<section id="H57A0616F17A84FE59B421BB9D5361922"><enum>2.</enum><header>Reauthorization</header><text display-inline="no-display-inline">Section 579 of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended—</text> 
<paragraph id="HE525BD1F41884F60B99FF44371F53F21"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>October 1, 2006</quote> and inserting <quote>October 1, 2011</quote>; and</text> </paragraph>

<section id="H9C1D397D8C9F403E843F97531507C0B1"><enum>2.</enum><header>Reauthorization</header><text display-inline="no-display-inline">Section 579 of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended—</text>
<paragraph id="H6F2DB9CE55D74B19B25289EAC3FBAA06"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>October 1, 2006</quote> and inserting <quote>October 1, 2011</quote>; and</text></paragraph>
<paragraph id="H84CF362A799842ADA38D7FA30000E593"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>October 1, 2006</quote> and inserting <quote>October 1, 2011</quote>.</text></paragraph></section>
<section id="H67B1E13EDDBB49C59DD295AECDA011D9" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Exception rents</header><text display-inline="no-display-inline">Section 514(g)(2)(A) of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended by striking <quote>five percent</quote> and inserting <quote>nine percent</quote>.</text></section>
<section id="HB8581B359B7242339CF7448FBEC25058"><enum>4.</enum><header>Period of eligibility for nonprofit debt relief</header><text display-inline="no-display-inline">Section 517(a)(5) of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended by inserting before the period at the end the following: <quote>: <italic>Provided</italic>, That if such purchaser acquires such project subsequent to the date of recordation of the affordability agreement described in section 514(e)(6), (A) such purchaser must acquire such project on or before the later of (i) five years after the date of recordation of the affordability agreement and (ii) two years after the date of enactment of this title; and (B) the Secretary must have received, and determined acceptable, such purchaser’s application for modification, assignment or forgiveness prior to such purchaser’s acquisition of the project</quote>.</text></section>
<section id="HDEEDC7B9114747B789BB45E9D4C9E2D8"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 512 of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H1873749F746D43B8AC49A813B56957D5"><enum>(20)</enum><header>Disaster-damaged eligible project</header><text>The term <quote>disaster-damaged eligible project</quote> means an eligible multifamily housing project—</text>
<subparagraph id="H356015E0C91B408E89D36660388591CF"><enum>(A)</enum><text>that is located in a county that was declared a major disaster area on or after January 1, 2005, by the President pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq);</text></subparagraph>
<subparagraph id="H6925E7CB97BD4271BCD2F22C6876FFA"><enum>(B)</enum><text>whose owner carried casualty and liability insurance covering such project in amounts required by the Secretary;</text></subparagraph>
<subparagraph id="HD089649F85154781BA45C5CD48DE981D"><enum>(C)</enum><text>that suffered damages not covered by such insurance that the Secretary determines are likely to exceed $5,000 per unit in connection with the natural disaster that was the subject of such designation; and</text></subparagraph>
<subparagraph id="HD15A5F6D0F4249F9B152C2E29200AF46"><enum>(D)</enum><text>whose owner requests restructuring within two years following the date that such damages were incurred.</text></subparagraph><continuation-text continuation-text-level="paragraph">Disaster-damaged eligible projects shall be eligible without regard to the relationship between rent level for the assisted units and comparable market rents.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H7216D6CAC88543489972704ECB157554"><enum>6.</enum><header>Disaster-damaged eligible projects</header>
<subsection id="H345D54AA671E4C22BA361730AC58443E"><enum>(a)</enum><header>Market rent determinations</header><text display-inline="yes-display-inline">Subparagraph (B) of section 514(g)(1) of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended to read as follows:</text>
<quoted-block style="OLC" id="H5E78AD2FCA75457DAB78867257B2496C" display-inline="no-display-inline">
<subparagraph id="HB073403B3CA64FFEAFEFB0E431DC2A0"><enum>(B)</enum><text>if those rents cannot be determined—</text>
<clause id="H4312556D822947CCB5B0E4FD25D78100"><enum>(i)</enum><text>with respect to a disaster-damaged eligible project, are equal to 100 percent of the fair market rents for the relevant market area (in effect at the time of such disaster); and</text></clause>
<clause id="H31BFA049685D49E882E5062DD8AE6700"><enum>(ii)</enum><text>with respect to other eligible multifamily housing projects, are equal to 90 percent of the fair market rents for the relevant market area.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HBF8C40A47D21484BB5B62B85312B8BDA"><enum>(b)</enum><header>Owner Investment</header><text display-inline="yes-display-inline">Section 517(c) of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H4BCCAD1102664E2AA4CF3419F5AF1CB4"><enum>(3)</enum><header>Properties damaged by natural disasters</header><text>With respect to a disaster-damaged eligible project, the owner contribution toward rehabilitation needs shall be determined in accordance with paragraph (2)(C).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
