales</header>
					<paragraph id="H17535132EFC145AE9FC6D629CE73FC00"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall—</text>
						<subparagraph id="H4DB69235B55845E6964DB1F6E6B4D906"><enum>(A)</enum><text>with respect to
			 the land described in subsection (b)(1)—</text>
							<clause id="H71B43C1CEBC94A4396E3BBE0F0B2C4FD"><enum>(i)</enum><text>not
			 later than 1 year after the date of enactment of this Act, offer for sale the
			 land identified on the Central Map as <quote>First Directed Sale</quote>;
			 and</text>
							</clause><clause id="H4FD090A278DE4581B58DD864D47FEF03"><enum>(ii)</enum><text>beginning 1 year
			 after the date of the sale of land under clause (i) and at least annually
			 thereafter until the date on which all of the parcels of land described in
			 subsection (b)(1) are sold, conduct sales of the land described in subsection
			 (b)(1), except that all of the parcels of land shall be offered for sale not
			 later than January 1, 2013; and</text>
							</clause></subparagraph><subparagraph id="HACD805BE301C446FA9086428D151F1E0"><enum>(B)</enum><text>with respect to
			 the land described in subsection (b)(2), conduct sales or exchanges—</text>
							<clause id="HB6DC4F96033148EBA74B22153B6695DD"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="HE51BDEBF4BEC48F3A3ACBC00A276292C"><enum>(I)</enum><text>not earlier than January
			 1, 2010; or</text>
								</subclause><subclause id="HFC402EC0E2C0403089234FBAB88994" indent="up1"><enum>(II)</enum><text>if the County requests an earlier date,
			 the date that is requested by the County, subject to approval by the Secretary;
			 and</text>
								</subclause></clause><clause id="H407A4CC7DE9F4074B0802991668ED24E"><enum>(ii)</enum><text>except as
			 provided in paragraph (2), at least annually thereafter until the date on which
			 all of the parcels of land described in subsection (b)(2) are sold or
			 exchanged.</text>
							</clause></subparagraph></paragraph><paragraph id="HE02213E492A142199C1600B119F9047F"><enum>(2)</enum><header>Postponement;
			 exclusion from sale</header>
						<subparagraph id="H3313DE41693F4A8DA1E5984E863EB9DE"><enum>(A)</enum><header>Request by
			 county for postponement or exclusion</header><text>At the request of the
			 County, the Secretary shall postpone or exclude from sale or exchange all or a
			 portion of the land described in subsection (b)(2).</text>
						</subparagraph><subparagraph id="H973369FD309143EE0047ACED8C6FE65"><enum>(B)</enum><header>Indefinite
			 postponement</header><text>Unless specifically requested by the County, a
			 postponement under subparagraph (A) shall not be indefinite.</text>
						</subparagraph></paragraph></subsection><subsection id="H86CF36FC443649608E5DC2033003400"><enum>(i)</enum><header>Restrictive
			 covenants</header>
					<paragraph id="HC0B11A1A4EA840DE8E90573E2026FEF3"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may include in the deed of transfer of any
			 parcel of land disposed of under this section any restrictive covenant that the
			 Secretary determines to be necessary to protect the interests of the United
			 States.</text>
					</paragraph><paragraph id="HAEAF43786EA546D8B47FCB9FA489900"><enum>(2)</enum><header>Notice</header><text>At
			 least 30 days before the date on which a land sale is to be conducted under
			 this section, the Secretary shall publish in 1 or more local newspapers a
			 notice that describes any parcels of land that would be subject to a
			 restrictive covenant.</text>
					</paragraph></subsection></section><section id="H35808F925FDE4D92BC103EF46D174253"><enum>103.</enum><header>Disposition of
			 Proceeds</header>
				<subsection id="HA285383BB6DE4894B0B5CEC71147BDB"><enum>(a)</enum><header>Disposition of
			 Proceeds</header><text>Of the gross proceeds from a sale of land described in
			 section 102(b)—</text>
					<paragraph id="H971A9B25971E4B41AA161C1490F31C78"><enum>(1)</enum><text>5
			 percent shall be paid directly to the State, for the support of schools in
			 accordance with section 9 of the Act of July 16, 1894 (28 Stat. 107, chapter
			 138);</text>
					</paragraph><paragraph id="HDE3192C4D5E44E0E9E4293D6E7DBACD"><enum>(2)</enum><text>2
			 percent shall be paid directly to the County for—</text>
						<subparagraph id="H1F134E9345EB435699CFA3698900ED00"><enum>(A)</enum><text>administrative
			 costs; and</text>
						</subparagraph><subparagraph id="H39C09E9D94EF4AEE8858B9E0074388F8"><enum>(B)</enum><text>the costs of fire
			 protection, flood control, public safety, and transportation;</text>
						</subparagraph></paragraph><paragraph id="HB2D779F9100549B5BF7CB7FC7B9E63D"><enum>(3)</enum><text>8
			 percent shall be paid directly to the Washington County Water Conservancy
			 District for water treatment, transmission facility infrastructure, and water
			 conservation in the County; and</text>
					</paragraph><paragraph id="HD6F9E62F3C174686AFEACDF412900900"><enum>(4)</enum><text>the remainder
			 shall be deposited in a special account in the Treasury of the United States
			 and shall be available without further appropriation to the Secretary until
			 expended for—</text>
						<subparagraph id="HDF287B8881A74A62945CACEC73E147E6"><enum>(A)</enum><text>the reimbursement
			 of costs incurred by the Utah State Office of the Bureau of Land Management and
			 the St. George Field Office of the Bureau of Land Management in preparing for
			 the sale of land described in section 102(b), including the costs of—</text>
							<clause id="H438B5BE0188B4188AA609D1B40119B53"><enum>(i)</enum><text>surveys;</text>
							</clause><clause id="H0138600171524A32BCAC83DCDC3176C6"><enum>(ii)</enum><text>appraisals;
			 and</text>
							</clause><clause id="H6E259674CA5C4348865E681184C07848"><enum>(iii)</enum><text>compliance
			 with—</text>
								<subclause id="HA12DC962FCBC47609DE47702808E6E44"><enum>(I)</enum><text>the National
			 Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text>
								</subclause><subclause id="HF44E04D140EB4D7C95C400E600002B5C"><enum>(II)</enum><text>sections 201 and
			 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1711">43 U.S.C. 1711</external-xref>,
			 1712);</text>
								</subclause></clause></subparagraph><subparagraph id="H6887F86A2DE5463B85EF080097DAEE9F"><enum>(B)</enum><text>conservation
			 projects within the County, including—</text>
							<clause id="H40833B7E98FF48F080C024FCA3E89EBF"><enum>(i)</enum><text>the
			 acquisition, in accordance with the Washington County Habitat Conservation Plan
			 dated December 1995, of non-Federal land for inclusion in the Red Cliffs
			 National Conservation Area established by section 604(a);</text>
							</clause><clause id="HF715EE9771B34EE4BE006B64EA6FA7D6"><enum>(ii)</enum><text>trail repair and
			 reconstruction within the Dixie National Forest;</text>
							</clause><clause id="HB1E080B140D44642A0167776A3028FCD"><enum>(iii)</enum><text>projects
			 relating to parks, trails, and natural areas; and</text>
							</clause><clause id="H8AB6C6CA6FB74EF9A7A6BF9F0087C8DB"><enum>(iv)</enum><text>other
			 conservation projects that the Secretary, after consultation with the County,
			 determine to be appropriate;</text>
							</clause></subparagraph><subparagraph id="HFD6CEEA7C35F476B8356642D62DF3CE8"><enum>(C)</enum><text>the protection and
			 management of the Red Cliffs National Conservation Area established by section
			 604(a), including the development of any necessary amendments to the management
			 plan under section 606;</text>
						</subparagraph><subparagraph id="H91A39BE9FFC04639943BA35BF2A2CF79"><enum>(D)</enum><text>processing
			 wilderness designation, including the costs of appropriate fencing, signage,
			 public education, and enforcement for the wilderness areas designated;</text>
						</subparagraph><subparagraph id="HDE610DF035C04A08B0655194AF00DF91"><enum>(E)</enum><text>establishing the
			 High Desert Off-Highway Vehicle Trail under section 501, including—</text>
							<clause id="H29B5FDE6F7AE46AAA46B4250345681B1"><enum>(i)</enum><text>completing the
			 travel plan required under section 501(b); and</text>
							</clause><clause id="HD6AC6DD218584CF0AD2F7DC1DA328235"><enum>(ii)</enum><text>developing,
			 implementing, and enforcing the management plan for the Trail developed under
			 section 501(e)(2); and</text>
							</clause></subparagraph><subparagraph id="H3F794EA2ADDD4920913E6C5F1D34AE9"><enum>(F)</enum><text>the processing of
