		<section changed="added" display-inline="no-display-inline" id="H88790F6468614E9EB5550063E9E20391" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Child
			 and Family Services Improvement Act of 2006</quote>.</text>
		</section><section changed="added" id="H5AEFD324FE1B468F99D2C049956047A6" reported-display-style="italic"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
			<paragraph id="HBEBC784EE3964805B3EBFF97E2106699"><enum>(1)</enum><text display-inline="yes-display-inline">For Federal fiscal year 2004, child
			 protective services (CPS) staff nationwide reported investigating or assessing
			 an estimated 3,000,000 allegations of child maltreatment, and determined that
			 872,000 children had been abused or neglected by their parents or other
			 caregivers.</text>
			</paragraph><paragraph id="H19A43EF00BE64CCAB21142FA05386360"><enum>(2)</enum><text display-inline="yes-display-inline">Combined, the Child Welfare Services (CWS)
			 and Promoting Safe and Stable Families (PSSF) programs provide States about
			 $700,000,000 per year for services intended to ensure the safety, permanency,
			 and well-being of children. These programs are considered the largest source of
			 targeted Federal funding in the child protection system for prevention—that is,
			 for services to ensure that children are not abused or neglected and, whenever
			 possible, help children remain safely with their families.</text>
			</paragraph><paragraph id="HF99C0682BD334E03BDC949596775D9C6"><enum>(3)</enum><text display-inline="yes-display-inline">States have broad flexibility in directing
			 CWS dollars to protect children from abuse and neglect. Under the PSSF program,
			 States must invest significant portions of program funds in family preservation
			 services, family support services, time-limited reunification services, and
			 post-adoption support services.</text>
			</paragraph><paragraph id="HB8074FD901564B75924479E26C4FA63"><enum>(4)</enum><text display-inline="yes-display-inline">However, a 2003 report by the Government
			 Accountability Office (GAO) reported that little research is available on the
			 effectiveness of activities supported by CWS funds—evaluations of services
			 supported by PSSF funds have generally shown little or no effect.</text>
			</paragraph><paragraph id="HE00F5424A1D84B46BFF1E5D8C85C6BA"><enum>(5)</enum><text display-inline="yes-display-inline">Further, the Department of Health and Human
			 Services recently completed initial Child and Family Service Reviews (CFSRs) in
			 each State. No State was in full compliance with all measures of the CFSRs. The
			 CFSRs also revealed that States need to work to prevent repeat abuse and
			 neglect of children, improve services provided to families to reduce the risk
			 of future harm (including by better monitoring the participation of families in
			 services), and strengthen upfront services provided to families to prevent
			 unnecessary family break-up and protect children who remain at home.</text>
			</paragraph><paragraph id="H930B0C537C794D5993BB229D5D210934"><enum>(6)</enum><text display-inline="yes-display-inline">Federal policy should ensure that States
			 are appropriately targeting CWS and PSSF funds to assist at-risk families and
			 protect abused and neglected children to address issues found in the CFSRs.
			 Encouraging States to invest their CWS and PSSF funds in services that promote
			 and protect the welfare of children, support strong, healthy families, and
			 reduce the reliance on out-of-home care, will help ensure all children are
			 raised in safe, loving families.</text>
			</paragraph><paragraph id="H95DF7A674FDE4971907507DB18857C5D"><enum>(7)</enum><text display-inline="yes-display-inline">CFSRs also found a strong correlation
			 between frequent caseworker visits with children and positive outcomes for
			 these children, such as timely achievement of permanency and other indicators
			 of child well-being.</text>
			</paragraph><paragraph id="H9917796C2379487B8D75188BC91CD260"><enum>(8)</enum><text display-inline="yes-display-inline">However, a December 2005 report by the
			 Department of Health and Human Services Office of Inspector General found that
			 only 20 States were able to produce reports to show whether caseworkers
			 actually visited children in foster care on at least a monthly basis, despite
			 the fact that nearly all States had written standards suggesting monthly visits
			 were State policy. In fact, 7 of these 20 States indicated that fewer than half
			 of the children in foster care were visited on a monthly basis.</text>
			</paragraph><paragraph id="H0EA9500CD0CB4F68BDDDF3707D4262B8"><enum>(9)</enum><text display-inline="yes-display-inline">The Deficit Reduction Act of 2005 provided
			 $40,000,000 in fiscal year 2006 for the PSSF program which this Act ensures
			 will be available and which the Congressional Budget Office estimates will
			 increase mandatory budget authority by $40,000,000 each year from 2006 through
			 2015, for a total of $400,000,000.</text>
			</paragraph><paragraph id="H6DA1D85BFCFA481F841BB0A0B296ED20"><enum>(10)</enum><text display-inline="yes-display-inline">A 2003 GAO report found that the average
			 tenure for a child welfare caseworker is less than 2 years and this level of
			 turnover negatively affects safety and permanency for children.</text>
			</paragraph><paragraph id="HE008C99658D843A797174603D02DBBE"><enum>(11)</enum><text display-inline="yes-display-inline">Targeting additional PSSF funds to ensure
			 children in foster care are visited on at least a monthly basis will promote
			 better outcomes for vulnerable children, including by preventing further abuse
			 and neglect.</text>
			</paragraph></section><section changed="added" display-inline="no-display-inline" id="H534E858162834678B2E7C976ADE50061" reported-display-style="italic"><enum>3.</enum><header>Reauthorization of the
			 safe and stable families program</header>
			<subsection id="H9825A989A2984ACF928C45F76F76AA1"><enum>(a)</enum><header>Elimination of
			 findings</header><text>Section 430 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629">42 U.S.C. 629</external-xref>)
			 is amended by striking all through <quote>(b)
			 <header-in-text level="subsection" style="OLC">Purpose.—</header-in-text>The
			 purpose</quote> and inserting the following:</text>

