		  application of innovative energy technologies derived from federally-sponsored
		  research and development programs, by incorporating those technologies into
		  Federal buildings, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H90475C31EB9645C394C00034A0B0248E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Stimulus of Commercial
			 Application of Energy Technology Act of 2006</short-title></quote>.</text>
		</section><section id="H7E95C686C1CB4EBEAB149807B8C65137"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text>
			<paragraph display-inline="no-display-inline" id="HAED942BAA78E496BA2BFA33F981F704E"><enum>(1)</enum><header>Cost-effective</header><text>The
			 term <quote>cost-effective</quote> means resulting in a simple payback of costs
			 in 10 years or less.</text>
			</paragraph><paragraph id="H3116DEC952AE4DB590B29E74469273B5"><enum>(2)</enum><header>Department</header><text>The
			 term <quote>Department</quote> means the Department of Energy.</text>
			</paragraph><paragraph id="HDC11E999FF584F579E00D036E958A761"><enum>(3)</enum><header>Fund</header><text>The
			 term <quote>Fund</quote> means the Innovative Energy Technologies Fund for
			 Federal Buildings established in section 3.</text>
			</paragraph><paragraph id="HF42A48310838499E853887A35442E6B7"><enum>(4)</enum><header>Innovative
			 energy technology</header><text display-inline="yes-display-inline">The term
			 <quote>innovative energy technology</quote> means a technology, including an
			 advanced energy conservation or renewable energy technology, that was developed
			 with the support of the Department, or other similar technology.</text>
			</paragraph><paragraph display-inline="no-display-inline" id="HE8BB040DA4B84323968FDA693CFFAEAD"><enum>(5)</enum><header>Innovative
			 energy technology project</header><text display-inline="yes-display-inline">The
			 term <quote>innovative energy technology project</quote> means a project
			 that—</text>
				<subparagraph id="HE5ED474B7D27485AAA4226E6B0D900BF"><enum>(A)</enum><text>results in the
			 cost-effective commercial application of an innovative energy technology;
			 and</text>
				</subparagraph><subparagraph id="H6E1C2EC7CAE94C29A37744A793D3B0FF"><enum>(B)</enum><text>assists a Federal
			 agency in meeting or exceeding all Federal energy efficiency requirements then
			 in effect, including applicable Executive orders such as Executive Order Nos.
			 12759 and 13123.</text>
				</subparagraph></paragraph><paragraph id="HBC53FE55A4FC4F05B2DBB8E341D28251"><enum>(6)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Energy.</text>
			</paragraph></section><section id="HC8B03F50ABD64ACF88D3358BF19F223D"><enum>3.</enum><header>Establishment of
			 Fund</header>
			<subsection id="H938E2E991AFE408899C5D533D1874EC2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 6
			 months after the date of enactment of this Act, the Secretary of Energy shall
			 establish the Innovative Energy Technologies Fund for Federal Buildings. The
			 Secretary of Energy shall administer the Fund to enable Federal agencies to
			 demonstrate innovative energy technologies for retrofit or new construction of
			 Federal buildings and facilities.</text>
			</subsection><subsection id="HB2518697F0E646129164B5CD313DB8B9"><enum>(b)</enum><header>Criteria and
			 guidelines</header><text>Not later than 6 months after the date of enactment of
			 this Act, the Secretary shall establish criteria and guidelines for Federal
			 agencies to borrow from and pay back to the Fund.</text>
			</subsection></section><section id="H668B84AC6A0B4D01A993B04C09B838AC"><enum>4.</enum><header>Loans from the
			 Fund</header>
			<subsection id="HA063ADB2874D4BA1B1DCD46BD009D00"><enum>(a)</enum><header>General
			 procedure</header><text display-inline="yes-display-inline">Federal agencies
			 may apply to the Secretary for a loan for financing the demonstration of
			 innovative energy technology projects, and shall repay the Fund from savings in
			 energy, water, and other costs attributable to actions taken as a result of the
			 project undertaken with the loan.</text>
			</subsection><subsection id="H64812596C6BF473C9BA7851F3DEDFE99"><enum>(b)</enum><header>Purposes of
			 loan</header><text display-inline="yes-display-inline">In addition to financing
			 an innovative energy technology project, a Federal agency may use the loan
			 amount to pay the costs of administration and proposal development (including
			 data collection and energy surveys), and to acquire and operate equipment
			 necessary to monitor and verify associated energy savings.</text>
			</subsection><subsection id="HAB681E603FE8412D85E39B38CB391C73"><enum>(c)</enum><header>Repayments</header><text>A
			 Federal agency shall repay to the Fund the principal amount of the loan, plus
			 interest at a rate determined by the Secretary. The repayment period shall be
			 15 years, or less as appropriate to the project.</text>
			</subsection></section><section id="HC86AA6456C874163AFDA5F8B645B4494"><enum>5.</enum><header>Reports and
			 audits</header>
			<subsection id="HC405900620544BF69EBD89FC55154B00"><enum>(a)</enum><header>Reports to the
			 secretary</header><text display-inline="yes-display-inline">Not later than 1
			 year after the installation of an innovative energy technology project for
			 which a loan is provided under this Act in an amount greater than $1,000,000,
			 and each year thereafter until the date that final repayment of the loan is
			 due, the Federal agency receiving the loan shall transmit to the Secretary a
			 report that—</text>
				<paragraph id="HE7FC44A6F3504567839654AAAC36D000"><enum>(1)</enum><text>states whether the
			 project meets or fails to meet the energy savings projections for the project;
			 and</text>
				</paragraph><paragraph id="H67D8432A5C674008AB215DB66B30BBCD"><enum>(2)</enum><text>for each project
			 that fails to meet the energy savings projections, states the reasons for the
			 failure and describes proposed remedies.</text>
				</paragraph></subsection><subsection id="HF96FC75B8B124AAABFBB058EF86FF6E9"><enum>(b)</enum><header>Audits</header><text display-inline="yes-display-inline">The Secretary may audit any innovative
			 energy technology project financed with a loan from the Fund to assess the
			 project’s performance.</text>
			</subsection><subsection id="H932C6D3163D245CAB001F7876657002E"><enum>(c)</enum><header>Reports to
			 Congress</header><text>At the end of each fiscal year, the Secretary shall
			 transmit to Congress a report on the operations of the Fund, including a
			 statement of the total receipts into the Fund, and the total expenditures from
			 the Fund to each Federal agency.</text>
			</subsection></section><section id="H61ED221BA5D2497A8571C84A0ED53E5"><enum>6.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H58353FE882314B5697D4665215F7C2E6"><enum>(a)</enum><header>Establishment of
			 Fund</header><text display-inline="yes-display-inline">There are authorized to
			 be appropriated to the Secretary for the establishment of the Fund,
			 $100,000,000 for each of the fiscal years 2007 through 2016.</text>
			</subsection><subsection id="H384A7D523BB64C87A1B1520619841CDD"><enum>(b)</enum><header>Operation of
			 Fund</header><text display-inline="yes-display-inline">There are authorized to
			 be appropriated to the Secretary from the Fund, for carrying out the loan
			 program under this Act, such sums as may be necessary.</text>
			</subsection></section></legis-body>
