			<section id="H7AE4054DE99B4947971D50CAC335DAA8"><enum>101.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">Funds are
			 authorized to be appropriated for fiscal year 2007 for necessary expenses of
			 the Coast Guard as follows:</text>
				<paragraph id="H1A159B11742045EC886DB4D1F1D000BD"><enum>(1)</enum><text>For the operation
			 and maintenance of the Coast Guard, $5,680,000,000, of which—</text>
					<subparagraph id="H08884EDD2AAA414EADC18FC6E2BD064F"><enum>(A)</enum><text>$24,255,000 is
			 authorized to be derived from the Oil Spill Liability Trust Fund to carry out
			 the purposes of section 1012(a)(5) of the Oil Pollution Act of 1990
			 (33 U.S.C.
			 2712(a)(5));</text>
					</subparagraph><subparagraph id="HCCB61F6130D747918CAB1500CC05D8F6"><enum>(B)</enum><text>$629,000,000 shall
			 be available only for paying for search and rescue programs; and</text>
					</subparagraph><subparagraph id="H01002888278E4C6089354ECF402CF6F9"><enum>(C)</enum><text>$502,000,000 shall
			 be available only for paying for marine safety programs.</text>
					</subparagraph></paragraph><paragraph id="H76DEDE0514284D19A2F81E4C96509FB1"><enum>(2)</enum><text display-inline="yes-display-inline">For the acquisition, construction,
			 rebuilding, and improvement of aids to navigation, shore and offshore
			 facilities, vessels, and aircraft, including equipment related thereto,
			 $2,095,861,000, of which—</text>
					<subparagraph id="HF85DA4AF1D824668A500005EF66E87CD"><enum>(A)</enum><text>$19,800,000 shall
			 be derived from the Oil Spill Liability Trust Fund to carry out the purposes of
			 section 1012(a)(5) of the Oil Pollution Act of 1990, to remain available until
			 expended;</text>
					</subparagraph><subparagraph id="H61204AD9ABC849E20000DC0AE5042FD"><enum>(B)</enum><text display-inline="yes-display-inline">$1,419,223,000 is authorized for
			 acquisition and construction of shore and offshore facilities, vessels, and
			 aircraft, including equipment related thereto, and other activities that
			 constitute the Integrated Deepwater System; and</text>
					</subparagraph><subparagraph id="H6EE1D18A0ABA4AB8BFA4E0CBCFC1474F"><enum>(C)</enum><text display-inline="yes-display-inline">$316,638,000 is authorized for conversion
			 and sustainment of legacy vessels and aircraft, including equipment related
			 thereto, and other activities that constitute the Integrated Deepwater
			 Systems.</text>
					</subparagraph></paragraph><paragraph id="HA2C61F303B7048B8A72887B51CA5B5E5"><enum>(3)</enum><text>To the Commandant
			 of the Coast Guard for research, development, test, and evaluation of
			 technologies, materials, and human factors directly relating to improving the
			 performance of the Coast Guard’s mission in search and rescue, aids to
			 navigation, marine safety, marine environmental protection, enforcement of laws
			 and treaties, ice operations, oceanographic research, and defense readiness,
			 $24,000,000, to remain available until expended, of which $2,000,000 shall be
			 derived from the Oil Spill Liability Trust Fund to carry out the purposes of
			 section 1012(a)(5) of the Oil Pollution Act of 1990.</text>
				</paragraph><paragraph id="H973785296B644D36BA269E606C5EDFF6"><enum>(4)</enum><text>For retired pay
			 (including the payment of obligations otherwise chargeable to lapsed
			 appropriations for this purpose), payments under the Retired Serviceman’s
			 Family Protection and Survivor Benefit Plans, and payments for medical care of
			 retired personnel and their dependents under
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">chapter 55</external-xref> of title 10,
			 United States Code, $1,063,323,000, to remain available until expended.</text>
				</paragraph><paragraph id="H8FF28B6FD0FC449AA7423129E63BCCF"><enum>(5)</enum><text>For alteration or
			 removal of bridges over navigable waters of the United States constituting
			 obstructions to navigation, and for personnel and administrative costs
			 associated with the Bridge Alteration Program, $17,000,000.</text>
				</paragraph><paragraph id="HAA43A0DC45254731BDB630333EDC6200"><enum>(6)</enum><text>For environmental
			 compliance and restoration at Coast Guard facilities (other than parts and
			 equipment associated with operation and maintenance), $12,000,000, to remain
			 available until expended.</text>
				</paragraph><paragraph id="H2DAE9B00C5C545FB88F4B005CEFFC00"><enum>(7)</enum><text>For the Coast Guard
			 Reserve program, including personnel and training costs, equipment, and
			 services, $124,000,000.</text>
				</paragraph></section><section id="H46E69838B00F45BF89734840E9C57C9B"><enum>102.</enum><header>Authorized
			 levels of military strength and training</header>
				<subsection id="H3E6CF2BA201E45EBAD05806DE941A985"><enum>(a)</enum><header>Active duty
			 strength</header><text>The Coast Guard is authorized an end-of-year strength
			 for active duty personnel of 45,500 for the fiscal year ending on September 30,
			 2007.</text>
				</subsection><subsection id="H0451B9A4EC0342998035DD014BAA8641"><enum>(b)</enum><header>Military
			 training student loads</header><text>For fiscal year 2007, the Coast Guard is
			 authorized average military training student loads as follows:</text>
					<paragraph id="HB0327EFC69E5486CBD00D925F1EAC1"><enum>(1)</enum><text>For
			 recruit and special training, 2,500 student years.</text>
					</paragraph><paragraph id="HBED07D5052874574AEDC3600363C36C8"><enum>(2)</enum><text>For flight
			 training, 125 student years.</text>
					</paragraph><paragraph id="H544CC0409B144CF89471001EAD80C477"><enum>(3)</enum><text>For professional
			 training in military and civilian institutions, 350 student years.</text>
					</paragraph><paragraph id="HAE5596DE83EA40FEAE09B23B98E87E70"><enum>(4)</enum><text>For officer
			 acquisition, 1,200 student years.</text>
					</paragraph></subsection></section></title><title id="H97405A9808184E14AA462F7416F9BCE4"><enum>II</enum><header>Coast
			 Guard</header>
			<section id="HAC9D473E282243C195B74FD2C3BC80B3"><enum>201.</enum><header>Appointment of
			 civilian Coast Guard judges</header>
				<subsection id="H1D4BB53AF80A43D4BB153CE947245014"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/7">Chapter 7</external-xref> of title 14, United
			 States Code, is amended by adding at the end the following:</text>

			 for medical-related travel expenses</header>
				<subsection id="H5F5ABDF3C6D54A73BC500000EDB0565D"><enum>(a)</enum><header>In
			 General</header><text><?xm-replace_text "?>Chapter 13 of title 14, United
			 States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB27E2C24227C482FB8368609DF00B1BF" style="USC">
						<section id="HF621DD148AD743D2908EC5C111882C56"><enum>518.</enum><header>Reimbursement
				for medical-related travel expenses for certain persons residing on islands in
				the continental United States</header><text display-inline="no-display-inline">In any case in which a covered beneficiary
				(as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/1072">section 1072(5)</external-xref> of title 10)
				resides on an island that is located in the 48 contiguous States and the
				District of Columbia and that lacks public access roads to the mainland and is
				referred by a primary care physician to a specialty care provider (as defined
				in section
				1074i(b) of title 10) on the mainland who provides services
				less than 100 miles from the location where the beneficiary resides, the
				Secretary shall reimburse the reasonable travel expenses of the covered
				beneficiary and, when accompaniment by an adult is necessary, for a parent or
				guardian of the covered beneficiary or another member of the covered
				beneficiary’s family who is at least 21 years of
				age.</text>

