		<legis-type>A BILL</legis-type>
		<official-title>To amend the Internal Revenue Code of 1986 to include
		  heavier vehicles and sport utility vehicles in the limitation on the
		  depreciation of certain luxury automobiles and to impose the gas guzzler tax on
		  such vehicles.</official-title>

		<section id="HC39D8E0929F54252B1004521CDFF5C49" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>No Special Tax Subsidies for Gas
			 Guzzlers Act of 2006</short-title></quote>.</text>
		</section><section id="HA91BD07BEF424A7BB62C6219765897AD" section-type="subsequent-section"><enum>2.</enum><header>Inclusion of heavier
			 vehicles and sport utility vehicles in limitation on depreciation of certain
			 luxury automobiles</header>
			<subsection id="H40A35489B79A45B5B035B9F96558E690"><enum>(a)</enum><header>In
			 general</header><text>Section 280F(d)(5)(A) of the Internal Revenue Code of
			 1986 (defining passenger automobile) is amended by striking clause (ii) and all
			 that follows and inserting the following new clause:</text>
				<quoted-block id="H4ECBBF77E4CE40A5AFA65470DA4BD89D">
					<clause id="H12567327FA844B66B096C9BD2C79263"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H1F5484E9D14C4DF49086F47CD226E2E8"><enum>(I)</enum><text>except as provided in
				subclause (II) or (III), which is rated at 8,500 pounds unloaded gross vehicle
				weight or less,</text>
						</subclause><subclause id="HE5804240283E4B758C2E98D6C6F5649D" indent="up1"><enum>(II)</enum><text>in the case of a truck or van, which is
				rated at 8,500 pounds gross vehicle weight or less, or</text>
						</subclause><subclause id="HED494A3C6B4E4197BFA75F54A036F16B" indent="up1"><enum>(III)</enum><text>in the case of a sport utility vehicle,
				which is rated at 14,000 pounds gross vehicle weight or
				less.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3BF6CA9760B747C2ADBED103400BA88"><enum>(b)</enum><header>Definition</header><text>Section
			 280F(d)(5) of such Code is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block id="H559F06A465D946ED9BDA2BA848C8FB">
					<subparagraph id="H5F5A344223804134AF66160013A4B0B7"><enum>(C)</enum><header>Sport utility
				vehicle</header><text display-inline="yes-display-inline">The term <term>sport
				utility vehicle</term> means a medium duty passenger vehicle (as defined in
				regulations prescribed by the Administrator of the Environmental Protection
				Agency for purposes of the administration of title II of the Clean Air Act (42
				U.S.C. 7521 et seq.)). Such term does not include any vehicle which—</text>
						<clause id="H7E0F8BCDE0C4477392A6E0C5A894F2A6"><enum>(i)</enum><text>does not have the
				primary load carrying device or container attached,</text>
						</clause><clause id="HBBE3506DC1D74E5F85EAB3105E83B5AE"><enum>(ii)</enum><text>has a seating
				capacity of more than 12 individuals,</text>
						</clause><clause id="H8F046D00DC45418984C61210EED180C6"><enum>(iii)</enum><text>is designed for
				more than 9 individuals in seating rearward of the driver’s seat,</text>
						</clause><clause id="H82E0B6B6568142ABBD7211A9B881AC50"><enum>(iv)</enum><text>is equipped with
				an open cargo area, or a covered box not readily accessible from the passenger
				compartment, of at least 72.0 inches in interior length, or</text>
						</clause><clause id="HC02B066F4D1649128608EB008ECFE22D"><enum>(v)</enum><text>has an integral
				enclosure, fully enclosing the driver compartment and load carrying device,
				does not have seating rearward of the driver’s seat, and has no body section
				protruding more than 30 inches ahead of the leading edge of the
				windshield.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H764B090BB46344448457B9C7E6228E4F"><enum>(c)</enum><header>Conforming
			 amendment</header><text>Subparagraph (B) of section 179(b)(6) of such Code is
			 amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H3DECB60F37FC48AA80B6E175C9E04FE7" style="OLC">
					<subparagraph id="H1BABCEB4BEC447459F5F2886E557C8B6"><enum>(B)</enum><header>Sport utility
				vehicle</header><text display-inline="yes-display-inline">For purposes of
				subparagraph (A), the term <quote>sport utility vehicle</quote> means a sport
				utility vehicle (as defined by section 280F(d)(5)(C)) which is not subject to
				section
				280F.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2ECCB201327F46048D1539AF4CF440CA"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to property
			 placed in service after the date of the enactment of this Act.</text>
			</subsection></section><section id="H2F5174486A174739ACF2CBA705E1E1B"><enum>3.</enum><header>Imposition of gas
			 guzzler tax with respect to sport utility vehicles</header>
			<subsection id="H9F21BF0EDA5C47CB8165B62F40D024D1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Clause (ii) of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/4064">section 4064(b)(1)(A)</external-xref> of the Internal Revenue Code of 1986 (defining
			 automobile) is amended to read as follows:</text>
				<quoted-block id="HBE075F4D5508459685A700BC4F54E746">
					<clause id="H0C589F9ECA6744879E14008BAA6F700"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HE3929F9DA9AE48DD84CDC9D8C4BB1B06"><enum>(I)</enum><text>except as provided in
				subclause (II), which is rated at 8,500 pounds unloaded gross vehicle weight or
				less, or</text>
						</subclause><subclause id="H212329BFF8604D6C8D771FD294B31E7" indent="up1"><enum>(II)</enum><text>in the case of a sport utility vehicle
				(within the meaning of section 280F(d)(5)), which is rated at 14,000 pounds
				gross vehicle weight or
				less.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H82291D3C009D4221A5BBDCB4B89DB734"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall apply to sales after the date of the enactment of this
			 Act.</text>
