<official-title>To require motor vehicle operators transporting security sensitive material in commerce to obtain a permit from the Secretary of Homeland Security, and for other purposes.</official-title>

<section id="H865DAE6403A348D3B9CBC16300E9BF95" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Screening Applied Fairly and Equitably to Truckers Act of 2006</short-title></quote> or the <quote><short-title>SAFE Truckers Act of 2006</short-title></quote>.</text></section> 
<title id="H1BBA4252A7D642238489D16EDE8D1036"><enum>I</enum><header>Surface transportation security</header> 
<section id="HF763E20455D049EE8634BCB1C3ED7D76"><enum>101.</enum><header>Surface transportation security</header> 
<subsection id="HFBE2584084A14222B292243DA5C490DA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended by adding at the end the following:</text>

<title id="HBD74584BDCCD4128AD6C48E61FBEB798"><enum>XVIII</enum><header>Surface transportation security</header> 
<section id="H0859CFC982644DF9B3D287178E0398CE"><enum>1801.</enum><header>Designation of security sensitive material</header> 
<subsection id="H0E711AA1AD074844AB6B690512017622"><enum>(a)</enum><header>Designation</header><text>The Secretary shall designate a material, or a group or class of material, in a particular amount and form as security sensitive when the Secretary determines that transporting the material by motor vehicle in commerce poses a significant risk to homeland security due to the potential use of the material in an act of terrorism.</text></subsection> 
<subsection id="H2313F104F62343B5A73CE2E64F3D3BAD"><enum>(b)</enum><header>Consultation</header><text>In carrying out subsection (a), the Secretary shall consult with—</text> 
<paragraph id="HB6BD6B057CB647CDA614BABBF4FC2FE"><enum>(1)</enum><text>the Secretary of Health and Human Services, on the inclusion of chemical or biological materials or agents; and</text></paragraph> 
<paragraph id="H58810BFFEBE84347BA23539EF932B4AC"><enum>(2)</enum><text>the Secretary of Transportation, as appropriate.</text></paragraph></subsection> 
<subsection id="HB3358A8F226349698631A57F78BB9312"><enum>(c)</enum><header>Notice and comment</header><text>The Secretary shall make the designations under subsection (a) by regulation after providing notice and an opportunity for public comment.</text></subsection></section> 
<section id="H9F1DDB92DDA44DF98C075C36B422D9FB"><enum>1802.</enum><header>Security sensitive material permit</header> 
<subsection id="H5A18B95ACE0A4D53B4B06D1318F393E5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning not later than one year after the date of enactment of this title, the Secretary shall prohibit an individual from operating a motor vehicle in commerce while transporting a security sensitive material unless the individual holds a security sensitive material permit issued by the Secretary.</text></subsection> 
<subsection id="H87349C5EDF3B495C00EC6CBDAA736F84"><enum>(b)</enum><header>Issuance of permits</header><text>The Secretary may issue a security sensitive material permit to an individual if—</text> 
<paragraph id="H8A776CE2045E437387BB4D496C601561"><enum>(1)</enum><text>the individual holds a license to operate a motor vehicle transporting hazardous material in commerce in accordance with the requirements of <external-xref legal-doc="usc" parsable-cite="usc/49/5103a">section 5103a</external-xref> of title 49, United States Code; and</text></paragraph> 
<paragraph id="H6AD58F678A0D4BF3894277512C518C06"><enum>(2)</enum><text>after conducting a background check under subsection (c), the Secretary determines that the individual does not pose a terrorist security risk warranting denial of the permit.</text></paragraph> </subsection> 
<subsection id="H90D516A21D4F4F6780A832F9A7B8762"><enum>(c)</enum><header>Background records check</header> 
<paragraph id="H1A00B0822D0F487E81003687DF5F2914"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Before issuing a security sensitive material permit to an individual, the Secretary, in consultation with the Attorney General, shall conduct a fingerprint-based background records check of relevant criminal history databases regarding the individual.</text></paragraph> 
<paragraph id="HB4E287B28B504F7286D4E004DF4E1D0"><enum>(2)</enum><header>Written consent</header><text>A background records check regarding an individual may be conducted under this subsection only with the prior written consent of the individual.</text></paragraph> 
<paragraph id="H7EABD3FF409F466CA910327521F4857F"><enum>(3)</enum><header>Notification</header> 
<subparagraph id="HCF675A6DC67F4AE084FCDBBD04FFF0CC"><enum>(A)</enum><header>In general</header><text>After conducting a background records check regarding an individual under this section, the Secretary shall—</text> 
