		<official-title>To amend title 38, United States Code, to remove certain
		  limitations on attorney representation of claimants for veterans benefits in
		  administrative proceedings before the Department of Veterans Affairs, and for
		  other purposes.</official-title>

		<section display-inline="no-display-inline" id="H69687E00F46843C2A82153D35C5006B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Veterans’ Choice of Representation Act of 2006</quote>.</text>
		</section><section id="H07B04215834C44B7B8E263851CC53EEB"><enum>2.</enum><header>Attorney
			 representation in veterans benefits claims cases before the Department of
			 Veterans Affairs</header>
			<subsection id="H77297FD803324B9180CEEFA999610003"><enum>(a)</enum><header>Qualifications
			 and Standards of Conduct for Individuals Recognized as Agents or
			 Attorneys</header>
				<paragraph id="HD77C307D70E74860877CBC100084F69E"><enum>(1)</enum><header>Additional
			 qualifications and standards for agents and attorneys
			 generally</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/38/5904">section 5904</external-xref> of title 38, United
			 States Code, is amended—</text>
					<subparagraph id="H52127876808341BA91772DFCD442A823"><enum>(A)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(a)</quote>;</text>
					</subparagraph><subparagraph id="H782852A8E33C42668FE8062C0091D1C"><enum>(B)</enum><text>by striking the
			 second sentence; and</text>
					</subparagraph><subparagraph id="H9A078BB28F3E4DBCB56FFC2BC078B9DD"><enum>(C)</enum><text>by adding at the
			 end the following new paragraphs:</text>
						<quoted-block id="H5563143E2E5B427F8C1B051791E86568" style="OLC">
							<paragraph id="HEA37B9B209C04913BDD7B9CC55D8CC5" indent="up1"><enum>(2)</enum><text>The Secretary may prescribe in
				regulations qualifications and standards of conduct for individuals recognized
				under this section, including the following:</text>
								<subparagraph id="H24C80441157E4946004B065113473418"><enum>(A)</enum><text>A requirement that, before being
				recognized, an individual—</text>
									<clause id="H372B44E637BC411BB9EAF000ADC49520"><enum>(i)</enum><text>show that such individual is of
				good moral character and in good repute, is qualified to render claimants
				valuable service, and is otherwise competent to assist claimants in presenting
				claims; and</text>
									</clause><clause id="H2AB1764ABADA481D9EFB9B7696B91BD7"><enum>(ii)</enum><text>has such level of experience and
				specialized training as the Secretary shall specify.</text>
									</clause></subparagraph><subparagraph id="H33F25FF8EEC94596AB1D41CFB5F9700"><enum>(B)</enum><text>A requirement that the individual
				follow such standards of conduct as the Secretary shall specify.</text>
								</subparagraph></paragraph><paragraph id="H042073F6B1664D1DBBC13043B7574762" indent="up1"><enum>(3)</enum><text>The Secretary may prescribe in
				regulations restrictions on the amount of fees that an agent or attorney may
				charge a claimant for services rendered in the preparation, presentation, and
				prosecution of a claim before the
				Department.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H16C3046DD21C4A82AAB8D8A862DD6190"><enum>(2)</enum><header>Applicability to
			 representatives of veterans service organizations</header><text>Section 5902(b)
			 of such title is amended—</text>
					<subparagraph id="H52AA88AB56974B8AA6C72EC61C990367"><enum>(A)</enum><text>by redesignating
			 paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text>
					</subparagraph><subparagraph id="H58FE73CCCFC74DBB82084D83FF3F1E1E"><enum>(B)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(b)</quote>; and</text>
					</subparagraph><subparagraph id="H581FD7A758314EC0AE3B8D964DBF0099"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block id="H48AD418DD2994E31AD3938A767CB58BB" style="OLC">
							<paragraph id="H5B0951FBC2324BC29F22A8915CF4ACCE" indent="up1"><enum>(2)</enum><text>An individual recognized under this
				section shall be subject to suspension under section 5904(b) of this title on
				the same basis as an individual recognized under section 5904(a) of this
				title.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HDC743DA703F64947A422F12F22B003B"><enum>(3)</enum><header>Applicability to
			 individuals recognized for particular claims</header><text>Section 5903 of such
			 title is amended—</text>
					<subparagraph id="H13D7782C3D0D419ABE3E4E9F3500F612"><enum>(A)</enum><text>by inserting
			 <quote>(a) <header-in-text level="subsection">In
			 general</header-in-text>.—</quote> before <quote>The Secretary</quote>;
			 and</text>
					</subparagraph><subparagraph id="HC5C435D47EC3451CB6D69C6867D529C0"><enum>(B)</enum><text>by adding at the
			 end the following new subsection:</text>
						<quoted-block id="H258659107CD44428B709443EAB03BF9B" style="OLC">
							<subsection id="HD076EC54F1F94DAC898FCB66F7E477B7"><enum>(b)</enum><header>Suspension</header><text>An
				individual recognized under this section shall be subject to suspension under
				section 5904(b) of this title on the same basis as an individual recognized
				under section 5904(a) of this
				title.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H35461CCF4AC147B98285AB28C4128296"><enum>(b)</enum><header>Additional Bases
