		<section id="HB01F46116578490AA09BE9ED945B24CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Preventive Medicine for a Healthier America Act of 2006</quote>.</text>
		</section><section id="HE6E58989D52B45BF9B8435C5F2290078" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
			<paragraph id="H427C45EE1CF745B1999C2B317706C804"><enum>(1)</enum><text>Improving the
			 health of the population and reducing medical costs requires implementation of
			 preventive methods.</text>
			</paragraph><paragraph id="H0291B9FD849145F900A78EF9DB18EB89"><enum>(2)</enum><text display-inline="yes-display-inline">Organizations throughout the United States
			 have expressed the need for an increase of public health professionals.</text>
			</paragraph><paragraph id="H662E663DF5D84F32A7AFD94856A9ED00"><enum>(3)</enum><text display-inline="yes-display-inline">There are only approximately 6,000
			 physicians board certified in preventive medicine.</text>
			</paragraph><paragraph id="H0A4AA23AF00447AEB11805C2564302CE"><enum>(4)</enum><text>Many health care
			 costs are spent on chronic conditions that could be avoided by implementing
			 preventive methods.</text>
			</paragraph><paragraph id="H452EA1C7F0504C97AFBCB49311FAFA62"><enum>(5)</enum><text>The number of
			 preventive medicine residency programs and individuals pursuing preventive
			 medicine has significantly decreased in recent years.</text>
			</paragraph><paragraph id="HD4025A33EC8E42A9A05B137B92F3003E"><enum>(6)</enum><text>Preventive
			 medicine physicians are uniquely trained to serve patients and
			 communities.</text>
			</paragraph><paragraph id="H879B85DDFA604E94921EEF9F8D84E744"><enum>(7)</enum><text>A
			 strong public health system requires a strong preventive medicine
			 workforce.</text>
			</paragraph></section><section id="H047B7AB65A7F4CCE81308E75CDE51765"><enum>3.</enum><header>Loan payment
			 assistance for preventive medicine physicians</header>
			<subsection id="H54BF3D5F0DBF45EB92700023BE87663E"><enum>(a)</enum><header>Payments</header><text display-inline="yes-display-inline">On behalf of any eligible preventive
			 medicine physician, the Secretary of Health and Human Services may pay up to
			 $20,000 of the medical education loans incurred by the physician.</text>
			</subsection><subsection id="HEC63F3CB621C4403B6614E77BC88E443"><enum>(b)</enum><header>Application</header><text>To
			 request a payment under this section, an eligible preventive medicine physician
			 shall submit an application to the Secretary at such time, in such manner, and
			 containing such information as the Secretary may require.</text>
			</subsection><subsection id="HE62D56A93B994E6FB87298B0516891B"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H595D9B28679740F8ADDEA8007EC7AFAA"><enum>(1)</enum><text>The term
			 <term>eligible preventive medicine physician</term> means a practicing
			 physician who receives board certification in preventive medicine during the
			 period of fiscal years 2007 through 2011.</text>
				</paragraph><paragraph id="HD627F3015ADC4AE49DC5BCC4A926E35F"><enum>(2)</enum><text>The term
			 <term>medical education loan</term> means the outstanding principal of and
			 interest on a loan incurred for the cost of attendance (including tuition,
			 other reasonable educational expenses, and reasonable living costs) at a school
			 of medicine.</text>
				</paragraph><paragraph id="HF4FC1FE08311425BB04331C671F9F242"><enum>(3)</enum><text>The term
			 <term>school of medicine</term> has the meaning given to that term in section
			 799B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p</external-xref>).</text>
				</paragraph><paragraph id="HE20BD267675D402FAD30A35C2DA01F20"><enum>(4)</enum><text>The term
			 <term>Secretary</term> means the Secretary of Health and Human Services.</text>
				</paragraph></subsection><subsection id="H422B9EC699DA44E598C823E4594797D3"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>To carry out this section, there are authorized to
			 be appropriated such sums as may be necessary for each of fiscal years 2007