<clause id="HA62313A2ED05444AA2AEF133DA5EA09B"><enum>(i)</enum><text>notify the individual of the completion and results of the background records check; and</text></clause> 
<clause id="H964806374AEC415A98C300F2D4C2B58"><enum>(ii)</enum><text display-inline="yes-display-inline">issue a security sensitive material permit to the individual or deny issuance of the permit.</text></clause></subparagraph> 
<subparagraph id="H5BF37F6FDA04470FACFDC3D1ECDF6F42"><enum>(B)</enum><header>Limitations on disclosure</header><text display-inline="yes-display-inline">Information gathered under this section shall not otherwise be disclosed.</text></subparagraph></paragraph></subsection> 
<subsection id="HA651ADF8AD094515BC87DFF3AA1F556"><enum>(d)</enum><header>Expiration of permits</header><text display-inline="yes-display-inline">A security sensitive material permit issued to an individual shall expire at the end of the 5-year period beginning on the date of issuance of the permit or at the end of a shorter period established by the Secretary by regulation. The Secretary may reissue a security sensitive material permit to an individual before the date of the permit’s expiration after conducting a new background records check regarding the individual under subsection (c).</text></subsection> 
<subsection id="HA9E569C32DC24C65822D824C1751F11D"><enum>(e)</enum><header>Waiver process</header><text>The Secretary shall prescribe regulations that establish a waiver process for issuing a security sensitive material permit to an individual found to be otherwise ineligible for such a permit under subsection (c). In deciding to issue a permit to such an individual, the Secretary shall give consideration to the circumstances of any disqualifying act or offense, restitution made by the individual, Federal and State mitigation remedies, and other factors from which it may be concluded that the individual does not pose a terrorism risk warranting denial of the permit.</text></subsection> 
<subsection id="H50C0DA00B2BA4684B1D4A5003535F9A1"><enum>(f)</enum><header>Denial of waiver review</header> 
<paragraph id="HF25196EBBDB7409681003C88A724405"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a review process before an administrative law judge for individuals denied a waiver under subsection (e).</text></paragraph> 
<paragraph id="H4358884532BF4FFAB0A17B7EB5D7FC34" commented="no"><enum>(2)</enum><header>Scope of review</header><text display-inline="yes-display-inline">In conducting a review under the process established pursuant to paragraph (1), the administrative law judge shall be governed by the standards of <external-xref legal-doc="usc" parsable-cite="usc/5/706">section 706</external-xref> of title 5, United States Code. The substantial evidence standard in section 706(2)(E) of such title shall apply whether or not there has been an agency hearing. The judge shall review all facts on the record of the agency.</text></paragraph> 
<paragraph id="HD56C80CEB9C14EEAB120B28DB1BA928C"><enum>(3)</enum><header>Classified evidence</header><text>The Secretary, in consultation with the National Intelligence Director, shall issue regulations to establish procedures by which the Secretary, as part of a review conducted under this subsection, may provide to the individual adversely affected by the determination an unclassified summary of classified evidence upon which the denial of a waiver by the Secretary was based.</text></paragraph> 
<paragraph id="HDC870CA0A3C748B9B6B4000000D17321"><enum>(4)</enum><header>Review of classified evidence by administrative law judge</header> 
<subparagraph id="H414E1EB346C74440AFAF72009427E6F"><enum>(A)</enum><header>Review</header><text>As part of a review conducted under this subsection, if the decision of the Secretary was based on classified information (as defined in section 1(a) of the Classified Information Procedures Act (18 U.S.C. App.)), such information may be submitted by the Secretary to the reviewing administrative law judge, pursuant to appropriate security procedures, and shall be reviewed by the administrative law judge ex parte and in camera.</text></subparagraph> 
<subparagraph id="H8C304EEC043E4A1390FF005686821619"><enum>(B)</enum><header>Security clearances</header><text>Pursuant to existing procedures and requirements, the Secretary, in coordination (as necessary) with the heads of other affected departments or agencies, shall ensure that administrative law judges reviewing negative waiver decisions of the Secretary under this subsection possess security clearances appropriate for such review.</text></subparagraph> 