				</subsection><subsection id="H8F1E745F446749CA85BB33B36574BFE0"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>

			 officers</header>
				<subsection id="H01C7CF46447546F6AB685FECD6002B9F"><enum>(a)</enum><header>Active duty
			 promotion list</header><text><external-xref legal-doc="usc" parsable-cite="usc/14/42">Section 42</external-xref> of title 14, United States
			 Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H8F27975F9D33443BB23D753162A4AC7F" style="USC">
						<section id="H402222F228AF4C3B8C52BA5FF9DD1AF"><enum>42.</enum><header>Number and
				distribution of commissioned officers on active duty promotion list</header>
							<subsection id="H42B50DBE057C4718A14B00DB5FD4ECA7"><enum>(a)</enum><header>Maximum total
				number</header><text>The total number of Coast Guard commissioned officers on
				the active duty promotion list, excluding warrant officers, shall not exceed
				6,700; except that the Commandant may temporarily increase such number by up to
				2 percent for no more than 60 days following the date of the commissioning of a
				Coast Guard Academy class.</text>
							</subsection><subsection id="HDCA224EDDE8341E7850000AC148BD5E1"><enum>(b)</enum><header>Distribution
				percentages by grade</header>
								<paragraph id="H05723B9CE07B4672A9E676CCA0AEFF4"><enum>(1)</enum><header>Required</header><text>The
				total number of commissioned officers authorized by this section shall be
				distributed in grade in the following percentages: 0.375 percent for rear
				admiral; 0.375 percent for rear admiral (lower half); 6.0 percent for captain;
				15.0 percent for commander; and 22.0 percent for lieutenant commander.</text>
								</paragraph><paragraph id="H341AAF1F504648AD007F78F86ECA38F"><enum>(2)</enum><header>Discretionary</header><text>The
				Secretary shall prescribe the percentages applicable to the grades of
				lieutenant, lieutenant (junior grade), and ensign.</text>
								</paragraph><paragraph id="H7E73D86CC1DA466FB6952B719E093954"><enum>(3)</enum><header>Authority of
				secretary to reduce percentage</header><text>The Secretary—</text>
									<subparagraph id="HA2768B23D1404AF2824D56E1C89BEF08"><enum>(A)</enum><text>may reduce, as the
				needs of the Coast Guard require, any of the percentages set forth in paragraph
				(1); and</text>
									</subparagraph><subparagraph id="HF34082F3EA774E2C87D70220F3F9BFFD"><enum>(B)</enum><text>shall apply that
				total percentage reduction to any other lower grade or combination of lower
				grades.</text>
									</subparagraph></paragraph></subsection><subsection id="HE38C85E3E8CF420080BA8A31026F9AD"><enum>(c)</enum><header>Computations</header>
								<paragraph id="H16BBB7DE0CED46C300F417FEF4FA6D45"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall compute, at least once each year, the
				total number of commissioned officers authorized to serve in each grade by
				applying the grade distribution percentages established by or under this
				section to the total number of commissioned officers listed on the current
				active duty promotion list.</text>
								</paragraph><paragraph id="H803F9B461B7D47550034B6C11CA59F8F"><enum>(2)</enum><header>Rounding
				fractions</header><text>Subject to subsection (a), in making the computations
				under paragraph (1), any fraction shall be rounded to the nearest whole
				number.</text>
								</paragraph><paragraph id="H5629DACCE1A84F4DAA00FAE05FB18CAE"><enum>(3)</enum><header>Treatment of
				officers serving outside coast guard</header><text>The number of commissioned
				officers on the active duty promotion list serving with other Federal
				departments or agencies on a reimbursable basis or excluded under
				section
				324(d) of title 49 shall not be counted against the total
				number of commissioned officers authorized to serve in each grade.</text>
								</paragraph></subsection><subsection id="HA7F615840C2745CD844800E684668900"><enum>(d)</enum><header>Use of numbers;
				temporary increases</header><text display-inline="yes-display-inline">The
				numbers resulting from computations under subsection (c) shall be, for all
				purposes, the authorized number in each grade; except that the authorized
				number for a grade is temporarily increased during the period between one
				computation and the next by the number of officers originally appointed in that
				grade during that period and the number of officers of that grade for whom
				vacancies exist in the next higher grade but whose promotion has been delayed
				for any reason.</text>
							</subsection><subsection id="HF43C666BF3D440ACA7341401E395AE51"><enum>(e)</enum><header>Officers serving
				coast guard academy and reserve</header><text>The number of officers authorized
				to be serving on active duty in each grade of the permanent commissioned
				teaching staff of the Coast Guard Academy and of the Reserve serving in
				connection with organizing, administering, recruiting, instructing, or training
				the reserve components shall be prescribed by the
				Secretary.</text>

			 14, United States Code, and the item relating to such section in the analysis
			 for chapter 11 of such title, are repealed.</text>
			</section><section display-inline="no-display-inline" id="H705A47C0200E4217B85200D227978CF7" section-type="subsequent-section"><enum>211.</enum><header>Maritime safety for
			 nuclear power facilities located adjacent to navigable waters</header>
				<subsection id="HE3C554CC26F249BC00A7965FEABCA744"><enum>(a)</enum><header>Responsibility</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/2">Section 2</external-xref> of title 14, United States
			 Code, is amended by inserting before <quote>and shall maintain a state of
			 readiness</quote> the following: <quote>shall administer laws and promulgate
			 and enforce regulations to assure the maritime safety of nuclear power
			 facilities located adjacent to navigable waters of the United States not
			 specifically delegated by law to some other executive
			 department;</quote>.</text>
				</subsection><subsection id="HAF39AD03F9FA4F998D982200BB795438"><enum>(b)</enum><header>Cooperation with
			 NRC</header><text display-inline="yes-display-inline">Chapter 7 of such title
			 is amended by inserting after section 147a the following:</text>
					<quoted-block display-inline="no-display-inline" id="H020DA890EBAC49A6B31BD27CEBD6D263" style="USC">
						<section id="HD4E337DD142647CCBD5EA3ECBBEB4F8C"><enum>147b.</enum><header>Nuclear
				regulatory commission</header>

				general</header><text display-inline="yes-display-inline">The Commandant may
				enter into an agreement with the Chairman of the Nuclear Regulatory Commission
				to enhance the maritime safety of the navigable waters of the United States
				that are located adjacent to a nuclear power plant. Such agreement shall
				provide for—</text>
								<paragraph id="H6ACC08BC242D4519BE7BB09252AF911"><enum>(1)</enum><text display-inline="yes-display-inline">the exchange of certain information with
				the Chairman relating to the maritime safety of a nuclear power plant located
				adjacent to the navigable waters of the United States;</text>
								</paragraph><paragraph id="HD4DB88BA0C65480DA4DF1698B21457C9"><enum>(2)</enum><text>the assignment of
				officers of the Coast Guard to serve as liaisons to the Nuclear Regulatory
				Commission; and</text>
								</paragraph><paragraph id="HE99D36ED0B514BDCB83F375E1D15D678"><enum>(3)</enum><text>the provisions of
				equipment and support to, or accept the same from, the Nuclear Regulatory
				Commission.</text>
								</paragraph></subsection><subsection id="HC9998B7C1C2A42AF81C5B41559A8FC37"><enum>(b)</enum><header>Payment or
				reimbursement</header><text display-inline="yes-display-inline">With regard to
				any agreement entered into under subsection (a), the Commandant may prescribe
				conditions, including advance payment or reimbursement, under which such
				resources may be
				provided.</text>