			 through 2011.</text>
			</subsection></section><section id="HB5888EFB59344CEAAFFE6EEF22D735BF"><enum>4.</enum><header>Wellness program
			 credit</header>
			<subsection id="H39E12FFCB6B448D8BADF67F4276E3023"><enum>(a)</enum><header>In
			 general</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to business related credits) is amended
			 by inserting after section 45M the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HDA371389C74442D5A02903203FB403E3" style="OLC">
					<section id="H2D18233D5BEC4D828222BCCDB276A1D3"><enum>45N.</enum><header>Wellness
				program credit</header>
						<subsection id="HADABA668EEDB4836A4EF42C45CAD353"><enum>(a)</enum><header>General
				rule</header><text>For purposes of section 38, the wellness program credit
				determined under this section for any taxable year is an amount equal to $200
				per qualified employee employed by the eligible employer during the taxable
				year.</text>
						</subsection><subsection id="HBAE0C5DF0B7D4C91A73EBB96A42F74D"><enum>(b)</enum><header>Dollar
				limitation</header><text>The amount of the credit determined under this section
				for any taxable year shall not exceed 25 percent of the eligible employer’s
				regular tax liability (as defined in section 26(b)).</text>
						</subsection><subsection id="HA71D30A496A44DE0809C5DAFCA41009F"><enum>(c)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="H33F321A134914203B3D260B8BB774DF0"><enum>(1)</enum><header>Eligible
				employer</header><text>With respect to a taxable year, the term <term>eligible
				employer</term> means an employer who—</text>
								<subparagraph id="H2A023F5D64924CA790A3D926FBDBE6AB"><enum>(A)</enum><text>develops and
				implements a qualified wellness program, and</text>
								</subparagraph><subparagraph id="H26F3BCE562544884ACBBAE8E404C98AE"><enum>(B)</enum><text>keeps accurate
				records of the preventive health screenings and other programs in which the
				eligible employer’s employees have participated during the taxable year.</text>
								</subparagraph></paragraph><paragraph id="HD1BA6E0A56C0469F855609433EC00031"><enum>(2)</enum><header>Qualified
				wellness program</header><text>With respect to an eligible employer, the term
				<term>qualified wellness program</term> means a program—</text>
								<subparagraph id="H55A2D741D7734BF48E05B7B512509587"><enum>(A)</enum><text>that is developed
				and implemented by the eligible employer, in consultation with a physician (as
				defined in section 213(d)) who is board certified in preventive
				medicine,</text>
								</subparagraph><subparagraph id="H462791D497D64BE4000670EB38140321"><enum>(B)</enum><text>that provides at
				least 2 preventive health screenings for the benefit of the eligible employer’s
				employees,</text>
								</subparagraph><subparagraph id="H8FA5E082483843F5AF9539A1DF132C03"><enum>(C)</enum><text>that provides
				counseling, seminars, self-help materials, and other resources related to at
				least 3 of the following:</text>
									<clause id="H4816715609E044438B377D148BB9D20"><enum>(i)</enum><text>smoking,</text>
									</clause><clause id="HD72AD5561C7E4D5AA07477DEC02F8DA"><enum>(ii)</enum><text>obesity,</text>
									</clause><clause id="H8929A74050E44B5D8BAF2DA033C0978F"><enum>(iii)</enum><text>stress
				management,</text>
									</clause><clause id="H65D7E871104F429C942E09248E6592C1"><enum>(iv)</enum><text>physical
				fitness,</text>
									</clause><clause id="H5A9D7459B6D34EDA86E96F8A99D0263"><enum>(v)</enum><text>nutrition,</text>
									</clause><clause id="H14B3B55361974EF0AFE32DC857DE971E"><enum>(vi)</enum><text>substance
				abuse,</text>
									</clause><clause id="H2C208F34ABF64A7288D7FE00CFC39D00"><enum>(vii)</enum><text>depression,</text>
									</clause><clause id="H366BFE054C9E41288F7376DF8DF18254"><enum>(viii)</enum><text>mental
				health,</text>
									</clause><clause id="H7D0D525FF7C34E27A4F1E7D85635B8D1"><enum>(ix)</enum><text>heart disease,
				and</text>