<subparagraph id="H41B20E81CD16408081F1882966263882"><enum>(C)</enum><header>Unclassified summaries of classified evidence</header><text>As part of a review conducted under this subsection and upon the request of the individual adversely affected by the decision of the Secretary not to grant a waiver, the Secretary shall provide to the individual and reviewing administrative law judge, consistent with the procedures established under paragraph (1), an unclassified summary of any classified information upon which the decision of the Secretary was based.</text></subparagraph></paragraph> 
<paragraph id="HF6678600A64A42069CC71FAC1DCCC774"><enum>(5)</enum><header>New evidence</header><text>The Secretary shall establish a process under which an individual may submit a new request for a waiver, notwithstanding confirmation by the administrative law judge of the Secretary’s initial denial of the waiver, if the request is supported by substantial evidence that was not available to the Secretary at the time the initial waiver request was denied.</text></paragraph></subsection> 
<subsection id="HE757EC363F4440DB831DAFFEACF1B7E"><enum>(g)</enum><header>Appeals process</header><text>The Secretary shall establish an appeals process under this section for individuals found to be ineligible for a security sensitive permit that includes notice and an opportunity for a hearing.</text> </subsection></section> 
<section id="H4265C82E964F4B88B5D9C5EDF5EDB239" display-inline="no-display-inline" section-type="subsequent-section"><enum>1803.</enum><header>Transportation worker identification credential integration</header> 
<subsection id="H5E408F37E98043AFA553957DF8AEF08F"><enum>(a)</enum><header>Integration of security sensitive material permit</header><text display-inline="yes-display-inline">The Secretary shall modify the program established under <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section 70105</external-xref> of title 46, United States Code, to allow the Secretary to issue a security sensitive material permit to an individual as an integrated component of a transportation security card.</text></subsection> 
<subsection id="HC8D4AB82204342FE99D600E7EEE2F00"><enum>(b)</enum><header>Machine-readable element</header><text>A transportation security card referred to in subsection (a) shall indicate the security sensitive material permit through a machine-readable element in electronic storage on the card.</text> </subsection> 
<subsection id="HC7F073AA1D094F01B3D9B5BB45A3AB8F"><enum>(c)</enum><header>Fingerprint locations</header><text display-inline="yes-display-inline">The Secretary shall—</text> 
<paragraph id="HF2449CD825A74E9CB7804822216B5D47"><enum>(1)</enum><text>work with appropriate entities to ensure that fingerprinting locations for individuals applying for a transportation security card have flexible operating hours; and</text></paragraph> 
<paragraph id="HFEA9928FC6F84F5AA881EBA11F488C64"><enum>(2)</enum><text>permit an individual applying for a transportation security card to utilize a fingerprinting location outside of the individual’s State of residence to the greatest extent practicable.</text></paragraph></subsection></section> 
<section id="H6D127D45D4DC439EBF632E95DF7F19DC"><enum>1804.</enum><header>Consideration of other background checks</header> 
<subsection id="HFE4C4AD31A644989B9449847C8A2D2E1"><enum>(a)</enum><header>Individuals holding transportation security cards</header><text display-inline="yes-display-inline">An individual who holds a transportation security card issued under <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section 70105</external-xref> of title 46, United States Code, shall be treated as having met the requirements of section 1802(c).</text></subsection> 
<subsection id="H3D32926790C24094A01600B94C978740"><enum>(b)</enum><header>Reduction in fees</header><text>The Secretary shall reduce to the greatest extent practicable, any fees associated with obtaining a security sensitive material permit under section 1802 for any individual referred to in subsection (a).</text></subsection></section> 
<section id="H3EEA1C18EB5F40C286156C95375E41EB"><enum>1805.</enum><header>Limitation on shippers of security sensitive material</header><text display-inline="no-display-inline">The Secretary shall prohibit a person from—</text> 
<paragraph id="H455BDE9A3E09421B961CC0B36230E908"><enum>(1)</enum><text>offering a security sensitive material for transportation by motor vehicle in commerce; or</text></paragraph> 
<paragraph id="H938C4BE25DE0404FA2692F7734EECA62"><enum>(2)</enum><text display-inline="yes-display-inline">causing a security sensitive material to be transported by motor vehicle in commerce,</text></paragraph><continuation-text continuation-text-level="subsection">unless the motor vehicle operator transporting the security sensitive material holds a valid security sensitive material permit.</continuation-text></section> 