				general</header>
									<subparagraph id="HB207D4F1C03B45EAA116A50004CEF8E0"><enum>(A)</enum><header>Rebuild or
				replace</header><text display-inline="yes-display-inline">Notwithstanding any
				limitation to the contrary on replacing, rebuilding, or lengthening vessels or
				transferring permits or licenses to a replacement vessel contained in sections
				679.2
				and 679.4 of title 50, Code of Federal
				Regulations, as in effect on the date of enactment of the Coast Guard
				Authorization Act of 2006 and except as provided in paragraph (4), the owner of
				a vessel eligible under subsection (a), (b), (c), (d), or (e) (other than
				paragraph (21)), in order to improve vessel safety and operational efficiencies
				(including fuel efficiency), may rebuild or replace that vessel (including fuel
				efficiency) with a vessel documented with a fishery endorsement under
				section
				12108 of title 46, United States Code.</text>
									</subparagraph><subparagraph id="H02FD07E1129641A48779220100302B60"><enum>(B)</enum><header>Same
				requirements</header><text>The rebuilt or replacement vessel shall be eligible
				in the same manner and subject to the same restrictions and limitations under
				such subsection as the vessel being rebuilt or replaced.</text>
									</subparagraph><subparagraph id="H253637CB35374970863CB618F2895855"><enum>(C)</enum><header>Transfer of
				permits and licenses</header><text>Each fishing permit and license held by the
				owner of a vessel or vessels to be rebuilt or replaced under subparagraph (A)
				shall be transferred to the rebuilt or replacement vessel.</text>
									</subparagraph></paragraph><paragraph id="HE810E6D672494167B93DC2439574602C"><enum>(2)</enum><header>Recommendations
				of north pacific council</header><text>The North Pacific Council may recommend
				for approval by the Secretary such conservation and management measures,
				including size limits and measures to control fishing capacity, in accordance
				with the Magnuson-Stevens Act as it considers necessary to ensure that this
				subsection does not diminish the effectiveness of fishery management plans of
				the Bering Sea and Aleutian Islands Management Area or the Gulf of
				Alaska.</text>
								</paragraph><paragraph id="H0731A410AC8C446F92D2B22796B9D5B"><enum>(3)</enum><header>Special rule for
				replacement of certain vessels</header>
									<subparagraph id="HB594E02B8DB645DB89D20000972183EF"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding the requirements of paragraphs (1), (2),
				and (3) of section
				12102(c) of title 46, United States Code, a vessel that is
				eligible under subsection (a), (b), (c), (d), or (e) (other than paragraph
				(21)) and that qualifies to be documented with a fishery endorsement pursuant
				to section 203(g) or 213(g) may be replaced with a replacement vessel under
				paragraph (1) if the vessel that is replaced is validly documented with a
				fishery endorsement pursuant to section 203(g) or 213(g) before the replacement
				vessel is documented with a fishery endorsement under
				section
				12108 of title 46, United States Code.</text>
									</subparagraph><subparagraph id="H50C3A529E76E4FE8824000D354BC9DD"><enum>(B)</enum><header>Applicability</header><text>A
				replacement vessel under subparagraph (A) and its owner and mortgagee are
				subject to the same limitations under section 203(g) or 213(g) that are
				applicable to the vessel that has been replaced and its owner and
				mortgagee.</text>
									</subparagraph></paragraph><paragraph id="H5C86A7DAAC8D40C9A0C8562D007E6C94"><enum>(4)</enum><header>Special rules
				for certain catcher vessels</header>
									<subparagraph id="H57114ABB4A03420DA400D84E6E027303"><enum>(A)</enum><header>In
				general</header><text>A replacement for a covered vessel described in
				subparagraph (B) is prohibited from harvesting fish in any fishery (except for
				the Pacific whiting fishery) managed under the authority of any regional
				fishery management council (other than the North Pacific Council) established
				under section 302(a) of the Magnuson-Stevens Act.</text>
									</subparagraph><subparagraph id="HAF1AD2ADEAED41E2B9EC305428DA67DE"><enum>(B)</enum><header>Covered
				vessels</header><text>A covered vessel referred to in subparagraph (A)
				is—</text>
										<clause id="HF83A5102AB5A49D2A0979D45AF09377F"><enum>(i)</enum><text display-inline="yes-display-inline">a vessel eligible under subsection (a),
				(b), or (c) that is replaced under paragraph (1); or</text>
										</clause><clause id="HE99E39EAEFA64A9789B9C3BF5B8CB401"><enum>(ii)</enum><text display-inline="yes-display-inline">a vessel eligible under subsection (a),
				(b), or (c) that is rebuilt to increase its registered length, gross tonnage,
				or shaft horsepower.</text>
										</clause></subparagraph></paragraph><paragraph id="H4B25082A2116498D9BA8AAB43FCBBC73"><enum>(5)</enum><header>Limitation on
				fishery endorsements</header><text>Any vessel that is replaced under this
				subsection shall thereafter not be eligible for a fishery endorsement under
				section
				12108 of title 46, United States Code, unless that vessel is
				also a replacement vessel described in paragraph (1).</text>
								</paragraph><paragraph id="H2F6F11E8EB0346A6B9DAC3F600BC27D1"><enum>(6)</enum><header>Gulf of Alaska
				limitation</header><text>Notwithstanding paragraph (1), the Secretary shall
				prohibit from participation in the groundfish fisheries of the Gulf of Alaska
				any vessel that is rebuilt or replaced under this subsection and that exceeds
				the maximum length overall specified on the license that authorizes fishing for
				groundfish pursuant to the license limitation program under part 679 of title
				50, Code of Federal Regulations, as in effect on the date of enactment of the
				Coast Guard Authorization Act of 2006.</text>
								</paragraph><paragraph id="H7DB9A8379FA0440AA9802B1D6392DACA"><enum>(7)</enum><header>Authority of
				Pacific Council</header><text>Nothing in this section shall be construed to
				diminish or otherwise affect the authority of the Pacific Council to recommend
				to the Secretary conservation and management measures to protect fisheries
				under its jurisdiction (including the Pacific whiting fishery) and participants
				in such fisheries from adverse impacts caused by this
				Act.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H291FCAB706C2468C9EE5ED8B6FF8F9B4"><enum>(2)</enum><header>Exemption of
			 certain vessels</header><text>Section 203(g) of the American Fisheries Act
			 (title II of division C of
			 Public Law
			 105–277; 112 Stat. 2681-620) is amended—</text>
						<subparagraph id="HD438A4C220844D5B80A679286300C065"><enum>(A)</enum><text>by inserting
			 <quote>and</quote> after <quote>(United States official number
			 651041)</quote>;</text>

						</subparagraph></paragraph><paragraph id="H4E657772BBD04D74936218DDB8EEE984"><enum>(3)</enum><header>Fishery
			 cooperative exit provisions</header><text>Section 210(b) of the American
			 Fisheries Act (title II of division C of
			 Public Law
			 105–277; 112 Stat. 2681-629) is amended—</text>
						<subparagraph id="H0287368D188348249C666C828DF289BF"><enum>(A)</enum><text>by moving the
			 matter beginning with <quote>the Secretary shall</quote> in paragraph (1) 2 ems

				determination</header><text>For purposes of determining the aggregate
				percentage of directed fishing allowances under paragraph (1), when a catcher
				vessel is removed from the directed pollock fishery, the fishery allowance for
				pollock for the vessel being removed—</text>
										<clause commented="no" id="H49EA9BC2E3EA497D9171E5E56F7E39AC"><enum>(i)</enum><text display-inline="yes-display-inline">shall be based on the catch history
				determination for the vessel made pursuant to
				section
				679.62 of title 50, Code of Federal Regulations, as in effect
				on the date of enactment of the Coast Guard Authorization Act 2006; and</text>
										</clause><clause id="H1AC4F3DE770144D6B404AF74D4CC1100"><enum>(ii)</enum><text>shall be
				assigned, for all purposes under this title, in the manner specified by the
				owner of the vessel being removed to any other catcher vessel or among other
				catcher vessels participating in the fishery cooperative if such vessel or
				vessels remain in the fishery cooperative for at least one year after the date
				on which the vessel being removed leaves the directed pollock fishery.</text>
										</clause></subparagraph><subparagraph id="H00108991611F41A2A85E1DE2F8C35B1"><enum>(B)</enum><header>Eligibility for
				fishery endorsement</header><text>Except as provided in subparagraph (C), a
				vessel that is removed pursuant to this paragraph shall be permanently
				ineligible for a fishery endorsement, and any claim (including relating to
				catch history) associated with such vessel that could qualify any owner of such
				vessel for any permit to participate in any fishery within the exclusive
				economic zone of the United States shall be extinguished, unless such removed
				vessel is thereafter designated to replace a vessel to be removed pursuant to
				this paragraph.</text>
									</subparagraph><subparagraph id="H227BD6AAF41C40D0991ECDC55C8FF055"><enum>(C)</enum><header>Limitations on
				statutory construction</header><text>Nothing in this paragraph shall be
				construed—</text>
										<clause id="H6AC3E13C8C8240F38FBEBDC91AD74C1"><enum>(i)</enum><text>to
				make the vessels AJ (United States official number 905625), DONA MARTITA
				(United States official number 651751), NORDIC EXPLORER (United States official
				number 678234), and PROVIDIAN (United States official number 1062183)
				ineligible for a fishery endorsement or any permit necessary to participate in
				any fishery under the authority of the New England Fishery Management Council
				or the Mid-Atlantic Fishery Management Council established, respectively, under
				subparagraphs (A) and (B) of section 302(a)(1) of the Magnuson-Stevens Act;
				or</text>
										</clause><clause id="H62B3CDB56CB84CF795B37C94A127B400"><enum>(ii)</enum><text display-inline="yes-display-inline">to allow the vessels referred to in clause
				(i) to participate in any fishery under the authority of the Councils referred
				to in clause (i) in any manner that is not consistent with the fishery
				management plan for the fishery developed by the Councils under section 303 of
				the Magnuson-Stevens
				Act.</text>
										</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H3DA4E66D9806490A9441E6DF735D769F"><enum>(c)</enum><header>Vessel safety
			 standards</header>
					<paragraph id="H3AE0C2794DC548B8832F86B1B312933D"><enum>(1)</enum><header>Loadlines</header><text>Section 5102(b)(3)
			 of title 46, United States Code, is amended by striking <quote>a fishing
			 vessel.</quote> and inserting</text>