			 public land use authorizations and rights-of-way relating to the development of
			 land conveyed under this title.</text>
						</subparagraph></paragraph></subsection><subsection id="HE6A43B73CE0040CAB017C273DB29E23D"><enum>(b)</enum><header>Investment of
			 special account</header><text>Any amounts deposited in the special account
			 shall earn interest in an amount determined by the Secretary of the Treasury on
			 the basis of the current average market yield on outstanding marketable
			 obligations of the United States of comparable maturities, and may be expended
			 according to the provisions of this section.</text>
				</subsection></section></title><title id="H14F9D8D42FED43798387D95E68756156"><enum>II</enum><header>WILDERNESS
			 AREAS</header>
			<section id="H99F1D53E6342495B904CCECD7B1175B4"><enum>201.</enum><header>Additions to
			 National Wilderness Preservation System</header>
				<subsection id="H18E27A66163A4AA19F9F00D29CE58100"><enum>(a)</enum><header>Additions</header><text>The
			 following land in the State is designated as wilderness and as components of
			 the National Wilderness Preservation System:</text>
					<paragraph id="H8E6A1CC221734CF499A15DD21354386C"><enum>(1)</enum><header>Beartrap
			 canyon</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 40 acres, as generally depicted on the
			 Eastern Map, which shall be known as the <quote>Beartrap Canyon
			 Wilderness</quote>.</text>
					</paragraph><paragraph id="H0FDCDF90CEA5433FBDF71D5C05EE2764"><enum>(2)</enum><header>Blackridge</header><text>Certain
			 Federal land managed by the Bureau of Land Management, comprising approximately
			 7,145 acres, as generally depicted on the Eastern Map, which shall be known as
			 the <quote>Blackridge Wilderness</quote>.</text>
					</paragraph><paragraph id="H58898DA6FD344D69ACE8B7E9B32E945F"><enum>(3)</enum><header>Canaan
			 mountain</header><text>Certain Federal land in the County managed by the Bureau
			 of Land Management, comprising approximately 35,344 acres, as generally
			 depicted on the Eastern Map, which shall be known as the <quote>Canaan Mountain
			 Wilderness</quote>.</text>
					</paragraph><paragraph id="H20EB0EDA6DF74D249C11893826F0C873"><enum>(4)</enum><header>Cottonwood</header><text>Certain
			 Federal land managed by the Bureau of Land Management, comprising approximately
			 11,650 acres, as generally depicted on the Central Map, which shall be known as
			 the <quote>Cottonwood Wilderness</quote>.</text>
					</paragraph><paragraph id="H0DD47C7408904526ABDA719B535515FA"><enum>(5)</enum><header>Cottonwood
			 forest</header><text>Certain Federal land managed by the Forest Service,
			 comprising approximately 2,642 acres, as generally depicted on the Central Map,
			 which shall be known as the <quote>Cottonwood Forest Wilderness.</quote></text>
					</paragraph><paragraph id="H1B16911B55284B4BBAAD32144D509F28"><enum>(6)</enum><header>Cougar
			 canyon</header><text>Certain Federal land managed by the Bureau of Land

					</paragraph><paragraph id="HF9A77E6EEAD04A49948C92EBB4B490FB"><enum>(12)</enum><header>Red
			 mountain</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 18,716 acres, as generally depicted on the
			 Central Map, which shall be known as the <quote>Red Mountain
			 Wilderness</quote>.</text>
					</paragraph><paragraph id="H53EB429D4FA64E8984DD61DF3F6EA00"><enum>(13)</enum><header>Taylor
			 creek</header><text>Certain Federal land managed by the Bureau of Land
			 Management, comprising approximately 35 acres, as generally depicted on the
			 Eastern Map, which shall be known as the <quote>Taylor Creek
			 Wilderness</quote>.</text>
					</paragraph><paragraph id="HF35EB1F8F6A14A75B556D400FA7E06EE"><enum>(14)</enum><header>Watchman</header><text>Certain
			 Federal land managed by the Bureau of Land Management, comprising approximately
			 600 acres, as generally depicted on the Eastern Map, which shall be known as
			 the <quote>Watchman Wilderness</quote>.</text>
					</paragraph><paragraph id="HAF89900C87C84C4C8373354DD4138CDB"><enum>(15)</enum><header>Zion</header>
						<subparagraph id="H57A2EA95C9664EE0BC91E10097A006C"><enum>(A)</enum><header>In
			 general</header><text>Certain Federal land in the County managed by the
			 National Park Service, comprising approximately 123,743 acres, as generally
			 depicted on the Eastern Map, which shall be known as the <quote>Zion
			 Wilderness</quote>.</text>
						</subparagraph><subparagraph id="HAB24A1DE016F4BB1A9AC9BC0D4332D11"><enum>(B)</enum><header>Subsequent
			 acquisition</header><text>Any land within Zion National Park that is
			 subsequently acquired by the National Park Service by purchase from a willing
			 seller, exchange, or donation, may become wilderness on the recommendation of
			 the Secretary, in accordance with the Wilderness Act (16 U.S.C. 1131 et
			 seq.).</text>
						</subparagraph><subparagraph id="H509F5ABF4902434EB0D17E9EBDD014B4"><enum>(C)</enum><header>Transfer of
			 bureau of land management land to national park service</header>
							<clause id="H2D16FFE682B64B378C49754F16F73251"><enum>(i)</enum><header>In
			 general</header><text>Administrative jurisdiction over approximately 1,009
			 acres of Bureau of Land Management land, as depicted on the Eastern Map, shall
			 be transferred from the Director of the Bureau of Land Management to the
			 Director of the National Park Service.</text>
							</clause><clause id="HAB08047B2268418AAC49D6F09E1FAEE3"><enum>(ii)</enum><header>Nonwilderness</header><text>Approximately
			 390 acres of the land transferred under clause (i) shall be managed by the
			 Director of the National Park Service as a nonwilderness area under the Zion
			 National Park General Management Plan of 2001 and in accordance with the Act of
			 August 25, 1916 (commonly known as the <quote>National Park Service Organic
			 Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C. 1 et seq.</external-xref>).</text>
							</clause></subparagraph><subparagraph id="HDB7D6C5B48044E85B03D444200D94CCD"><enum>(D)</enum><header>Boundary
			 adjustment</header><text>Any adjustments to the boundary of Zion National Park
			 under this paragraph shall be depicted on the Eastern Map, Central Map, or
			 Western Map, as appropriate.</text>
						</subparagraph></paragraph></subsection><subsection id="H5B745937C6C742F79D045C98CA2532DD"><enum>(b)</enum><header>Boundary</header><text>The
			 boundary of any portion of a wilderness area designated by subsection (a) that
			 is bordered by a road shall be at least 100 feet from the center line of the
			 road to allow public access.</text>
				</subsection><subsection id="H1C1BDC0E5796478B8EB058F38CC5319"><enum>(c)</enum><header>Map and legal
			 description</header>
					<paragraph id="H232B594DB20B4435A56DE3DC687D899D"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall file a map and legal description of each
			 wilderness area designated by subsection (a) with the Committee on Resources of
			 the House of Representatives and the Committee on Energy and Natural Resources
			 of the Senate.</text>
					</paragraph><paragraph id="HFDAE7884EA7E431792B963CCF503DA6"><enum>(2)</enum><header>Effect</header><text>Each
			 map and legal description shall have the same force and effect as if included
			 in this section, except that the Secretary may correct clerical and
			 typographical errors in the map or legal description.</text>
					</paragraph><paragraph id="H86C8C7D989BB42B098E09B60C3005928"><enum>(3)</enum><header>Availability</header><text>Each
			 map and legal description shall be on file and available for public inspection
			 in (as appropriate)—</text>
						<subparagraph id="H28B5D2E16ADB4DF0003FBE7F78B6C07"><enum>(A)</enum><text>the Office of the
			 Director of the Bureau of Land Management;</text>
						</subparagraph><subparagraph id="HC02084F1C86A4582A7D73FBEE83DCBFD"><enum>(B)</enum><text>the Office of the
			 Utah State Director of the Bureau of Land Management;</text>
						</subparagraph><subparagraph id="H7697EC88A07B4CBF96797F247E30A045"><enum>(C)</enum><text>the St. George
			 Field Office of the Bureau of Land Management;</text>
						</subparagraph><subparagraph commented="no" id="HAAD46D39A76945489328ECF4099EBB0"><enum>(D)</enum><text>the Dixie National
			 Forest Supervisor’s Office; and</text>
						</subparagraph><subparagraph id="H2AD575F7C45D43D78D02C390CBD92920"><enum>(E)</enum><text>the Office of the
			 Superintendent of Zion National Park.</text>