<section id="H09D0EC2B5C6542F5B59EF3EAD0418691"><enum>1806.</enum><header>Authority to ensure compliance</header> 
<subsection id="H95931CA7030E4F509633D07462A38B93"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary is authorized to ensure compliance with this title.</text></subsection> 
<subsection id="H1F6668F8ED4C4FAA9FCE00FF7E0498EF"><enum>(b)</enum><header>Memorandum of understanding</header><text>The Secretary may enter into a memorandum of understanding with the Secretary of Transportation to ensure compliance with sections 1802(a), 1805, and 1810.</text> </subsection></section> 
<section id="H59AE9B38BB7A4047AC9F373629735601"><enum>1807.</enum><header>Civil penalties</header> 
<subsection id="H4AE17961B3E64EC7BF7900CBDBD8E6A7"> <enum>(a)</enum> <header>Penalty</header> 
<paragraph id="HF7B219C7F1E74D30BCD855AA67CB3500" display-inline="no-display-inline"> <enum>(1)</enum><header>In general</header> <text>A person that violates this title or a regulation or order issued under this title is liable to the United States Government for a civil penalty of at least $250 but not more than $75,000 for each violation.</text> </paragraph> 
<paragraph id="H77D27339C27C46E38898B7EC0059AC88"> <enum>(2)</enum><header>Increased penalties</header> <text>If the Secretary finds that a violation under paragraph (1) results in death, serious illness, or severe injury to any person or substantial destruction of property, the Secretary may increase the amount of the civil penalty for such violation to not more than $100,000.</text> </paragraph> 
<paragraph id="HB565319D68B84FDF887C9E01003B2F9D"> <enum>(3)</enum><header>Separate violations</header> <text>A separate violation occurs for each day the violation continues.</text> </paragraph> </subsection> 
<subsection id="H9B9A6F5895B0436F93FA58389442C25C"> <enum>(b)</enum> <header>Hearing Requirement</header> <text>The Secretary may find that a person has violated this title or a regulation or order issued under this title only after notice and an opportunity for a hearing. The Secretary shall impose a penalty under this section by giving the person written notice of the amount of the penalty.</text> </subsection> 
<subsection id="HF6F704911DB942AE98E8E8A483BDB35C"> <enum>(c)</enum> <header>Penalty Considerations</header> <text>In determining the amount of a civil penalty under this section, the Secretary shall consider—</text> 
<paragraph id="H5FE827FC284B4A9EA8F1F29FE6FCE5A4"> <enum>(1)</enum> <text>the nature, circumstances, extent, and gravity of the violation;</text> </paragraph> 
<paragraph id="H8E9D314C5EC240F8B54C79334B4632B"> <enum>(2)</enum> <text>with respect to the violator, the degree of culpability, any history of prior violations, the ability to pay, and any effect on the ability to continue to do business; and</text> </paragraph> 
<paragraph id="H7150B0F1C7DD4796B3B382B38308FE37"> <enum>(3)</enum> <text>other matters that justice requires.</text> </paragraph> </subsection> 
<subsection id="HF264F7461F5B481EBA2D10FF23B6A873"> <enum>(d)</enum> <header>Civil Actions To Collect</header> <text>The Attorney General may bring a civil action in an appropriate district court of the United States to collect a civil penalty under this section and any accrued interest on the civil penalty as calculated in accordance with section 1005 of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2705">33 U.S.C. 2705</external-xref>). In the civil action, the amount and appropriateness of the civil penalty shall not be subject to review.</text></subsection> 
<subsection id="H405870BD557945679C9FEF797C56D340"><enum>(e)</enum><header>Compromise</header><text display-inline="yes-display-inline">The Secretary may compromise the amount of a civil penalty imposed under this section before referral to the Attorney General.</text> </subsection> 
<subsection id="H5771903AE109470A9BCF272F4456EA00"> <enum>(f)</enum> <header>Setoff</header> <text>The Government may deduct the amount of a civil penalty imposed or compromised under this section from amounts it owes the person liable for the penalty.</text> </subsection> 
<subsection id="H17B9602B4E484A13980006902BB00080"> <enum>(g)</enum> <header>Depositing Amounts Collected</header> <text>Amounts collected under this section shall be deposited in the Treasury as miscellaneous receipts.</text> </subsection></section> 