					</paragraph><paragraph id="H11C6ADF337B44E999809E640A9C89B6B"><enum>(2)</enum><header>Classing</header><text>Section 4503 of
			 title 46, United States Code, is amended—</text>

			 catcher/processor shares</header>
					<paragraph id="H21AD723DDB654D6589FCCFF7594EE53D"><enum>(1)</enum><header>In
			 general</header>
						<subparagraph id="H82657688BDF7465EAEBCACD6B5AA1187"><enum>(A)</enum><header>Amendment of
			 plan</header><text>Not later than 90 days after the date of enactment of this
			 Act, the Secretary of Commerce shall amend the fishery management plan for
			 Bering Sea/Aleutian Islands King and Tanner Crabs (in this section referred to
			 as the <quote>Plan</quote>) for the Northern Region (as that term is used in
			 the Plan) to authorize entities affiliated through common ownership to elect on
			 an annual basis to work together to combine any of their catcher vessel owner
			 quota shares for the Northern Region with any of their processor quota shares
			 and to exchange them for newly created catcher/processor owner quota shares for
			 the Northern Region.</text>
						</subparagraph><subparagraph id="HA1E02EBB24EC4A179247E200147DF9A2"><enum>(B)</enum><header>Exchange
			 rate</header><text>The entities referred to in subparagraph (A) shall receive
			 under the amendment one unit of newly created catcher/processor owner quota
			 shares in exchange for one unit of catcher vessel owner quota shares and 0.9
			 units of processor quota shares.</text>
						</subparagraph><subparagraph id="HA26B3B9BFF7046A5A5DE27108701A6A1"><enum>(C)</enum><header>Area of
			 validity</header><text>Each unit of newly created catcher/processor owner quota
			 shares under this paragraph shall only be valid for the Northern Region.</text>
						</subparagraph></paragraph><paragraph id="HA0A67545A2774CD190355EE86F98FB66"><enum>(2)</enum><header>Fees</header>
						<subparagraph id="H77825763406C4EC498918DCA3D39E533"><enum>(A)</enum><header>Local
			 fees</header><text>The holder of the newly created catcher/processor owner
			 quota shares under paragraph (1) shall pay a fee of 5.0 percent of the
			 ex-vessel value of the crab harvested pursuant to those shares to any local
			 governmental entities in the Northern Region, that would otherwise have
			 received tax revenues from local raw fish taxes had the exchange authorized by
			 paragraph (1) not occurred.</text>
						</subparagraph><subparagraph id="H08B5041605564639B1646706C419A2CA"><enum>(B)</enum><header>State
			 fee</header><text>The State of Alaska may collect from the holder of the newly
			 created catcher/processor owner quota shares under paragraph (1) a fee of 1.0
			 percent of the ex-vessel value of the crab harvested pursuant to those
			 shares.</text>
						</subparagraph></paragraph><paragraph id="HF6CCC3653FE24F52A5C8562F67ABC007"><enum>(3)</enum><header>Landing
			 requirement</header><text>Crab harvested pursuant to catcher/processor owner
			 quota shares created under this subsection shall be landed in those communities
			 receiving the local governmental entities fee revenue set forth in paragraph
			 (2)(A).</text>
					</paragraph><paragraph id="H63CE3FF7EF304982B5D8CB8934A48F21"><enum>(4)</enum><header>Periodic Council
			 review</header><text>As part of its periodic review of the Plan referred to in
			 paragraph (1), the North Pacific Fishery Management Council may review the
			 effect, if any, of this subsection upon communities in the Northern Region. If
			 the Council determines that this section adversely affects the communities, the
			 Council may recommend to the Secretary of Commerce, and the Secretary may
			 approve, such changes to the Plan as are necessary to mitigate those adverse
			 effects.</text>
					</paragraph><paragraph id="H4B41F4BA1F034A4BB983FF77051C341D"><enum>(5)</enum><header>Limitation on
			 applications</header><text>Paragraph (1) shall apply only with respect to
			 entities that—</text>
						<subparagraph id="H188E2E107F3340F8B434F957A1BF2C7"><enum>(A)</enum><text>were initially
			 awarded catcher/processor owner quota shares under the Plan; and</text>
						</subparagraph><subparagraph id="H037387162A004C3AB688954C1333C2E9"><enum>(B)</enum><text>either were
			 initially awarded processor quota shares under the Plan or received such shares
			 under section 417(a) of the Coast Guard and Maritime Transportation Act of 2006
			 (Public Law
			 109–241; 120 Stat. 546).</text>
						</subparagraph></paragraph></subsection></section><section id="HAECD9CEB76704B0A8BEDE7CC7C18678E"><enum>302.</enum><header>Goods and
			 services</header><text display-inline="no-display-inline">Section 4(b) of the
			 Act of July 5, 1884, commonly known as the Rivers and Harbors Appropriation Act
			 of 1884 (33 U.S.C.
			 5(b)), is amended—</text>
				<paragraph id="H7EC10FDCD1EA478883085DD72419175C"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of paragraph (2)(C);</text>

				</paragraph></section><section id="H8E1D409352DF40E3AC6CFB86F35D242"><enum>303.</enum><header>Maritime
			 activities</header><text display-inline="no-display-inline">Not later than 30
			 days after the date of enactment of this Act, the Commandant of the Coast Guard
			 shall prepare and submit to the Committee on Transportation and Infrastructure
			 of the House of Representatives and the Committee on Commerce, Science, and
			 Transportation of the Senate a report on the use of funds provided to the
			 Alaska Sealife Center from the Oil Spill Liability Trust Fund.</text>
			</section><section display-inline="no-display-inline" id="H9740A2E86FEE43B0B4E9E37329B1C9D1" section-type="subsequent-section"><enum>304.</enum><header>Seaward extension of
			 anchorage grounds jurisdiction</header><text display-inline="no-display-inline">Section 7 of the Rivers and Harbors
			 Appropriations Act of 1915 (<external-xref legal-doc="usc" parsable-cite="usc/33/471">33 U.S.C. 471</external-xref>) is amended—</text>

			 Law Enforcement Act amendment-simple possession</header><text display-inline="no-display-inline">The Maritime Drug Law Enforcement Act (46
			 U.S.C. App. 1901-1904) is amended by adding at the end the following:</text>
				<quoted-block id="H7A8FDDE5254F4676B36053B45E9B4EA8" style="OLC">
					<section id="HE587B83E27BA40B9B76F50FF14F0F1DF"><enum>1905.</enum><header>Simple
				possession</header>
						<subsection id="H157345F41A0D44D9B2689C9866D61D05"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Any individual at a
				facility (as defined under
				section
				70101 of title 46, United States Code) or on a vessel subject
				to the jurisdiction of the United States who is found by the Secretary, after
				notice and an opportunity for a hearing, to have knowingly or intentionally
				possessed a controlled substance within the meaning of the Controlled
				Substances Act (21
				U.S.C. 812) shall be liable to the United States for a civil
				penalty of not to exceed $10,000 for each violation. The Secretary shall notify
				the individual in writing of the amount of the civil penalty.</text>
						</subsection><subsection id="HB750158AA9854B27966DE17C016E17AE"><enum>(b)</enum><header>Determination of
				amount</header><text>In determining the amount of the penalty, the Secretary
				shall consider the nature, circumstances, extent, and gravity of the prohibited
				acts committed and, with respect to the violator, the degree of culpability,
				any history of prior offenses, ability to pay, and other matters that justice
				requires.</text>
						</subsection><subsection id="H8C4818564EC24F278E80D374D26281AC"><enum>(c)</enum><header>Treatment of
				civil penalty assessment</header><text>Assessment of a civil penalty under this
				section shall not be considered a conviction for purposes of State or Federal
				law but may be considered proof of possession if such a determination is
				relevant.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HE67529CBB6354523BB2FDC56A114CEAD"><enum>306.</enum><header>Technical
			 amendments to tonnage measurement law</header>
				<subsection id="HCF7F9FBEAFDB4F33B544042C01504E7E"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/14301">Section 14301(b)(3)</external-xref> of title 46,
			 United States Code, is amended by inserting <quote>of United States or Canadian
			 registry</quote> after <quote>vessel</quote>.</text>
				</subsection><subsection id="HFD10EBE036D8453F8BB9AE701FA4AEDF"><enum>(b)</enum><header>Measurement</header><text>Section
			 14302(b) of such title is amended to read as follows:</text>

				</subsection><subsection display-inline="no-display-inline" id="H0E26279E4F114F94AE3F64D43E2503D1"><enum>(c)</enum><header>Reciprocity for
			 foreign vessels</header><text display-inline="yes-display-inline">Subchapter II
			 of chapter 145 of such title is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HDD84A1ED28B842788EA97FEB4CA0F9A7" style="USC">
						<section id="H11FADD110CFE44F0B506324C9EBEFB1B"><enum>14514.</enum><header>Reciprocity

				foreign vessel not measured under chapter 143, if the Secretary finds that the
				laws and regulations of a foreign country related to measurement of vessels are
				substantially similar to those of this chapter and the regulations prescribed
				under this chapter, the Secretary may accept the measurement and certificate of
				a vessel of that foreign country as complying with this chapter and the
				regulations prescribed under this
				chapter.</text>

			 measurement</header><text>Section 14513(c) of such title is amended—</text>

			 access</header><text display-inline="no-display-inline">Each facility security
			 plan approved under <external-xref legal-doc="usc" parsable-cite="usc/46/70103">section 70103(c)</external-xref> of title 46,
			 United States Code, shall provide a system for seamen assigned to a vessel at
			 that facility, pilots, and representatives of seamen’s welfare and labor
			 organizations to board and depart the vessel through the facility in a timely
			 manner at no cost to the individual.</text>
			</section><section id="H2170ED30E10D4B35AB976F004F796037"><enum>308.</enum><header>Limitation on
			 maritime liens on fishing permits</header>
				<subsection id="H7407C19F749740E9B06B794418CF87B1"><enum>(a)</enum><header>In
			 general</header><text>Subchapter I of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/313">chapter 313</external-xref> of title 46,
			 United States Code, is amended by adding at the end the following:</text>

