<section id="H08E933D249FD4ED58DBC5D59C8A27287"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text> 
<paragraph id="HD7FBCE31DBDA486386CAB8C03D1174FF"><enum>(1)</enum><text>to approve and implement the Free Trade Agreement between the United States and Oman entered into under the authority of section 2103(b) of the Bipartisan Trade Promotion Authority Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/19/3803">19 U.S.C. 3803(b)</external-xref>);</text> </paragraph> 
<paragraph id="H260926B866724A8381DD61FFEB7C8626"><enum>(2)</enum><text>to strengthen and develop economic relations between the United States and Oman for their mutual benefit;</text> </paragraph> 
<paragraph id="HF927E3878D8B456ABC8C5F9081CF4CF2"><enum>(3)</enum><text>to establish free trade between the 2 nations through the reduction and elimination of barriers to trade in goods and services and to investment; and</text> </paragraph> 
<paragraph id="H6A977B84F3094BAC00AE9DF87993BFCC"><enum>(4)</enum><text>to lay the foundation for further cooperation to expand and enhance the benefits of such Agreement.</text> </paragraph></section> 
<section id="H351BA86263424198B03B2CB80940CA15"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HDBF9DD60A28B464C8CDEB484B54EF3EF"><enum>(1)</enum><header>Agreement</header><text>The term <term>Agreement</term> means the United States-Oman Free Trade Agreement approved by Congress under section 101(a)(1).</text> </paragraph> 
<paragraph id="HFFAB6455C64D4B7B84E251E572EE4000"><enum>(2)</enum><header>HTS</header><text>The term <term>HTS</term> means the Harmonized Tariff Schedule of the United States.</text> </paragraph> 
<paragraph id="H9D07FA26399248E6A2EF6B930348B4D2"><enum>(3)</enum><header>Textile or apparel good</header><text>The term <term>textile or apparel good</term> means a good listed in the Annex to the Agreement on Textiles and Clothing referred to in section 101(d)(4) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(4)</external-xref>).</text> </paragraph></section> 
<title id="H211FBFD00C6045328F7BBCFA005FFEE"><enum>I</enum><header>Approval of, and general provisions relating to, the agreement</header> 
<section id="H1B76B0B4505B4B228DC79218471857C4"><enum>101.</enum><header>Approval and entry into force of the Agreement</header> 
<subsection id="HE08A48823D934383B2DB42D430CCF88E"><enum>(a)</enum><header>Approval of agreement and statement of administrative action</header><text>Pursuant to section 2105 of the Bipartisan Trade Promotion Authority Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/19/3805">19 U.S.C. 3805</external-xref>) and section 151 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2191">19 U.S.C. 2191</external-xref>), Congress approves—</text> 
<paragraph id="HD3B499BA3B79466496ECAAC076DD6E09"><enum>(1)</enum><text>the United States-Oman Free Trade Agreement entered into on January 19, 2006, with Oman and submitted to Congress on June 26, 2006; and</text> </paragraph> 
<paragraph id="H5692CACECB304AA0A335009B55059952"><enum>(2)</enum><text>the statement of administrative action proposed to implement the Agreement that was submitted to Congress on June 26, 2006.</text> </paragraph></subsection> 
<subsection id="H9821B167B17C4336AC00D33EF2ACE46E"><enum>(b)</enum><header>Conditions for entry into force of the agreement</header><text>At such time as the President determines that Oman has taken measures necessary to bring it into compliance with those provisions of the Agreement that are to take effect on the date on which the Agreement enters into force, the President is authorized to exchange notes with the Government of Oman providing for the entry into force, on or after January 1, 2007, of the Agreement with respect to the United States.</text> </subsection></section> 
<section id="H815BC4B40E5342029500774C4FD84EC2"><enum>102.</enum><header>Relationship of the Agreement to United States and State law</header> 
<subsection id="H6F77773971704F40BC1115BB2432BC3D"><enum>(a)</enum><header>Relationship of agreement to united states law</header> 
<paragraph id="H8A86A0CA58AB4E3FA6E7B2DFDA5258F3"><enum>(1)</enum><header>United States law to prevail in conflict</header><text>No provision of the Agreement, nor the application of any such provision to any person or circumstance, which is inconsistent with any law of the United States shall have effect.</text> </paragraph> 
<paragraph id="HA0D18BCDE2B94F2582FD44E3BC2F9D08"><enum>(2)</enum><header>Construction</header><text>Nothing in this Act shall be construed—</text> 
<subparagraph id="H86068BF277C044F6B5D00D405CEDD3"><enum>(A)</enum><text>to amend or modify any law of the United States, or</text> </subparagraph> 
<subparagraph id="H2870EC7617D740CDB845009E79F0B768"><enum>(B)</enum><text>to limit any authority conferred under any law of the United States,</text> </subparagraph><continuation-text continuation-text-level="paragraph">unless specifically provided for in this Act.</continuation-text></paragraph></subsection> 
<subsection id="H01CA6ED11B874C808B6DC14C2E6CADB"><enum>(b)</enum><header>Relationship of agreement to state law</header> 
<paragraph id="HA5FE5C3CE3264E289E524EDB37F65C05"><enum>(1)</enum><header>Legal challenge</header><text>No State law, or the application thereof, may be declared invalid as to any person or circumstance on the ground that the provision or application is inconsistent with the Agreement, except in an action brought by the United States for the purpose of declaring such law or application invalid.</text> </paragraph> 
<paragraph id="H34E0196D03954D72964C18BA5DF0B82C"><enum>(2)</enum><header>Definition of State law</header><text>For purposes of this subsection, the term <term>State law</term> includes—</text> 
<subparagraph id="H6896CD695D654791A0DE4BDA6643E1A5"><enum>(A)</enum><text>any law of a political subdivision of a State; and</text> </subparagraph> 
<subparagraph id="H0D7CF269B3EB4D42A64C6C44557052E"><enum>(B)</enum><text>any State law regulating or taxing the business of insurance.</text> </subparagraph></paragraph></subsection> 
<subsection id="H54649B53500A4B469112DECCA27848DA"><enum>(c)</enum><header>Effect of agreement with respect to private remedies</header><text>No person other than the United States—</text> 
<paragraph id="HECBE5A26E5C34E09A7971BF09EF47E5B"><enum>(1)</enum><text>shall have any cause of action or defense under the Agreement or by virtue of congressional approval thereof; or</text> </paragraph> 
<paragraph id="H39DEE92F2E2243C0814F2025F63C4F63"><enum>(2)</enum><text>may challenge, in any action brought under any provision of law, any action or inaction by any department, agency, or other instrumentality of the United States, any State, or any political subdivision of a State, on the ground that such action or inaction is inconsistent with the Agreement.</text> </paragraph></subsection></section> 
<section id="HCCDFCD07C26D47449590B3F4849DDA9E"><enum>103.</enum><header>Implementing actions in anticipation of entry into force and initial regulations</header> 
<subsection id="HE9D1231F87BE4B269FDF07C153D7B9B8"><enum>(a)</enum><header>Implementing actions</header> 
<paragraph id="H3F7528E680854DA1805468E30000374F"><enum>(1)</enum><header>Proclamation authority</header><text>After the date of the enactment of this Act—</text> 
<subparagraph id="H2ADBB0284E944EF9989B99DECA736C24"><enum>(A)</enum><text>the President may proclaim such actions, and</text> </subparagraph> 
<subparagraph id="H0223EE473C764150BEDCFBCE2E587F1B"><enum>(B)</enum><text>other appropriate officers of the United States Government may issue such regulations,</text> </subparagraph><continuation-text continuation-text-level="paragraph">as may be necessary to ensure that any provision of this Act, or amendment made by this Act, that takes effect on the date on which the Agreement enters into force is appropriately implemented on such date, but no such proclamation or regulation may have an effective date earlier than the date on which the Agreement enters into force.</continuation-text></paragraph> 
<paragraph id="HD165B8059F874DC5AF3611E8D927C176"><enum>(2)</enum><header>Effective date of certain proclaimed actions</header><text>Any action proclaimed by the President under the authority of this Act that is not subject to the consultation and layover provisions under section 104 may not take effect before the 15th day after the date on which the text of the proclamation is published in the Federal Register.</text> </paragraph> 
<paragraph id="HDD924532285649B9B06556DCD1719B47"><enum>(3)</enum><header>Waiver of 15-day restriction</header><text>The 15-day restriction in paragraph (2) on the taking effect of proclaimed actions is waived to the extent that the application of such restriction would prevent the taking effect on the date on which the Agreement enters into force of any action proclaimed under this section.</text> </paragraph></subsection> 
<subsection id="H4B5C3B92A3A24BEEB2638116D74E971C"><enum>(b)</enum><header>Initial regulations</header><text>Initial regulations necessary or appropriate to carry out the actions required by or authorized under this Act or proposed in the statement of administrative action submitted under section 101(a)(2) to implement the Agreement shall, to the maximum extent feasible, be issued within 1 year after the date on which the Agreement enters into force. In the case of any implementing action that takes effect on a date after the date on which the Agreement enters into force, initial regulations to carry out that action shall, to the maximum extent feasible, be issued within 1 year after such effective date.</text> </subsection></section> 