						</subparagraph></paragraph></subsection><subsection id="HDB1014D4910D46A5BA2696EA28BB32D7"><enum>(d)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, the wilderness areas designated by subsection (a) are
			 withdrawn from—</text>
					<paragraph id="H9CB4109F377D4641A027D871FEA0C2EF"><enum>(1)</enum><text>all forms of
			 entry, appropriation, and disposal under the public land laws;</text>
					</paragraph><paragraph id="H141111753918477DA0162CE64596BB9B"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</paragraph><paragraph id="H52AE4A53E564494A8D4F68D7F97301DA"><enum>(3)</enum><text>operation of the
			 mineral leasing, geothermal leasing, and mineral materials laws.</text>
					</paragraph></subsection></section><section id="HB50B6FF812D444EF87BC94D6E9009100"><enum>202.</enum><header>Administration</header>
				<subsection id="H6BF180E4268E43228DBB303044AC78E8"><enum>(a)</enum><header>Management</header><text display-inline="yes-display-inline">Subject to valid existing rights, each area
			 designated as wilderness by this title shall be administered by the Secretary
			 in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except
			 that—</text>
					<paragraph id="H535C12375EA348399B2062B3D0F57E4B"><enum>(1)</enum><text>any reference in
			 that Act to the effective date shall be considered to be a reference to the
			 date of enactment of this Act; and</text>
					</paragraph><paragraph id="H8A70219B5D934D8F9D498386B71293E7"><enum>(2)</enum><text>any reference in
			 that Act to the Secretary of Agriculture shall be considered to be a reference
			 to the Secretary of the Interior with respect to land under the jurisdiction of
			 the Secretary of the Interior.</text>
					</paragraph></subsection><subsection id="H5EE6EE331D30462B8CA2A5006498BFBD"><enum>(b)</enum><header>Livestock</header><text>Within
			 the wilderness areas designated under this title that are administered by the
			 Bureau of Land Management, the grazing of livestock in areas in which grazing
			 is established as of the date of enactment of this Act shall be allowed to
			 continue—</text>
					<paragraph id="HB5C45E2EC2A24F90A5D1B76E3521D0F3"><enum>(1)</enum><text>subject to such
			 reasonable regulations, policies, and practices that the Secretary considers
			 necessary; and</text>
					</paragraph><paragraph id="H414CBB0347B64E84818FFC2200653866"><enum>(2)</enum><text>consistent with
			 section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>), including the
			 guidelines set forth in Appendix A of House Report 101–405.</text>
					</paragraph></subsection><subsection id="HB34AB20883AF4887915518621ECD83E9"><enum>(c)</enum><header>Incorporation of
			 Acquired Land and Interests</header><text>Any land or interest in land within
			 the boundaries of an area designated as wilderness by this title that is
			 acquired by the United States after the date of enactment of this Act shall be
			 added to and administered as part of the wilderness area within which the
			 acquired land or interest is located.</text>
				</subsection><subsection id="H2BAF080F016F466000F17F0024E1006D"><enum>(d)</enum><header>Water
			 Rights</header>
					<paragraph id="HA0B034556B244F5199AAE0E1002B80D7"><enum>(1)</enum><header>Findings</header><text>Congress
			 finds that—</text>
						<subparagraph id="HCB90F9B29BE74EF9B8F4845CF1CFC5CD"><enum>(A)</enum><text>the land
			 designated as wilderness by section 201(a)—</text>
							<clause id="H6968C6B3198D49568155B00359674786"><enum>(i)</enum><text>is
			 arid in nature; and</text>
							</clause><clause id="HDF5CC3DCA57E4BA5A5FFE845E69DF"><enum>(ii)</enum><text>includes ephemeral
			 streams;</text>
							</clause></subparagraph><subparagraph id="H9F9A640F3DDA4A31B30076A395B68534"><enum>(B)</enum><text>the hydrology of
			 the land designated as wilderness by section 201(a) is locally characterized by
			 complex flow patterns and alluvial fans with impermanent channels;</text>
						</subparagraph><subparagraph id="H522DAB18134A41189ED9BC1FCB216564"><enum>(C)</enum><text>the subsurface
			 hydrogeology of the region of the wilderness is characterized by groundwater
			 subject to local and regional flow gradients and artesian aquifers;</text>
						</subparagraph><subparagraph id="H1C147428FAA8437CBB1FD2DDDC92CB2E"><enum>(D)</enum><text>the land
			 designated as wilderness is generally not suitable for use or development of
			 new water resource facilities;</text>
						</subparagraph><subparagraph id="H132FC0169BA64014A674B3E788EBC9C9"><enum>(E)</enum><text>there are no
			 actual or proposed water resource facilities and no opportunities for
			 diversion, storage, or other uses of water occurring outside the land
			 designated as wilderness that would adversely affect the wilderness or other
			 values of the land; and</text>
						</subparagraph><subparagraph id="HC761314E137C4C5BAA5F00DB5BC80806"><enum>(F)</enum><text>because of the
			 unique nature and hydrology of the desert land designated as wilderness and the
			 existence of the Virgin River Resource Management and Recovery Program, it is
			 possible to provide for proper management and protection of the wilderness,
			 perennial springs and other values of the land in ways not used in other
			 legislation.</text>
						</subparagraph></paragraph><paragraph id="HCD7ADF659ECE4314B0CA72192EAEFA86"><enum>(2)</enum><header>Statutory
			 construction</header><text>Nothing in this title—</text>
						<subparagraph id="H8816CF237B8F4E6085CCF74CD4D6B5E"><enum>(A)</enum><text>shall constitute or
			 be construed to constitute either an express or implied reservation by the
			 United States of any water or water rights with respect to the land designated
			 as wilderness by this title;</text>
						</subparagraph><subparagraph id="HAC5974A4327E4880A01399EC8865E1D6"><enum>(B)</enum><text>shall affect any
			 water rights in the State existing on the date of enactment of this Act,
			 including any water rights held by the United States;</text>
						</subparagraph><subparagraph id="H676B5C55956B4DCC8E55B066068CAD69"><enum>(C)</enum><text>shall be construed
			 as establishing a precedent with regard to any future wilderness
			 designations;</text>
						</subparagraph><subparagraph id="H18FA78D7CA304C4E97DA014EDCEBD7C9"><enum>(D)</enum><text>shall affect the
			 interpretation of, or any designation made pursuant to, any other Act;
			 or</text>
						</subparagraph><subparagraph id="H597553E8810840F0A07D2BDAEB99C0E8"><enum>(E)</enum><text>shall be construed
			 as limiting, altering, modifying, or amending any of the interstate compacts or
			 equitable apportionment decrees that apportion water among and between the
			 State and other States.</text>
						</subparagraph></paragraph><paragraph id="HDEF89AA84A564B328953A3B7B15C3024"><enum>(3)</enum><header>Utah water
			 law</header><text>The Secretary shall follow the procedural and substantive
			 requirements of the law of the State in order to obtain and hold any water
			 rights not in existence on the date of enactment of this Act with respect to
			 the wilderness areas designated by this title.</text>
					</paragraph><paragraph id="H228FB36425764980A3815D95E366B639"><enum>(4)</enum><header>New
			 projects</header>
						<subparagraph id="H3CB2768C79984F7BA54C8E0058D8F4E0"><enum>(A)</enum><header>Water resource
			 facility</header><text>As used in this paragraph, the term <quote>water
			 resource facility</quote>—</text>
							<clause id="HA3598CF21641419C95BCEFAC6CBF1800"><enum>(i)</enum><text>means irrigation
			 and pumping facilities, reservoirs, water conservation works, aqueducts,
			 canals, ditches, pipelines, wells, hydropower projects, and transmission and
			 other ancillary facilities, and other water diversion, storage, and carriage
			 structures; and</text>
							</clause><clause id="H7B28DD0E6DDB4945BA9B5B79AFDFEA97"><enum>(ii)</enum><text>does not include
			 wildlife guzzlers.</text>
							</clause></subparagraph><subparagraph id="HB7117BC08E064D87A015962BCD00A3B2"><enum>(B)</enum><header>Restriction on
			 new water resource facilities</header><text>Except as otherwise provided in
			 this title, on and after the date of enactment of this Act, neither the
			 President nor any other officer, employee, or agent of the United States shall
			 fund, assist, authorize, or issue a license or permit for the development of
			 any new water resource facility within the wilderness areas designated by this
			 title.</text>