<section id="HC0D0BC64A37A486783B900F3340041C9"><enum>1808.</enum><header>Criminal penalties</header> <text display-inline="no-display-inline">A person that knowingly violates this title or a regulation or order issued under this title shall be fined under title 18, United States Code, imprisoned for not more than 5 years, or both; except that the maximum amount of imprisonment shall be 10 years in any case in which the violation results in death or bodily injury to any person.</text> </section> 
<section id="H1C8A1D63FD494B3FB4A2FA24B85FA28E"><enum>1809.</enum><header>Enforcement</header> 
<subsection id="H33C6DDE7485A311348C22CBB729E2CE" display-inline="no-display-inline" commented="no"> <enum>(a)</enum> <header>In general</header> <text>At the request of the Secretary, the Attorney General may bring a civil action in an appropriate district court of the United States to enforce this title or a regulation or order issued under this title. The court may award appropriate relief, including a temporary or permanent injunction, punitive damages, and assessment of civil penalties considering the same penalty amounts and factors as prescribed for the Secretary in an administrative case under section 1807.</text> </subsection> 
<subsection id="H58ABA5044870FAA3356BFEB4F6CE81B" display-inline="no-display-inline"> <enum>(b)</enum> <header>Imminent security hazards</header> 
<paragraph id="H0CC5291043887410DEFD739F357454C" display-inline="no-display-inline"> <enum>(1)</enum><header>In general</header> <text>If the Secretary has reason to believe that an imminent security hazard exists, the Secretary may bring a civil action in an appropriate district court of the United States—</text> 
<subparagraph id="H75F35FCE405DB8F644516BB0C090C9A"> <enum>(A)</enum> <text>to suspend or restrict the transportation of the security sensitive material responsible for the hazard; or</text> </subparagraph> 
<subparagraph id="H2D431ECF4F2060AC646DD79E7C2887B"> <enum>(B)</enum> <text>to eliminate or mitigate the hazard.</text> </subparagraph> </paragraph> 
<paragraph id="H612C0E8547D7CF38BB3DCA8E297BB1A"> <enum>(2)</enum><header>Actions by the Attorney General</header> <text>On request of the Secretary, the Attorney General shall bring an action under paragraph (1).</text> </paragraph> </subsection> </section> 
<section id="H73C9F884034F48ED9EB17F61D6A27CC9"><enum>1810.</enum><header>Motor vehicle operators registered to operate in Mexico or Canada</header> <text display-inline="no-display-inline">The Secretary shall prohibit a motor vehicle operator registered to operate in Mexico or Canada from operating a motor vehicle transporting a security sensitive material in commerce in the United States until the operator has undergone a background records check similar to the background records check required for motor vehicle operators licensed in the United States to transport security sensitive materials in commerce.</text></section> 
<section id="H18B78536447847C8A2B3F777B5A3EFEE"><enum>1811.</enum><header>Fee authority</header> 
<subsection id="H7EC7ACA3BAF0440E9505AF6084636F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may charge reasonable fees for providing security sensitive material permits and conducting background records checks under this title.</text></subsection> 
<subsection id="H88E26F1655A04CA6B856E21F19F1D11D"><enum>(b)</enum><header>Fee requirements</header><text>The establishment and collection of fees under this section shall be subject to the following requirements: </text> 
<paragraph id="H7216DEE80CB7417BB552429523641882"><enum>(1)</enum><text display-inline="yes-display-inline">The fees, in the aggregate, shall not exceed the costs incurred by the Department of Homeland Security associated with the program established under this title.</text></paragraph> 
<paragraph id="H5249080B521C42C5A94738D58E061E6B"><enum>(2)</enum><text>The Secretary shall charge fees in amounts that are reasonably related to the costs of providing services in connection with the activity or item for which the fee is charged. </text></paragraph> 
<paragraph id="H81D206B96E95424C9217356BB81DE9C9"><enum>(3)</enum><text>A fee may not be collected except to the extent such fee will be expended—</text> 
<subparagraph id="HA9188E4A88C74FFDBDCA16EF31B2F55B"><enum>(A)</enum><text display-inline="yes-display-inline">to pay for the costs of providing security sensitive material permits and conducting background records checks under this title;</text></subparagraph> 
<subparagraph id="HB652E09B85654FD79868E329CB35E4A7"><enum>(B)</enum><text display-inline="yes-display-inline">to pay for the costs of reviewing and adjudicating requests for waivers and appeals of agency decisions with respect to providing security sensitive material permits, performing background record checks, and denying requests for waivers and appeals under this title; and</text></subparagraph> 