			</subsection><subsection changed="added" id="H8D65092E8B4C4646AF907DFF9D54E86F" reported-display-style="italic"><enum>(b)</enum><header>Limitation on
			 administrative cost reimbursement</header><text>Section 434 of such Act (42
			 U.S.C. 629d) is amended—</text>
				<paragraph display-inline="no-display-inline" id="H3FC0760E87774D9B9C723E01346FCB2F"><enum>(1)</enum><text>in subsection (a), by
			 inserting <quote>, subject to subsection (d),</quote> after
			 <quote>shall</quote>; and</text>
				</paragraph><paragraph id="H7F8D9FEA6EE1477DA07654A7D196316C"><enum>(2)</enum><text>by adding at the end the
			 following:</text>

				during a fiscal year, to the extent that the total amount of the expenditures
				exceeds 10 percent of the total expenditures of the State during the fiscal
				year under the State plan approved under section
				432.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection changed="added" id="H6486DAE46E6241FC8707521301A28B21" reported-display-style="italic"><enum>(c)</enum><header>Funding of mandatory
			 grants at $345 million per fiscal year</header><text>Section 436(a) of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/629f">42 U.S.C. 629f(a)</external-xref>) is amended by striking <quote>for fiscal year 2006.</quote>
			 and all that follows and inserting <quote>for each of fiscal years 2007 through
			 2011.</quote>.</text>
			</subsection><subsection changed="added" id="HD94ECFB70CD449B49FB08571D044F00" reported-display-style="italic"><enum>(d)</enum><header>Funding of
			 discretionary grants</header><text>Section 437(a) of such Act (42 U.S.C.