						<section id="H93D1C04979404ED691425BD036E0148E"><enum>31310.</enum><header>Limitation on
				maritime liens on fishing permits</header>
							<subsection id="HF3454D5454054E949191FF8CC1B6A1B2"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">A maritime lien shall
				not attach to a permit that—</text>
								<paragraph id="H15955B4524B24EB69F74AB69F02CA0CF"><enum>(1)</enum><text>authorizes use of
				a vessel to engage in fishing; and</text>
								</paragraph><paragraph id="HFB2E9F1C36C74FCDA93817EF096600C0"><enum>(2)</enum><text>is issued under
				State or Federal law.</text>
								</paragraph></subsection><subsection id="HD115017072CC422E875D005FFEFFFFE"><enum>(b)</enum><header>Limitation on
				enforcement</header><text>No civil action may be brought to enforce a maritime
				lien on a permit described in subsection (a).</text>
							</subsection><subsection id="H0AF060FCCCA342C7A787B384182287FB"><enum>(c)</enum><header>Limitation on
				statutory construction</header><text>Nothing in subsections (a) and (b) shall
				be construed as imposing any limitation upon the authority of the Secretary of
				Commerce to modify, suspend, revoke, or sanction any Federal fishery permit
				issued by the Secretary of Commerce or to bring a civil action to enforce such
				modification, suspension, revocation, or
				sanction.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HC3054422F83847649F1457FF67804104"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by inserting
			 after the item relating to section 31309 the following:</text>

			</section><section id="H044171068C9A409E98D5C556A46C31B1"><enum>310.</enum><header>Documentation
			 of certain fishing vessels</header><text display-inline="no-display-inline">Section
			 12102(c)(5) of title 46, United States Code, as amended by
			 section 301(a) of this Act, is amended by adding at the end the
			 following:</text>
				<quoted-block id="HDCA7A71129604C818FBDF5C84004CA4" style="OLC">
					<subparagraph id="HF2C5C36CDA834FF69BBEA5D18CBAC2C" indent="up1"><enum>(D)</enum><text>the vessel has been issued a permit
				pursuant to part 648.6(a)(2) of title 50, Code of Federal Regulations, and the
				owner of the vessel—</text>
						<clause id="HF584A27DDABA46658D2DAAFA36C25A5"><enum>(i)</enum><text>demonstrates to the Secretary the
				recommendation and approval referred to in subparagraph (B);</text>
						</clause><clause id="H4623C0689C5D4E24AAFFFFC9F507C8C"><enum>(ii)</enum><text>is required under the endorsement
				to land all harvested fish and processed fish products at a United States port;
				and</text>
						</clause><clause id="H156ED6F7AED94B2996CEB31320D08C84"><enum>(iii)</enum><text>demonstrates to the Secretary
				that the vessel is in compliance with—</text>
							<subclause id="H9F2A3B46CFCA46BFBBB7F3799BBC3EF1"><enum>(I)</enum><text>requirements that otherwise apply under
				section 403 of the Magnuson-Stevens Fishery Conservation and Management Act
				(16 U.S.C.
				1881b) that the vessel carry one or more Federal observers;
				and</text>
							</subclause><subclause id="H9A66023838114CFE80C4FDB98CDF6958"><enum>(II)</enum><text>recordkeeping and reporting requirements
				that otherwise apply under part 648.7 of title 50, Code of Federal
				Regulations.</text>

			</section></title><title id="HB29C55747A054C98B5F7B90542AF2714"><enum>IV</enum><header>Miscellaneous
			 Provisions</header>
			<section display-inline="no-display-inline" id="H504CA7BDBAB34F01B7FBF779BBB1753F" section-type="subsequent-section"><enum>401.</enum><header>Secure
			 communications program</header><text display-inline="no-display-inline">There
			 is authorized to be appropriated to the Commandant of the Coast Guard
			 $3,000,000 to improve boarding team communications through the use of a
			 cryptographic mesh overlay protocol.</text>
			</section><section display-inline="no-display-inline" id="H3C0DC54446AE4BE38D10DB09394BD929" section-type="subsequent-section"><enum>402.</enum><header>Certificate of
			 documentation for GALLANT LADY</header><text display-inline="no-display-inline">Section 1120(c) of the Coast Guard
			 Authorization Act of 1996 (110 Stat. 3977) is amended—</text>
				<paragraph id="HDE314F47669B47259317000080F10235"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H55C4FA1EC54B4EF6B7DE984AFF2AB33"><enum>(A)</enum><text>by striking
			 <quote>of Transportation</quote> and inserting <quote>of the department in
			 which the Coast Guard is operating</quote>; and</text>

				</paragraph></section><section display-inline="no-display-inline" id="HC20D58B578EF416892E8CEC7BBB82590" section-type="subsequent-section"><enum>403.</enum><header>Waiver</header><text display-inline="no-display-inline">Notwithstanding section 27 of the Merchant
			 Marine Act, 1920 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/883">46 U.S.C. App. 883</external-xref>),
			 section 8 of the Act of June 19, 1886 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/289">46 U.S.C. App. 289</external-xref>; 24
			 Stat. 81), and <external-xref legal-doc="usc" parsable-cite="usc/46/12106">section 12106</external-xref> of title 46, United
			 States Code, the Secretary of the department in which the Coast Guard is
			 operating may issue a certificate of documentation with a coastwise endorsement
			 for the OCEAN VERITAS (IMO Number 7366805).</text>
			</section><section display-inline="no-display-inline" id="H8F360B1E68DF499A871439EB26FEADF9" section-type="subsequent-section"><enum>404.</enum><header>Data</header><text display-inline="no-display-inline">In each of fiscal years 2007 and 2008, there
			 is authorized to be appropriated to the Administrator of the National Oceanic
			 and Atmospheric Administration $7,000,000 to acquire through the use of
			 unmanned aerial vehicles data to improve the management of natural disasters,
			 and the safety of marine and aviation transportation.</text>
			</section><section display-inline="no-display-inline" id="HEE10EEAA37084A96AF33D4D5CC4B8C7B" section-type="subsequent-section"><enum>405.</enum><header>Great Lakes Maritime
			 Research Institute</header><text display-inline="no-display-inline">Section 605
			 of the Coast Guard and Maritime Transportation Act of 2004 (118 Stat. 1052) is
			 amended—</text>
				<paragraph id="H68759771F7A84269A9844418C5C4ADE5"><enum>(1)</enum><text>in subsection
			 (b)(1)—</text>
					<subparagraph id="HD4C237804DF44A2EB3F19F3BF0D702C8"><enum>(A)</enum><text>by striking
			 <quote>The Secretary of Transportation shall conduct a study that</quote> and
			 inserting <quote>The Institute shall conduct maritime transportation studies of
			 the Great Lakes region, including studies that</quote>;</text>