<section id="H3C071DF3D8DB4D06BCED2322CAD8A95C"><enum>104.</enum><header>Consultation and layover provisions for, and effective date of, proclaimed actions</header><text display-inline="no-display-inline">If a provision of this Act provides that the implementation of an action by the President by proclamation is subject to the consultation and layover requirements of this section, such action may be proclaimed only if—</text> 
<paragraph id="H3EB99DCA2FCA4D5FA1E10062CD5E7B37"><enum>(1)</enum><text>the President has obtained advice regarding the proposed action from—</text> 
<subparagraph id="HB3775E0E547B41BAB29F63DC0097CF69"><enum>(A)</enum><text>the appropriate advisory committees established under section 135 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2155">19 U.S.C. 2155</external-xref>); and</text> </subparagraph> 
<subparagraph id="H303C3E24004A46EE9CBA233F3F005D74"><enum>(B)</enum><text>the United States International Trade Commission;</text> </subparagraph></paragraph> 
<paragraph id="H2B1A9D261F8245678077635682D00084"><enum>(2)</enum><text>the President has submitted to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives a report that sets forth—</text> 
<subparagraph id="HF35F3222E07F4998A591B3CF53CCD9BE"><enum>(A)</enum><text>the action proposed to be proclaimed and the reasons therefor; and</text> </subparagraph> 
<subparagraph id="H97E94623088A41C0BB6D64FCB8E1A478"><enum>(B)</enum><text>the advice obtained under paragraph (1);</text> </subparagraph></paragraph> 
<paragraph id="H822B45A10F564610AE342E565400FF16"><enum>(3)</enum><text>a period of 60 calendar days, beginning on the first day on which the requirements set forth in paragraphs (1) and (2) have been met has expired; and</text> </paragraph> 
<paragraph id="H08FC54FFF11649D8987D10A5A7683673"><enum>(4)</enum><text>the President has consulted with the Committees referred to in paragraph (2) regarding the proposed action during the period referred to in paragraph (3).</text> </paragraph></section> 
<section id="H0A097895C96D4BCAAFC5DD896D6D33F1"><enum>105.</enum><header>Administration of Dispute Settlement proceedings</header> 
<subsection id="H9377EDBFC6FC4FE092EFFCEFF614FF0"><enum>(a)</enum><header>Establishment or designation of office</header><text>The President is authorized to establish or designate within the Department of Commerce an office that shall be responsible for providing administrative assistance to panels established under chapter 20 of the Agreement. The office may not be considered to be an agency for purposes of <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code.</text> </subsection> 
<subsection id="H464F05E30BF548878CA6443ED3B23E69"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for each fiscal year after fiscal year 2006 to the Department of Commerce such sums as may be necessary for the establishment and operations of the office established or designated under subsection (a) and for the payment of the United States share of the expenses of panels established under chapter 20 of the Agreement.</text> </subsection></section> 
<section id="HB7341BEFD4404A7B008B35EEB7CBD84C"><enum>106.</enum><header>Arbitration of claims</header><text display-inline="no-display-inline">The United States is authorized to resolve any claim against the United States covered by article 10.15.1(a)(i)(C) or article 10.15.1(b)(i)(C) of the Agreement, pursuant to the Investor-State Dispute Settlement procedures set forth in section B of chapter 10 of the Agreement.</text> </section> 
<section id="HF242847D726C4213A861BC4239FFA2B"><enum>107.</enum><header>Effective dates; effect of termination</header> 
<subsection id="H961B940D393F4FBE9CED1F92DC9F4C47"><enum>(a)</enum><header>Effective dates</header><text>Except as provided in subsection (b), the provisions of this Act and the amendments made by this Act take effect on the date on which the Agreement enters into force.</text> </subsection> 
<subsection id="H019B73182BBC43C8AA4C913200B78BEB"><enum>(b)</enum><header>Exceptions</header><text>Sections 1 through 3 and this title take effect on the date of the enactment of this Act.</text> </subsection> 
<subsection id="H530E9962C64E46C184003ED657346794"><enum>(c)</enum><header>Termination of the agreement</header><text>On the date on which the Agreement terminates, the provisions of this Act (other than this subsection) and the amendments made by this Act shall cease to be effective.</text> </subsection></section></title> 
<title id="HB51D62CA322D474DB800A29267DFD8D"><enum>II</enum><header>Customs provisions</header> 
<section id="H6B7961FF155C4B22BED1D0D500ED22FB"><enum>201.</enum><header>Tariff modifications</header> 
<subsection id="HDBF3DC786F5343BD98C05D42F1EFC72E"><enum>(a)</enum><header>Tariff modifications provided for in the Agreement</header> 
<paragraph id="HF77012F828D44F52A8CC9D0D779BD9D"><enum>(1)</enum><header>Proclamation authority</header><text>The President may proclaim—</text> 
<subparagraph id="H8C79854CB7194D36BC84698D42002507"><enum>(A)</enum><text>such modifications or continuation of any duty,</text> </subparagraph> 
<subparagraph id="H7769C698F85C4166B97BBD34B1AED6E6"><enum>(B)</enum><text>such continuation of duty-free or excise treatment, or</text> </subparagraph> 
<subparagraph id="H1786BDBE46654503876250E26F9FCE5"><enum>(C)</enum><text>such additional duties,</text> </subparagraph><continuation-text continuation-text-level="paragraph">as the President determines to be necessary or appropriate to carry out or apply articles 2.3, 2.5, 2.6, 3.2.8, and 3.2.9, and Annex 2–B of the Agreement.</continuation-text></paragraph> 
<paragraph id="H5FC885EECF67442B888B3007F282D068"><enum>(2)</enum><header>Effect on Omani GSP status</header><text>Notwithstanding section 502(a)(1) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2462">19 U.S.C. 2462(a)(1)</external-xref>), the President shall, on the date on which the Agreement enters into force, terminate the designation of Oman as a beneficiary developing country for purposes of title V of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2461">19 U.S.C. 2461 et seq.</external-xref>).</text> </paragraph></subsection> 
<subsection id="H532007BABB0D421BA7BFC300D8FBF468"><enum>(b)</enum><header>Other tariff modifications</header><text>Subject to the consultation and layover provisions of section 104, the President may proclaim—</text> 
<paragraph id="H13C14764942D4C2FAC4E6CB7B11454E8"><enum>(1)</enum><text>such modifications or continuation of any duty,</text> </paragraph> 
<paragraph id="HE2B42284A9684AD9857CD1777B23A06F"><enum>(2)</enum><text>such modifications as the United States may agree to with Oman regarding the staging of any duty treatment set forth in Annex 2–B of the Agreement,</text> </paragraph> 
<paragraph id="H070DF2484A044564B9E20584FA1783DB"><enum>(3)</enum><text>such continuation of duty-free or excise treatment, or</text> </paragraph> 
<paragraph id="HD7B2EF27C5394B1E8EFD26FBE6980E4"><enum>(4)</enum><text>such additional duties,</text> </paragraph><continuation-text continuation-text-level="subsection">as the President determines to be necessary or appropriate to maintain the general level of reciprocal and mutually advantageous concessions with respect to Oman provided for by the Agreement.</continuation-text></subsection> 
<subsection id="H52431104F96943C2BDAE54CA9DAAEF81"><enum>(c)</enum><header>Conversion to ad valorem rates</header><text>For purposes of subsections (a) and (b), with respect to any good for which the base rate in the Tariff Schedule of the United States to Annex 2–B of the Agreement is a specific or compound rate of duty, the President may substitute for the base rate an ad valorem rate that the President determines to be equivalent to the base rate.</text> </subsection></section> 
<section id="H5DA51D88F5A1478F807D538BF8838E34"><enum>202.</enum><header>Rules of origin</header> 
<subsection id="HC1F5426958EF447DBFD95326BFF1DD51"><enum>(a)</enum><header>Application and interpretation</header><text>In this section:</text> 
<paragraph id="HB25A1CAC67AD4A90A89BD0E500DD0202"><enum>(1)</enum><header>Tariff classification</header><text>The basis for any tariff classification is the HTS.</text> </paragraph> 
<paragraph id="HC644169BC70B40C0B283B66BD1AFFD6B"><enum>(2)</enum><header>Reference to HTS</header><text>Whenever in this section there is a reference to a heading or subheading, such reference shall be a reference to a heading or subheading of the HTS.</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H7A21AA5899544DBD9BDFCA4E7E62762C"><enum>(b)</enum><header>Originating goods</header> 
<paragraph id="H0ECD300FAD3F4474A1F1BC903BE1E200"><enum>(1)</enum><header>In general</header><text>For purposes of this Act and for purposes of implementing the preferential tariff treatment provided for under the Agreement, a good is an originating good if—</text> 
<subparagraph id="H14E1F3B10D2946E196100029FFD1468"><enum>(A)</enum><text>the good is imported directly—</text> 
<clause id="H476E370FEDE749539EA7FA674339DC8"><enum>(i)</enum><text>from the territory of Oman into the territory of the United States; or</text> </clause> 
<clause id="HBE0998C5FE8D467DAC95BF7D0047C684"><enum>(ii)</enum><text>from the territory of the United States into the territory of Oman; and</text> </clause></subparagraph> 
<subparagraph id="H58717B95A083446B8BA8734D8E18375C"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H1FD247794E0A47D8A244D80086753165"><enum>(i)</enum><text>the good is a good wholly the growth, product, or manufacture of Oman or the United States, or both;</text> </clause> 
<clause id="HE28BB06B449B42C981F4315EB2EB4CEE" indent="up1"><enum>(ii)</enum><text>the good (other than a good to which clause (iii) applies) is a new or different article of commerce that has been grown, produced, or manufactured in Oman or the United States, or both, and meets the requirements of paragraph (2); or</text> </clause> 
