		<official-title>To amend the Federal Water Pollution Control Act to
		  establish a deadline for restricting sewage dumping into the Great Lakes and to
		  fund programs and activities for improving wastewater discharges into the Great
		  Lakes.</official-title>

		<section display-inline="no-display-inline" id="HD358FF2448754723989DF31BC301772C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Great
			 Lakes Water Protection Act</quote>.</text>
		</section><section id="H8D8E628400A746F691E31D59004BDAB"><enum>2.</enum><header>Prohibition on
			 sewage dumping into the Great Lakes</header><text display-inline="no-display-inline">Section 402 of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/1342">22 U.S.C. 1342</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block id="HB142BFE6A4624BEA85B4C810D6923B47">
				<subsection id="H76303270259A4F66A6C16BE28CBD65AF"><enum>(r)</enum><header>Prohibition on
				sewage dumping into the Great Lakes</header>
					<paragraph id="HCCBB97327A8D4778BA9F70D5F3511683"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">A publicly owned
				treatment works is prohibited from intentionally diverting waste streams to
				bypass any portion of a treatment facility at the treatment works if the
				diversion results in a discharge into the Great Lakes unless—</text>
						<subparagraph id="HC2D01B27C4B84DEC8B593373857F6E99"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H75FC21872B8C44C39F33B82600DCF351"><enum>(i)</enum><text>the bypass is
				unavoidable to prevent loss of life, personal injury, or severe property
				damage;</text>
							</clause><clause id="H0F061629807E40F08EC0DCEAE1E1316C" indent="up1"><enum>(ii)</enum><text>there is not a feasible
				alternative to the bypass, such as the use of auxiliary treatment facilities,
				retention of untreated wastes, or maintenance during normal periods of
				equipment downtime; and</text>
							</clause><clause id="HBE86CB55F1C3423FAF7D8400CE91F71E" indent="up1"><enum>(iii)</enum><text>the treatment works provides
				notice of the bypass in accordance with the requirements of this subsection;
				or</text>
							</clause></subparagraph><subparagraph id="H20FCD5B72A8F4B0499D2C614153F0089"><enum>(B)</enum><text>the bypass does
				not cause effluent limitations to be exceeded, and the bypass is for essential
				maintenance to ensure efficient operation of the treatment facility.</text>
						</subparagraph></paragraph><paragraph id="H989925CE740E4235832D1B192489AC9E"><enum>(2)</enum><header>Limitation</header><text>The
				requirement of paragraph (1)(A)(ii) is not satisfied if adequate back-up
				equipment should have been installed in the exercise of reasonable engineering
				judgment to prevent the bypass and the bypass occurred during normal periods of
				equipment downtime or preventive maintenance.</text>
					</paragraph><paragraph id="H01AF7F82C9A24A759717C8D62DBCABCF"><enum>(3)</enum><header>Notice
				requirements</header><text>A publicly owned treatment works shall provide to
				the Administrator (or to the State in the case of a State that has a permit
				program approved under this section)—</text>
						<subparagraph id="H1FD58489BB2F4798BECFE44C10DF6D1D"><enum>(A)</enum><text>prior notice of an
				anticipated bypass; and</text>
						</subparagraph><subparagraph id="H1DA7549474C740DFA258281202607DB0"><enum>(B)</enum><text>notice of an
				unanticipated bypass within 24 hours following the time the treatment works
				first becomes aware of the bypass.</text>
						</subparagraph></paragraph><paragraph id="H62E2B74B40BC4823986E989F3DDD302C"><enum>(4)</enum><header>Follow-up notice
				requirements</header><text display-inline="yes-display-inline">In the case of
				an unanticipated bypass for which a publicly owned treatment works provides
				notice under paragraph (3)(B), the treatment works shall provide to the
				Administrator (or to the State in the case of a State that has a permit program
				approved under this section), not later than 5 days following the date on which
				the treatment works first becomes aware of the bypass, a follow-up notice
				containing a description of—</text>
						<subparagraph id="H2959CAD9E2084EDFAD97B141BECED77F"><enum>(A)</enum><text>the cause of the
				bypass;</text>
						</subparagraph><subparagraph id="HBFDAD04B14B74281B6DCE713AEAA72E"><enum>(B)</enum><text display-inline="yes-display-inline">the reason for the bypass</text>