						</subparagraph></paragraph></subsection><subsection id="H058545D9660D455AB8A21C229C7BCC86"><enum>(e)</enum><header>Military
			 overflights</header><text>Nothing in this title precludes or restricts—</text>
					<paragraph id="HA157C3B93FAD4A978E9D4BD5003FDEDD"><enum>(1)</enum><text>low-level
			 overflights and operations of military aircraft, helicopters, missiles, or
			 unmanned aerial vehicles over wilderness areas designated under this title,
			 including military overflights and operations that can be seen or heard within
			 the wilderness areas;</text>
					</paragraph><paragraph id="H0C5352A6F6884E6EB9331FBFE0EA3242"><enum>(2)</enum><text>flight testing and
			 evaluation; or</text>
					</paragraph><paragraph id="H14A308CF18A94CC4A8F3E91B16C1DA1"><enum>(3)</enum><text>the designation or
			 creation of new units of special use airspace, or the establishment of military
			 flight training routes over the wilderness areas designated under this
			 title.</text>
					</paragraph></subsection></section><section id="HBD91F03594CA4DFF906CEC839C64C28F"><enum>203.</enum><header>Adjacent
			 Management</header>
				<subsection id="H87896AB7DA274C878D32F00054882296"><enum>(a)</enum><header>In
			 general</header><text>Congress does not intend for the designation of
			 wilderness in the State pursuant to this title to lead to the creation of
			 protective perimeters or buffer zones around any such wilderness area.</text>
				</subsection><subsection id="H23D22816C3A4495C870300DE838F1B00"><enum>(b)</enum><header>Nonwilderness
			 Activities</header><text display-inline="yes-display-inline">The fact that
			 nonwilderness activities or uses can be seen or heard from areas within a
			 wilderness designated under this title shall not preclude the conduct of those
			 activities or uses outside the boundary of the wilderness area.</text>
				</subsection></section><section id="H60262199431845E7A763F3FFCF3B8D3"><enum>204.</enum><header>Native American
			 cultural and religious uses</header><text display-inline="no-display-inline">Nothing in this title diminishes—</text>
				<paragraph id="H07A7722AD7944A348586334423819538"><enum>(1)</enum><text>the rights of any
			 Indian tribe; or</text>
				</paragraph><paragraph id="HC86A337D9016472C00953B1D69C1F31C"><enum>(2)</enum><text>any tribal rights
			 regarding access to Federal land for tribal activities, including spiritual,
			 cultural, and traditional food-gathering activities.</text>
				</paragraph></section><section id="H4DA46CE579134D1BAD1E7C8BF5FE164"><enum>205.</enum><header>Release of
			 wilderness study areas</header>
				<subsection id="H6655789D533D4A6F850071A9993297C3"><enum>(a)</enum><header>Finding</header><text>Congress
			 finds that, for the purposes of section 603 of the Federal Land Policy and
			 Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782</external-xref>), any public land in the County
			 administered by the Bureau of Land Management in the wilderness study areas
			 that is not designated as wilderness by section 201(a) or depicted as released
			 on the Central Map, Eastern Map, or Western Map has been adequately studied for
			 wilderness designation.</text>
				</subsection><subsection id="H31BE1016BA8E4C6EAC84F1D517D8B5FC"><enum>(b)</enum><header>Release</header><text>Any
			 public land described in subsection (a) that is not designated as wilderness by
			 this title—</text>
					<paragraph id="H7D7A0EDC35604B9ABBDA925F575C8388"><enum>(1)</enum><text>is no longer
			 subject to section 603(c) of the Federal Land Policy and Management Act of 1976
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>);</text>
					</paragraph><paragraph id="HCE428296DE06440F9B4FFA5FAB7F405D"><enum>(2)</enum><text>shall be managed
			 in accordance with—</text>
						<subparagraph id="HBA76E792C6C446E8933C1C5B2510AFA5"><enum>(A)</enum><text>land management
			 plans adopted under section 202 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); and</text>
						</subparagraph><subparagraph id="H9046C32F321C4E34ACD9F2388101974"><enum>(B)</enum><text>existing
			 cooperative conservation agreements; and</text>
						</subparagraph></paragraph><paragraph id="H617BE9901DB6437585745FC72CF8CC51"><enum>(3)</enum><text>shall be subject
			 to the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text>
					</paragraph></subsection></section><section id="HBB3789A94D754BF19300911F4238BFCD"><enum>206.</enum><header>Wildlife
			 management</header>
				<subsection id="H4EC57F3A19EC43A9B83497C99B9F6E05"><enum>(a)</enum><header>In
			 General</header><text>In accordance with section 4(d)(7) of the Wilderness Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this title affects or diminishes the
			 jurisdiction of the State with respect to fish and wildlife management,
			 including the regulation of hunting, fishing, and trapping, in the wilderness
			 areas designated by this title.</text>
				</subsection><subsection id="H6309E6A515B040EC8042D5EB95A3BCA"><enum>(b)</enum><header>Management
			 Activities</header><text>In furtherance of the purposes and principles of the
			 Wilderness Act, management activities to maintain or restore fish and wildlife
			 populations and the habitats to support such populations may be carried out
			 within wilderness areas designated by this title where consistent with relevant
			 wilderness management plans, in accordance with appropriate policies such as
			 those set forth in Appendix B of House Report 101–405, including the occasional
			 and temporary use of motorized vehicles, if such use, as determined by the
			 Secretary, would promote healthy, viable, and more naturally distributed
			 wildlife populations that would enhance wilderness values and accomplish those
			 purposes with the minimum impact necessary to reasonably accomplish the
			 task.</text>
				</subsection><subsection id="H3200353D90A64F1D91DC38F72E551D45"><enum>(c)</enum><header>Existing
			 Activities</header><text>Consistent with section 4(d)(1) of the Wilderness Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)</external-xref>) and in accordance with appropriate policies such as those
			 set forth in Appendix B of House Report 101–405, the State may continue to use
			 aircraft, including helicopters, to survey, capture, transplant, monitor, and
			 provide water for wildlife populations.</text>
				</subsection><subsection id="H431E53180F3D488DA80498CB8455B957"><enum>(d)</enum><header>Wildlife Water
			 Development Projects</header><text>Subject to subsection (f), the Secretary
			 shall authorize structures and facilities, including existing structures and
			 facilities, for wildlife water development projects, including guzzlers, in the
			 wilderness areas designated by this title if—</text>
					<paragraph id="H7E35C58159DA4C09B8ECC4500000ABF3"><enum>(1)</enum><text>the structures and
			 facilities will, as determined by the Secretary, enhance wilderness values by
			 promoting healthy, viable, and more naturally distributed wildlife populations;
			 and</text>
					</paragraph><paragraph id="H4B4653825754418CB0D1ADAAEDA1D44"><enum>(2)</enum><text>the visual impacts
			 of the structures and facilities on the wilderness areas can reasonably be
			 minimized.</text>
					</paragraph></subsection><subsection id="HED76AEA8CC6941EDA1EF7BC73844ACE0"><enum>(e)</enum><header>Hunting,
			 Fishing, and Trapping</header><text>In consultation with the appropriate State
			 agency (except in emergencies), the Secretary may designate by regulation areas
			 in which, and establish periods during which, for reasons of public safety,
			 administration, or compliance with applicable laws, no hunting, fishing, or
			 trapping will be permitted in the wilderness areas designated by this
			 title.</text>
				</subsection><subsection id="HBC038FF7D570457EB37E3E98DE80A56C"><enum>(f)</enum><header>Cooperative
			 Agreement</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Secretary shall enter into a cooperative agreement with the State
			 that specifies the terms and conditions under which the State or a designee of
			 the State may carry out wildlife management activities in the wilderness areas
			 designated by this title.</text>
				</subsection></section><section id="HB471FCCD783D4591B2F844CDF08ECE25"><enum>207.</enum><header>Wildfire
			 management</header><text display-inline="no-display-inline">Consistent with
			 section 4 of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133</external-xref>), nothing in this title
