<section section-type="section-one" id="H1AC50F064EBA48E38D79302B669D8053" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Say No to Drug Ads Act</short-title></quote>.</text></section> 
<section id="H8D483327D1F6440F86733D58425C8BE2"><enum>2.</enum><header>Disallowance of deduction for direct-to-consumer advertisement of prescription drugs</header> 
<subsection id="H3BA6AA46783D458C96A0E1EC5B53139E"><enum>(a)</enum><header>General rule</header><text>Part IX of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to items not deductible) is amended by adding at the end the following new section:</text>

<section id="HC1FF646A18F64711BD3533E9C18279FB"><enum>280I.</enum><header>Direct-to-consumer advertisement of prescription drugs</header><text display-inline="no-display-inline">No deduction shall be allowed under this chapter for any amount paid or incurred for a direct-to-consumer advertisement of a prescription drug.</text></section><after-quoted-block></after-quoted-block></quoted-block></subsection> 
<subsection id="HC665C379E1F74A9294985711DB03AA24"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for part IX of subchapter B of chapter 1 of such Code is amended by adding at the end thereof the following new item:</text>

<subsection id="H67DFD362EBE3442FA0ECBA4C6CE86C4"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to amounts paid or incurred after December 31, 2004.</text></subsection></section>