			 correction</header><text>Section 431(a)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629a">42 U.S.C. 629a(a)(6)</external-xref>)
			 is amended by striking <quote>1986</quote> and inserting
			 <quote>1996</quote>.</text>
			</subsection></section><section changed="added" id="HA69AA762A2A84784A16266BEF59DC81" reported-display-style="italic"><enum>4.</enum><header>Targeting of increased
			 safe and stable families program resources to support monthly caseworker
			 visits</header>
			<subsection changed="added" id="H6E733BECB6FC47FE9EEA000960048516" reported-display-style="italic"><enum>(a)</enum><header>Reservation and use of
			 funds</header>
				<paragraph id="H56A34FEA6AD841CD90FF18FC2EE7496C"><enum>(1)</enum><header>In
			 general</header><text>Section 436(b) of the Social Security Act (42 U.S.C.
			 629f(b)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3DEBCD35AD4243D48B51A707003380E4" style="OLC">
						<paragraph id="H0EF02493F4B8430D8DD7C6C6145021DD"><enum>(4)</enum><header>Support for
				monthly caseworker visits</header>
							<subparagraph id="HACAFA337552046D593048FADD589005D"><enum>(A)</enum><header>Reservation</header><text>In
				the case of each of fiscal years 2006 through 2011, the Secretary shall reserve
				$40,000,000 for allotment in accordance with section 433(e).</text>
							</subparagraph><subparagraph id="H6E7D2C2C15044F72BEAAEF952300DE1D"><enum>(B)</enum><header>Use of
				funds</header>
								<clause id="HCF3927FAEA6941FDAD293D159149CA00"><enum>(i)</enum><header>In
				general</header><text>A State to which an amount is paid from amounts reserved
				under subparagraph (A) shall use the amount to support monthly caseworker
				visits with children who are in foster care under the responsibility of the
				State, with a primary emphasis on activities designed to improve caseworker
				retention, recruitment, training, and ability to access the benefits of
				technology.</text>
								</clause><clause id="HED5C65D2E4D24D71A5235D98374800E0"><enum>(ii)</enum><header>Nonsupplantation</header><text display-inline="yes-display-inline">A State to which an amount is paid from
				amounts reserved pursuant to subparagraph (A) shall not use the amount to
				supplant any Federal funds paid to the State under part E that could be used as
				described in clause
				(i).</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph changed="added" id="HEC14A494869D44C7BA4392B4C422EF00" reported-display-style="italic"><enum>(2)</enum><header>Effect on amounts
			 reserved for Indian tribes</header><text>Section 436(b)(3) of such Act (42
			 U.S.C. 629b(b)(3)) is amended by striking <quote>The</quote> and inserting

				applicable to funds reserved To support monthly caseworker visits</header>
							<paragraph id="H1C2FF5A4450F4CE6B0D40004212F4767"><enum>(1)</enum><header>Allotments</header>
								<subparagraph id="HB5D04F834E6E4E81A6E2A8CE08E09E15"><enum>(A)</enum><header>Territories</header><text>From
				the amount reserved pursuant to section 436(b)(4)(A) for fiscal year 2006 or
				any succeeding fiscal year, the Secretary shall allot to each jurisdiction
				specified in subsection (b) of this section that meets the requirements of
				paragraph (2) of this subsection for the fiscal year an amount determined in
				the same manner as the allotment to each of such jurisdictions is determined
				under section 423 (without regard to the initial allotment of $70,000 to each
				State).</text>
								</subparagraph><subparagraph id="H55791A6D2AAF42E28CF4D24C8B8B22D6"><enum>(B)</enum><header>Other
				States</header><text>From the amount reserved pursuant to section 436(b)(4)(A)
				for fiscal year 2006 or any succeeding fiscal year that remains after applying
				subparagraph (A) of this paragraph for the fiscal year, the Secretary shall
				allot to each State (other than an Indian tribe) not specified in subsection
				(b) of this section that meets the requirements of paragraph (2) of this
				subsection for the fiscal year an amount equal to such remaining amount
				multiplied by the food stamp percentage of the State (as defined in subsection
				(c)(2) of this section) for the fiscal year, except that in applying subsection
				(c)(2)(A) of this section, <quote>subsection (e)(1)(B)</quote> shall be
				substituted for <quote>such paragraph (1)</quote>.</text>
								</subparagraph></paragraph><paragraph id="H05BE0268882343A3868001C4D8537E5"><enum>(2)</enum><header>Requirements</header><text>The
				requirements of this paragraph are the following:</text>
								<subparagraph id="H1CC1A9A8F6BD4256004238424EB22584"><enum>(A)</enum><header>Amounts allotted
				for fiscal year 2007</header><text display-inline="yes-display-inline">In the
				case of amounts reserved pursuant to section 436(b)(4)(A) for fiscal year 2007,
				the State has provided to the Secretary data which shows, for the most recent
				fiscal year for which such information is available—</text>
									<clause id="H1D92F2641FFB49BEB9CD184D1C53CFBA"><enum>(i)</enum><text>the percentage of
				children in foster care under the responsibility of the State who were visited
				by the caseworker handling the case of the child at least once each month while
				the child was in such care; and</text>
									</clause><clause id="HD14945DB0A3945B9B0B61EF951B7F690"><enum>(ii)</enum><text>the percentage of
				the visits that occurred in the residence of the child.</text>
									</clause></subparagraph><subparagraph id="H2527BFF8203C432799A22303A503065B"><enum>(B)</enum><header>Amounts allotted
				for succeeding fiscal years</header><text display-inline="yes-display-inline">In the case of amounts reserved pursuant to
				section 436(b)(4)(A) for fiscal year 2008 or any succeeding fiscal year:</text>
									<clause id="H65306C55657C42C3008EE59424BF5380"><enum>(i)</enum><header>Data showing
				frequency and location of caseworker visits</header><text>The State has
				provided to the Secretary data which shows, for the preceding fiscal year,
				that—</text>
										<subclause id="H2A70B1FDCFA8442191767D857BE369B7"><enum>(I)</enum><text display-inline="yes-display-inline">for at least 90 percent of the children in
				foster care under the responsibility of the State—</text>
											<item display-inline="no-display-inline" id="H94AB273B02C342209CCDD9763E978C67"><enum>(aa)</enum><text>the caseworker
				handling the case of the child visited the child at least once each month while
				the child was in such care; and</text>
											</item><item id="H1FEB1B01D6114DFAAC00C6457EF19D7B"><enum>(bb)</enum><text>the
				majority of the visits occurred in the residence of the child; or</text>
											</item></subclause><subclause id="HC977BD1B38B24F05AEF89648FB5875C9"><enum>(II)</enum><text>the State made
				the requisite annual progress, as determined by the Secretary, to comply with
				subclause (I) by October 1, 2011.</text>
										</subclause></clause><clause id="H7DD15F9984B14D3FBA82B6B647997404"><enum>(ii)</enum><header>State ability
				to verify frequency of caseworker visits</header><text display-inline="yes-display-inline">The Secretary has verified that the State
				has in effect such policies and standards as may be necessary to enable the
				State to determine whether, for at least 90 percent of the children in foster
				care under the responsibility of the State, a caseworker visited the child at
				least once each month during the fiscal year.</text>
									</clause><clause id="H04BE41D23D864317BD55B07C09C3CAEA"><enum>(iii)</enum><header>Verification
				of nonsupplantation compliance</header><text display-inline="yes-display-inline">The State has provided to the Secretary
				such documentation as may be necessary to verify that the State has complied
				with section 436(b)(4)(B)(ii) during the fiscal
				year.</text>

