		<official-title>To amend title XVIII of the Social Security Act to
		  provide for a Medicare prescription drug special enrollment period in 2006 for
		  all part D eligible individuals and to waive the late enrollment penalty for
		  low-income individuals who enroll during such period.</official-title>

		<section id="H7019FF1C8F8B4610AE30C14D4CE0409C" section-type="section-one"><enum>1.</enum><header>Medicare prescription drug
			 special enrollment period in 2006 for all part D eligible individuals and
			 waiver of late enrollment penalty for low-income individuals who enroll during
			 such period</header><text display-inline="no-display-inline">Section
			 1860D–1(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-101">42 U.S.C. 1395w–101(b)(3)</external-xref>) is amended
			 by adding at the end the following new subparagraph:</text>
			<quoted-block display-inline="no-display-inline" id="H33C74BD41CE54918BC77268017AABD48" style="OLC">
				<subparagraph id="H23BBC60DF54449FEA414485DF6D5BFBE" indent="up1"><enum>(F)</enum><header>2006 enrollments</header>
					<clause id="HBF24440B49754E9A00679BE9FD1EC6C9"><enum>(i)</enum><header>In general</header><text>In the
				case of a part D eligible individual who is not enrolled in a prescription drug
				plan under this part (or an MA–PD plan under part C) as of the date of the
				enactment of this subparagraph, a special enrollment period starting on such
				date of enactment and ending on November 14, 2006.</text>
					</clause><clause id="HA6D3632ADEE04B29B03F654B534F454B"><enum>(ii)</enum><header>Treatment of late enrollment
				penalty</header><text>In establishing the special enrollment period under
				clause (i), the Secretary shall ensure the following:</text>
						<subclause id="H7248012FE2734216822F09F12B7914C1"><enum>(I)</enum><header>In general</header><text>Subject to
				subclause (II), nothing in this subparagraph shall be construed as affecting
				the application of section 1860D–13(b), and the special enrollment period shall
				not be treated as an initial enrollment period for purposes of part C.</text>
						</subclause><subclause id="HE7F1AC51DD644AB3B8001217077BF9AE"><enum>(II)</enum><header>No late enrollment penalties for
				low-income</header><text display-inline="yes-display-inline">In the case of a
				subsidy-eligible individual (as defined in section 1860D–14(a)(3)) who enrolls
				in a prescription drug plan (or an MA–PD plan) during the special enrollment
				period under clause (i), any month that starts before the date of such
				enrollment shall not be treated as an <quote>uncovered month</quote> for
				purposes of the late enrollment penalty under section 1860D–13(b).</text>
						</subclause></clause><clause id="H65BC13CE756948A68B84104E215DE6B"><enum>(iii)</enum><header>Effective date of
				enrollment</header><text display-inline="yes-display-inline">In establishing
				the special enrollment period under clause (i), the Secretary shall ensure that
				enrollments occurring during the special enrollment period shall take effect
				with the first day of the first calendar month following the date on which the
				enrollment
				occurs.</text>
