		  Angostura Irrigation Project certain benefits of the Pick-Sloan Missouri River
		  basin program.</official-title>

		<section id="HCB7C7A7138204EFCACFB99B074D42C78" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Oglala Sioux Tribe Angostura
			 Irrigation Project Modernization and Development
			 Act</short-title></quote>.</text>
		</section><section id="HB320BA0B5AD24FCA9C9283C7F54D63BC"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text>
			<paragraph id="H3240871CDB814CC5007357BDC98C19"><enum>(1)</enum><text>Congress approved
			 the Pick-Sloan Missouri River Basin Program by passing the Act of December 22,
			 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (33
			 U.S.C. 701–1 et seq.)—</text>
				<subparagraph id="H81EEC135588E48B29DDE62865FB92F00"><enum>(A)</enum><text>to promote the
			 economic development of the United States;</text>
				</subparagraph><subparagraph id="H51BC3C043E5949A5BEAE00B9A0BF8F74"><enum>(B)</enum><text>to provide for
			 irrigation in regions north of Sioux City, Iowa;</text>
				</subparagraph><subparagraph id="H47DC7746A2A14262BB85922C668B6BEC"><enum>(C)</enum><text>to protect urban
			 and rural areas from devastating floods of the Missouri River; and</text>
				</subparagraph><subparagraph id="H297DC1D7A05443D49326309452007842"><enum>(D)</enum><text>for other
			 purposes.</text>
				</subparagraph></paragraph><paragraph id="H92D178CB727B43EC808601FA52357335"><enum>(2)</enum><text>The Angostura
			 Unit—</text>
				<subparagraph id="H365D48145B9448B994F29933AE1B8DDB"><enum>(A)</enum><text>is a component of
			 the Pick-Sloan program; and</text>
				</subparagraph><subparagraph id="H27D8CC8490CB4FE0003995976DED389E"><enum>(B)</enum><text>provides
			 for—</text>
					<clause id="H1AAB4DAE69384AB5BA102900CC1C40A7"><enum>(i)</enum><text>irrigation of
			 approximately 12,218 acres of productive farm land in South Dakota; and</text>
					</clause><clause id="HA79B40857E5842BFA2DADDB3BDCBB684"><enum>(ii)</enum><text>substantial
			 recreation and fish and wildlife benefits.</text>
					</clause></subparagraph></paragraph><paragraph id="HB7028F69FEE246CE81AEBC55DB2CBFA8"><enum>(3)</enum><text>The Commissioner
			 of Reclamation has determined that—</text>
				<subparagraph id="H93F3F0637B91411B9DD55E8F302FE77D"><enum>(A)</enum><text>the national
			 economic development benefits from irrigation at the Angostura Unit total
			 approximately $3,410,000 annually; and</text>
				</subparagraph><subparagraph id="H1BB86222C04C4BEEB979542616BE7800"><enum>(B)</enum><text>the national
			 economic development benefits of recreation at Angostura Reservoir total
			 approximately $7,100,000 annually.</text>
				</subparagraph></paragraph><paragraph id="H8F6417913274419093F1B07558BB22A7"><enum>(4)</enum><text>The Angostura Unit
			 impounds the Cheyenne River 20 miles upstream of the Pine Ridge Indian
			 Reservation in South Dakota.</text>
			</paragraph><paragraph id="H61DD02CA1D81419CBC76C3E00BD4D"><enum>(5)</enum><text display-inline="yes-display-inline">The Reservation experiences extremely high
			 rates of unemployment and poverty.</text>
			</paragraph><paragraph id="HDA323B650CC04CDFB88386552595AB28"><enum>(6)</enum><text display-inline="yes-display-inline">There is a need for economic development on
			 the Reservation.</text>
			</paragraph><paragraph id="HCC6F564E35A34BC2B0AC92FFB46D6BC3"><enum>(7)</enum><text>The national
			 economic development benefits of the Angostura Unit do not extend to the
			 Reservation.</text>
			</paragraph><paragraph id="H6D7E283758D94B188408B8305C5FF2FB"><enum>(8)</enum><text>The Angostura Unit
			 may be associated with negative effects on water quality and riparian
			 vegetation in the Cheyenne River on the Reservation.</text>
			</paragraph><paragraph id="HCE619BFB34DF421FA6FFB3EA223994B8"><enum>(9)</enum><text>Modernization of