<clause id="H71EBA067C18045FA8DA0361564009B8F" indent="up1"><enum>(iii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="HB562C3E1A06A4273A98E0099A4C54FCA"><enum>(I)</enum><text>the good is a good covered by Annex 3–A or 4–A of the Agreement;</text> </subclause> 
<subclause id="H6B75117D9AC64567A672D7C65FCC2E8" indent="up1"><enum>(II)</enum> 
<item commented="no" display-inline="yes-display-inline" id="HEC2F7BE4AC03400ABA529E9D13282899"><enum>(aa)</enum><text>each of the nonoriginating materials used in the production of the good undergoes an applicable change in tariff classification specified in such Annex as a result of production occurring entirely in the territory of Oman or the United States, or both; or</text> </item> 
<item id="H48B4C5157C1A44C0B98C3C4C6FCA69C4" indent="up1"><enum>(bb)</enum><text>the good otherwise satisfies the requirements specified in such Annex; and</text> </item></subclause> 
<subclause id="H49F1188C7D4E473BA6C15B80B8168BF9" indent="up1"><enum>(III)</enum><text>the good satisfies all other applicable requirements of this section.</text> </subclause></clause></subparagraph></paragraph> 
<paragraph id="HAD1CE98A66D247C8B90094FF382BDBEB"><enum>(2)</enum><header>Requirements</header><text>A good described in paragraph (1)(B)(ii) is an originating good only if the sum of—</text> 
<subparagraph id="H0918FF8FC74F4873953974D5DE6371BF"><enum>(A)</enum><text>the value of each material produced in the territory of Oman or the United States, or both, and</text> </subparagraph> 
<subparagraph id="H0CAB8EB12A56498A9DFC8F7FEE6B09C0"><enum>(B)</enum><text>the direct costs of processing operations performed in the territory of Oman or the United States, or both,</text> </subparagraph><continuation-text continuation-text-level="paragraph">is not less than 35 percent of the appraised value of the good at the time the good is entered into the territory of the United States.</continuation-text></paragraph></subsection> 
<subsection id="H70B256B05BE34CE8A4559B85CAB3D134"><enum>(c)</enum><header>Cumulation</header> 
<paragraph id="HFC635B0F5B384E19A46B29982BF6C5DA"><enum>(1)</enum><header>Originating good or material incorporated into goods of other country</header><text>An originating good, or a material produced in the territory of Oman or the United States, or both, that is incorporated into a good in the territory of the other country shall be considered to originate in the territory of the other country.</text> </paragraph> 
<paragraph id="HA105E41A71AE41488F57C66107BB461C"><enum>(2)</enum><header>Multiple producers</header><text>A good that is grown, produced, or manufactured in the territory of Oman or the United States, or both, by 1 or more producers, is an originating good if the good satisfies the requirements of subsection (b) and all other applicable requirements of this section.</text> </paragraph></subsection> 
<subsection id="HE8FBC508AD8B4DAB86A112ADF76244F"><enum>(d)</enum><header>Value of materials</header> 
<paragraph id="H8B7F85F5EE4D43AF9E0143BABDAB7402"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the value of a material produced in the territory of Oman or the United States, or both, includes the following:</text> 
<subparagraph id="H54B52C1F923A4F1F999054C2EE70DF1F"><enum>(A)</enum><text>The price actually paid or payable for the material by the producer of the good.</text> </subparagraph> 
<subparagraph id="HBDA4053339AC4173B5085EBCD086BE90"><enum>(B)</enum><text>The freight, insurance, packing, and all other costs incurred in transporting the material to the producer’s plant, if such costs are not included in the price referred to in subparagraph (A).</text> </subparagraph> 
<subparagraph id="HDF4961C0377343F1A8661163A1C9CCF4"><enum>(C)</enum><text>The cost of waste or spoilage resulting from the use of the material in the growth, production, or manufacture of the good, less the value of recoverable scrap.</text> </subparagraph> 
<subparagraph id="H25B9CD2C75E747AD85836F0501A17810"><enum>(D)</enum><text>Taxes or customs duties imposed on the material by Oman or the United States, or both, if the taxes or customs duties are not remitted upon exportation from the territory of Oman or the United States, as the case may be.</text> </subparagraph></paragraph> 
<paragraph id="H830CADEC801441B1833365B6418597AD"><enum>(2)</enum><header>Exception</header><text>If the relationship between the producer of a good and the seller of a material influenced the price actually paid or payable for the material, or if there is no price actually paid or payable by the producer for the material, the value of the material produced in the territory of Oman or the United States, or both, includes the following:</text> 
<subparagraph id="H7A92C2707F1F4C25A244C021382E0602"><enum>(A)</enum><text>All expenses incurred in the growth, production, or manufacture of the material, including general expenses.</text> </subparagraph> 
<subparagraph id="HCFAEBCDC6FFD48BF83F412D93DF77062"><enum>(B)</enum><text>A reasonable amount for profit.</text> </subparagraph> 
<subparagraph id="H4E67FD4B88CF4D7C91AA00A81257D7A3"><enum>(C)</enum><text>Freight, insurance, packing, and all other costs incurred in transporting the material to the producer’s plant.</text> </subparagraph></paragraph></subsection> 
<subsection id="H48BA09474BB6433B87918DFCCD963C75"><enum>(e)</enum><header>Packaging and packing materials and containers for retail sale and for shipment</header><text>Packaging and packing materials and containers for retail sale and shipment shall be disregarded in determining whether a good qualifies as an originating good, except to the extent that the value of such packaging and packing materials and containers has been included in meeting the requirements set forth in subsection (b)(2).</text> </subsection> 
<subsection id="H6A9267721E3C4B9F90F2DEC54E781BE2"><enum>(f)</enum><header>Indirect materials</header><text>Indirect materials shall be disregarded in determining whether a good qualifies as an originating good, except that the cost of such indirect materials may be included in meeting the requirements set forth in subsection (b)(2).</text> </subsection> 
<subsection id="HC85FB62EC602489F9C8C0010E2B676B0"><enum>(g)</enum><header>Transit and transshipment</header><text>A good shall not be considered to meet the requirement of subsection (b)(1)(A) if, after exportation from the territory of Oman or the United States, the good undergoes production, manufacturing, or any other operation outside the territory of Oman or the United States, other than unloading, reloading, or any other operation necessary to preserve the good in good condition or to transport the good to the territory of Oman or the United States.</text> </subsection> 
<subsection id="HB0F8CB588BB2446188E81E736CD1F7C4"><enum>(h)</enum><header>Textile and apparel goods</header> 
<paragraph id="H740225D503AB4C898195239EF7CF5178"><enum>(1)</enum><header>De minimis amounts of nonoriginating materials</header> 
<subparagraph id="H3E28E91494A947008B656155ACE3A7D0"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a textile or apparel good that is not an originating good because certain fibers or yarns used in the production of the component of the good that determines the tariff classification of the good do not undergo an applicable change in tariff classification set out in Annex 3–A of the Agreement shall be considered to be an originating good if the total weight of all such fibers or yarns in that component is not more than 7 percent of the total weight of that component.</text> </subparagraph> 
<subparagraph id="HD3BE32B820F5494F88B000FB97EA76C8"><enum>(B)</enum><header>Certain textile or apparel goods</header><text>A textile or apparel good containing elastomeric yarns in the component of the good that determines the tariff classification of the good shall be considered to be an originating good only if such yarns are wholly formed in the territory of Oman or the United States.</text> </subparagraph> 
<subparagraph id="H0EAAF6272B5B497083DFF036DBBDFAA"><enum>(C)</enum><header>Yarn, fabric, or group of fibers</header><text>For purposes of this paragraph, in the case of a textile or apparel good that is a yarn, fabric, or group of fibers, the term <term>component of the good that determines the tariff classification of the good</term> means all of the fibers in the yarn, fabric, or group of fibers.</text> </subparagraph></paragraph> 
<paragraph id="H59174DE46DE0405692FDDE7FED6A24F"><enum>(2)</enum><header>Goods put up in sets for retail sale</header><text>Notwithstanding the rules set forth in Annex 3–A of the Agreement, textile or apparel goods classifiable as goods put up in sets for retail sale as provided for in General Rule of Interpretation 3 of the HTS shall not be considered to be originating goods unless each of the goods in the set is an originating good or the total value of the nonoriginating goods in the set does not exceed 10 percent of the value of the set determined for purposes of assessing customs duties.</text> </paragraph></subsection> 
<subsection id="H339D53E712B44479B666983165592F98"><enum>(i)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HF0724A15A3C941B5B106F0CA3FDD9792"><enum>(1)</enum><header>Direct costs of processing operations</header> 
<subparagraph id="H5EA29FC618AF4613B8109521F04D23A8"><enum>(A)</enum><header>In general</header><text>The term <term>direct costs of processing operations</term>, with respect to a good, includes, to the extent they are includable in the appraised value of the good when imported into Oman or the United States, as the case may be, the following:</text> 
