		<official-title>To amend the Occupational Safety and Health Act of 1970
		  and the Federal Mine Safety and Health Act of 1977 to prohibit the promulgation
		  of safety and health standards that do not meet certain requirements for
		  national consensus standards.</official-title>

		<section id="H33EDAF19506D4A8DABF88E9B4CE68D23" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Workplace Safety and Health
			 Transparency Act of 2006</short-title></quote>.</text>
		</section><section id="H78E4FD229D70449A9D19CF051959EA8B"><enum>2.</enum><header>Adoption of
			 nongovernmental standards under the Occupational Health and Safety Act</header>
			<subsection id="H05EFDB4C5BFB44F58FB5942E3C844B57"><enum>(a)</enum><header>Adoption by
			 OSHA</header><text display-inline="yes-display-inline">The Occupational Health
			 and Safety Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>) is amended by adding after
			 section 6 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1384F74ABDB24E41836D3C111E1D9E41" style="traditional">
					<section id="HC4B2BB76BB1E4BA183E7D9303042A811"><enum>6A.</enum><header>Adoption of nongovernmental standards</header><subsection commented="no" display-inline="yes-display-inline" id="H4B70190E99B74819BE181F2329BB0068"><enum>(a)</enum><text display-inline="yes-display-inline">Effective on the date of enactment of this
				section, the Secretary shall not promulgate or incorporate by reference any
				finding, guideline, standard, limit, rule, or regulation based on a
				determination reached by any organization, unless the Secretary affirmatively
				finds that such determination—</text>
							<paragraph id="HFD6ACCBCEE2441558F363705A5A5B612"><enum>(1)</enum><text>has been adopted
				and promulgated by a nationally recognized standards-producing organization
				under procedures whereby it can be determined by the Secretary that persons
				interested and affected by the scope or provisions of the standard have reached
				substantial agreement on its adoption;</text>
							</paragraph><paragraph id="HE79BEB1C798A4F60AB4600AF7FB50700"><enum>(2)</enum><text>was formulated in
				a manner which afforded an opportunity for diverse views to be considered;
				and</text>
							</paragraph><paragraph id="HDA99B5B6DFE9469B8DC99BA0CB472B64"><enum>(3)</enum><text>has been
				designated as such a standard by the Secretary, after consultation with other
				appropriate Federal agencies.</text>
								<continuation-text continuation-text-level="paragraph">Such
				finding and a summary of its basis shall be published in the Federal Register
				and shall be considered a final action subject to review by a United States
				District Court in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/706">section 706</external-xref> of title 5, United States
				Code.</continuation-text></paragraph></subsection><subsection id="H983E9ED036224CB8935ECCBA1D3E1B7E"><enum>(b)</enum><text display-inline="yes-display-inline">With respect to rulemaking proceedings
				initiated by the Secretary but not finalized prior to the date of enactment of
				this section, the Secretary shall, within 180 days of the date of enactment of
				this section, investigate and identify the use of, influence of, or reliance
				upon any finding, guideline, standard, limit or any other recommendation that
				has not been made by an organization and procedure that does not comply with
				the requirements set forth in subsection (a). The Secretary shall publish the
				results of such investigations in the Federal Register and, in any final rule,
				standard, or official recommendation that is prescribed under such proceedings,
				shall not incorporate, use, or rely upon any finding, guideline, standard,
				limit, or other recommendation that does not comply with the requirements set
				forth in subsection (a). The Secretary’s actions under this section shall be
				subject to review by a United States district court of appropriate
				jurisdiction.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA152CCAD0E8F4DA68340E3847CAD94D4"><enum>(b)</enum><header>Approval of
			 State plans</header><text>Section 18 of the Occupational Safety and Health Act
			 of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/667">29 U.S.C. 667</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF0A00CDDC27B4D5AB89B850098A26B16" style="traditional">
					<subsection id="HE9C82FAA9A4342AC8843CD64B096FF00"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary shall not approve a State
				plan under this section that incorporates by reference any finding, guideline,
				standard, limit, rule, or regulation based on a determination reached by any
				organization, unless the Secretary determines that the standards adopted in
				such plan are standards that—</text>
						<paragraph id="H8CB0A7A1B2BA4344A54E6B5622FC4D82"><enum>(1)</enum><text>have been adopted
				and promulgated by a nationally recognized standards-producing organization
				under procedures whereby it can be determined by the State that persons
				interested and affected by the scope or provisions of such standards have
				reached substantial agreement on their adoption; and</text>
						</paragraph><paragraph id="H98E4813B19E84A608940D9F857604736"><enum>(2)</enum><text>were formulated in
				a manner which afforded an opportunity for diverse views to be
				considered.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H3DFD6E962D4D473AB2E897E6274B082C"><enum>3.</enum><header>Adoption of
			 nongovernmental standards under the Federal Mine Safety and Health
			 Act</header><text display-inline="no-display-inline">Section 101 of the Federal
			 Mine Safety and Health Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/811">30 U.S.C. 811</external-xref>) is amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HC2EB5943036F40CB957BE1825FA292D8" style="traditional">
				<subsection id="HADD0216BD3DC43EB00FD5FFDCCE6DEA"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB442E0708EED40C0870783974775199F"><enum>(1)</enum><text display-inline="yes-display-inline">Effective on the date of enactment of this
				section, the Secretary shall not promulgate or incorporate by reference any
				finding, guideline, standard, limit, rule, or regulation based on a
				determination reached by any organization, unless the Secretary affirmatively
				finds that such determination—</text>
						<subparagraph id="HD397C74B7B134A6D82FE0300DD58B35B" indent="up1"><enum>(A)</enum><text>has been adopted and promulgated by a
				nationally recognized standards-producing organization under procedures whereby
				it can be determined by the Secretary that persons interested and affected by
				the scope or provisions of the standard have reached substantial agreement on
				its adoption;</text>
						</subparagraph><subparagraph id="HE35545E9F8684DF3B2C4B7EB00003BF5" indent="up1"><enum>(B)</enum><text>was formulated in a manner which
				afforded an opportunity for diverse views to be considered; and</text>
						</subparagraph><subparagraph id="H65FD2096DE8E42ADB44EE965CDEAA8C" indent="up1"><enum>(C)</enum><text>has been designated as such a standard
				by the Secretary, after consultation with other appropriate Federal
				agencies.</text>
						</subparagraph></paragraph><continuation-text continuation-text-level="subsection">Such
				finding and a summary of its basis shall be published in the Federal Register