									</clause><clause id="HB9C0A979827847CB9D09F68E2022C6D"><enum>(x)</enum><text>maternal and infant
				health, and</text>
									</clause></subparagraph><subparagraph id="H1C88F68609704916BAF4E1483F8D4B59"><enum>(D)</enum><text>whose qualified
				participants include not less than 50 percent of the eligible employer’s
				full-time employees.</text>
								</subparagraph></paragraph><paragraph id="H96A268C243E34CAF0090D1827CC29974"><enum>(3)</enum><header>Qualified
				employee</header><text>With respect to an eligible employer, the term
				<term>qualified employee</term> means an individual who is—</text>
								<subparagraph id="HD3F31EB539614EA997149CCE60B9D3F0"><enum>(A)</enum><text>a full-time
				employee of the eligible employer, and</text>
								</subparagraph><subparagraph id="HB908C449559543C6A2B87477BC89CD76"><enum>(B)</enum><text>a qualified
				participant in the eligible employer’s qualified wellness program.</text>
								</subparagraph></paragraph><paragraph id="HA6E624840AF04C3B9B6707DAF006B81"><enum>(4)</enum><header>Qualified
				participant</header><text>With respect to a taxable year, the term
				<term>qualified participant</term> means an individual who participates in at
				least 2 of the preventive health screenings or other programs offered through a
				qualified wellness program during the taxable year, as determined by the
				eligible employer who has developed and implemented such qualified wellness
				program.</text>
							</paragraph></subsection><subsection id="H93122167AEAB41D8866E009133A6CA03"><enum>(d)</enum><header>Termination</header><text>This
				section shall not apply in taxable years beginning after December 31,
				2011.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFE7DF5618AAE4DFAB862A7ABDB38CC34"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H747F1F43FC894DBDAB2CBE983D482525"><enum>(1)</enum><text display-inline="yes-display-inline">Section 38(b) of such Code is amended by
			 striking <quote>and</quote> at the end of paragraph (29), by striking the
			 period at the end of paragraph (30) and inserting <quote>, and</quote>, and by
			 adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H0E7FBF7B10F245CB87A37FA560B7A9C1" style="OLC">
						<paragraph id="H964E92167D9741418704F0B40D245A6"><enum>(31)</enum><text>the wellness
				program credit determined under section
				45N(a).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0D201F6531704504A9B6FEE9DB3E0099"><enum>(2)</enum><text display-inline="yes-display-inline">The table of sections for subpart D of part
			 IV of subchapter A of chapter 1 of such Code is amended by inserting after the
			 item relating to section 45M the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="HB6CFEDE84D51474A9FDEA3B4AFAEC1F4" style="OLC">
						<toc regeneration="no-regeneration">
							<toc-entry level="section">Sec. 45N. Wellness program
				credit.</toc-entry>
						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC0375BE5630840DD906F4B28A4BBFEC8"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2006.</text>
			</subsection></section><section id="H7D95EAC2A1924F40A398FCACF2F3D1E7"><enum>5.</enum><header>National
			 education campaign</header>
			<subsection id="HC831635E08B248638090F673EC2FE1E4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services, acting through the Director of the Agency for
			 Healthcare Research and Quality, shall carry out a national education campaign
			 to encourage the use of preventive health screenings by individuals, employers,
			 physicians, hospitals, State and local health departments, community health
			 centers, industrial sites, occupational health centers, academic centers,
			 private practices, the military, and Federal departments and agencies.</text>
			</subsection><subsection id="HE1D57C8DC60E41B2B98FF22F42DC1021"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>To carry out this section, there are authorized to
			 be appropriated such sums as may be necessary for each of fiscal years 2007
			 through 2011.</text>