				system;</text>

				include intelligent transportation applications into the Great Lakes marine
				transportation system;</text>
							</subparagraph><subparagraph id="HDEB07D848DA8480E9000D3DBAF7B56C2"><enum>(N)</enum><text>analyze the
				effects and impacts of aging infrastructure and port corrosion on the Great
				Lakes marine transportation system;</text>
							</subparagraph><subparagraph id="HC7795B51834B4CC2B1FEFFDE248343B2"><enum>(O)</enum><text>establish and
				maintain a model Great Lakes marine transportation system database; and</text>
							</subparagraph><subparagraph id="HFCA0E7482EB342DAA2C7E1B0197B066"><enum>(P)</enum><text>identify market
				opportunities for, and impediments to, the use of United States-flag vessels in
				trade with Canada on the Great Lakes.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H48E47A06203F49D5BE305DE3653B90D1"><enum>(2)</enum><text>by striking
			 subsection (b)(4) and inserting the following:</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section display-inline="no-display-inline" id="H76AE0F577E624974AFEC9616C188009C" section-type="subsequent-section"><enum>406.</enum><header>Inspection and
			 certification of permanently moored vessels</header><text display-inline="no-display-inline">Any vessel which has a valid certificate of
			 inspection in effect on the date of enactment of this Act and which is
			 subsequently classified by the Coast Guard as a permanently moored vessel shall
			 remain eligible for a certificate of inspection for an additional 5 years from
			 the expiration date of the certificate of inspection in effect on the date of
			 the reclassification.</text>
			</section><section display-inline="no-display-inline" id="H2FEF6D6A3EDB462F9730F104C089D718" section-type="subsequent-section"><enum>407.</enum><header>Competitive
			 contracting for patrol boat replacement</header><text display-inline="no-display-inline">The Coast Guard may only buy or operate a
			 patrol boat replacement (fast response cutter) if the contract to build the
			 cutter is awarded using a competitive contracting procedure among shipyards in
			 the United States and the management of the competitive contracting procedure
			 is done by the Coast Guard or the primary contractor for the Deepwater Program
			 of the Coast Guard.</text>
			</section><section id="H1B06982E6D6747C78F8FF2C6285C00AE"><enum>408.</enum><header>Patrol boat
			 report</header><text display-inline="no-display-inline">Not later than 90 days
			 after the date of enactment of this Act the Secretary of the department in
			 which the Coast Guard is operating shall submit to the Committee on Commerce,
			 Science, and Transportation of the Senate and the Committee on Transportation
			 and Infrastructure of the House of Representatives a report how the Coast Guard
			 plans to manage the annual readiness gap of lost time for 110-foot patrol boats
			 from fiscal year 2007 through fiscal year 2013. The report shall
			 include—</text>
				<paragraph id="H227541FFE7CD4CD59F68F03CC92584F9"><enum>(1)</enum><text>an identification
			 of assets that may be used to alleviate the annual readiness gap of lost time
			 for such patrol boats;</text>
				</paragraph><paragraph id="H6F4B5B02D8F4486C8F00F4A537DCB564"><enum>(2)</enum><text>a
			 projection of the remaining operational lifespan of the 110-foot patrol boat
			 fleet;</text>
				</paragraph><paragraph id="H4FEC43C5D4F9466F91647F66D1FFED4D"><enum>(3)</enum><text>a
			 description of how extending through fiscal year 2013 the transfer agreement
			 between the Coast Guard and the United States Navy for 5 Cyclone class 179-foot
			 patrol coastal ships would effect the annual readiness gap of lost time for
			 110-foot patrol boats; and</text>
				</paragraph><paragraph id="H3FDD9E992ACA4D9F993FFF3E1D217E38"><enum>(4)</enum><text>an estimate of the
			 cost to extend the operational lifespan of the 110-foot patrol boat fleet for
			 each of fiscal years 2007 through 2013.</text>
				</paragraph></section><section display-inline="no-display-inline" id="HA472994915F4490CAEF07E83B4BE97E5" section-type="subsequent-section"><enum>409.</enum><header>Actions to address
			 sexual harassment and violence at Coast Guard Academy</header>
				<subsection id="H3D5C75C79E994A2184DCC6D0AAA140D6"><enum>(a)</enum><header>Policy on Sexual
			 harassment</header>
					<paragraph id="HAADEA998FD6E4568B435E9F6BD30FFE8"><enum>(1)</enum><header>In
			 general</header><text>Under guidance prescribed by the Secretary of the
			 department in which the Coast Guard is operating, the Commandant of the Coast
			 Guard shall direct the Superintendent of the Coast Guard Academy to prescribe a
			 policy on sexual harassment and violence applicable to the personnel of the
			 Coast Guard Academy.</text>
					</paragraph><paragraph id="HBF9B83BF989446588614292069B63F24"><enum>(2)</enum><header>Specified
			 programs and procedures</header><text>The policy on sexual harassment and
			 violence prescribed for the Academy under paragraph (1) shall specify the
			 following:</text>
						<subparagraph id="H303504448766423BAB5C6F95EE6676EB"><enum>(A)</enum><text>Programs to
			 promote awareness of the incidence of rape, acquaintance rape, and other sexual
			 offenses of a criminal nature that involve academy personnel.</text>
						</subparagraph><subparagraph id="H55EFBE0683524CFB003F6822255FAFDB"><enum>(B)</enum><text>Procedures that a
			 cadet should follow in the case of an occurrence of sexual harassment or
			 violence, including—</text>
							<clause id="H96A58B83610844A586B4386DE2ED001D"><enum>(i)</enum><text display-inline="yes-display-inline">a specification of the person or persons to
			 whom the alleged offense should be reported;</text>
							</clause><clause id="H48F6B4C2E7DB4496AE50F0CCD6C30000"><enum>(ii)</enum><text>a
			 specification of any other person whom the victim should contact; and</text>
							</clause><clause id="HB6CAAB3E5FA5430800F70478CB5B3B36"><enum>(iii)</enum><text>procedures on
			 the preservation of evidence potentially necessary for proof of criminal sexual
			 assault.</text>
							</clause></subparagraph><subparagraph id="H9E6FC462DDC044A3B6BD11789C8D9BB"><enum>(C)</enum><text>Procedures for
			 disciplinary action in cases of alleged criminal sexual assault involving
			 academy personnel.</text>
						</subparagraph><subparagraph id="HF93D0AC485FE4D2EB27905CCD5B46EFF"><enum>(D)</enum><text display-inline="yes-display-inline">Any other sanction authorized to be imposed
			 in a substantiated case of harassment or violence involving academy personnel
			 in rape, acquaintance rape, or any other criminal sexual offense, whether
			 forcible or nonforcible.</text>
						</subparagraph><subparagraph id="HF08D77F8AED6430DBA4CE71151A6D04"><enum>(E)</enum><text>Required training
			 on the policy for all academy personnel, including the specific training
			 required for personnel who process allegations of sexual harassment or violence
			 involving academy personnel.</text>
						</subparagraph></paragraph><paragraph id="H8A0DEE0076DB43A99B029208FD00F783"><enum>(3)</enum><header>Factors to
			 consider</header><text display-inline="yes-display-inline">In prescribing the
			 policy on sexual harassment and violence for the Academy under paragraph (1),
			 the Superintendent shall take into consideration—</text>
						<subparagraph id="H0F46AB7DA25C4C2CB98CF0C5EBADF008"><enum>(A)</enum><text>the findings,
			 conclusions, and recommendations of the panel established pursuant to title V
			 of the Emergency Wartime Supplemental Appropriations Act, 2003 (Public Law
			 108–11; 117 Stat. 609) to review sexual misconduct allegations
			 at the United States Air Force Academy; and</text>
						</subparagraph><subparagraph id="H0812A0B2A1104E19AD47BC1DD5458BF5"><enum>(B)</enum><text display-inline="yes-display-inline">the findings, conclusions, and
			 recommendations of other previous reviews and investigations of sexual
			 harassment and violence conducted with respect to the Coast Guard Academy and
			 one or more of the United States Military Academy, the United States Naval
			 Academy, or the United States Air Force Academy.</text>
						</subparagraph></paragraph><paragraph id="H3A73F55DDC644E5A9F79921065A60094"><enum>(4)</enum><header>Deadline</header><text>The
			 policy required by paragraph (1) shall be prescribed not later than June 1,
			 2007.</text>
					</paragraph></subsection><subsection id="H79C51334AAC2433A8F003900A53732BB"><enum>(b)</enum><header>Annual
			 assessment</header>
					<paragraph id="H989CA0E96A7644C4ADFC1CFAFCF283D"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall direct the Superintendent to conduct
			 at the Coast Guard Academy an assessment during the Academy’s program year to
			 determine the effectiveness of the Academy’s policies, training, and procedures
			 on sexual harassment and violence to prevent criminal sexual harassment and
			 violence involving academy personnel.</text>
					</paragraph><paragraph id="H7B51E988A27D4A46AA8C00187DF97DF"><enum>(2)</enum><header>Survey of
			 personnel</header><text>For the assessment for each academy program year, the
			 Superintendent shall conduct a survey of all academy personnel—</text>
						<subparagraph id="HF20418E2C67C4B9687DCD3093BC7ED8F"><enum>(A)</enum><text>to measure—</text>
							<clause id="HBDC685D7F1F54A05921CC2335F3B5007"><enum>(i)</enum><text display-inline="yes-display-inline">the incidence, during that program year, of
			 sexual harassment and violence events, on or off the academy reservation, that
			 have been reported to officials of the Academy; and</text>
							</clause><clause id="H4F44BAB1EC4B4C2FB13C39792C844C02"><enum>(ii)</enum><text>the
			 incidence, in that program year, of sexual harassment and violence events, on
			 or off the academy reservation, that have not been reported to officials of the
			 Academy; and</text>
							</clause></subparagraph><subparagraph id="H451AFEDB33064578A4D1BAD9B729D649"><enum>(B)</enum><text>to assess the
			 perceptions of academy personnel on—</text>
							<clause id="H2243A87F73904621A99274FDBCA61D8"><enum>(i)</enum><text>the
			 policies, training, and procedures on sexual harassment and violence involving
			 academy personnel;</text>
							</clause><clause id="HFB1B494A058F4E72BB6275DBD5BCE2F"><enum>(ii)</enum><text>the
			 enforcement of such policies;</text>
							</clause><clause id="HDBFB0EB5E77946679190433BF465B524"><enum>(iii)</enum><text>the incidence of
			 sexual harassment and violence involving academy personnel in such program
			 year; and</text>
							</clause><clause id="HF20AEA5BFBCF4482A730125D1BB139E"><enum>(iv)</enum><text>any
			 other issues relating to sexual harassment and violence involving academy
			 personnel.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="HEEB4CFB7E2F84E9B00F0E08636BC9555"><enum>(c)</enum><header>Annual
			 report</header>
					<paragraph id="H7C48D19095C3416CBED5AA7D7C2BF4E2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Commandant shall
			 direct the Superintendent to submit to the Secretary a report on sexual
			 harassment and violence involving academy personnel for each academy program
			 year.</text>
					</paragraph><paragraph id="H928EE0CC0D9C445A9C6DA8EC33F019F4"><enum>(2)</enum><header>Specified
			 matters to be covered</header><text display-inline="yes-display-inline">The
			 annual report for the Academy under paragraph (1) shall contain, for the
			 academy program year covered by the report, the following matters:</text>
						<subparagraph id="H23C733F50DCE4DE79CFE7C49EF21E74"><enum>(A)</enum><text>The number of
			 sexual assaults, rapes, and other sexual offenses involving academy personnel
			 that have been reported to academy officials during the program year and the
			 number of the reported cases that have been substantiated.</text>
						</subparagraph><subparagraph id="H8F0AED37AB044CB1B03F60F4FC5165EE"><enum>(B)</enum><text>The policies,
			 procedures, and processes implemented by the Commandant and the leadership of
			 the Academy in response to sexual harassment and violence involving academy
			 personnel during the program year.</text>