<clause id="HB0D4A91746664292B241D6AA59002543"><enum>(i)</enum><text>All actual labor costs involved in the growth, production, or manufacture of the good, including fringe benefits, on-the-job training, and the cost of engineering, supervisory, quality control, and similar personnel.</text> </clause> 
<clause id="H7699C2416E7341E0B74C52E83120EE5D"><enum>(ii)</enum><text>Tools, dies, molds, and other indirect materials, and depreciation on machinery and equipment that are allocable to the good.</text> </clause> 
<clause id="HE43BE13174DF47EF913562A5B3DA99F9"><enum>(iii)</enum><text>Research, development, design, engineering, and blueprint costs, to the extent that they are allocable to the good.</text> </clause> 
<clause id="H7AA886C0AAD5436287B7D94666653695"><enum>(iv)</enum><text>Costs of inspecting and testing the good.</text> </clause> 
<clause id="H7E493E3EAE744AD4864D57C85022F075"><enum>(v)</enum><text>Costs of packaging the good for export to the territory of the other country.</text> </clause></subparagraph> 
<subparagraph id="HE897EF3B36AF477EADE95EE653AEFE72"><enum>(B)</enum><header>Exceptions</header><text>The term <term>direct costs of processing operations</term> does not include costs that are not directly attributable to a good or are not costs of growth, production, or manufacture of the good, such as—</text> 
<clause id="H7D421990781A4B779B828F60136E554E"><enum>(i)</enum><text>profit; and</text> </clause> 
<clause id="H7835BD0AF9C54FE2930600FD2C1C2607"><enum>(ii)</enum><text>general expenses of doing business that are either not allocable to the good or are not related to the growth, production, or manufacture of the good, such as administrative salaries, casualty and liability insurance, advertising, and sales staff salaries, commissions, or expenses.</text> </clause></subparagraph></paragraph> 
<paragraph id="HB72949CA93DF4E518F8F9604C1F7594E"><enum>(2)</enum><header>Good</header><text>The term <term>good</term> means any merchandise, product, article, or material.</text> </paragraph> 
<paragraph id="H53F5249F2F52434F834306BE44951082"><enum>(3)</enum><header>Good wholly the growth, product, or manufacture of oman or the united states, or both</header><text>The term <term>good wholly the growth, product, or manufacture of Oman or the United States, or both</term> means—</text> 
<subparagraph id="HE6B5327D7FFA4E5F9E7B00B933588FD4"><enum>(A)</enum><text>a mineral good extracted in the territory of Oman or the United States, or both;</text> </subparagraph> 
<subparagraph id="HB8C5DE52A9C343BABB293E0081005EA7"><enum>(B)</enum><text>a vegetable good, as such a good is provided for in the HTS, harvested in the territory of Oman or the United States, or both;</text> </subparagraph> 
<subparagraph id="H7372C5119C9C45A1B33E3439501FABAE"><enum>(C)</enum><text>a live animal born and raised in the territory of Oman or the United States, or both;</text> </subparagraph> 
<subparagraph id="H1B4D41662E9F4ABB9ED679F775C4EFCE"><enum>(D)</enum><text>a good obtained from live animals raised in the territory of Oman or the United States, or both;</text> </subparagraph> 
<subparagraph id="H0E3D192A8F154282BD84A82C0228E01F"><enum>(E)</enum><text>a good obtained from hunting, trapping, or fishing in the territory of Oman or the United States, or both;</text> </subparagraph> 
<subparagraph id="HDAC7284DA8B64071A7F9132D4CF398D3"><enum>(F)</enum><text>a good (fish, shellfish, and other marine life) taken from the sea by vessels registered or recorded with Oman or the United States and flying the flag of that country;</text> </subparagraph> 
<subparagraph id="H728E5FC670614E7AA4D068FD79006491"><enum>(G)</enum><text>a good produced from goods referred to in subparagraph (F) on board factory ships registered or recorded with Oman or the United States and flying the flag of that country;</text> </subparagraph> 
<subparagraph id="HBFEAF05DFACD409AB116DA31EEEEDC8B"><enum>(H)</enum><text>a good taken by Oman or the United States or a person of Oman or the United States from the seabed or beneath the seabed outside territorial waters, if Oman or the United States, as the case may be, has rights to exploit such seabed;</text> </subparagraph> 
<subparagraph id="HF58F11C7E0C84DA78BE6EE154B21C878"><enum>(I)</enum><text>a good taken from outer space, if such good is obtained by Oman or the United States or a person of Oman or the United States and not processed in the territory of a country other than Oman or the United States;</text> </subparagraph> 
<subparagraph id="H0B39488E2F8D409488A373D33CA5769D"><enum>(J)</enum><text>waste and scrap derived from—</text> 
<clause id="H6FB4309A057B439FA486F16671E0223"><enum>(i)</enum><text>production or manufacture in the territory of Oman or the United States, or both; or</text> </clause> 
<clause id="HC94E64DD34594D35889E988E1E089705"><enum>(ii)</enum><text>used goods collected in the territory of Oman or the United States, or both, if such goods are fit only for the recovery of raw materials;</text> </clause></subparagraph> 
<subparagraph id="H130360ED6955438BB848004128B38DB0"><enum>(K)</enum><text>a recovered good derived in the territory of Oman or the United States from used goods and utilized in the territory of that country in the production of remanufactured goods; and</text> </subparagraph> 
<subparagraph id="H6ED04A903A7F4D8BBD7BAC899EA386D"><enum>(L)</enum><text>a good produced in the territory of Oman or the United States, or both, exclusively—</text> 
<clause id="H5F1F3222346140FF998BCBD61135005F"><enum>(i)</enum><text>from goods referred to in subparagraphs (A) through (J), or</text> </clause> 
<clause id="HD08E97DC973143E2B0840117C6808422"><enum>(ii)</enum><text>from the derivatives of goods referred to in clause (i),</text> </clause><continuation-text continuation-text-level="subparagraph">at any stage of production.</continuation-text></subparagraph></paragraph> 
<paragraph id="H489E2B31521745D29B550394E4807BE3"><enum>(4)</enum><header>Indirect material</header><text>The term <term>indirect material</term> means a good used in the growth, production, manufacture, testing, or inspection of a good but not physically incorporated into the good, or a good used in the maintenance of buildings or the operation of equipment associated with the growth, production, or manufacture of a good, including—</text> 
<subparagraph id="HD11970384010492980EB6FC11EF17E06"><enum>(A)</enum><text>fuel and energy;</text> </subparagraph> 
<subparagraph id="H13651D4489EC4669BEDC60A08E8EC867"><enum>(B)</enum><text>tools, dies, and molds;</text> </subparagraph> 
<subparagraph id="H7343CEF7B194463AB1ADF07408EF5174"><enum>(C)</enum><text>spare parts and materials used in the maintenance of equipment and buildings;</text> </subparagraph> 
<subparagraph id="H55DB0D57179C4A81B272DE0389BE6593"><enum>(D)</enum><text>lubricants, greases, compounding materials, and other materials used in the growth, production, or manufacture of a good or used to operate equipment and buildings;</text> </subparagraph> 
<subparagraph id="H9C14BBC29C524D72991FDF9184FFF9C"><enum>(E)</enum><text>gloves, glasses, footwear, clothing, safety equipment, and supplies;</text> </subparagraph> 
<subparagraph id="H21856EBF5061479F8F4C86F731689094"><enum>(F)</enum><text>equipment, devices, and supplies used for testing or inspecting the good;</text> </subparagraph> 
<subparagraph id="H80A8EDBEF451450DACD3F05DE65FFC65"><enum>(G)</enum><text>catalysts and solvents; and</text> </subparagraph> 
<subparagraph id="H28EF4E31D3B340BF8B76623182B582B"><enum>(H)</enum><text>any other goods that are not incorporated into the good but the use of which in the growth, production, or manufacture of the good can reasonably be demonstrated to be a part of that growth, production, or manufacture.</text> </subparagraph></paragraph> 
<paragraph id="H3A0382117B464EF1BCB45363C7A6E387"><enum>(5)</enum><header>Material</header><text>The term <term>material</term> means a good, including a part or ingredient, that is used in the growth, production, or manufacture of another good that is a new or different article of commerce that has been grown, produced, or manufactured in Oman or the United States, or both.</text> </paragraph> 
<paragraph id="H9546A4B959914DB48E6E9E2299D93FB0"><enum>(6)</enum><header>Material produced in the territory of Oman or the United States, or both</header><text>The term <term>material produced in the territory of Oman or the United States, or both</term> means a good that is either wholly the growth, product, or manufacture of Oman or the United States, or both, or a new or different article of commerce that has been grown, produced, or manufactured in the territory of Oman or the United States, or both.</text> </paragraph> 
<paragraph id="HFCD977B4DE864A04A70008F25246E768"><enum>(7)</enum><header>New or different article of commerce</header> 
<subparagraph id="HDBA8BDF466874E12944BE709D82608AD"><enum>(A)</enum><header>In general</header><text>The term <term>new or different article of commerce</term> means, except as provided in subparagraph (B), a good that—</text> 
<clause id="H4F060EBAA4164D699C920073867DB27E"><enum>(i)</enum><text>has been substantially transformed from a good or material that is not wholly the growth, product, or manufacture of Oman or the United States, or both; and</text> </clause> 
<clause id="H0353031383E349A9841E2ED4BBDBACA"><enum>(ii)</enum><text>has a new name, character, or use distinct from the good or material from which it was transformed.</text> </clause></subparagraph> 
