		<official-title>To amend the Fair Labor Standards Act to provide for the
		  calculation of the minimum wage based on the Federal poverty guidelines
		  published by the Department of Health and Human Services.</official-title>

		<section id="HC51E6A4FA0974D28B8A51E14FC6306C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Living American Wage (LAW) Act of
			 2006</short-title></quote>.</text>
		</section><section id="H47EC8B0672C344CD8B98318F6DA841C4"><enum>2.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that—</text>
			<paragraph id="HB4F2C7FE29A64A6EAC3779A2215742F4"><enum>(1)</enum><text>the Federal
			 minimum wage should, as a minimum, be adjusted every 4 years so that a person
			 working for such a wage may earn an annual income that is not less than 112
			 percent of the Federal poverty threshold, as determined by the Census Bureau;
			 and</text>
			</paragraph><paragraph id="HA95C76C5E4524798940054F1875BBAEC"><enum>(2)</enum><text>Congress or any of
			 the several States may establish a higher minimum wage requirement than that
			 established in this Act.</text>
			</paragraph></section><section id="H6F2177188C6F46C9A748C49EC487E718"><enum>3.</enum><header>Minimum
			 wage</header><text display-inline="no-display-inline">Section 6 of the Fair
			 Labor Standards Act of 1938 is amended—</text>
			<paragraph id="H948E9C0EFF4947B2001DA3EE01B3C334"><enum>(1)</enum><text>by amending
			 subsection (a)(1) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H1C1D6DEA1E0F4B10809063E37ED56731" style="traditional">
					<paragraph id="HF4751605D7014E2D99C8C09E2F001C47"><enum>(1)</enum><text>except as
				otherwise provided in this section, not less than $5.15 an hour beginning
				September 1, 1997, and not less than the amount determined by the Secretary
				under subsection (b) beginning January 1,
				2007;</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HC2CA3D45FFC841DBB0B73F2C6F2E00FF"><enum>(2)</enum><text>by redesignating
			 subsection (b) as subsection (c) and inserting after subsection (a) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H0F5F458458024191BA6CF3C4725C2F00" style="traditional">
					<subsection id="H59D05F562E9F4DA8A920FFC800B000EC"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H963A83E89D9F4B4CB50242769C88DF48"><enum>(1)</enum><text>Not later than September
				1, 2006, and once every 4 years thereafter, the Secretary shall determine the
				minimum wage rate applicable under subsection (a)(1) based on the formula
				described in paragraph (2). The Secretary shall publish such wage rate in the
				Federal Register not later than October 1 of each year. If such determination
				results in a lower minimum wage than that then in effect, the Secretary shall
				not adjust the minimum wage then in effect pursuant to this subsection.</text>
						</paragraph><paragraph id="H4002C3C9FF4145C994DC8B54A0D65B00" indent="up1"><enum>(2)</enum><text>The minimum wage rate determined by
				the Secretary under paragraph (1) shall be the minimum hourly wage sufficient
				for a person working for such wage 40 hours per week, 52 weeks per year, to
				earn an annual income in an amount that is 12 percent higher than the Federal
				poverty threshold for a two person household, with one person a child under age
				18, and living in the 48 contiguous States, as published for each such year by
				the Census
				Bureau.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