			 the irrigation facilities at the Angostura Unit would—</text>
				<subparagraph id="H5C24B3B750E642F09D63DF00C472AA1B"><enum>(A)</enum><text>enhance the
			 national economic development benefits of the Angostura Unit; and</text>
				</subparagraph><subparagraph id="HEC6A638B9FE145909F55325C5516B28D"><enum>(B)</enum><text>result in improved
			 water efficiency and environmental restoration benefits on the
			 Reservation.</text>
				</subparagraph></paragraph><paragraph id="H91CCBCF4093E4E8EA0DD00D1305BB2AF"><enum>(10)</enum><text>The establishment
			 of a trust fund for the Oglala Sioux tribe would—</text>
				<subparagraph id="H8C4242CEB58B4226A8FFF3AE35BBC68E"><enum>(A)</enum><text>produce economic
			 development benefits for the Reservation comparable to the benefits produced at
			 the Angostura Unit; and</text>
				</subparagraph><subparagraph id="HAFCD3CE293FC4811BE5DC4B1B4618DE"><enum>(B)</enum><text>provide resources
			 that are necessary for restoration of the Cheyenne River corridor on the
			 Reservation.</text>
				</subparagraph></paragraph></section><section id="H136E644850F141C997FE8751BB3C8C00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H2A8EB1FDBC0E4B44BF0085D960A63D85"><enum>(1)</enum><header>Angostura
			 unit</header><text>The term <term>Angostura Unit</term> means the irrigation
			 unit of the Angostura irrigation project developed under the Act of August 11,
			 1939 (<external-xref legal-doc="usc" parsable-cite="usc/16/590y">16 U.S.C. 590y et seq.</external-xref>).</text>
			</paragraph><paragraph id="H7A60FE31E4724210002FFC56FAD5DE18"><enum>(2)</enum><header>Fund</header><text>The
			 term <term>Fund</term> means the Oglala Sioux Tribal Development Trust Fund
			 established by section 201(a).</text>
			</paragraph><paragraph id="H54109F822D49447988A0A3056840031"><enum>(3)</enum><header>Pick-sloan
			 program</header><text>The term <term>Pick-Sloan program</term> means the
			 Pick-Sloan Missouri River basin program approved under the Act of December 22,
			 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>; 33 U.S.C.
			 701–1 et seq.).</text>
			</paragraph><paragraph id="HB2356BD15C174E9B8439C9A3F504AD33"><enum>(4)</enum><header>Plan</header><text>The
			 term <term>plan</term> means the development plan developed by the Tribe under
			 section 201(f).</text>
			</paragraph><paragraph id="H5424D57F9EA24ACD8F161FDA55004906"><enum>(5)</enum><header>Reservation</header><text>The
			 term <term>Reservation</term> means the Pine Ridge Indian Reservation.</text>
			</paragraph><paragraph id="HEA730547BB214AAB00A598C0A5E1BDBC"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="H529EFB31E33046BB82EB27C0E7C020C9"><enum>(7)</enum><header>Tribe</header><text>The
			 term <term>Tribe</term> means the Oglala Sioux Tribe of the Pine Ridge Indian
			 Reservation.</text>
			</paragraph><paragraph id="HA352BC19B9B9491CA4E4EA09DBDBC033"><enum>(8)</enum><header>Tribal
			 council</header><text>The term <term>Tribal Council</term> means the governing
			 body of the Tribe.</text>
			</paragraph></section><section id="HFEC7F2ADF1944AA09E6231DA96B7756F"><enum>4.</enum><header>Modernization</header>
			<subsection id="H3A2AFE35899749FEBA76E0D3ABEB9E3D"><enum>(a)</enum><header>Modernization of
			 facilities at angostura unit</header>
				<paragraph id="HE30BD0813C8E4415A900FC66A0D2B900"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall carry out the modernization and
			 improvement of the facilities at the Angostura Unit as described in the
			 Improved Efficiencies Alternative included in the report titled <quote>Final
			 Environmental Impact Statement, Angostura Unit Contract Negotiation and Water
			 Management (August 2002)</quote>.</text>