<subparagraph id="HAE296C7136324739A1D3BD10D0E5C27"><enum>(C)</enum><text>to pay for any other costs related to providing security sensitive material permits or performing background record checks under this title.</text></subparagraph></paragraph> 
<paragraph id="HAF3DEC4EE08F43E0A7ED008F2F4F5D55"><enum>(4)</enum><text>Any fee collected shall be available for expenditure only to pay the costs incurred in providing services in connection with the activity or item for which the fee is charged and shall remain available until expended.</text></paragraph></subsection></section> 
<section id="H206EA7F5FEAF44779BDAF0836034FCFF"><enum>1812.</enum><header>Transition</header> 
<subsection id="H6888629212BB4A8CB19ED2A04B0924A8"><enum>(a)</enum><header>Treatment of individuals receiving prior hazardous materials endorsements</header><text>An individual who has obtained a hazardous materials endorsement in accordance with <external-xref legal-doc="regulation" parsable-cite="cfr/49/1572">section 1572</external-xref> of title 49, Code of Federal Regulations, before the date of enactment of this title shall be treated as having met the requirements of section 1802(c).</text></subsection> 
<subsection id="H77B20A34D0A94C45A8A0633043C26FD2"><enum>(b)</enum><header>Reduction in fees</header><text>The Secretary shall reduce, to the great extent practicable, any fees associated with obtaining a security sensitive material permit under this title for any individual referred to in subsection (a). </text></subsection></section> 
<section id="HFC7A6FE0A62E44A7A5291BA4EF503D7B"><enum>1813.</enum><header>Savings clause</header><text display-inline="no-display-inline">Nothing in the title shall be construed as affecting the authority of the Secretary of Transportation to regulate hazardous materials under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/51">chapter 51</external-xref> of title 49, United States Code.</text></section> 
<section id="H02C954BFF7AB4A38A4F05D87376536F5"><enum>1814.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions apply:</text> 
<paragraph id="H2927646CAFD8430D99704BA2B12F11F"><enum>(1)</enum><header>Commerce</header><text>The term <quote>commerce</quote> means trade or transportation in the jurisdiction of the United States—</text> 
<subparagraph id="H633105743E5343B98450DFDAA2EFE2E6"><enum>(A)</enum><text>between a place in a State and a place outside of the State; or</text></subparagraph> 
<subparagraph id="HFA759C8F45104E778C4160D7451F617F"><enum>(B)</enum><text>that affects trade or transportation between a place in a State and a place outside of the State.</text></subparagraph></paragraph> 
<paragraph id="H0D3EFB12E36A47D98C6C042F846500A7"><enum>(2)</enum><header>Hazardous material</header><text display-inline="yes-display-inline">The term <quote>hazardous material</quote> means a substance or material the Secretary of Transportation designates under <external-xref legal-doc="usc" parsable-cite="usc/49/5103">section 5103(a)</external-xref> of title 49, United States Code.</text></paragraph> 
<paragraph id="HA5BDBDE41E8B4700A1E8EF2721FA126"><enum>(3)</enum><header>Imminent security hazard</header><text>The term <quote>imminent security hazard</quote> means the existence of a condition relating to security sensitive materials that—</text> 
<subparagraph id="H725A31C88751452193355FDA14EA646"><enum>(A)</enum><text>presents a substantial likelihood of a terrorist attack that would result in death, serious illness, severe personal injury, or substantial endangerment to health, property, or national security; and</text></subparagraph> 
<subparagraph id="H7724D3BF07A64FB98574ABD8A3F245FE"><enum>(B)</enum><text>may occur before the reasonably foreseeable completion date of a formal proceeding begun to lessen the risk of that death, illness, injury, or endangerment.</text></subparagraph></paragraph> 
<paragraph id="H0FB180D0B0B14233AA7D0690A806BC1F"><enum>(4)</enum><header>Person</header><text>The term <quote>person</quote>, in addition to its meaning under <external-xref legal-doc="usc" parsable-cite="usc/1/1">section 1</external-xref> of title 1, United States Code—</text> 
<subparagraph id="HA3206F8D9EFE46468094877061552169"><enum>(A)</enum><text>includes a government, Indian tribe, or authority of a government or tribe offering security sensitive material for transportation in commerce or transporting security sensitive material to further a commercial enterprise; but</text> </subparagraph> 
<subparagraph id="HF12F8B038AB24827B8EFB5329FEDF9D8"><enum>(B)</enum><text>does not include—</text> 
<clause id="HCC77D6A7C9C04C928B089697791C9427"><enum>(i)</enum><text>the United States Postal Service; and</text></clause> 
