				transportation system.</text>

				term <term>transportation systems management and operations</term>
				includes—</text>

				funds shall not be transferable and shall remain available until expended, and
				the Federal share of the cost of a project under this section shall be
				determined in accordance with sections 120(b) and 120(c) of such

			</subsection></section><section changed="deleted" id="ID12134A1F90BF4A17BCB142F8D36ADDDC" reported-display-style="strikethrough"><enum>6.</enum><header>Definition of
			 repeat intoxicated driver law</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/164">Section 164(a)(5)(A)</external-xref> of title 23, United
			 States Code, is amended to read as follows:</text>

			 Safety</header>

			 Apportionments for Highway Safety Programs</header><text>Section 402(c) of the
			 title 23, United States Code, is amended by striking <quote>The annual
			 apportionment to each State shall not be less than one-half of 1 per
			 centum</quote> and inserting <quote>The annual apportionment to each State
			 shall not be less than three-quarters of 1 percent</quote>.</text>

			 authority</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/23/117">section 117(g)</external-xref> of title 23, United
			 States Code, or any other provision of law, unused obligation authority made
			 available for an item in section 1702 of the Safe, Accountable, Flexible,
			 Efficient Transportation Equity Act: A Legacy for Users (119 Stat. 1256) that
			 was repealed, or authorized funding for such an item that was reduced, by this
			 section shall be made available—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1593FADD47424158B1A2CC2F39DFFDF8"><enum>(1)</enum><text>for an item in section
			 1702 of that Act that was added or increased by this section and that is in the
			 same State as the item for which obligation authority or funding was repealed
			 or reduced; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id140A10DC98A04BDE83B9E078D1E255D7"><enum>(2)</enum><text>in an amount proportional
			 to the amount of obligation authority or funding that was so repealed or
			 reduced.</text>
				</paragraph></subsection><subsection changed="added" id="idD74C8780A6D24321B259613CC5E94AC2" reported-display-style="italic"><enum>(d)</enum><header>Additional
			 discretionary use of surface transportation program funds</header><text display-inline="yes-display-inline">Of the funds apportioned to each State
			 under <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)(3)</external-xref> of title 23, United States Code, a State may expend for
			 each of fiscal years 2005 through 2009 not more than $1,000,000 for the
			 following activities:</text>
				<paragraph id="id30B3EEB8E3F44A53BD26E63CFBD1FFBF"><enum>(1)</enum><text display-inline="yes-display-inline">Participation in the Joint Operation Center
			 for Fuel Compliance (JOC), including the funding of additional positions for
			 motor fuel tax enforcement officers and other staff dedicated on a full-time
			 basis to participation in the activities of the Center.</text>
				</paragraph><paragraph id="id3707A49175444FAE9B3477034DEFD1A1"><enum>(2)</enum><text display-inline="yes-display-inline">Development, operation, and maintenance of
			 electronic filing systems to coordinate data exchange with the Internal Revenue
			 Service by States that impose a tax on the removal of taxable fuel from any
			 refinery and on the removal of taxable fuel from any terminal.</text>
				</paragraph><paragraph id="idAC4391FA29244BEAB01320A440D8433C"><enum>(3)</enum><text>Development, operation,
			 and maintenance of electronic single point of filing in conjunction with the
			 Internal Revenue Service by States that impose a tax on the removal of taxable
			 fuel from any refinery and on the removal of taxable fuel from any
			 terminal.</text>
				</paragraph><paragraph id="id7952C1BEF5A448B09CBE01833BDA9518"><enum>(4)</enum><text>Development, operation,
			 and maintenance of a certification system by a State of any fuel sold to a
			 State or local government for the exclusive use of the State or local
			 government (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/4221">section 4221(d)</external-xref> of the Internal Revenue Code of 1986)
			 or sold to a qualified volunteer fire department (as defined in section
			 150(e)(2) of such Code) for its exclusive use.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4667A42A0E644E4292DA62460B44D36E"><enum>(5)</enum><text>Development, operation,
			 and maintenance of a certification system by a State to certify nonprofit
			 educational organizations (as defined in section 4221(d) of such Code) to be in
			 good standing in the state in which the organization is providing educational
			 services.</text>

			 obligation limitation</header><text>Funds made available under this section
			 shall be subject to any limitation on obligations for Federal-aid highways and

			 Flexible, Efficient Transportation Equity Act: A Legacy for Users (23 U.S.C.
			 104 note; 119 Stat. 1157) or any other Act.</text>
			</subsection><subsection changed="added" id="ID2F817FFC12D34327AE342B4E1BBFD49F" reported-display-style="italic"><enum>(e)</enum><header>Equity bonus
			 formula</header><text>Notwithstanding any other provision of law, in allocating
			 funds for the equity bonus program under <external-xref legal-doc="usc" parsable-cite="usc/23/105">section 105</external-xref> of title 23, United States
			 Code, for each of fiscal years 2007 through 2009, the Secretary of
			 Transportation shall make the required calculations under that section as if
			 this section had not been enacted.</text>
			</subsection><subsection changed="added" id="ID4E43CADACA794354AF1986CC15911671" reported-display-style="italic"><enum>(f)</enum><header>Funding for research
			 activities</header><text>Of the amount made available by section 5101(a)(1) of
			 the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy
			 for Users (119 Stat. 1779)—</text>
				<paragraph id="id0E548C3FFAFD4E41B8743501D3A4D815"><enum>(1)</enum><text>at least $1,000,000 shall
			 be made available for each of fiscal years 2007 through 2009 to carry out
			 <external-xref legal-doc="usc" parsable-cite="usc/23/502">section 502(h)</external-xref> of title 23, United States Code; and</text>