			 Representatives.</text>
					</paragraph><paragraph id="HE1A22D6C54034767885D961BCECEB8DF"><enum>(5)</enum><header>Deadline for
			 2008 report</header><text>The report for the 2008 academy program year shall be

			 demonstration project</header>
				<subsection id="H0228B3B2C1B541EB9578B0FAA500C958"><enum>(a)</enum><header>In
			 general</header><text>The Commandant of the Coast Guard, in cooperation the
			 regional trade association representing the major cruise lines that operate in
			 the Alaska cruise trade, shall conduct a demonstration project on the methods
			 and best practices of the use of smokestack scrubbers on cruise ships that
			 operate in that region.</text>
				</subsection><subsection id="H10D8F9232AC04B29ADF71DE2A31CBC66"><enum>(b)</enum><header>Agreement</header><text>The
			 Commandant of the Coast Guard may enter into an agreement with the regional
			 trade association referred to in subsection (a), or one or more of its members,
			 to assist in conducting the demonstration project under subsection (a).</text>
				</subsection><subsection id="HA667BBF164C346A9A1BA06CF9567D48"><enum>(c)</enum><header>Report</header><text>Upon
			 completion of the project described in subsection (a), the Commandant of the
			 Coast Guard shall submit a report on the results of the project to the
			 Committee on Transportation and Infrastructure of the House of Representatives
			 and the Committee on Commerce, Science, and Transportation of the
			 Senate.</text>
				</subsection></section><section display-inline="no-display-inline" id="H1BD9F9BE0EDB4AECBE6F130300C585A7" section-type="subsequent-section"><enum>411.</enum><header>Crew wages on
			 passenger vessels</header>
				<subsection id="H8382527D82494F89B6A209E61D2F6FF4"><enum>(a)</enum><header>Foreign and
			 Intercoastal voyages</header>
					<paragraph id="HFFFE7D30B18545C0A7E8F90082FB84D9"><enum>(1)</enum><header>Cap on penalty
			 wages</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/10313">Section 10313(g)</external-xref> of title 46,
			 United States Code, is amended—</text>
						<subparagraph id="HD1CF77D18B5247D196005D1CB037B55"><enum>(A)</enum><text>by striking
			 <quote>When</quote> and inserting <quote>(1) Subject to paragraph (2),
			 when</quote>; and</text>

								</paragraph><paragraph id="HDD97F758C9CA41A499BD431F005BD8EB" indent="up1"><enum>(3)</enum><text>A class action suit for wages under
				this subsection must be commenced within three years after the later of—</text>
									<subparagraph id="HBD8C1E0EC88D412884CA3E5B6C66B58C"><enum>(A)</enum><text>the date of the end of the last voyage
				for which the wages are claimed; or</text>
									</subparagraph><subparagraph id="H5B0A90E166104B6FA784A22128B75672"><enum>(B)</enum><text>the receipt, by a seaman who is a
				claimant in the suit, of a payment of wages that are the subject of the suit
				that is made in the ordinary course of
				employment.</text>

						</subparagraph></paragraph><paragraph id="H678CC139487942EC84B8C78309CB9D24"><enum>(2)</enum><header>Deposits</header><text>Section
			 10315 of such title is amended by adding at the end the following:</text>

				authorize, by written request signed by the seaman, the master, owner, or
				operator of the vessel, or the employer of the seaman, to make deposits of
				wages of the seaman into a checking, savings, investment, or retirement
				account, or other account to secure a payroll or debit card for the seaman
				if—</text>
								<paragraph id="H8704F81ABD7546129771A500F801C3D"><enum>(1)</enum><text>the wages
				designated by the seaman for such deposit are deposited in a United States or
				international financial institution designated by the seaman;</text>
								</paragraph><paragraph id="H4849898D3CE74AE681C8613CECB7AEFF"><enum>(2)</enum><text>such deposits in
				the financial institution are fully guaranteed under commonly accepted
				international standards by the government of the country in which the financial
				institution is licensed;</text>
								</paragraph><paragraph id="H4DAA48FB9361439A85A8776116BFC1E"><enum>(3)</enum><text>a written wage
				statement or pay stub, including an accounting of any direct deposit, is
				delivered to the seaman no less often than monthly; and</text>
								</paragraph><paragraph id="HB6CD95D102444C338D2B11AD20D083A9"><enum>(4)</enum><text>while on board the
				vessel on which the seaman is employed, the seaman is able to arrange for
				withdrawal of all funds on deposit in the account in which the wages are
				deposited.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H16B7CF7612BF43770065B8054173C906"><enum>(b)</enum><header>Coastwise
			 voyages</header>
					<paragraph id="H90B319B861D84B0A87A58C6FE4FD49BB"><enum>(1)</enum><header>Cap on penalty
			 wages</header><text>Section 10504(c) of such title is amended—</text>