				</paragraph><paragraph id="HFFA24FA600B6425689D5891B2D19DD9C"><enum>(2)</enum><header>Nonreimbursability</header><text>The
			 cost of the modernization and improvement of the facilities at the Angostura
			 Unit shall be carried out on a nonreimbursable basis.</text>
				</paragraph></subsection><subsection id="HCCE5374D3EB4404CB403DAE95C44EA7"><enum>(b)</enum><header>Delivery of water
			 to pine ridge Indian reservation</header><text>The Secretary shall provide for
			 the delivery of the water saved through the modernization and improvement of
			 the facilities of the Angostura Unit as an instream flow of the Cheyenne River
			 to be used for fish and wildlife purposes and environmental restoration on the
			 Reservation.</text>
			</subsection><subsection id="HA6100AA2BEC447809109CA87C3F471F1"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out subsection (a) $4,660,000, to remain available until expended.</text>
			</subsection></section><section id="H412754C3CF1B4C4199F29B52D21F9F8"><enum>5.</enum><header>Development</header>
			<subsection id="H77FB40DDA9B148FEB0ECAD8DF91E7C5B"><enum>(a)</enum><header>Oglala Sioux
			 tribal development trust fund</header>
				<paragraph id="H50F68D53491B4CC188AFA400B7258095"><enum>(1)</enum><header>Oglala Sioux
			 tribal development trust fund</header><text>There is established in the
			 Treasury of the United States a fund to be known as the <quote>Oglala Sioux
			 Tribal Development Trust Fund,</quote> consisting of any amounts deposited in
			 the Fund under this Act.</text>
				</paragraph><paragraph id="H456EDAAC454941A1AEFED4F7B70051A6"><enum>(2)</enum><header>Funding</header><text>Not
			 later than the first day of the 11th fiscal year that begins after the date of
			 enactment of this Act, the Secretary of the Treasury shall, from the General
			 Fund of the Treasury, deposit in the Fund $92,500,000.</text>
				</paragraph><paragraph id="HAE248107B87A410E80E2F50940679867"><enum>(3)</enum><header>Investment of
			 trust fund</header>
					<subparagraph id="H59096A9668FE452D99F177EE7FDCBC1"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of the Treasury shall invest such portion
			 of the Fund as is not, in the judgment of the Secretary of the Treasury,
			 required to meet current withdrawals.</text>
					</subparagraph><subparagraph id="HE9A9149C208D45628991B21631F02600"><enum>(B)</enum><header>Eligible
			 obligations</header><text>Notwithstanding any other provision of law, the
			 Secretary of the Treasury shall invest the amounts deposited under paragraph
			 (2) and the interest earned on those amounts only in interest-bearing
			 obligations of the United States issued directly to the Fund.</text>
					</subparagraph><subparagraph id="H33E56F24C0094D2BB946347FEF40070"><enum>(C)</enum><header>Interest</header><text>The
			 Secretary of the Treasury shall deposit interest resulting from such
			 investments into the Fund.</text>
					</subparagraph></paragraph><paragraph id="H4FBBD508B07540F6B43EC6FE4BA130D0"><enum>(4)</enum><header>Payment of
			 interest to tribe</header>
					<subparagraph id="HEE373784E3694F50BA8F9EDE8EC27E49"><enum>(A)</enum><header>Withdrawal of
			 interest</header><text>On October 1st of each year, the Secretary of the
			 Treasury shall transfer the aggregate amount of interest deposited into the
			 Fund for the fiscal year to the Secretary for use in accordance with
			 subparagraph (C).</text>
					</subparagraph><subparagraph id="HDBB741CDA0734C44A12070902EF511C7"><enum>(B)</enum><header>Availability</header><text>Each
			 amount transferred under subparagraph (A) shall be available without fiscal
			 year limitation.</text>
					</subparagraph><subparagraph id="H898B6B62541F435F90A3325FE59E5848"><enum>(C)</enum><header>Payments to
			 tribe</header>
						<clause id="H0512AC9AFD5E433D8DBD65C200141345"><enum>(i)</enum><header>In