			 precludes a Federal, State, or local agency from conducting wildfire and
			 management operations (including operations using aircraft or mechanized
			 equipment) to manage wildfires in the wilderness areas designated by this
			 title.</text>
			</section><section id="H85FAFE973D874025A1C8E861FE6B86D"><enum>208.</enum><header>Climatological
			 data collection</header><text display-inline="no-display-inline">Subject to
			 such terms and conditions as the Secretary may prescribe, nothing in this title
			 precludes the installation and maintenance of hydrologic, meteorologic, or
			 climatological collection devices in the wilderness areas designated by this
			 title if the facilities and access to the facilities are essential to flood
			 warning, flood control, and water reservoir operation activities.</text>
			</section><section id="H7BEBE38FD5F746519C5CF7F699DE5499"><enum>209.</enum><header>National Park
			 Service land</header><text display-inline="no-display-inline">To the extent any
			 of the provisions of this title conflict with the laws applicable to the
			 National Park Service for Zion National Park, the laws shall control.</text>
			</section></title><title id="HF555BA9EFA124145998C7254BADCF98D"><enum>III</enum><header>WILD AND SCENIC
			 RIVER DESIGNATION </header>
			<section id="HB3DACBDD12094192B365902BD71E5B94"><enum>301.</enum><header>Zion National
			 Park Wild and Scenic Rivers</header>
				<subsection id="HB0C7E984B99649ADAD15B3408CD90041"><enum>(a)</enum><header>Designation</header><text>Section

				</subsection><subsection id="HFE7A4BA33B2D4AE28B8CD2F3F888FEFE"><enum>(b)</enum><header>Incorporation of
			 acquired non-Federal land</header><text>If the United States acquires any
			 non-Federal land within or adjacent to Zion National Park that includes a river
			 segment that is contiguous to a river segment of the Virgin River designated as
			 a wild, scenic, or recreational river by paragraph (167) of section 3(a) of the
			 Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>), the acquired river segment
			 shall be incorporated in, and be administered as part of, the applicable wild,
			 scenic, or recreational river.</text>
				</subsection></section></title><title id="HE8D0986A60564DFFBAC7DBFA348D7473"><enum>IV</enum><header>UTILITY
			 CORRIDORS</header>
			<section id="H3BB7534BDB634C49BD2D8E50C416575F"><enum>401.</enum><header>Utility
			 corridors and rights-of way</header>
				<subsection id="HADEADC883C9D4D73913FBB651954856F"><enum>(a)</enum><header>Utility
			 Corridor</header>
					<paragraph id="H5D8F49BFEDB14E8B92E7B83DDC4BC479"><enum>(1)</enum><header>In
			 general</header><text>Consistent with title II and notwithstanding sections 202
			 and 503 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>,
			 1763), the Secretary shall establish on public land—</text>
						<subparagraph id="HE700CDB6F83F495292B717D56ED9400"><enum>(A)</enum><text>corridors for
			 utilities, water infrastructure, and transportation purposes, in the County, as
			 generally depicted on the Central Map, Eastern Map, and Western Map; and</text>

			 transportation purposes in the County, to be identified by the Secretary,
			 after—</text>
							<clause id="H436FB5AD98134EA0AC55CCB88FF9F2F8"><enum>(i)</enum><text>consultation with
			 the County and the Habitat Conservation Advisory Committee;</text>
							</clause><clause id="H4F2360C38AAF41B8854781B2FE2288A6"><enum>(ii)</enum><text>complying with
			 the <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text>
							</clause><clause id="H0F32BAC957F44582A200C3E0161F8D0"><enum>(iii)</enum><text>evaluating, at a
			 minimum—</text>
								<subclause id="H9E860EA1B58E4B35BA5993ACCE756D9"><enum>(I)</enum><text>a
			 corridor within the Red Cliffs National Conservation Area established by
			 section 604(a), beginning on the western boundary of the Conservation Area at a
			 point, to be identified by the Secretary, between Diamond Valley and Winchester
			 Hills, and ending on the eastern boundary of the Conversation Area at a point,
			 to be identified by the Secretary, between milepost 10 and milepost 16 of
			 Interstate 15; and</text>
								</subclause><subclause id="H32281555165245449291D0A92CC25F65"><enum>(II)</enum><text>a corridor
			 outside the Red Cliffs National Conservation Area.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="H7C8FB304525147CCA5BAD6ED97BBCE29"><enum>(2)</enum><header>Width</header><text>The
			 utility corridors established under paragraph (1) shall be—</text>
						<subparagraph id="H9754F6D20624481CB1F6C9D32596A6B1"><enum>(A)</enum><text>2,640-feet wide;
			 or</text>
						</subparagraph><subparagraph id="H5ED442331C284508BD5B768FE405C8E9"><enum>(B)</enum><text>if the St. George
			 Field Office Resource Management Plan of 1999 provides for a width other than
			 2,640 feet in a particular portion of the corridor, the width provided by the
			 Plan for the particular portion.</text>
						</subparagraph></paragraph></subsection><subsection id="HF62BDED0F7D04601973F8E426074764C"><enum>(b)</enum><header>Rights-of-Way</header>
					<paragraph id="H3966A7E2D0674D329CA5F6E911DC4702"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding sections 202 and 503 of the Federal Land
			 Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1763), and subject to valid
			 and existing rights, the Secretary shall grant to the County and the Washington
			 County Water Conservancy District nonexclusive rights-of-way to nonwilderness
			 Federal land in the County, as generally depicted on the Central Map and
			 Eastern Map, for any reservoirs, canals, channels, ditches, pipes, pipelines,
			 tunnels, wells, well fields, pump stations, storage facilities, and other
			 facilities and systems that are necessary for—</text>
						<subparagraph id="H9266429211344B3EA1AB00EB00D88547"><enum>(A)</enum><text>the impoundment,
			 storage, treatment, transportation, or distribution of water or wastewater;
			 or</text>
						</subparagraph><subparagraph id="HA6067846D7CB489D904CC2805B44CA99"><enum>(B)</enum><text>flood control
			 management.</text>
						</subparagraph></paragraph><paragraph id="H05AA36059EA442BA83E71D2306DAB61D"><enum>(2)</enum><header>Applicable
			 requirements</header><text>Any right-of-way granted under paragraph (1) shall
			 be consistent with any general plan adopted by the County.</text>
					</paragraph><paragraph id="H90294CD8EBA4411E99167046C1426964"><enum>(3)</enum><header>Duration; waiver
			 of fees</header><text>A right-of-way granted under paragraph (1)—</text>
						<subparagraph id="H5E65855891264E85BD5FC20836A00051"><enum>(A)</enum><text>shall be valid in
			 perpetuity; and</text>
						</subparagraph><subparagraph id="HB15C03D45B724C95862FCF262BB71C9C"><enum>(B)</enum><text>shall not require
			 the payment of rental fees.</text>
						</subparagraph></paragraph><paragraph id="H9E68DED853F5403695CC22BF56497F5D"><enum>(4)</enum><header>Compliance with
			 NEPA</header><text>Before granting a right-of-way under paragraph (1), the
			 Secretary shall comply with the National Environmental Policy Act of 1969 (42
			 U.S.C. 4321 et seq.), including the identification of potential impacts to fish
			 and wildlife resources and habitat.</text>
					</paragraph></subsection><subsection id="H815D1325C6C2467EA90300048EE29779"><enum>(c)</enum><header>State Water
			 Law</header><text>Nothing in this title shall—</text>
					<paragraph id="HAABB0E0CBEE84AE9B199C4BCF686FDA"><enum>(1)</enum><text>prejudice the
			 decisions or abrogate the jurisdiction of the Utah State Engineer with respect
			 to the appropriation, permitting, certification, or adjudication of water
			 rights;</text>
					</paragraph><paragraph id="H462B72D0569146F7B2C4BB062AD46F4"><enum>(2)</enum><text>preempt State water
			 law; or</text>
					</paragraph><paragraph id="H5CA825951DB246E2B944555BD1A8E7E8"><enum>(3)</enum><text>limit or supersede
			 existing water rights or interest in water rights under State law.</text>
					</paragraph></subsection><subsection id="HF4729ED330BC447EBF7EFF9FA53C3C07"><enum>(d)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, the areas designated as utility corridors or
			 rights-of-way by subsections (a) and (b) are withdrawn from location, entry,
			 and patent under the mining laws.</text>
				</subsection></section></title><title id="H8D76AF7D996E4C099EC7CB4CA00316E1"><enum>V</enum><header>HIGH
			 DESERT OFF-HIGHWAY VEHICLE TRAIL</header>