			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/620">42 U.S.C. 620–628b</external-xref>) is amended by striking sections 420
			 and 425 and inserting after section 424 the following:</text>

				services which allow children, where appropriate, to remain safely with their
				families or return to their families in a timely manner;</text>

				well-being of children in foster care; and</text>

				development and support to ensure a well-qualified child welfare
				workforce.</text>

				Secretary will not be required for carrying out the State plan developed as
				provided in section 422 shall be available for reallotment from time to time,
				on such dates as the Secretary may fix, to other States which the Secretary
				determines—</text>
								<subparagraph id="HD2B1ED24F34C475991DE77A2A11218D5"><enum>(A)</enum><text display-inline="yes-display-inline">need sums in excess of the amounts allotted
				to such other States under the preceding provisions of this section, in
				carrying out their State plans so developed; and</text>
								</subparagraph><subparagraph id="H38CEF8EA851C46EC8E002BEE005049BA"><enum>(B)</enum><text>will be able to so
				use such excess sums during the fiscal year.</text>
								</subparagraph></paragraph><paragraph id="HD46AB790D3DF4645AEC7ABA314E58059"><enum>(2)</enum><header>Considerations</header><text>The
				Secretary shall make the reallotments on the basis of the State plans so
				developed, after taking into consideration—</text>
								<subparagraph id="H257BAC5B252347B3AAFEE54E6EF8723D"><enum>(A)</enum><text>the population
				under 21 years of age;</text>
								</subparagraph><subparagraph id="HEA1A2D0366014FF9AFA717610281D170"><enum>(B)</enum><text>the per capita
				income of each of such other States as compared with the population under 21
				years of age; and</text>
								</subparagraph><subparagraph id="H5C79896837D24C4A8400F99FAB3DE821"><enum>(C)</enum><text>the per capita
				income of all such other States with respect to which such a determination by
				the Secretary has been made.</text>
								</subparagraph></paragraph><paragraph id="H741347ED0D1B4A03AB7FA4CDAE25E63"><enum>(3)</enum><header>Amounts
				reallotted to a State amounts deemed part of State allotment</header><text>Any
				amount so reallotted to a State is deemed part of the allotment of the State
				under this
				section.</text>