			 general</header><text>The Secretary of the Interior shall use the amounts
			 transferred under subparagraph (A) only for the purpose of making payments to
			 the Tribe, as such payments are requested by the Tribe pursuant to tribal
			 resolution.</text>
						</clause><clause id="H51B392F8257F441FADE754E4BF6DE483"><enum>(ii)</enum><header>Limitation</header><text>Payments
			 may be made by the Secretary of the Interior under clause (i) only after the
			 Tribe has adopted a plan under paragraph (6).</text>
						</clause><clause id="H6EC58642F35C4354BC9C106601B0ADF"><enum>(iii)</enum><header>Use of payments
			 by tribe</header><text>The Tribe shall use the payments made under this
			 subparagraph only for carrying out projects and programs under the plan
			 prepared under paragraph (6).</text>
						</clause></subparagraph></paragraph><paragraph id="H7ADF5139255C483F83C204081E77AB85"><enum>(5)</enum><header>Limitation on
			 transfers and withdrawals</header><text>Except as provided in paragraphs (3)
			 and (4)(A), the Secretary of the Treasury shall not transfer or withdraw any
			 amount deposited under paragraph (2).</text>
				</paragraph><paragraph id="H228067FD0ABA4BC7B8571878ED808891"><enum>(6)</enum><header>Development
			 plan</header>
					<subparagraph id="H13FAC43708764D65B91EDFA3E062CDF"><enum>(A)</enum><header>In
			 general</header><text>Not later than 18 months after the date of enactment of
			 this Act, the governing body of the Tribe shall prepare a plan for the use of
			 the payments to the Tribe under paragraph (4).</text>
					</subparagraph><subparagraph id="H8715ED466480400DAF5199ABB3F2E480"><enum>(B)</enum><header>Contents</header><text>The
			 plan shall provide for the manner in which the Tribe shall expend payments to
			 the Tribe under paragraph (4) to promote—</text>
						<clause id="HB863F311A8E8407FA070FE84C61E736B"><enum>(i)</enum><text>economic
			 development;</text>
						</clause><clause id="HA084DFAAD37D439E9D6647FD4FE1E371"><enum>(ii)</enum><text>infrastructure
			 development;</text>
						</clause><clause id="H0CDFAC4BB944498E92802CF9F9E779B9"><enum>(iii)</enum><text>the educational,
			 health, recreational, and social welfare objectives of the Tribe and members of
			 the Tribe; or</text>
						</clause><clause id="H6793C43AE461441BBD5512006BD7F074"><enum>(iv)</enum><text>any
			 combination of the activities described in subparagraphs (A) through
			 (C).</text>
						</clause></subparagraph><subparagraph id="HF630984D9D8044A1A665835DF755602B"><enum>(C)</enum><header>Plan review and
			 revision</header>
						<clause id="HB31EF549EB494C95890024A5A600EA63"><enum>(i)</enum><header>In
			 general</header><text>The Tribal Council shall make available for review and
			 comment by the members of the Tribe a copy of the plan before the plan becomes
			 final, in accordance with procedures established by the Tribal Council.</text>
						</clause><clause id="H9ED0F9790D3444EB8577C613914D32CA"><enum>(ii)</enum><header>Updating of
			 plan</header>
							<subclause id="HD901EF40C5AA4EE98B5E4295C2D6096F"><enum>(I)</enum><header>In
			 general</header><text>The Tribal Council may, on an annual basis, revise the
			 plan.</text>
							</subclause><subclause id="H15B1904063BD40AC8C2F561BB44B3D72"><enum>(II)</enum><header>Review and
			 comment</header><text>In revising the plan, the Tribal Council shall provide
			 the members of the Tribe opportunity to review and comment on any proposed
			 revision to the plan.</text>
							</subclause></clause><clause id="H4667B89D92E54580B2D10066E41F5F00"><enum>(iii)</enum><header>Consultation</header><text>In
			 preparing the plan and any revisions to the plan, the Tribal Council shall
			 consult with the Secretary and the Secretary of Health and Human
