		<official-title>To authorize the extension of nondiscriminatory treatment
		  (normal trade relations treatment) to the products of Vietnam.</official-title>

		<section display-inline="no-display-inline" id="HCC3CE0492F8D454A9626E5B017E900A1" section-type="section-one"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HD17BCCFCEE7C4A4B9024CEE965997E9C"><enum>(1)</enum><text>In July 1995,
			 President Bill Clinton announced the formal normalization of diplomatic
			 relations between the United States and Vietnam.</text>
			</paragraph><paragraph id="HE802FBD773A547C0844F49A93E92A735"><enum>(2)</enum><text>Vietnam has taken
			 cooperative steps with the United States under the United States Joint POW/MIA
			 Accounting Command (formerly the Joint Task Force-Full Accounting) established
			 in 1992 by President George H.W. Bush to provide the fullest possible
			 accounting of MIA and POW cases.</text>
			</paragraph><paragraph id="HB3CB46A83A834B91BE5B24F00B3EC36"><enum>(3)</enum><text>In
			 2000, the United States and Vietnam concluded a bilateral trade agreement that
			 included commitments on goods, services, intellectual property rights, and
			 investment. The agreement was approved by joint resolution enacted pursuant to
			 section 405(c) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2435">19 U.S.C. 2435(c)</external-xref>), and entered into
			 force in December 2001.</text>
			</paragraph><paragraph id="HE20397AB00FA469CB2098BE949410025"><enum>(4)</enum><text>Since 2001, normal
			 trade relations treatment has consistently been extended to Vietnam pursuant to
			 title IV of the Trade Act of 1974.</text>
			</paragraph><paragraph id="H139E4FA9C34540B790B14F7798F2B940"><enum>(5)</enum><text>Vietnam has
			 undertaken significant market-based economic reforms, including the reduction
			 of government subsidies, tariffs and nontariff barriers, and extensive legal
			 reform. These measures have dramatically improved Vietnam’s business and
			 investment climate.</text>
			</paragraph><paragraph id="H3E109FB443EF4818AAEE00D635EB48D2"><enum>(6)</enum><text>Vietnam is in the
			 process of acceding to the World Trade Organization. On May 31, 2006, the
			 United States and Vietnam signed a comprehensive bilateral agreement providing
			 greater market access for goods and services and other trade liberalizing
			 commitments as part of the World Trade Organization accession process.</text>
			</paragraph></section><section id="H1608575816934F05B7FBA7ACF5F3E69D"><enum>2.</enum><header>Termination of
			 application of title iv of the trade Act of 1974 to vietnam</header>
			<subsection id="H3A4A00ECA4104F9A97B1C66FA9CA4D96"><enum>(a)</enum><header>Presidential
			 determinations and extension of non-discriminatory
			 treatment</header><text>Notwithstanding any provision of title IV of the Trade
			 Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2431">19 U.S.C. 2431 et seq.</external-xref>), the President may—</text>
				<paragraph id="HEA778407FF1A4C5594443C97F8E3A1F"><enum>(1)</enum><text>determine that such
			 title should no longer apply to Vietnam; and</text>
				</paragraph><paragraph id="H8E45EFB961234EB49D011131E14C76A0"><enum>(2)</enum><text>after making a
			 determination under paragraph (1) with respect to Vietnam, proclaim the
			 extension of nondiscriminatory treatment (normal trade relations treatment) to
			 the products of that country.</text>
				</paragraph></subsection><subsection id="HB492F23BEEAA4B5887177DD300EDA2D"><enum>(b)</enum><header>Termination of
			 the Applicability of Title IV</header><text>On and after the effective date of
			 the extension of nondiscriminatory treatment to the products of Vietnam under
			 subsection (a), title IV of the Trade Act of 1974 shall cease to apply to that
			 country.</text>