<subparagraph id="H415EFF10B11B49BB81AEAFCFC76F6118"><enum>(B)</enum><header>Exception</header><text>A good shall not be considered a new or different article of commerce by virtue of having undergone simple combining or packaging operations, or mere dilution with water or another substance that does not materially alter the characteristics of the good.</text> </subparagraph></paragraph> 
<paragraph id="H0A8C1F191C53476DA45B5632938165AF"><enum>(8)</enum><header>Recovered goods</header><text>The term <term>recovered goods</term> means materials in the form of individual parts that result from—</text> 
<subparagraph id="H4668F3A2D57448908F63138D8609C610"><enum>(A)</enum><text>the disassembly of used goods into individual parts; and</text> </subparagraph> 
<subparagraph id="HC8100CEF4416453B800000C415F4D0D9"><enum>(B)</enum><text>the cleaning, inspecting, testing, or other processing of those parts as necessary for improvement to sound working condition.</text> </subparagraph></paragraph> 
<paragraph id="HEC272C930C9440AAAADEF5220063005C"><enum>(9)</enum><header>Remanufactured good</header><text>The term <term>remanufactured good</term> means an industrial good that is assembled in the territory of Oman or the United States and that—</text> 
<subparagraph id="HFA58F4D2DF0F4886BC7E216C4EBF2D7D"><enum>(A)</enum><text>is entirely or partially comprised of recovered goods;</text> </subparagraph> 
<subparagraph id="HC881C1B3A8D54D079003DF471384CB8D"><enum>(B)</enum><text>has a similar life expectancy to a like good that is new; and</text> </subparagraph> 
<subparagraph id="H33703E2794044B658894651509AC3C56"><enum>(C)</enum><text>enjoys a factory warranty similar to that of a like good that is new.</text> </subparagraph></paragraph> 
<paragraph id="H3B7A47A1F92741DCB041B2217B52295E"><enum>(10)</enum><header>Simple combining or packaging operations</header><text>The term <term>simple combining or packaging operations</term> means operations such as adding batteries to devices, fitting together a small number of components by bolting, gluing, or soldering, and repacking or packaging components together.</text> </paragraph> 
<paragraph id="H80F2473496D54514B641678C4F56C7A5"><enum>(11)</enum><header>Substantially transformed</header><text>The term <term>substantially transformed</term> means, with respect to a good or material, changed as the result of a manufacturing or processing operation so that—</text> 
<subparagraph id="H3EBA8D35EFE940B4929122318700755F"><enum>(A)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H172BFEF1AF5C4C1C979B40CFC4A0B127"><enum>(i)</enum><text>the good or material is converted from a good that has multiple uses into a good or material that has limited uses;</text> </clause> 
<clause id="HCE201B44B7A540459F00E48B13D4350" indent="up1"><enum>(ii)</enum><text>the physical properties of the good or material are changed to a significant extent; or</text> </clause> 
<clause id="H2D818B6C94FA4537982D75A9A988CA14" indent="up1"><enum>(iii)</enum><text>the operation undergone by the good or material is complex by reason of the number of different processes and materials involved and the time and level of skill required to perform those processes; and</text> </clause></subparagraph> 
<subparagraph id="H09EB189C65D04608A42B72F9B34E00C6"><enum>(B)</enum><text>the good or material loses its separate identity in the manufacturing or processing operation.</text> </subparagraph></paragraph></subsection> 
<subsection id="H8E57C3A2680447BBB6162D5CE7F99FF2"><enum>(j)</enum><header>Presidential proclamation authority</header> 
<paragraph id="H8964677F693147D0A49897393F906C75"><enum>(1)</enum><header>In general</header><text>The President is authorized to proclaim, as part of the HTS—</text> 
<subparagraph id="HA59F2B6D32E74E7D80DC64D1AC1519B9"><enum>(A)</enum><text>the provisions set forth in Annex 3–A and Annex 4–A of the Agreement; and</text> </subparagraph> 
<subparagraph id="HC1F7E4F052584666833514F6DA8F72FA"><enum>(B)</enum><text>any additional subordinate category that is necessary to carry out this title, consistent with the Agreement.</text> </subparagraph></paragraph> 
<paragraph id="HC9882477DF754327BD99DCEE7439AB5E"><enum>(2)</enum><header>Modifications</header> 
<subparagraph id="HEB2B9F66C9784450A89B8C0995671741"><enum>(A)</enum><header>In general</header><text>Subject to the consultation and layover provisions of section 104, the President may proclaim modifications to the provisions proclaimed under the authority of paragraph (1)(A), other than provisions of chapters 50 through 63 of the HTS (as included in Annex 3–A of the Agreement).</text> </subparagraph> 
<subparagraph id="H8C1228B36C1F4E79878211EFEED8BFA5"><enum>(B)</enum><header>Additional proclamations</header><text>Notwithstanding subparagraph (A), and subject to the consultation and layover provisions of section 104, the President may proclaim—</text> 
<clause id="H4F85B74AE12B4A73BE64F0AD91210083"><enum>(i)</enum><text>modifications to the provisions proclaimed under the authority of paragraph (1)(A) as are necessary to implement an agreement with Oman pursuant to article 3.2.5 of the Agreement; and</text> </clause> 
<clause id="H05D0412DADA249C0B5E72DE2CAA8363B"><enum>(ii)</enum><text>before the end of the 1-year period beginning on the date of the enactment of this Act, modifications to correct any typographical, clerical, or other nonsubstantive technical error regarding the provisions of chapters 50 through 63 of the HTS (as included in Annex 3–A of the Agreement).</text> </clause></subparagraph></paragraph></subsection></section> 
<section id="H8D0951E815954E6EAB8565FF4E001CB5"><enum>203.</enum><header>Customs user fees</header><text display-inline="no-display-inline">Section 13031(b) of the Consolidated Omnibus Budget Reconciliation Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/19/58c">19 U.S.C. 58c(b)</external-xref>) is amended by adding after paragraph (16) the following:</text> 
<quoted-block id="HE79A9817688B4DBEB3442DBE83B62DC6" style="OLC"> 
<paragraph id="H9EAFD623FBD4478A99655DEE22A82372" indent="up1"><enum>(17)</enum><text>No fee may be charged under subsection (a) (9) or (10) with respect to goods that qualify as originating goods under section 202 of the United States-Oman Free Trade Agreement Implementation Act. Any service for which an exemption from such fee is provided by reason of this paragraph may not be funded with money contained in the Customs User Fee Account.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="HF6432A0E074F4918A374BAD4A67697C"><enum>204.</enum><header>Enforcement relating to trade in textile and apparel goods</header> 
<subsection id="H4EB864218100479FB8B85DA9FD779513"><enum>(a)</enum><header>Action during verification</header> 
<paragraph id="HE9C700423E3244DC923D3952ED1D3461"><enum>(1)</enum><header>In general</header><text>If the Secretary of the Treasury requests the Government of Oman to conduct a verification pursuant to article 3.3 of the Agreement for purposes of making a determination under paragraph (2), the President may direct the Secretary to take appropriate action described in subsection (b) while the verification is being conducted.</text> </paragraph> 
<paragraph id="HCC2637440C094CBBB945BD24D841BFDF"><enum>(2)</enum><header>Determination</header><text>A determination under this paragraph is a determination—</text> 
<subparagraph id="HA0DE007B750E430588877222312F083B"><enum>(A)</enum><text>that an exporter or producer in Oman is complying with applicable customs laws, regulations, procedures, requirements, or practices affecting trade in textile or apparel goods; or</text> </subparagraph> 
<subparagraph id="H1D185C305D544FB1A9FE0931DB70EF95"><enum>(B)</enum><text>that a claim that a textile or apparel good exported or produced by such exporter or producer—</text> 
<clause id="H613A678D1FD045E28140A21C2745662B"><enum>(i)</enum><text>qualifies as an originating good under section 202, or</text> </clause> 
<clause id="H6C88C8D2FBA244BE9DF334E751B3E961"><enum>(ii)</enum><text>is a good of Oman,</text> </clause><continuation-text continuation-text-level="subparagraph">is accurate.</continuation-text></subparagraph></paragraph></subsection> 
<subsection id="H3121B9437A6247A58CA49C2127D8D3C6"><enum>(b)</enum><header>Appropriate action described</header><text>Appropriate action under subsection (a)(1) includes—</text> 
<paragraph id="H64C3FB5850414EF895A6100AB97FE60"><enum>(1)</enum><text>suspension of liquidation of the entry of any textile or apparel good exported or produced by the person that is the subject of a verification referred to in subsection (a)(1) regarding compliance described in subsection (a)(2)(A), in a case in which the request for verification was based on a reasonable suspicion of unlawful activity related to such good; and</text> </paragraph> 
<paragraph id="HEDDB769CFB7242C8A8C5C4D6846F4F1B"><enum>(2)</enum><text>suspension of liquidation of the entry of a textile or apparel good for which a claim has been made that is the subject of a verification referred to in subsection (a)(1) regarding a claim described in subsection (a)(2)(B).</text> </paragraph></subsection> 
<subsection id="H2A9338960B7648300077BEEBADD9FBF"><enum>(c)</enum><header>Action when information is insufficient</header><text>If the Secretary of the Treasury determines that the information obtained within 12 months after making a request for a verification under subsection (a)(1) is insufficient to make a determination under subsection (a)(2), the President may direct the Secretary to take appropriate action described in subsection (d) until such time as the Secretary receives information sufficient to make a determination under subsection (a)(2) or until such earlier date as the President may direct.</text> </subsection> 