			 Services.</text>
						</clause></subparagraph><subparagraph id="H04873A95BD194587ABA5218F07701C80"><enum>(D)</enum><header>Audit</header>
						<clause id="H31190FEA153D488BA1643815BADD3D4F"><enum>(i)</enum><header>In
			 general</header><text>The activities of the Tribe in carrying out the plan
			 shall be audited as part of the annual single-agency audit that the Tribe is
			 required to prepare pursuant to the Office of Management and Budget circular
			 numbered A–133.</text>
						</clause><clause id="H73D624FD1C7B45E793BA9F3FDAF28C9E"><enum>(ii)</enum><header>Determination
			 by auditors</header><text display-inline="yes-display-inline">The auditors that
			 conduct the audit conducted pursuant to this subparagraph shall—</text>
							<subclause id="H257E05FE282C441EB2C766D2DF115AF"><enum>(I)</enum><text display-inline="yes-display-inline">determine whether funds received by the
			 Tribe under this section for the period covered by the audit conducted pursuant
			 to this subparagraph were expended to carry out the plan in a manner consistent
			 with this section; and</text>
							</subclause><subclause id="H8D004CE3A77345EE9787A19ED8B261B"><enum>(II)</enum><text>include in the
			 written findings of the audit the determination made under clause (i).</text>
							</subclause></clause><clause id="HF901358DAB924468A07C87D5E3D7B41"><enum>(iii)</enum><header>Inclusion of
			 findings with publication of proceedings of tribal council</header><text>A copy
			 of the written findings of the audit conducted pursuant to this subparagraph
			 shall be inserted in the published minutes of the Tribal Council proceedings
			 for the session at which the audit is presented to the Tribal Council.</text>
						</clause></subparagraph></paragraph><paragraph id="H42AC75CC6D1F429290ECD3199EA0FD72"><enum>(7)</enum><header>Prohibition of
			 per capita payments</header><text>No portion of any payment made under this Act
			 may be distributed to any member of the Tribe on a per capita basis.</text>
				</paragraph></subsection><subsection id="H2957FA7F2AC94A4596556603BB71A1FC"><enum>(b)</enum><header>Eligibility of
			 tribe for certain programs and services</header><text>No payment made to the
			 Tribe under this Act shall result in the reduction or denial of any service or
			 program with respect to which, under Federal law—</text>
				<paragraph id="HA48BC4ECCBD3483584A67B8B5D6996DD"><enum>(1)</enum><text>the Tribe is
			 otherwise entitled because of the status of the Tribe as a federally recognized
			 Indian tribe; or</text>
				</paragraph><paragraph id="HFAF0F384181B44D69E1E479BAE1F82C9"><enum>(2)</enum><text>any individual who
			 is a member of the Tribe is entitled because of the status of the individual as
			 a member of the Tribe.</text>
				</paragraph></subsection><subsection id="HF097588358D24605B44EDD9CC0588476"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as are necessary to pay the administrative expenses of the Fund.</text>
			</subsection><subsection id="HD9FD5D0CBC424329B9ABCBD8CD76E29B"><enum>(d)</enum><header>Disclaimer of
			 effects</header><text>Nothing in this Act affects—</text>
				<paragraph id="H348FC3BBFE55406FABB5D2AF3DCC3F79"><enum>(1)</enum><text>the rights or
			 claims of the Tribe under the Treaty of Fort Laramie of September 15, 1851 (11
			 Stat. 749);</text>
				</paragraph><paragraph id="HD5B5ECA4042E40C7A142B9007788A9B7"><enum>(2)</enum><text>the rights or
			 claims of the Tribe under the Treaty of Fort Laramie of April 29, 1868 (15
			 Stat. 635); or</text>
				</paragraph><paragraph id="H6FB73E606A4743D5BD003502BADF312E"><enum>(3)</enum><text>the reserved water
			 rights of the Tribe under the principles of Winters v. United States (207 U.S.
			 564 (1908)).</text>
				</paragraph></subsection></section></legis-body>