						</subparagraph><subparagraph id="H730933344F074E6997B4F71A87F9260"><enum>(C)</enum><text>the period of
				bypass, including the exact dates and times;</text>
						</subparagraph><subparagraph id="H0CD51E0C2171454194D1A06445EF98DB"><enum>(D)</enum><text display-inline="yes-display-inline">if the bypass has not been corrected, the
				anticipated time the bypass is expected to continue;</text>
						</subparagraph><subparagraph id="H63B8C04C00B546E7B2CEEFD9B02C31F"><enum>(E)</enum><text display-inline="yes-display-inline">the volume of the discharge resulting from
				the bypass;</text>
						</subparagraph><subparagraph id="H0F51C175F96B4E170017F6C580905C00"><enum>(F)</enum><text display-inline="yes-display-inline">any public access areas that may be
				impacted by the bypass; and</text>
						</subparagraph><subparagraph id="H2E7F6563A388419C9DF5FF213416A0B8"><enum>(G)</enum><text>steps taken or
				planned to reduce, eliminate, and prevent reoccurrence of the bypass.</text>
						</subparagraph></paragraph><paragraph id="HD7974C448CBF408AAF750341E36E39"><enum>(5)</enum><header>Public
				availability of notices</header><text>A publicly owned treatment works
				providing a notice under this subsection, and the Administrator (or the State
				in the case of a State that has a permit program approved under this section)
				receiving such a notice, shall each post all such notices provided or received
				in a searchable database accessible on the Internet.</text>
					</paragraph><paragraph id="H5A402AE303AC45419D375EA48F36133D"><enum>(6)</enum><header>Sewage
				blending</header><text display-inline="yes-display-inline">Bypasses prohibited
				by this section include bypasses resulting in discharges from a publicly owned
				treatment works that consist of effluent routed around treatment units and
				thereafter blended together with effluent from treatment units prior to
				discharge.</text>
					</paragraph><paragraph id="H77DF3BAFB96047E59DC261114B2BEA6F"><enum>(7)</enum><header>Definitions</header><text>In
				this subsection, the following definitions apply:</text>
						<subparagraph id="HCF613EB4AA114D7A8742CB049F4BC7BF"><enum>(A)</enum><header>Bypass</header><text display-inline="yes-display-inline">The term <quote>bypass</quote> means an
				intentional diversion of waste streams to bypass any portion of a treatment
				facility which results in a discharge into the Great Lakes.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H79BD66C80E1542E5B820A825FB6400A2"><enum>(B)</enum><header>Great
				lakes</header><text>The term <quote>Great Lakes</quote> has the meaning given
				such term by section 118(a)(3).</text>
						</subparagraph><subparagraph id="H3B52612449084EA0902E9B5B2934845D"><enum>(C)</enum><header>Treatment
				facility</header><text display-inline="yes-display-inline">The term
				<quote>treatment facility</quote> includes all wastewater treatment units used
				by a publicly owned treatment works to meet secondary treatment standards or
				higher, as required to attain water quality standards, under any operating
				conditions.</text>
						</subparagraph><subparagraph id="H3AC7210848E74D9193CC8F17AEDEB9B5"><enum>(D)</enum><header>Treatment
				works</header><text>The term <quote>treatment works</quote> has the meaning
				given that term in section 212.</text>
						</subparagraph></paragraph><paragraph id="H8141E7BE827F4F81A90198512D2B655B"><enum>(8)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Administrator shall establish
				procedures to ensure that permits issued under this section (or under a State
				permit program approved under this section) to a publicly owned treatment works
				include requirements to implement this subsection.</text>
					</paragraph><paragraph id="HC315CA37A0F14C0E9D5ED0AD6CFEC55D"><enum>(9)</enum><header>Maximum civil
				penalty</header><text>Notwithstanding any provision of section 309, the maximum
				civil penalty which shall be assessed for a violation of this subsection, or
				any permit limitation or condition implementing this subsection, shall be
				$100,000 per day for each day the violation occurs.</text>
					</paragraph><paragraph id="H3D63A67F34484180A5C4ECA9CFD43493"><enum>(10)</enum><header>Effective
				date</header>
						<subparagraph id="H45BBB947DE1F4A0F836E9C456CE5C316"><enum>(A)</enum><header>In
				general</header><text>Except as provided by subparagraph (B), the requirements
				of this subsection shall become effective beginning January 1, 2026.</text>