<subsection id="H7D6C9055467744A9971743FBB1029DD3"><enum>(d)</enum><header>Appropriate action described</header><text>Appropriate action referred to in subsection (c) includes—</text> 
<paragraph id="H6BFC0E1B83754B2288873B008E3B73AD"><enum>(1)</enum><text>publication of the name and address of the person that is the subject of the verification;</text> </paragraph> 
<paragraph id="HF7A79333CB854289AF439FA584C2529"><enum>(2)</enum><text>denial of preferential tariff treatment under the Agreement to—</text> 
<subparagraph id="HAACC1B2D276B41A384405D2CEAB088A9"><enum>(A)</enum><text>any textile or apparel good exported or produced by the person that is the subject of a verification referred to in subsection (a)(1) regarding compliance described in subsection (a)(2)(A); or</text> </subparagraph> 
<subparagraph id="HC34968B8363C4F6B8718B7728956EEAB"><enum>(B)</enum><text>a textile or apparel good for which a claim has been made that is the subject of a verification referred to in subsection (a)(1) regarding a claim described in subsection (a)(2)(B); and</text> </subparagraph></paragraph> 
<paragraph id="H95D40E4ABA2E4A7F97FDCB4840526919"><enum>(3)</enum><text>denial of entry into the United States of—</text> 
<subparagraph id="H8401B57CF422497AAEA9F9DA4C44C409"><enum>(A)</enum><text>any textile or apparel good exported or produced by the person that is the subject of a verification referred to in subsection (a)(1) regarding compliance described in subsection (a)(2)(A); or</text> </subparagraph> 
<subparagraph id="HB1B9CDBC5BB24ADFB060CCAC00FD262F"><enum>(B)</enum><text>a textile or apparel good for which a claim has been made that is the subject of a verification referred to in subsection (a)(1) regarding a claim described in subsection (a)(2)(B).</text> </subparagraph></paragraph></subsection></section> 
<section id="H2F1F2D8C985145D78E95F1BD9D91A04C"><enum>205.</enum><header>Reliquidation of entries</header><text display-inline="no-display-inline">Subsection (d) of section 520 of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1520">19 U.S.C. 1520(d)</external-xref>) is amended—</text> 
<paragraph id="HF0340410CEA04B5A9EB358FD48F97A0"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1)—</text> 
<subparagraph id="H70C1C46978F649D5BD7302ADF98F00CA"><enum>(A)</enum><text>by striking <quote>or</quote>; and</text> </subparagraph>

<section id="H333A11FDCB4B456681003DCDF6C4319E"><enum>206.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary of the Treasury shall prescribe such regulations as may be necessary to carry out—</text> 
<paragraph id="H3375CBDE744C4102BE005336A1556E61"><enum>(1)</enum><text>subsections (a) through (i) of section 202;</text> </paragraph> 
<paragraph id="HC7E9CFDBAB31452DB44871737EE18CE"><enum>(2)</enum><text>the amendment made by section 203; and</text> </paragraph>

<title id="HCF096FF00DF64E658CBA2D5CDDFEC57C"><enum>III</enum><header>Relief from imports</header> 
<section id="H53CA659E546B46388975DA7F00797DB5"><enum>301.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="HDB168DFE37E5482A8E880070E7570060"><enum>(1)</enum><header>Omani article</header><text>The term <term>Omani article</term> means an article that—</text> 
<subparagraph id="H3F83F0A124BA4055B2A55CA4F0C5B549"><enum>(A)</enum><text>qualifies as an originating good under section 202(b); or</text> </subparagraph> 
<subparagraph id="H417DE2BBA87145429522AC6432A47F1B"><enum>(B)</enum><text>receives preferential tariff treatment under paragraphs 8 through 11 of article 3.2 of the Agreement.</text> </subparagraph></paragraph> 
<paragraph id="H42251A3A11474534AB178C3D8DE882AD"><enum>(2)</enum><header>Omani textile or apparel article</header><text>The term <term>Omani textile or apparel article</term> means an article that—</text> 
<subparagraph id="H059634E354A34DA79153EF630593F472"><enum>(A)</enum><text>is listed in the Annex to the Agreement on Textiles and Clothing referred to in section 101(d)(4) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(4)</external-xref>); and</text> </subparagraph> 
<subparagraph id="H505546709BF4476287458B0745A9CC94"><enum>(B)</enum><text>is an Omani article.</text> </subparagraph></paragraph> 
<paragraph id="HE058C79E01894637814E859B63AB22C"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the United States International Trade Commission.</text> </paragraph></section> 
<subtitle id="H32E4CA0137A64E3EB5AF6D40FD8DE831"><enum>A</enum><header>Relief from imports benefiting from the Agreement</header> 
<section id="HF0F5DCCD1B7F40FD8F76A0014605EEFE"><enum>311.</enum><header>Commencing of action for relief</header> 
<subsection id="H624293E06B364D959661097538C71891"><enum>(a)</enum><header>Filing of petition</header><text>A petition requesting action under this subtitle for the purpose of adjusting to the obligations of the United States under the Agreement may be filed with the Commission by an entity, including a trade association, firm, certified or recognized union, or group of workers, that is representative of an industry. The Commission shall transmit a copy of any petition filed under this subsection to the United States Trade Representative.</text> </subsection> 
<subsection id="H3EACBAE170384F5CB81846C97B84AD89"><enum>(b)</enum><header>Investigation and determination</header><text>Upon the filing of a petition under subsection (a), the Commission, unless subsection (d) applies, shall promptly initiate an investigation to determine whether, as a result of the reduction or elimination of a duty provided for under the Agreement, an Omani article is being imported into the United States in such increased quantities, in absolute terms or relative to domestic production, and under such conditions that imports of the Omani article constitute a substantial cause of serious injury or threat thereof to the domestic industry producing an article that is like, or directly competitive with, the imported article.</text> </subsection> 
<subsection id="H503D8183E4EF4DE0839300ACCEBD00D1"><enum>(c)</enum><header>Applicable provisions</header><text>The following provisions of section 202 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2252">19 U.S.C. 2252</external-xref>) apply with respect to any investigation initiated under subsection (b):</text> 
<paragraph id="H7156776D5BEF4C7C901720F7E58744E4"><enum>(1)</enum><text>Paragraphs (1)(B) and (3) of subsection (b).</text> </paragraph> 
<paragraph id="H04CA47437B454762837D6DECB962E7E9"><enum>(2)</enum><text>Subsection (c).</text> </paragraph> 
<paragraph id="H4D826A00D5494801836512379405D1D8"><enum>(3)</enum><text>Subsection (i).</text> </paragraph></subsection> 
<subsection id="HF59AFD8E39B24730938E15B6B5006564"><enum>(d)</enum><header>Articles exempt from investigation</header><text>No investigation may be initiated under this section with respect to any Omani article if, after the date on which the Agreement enters into force with respect to the United States, import relief has been provided with respect to that Omani article under this subtitle.</text> </subsection></section> 
<section id="HF8084BC515B242808EA980153DF02C52"><enum>312.</enum><header>Commission action on petition</header> 
<subsection id="H4537AA405D24403CA952ADA85CB34223"><enum>(a)</enum><header>Determination</header><text>Not later than 120 days after the date on which an investigation is initiated under section 311(b) with respect to a petition, the Commission shall make the determination required under that section.</text> </subsection> 
<subsection id="H01FAA3DE829749818883B26D5FD89DDD"><enum>(b)</enum><header>Applicable provisions</header><text>For purposes of this subtitle, the provisions of paragraphs (1), (2), and (3) of section 330(d) of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1330">19 U.S.C. 1330(d)</external-xref> (1), (2), and (3)) shall be applied with respect to determinations and findings made under this section as if such determinations and findings were made under section 202 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2252">19 U.S.C. 2252</external-xref>).</text> </subsection> 
<subsection id="H24BE9A7CC450423089E5143F6CC91DFD"><enum>(c)</enum><header>Additional finding and recommendation if determination affirmative</header> 
<paragraph id="H82E7DBD7DE974E1E9C1E97469355EF63"><enum>(1)</enum><header>In general</header><text>If the determination made by the Commission under subsection (a) with respect to imports of an article is affirmative, or if the President may consider a determination of the Commission to be an affirmative determination as provided for under paragraph (1) of section 330(d) of the <act-name parsable-cite="TA30">Tariff Act of 1930 </act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1330">19 U.S.C. 1330(d)</external-xref>), the Commission shall find, and recommend to the President in the report required under subsection (d), the amount of import relief that is necessary to remedy or prevent the injury found by the Commission in the determination and to facilitate the efforts of the domestic industry to make a positive adjustment to import competition.</text> </paragraph> 
<paragraph id="H190DB1750DF04207A8709BC8F8DE6B15"><enum>(2)</enum><header>Limitation on relief</header><text>The import relief recommended by the Commission under this subsection shall be limited to that described in section 313(c).</text> </paragraph> 
<paragraph id="H98ED485BC28A4501A18B1D44F9D65BA"><enum>(3)</enum><header>Voting; separate views</header><text>Only those members of the Commission who voted in the affirmative under subsection (a) are eligible to vote on the proposed action to remedy or prevent the injury found by the Commission. Members of the Commission who did not vote in the affirmative may submit, in the report required under subsection (d), separate views regarding what action, if any, should be taken to remedy or prevent the injury.</text> </paragraph></subsection> 