			<section id="H7568BB4A82A64309ACB1601E735374AB"><enum>501.</enum><header>High Desert
			 Off-Highway Vehicle Trail</header>
				<subsection id="H2E95FE16EEB845659ED30029F1E9B354"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="H39FDDB66C9EC4CB2AE28BB9BCEBCA538"><enum>(1)</enum><header>Trail</header><text>The
			 term <term>Trail</term> means the High Desert Off-Highway Vehicle Trail
			 designated under subsection (c).</text>
					</paragraph><paragraph id="H6BD070EB2EBA4DE2A8AC96474BA4C17F"><enum>(2)</enum><header>Travel
			 plan</header><text>The term <term>travel plan</term> means the travel plan
			 developed under subsection (b).</text>
					</paragraph></subsection><subsection id="HF73C39FC4905488CBCE1EC76795F84DC"><enum>(b)</enum><header>Travel
			 plan</header><text>Not later than 2 years after the date of enactment of this
			 Act, the Secretary and the Secretary of Agriculture shall jointly complete a
			 travel plan that identifies routes for the Trail.</text>
				</subsection><subsection id="HFA5A06E0E9904E84A043351F95238BAB"><enum>(c)</enum><header>Designation of
			 Trail</header><text>Not later than 30 days after the date on which the travel
			 plan is completed under subsection (b), the Secretary and the Secretary of
			 Agriculture shall jointly designate a system of trails, identified in the
			 travel plan, to be known as the <quote>High Desert Off-Highway Vehicle
			 Trail</quote>.</text>
				</subsection><subsection id="H210160CDB1C44D63A83439A352E26201"><enum>(d)</enum><header>Requirements</header><text>To
			 be eligible for inclusion in the Trail, a route shall be—</text>
					<paragraph id="H52A38F917E7748C78DA1FB011F7FDD68"><enum>(1)</enum><text>open to motorized
			 and mechanized uses on and after the date of enactment of this Act; and</text>
					</paragraph><paragraph id="H2F5E75B4044740C8AA37D900665458F1"><enum>(2)</enum><text>located on land
			 managed by the Director of the Bureau of Land Management or the Chief of the
			 Forest Service.</text>
					</paragraph></subsection><subsection id="HD2A34F4E13AE400B9D47BC87D705B571"><enum>(e)</enum><header>Management</header>
					<paragraph id="H30776EFD2C5E496FA09C63A4C6DBE400"><enum>(1)</enum><header>In
			 general</header><text>The Secretary or the Secretary of Agriculture shall
			 manage portions of the Trail under the jurisdiction of the Secretary or the
			 Secretary of Agriculture, as appropriate, in a manner that—</text>
						<subparagraph id="H3FF24B20D21B4791B9C3206F5B1F1190"><enum>(A)</enum><text>is consistent with
			 motorized and mechanized use of the Trail that is authorized on the date of
			 enactment of this Act pursuant to applicable Federal and State laws and
			 regulations;</text>
						</subparagraph><subparagraph id="H006628F3FC9F4DD30059001200700834"><enum>(B)</enum><text>ensures the safety
			 of the people who use the Trail; and</text>
						</subparagraph><subparagraph id="H5CDF32A4945B4920B1269D32F5946802"><enum>(C)</enum><text>does not damage
			 sensitive habitat or cultural resources.</text>
						</subparagraph></paragraph><paragraph id="HA3B8C378CAD341ECA748D8306DDDEA30"><enum>(2)</enum><header>Management
			 plan</header>
						<subparagraph id="HA5280EE53A924B54958577FBA4AFA8C3"><enum>(A)</enum><header>In
			 general</header><text>Not later than 2 years after the date on which the travel
			 plan is completed under subsection (b), the Secretary and the Secretary of
			 Agriculture, in consultation with the State, the County, and any other
			 interested persons, shall jointly complete a management plan for the Trail that
			 includes a description of the routes identified in the travel plan for
			 inclusion in the Trail.</text>
						</subparagraph><subparagraph id="HAF9F689D5D51446E82E6A4FD7DB70039"><enum>(B)</enum><header>Components</header><text>The
			 management plan shall—</text>
							<clause id="H1FBB90A87C0A48A7A91F003B27F0A295"><enum>(i)</enum><text>describe the
			 appropriate uses and management of the Trail;</text>
							</clause><clause id="H5D8E2083A9C6495C8810A91733B56D00"><enum>(ii)</enum><text>authorize the use
			 of motorized and mechanized vehicles on the Trail; and</text>
							</clause><clause id="HF18F98C4E8784D69B7A9F6CEAD476B58"><enum>(iii)</enum><text>describe actions
			 carried out to periodically evaluate and manage the appropriate levels of use
			 and location of the Trail to minimize environmental impacts and prevent damage
			 to cultural resources from the use of the Trail.</text>
							</clause></subparagraph></paragraph><paragraph id="H5040DB6086004D5FB9C600B0E5F7875B"><enum>(3)</enum><header>Monitoring and
			 evaluation</header>
						<subparagraph id="H7D08A76D45D941DFA1B9C45324D38D5"><enum>(A)</enum><header>Annual
			 assessment</header><text>The Secretary and the Secretary of Agriculture shall
			 annually assess the effects of the use of off-highway vehicles on the Trail on
			 land and, in consultation with the Utah Department of Natural Resources, assess
			 the effects of the Trail on wildlife and wildlife habitat to minimize
			 environmental impacts and prevent damage to cultural resources from the use of
			 the Trail.</text>
						</subparagraph><subparagraph id="HFD202FF6E2714E12B965EC4CEFEEA48D"><enum>(B)</enum><header>Closure</header><text>Subject
			 to valid existing rights, the Secretary and the Secretary of Agriculture, as
			 appropriate, in consultation with the State and the County, may temporarily
			 close or permanently reroute, subject to subparagraph (C), a portion of the
			 Trail if the Secretary determines that—</text>
							<clause id="HE71C660971CB43F0A5CC1D1026FC4C"><enum>(i)</enum><text>the
			 Trail is having an adverse impact on—</text>
								<subclause id="H8D12A51BE74D484397BCEB00F051D0B6"><enum>(I)</enum><text>natural resources;
			 or</text>
								</subclause><subclause id="H41DEBEEE02D5473A90942526BE77F151"><enum>(II)</enum><text>cultural
			 resources;</text>
								</subclause></clause><clause id="H8160905EF4BB468FBCD0D995A400EE33"><enum>(ii)</enum><text>the
			 Trail threatens public safety;</text>
							</clause><clause id="H04371659FA24461DB937C713B633B2D1"><enum>(iii)</enum><text>closure of the
			 Trail is necessary to repair damage to the Trail; or</text>
							</clause><clause id="HB5F7A91D2BD74071A7CC8B00406E6CF1"><enum>(iv)</enum><text>closure of the
			 Trail is necessary to repair resource damage.</text>
							</clause></subparagraph><subparagraph id="HA891277B958A47DB8F9DD47388412D05"><enum>(C)</enum><header>Rerouting</header><text>Portions
			 of the Trail that are temporarily closed may be permanently rerouted along
			 existing roads and trails on public land currently open to motorized use if the
			 Secretary determines, after consultation with the Utah Department of Natural
			 Resources, that such rerouting will not significantly increase or decrease the
			 length of the Trail.</text>
						</subparagraph><subparagraph id="H3BD4A37ABFF943C29D8B205E2DF9BD08"><enum>(D)</enum><header>Notice</header><text>The
			 Secretary and the Secretary of Agriculture shall provide information to the
			 public regarding any routes on the Trail that are closed under subparagraph
			 (B), including by providing appropriate signage along the Trail.</text>
						</subparagraph></paragraph><paragraph id="HFAB742EE267F4594A442538E4D18B2DE"><enum>(4)</enum><header>Notice of open
			 routes</header><text>The Secretary and the Secretary of Agriculture shall
			 ensure that visitors to the Trail have access to adequate notice regarding the
			 routes on the Trail that are open through use of appropriate signage along the
			 Trail and through the distribution of maps, safety education materials, and
			 other information considered appropriate by the Secretary and the Secretary of
			 Agriculture.</text>
					</paragraph></subsection><subsection id="H1E1B3B1FD0704E38A8810573B7B2E404"><enum>(f)</enum><header>No Effect on
			 Non-Federal Land and Interests in Land</header><text>Nothing in this section
			 shall be construed to affect ownership, management, or other rights related to
			 non-Federal land or interests in land.</text>
				</subsection><subsection id="H300F5B62CD92424FBD3F81B2DDAB76E"><enum>(g)</enum><header>Map on
			 File</header><text>The appropriate maps shall be kept on file at the
			 appropriate offices of the Secretary and the Secretary of Agriculture.</text>
				</subsection></section></title><title id="HCF390A87EAB54C28B5C26CD1AFC857E9"><enum>VI</enum><header>RED
