<official-title>To extend the time for filing certain claims under the September 11th Victim Compensation Fund of 2001, and for other purposes.</official-title>

<section id="HFFC91820725C44D100533D18770054A6" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Victim Compensation Fund Extension Act</short-title></quote>.</text></section> 
<section id="H01CF69C396B5420AADA63D79216E62A5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HDEDC2D5A197B435FAA0800AA21C33EB6"><enum>(1)</enum><text display-inline="yes-display-inline">The September 11th Victim Compensation Fund of 2001 was established to provide compensation to individuals (or relatives of deceased individuals) who were physically injured or killed as a result of the terrorist-related aircraft crashes of September 11, 2001.</text></paragraph> 
<paragraph id="H341AC16D27BF4181925CAC728536AF2F"><enum>(2)</enum><text>The deadline for filing claims for compensation under the Victim Compensation Fund was December 22, 2003. </text></paragraph> 
<paragraph id="H72E1B6BD648043F3AC2068D4CA68283D"><enum>(3)</enum><text>Some individuals did not know they were eligible to file claims for compensation or did not know they had suffered physical harm as a result of the terrorist-related aircraft crashes until after the December 22, 2003, deadline.</text></paragraph></section> 
<section id="HE0811FC5807E4017B11C07D6B7B00E2"><enum>3.</enum><header>Deadline extension for certain claims under September <enum-in-header>11</enum-in-header>th Victim Compensation Fund of <enum-in-header>2001</enum-in-header></header><text display-inline="no-display-inline">Section 405(a)(3) of the Air Transportation Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended to read as follows:</text>

<paragraph id="HAF5ACC9289AF4D14AAC427F139B9C6A5"><enum>(3)</enum><header>Limitation</header> 
<subparagraph id="HA7D7962EB27D476BA9B48044B026A9B"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), no claim may be filed under paragraph (1) after December 22, 2003.</text></subparagraph> 
<subparagraph id="HBC16EE35C9AD4A7582C7FE003C65A1D5"><enum>(B)</enum><header>Exceptions</header><text>A claim may be filed under paragraph (1)—</text> 
<clause id="H373567DC05724260A418007C00F2D7BD"><enum>(i)</enum><text>during the 3-year period after the date of the enactment of this subparagraph, if the Special Master determines that the claimant—</text> 
<subclause id="H08B5E3572A1544E9B6CDDA65A2D434E9"><enum>(I)</enum><text>did not know that the claimant had suffered physical harm as a result of the terrorist-related aircraft crashes of September 11, 2001, until after December 22, 2003, and before the date of the enactment of this subparagraph; or</text></subclause> 
<subclause id="HF140DEF87D944E0A9BC7D0CCDFA5BFD1"><enum>(II)</enum><text display-inline="yes-display-inline">did not for any reason other than as described in subclause (I) know that the claimant was eligible to file a claim under paragraph (1) until after December 22, 2003; and</text></subclause></clause> 
<clause id="H2F2EFA98E526488FA6832D098DFA00E2"><enum>(ii)</enum><text display-inline="yes-display-inline">during the 3-year period after the date that the claimant first knew that the claimant had suffered physical harm as a result of the terrorist-related aircraft crashes of September 11, 2001, if the Special Master determines that the claimant did not know that the claimant had suffered physical harm as a result of the crashes until a date that is on or after the date of the enactment of this subparagraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H27682F5F903E4967BDF292C51500FAE5"><enum>4.</enum><header>Immediate aftermath defined</header><text display-inline="no-display-inline">Section 402 of the Air Transportation Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H0A4DEDDC95814D72932683169F490391"><enum>(9)</enum><header>Immediate aftermath</header><text display-inline="yes-display-inline">In section 405(c)(2)(A)(i), the term <term>immediate aftermath</term> means any period of time after the terrorist-related aircraft crashes of September 11, 2001, as determined by the Special Master, that was sufficiently close in time to the crashes that there was a demonstrable risk to the claimant of physical harm resulting from the crashes.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
