			 Efficiency Consumer Information</header>
			<subsection changed="deleted" id="HDA59D69E776C426CAF5FEE2681B8CA05" reported-display-style="strikethrough"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">Chapter 301</external-xref> of title 49, United States Code, is amended
			 by inserting after section 30123 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HD5289C5A5E034F93B000EDCBCB5FB7F9" style="USC">
					<section id="HB455948C29E9462CB26D2448AC5FF6FD"><enum>30123A.</enum><header>Tire Fuel
				Efficiency Consumer Information</header>
						<subsection id="H183C308926324536A335D75EBBBAA5E"><enum>(a)</enum><header>Rulemaking</header><paragraph commented="no" display-inline="yes-display-inline" id="H5A200AA8E36A4826B8DB4E80EF607106"><enum>(1)</enum><text>Not later than 18 months
				after the date of enactment of this section, the Secretary of Transportation
				shall, after notice and opportunity for comment, promulgate rules establishing
				a national tire fuel efficiency consumer information program for tires designed
				for use on motor vehicles to educate consumers about the effect of tires on
				automobile fuel efficiency.</text>
							</paragraph><paragraph id="H38307D4776F942B3BBB305F00334D5B" indent="up1"><enum>(2)</enum><header>Items included in
				rule</header><text>The rulemaking shall include each of the following:</text>
								<subparagraph id="H50F5AB1FF7924BECBF64EB52C5D30788"><enum>(A)</enum><text>A national tire fuel efficiency rating
				system for motor vehicle tires to assist consumers in making more educated tire
				purchasing decisions.</text>
								</subparagraph><subparagraph id="HCB25E6CDC1E045E7A2FE872BFC02576D"><enum>(B)</enum><text>Requirements for providing information
				to consumers, including information at the point of sale and other potential
				information dissemination methods, including the internet.</text>
								</subparagraph><subparagraph id="HD093CEB968054524B64B093057F3AFE6"><enum>(C)</enum><text>Specifications for test methods for
				manufacturers to use in assessing and rating tires to avoid variation among
				test equipment and manufacturers.</text>
								</subparagraph><subparagraph id="H1C8745232C88486296BF10BDFB6350FF"><enum>(D)</enum><text>A national tire maintenance consumer
				education program including, information on tire inflation pressure, alignment,
				rotation, and tread wear to maximize fuel efficiency.</text>
								</subparagraph></paragraph><paragraph id="H3676E86E1C604457A7BAA4F2781C7077" indent="up1"><enum>(3)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section shall not apply to tires
				excluded from coverage under <external-xref legal-doc="usc" parsable-cite="usc/49/575">section 575.104(c)(2)</external-xref> of title 49, Code of Federal
				Regulations, as in effect on date of enactment of this section.</text>
							</paragraph></subsection><subsection id="HA6B6006BA55045A5A811426C2E6FE2A3"><enum>(b)</enum><header>Consultation</header><text>The
				Secretary shall consult with the Secretary of Energy and the Administrator of
				the Environmental Protection Agency on the means of conveying tire fuel
				efficiency consumer information.</text>
						</subsection><subsection id="H434F0AFE93CB44448D252E8F87AFB014"><enum>(c)</enum><header>Report to
				congress</header><text>The Secretary shall conduct periodic assessments of the
				rules promulgated under this section to determine the utility of such rules to
				consumers, the level of cooperation by industry, and the contribution to
				national goals pertaining to energy consumption. The Secretary shall transmit
				periodic reports detailing the findings of such assessments to the Energy and
				Commerce Committee of the House of Representatives and the Commerce, Science,
				and Transportation Committee of the Senate.</text>
						</subsection><subsection id="H8E779C56925440DBA800BF12E5B02000"><enum>(d)</enum><header>Tire
				marking</header><text>The Secretary shall not require permanent labeling of any
				kind on a tire for the purpose of tire fuel efficiency information.</text>
						</subsection><subsection id="H8AECADE6441B4FF2A35D8FDBA05B23A1"><enum>(e)</enum><header>Preemption</header><text display-inline="yes-display-inline">When a requirement under this section is in
				effect, a State or political subdivision of a State may adopt or enforce a law
				or regulation on tire fuel efficiency consumer information only if the law or
				regulation is identical to that requirement. Nothing in this section shall be
				construed to preempt a State or political subdivision of a State from
				regulating the fuel efficiency of tires not otherwise preempted under this
				chapter.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="deleted" id="H1C48FE21A2784124A630B1ADC65EB44" reported-display-style="strikethrough"><enum>(b)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 30165(a) of such chapter is amended
			 by adding at the end the following:</text>