<subsection id="H331829E8ADC14AC9BF12BA521B28E845"><enum>(d)</enum><header>Report to President</header><text>Not later than the date that is 30 days after the date on which a determination is made under subsection (a) with respect to an investigation, the Commission shall submit to the President a report that includes—</text> 
<paragraph id="H44F7CE8D41614201A86BCC006C965F7E"><enum>(1)</enum><text>the determination made under subsection (a) and an explanation of the basis for the determination;</text> </paragraph> 
<paragraph id="H25E987D4ADB1410585E29E54B3E1EAFC"><enum>(2)</enum><text>if the determination under subsection (a) is affirmative, any findings and recommendations for import relief made under subsection (c) and an explanation of the basis for each recommendation; and</text> </paragraph> 
<paragraph id="H4296F11096984A5199D83598FD80008D"><enum>(3)</enum><text>any dissenting or separate views by members of the Commission regarding the determination and recommendation referred to in paragraphs (1) and (2).</text> </paragraph></subsection> 
<subsection id="HDD1329A5041F44E8B6A06F07007F0000"><enum>(e)</enum><header>Public notice</header><text>Upon submitting a report to the President under subsection (d), the Commission shall promptly make public such report (with the exception of information which the Commission determines to be confidential) and shall cause a summary thereof to be published in the Federal Register.</text> </subsection></section> 
<section id="H5D748874CAAB4399A044D6F84DAEF5BC"><enum>313.</enum><header>Provision of relief</header> 
<subsection id="HE91108A325E24EA6AC2F41683546ED95"><enum>(a)</enum><header>In general</header><text>Not later than the date that is 30 days after the date on which the President receives the report of the Commission in which the Commission’s determination under section 312(a) is affirmative, or which contains a determination under section 312(a) that the President considers to be affirmative under paragraph (1) of section 330(d) of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1330">19 U.S.C. 1330(d)(1)</external-xref>), the President, subject to subsection (b), shall provide relief from imports of the article that is the subject of such determination to the extent that the President determines necessary to remedy or prevent the injury found by the Commission and to facilitate the efforts of the domestic industry to make a positive adjustment to import competition.</text> </subsection> 
<subsection id="HC16624637EA5499A904D227EC2478D05"><enum>(b)</enum><header>Exception</header><text>The President is not required to provide import relief under this section if the President determines that the provision of the import relief will not provide greater economic and social benefits than costs.</text> </subsection> 
<subsection id="H102E98C964444A859C2BCABA9CDAC1C1"><enum>(c)</enum><header>Nature of relief</header> 
<paragraph id="H218744AA53694437ACA798CEA0E614C8"><enum>(1)</enum><header>In general</header><text>The import relief that the President is authorized to provide under this section with respect to imports of an article is as follows:</text> 
<subparagraph id="HD8779585A85D4B8C9302DD1E87D59C34"><enum>(A)</enum><text>The suspension of any further reduction provided for under Annex 2–B of the Agreement in the duty imposed on such article.</text> </subparagraph> 
<subparagraph id="HEBF2CF7EE9FB46D8A43D7C00F157F282"><enum>(B)</enum><text>An increase in the rate of duty imposed on such article to a level that does not exceed the lesser of—</text> 
<clause id="HC40515BCCE1445BE8BD42D49C1B8A1E8"><enum>(i)</enum><text>the column 1 general rate of duty imposed under the HTS on like articles at the time the import relief is provided; or</text> </clause> 
<clause id="HCA8BF0666AB940A300A41538E1FB34E3"><enum>(ii)</enum><text>the column 1 general rate of duty imposed under the HTS on like articles on the day before the date on which the Agreement enters into force.</text> </clause></subparagraph></paragraph> 
<paragraph id="H08E4F6983AD042E7BC975BA7A861D02"><enum>(2)</enum><header>Progressive liberalization</header><text>If the period for which import relief is provided under this section is greater than 1 year, the President shall provide for the progressive liberalization of such relief at regular intervals during the period in which the relief is in effect.</text> </paragraph></subsection> 
<subsection id="H702DBB296C9847A3AD35946E74975040"><enum>(d)</enum><header>Period of relief</header> 
<paragraph id="HEB89600116764A16A0C229CDF0677600"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), any import relief that the President provides under this section may not, in the aggregate, be in effect for more than 3 years.</text> </paragraph> 
<paragraph id="HEF494B6C397E4047AE324FF1952856C8"><enum>(2)</enum><header>Extension</header> 
<subparagraph id="H2D53B441954A41C1AE51D8CDB300B3DF"><enum>(A)</enum><header>In general</header><text>If the initial period for any import relief provided under this section is less than 3 years, the President, after receiving a determination from the Commission under subparagraph (B) that is affirmative, or which the President considers to be affirmative under paragraph (1) of section 330(d) of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1330">19 U.S.C. 1330(d)(1)</external-xref>), may extend the effective period of any import relief provided under this section, subject to the limitation under paragraph (1), if the President determines that—</text> 
<clause id="H2DDD11373E3D4CD3A291A237E60D09E"><enum>(i)</enum><text>the import relief continues to be necessary to remedy or prevent serious injury and to facilitate adjustment by the domestic industry to import competition; and</text> </clause> 
<clause id="H450811CFD4054D8AA8DEC080D9990450"><enum>(ii)</enum><text>there is evidence that the industry is making a positive adjustment to import competition.</text> </clause></subparagraph> 
<subparagraph id="H77DA07950B73472599B13694A5B33F21"><enum>(B)</enum><header>Action by Commission</header> 
<clause id="HE856673EE797415A93A53F5E86B088A7"><enum>(i)</enum><header>Investigation</header><text>Upon a petition on behalf of the industry concerned that is filed with the Commission not earlier than the date which is 9 months, and not later than the date which is 6 months, before the date any action taken under subsection (a) is to terminate, the Commission shall conduct an investigation to determine whether action under this section continues to be necessary to remedy or prevent serious injury and to facilitate adjustment by the domestic industry to import competition and whether there is evidence that the industry is making a positive adjustment to import competition.</text> </clause> 
<clause id="HF6F35BA842FE4B6C907E23C8662F3EAD"><enum>(ii)</enum><header>Notice and hearing</header><text>The Commission shall publish notice of the commencement of any proceeding under this subparagraph in the Federal Register and shall, within a reasonable time thereafter, hold a public hearing at which the Commission shall afford interested parties and consumers an opportunity to be present, to present evidence, and to respond to the presentations of other parties and consumers, and otherwise to be heard.</text> </clause> 
<clause id="H935E91F3CB0F4C24B109D0878A5BF1"><enum>(iii)</enum><header>Report</header><text>The Commission shall transmit to the President a report on its investigation and determination under this subparagraph not later than 60 days before the action under subsection (a) is to terminate, unless the President specifies a different date.</text> </clause></subparagraph></paragraph></subsection> 
<subsection id="H3CEB8D9D2DBB49DC8EA632EDB805B600"><enum>(e)</enum><header>Rate after termination of import relief</header><text>When import relief under this section is terminated with respect to an article, the rate of duty on that article shall be the rate that would have been in effect, but for the provision of such relief, on the date on which the relief terminates.</text> </subsection> 
<subsection id="H0D314B8F02744B188E4CA7000071FE"><enum>(f)</enum><header>Articles exempt from relief</header><text>No import relief may be provided under this section on any article that has been subject to import relief under this subtitle after the date on which the Agreement enters into force.</text> </subsection></section> 
<section id="H167528D332EA4927A956FAA9A5023455"><enum>314.</enum><header>Termination of relief authority</header> 
<subsection id="HF7D23234FBB24BA3BA5C54FB3EAFBB9E"><enum>(a)</enum><header>General rule</header><text>Subject to subsection (b), no import relief may be provided under this subtitle after the date that is 10 years after the date on which the Agreement enters into force.</text> </subsection> 
<subsection id="HCE04C99718E74FDC8F2EB0F7D87BD1E4"><enum>(b)</enum><header>Presidential determination</header><text>Import relief may be provided under this subtitle in the case of an Omani article after the date on which such relief would, but for this subsection, terminate under subsection (a), if the President determines that Oman has consented to such relief.</text> </subsection></section> 
<section id="H42B21339F6DA455DADC15050553F4256"><enum>315.</enum><header>Compensation authority</header><text display-inline="no-display-inline">For purposes of section 123 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2133">19 U.S.C. 2133</external-xref>), any import relief provided by the President under section 313 shall be treated as action taken under chapter 1 of title II of such Act (<external-xref legal-doc="usc" parsable-cite="usc/19/2251">19 U.S.C. 2251 et seq.</external-xref>).</text> </section> 