			 CLIFFS NATIONAL CONSERVATION AREA</header>
			<section id="HBD268882ABDE4636813E6591A77C9502"><enum>601.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote>Red Cliffs National Conservation Area Act</quote>.</text>
			</section><section id="HA51B75A6634A4CAC935BF5437771FECA"><enum>602.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to establish
			 the Red Cliffs National Conservation Area—</text>
				<paragraph id="H1B17E115AFB14AC596DDB9F2D867C500"><enum>(1)</enum><text>to conserve,
			 protect, and enhance for the benefit and enjoyment of present and future
			 generations the ecological resources, wildlife, endangered species, and
			 recreational resources of the Conservation Area, in accordance with the
			 management plan; and</text>
				</paragraph><paragraph id="HC7157A27A28D44B9A13EAD22E4ACC64"><enum>(2)</enum><text>to
			 serve the needs of communities in the vicinity of the Conservation Area, in
			 accordance with the management plan.</text>
				</paragraph></section><section id="H4FD471D3207B4C96BFE0B01B3321DF00"><enum>603.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="HCC38097929464D94A55B031964F59BDE"><enum>(1)</enum><header>Conservation
			 area</header><text>The term <term>Conservation Area</term> means the Red Cliffs
			 National Conservation Area established by section 604(a).</text>
				</paragraph><paragraph id="HDF50038609CE4C9C95E08C32F9F82557"><enum>(2)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means—</text>
					<subparagraph id="HAFB059945CDE4EA5A534C563F01D0000"><enum>(A)</enum><text>the management
			 plan entitled the <quote>Washington County Habitat Conservation Plan</quote>
			 and dated December 1995, as approved by the Director of the United States Fish
			 and Wildlife Service on February 23, 1996; and</text>
					</subparagraph><subparagraph id="HEFECD19956BE41F1BE77E45EB9A6006C"><enum>(B)</enum><text>the St. George
			 Field Office Resource Management Plan of March 15, 1999.</text>
					</subparagraph></paragraph><paragraph id="H3BA6FCE71BF443CFA25324CEBDE8F7D"><enum>(3)</enum><header>Public
			 land</header><text>The term <term>public land</term> has the meaning given the
			 term <quote>public lands</quote> in section 103 of the Federal Land Policy and
			 Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text>
				</paragraph></section><section id="H025E85F5F85747A9BF8FFD9CF7DC27E1"><enum>604.</enum><header>Establishment
			 of the Conservation Area</header>
				<subsection id="H6423FF0A213848689E437E1100DCD031"><enum>(a)</enum><header>In
			 General</header><text>There is established in the State the Red Cliffs National
			 Conservation Area.</text>
				</subsection><subsection id="H9E026D7209DB4ED089D464506C15AB00"><enum>(b)</enum><header>Area
			 Included</header><text>The Conservation Area shall consist of approximately
			 61,473 acres of public land, as generally depicted on the Central Map.</text>
				</subsection><subsection id="H06D47C6A0E084C0D90937030822521E2"><enum>(c)</enum><header>Map and Legal
			 Description</header>
					<paragraph id="H0C81BA6494ED4482AB0154BDEB12D7E8"><enum>(1)</enum><header>Map</header><text>The
			 Central Map shall be on file and available for public inspection in the
			 appropriate offices of the Bureau of Land Management.</text>
					</paragraph><paragraph id="H19E005AC9DFC484A881961A99B3B9ED4"><enum>(2)</enum><header>Legal
			 description</header>
						<subparagraph id="HDBC6EF4E0CA8477FA5A4042D77CA5B5"><enum>(A)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Resources of the House of
			 Representatives a legal description of the Conservation Area.</text>
						</subparagraph><subparagraph id="HA71BCFE05A3449D5B4085F1260D1DAF8"><enum>(B)</enum><header>Force and
			 effect</header><text>The legal description submitted under subparagraph (A)
			 shall have the same force and effect as if included in this Act, except that
			 the Secretary may—</text>
							<clause id="H07168A6A94154558ABD4B3CA76A72B14"><enum>(i)</enum><text>correct minor
			 errors in the legal description; and</text>
							</clause><clause id="H85F25769379440AABD3D47A85EE55FEC"><enum>(ii)</enum><text>in
			 consultation with the County and the Habitat Conservation Advisory Committee,
			 make any minor boundary adjustments that the Secretary, the County, and the
			 Habitat Conservation Advisory Committee determine to be necessary.</text>
							</clause></subparagraph><subparagraph id="H532E98578DCA41118F943D25C8BEC0E6"><enum>(C)</enum><header>Availability</header><text>The
			 legal description submitted under subparagraph (A) shall be on file and
			 available for public inspection in the office of the Director of the Bureau of
			 Land Management.</text>
						</subparagraph></paragraph><paragraph id="H076446F973C444E385DC4FDF00EBCA77"><enum>(3)</enum><header>Conflict</header><text>If
			 there is a conflict among the Central Map, the acreage described in subsection
			 (b), or the legal description submitted under paragraph (1), the Central Map
			 shall control with respect to determining the boundaries of the Conservation
			 Area.</text>
					</paragraph></subsection></section><section id="H18354A381660495085F3666EC28CAC9D"><enum>605.</enum><header>Management</header>
				<subsection id="HC664882DA16A4570A2C870A19D3BA899"><enum>(a)</enum><header>In
			 General</header><text>The Secretary, acting through the Director of the Bureau
			 of Land Management, shall, subject to valid existing rights, manage the
			 Conservation Area—</text>
					<paragraph id="HB6BDEE941E3F488C98C5D0ACBCB6A18"><enum>(1)</enum><text>in
			 a manner that conserves, protects, and enhances the resources of the
			 Conservation Area described in section 602(1); and</text>
					</paragraph><paragraph id="HFD2BCC82BDD245AD9EB6A4A805E1F341"><enum>(2)</enum><text>in accordance
			 with—</text>
						<subparagraph id="H57F75A2CFA9A483F93745467F462C1FB"><enum>(A)</enum><text>the management
			 plan;</text>
						</subparagraph><subparagraph id="H0EB165EE5860454192C49E00D8EBFAA1"><enum>(B)</enum><text>this Act;
			 and</text>
						</subparagraph><subparagraph id="H795E6C7E160A44E280DC96C25159CF87"><enum>(C)</enum><text>any other
			 applicable laws.</text>
						</subparagraph></paragraph></subsection><subsection id="H9943000356F0472800066B477BFEC18"><enum>(b)</enum><header>Use</header>
					<paragraph id="HDDEF59688C6D4D7E8059BA09C5000984"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall only allow uses of the Conservation
			 Area—</text>
						<subparagraph id="H4694204164F843769B01A88B95009300"><enum>(A)</enum><text>in accordance with
			 the St. George Field Office Resource Management Plan dated March 15,
			 1999;</text>
						</subparagraph><subparagraph id="HC6F4445D9AA24DF8BDE47650FBA413A7"><enum>(B)</enum><text>that are described
			 in the Washington County Habitat Conservation Plan dated December 1995
			 (including any appendices to the plan);</text>
						</subparagraph><subparagraph id="HA92CBA2A9C0A48F99D1D2F2823DCA1D"><enum>(C)</enum><text>in accordance with
			 the Red Cliffs Desert Reserve Public Use Plan dated June 12, 2000; and</text>
						</subparagraph><subparagraph id="H30D74C8DCEEC4E55B40033BAD3CB56B9"><enum>(D)</enum><text>that the Secretary
			 determines would further the purposes described in section 602.</text>
						</subparagraph></paragraph><paragraph id="H20BA6E70F78E4F42ACB3E0525F628177"><enum>(2)</enum><header>Motorized and
			 Mechanized Vehicles</header><text>Except in cases in which motorized or
			 mechanized vehicles are needed for administrative purposes or to respond to an
			 emergency, the use of motorized or mechanized vehicles in the Conservation Area
			 shall be permitted only on roads and trails designated for the use of motorized
			 or mechanized vehicles.</text>
					</paragraph></subsection><subsection id="H9C1723BD18F548C18E06245359F2850"><enum>(c)</enum><header>Preventive
			 Measures</header><text>Nothing in this Act precludes any measures that the
			 Secretary determines to be necessary to prevent devastating fire or infestation
			 of insects or disease within the Conservation Area.</text>
				</subsection><subsection id="H08DAE72E7DB0446D8733EFEC190000F1"><enum>(d)</enum><header>Water
			 Rights</header>
					<paragraph id="HACC1291736B745E40099902400972B52"><enum>(1)</enum><header>State water
			 law</header><text>The laws of the State relating to water rights shall apply to
			 the acquisition and holding of any water rights in the Conservation Area that