					<paragraph id="HFE61E482691F4DD4942964C9975248AF"><enum>(3)</enum><header>Section
				30123A</header><text display-inline="yes-display-inline">Any person who fails
				to comply with the national tire fuel efficiency consumer information program
				under section 30123A is liable to the United States Government for a civil
				penalty of not more than $50,000 for each
				violation.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="deleted" id="HEB30C9B67D7547E6B5E8006D8E5B2000" reported-display-style="strikethrough"><enum>(c)</enum><header>Table of
			 contents</header><text display-inline="yes-display-inline">The table of
			 contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49 is amended by adding the following new
			 item after the item relating to section 30123:</text>

			<subsection changed="added" id="HC5F7D9F228D04D99B01BF1FCBCF0D540" reported-display-style="italic"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">Chapter 301</external-xref> of title 49, United States Code, is amended
			 by inserting after section 30123 the following new section:</text>

					<section id="H721D8060FF7A4C48A2C66836AB9F1977"><enum>30123A.</enum><header>Tire Fuel
				Efficiency Consumer Information</header>
						<subsection id="H4AD8DCF6B0EB4B60BA9EFE34E47D484F"><enum>(a)</enum><header>Rulemaking</header><paragraph commented="no" display-inline="yes-display-inline" id="H4EF513342BB24CC181F5E7B8D373DD24"><enum>(1)</enum><text>Not later than 18 months
				after the date of enactment of this section, the Secretary of Transportation
				shall, after notice and opportunity for comment, promulgate rules establishing
				a national tire fuel efficiency consumer information program for tires designed
				for use on motor vehicles to educate consumers about the effect of tires on
				automobile fuel efficiency.</text>
							</paragraph><paragraph id="H50F39CFDA90C4BF89712C1AB3700AB7E" indent="up1"><enum>(2)</enum><text>The rulemaking shall include each of
				the following:</text>
								<subparagraph id="HD5788BD3A38D48F4AB5671749E797996"><enum>(A)</enum><text>A national tire fuel efficiency rating
				system for motor vehicle tires to assist consumers in making more educated tire
				purchasing decisions.</text>
								</subparagraph><subparagraph id="H278499E78DD542FF9483D736FA053DA0"><enum>(B)</enum><text>Requirements for providing information
				to consumers, including information at the point of sale and other potential
				information dissemination methods, including the internet.</text>
								</subparagraph><subparagraph id="H54E55670D587417A83B353733688D244"><enum>(C)</enum><text>Specifications for test methods for
				manufacturers to use in assessing and rating tires to avoid variation among
				test equipment and manufacturers.</text>
								</subparagraph><subparagraph id="HB9C3D2DDC6914D3300B9C21DBA66887F"><enum>(D)</enum><text>A national tire maintenance consumer
				education program including, information on tire inflation pressure, alignment,
				rotation, and tread wear to maximize fuel efficiency.</text>
								</subparagraph></paragraph><paragraph id="H8C2E0A3E446B4B89961B5B018E30F795" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">This section shall not apply to tires
				excluded from coverage under <external-xref legal-doc="usc" parsable-cite="usc/49/575">section 575.104(c)</external-xref> of title 49, Code of Federal
				Regulations, as in effect on date of enactment of this section.</text>
							</paragraph></subsection><subsection id="HDB7D34F8B5ED4C9D8BCB7FC4BCECC0E2"><enum>(b)</enum><header>Consultation</header><text>The
				Secretary shall consult with the Secretary of Energy and the Administrator of
				the Environmental Protection Agency on the means of conveying tire fuel
				efficiency consumer information.</text>
						</subsection><subsection id="H02ADC177DE78488EB63340AED31E2FF7"><enum>(c)</enum><header>Report to

						</subsection><subsection id="HC19C136A57E84005AB73512968484BE"><enum>(d)</enum><header>Tire
				marking</header><text>The Secretary shall not require permanent labeling of any
				kind on a tire for the purpose of tire fuel efficiency information.</text>
						</subsection><subsection id="HFF369309C8AB413EBE2F0060811501A3"><enum>(e)</enum><header>Preemption</header><text display-inline="yes-display-inline">Nothing in this section shall prohibit a
				State or political subdivision of a State from enforcing a law or regulation on
				tire fuel efficiency consumer information in effect on January 1, 2006. After a
				requirement under this section is in effect, a State or political subdivision
				of a State may adopt or enforce a law or regulation on tire fuel efficiency
				consumer information enacted after January 1, 2006, only if the law or
				regulation is identical to that requirement. Nothing in this section shall be
				construed to preempt a State or political subdivision of a State from
				regulating the fuel efficiency of tires not otherwise preempted under this
				chapter.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="H88C00F6E8AF0496600A353664BC7F5C8" reported-display-style="italic"><enum>(b)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 30165(a) of such chapter is amended
			 by adding at the end the following:</text>

					<paragraph id="HE1FAFD8300F445A296EE6CA7695018F7"><enum>(4)</enum><header>Section