<clause id="H04A49D5EAAD045E5AA2C21AB5670D211"><enum>(ii)</enum><text>in section 1807 and 1808, a department, agency, or instrumentality of the Government.</text></clause></subparagraph></paragraph> 
<paragraph id="H5D180BBFCFAC430E810590F71CE55B57"><enum>(5)</enum><header>Security sensitive material</header> <text>The term <quote>security sensitive material</quote> means a substance or material in quantity and form the Secretary designates under section 1801.</text></paragraph> 
<paragraph id="HFEC7E9B59A134F0DAEAB424B808F884F"><enum>(6)</enum><header>Security sensitive material permit</header><text>The term <quote>security sensitive material permit</quote> means a permit issued under section 1802.</text></paragraph> 
<paragraph id="HB01850DFA4CC4A1C99DF2548F36007F"><enum>(7)</enum><header>Transports; transportation</header><text>The term <quote>transports</quote> or <quote>transportation</quote> means the movement of property and loading, unloading, or storage incidental to the movement.</text></paragraph> </section> </title><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="H09C2B178204D48BAB128C29168586253"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Homeland Security shall establish a task force to assess security risks to motor vehicles transporting security sensitive material, including the vulnerabilities of such motor vehicles to hijacking, en route sabotage, theft, and insider threats.</text></subsection> 
<subsection id="HB678C07EA97F45768288C600B48DAE47"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The task force shall be composed of representatives of the Department of Homeland Security, the Department of Transportation, and representatives of appropriate industry officials, including employee organizations.</text></subsection> 
<subsection id="HD924C1346C1B41C0B466A71DB601FF2"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the task force shall transmit to the Secretary and Congress a report containing the results of the assessment, including proposed solutions for any vulnerabilities identified.</text></subsection></section> 
<section id="H4AB35B04EF31401AA4E278A9379F1E95"><enum>202.</enum><header>Task force on disqualifying crimes</header> 
<subsection id="H3BB1FE88FA1A48E8B4135F59BED6DD6B" commented="no"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall establish a task force to review the lists of crimes that disqualify individuals from certain transportation-related employment under current regulations of the Transportation Security Administration and assess whether such lists of crimes are accurate indicators of a terrorism security risk.</text></subsection> 
<subsection id="H2865DE41E8A34980A00254DDD2A9CB00"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The task force shall be composed of representatives of appropriate industries, including representatives of employee organizations, and Federal agencies.</text></subsection> 
<subsection id="HDE51AD70871D414E966F76ADABD0751F"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the task force shall transmit to the Secretary and Congress a report containing the results of the review, including recommendations for a common list of disqualifying crimes and the rationale for the inclusion of each crime on the list. </text></subsection></section> 
<section id="H8EAEC8494FDD494D905F8B4EF300B5B2"><enum>203.</enum><header>Task force on redundant checks</header> 
<subsection id="HC59CE9AA328248E7B8D5F19C9B254365"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in consultation with the Attorney General, the Secretary of Defense, and the Secretary of Energy, shall establish a task force to review—</text> 
<paragraph id="H309434116088438DBBF384660057B5E5"><enum>(1)</enum><text>all Federal Government background check, vetting, and clearance programs; and</text></paragraph> 
<paragraph id="H8FE04A262DAE4A41BDDFA61E68E4EB2"><enum>(2)</enum><text>the fees imposed under such programs.</text></paragraph></subsection> 
<subsection id="HBDA982F20C974192B48071FEAFA7B60"><enum>(b)</enum><header>Membership</header><text>The task force shall be composed of representatives of appropriate Federal agencies.</text></subsection> 
<subsection id="HDAFE805313DB4FB782BF66F82E365BEA"><enum>(c)</enum><header>Goal</header><text display-inline="yes-display-inline">The task force shall focus on the goal of creating a Government-wide system of background checks to reduce redundancy and minimize the costs paid by the individuals subject to such checks.</text></subsection> 
<subsection id="H34F3A5C85EC94FF6AFE83D00D7762BE4"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the task force shall transmit to the Secretary and Congress a report containing its findings.</text></subsection></section></title>
