		  24-month waiting period for Medicare coverage of individuals disabled with
		  distant stage cancer.</official-title>

		<section display-inline="no-display-inline" id="H23017D68EBB34E83A5334B1923EC1BD6" section-type="section-one"><enum>1.</enum><header>Short title;
			 findings</header>
			<subsection id="H6C9E661DC07F42EDB08F76E33DC3C9E7"><enum>(a)</enum><header>Short
			 Title</header><text>This Act may be cited as the <quote>Dean Gallo Cancer
			 Patient Compassion Act of 2006</quote>.</text>
			</subsection><subsection id="H92FC9965157944699C45B29772006BF3"><enum>(b)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="H227BC56E3A434A5400034C797B09DF77"><enum>(1)</enum><text>It is estimated
			 that over 1,300,000 new cases of cancer are diagnosed each year.</text>
				</paragraph><paragraph id="HF598089D103041FEBA5DED3720135C16"><enum>(2)</enum><text>Roughly, 86,000 or
			 7 percent of all diagnosed cancer patients have no health insurance.</text>
				</paragraph><paragraph id="H3C20753BDB6B4E998E6DE6F87BA307D"><enum>(3)</enum><text>Lung and colorectal
			 cancers alone account for over a quarter of all new cases of cancer.</text>
				</paragraph><paragraph id="H170D0A7D494E45048BE3521171EC12C1"><enum>(4)</enum><text>The 5-year
			 survival rate for individuals with distant stage lung cancers is 3
			 percent.</text>
				</paragraph><paragraph id="HFABEF12D33004ECCAD11613EE154311D"><enum>(5)</enum><text>The 5-year
			 survival rate for individuals with distant stage colorectal cancer is 9
			 percent.</text>
				</paragraph><paragraph id="H5949ABADA9EB4F11BF684B9CA2021E31"><enum>(6)</enum><text>Individuals
			 suffering from cancer who receive Social Security Disability benefits must wait
			 24 months for Medicare eligibility.</text>
				</paragraph></subsection></section><section id="H6C2C12081F2845898DE4755900308500"><enum>2.</enum><header>Waiver of
			 24-month waiting period for Medicare coverage of individuals disabled with
			 cancer</header>
			<subsection id="H2678F6E171CA4ECE8CE9793BB5760404"><enum>(a)</enum><header>In
			 General</header><text>Section 226(h) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/426">42 U.S.C. 426(h)</external-xref>) is
			 amended—</text>
				<paragraph id="H2B1679D2496D4D56A770B112C9045DEB"><enum>(1)</enum><text>by redesignating
			 paragraphs (1), (2), and (3), as subparagraphs (A), (B), and (C),
			 respectively;</text>
				</paragraph><paragraph id="HF5EBC2C8901A4C14AC49F09B705F6DBA"><enum>(2)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(h)</quote>;</text>
				</paragraph><paragraph id="H03BA33EDE66A4A38B9D6614DF32498D"><enum>(3)</enum><text>in
			 the matter preceding subparagraph (A) of paragraph (1), as so redesignated, by
			 striking <quote>an individual medically determined to have amyotrophic lateral
			 sclerosis (ALS)</quote> and inserting <quote>an individual described in
			 paragraph (2)</quote>; and</text>
				</paragraph><paragraph id="H579123CDA7FC4F9CA195D17FB8637295"><enum>(4)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block id="HB6576A0FD1AE44068D4E90F4B334D610" style="OLC">
						<paragraph id="HBFE950D271554C809BF75F089E09C871"><enum>(2)</enum><text>For purposes of
				paragraph (1), an individual described in this paragraph is any of the
				following:</text>
							<subparagraph id="HDE9453044D6B40FB00F5BA31C3B049DF"><enum>(A)</enum><text>An individual
				medically determined to have amyotrophic lateral sclerosis (ALS).</text>
							</subparagraph><subparagraph id="H62C0047DA7AF4D3B8EE58853C685619D"><enum>(B)</enum><text>An individual
				medically determined to have stage III or IV cancer who is not enrolled, or who
				may not be enrolled, in a group health plan described in section
				1862(b)(1)(A)(v), or a large group health plan described in section
				1862(b)(1)(B)(iii), by reason of the individual’s current or former employment
				or by reason of the current or former employment status of a member of the
				individual’s
				family.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD4555BC33DB14BEEA6806EBDB1C0C6B"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to benefits
			 for months beginning after the date of the enactment of this Act.</text>