			 are not in existence as of the date of enactment of this Act.</text>
					</paragraph><paragraph id="H17B8125242C1466FA08B987FC195216E"><enum>(2)</enum><header>Effect</header><text>Nothing
			 in this title—</text>
						<subparagraph id="H2493D8F2803E45D6B85CF77224816D56"><enum>(A)</enum><text>creates an express
			 or implied reservation by the United States of any water or water rights in the
			 Conservation Area;</text>
						</subparagraph><subparagraph id="HCF6461981DF949BD8236EE2C50FE394F"><enum>(B)</enum><text>affects any water
			 rights in the State (including any water rights held by the United States) in
			 existence on the date of enactment of this Act;</text>
						</subparagraph><subparagraph id="HB42F73A9BE204CD29657001B1169C0F1"><enum>(C)</enum><text>establishes a
			 precedent with regard to any future conservation area designations;</text>
						</subparagraph><subparagraph id="HA9A04F23ECE2475F825826CFA90F951"><enum>(D)</enum><text>affects the
			 interpretation of, or any designation made pursuant to, any other Act;</text>
						</subparagraph><subparagraph id="HF2D2C0313FAD4EA793B94DEE93CB3346"><enum>(E)</enum><text>limits, alters,
			 modifies, or amends any interstate compact or equitable apportionment decree
			 that apportions water among and between the State and other States; or</text>
						</subparagraph><subparagraph id="HD6E55B18E9A64D029DBEDFBAAAC27BA0"><enum>(F)</enum><text>prohibits the
			 funding of, assistance with, authorizing of, or issuance of a license, permit,
			 easement, or right-of-way for the development of any new water resource
			 facility within the Conservation Area consistent with utility development
			 protocols provided in the management plan.</text>
						</subparagraph></paragraph></subsection></section><section id="H904256E9CE45444EBDB7500A00CEB7"><enum>606.</enum><header>Management plan
			 amendments</header>
				<subsection id="H64B105EE8D0A4015AE670658BC46F860"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The management plan
			 may be amended as the Secretary determines to be necessary to achieve the
			 purposes of the Conservation Area described in section 602.</text>
				</subsection><subsection id="HB9478428B4DC40E6800769779FECD3A0"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">Any amendments to the management plan
			 adopted under subsection (a) shall comply with the procedures for amendments
			 outlined in the management plan, including the requirements that any amendments
			 shall—</text>
					<paragraph id="HBA6E23E4F5F04D9986125882EBC04313"><enum>(1)</enum><text display-inline="yes-display-inline">be developed with full public
			 participation; and</text>
					</paragraph><paragraph id="H46DBCF5410484F20917178C9ADF42400"><enum>(2)</enum><text display-inline="yes-display-inline">take into consideration affected
			 landowners, Federal, State, and local agencies, and affected Indian
			 tribes.</text>
					</paragraph></subsection></section><section id="H8D440226094C4C70B63ED69E31D040D7"><enum>607.</enum><header>Acquisition of
			 additional land</header>
				<subsection id="HEF5CAF81074945F49B640051DC375ED2"><enum>(a)</enum><header>In
			 General</header><text>The Secretary may acquire land or interests in land in
			 the Conservation Area—</text>
					<paragraph id="H66F397C08CAD46C19100E0912300DCC1"><enum>(1)</enum><text>by
			 donation;</text>
					</paragraph><paragraph id="HA1B109D4E3C24CC988B41880A4F001E1"><enum>(2)</enum><text>by purchase with
			 donated or appropriated funds;</text>
					</paragraph><paragraph id="HB86C27CD55704231B707D32726D269DB"><enum>(3)</enum><text>in exchange for
			 Federal land outside the Conservation Area, in accordance with—</text>
						<subparagraph id="H10EF806BCEE547C0BCD738BF30673DBF"><enum>(A)</enum><text>section 206 of the
			 Federal Land Management and Policy Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>); and</text>
						</subparagraph><subparagraph id="H20658FF8C0F1461EB58D2C00ADCF3C54"><enum>(B)</enum><text>any other
			 applicable law;</text>
						</subparagraph></paragraph><paragraph id="H8F348DC91D0647AAA31BF6E4E97BE9B"><enum>(4)</enum><text>with the
			 concurrence of the appropriate agency head, transfer from another Federal
			 agency; or</text>
					</paragraph><paragraph id="HFA68C1C7CC304B9E9E5B589C3B6CAFD0"><enum>(5)</enum><text>in accordance with
			 section 103(a)(4)(B)(i).</text>
					</paragraph></subsection><subsection id="HD56847DD2B8142D1B724212D3697E69F"><enum>(b)</enum><header>State
			 Land</header><text>Land or interests in land owned by the State or a political
			 subdivision of the State may only be acquired by donation, exchange, or
			 purchase.</text>
				</subsection><subsection id="H440066629A044A0FB2D866C738C9DEAB"><enum>(c)</enum><header>Private
			 Land</header><text>Private land or interests in private land may only be
			 acquired from willing sellers.</text>
				</subsection><subsection id="H531DBA82370745DEAD6546ED3EA13B00"><enum>(d)</enum><header>Subsequent
			 Acquisition</header><text>Any land or interests in land within the boundaries
			 of the Conservation Area that is acquired after the date of enactment of this
			 Act shall be—</text>
					<paragraph id="H0302B57893AE4ACAAF1E8B550600E6E4"><enum>(1)</enum><text>incorporated into
			 the Conservation Area; and</text>
					</paragraph><paragraph id="H953CBD5E05744CEF97128600C83C2ECC"><enum>(2)</enum><text>managed as part of
			 the Conservation Area, in accordance with—</text>
						<subparagraph id="HBE800A21109F4B4E9CD2DA767F2979FB"><enum>(A)</enum><text>this Act;
			 and</text>
						</subparagraph><subparagraph id="H01AF15BA99344E7094115C003E08B0AF"><enum>(B)</enum><text>any other
			 applicable laws.</text>
						</subparagraph></paragraph></subsection></section><section id="H00ED9A790F7847A6BB83EB1C001DB47B"><enum>608.</enum><header>Withdrawal</header>
				<subsection id="HC5C7C53B34CF4513B787F3EF859B8E6C"><enum>(a)</enum><header>In
			 General</header><text>Subject to valid existing rights, all public land in the
			 Conservation Area is withdrawn from—</text>
					<paragraph id="HEAB0C09F5E5B4B59919B292FE6358D7C"><enum>(1)</enum><text>all forms of
			 entry, appropriation, and disposal under the public land laws;</text>
					</paragraph><paragraph id="HE19452DB55A6443EAC10804B1D542766"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</paragraph><paragraph id="H9F2B2752CDEC4824A915DD4800E65F38"><enum>(3)</enum><text>operation of the
			 mineral leasing, geothermal leasing, and mineral materials laws.</text>
					</paragraph></subsection><subsection id="HFBFE6E42ABE74EEFBBFA0098005445BA"><enum>(b)</enum><header>Additional
			 Land</header><text>Notwithstanding any other provision of law, if the Secretary
			 acquires additional land within the Conservation Area after the date of
			 enactment of this Act, the land is withdrawn from operation of the laws
			 referred to in subsection (a) on the date of acquisition of the land.</text>
				</subsection></section><section id="H6E78B671AB084888AE024126238F0083"><enum>609.</enum><header>Cooperative
			 agreements</header><text display-inline="no-display-inline">The Secretary may
			 enter into cooperative agreements with other Federal agencies, State and local
			 agencies, and nonprofit entities that provide for the management and
			 interpretation of natural and cultural resources in the Conservation
			 Area.</text>
			</section><section id="HD229998813DF4C9D8737DA40A5819E2F"><enum>610.</enum><header>No buffer
			 zones</header>
				<subsection id="HDD60B6964DDF40FF929C315467F9F591"><enum>(a)</enum><header>In
			 General</header><text>The establishment of the Conservation Area shall not
			 create protective perimeters or buffer zones around the Conservation
			 Area.</text>
				</subsection><subsection id="H9DD97B443AFB4739BFDB77C980C6CD6D"><enum>(b)</enum><header>Private
			 Land</header><text>If the use of, or conduct of an activity on, private land
			 outside the boundaries of the Conservation Area is consistent with applicable
			 law, nothing in this title concerning the establishment of the Conservation
			 Area shall prohibit or limit the use or conduct of the activity.</text>
				</subsection></section></title><title id="H1B5FBAA19FF84C4B9ED21144B76204B6"><enum>VII</enum><header>AUTHORIZATION OF
			 APPROPRIATIONS</header>
			<section commented="no" display-inline="no-display-inline" id="HF32B24B19C5A4CBF90337F4C75C31D9E" section-type="subsequent-section"><enum>701.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
