		<section id="HC406702D6488432B9BFD06D8A765166C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Elder
			 Abuse Prevention Act of 2006</quote>.</text>
		</section><section id="H0505BFD6EC1342D393B73B42DE769DB0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HF0CED56438534419AB006C8FABC82C2"><enum>(1)</enum><text display-inline="yes-display-inline">The number of older Americans who are
			 abused, neglected, or exploited is increasing, and a large percentage of elder
			 abuse cases are not reported to Federal and State law enforcement
			 authorities.</text>
			</paragraph><paragraph id="H559420EEEE044502961344C9CF21B2D"><enum>(2)</enum><text display-inline="yes-display-inline">The number of Americans aged 65 and older
			 is projected to increase exponentially in the coming years, and many of these
			 valued citizens will begin to constitute a vulnerable population at increased
			 risk of abuse and exploitation in domestic and community-based settings.</text>
			</paragraph><paragraph id="H463EEFA0FC06471300AF129BF64467E3"><enum>(3)</enum><text display-inline="yes-display-inline">The projected increase in the number of
			 Americans aged 65 and over is expected to result in a corresponding increase in
			 the number of cases of elder abuse, which suggests an urgent need for
			 comprehensive consideration of means by which such abuse can be prevented,
			 reported, and prosecuted by Federal and State authorities.</text>
			</paragraph><paragraph id="H7BD9B95BF9994A53949E178D3CBBFE17"><enum>(4)</enum><text display-inline="yes-display-inline">Violent, physical, and sexual assaults upon
			 older Americans are particularly abhorrent and should be prosecuted vigorously
			 by Federal and State law enforcement authorities. Such acts should be deterred
			 by appropriate penalties including enhanced penalties and the elimination of
			 parole for individuals convicted of violent sexual offenses against the
			 elderly.</text>
			</paragraph></section><section id="HBB78D7FFB5FC41E08658BE16CA974E8B"><enum>3.</enum><header>No
			 parole for sexual offenses committed against the elderly or for sexually
			 violent predators</header>
			<subsection id="H560291B1D21E4D12809066140485AFB3"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">For each fiscal year
			 after the expiration of the period specified in
			 <internal-xref idref="H0E11E3266D0C48CBBDB67000AC29DA54" legis-path="3.(b)(1)">subsection (b)(1)</internal-xref> in which a State
			 receives funds for a program referred to in
			 <internal-xref idref="HADF01516D62048C991024838C083B000" legis-path="3.(b)(2)">subsection (b)(2)</internal-xref>, the State shall have
			 in effect throughout the State laws and policies that prohibit parole for any
			 individual who is—</text>
				<paragraph id="H6823120E5DE4463BBB5971A96F368E"><enum>(1)</enum><text display-inline="yes-display-inline">convicted of a criminal sexual offense
			 against a victim who is elderly, which shall include any such offense under
			 State law for conduct that would constitute an offense under chapter 109A of
			 title 18 had the conduct occurred in the special maritime and territorial
			 jurisdiction of the United States or in a Federal prison; or</text>
				</paragraph><paragraph id="HA058F9B2E3D54686993B29C802B7558F"><enum>(2)</enum><text>a
			 sexually violent predator, as such term is defined in section 14071(a)(3) of
			 title 18, United States Code.</text>
				</paragraph></subsection><subsection id="HA0BE6A8A4ED44623A21E19516700FE9E"><enum>(b)</enum><header>Compliance and
			 Ineligibility</header>
				<paragraph id="H0E11E3266D0C48CBBDB67000AC29DA54"><enum>(1)</enum><header>Compliance
			 date</header><text>Each State shall have not more than 3 years from the date of
			 enactment of this Act to comply with
			 <internal-xref idref="H560291B1D21E4D12809066140485AFB3" legis-path="3.(a)">subsection (a)</internal-xref>, except that—</text>
					<subparagraph id="H73202DC2D90E4CD38FF7C200E37D5952"><enum>(A)</enum><text>the Attorney
			 General may grant an additional 2 years to a State that is making good faith
			 efforts to comply with such subsection; and</text>
					</subparagraph><subparagraph id="H56C68650335A44118BDD91E2A6EC8CB9"><enum>(B)</enum><text display-inline="yes-display-inline">the Attorney General shall waive the
			 requirements of
			 <internal-xref idref="H560291B1D21E4D12809066140485AFB3" legis-path="3.(a)">subsection (a)</internal-xref> if compliance with such
			 subsection by a State would be unconstitutional under the constitution of such
			 State.</text>
					</subparagraph></paragraph><paragraph id="HADF01516D62048C991024838C083B000"><enum>(2)</enum><header>Ineligibility
			 for funds</header><text display-inline="yes-display-inline">For any fiscal year
			 after the expiration of the period specified in
			 <internal-xref idref="H0E11E3266D0C48CBBDB67000AC29DA54" legis-path="3.(b)(1)">paragraph (1)</internal-xref>, a State that fails to
			 comply with