								</subparagraph><subparagraph id="HAC1DA393A76A4644006B61ED31C91657"><enum>(B)</enum><text>is in the
				territorial sea of the United States as defined in Presidential Proclamation
				5928 of December 27, 1988;</text>
								</subparagraph><subparagraph id="H7C4172E69B9B4F95B3BCF4835E72055E"><enum>(C)</enum><text>is in an emission
				control area designated pursuant to section 4; or</text>
								</subparagraph><subparagraph id="H4F1C10044B634E47AC2E55C6722E15C6"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HA3FB659689324ECAA7E068C3D3AE1604"><enum>(i)</enum><text>is bound for or
				departing a port, shipyard, offshore terminal, or the internal waters of the
				United States; and</text>
									</clause><clause id="H013B951A0D6041118ED4662D24D8788" indent="up1"><enum>(ii)</enum><text>is in any other area that the
				Administrator, in consultation with the Secretary, has designated by regulation
				and based on the best available scientific data as being an area from which
				emissions from ships are of concern with respect to protection of public
				health, welfare, or the
				environment.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HEAE8904DB7BA4D108241912566A0358E"><enum>(2)</enum><text>in subsection
			 (b)(1) by inserting <quote>or (3)</quote> after <quote>paragraph
			 (2)</quote>;</text>
				</paragraph><paragraph id="HED626BE2E6374D02BA672048FB015524"><enum>(3)</enum><text>in subsection (b)
			 by adding at the end the following:</text>
					<quoted-block id="HF5908F260A674ECBB85953B72E2B9C44" style="OLC">
						<paragraph id="HA18EBC87C24C4B9D9EDC85DC5400662E" indent="up1"><enum>(3)</enum><text>With respect to Annex VI to the
				Convention, the head of a Federal department or agency may determine that some
				or all of the requirements under this Act shall apply to one or more classes of
				public vessels operated under the authority of such department or
				agency.</text>
						</paragraph><after-quoted-block>; and
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H198AAE269CEE40E391B3912E56B7F818"><enum>(4)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="HDD5603A322EE4BCB853DDCDDB373B536"><enum>(A)</enum><text>by inserting
			 <quote>, or the Administrator as authorized by section 4,</quote> after
			 <quote>Secretary</quote>;</text>
					</subparagraph><subparagraph id="H7C33083DDB9944C781004B2C77DF66A9"><enum>(B)</enum><text>by inserting
			 <quote>(or an applicable Annex)</quote> after <quote>MARPOL Protocol</quote>
			 the first place it appears; and</text>
					</subparagraph><subparagraph id="HD4284EECC76547F0BBCEBAC4CD30D548"><enum>(C)</enum><text>by inserting
			 <quote>and Annex VI</quote> after <quote>Annex V</quote>.</text>
					</subparagraph></paragraph></section><section id="H1289B74C914C4F2A96D1B5B642EAAB6F"><enum>505.</enum><header>Administration
			 and enforcement</header><text display-inline="no-display-inline">Section 4(b)
			 (33 U.S.C.
			 1903(b)) is amended—</text>
				<paragraph id="HE80A13995A904690A51EE1C72B4EF2EF"><enum>(1)</enum><text>by redesignating
			 paragraph (2) as paragraph (4);</text>
				</paragraph><paragraph id="H8A7844667368496BB4448B8EC1E09213"><enum>(2)</enum><text>by inserting after
			 paragraph (1) the following:</text>
					<quoted-block id="H334BCA6B5F2C4409AACF6B9314CFE492" style="OLC">
						<paragraph id="HB527A5E6C05A4C148730A7FE25F8B759" indent="up1"><enum>(2)</enum><text>In prescribing regulations under this
				section to carry out the provisions of Annex VI to the Convention, the
				Secretary shall consult with the Administrator with respect to Regulations 12
				and 16 of such Annex and with the Administrator and the Secretary of the
				Interior with respect to Regulation 19 of such Annex.</text>
						</paragraph><paragraph id="HCD39A591CA7342158706967D03A55E9" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In addition to the authority the Secretary
				has to prescribe regulations under this section to carry out Annex VI to the
				Convention, the Administrator, in consultation with the Secretary, shall
				prescribe any necessary or desired regulations to carry out Regulations 13, 14,
				15, and 18 of such Annex.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HBFDB6830E1E64C54B4056E4F6215D366"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HC826B0F837C84814BD162BDAB9C90596" style="OLC">
						<paragraph id="H6BCC685CB3FC462BB0C93B1B437E0353" indent="up1"><enum>(5)</enum><text>No standard issued by any person or
				Federal agency regarding emissions from tank vessels that are subject to
				Regulation 15 of Annex VI to the Convention shall be effective until six months
				after the date on which the Secretary submits a notification to the
				International Maritime Organization that such standard has been
				established.</text>
						</paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</paragraph></section><section id="HC99AF6D1557F49958CD368006D70C07D"><enum>506.</enum><header>Certificates</header><text display-inline="no-display-inline">Section 5 (<external-xref legal-doc="usc" parsable-cite="usc/33/1904">33 U.S.C. 1904</external-xref>) is amended—</text>
				<paragraph id="H73999B98C24F46EA9D58F6FFFA41811F"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="HFBA7F3B47EF94C9DB2E7805CD32E4C00"><enum>(A)</enum><text>by striking
			 <quote>The</quote> and inserting <quote>(1) Except as provided in paragraph
			 (2), the</quote>; and</text>
					</subparagraph><subparagraph id="HE4400365641742319FBB8E11BAA280A2"><enum>(B)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block id="H45C829C90FCE490D9C8E75B02CC03AA" style="OLC">
							<paragraph id="HB409AFAD67A94045A2185935C14DB19B" indent="up1"><enum>(2)</enum><text>The Administrator shall, and no other
				person may, issue an Engine International Air Pollution Prevention Certificate
				in accordance with Annex VI to the Convention and the International Maritime
				Organization’s Technical Code on Control of Emissions of Nitrogen Oxides from
				Marine Diesel Engines, on behalf of the United States. The issuance of such
				certificates shall be consistent with any applicable requirements under the
				Clean Air Act (42
				U.S.C. 7401 et seq.) and regulations promulgated
				thereunder.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H14CB4413DB9648DDA254405459C190EB"><enum>(2)</enum><text>by striking
			 subsection (b) and inserting the following:</text>
					<quoted-block id="H2852325F2F3B44498C406E388377A953" style="OLC">
						<subsection id="HBAF32243B8BF4778B3957842270029C7"><enum>(b)</enum><text>A certificate
				issued by a country that is a party to the MARPOL Protocol has the same
				validity as a certificate issued by the Secretary under this Act or by the
				Administrator under subsection (a)(2).</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7C74D970F85E4C7993C0BBCE274B808"><enum>(3)</enum><text>in
			 subsection (e) by inserting <quote>or the public health or welfare</quote>
			 after <quote>marine environment</quote>.</text>
				</paragraph></section><section id="H54C2F0B384BF4EE39317B2003EE04C38"><enum>507.</enum><header>Reception
			 facilities</header><text display-inline="no-display-inline">Section 6
			 (33 U.S.C.
			 1905) is amended—</text>
				<paragraph id="HA400591AA3DA4AFFAEADBB944800DCE4"><enum>(1)</enum><text>in subsection (a)
			 by adding at the end the following:</text>
					<quoted-block id="H1ABC76DBCE2046D2B60031EBB4AB9E96" style="OLC">
						<paragraph id="H39A37A72DAC74D5C006308657D916495" indent="up1"><enum>(3)</enum><text>The Secretary, after consulting with
				appropriate Federal agencies, shall establish regulations to require that ports
				and terminals provide reception facilities for receiving ozone depleting
				substances, equipment containing such substances, and exhaust gas cleaning
				residues or ensure that such facilities are available. The regulations shall
				establish criteria for determining the adequacy of reception facilities for
				receiving such substances, equipment, or residues at a port or terminal and
				such additional measures and requirements as are appropriate to ensure such
				adequacy.</text>
						</paragraph><paragraph id="H15E43F6F7B084BE9AE71705F7E006DB9" indent="up1"><enum>(4)</enum><text>The Secretary may establish
				regulations to certify, and may issue certificates to the effect, that a port’s
				or terminal’s facilities for receiving such substances, equipment, and residues
				from ships are
				adequate.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4A17F10230444607AE7BBFF5F5DF77B"><enum>(2)</enum><text>in
			 subsection (c)(2)(A) by inserting <quote>or (a)(3)</quote> after
			 <quote>subsection (a)(2)</quote>;</text>
				</paragraph><paragraph id="H1E7C2F1D6A3D4295A0853CEF7600EB94"><enum>(3)</enum><text>by striking
			 subsection (e)(2) and inserting the following:</text>
					<quoted-block id="H03B2C42061224DA380E125275C073B57" style="OLC">
						<paragraph id="H27322C9E67374935AD064627C7AB36B" indent="up1"><enum>(2)</enum><text>The Secretary may deny the entry of a
				ship to a port or terminal required by regulations issued under this section to
				provide adequate reception facilities for garbage, ozone depleting substances,
				equipment containing such substances, and exhaust gas cleaning residues if the
				port of terminal is not in compliance with such
				regulations.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD29BEC3ECA9B4C2AA959F1B7F4F241F8"><enum>(4)</enum><text>in subsection
			 (f)(1) by striking <quote>MARPOL Protocol or the Antarctic Protocol</quote> and
			 inserting <quote>MARPOL Protocol, the Antarctic Protocol, or this
			 Act</quote>.</text>
				</paragraph></section><section id="H9E2ABA4D5EA542C3972E2DDFAC1DABC0"><enum>508.</enum><header>Inspections</header><text display-inline="no-display-inline">Section 8(f) (<external-xref legal-doc="usc" parsable-cite="usc/33/1907">33 U.S.C. 1907(f)</external-xref>) is amended to
			 read as follows:</text>
				<quoted-block id="H11B6789D375740FEB623699EB200AB92" style="OLC">
					<subsection id="H22C61E4111704B46AA51F47036A00666"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE07219FC97454184A5F77000CC4E9F43"><enum>(1)</enum><text>The Secretary may
				inspect a ship to which this Act applies as provided under section 3(a)(5), to
				verify whether the ship is in compliance with Annex VI to the Convention and
				this Act.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="HCF262790F20847F6A785B439CF70AAA1" indent="up1"><enum>(2)</enum><text>If an inspection under this
				subsection or any other information indicates that a violation has occurred,
				the Secretary may undertake enforcement action under this
				section.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H97770AF2EB2A442187B84687F4E4F589"><enum>509.</enum><header>Amendments to
			 the protocol</header><text display-inline="no-display-inline">Section 10(b)
			 (33 U.S.C.
			 1909(b)) is amended by striking <quote>Annex I, II, or
			 V</quote> and by inserting <quote>Annex I, II, V, or VI</quote>.</text>
			</section><section id="H79210AE22EF64783A9ACBC74F5388799"><enum>510.</enum><header>Effect on other
			 laws</header><text display-inline="no-display-inline">Section 15
			 (33 U.S.C.
			 1911) is amended to read as follows:</text>

				any other authorities, requirements, or remedies conferred by any other
				provision of law. Nothing in this Act shall limit, deny, amend, modify, or
				repeal any other authority, requirement, or remedy available to the United
				States or any other person, except as expressly provided in this
				Act.</text>

			</section><section id="H2E02E0FA9C8D4BDA865067E04BA100FA"><enum>511.</enum><header>MARPOL
			 technical corrections</header><text display-inline="no-display-inline">Subsections (a), (b), and (d) of section 9
			 (33 U.S.C.
			 1908(a), (b), and (d)) are amended by striking the second comma
			 after <quote>MARPOL Protocol</quote> each place it appears.</text>