<section id="H4A784598F33B4C70AF862E1DDE07A935"><enum>316.</enum><header>Confidential business information</header><text display-inline="no-display-inline">Section 202(a)(8) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2252">19 U.S.C. 2252(a)(8)</external-xref>) is amended in the first sentence—</text> 
<paragraph id="HAC636C98D0704C8BB2811CEB2E784002"><enum>(1)</enum><text>by striking <quote>and</quote>; and</text> </paragraph> 
<paragraph id="H542C2070A6D94AE2AB34005320AB00C9"><enum>(2)</enum><text>by inserting before the period at the end <quote>, and title III of the United States-Oman Free Trade Agreement Implementation Act</quote>.</text> </paragraph></section></subtitle> 
<subtitle id="H1A8A749A5ECC446CAB00D127B985783E"><enum>B</enum><header>Textile and apparel safeguard measures</header> 
<section id="H5AEB85AD70E84F628B282EA0D549922C"><enum>321.</enum><header>Commencement of action for relief</header> 
<subsection id="HA42BB307E1BD4089B43CE2C890E94069"><enum>(a)</enum><header>In general</header><text>A request under this subtitle for the purpose of adjusting to the obligations of the United States under the Agreement may be filed with the President by an interested party. Upon the filing of a request, the President shall review the request to determine, from information presented in the request, whether to commence consideration of the request.</text> </subsection> 
<subsection id="H11A37A96948A403ABC2078476CA098C6"><enum>(b)</enum><header>Publication of request</header><text>If the President determines that the request under subsection (a) provides the information necessary for the request to be considered, the President shall cause to be published in the Federal Register a notice of commencement of consideration of the request, and notice seeking public comments regarding the request. The notice shall include a summary of the request and the dates by which comments and rebuttals must be received.</text> </subsection></section> 
<section id="HEC49E971838E473EBE8D55EBC7C4E945"><enum>322.</enum><header>Determination and provision of relief</header> 
<subsection id="H4684DD1F1BCE437685D13F60BD710069"><enum>(a)</enum><header>Determination</header> 
<paragraph id="H6259F26AF6EF4DF2ADD4604D002F0703"><enum>(1)</enum><header>In general</header><text>If a positive determination is made under section 321(b), the President shall determine whether, as a result of the reduction or elimination of a duty under the Agreement, an Omani textile or apparel article is being imported into the United States in such increased quantities, in absolute terms or relative to the domestic market for that article, and under such conditions as to cause serious damage, or actual threat thereof, to a domestic industry producing an article that is like, or directly competitive with, the imported article.</text> </paragraph> 
<paragraph id="HCB566273A12B4D2C86B512B0258D2905"><enum>(2)</enum><header>Serious damage</header><text>In making a determination under paragraph (1), the President—</text> 
<subparagraph id="H701A22CC1DF74F3AADAA308BF6FCA3C"><enum>(A)</enum><text>shall examine the effect of increased imports on the domestic industry, as reflected in changes in such relevant economic factors as output, productivity, utilization of capacity, inventories, market share, exports, wages, employment, domestic prices, profits, and investment, none of which is necessarily decisive; and</text> </subparagraph> 
<subparagraph id="H6FF62083FCAF46FA9792951E7BF1BB8"><enum>(B)</enum><text>shall not consider changes in technology or consumer preference as factors supporting a determination of serious damage or actual threat thereof.</text> </subparagraph></paragraph></subsection> 
<subsection id="HF3C0CB0C4CDF471BB77D65B0A78B9780"><enum>(b)</enum><header>Provision of relief</header> 
<paragraph id="H4581F9BA41F74893B85C885D6BA5B22"><enum>(1)</enum><header>In general</header><text>If a determination under subsection (a) is affirmative, the President may provide relief from imports of the article that is the subject of such determination, as described in paragraph (2), to the extent that the President determines necessary to remedy or prevent the serious damage and to facilitate adjustment by the domestic industry to import competition.</text> </paragraph> 
<paragraph id="H3D63EA238E02433D98EDB6E4B483D466"><enum>(2)</enum><header>Nature of relief</header><text>The relief that the President is authorized to provide under this subsection with respect to imports of an article is an increase in the rate of duty imposed on the article to a level that does not exceed the lesser of—</text> 
<subparagraph id="H2F79099EE68C459BA124BAB4D1F97412"><enum>(A)</enum><text>the column 1 general rate of duty imposed under the HTS on like articles at the time the import relief is provided; or</text> </subparagraph> 
<subparagraph id="H4AEFBB9019E24E20B0FFE11722849789"><enum>(B)</enum><text>the column 1 general rate of duty imposed under the HTS on like articles on the day before the date on which the Agreement enters into force.</text> </subparagraph></paragraph></subsection></section> 
<section id="H548EEF237D1C4AEDB63019D7AFFBCACC"><enum>323.</enum><header>Period of relief</header> 
<subsection id="HC59C0960A00C4C3EAA2173CDA4A1EAD8"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), any import relief that the President provides under subsection (b) of section 322 may not, in the aggregate, be in effect for more than 3 years.</text> </subsection> 
<subsection id="H9254121C33A548ACB8902EB5760576D2"><enum>(b)</enum><header>Extension</header><text>If the initial period for any import relief provided under section 322 is less than 3 years, the President may extend the effective period of any import relief provided under that section, subject to the limitation set forth in subsection (a), if the President determines that—</text> 
<paragraph id="H5A9AEB8BB81A4726942063DFAEE7257"><enum>(1)</enum><text>the import relief continues to be necessary to remedy or prevent serious damage and to facilitate adjustment by the domestic industry to import competition; and</text> </paragraph> 
<paragraph id="H35D5E6BA9C084CB68CC13959F4044971"><enum>(2)</enum><text>there is evidence that the industry is making a positive adjustment to import competition.</text> </paragraph></subsection></section> 
<section id="HAD0DE6C25DFE4354823B8FC13DAA3304"><enum>324.</enum><header>Articles exempt from relief</header><text display-inline="no-display-inline">The President may not provide import relief under this subtitle with respect to any article if—</text> 
<paragraph id="H145C5FE1D0FE41DEBD7B75EC7772803B"><enum>(1)</enum><text>the article has been subject to import relief under this subtitle after the date on which the Agreement enters into force; or</text> </paragraph> 
<paragraph id="H58ADE63E6065433C830071F7CA78B4FB"><enum>(2)</enum><text>the article is subject to import relief under chapter 1 of title II of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2251">19 U.S.C. 2251 et seq.</external-xref>).</text> </paragraph></section> 
<section id="HEACFB1A4C3844E02874B4DC4E63E25E3"><enum>325.</enum><header>Rate after termination of import relief</header><text display-inline="no-display-inline">When import relief under this subtitle is terminated with respect to an article, the rate of duty on that article shall be the rate that would have been in effect, but for the provision of such relief, on the date on which the relief terminates.</text> </section> 
<section id="H6F2923AF1D8241DC93E363EDB63F2C65"><enum>326.</enum><header>Termination of relief authority</header><text display-inline="no-display-inline">No import relief may be provided under this subtitle with respect to any article after the date that is 10 years after the date on which duties on the article are eliminated pursuant to the Agreement.</text> </section> 
<section id="HB61DABE4BA5A471185F649350079BEA1"><enum>327.</enum><header>Compensation authority</header><text display-inline="no-display-inline">For purposes of section 123 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2133">19 U.S.C. 2133</external-xref>), any import relief provided by the President under this subtitle shall be treated as action taken under chapter 1 of title II of such Act.</text> </section> 
<section id="H8362EE1F580C443BA70755003F6012B2"><enum>328.</enum><header>Confidential business information</header><text display-inline="no-display-inline">The President may not release information that is submitted in a proceeding under this subtitle and that the President considers to be confidential business information unless the party submitting the confidential business information had notice, at the time of submission, that such information would be released, or such party subsequently consents to the release of the information. To the extent a party submits confidential business information to the President in a proceeding under this subtitle, the party shall also submit a nonconfidential version of the information, in which the confidential business information is summarized or, if necessary, deleted.</text> </section></subtitle></title> 
<title id="HCAA756C46FAF42488DD7C080D400B92E"><enum>IV</enum><header>Procurement</header> 
<section id="H1708F9C435ED4D11A1E897C5935CDAE9"><enum>401.</enum><header>Eligible products</header><text display-inline="no-display-inline">Section 308(4)(A) of the <act-name parsable-cite="TAA79">Trade Agreements Act of 1979</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2518">19 U.S.C. 2518(4)(A)</external-xref>) is amended—</text>