			 <internal-xref idref="H560291B1D21E4D12809066140485AFB3" legis-path="3.(a)">subsection (a)</internal-xref> shall not receive 10 percent
			 of the funds that would otherwise be allocated for that fiscal year to the
			 State under Subpart 1 of Part E of title I of the Omnibus Crime Control and
			 Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750 et seq.</external-xref>), whether characterized as the
			 Edward Byrne Memorial State and Local Law Enforcement Assistance Programs, the
			 Local Government Law Enforcement Block Grants Program, the Edward Byrne
			 Memorial Justice Assistance Grant Program, or otherwise.</text>
				</paragraph><paragraph id="H1AA3F1EA85D4411AB0D8364FCBAF4C7F"><enum>(3)</enum><header>Reallocation</header><text display-inline="yes-display-inline">Amounts not allocated under a program
			 referred to in
			 <internal-xref idref="HADF01516D62048C991024838C083B000" legis-path="3.(b)(2)">paragraph (2)</internal-xref> to a State for failure to
			 fully comply with
			 <internal-xref idref="H560291B1D21E4D12809066140485AFB3" legis-path="3.(a)">subsection (a)</internal-xref> shall be reallocated under
			 that program to States that have not failed to comply with such subsection.</text>
				</paragraph></subsection></section><section id="H155AA80DA50D4FD8A6BA94F8A635B89D"><enum>4.</enum><header>Amendment to the
			 Federal sentencing guidelines</header>
			<subsection id="H9081E888D0104372A782AA7E03E821FA"><enum>(a)</enum><header>Request for
			 immediate consideration by the united states sentencing
			 commission</header><text display-inline="yes-display-inline">Pursuant to its
			 authority under <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994(p)</external-xref> of title 28, United States Code, and in
			 accordance with this section, the United States Sentencing Commission is
			 requested to—</text>
				<paragraph id="H860D4F3BA46F4BC083998C426F9CB1CE"><enum>(1)</enum><text display-inline="yes-display-inline">promptly review the sentencing guidelines
			 applicable to sexual offenses committed against the elderly;</text>
				</paragraph><paragraph id="H8F412DD3661B4ABA8F06EB5CF320A63E"><enum>(2)</enum><text display-inline="yes-display-inline">expeditiously consider the promulgation of
			 new sentencing guidelines or amendments to existing sentencing guidelines to
			 provide an enhancement for such offenses; and</text>
				</paragraph><paragraph id="H69990B5528524359BDF38C06E89A71E"><enum>(3)</enum><text display-inline="yes-display-inline">submit to Congress an explanation of
			 actions taken by the Sentencing Commission pursuant to paragraph (2) and any
			 additional policy recommendations the Sentencing Commission may have for
			 combating offenses described in paragraph (1).</text>
				</paragraph></subsection><subsection id="H30E6905812134FF1841CCCB616223DC"><enum>(b)</enum><header>Considerations in
			 review</header><text display-inline="yes-display-inline">In carrying out this
			 section, the Sentencing Commission is requested to—</text>
				<paragraph id="HBCFE387B528A45209893488364BD8B3E"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that the sentencing guidelines and
			 policy statements reflect the serious nature of such offenses and the need for
			 aggressive and appropriate law enforcement action to prevent such
			 offenses;</text>
				</paragraph><paragraph id="H66D515416AE34FC296BAA47118D75C70"><enum>(2)</enum><text display-inline="yes-display-inline">assure reasonable consistency with other
			 relevant directives and with other guidelines;</text>
				</paragraph><paragraph id="H7394DF263C6B49729E32A8BADD392B3E"><enum>(3)</enum><text display-inline="yes-display-inline">account for any aggravating or mitigating
			 circumstances that might justify exceptions, including circumstances for which
			 the sentencing guidelines currently provide sentencing enhancements;</text>
				</paragraph><paragraph id="HF3935A4A1C3040BABC700000FB956DEC"><enum>(4)</enum><text display-inline="yes-display-inline">make any necessary conforming changes to
			 the sentencing guidelines; and</text>
				</paragraph><paragraph id="H52104A95614242549137A4009EE6453"><enum>(5)</enum><text display-inline="yes-display-inline">assure that the guidelines adequately meet
			 the purposes of sentencing as set forth in section 3553 (a)(2) of title 18,
			 United States Code.</text>
				</paragraph></subsection><subsection id="H4EBA095DB3AE4E33A8F4024232C6B16"><enum>(c)</enum><header>Emergency
			 authority and deadline for commission action</header><text display-inline="yes-display-inline">The United States Sentencing Commission is
			 requested to promulgate the guidelines or amendments provided for under this
			 section as soon as practicable, and in any event not later than the 180 days
			 after the date of enactment of this Act, in accordance with the procedures sent
			 forth in section 21(a) of the Sentencing Reform Act of 1987, as though the
			 authority under that Act had not expired.</text>