						</subparagraph><subparagraph id="H1B3B0B9410A14855AF96B399C3D2244"><enum>(B)</enum><header>Notice
				requirements</header><text>The requirements of paragraphs (3), (4), and (5)
				shall become effective one year after the date of enactment of this
				subsection.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H87C7EB842166462EB8F71C56F6AA98B0"><enum>3.</enum><header>Establishment of
			 Great Lakes Cleanup Fund</header>
			<subsection id="H54B097C84F8C48BCAD4C9351D75078A0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title V of the
			 Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1361">33 U.S.C. 1361 et seq.</external-xref>) is amended by
			 redesignating section 519 as section 520 and inserting after section 518 the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H77E286BA76BC48AE9B00F21D11B4DE96" style="OLC">
					<section id="HD200B8242C3D40B682E0B3AC01591B14"><enum>519.</enum><header>Establishment
				of Great Lakes Cleanup Fund</header>
						<subsection id="H6C10D3016B2546BC8707159512B73E13"><enum>(a)</enum><header>Creation of
				fund</header><text display-inline="yes-display-inline">There is established in
				the Treasury of the United States a trust fund to be known as the <quote>Great
				Lakes Cleanup Fund</quote> (in this section referred to as the
				<quote>Fund</quote>).</text>
						</subsection><subsection id="H187742C93E0C4671B6661D93DD9F0100"><enum>(b)</enum><header>Transfers to
				fund</header><text display-inline="yes-display-inline">Effective January 1,
				2026, there are authorized to be appropriated to the Fund amounts equivalent to
				the penalties collected for violations of section 402(r).</text>
						</subsection><subsection id="H15E2CDDCB9164B7B9B9CFB474F7630BB"><enum>(c)</enum><header>Administration
				of fund</header><text display-inline="yes-display-inline">The Administrator
				shall administer the Fund.</text>
						</subsection><subsection id="HC2BF1C66E9E54DAE945FA678ADD09BDB"><enum>(d)</enum><header>Use of
				funds</header><text display-inline="yes-display-inline">The Administrator shall
				make the amounts in the Fund available to the Great Lakes States for programs
				and activities for improving wastewater discharges into the Great Lakes,
				including habitat protection and wetland restoration. The Administrator shall
				allocate such amounts among the Great Lakes States based on the proportional
				amount attributable to each Great Lakes State for penalties collected for
				violations of section 402(r).</text>
						</subsection><subsection id="H169F13E8A55F4DD5B09E471C3DAE0037"><enum>(e)</enum><header>Priority</header><text>In
				selecting programs and activities to be funded using amounts made available
				under this section, a Great Lakes State shall give priority consideration to
				programs and activities that address violations of section 402(r) resulting in
				the collection of penalties.</text>
						</subsection><subsection id="HBF040DD9AD7A481FBD45E55EBF00D52B"><enum>(f)</enum><header>Definitions</header><text>In
				this section, the terms <quote>Great Lakes</quote> and <quote>Great Lakes
				States</quote> have the meanings given such terms in section
				118(a)(3).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1FEC3640A39A4B5B96AD9B81C164916F"><enum>(b)</enum><header>Conforming
			 amendment to State revolving fund program</header><text>Section 607 of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1387">33 U.S.C. 1387</external-xref>) is amended—</text>
				<paragraph id="HCFC7A883E6D24AD087B9A5BCBA1AA1F"><enum>(1)</enum><text>by
			 inserting <quote>(a) <header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text></quote> before <quote>There is</quote>; and</text>
				</paragraph><paragraph id="H02F9FCE0BB8E43C5A3BCB5A1759D8511"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H83B6E5FC074E49C5A1CE9274E434178E" style="OLC">
						<subsection id="H63A9B248876C40649BC6EAF3738BAD29"><enum>(b)</enum><header>Treatment of
				Great Lakes Cleanup Fund</header><text>For purposes of this title, amounts made
				available from the Great Lakes Cleanup Fund under section 519 shall be treated
				as funds authorized to be appropriated to carry out this title and as funds
				made available under this title, except that such funds shall be made available
				to the Great Lakes States as provided in section
				519.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