			 additional promoting safe and stable families resources for fiscal year
			 2006</header>
			<subsection id="HBFB34D1E836B49FB9FA600970034D74"><enum>(a)</enum><header>Appropriation</header><text display-inline="yes-display-inline">Out of any money in the Treasury of the
			 United States not otherwise appropriated, there are appropriated to the
			 Secretary of Health and Human Services $40,000,000 for fiscal year 2006 to
			 carry out subpart 2 of part B of title IV of the Social Security Act, in
			 addition to any amount otherwise made available for fiscal year 2006 to carry
			 out such subpart.</text>
			</subsection><subsection id="H22754F9C9F55466CA5125B77832793A2"><enum>(b)</enum><header>Availability of
			 funds</header><text>Notwithstanding section 434(b)(2) of such Act, the amounts
			 paid to States from the amount appropriated under subsection (a) of this
			 section shall remain available for expenditure by the States through fiscal
			 year 2008.</text>
			</subsection></section><section changed="added" id="HCDDDCCB868964BABB02237AB76AB6775" reported-display-style="italic"><enum>9.</enum><header>Reports</header><text display-inline="no-display-inline">Section 435 of the Social Security Act (42
			 U.S.C. 629e) is amended by adding at the end the following:</text>

				<subsection id="H970E88CF016246EB9FA75EE375E0387C"><enum>(e)</enum><header>Reports</header>
					<paragraph id="H6690C1F46A0D4DC1A423D2C183277865"><enum>(1)</enum><header>Content</header><text>The
				Secretary shall submit to the Committee on Ways and Means of the House of
				Representatives and the Committee on Finance of the Senate biennial reports
				on—</text>
						<subparagraph id="HC3263BBE0431492F974B9CD900C49F2"><enum>(A)</enum><text display-inline="yes-display-inline">the level of expenditures, and the programs
				and activities funded, under subpart 1 and this subpart by each State,
				territory, and Indian tribe to which funds are paid under this part;</text>
						</subparagraph><subparagraph id="H4577717C07AC402C95774E03BEF435B3"><enum>(B)</enum><text display-inline="yes-display-inline">the number of children and families served
				by each such State, territory, and Indian tribe under the programs; and</text>
						</subparagraph><subparagraph id="H5D559382B53D49299C207C89E62070D9"><enum>(C)</enum><text display-inline="yes-display-inline">how spending under the programs has helped
				achieve the goals identified by each such State, territory, and Indian tribe as
				part of the annual planning process undertaken in developing plans pursuant to
				this part.</text>
						</subparagraph></paragraph><paragraph id="H734EB65CADEF4DA9BCE67C94B6FA4FB"><enum>(2)</enum><header>Timing</header><text>The
				Secretary shall submit the biennial reports required by paragraph (1) not later
				than July 1, 2008, and not later than July 1 of every other calendar year
				thereafter.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" id="HEBBEBEAE9B6C49E3824EE5783F204C17" reported-display-style="italic"><enum>10.</enum><header>Effective
			 dates</header>
			<subsection id="H3229A06867384859AF40EA01C6DCA38"><enum>(a)</enum><header>In
			 general</header><text>Except as otherwise provided in this section, the
			 amendments made by this Act shall take effect on October 1, 2006, and shall
			 apply to payments under part B of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> for calendar quarters
			 beginning on or after such date, without regard to whether regulations to
			 implement the amendments are promulgated by such date.</text>
			</subsection><subsection id="HFF871E64F15B4E1C8660A11B32C9BC12"><enum>(b)</enum><header>Delay permitted if
			 State legislation required</header><text>If the Secretary of Health and Human
			 Services determines that State legislation (other than legislation
			 appropriating funds) is required in order for a State plan developed pursuant
			 to subpart 1 of part B, or a State plan approved under subpart 2 of part B, of
			 title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> to
			 meet the additional requirements imposed by the amendments made by this Act,
			 the plan shall not be regarded as failing to meet any of the additional
			 requirements before the 1st day of the 1st calendar quarter beginning after the
			 first regular session of the State legislature that begins after the date of
			 the enactment of this Act. If the State has a 2-year legislative session, each
			 year of the session is deemed to be a separate regular session of the State
			 legislature.</text>
			</subsection><subsection id="HE5C1D166D7474EB5B5F1BCF2E944793F"><enum>(c)</enum><header>Availability of
			 additional promoting safe and stable families resources for fiscal year
			 2006</header><text>Section 8 shall take effect on the date of the enactment of
			 this Act.</text>