			 for Suspension of Individuals</header><text>Subsection (b) of section 5904 of
			 such title is amended—</text>
				<paragraph id="H02B6F5FB005E411A8500FCF6F4F77167"><enum>(1)</enum><text>by inserting
			 <quote>and sections 5902 and 5903 of this title</quote> after <quote>under this
			 section</quote>;</text>
				</paragraph><paragraph id="HE5A607E6772E42C193E800A0F7EF946E"><enum>(2)</enum><text>in paragraph (4),
			 by striking <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="H85CFA287141C48F783C90059FADC9F45"><enum>(3)</enum><text>in paragraph (5),
			 by striking the period and inserting a semicolon; and</text>
				</paragraph><paragraph id="HC57062E31FEE4131BE4C39189B259CCC"><enum>(4)</enum><text>by adding at the
			 end the following new paragraphs:</text>
					<quoted-block id="H2704BD70296D44BEB967C392D18E062D" style="OLC">
						<paragraph id="H1E4EC479DD204BFA8D294EE63854F113"><enum>(6)</enum><text>has failed to
				conduct himself or herself with due regard for the non-adversarial nature of
				any proceeding before the Department;</text>
						</paragraph><paragraph id="H4BBF66B5410C4A129BCE6E7BC27C8CF0"><enum>(7)</enum><text>has presented
				frivolous claims, issues, or arguments to the Department; or</text>
						</paragraph><paragraph id="H08FE1CE870DB435CB6C2A4CD13DB0795"><enum>(8)</enum><text>has failed to
				comply with any other condition specified by the Secretary in regulations
				prescribed by the Secretary for purposes of this
				subsection.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H50EB059FDF9347CD95A40093CBD095CB"><enum>(c)</enum><header>Repeal of
			 Limitation on Hiring Agents or Attorneys</header><text>Subsection (c) of
			 section 5904 of such title is amended by striking paragraph (1).</text>
			</subsection><subsection id="HF219783F15244580A06406EF6EFA8568"><enum>(d)</enum><header>Modification of
			 Requirements to File Attorney Fee Agreements</header><text>Such subsection is
			 further amended—</text>
				<paragraph id="H72346C03FCA4427C87C0355890C714C5"><enum>(1)</enum><text>by redesignating
			 paragraph (2) as paragraph (1); and</text>
				</paragraph><paragraph id="HD73C25AE190F415BADD0043C243B4F14"><enum>(2)</enum><text>in that paragraph,
			 as so redesignated—</text>
					<subparagraph id="H7D48E881371A41FAB807939BA0C94963"><enum>(A)</enum><text>by striking
			 <quote>in a case referred to in paragraph (1) of this
			 subsection</quote>;</text>
					</subparagraph><subparagraph id="H619062E959CF4919A9F153B82BCE5C00"><enum>(B)</enum><text>by striking
			 <quote>after the Board first makes a final decision in the case</quote>;</text>
					</subparagraph><subparagraph id="HB1A4D3C07E7346FC8868223430AEC19E"><enum>(C)</enum><text>by striking
			 <quote>with the Board at such time as may be specified by the Board</quote> and
			 inserting <quote>with the Secretary pursuant to regulations prescribed by the
			 Secretary</quote>; and</text>
					</subparagraph><subparagraph id="H4057177FB4C74F048EDDEBCAEAAC7D00"><enum>(D)</enum><text>by striking the
			 second and third sentences.</text>
					</subparagraph></paragraph></subsection><subsection id="H50BC196431424F89AB7CA8D061FA8148"><enum>(e)</enum><header>Attorney
			 Fees</header><text>Such subsection is further amended by inserting after
			 paragraph (1), as redesignated by subsection (d)(1) of this section, the
			 following new paragraph (2):</text>
				<quoted-block id="HC1978F05C5EB49598F1467A31D438663" style="OLC">
					<paragraph id="H8E2F1B9DAB534DB3B743646200EDB4CE" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HAAF4256234B34A29A69D9F6C5748C246"><enum>(A)</enum><text>The Secretary, upon the
				Secretary’s own motion or at the request of the claimant, may review a fee
				agreement filed pursuant to paragraph (1) and may order a reduction in the fee
				called for in the agreement if the Secretary finds that the fee is excessive or
				unreasonable.</text>
						</subparagraph><subparagraph id="H361FD157E51C4AEA8F14006BC77BD1E9" indent="up1"><enum>(B)</enum><text>A finding or order of the Secretary
				under subparagraph (A) may be reviewed by the Board of Veterans’ Appeals under
				section 7104 of this
				title.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H011EB55AC0924D42A96100F2D1A95600"><enum>(f)</enum><header>Repeal of
			 Penalty for Certain Acts</header><text>Section 5905 of such title is amended by
			 striking <quote>(1)</quote> and all that follows through
			 <quote>(2)</quote>.</text>
			</subsection><subsection id="H6946DFC89AE548B2BD267F5903ED9C29"><enum>(g)</enum><header>Effective
			 Date</header>
				<paragraph id="HF65A04ACA1ED4909A1CA80D1009DD92B"><enum>(1)</enum><header>In
			 general</header><text>The amendments made by this section shall take effect six
			 months after the date of the enactment of this Act.</text>
				</paragraph><paragraph id="H8DEB586B28A14F78832078A5EEE1922C"><enum>(2)</enum><header>Regulations</header><text>The
			 Secretary shall prescribe the regulations, if any, to be prescribed under the
			 amendments made by subsection (a) not later than the date specified in
			 paragraph (1).</text>
				</paragraph><paragraph id="H953DCF9B30A0478F9D58DB7FF1860032"><enum>(3)</enum><header>Claims</header><text>The
			 amendments made by subsections (b), (c), (d), and (e) shall apply to claims
			 submitted on or after the date specified in paragraph (1).</text>
