		  provide coverage for lung cancer screening tests for certain high-risk

		<section id="H7D7DEAA097DA438BBE2DB9557C007141" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Medicare
			 Lung Cancer Screening Benefit Act of 2006</quote>.</text>
		</section><section id="H92399F2AAFDB44FF941852C38B83DBD1"><enum>2.</enum><header>Medicare coverage
			 of lung cancer screening tests for high-risk individuals</header>
			<subsection id="H9C0104DDE87B4A30AF1B29109F904698"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1861(s)(2) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text>
				<paragraph id="H49878018FA4B4A03B9F3E6F28CB75C29"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (Z);</text>
				</paragraph><paragraph id="H75630B753E3A4BBF8D60142B442B8122"><enum>(2)</enum><text>by adding
			 <quote>and</quote> at the end of subparagraph (AA); and</text>
				</paragraph><paragraph id="H26259A3C25B04C4989DBDF06823C30BF"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H913A36C733B243A690A552839CCEF298" style="OLC">
						<subparagraph id="H5D8E7DBCC2624115B5E660F44E41AFDA" indent="up1"><enum>(BB)</enum><text display-inline="yes-display-inline">lung cancer screening tests (as defined in
				subsection
				(ccc)).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8F3554D92A244E428E81ADFEBBEE717"><enum>(b)</enum><header>Services
			 described</header><text>Section 1861 of such Act is further amended by adding
			 at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HAAF1EA0387F24008B136AB86F9495F1C" other-style="archaic" style="other">
					<subsection id="H3DE4D374450D4BA0AD4CD9CDB2A2974D"><enum>(ccc)</enum><header>Lung Cancer
				Screening Tests</header><paragraph commented="no" display-inline="yes-display-inline" id="H7BCFE52C6C7442EB957CAA00B853CF00"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>lung cancer screening
				tests</term> means testing furnished to an individual at risk for lung cancer
				(as defined in paragraph (2)) for the purpose of early detection of lung
				cancer, including—</text>
							<subparagraph id="H3714A252B0324C1E8C0061DB8CCE39BF" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">a
				low dose computerized axial tomography scan;</text>
							</subparagraph><subparagraph id="HD56BFE0C1064408EA37E203429FE3065" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">sputum analysis;</text>
							</subparagraph><subparagraph id="H7387F8E812334E8081FAFA0047AF0A7" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">fluorescent bronchoscopy; and</text>
							</subparagraph><subparagraph id="H824A877A1CDA4AB783C971E738F28610" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">such other tests, and modifications to
				tests, as the Secretary determines appropriate, in consultation with
				appropriate organizations.</text>
							</subparagraph></paragraph><paragraph id="HB275803A5CC7446183919B0090F1BA00" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1), the term
				<quote>individual at risk for lung cancer</quote> means an individual who has
				any of the following risk factors for lung cancer:</text>
							<subparagraph id="H04BDBD26C9734CD0A2F87588DF3BCB5B"><enum>(A)</enum><text display-inline="yes-display-inline">A
				family history of lung cancer.</text>
							</subparagraph><subparagraph id="HD3480045F947428FBF95BE324D61F950"><enum>(B)</enum><text display-inline="yes-display-inline">A
				significant smoking history.</text>
							</subparagraph><subparagraph id="H418663C7BF664D179379A2CC09C82B3C"><enum>(C)</enum><text display-inline="yes-display-inline">Exposure to toxic agents being monitored by
				the National Academy of Sciences under the Agent Orange Act of 1991 (Public Law
				102–4), under the Persian Gulf War Veterans Act of 1998 (title XVI of division
				C of <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>), or under the Veterans Program Enhancement Act of 1998
				(<external-xref legal-doc="public-law" parsable-cite="pl/105/368">Public Law 105–368</external-xref>).</text>
							</subparagraph><subparagraph id="H951CB4FDBAC94AF4BC5B8477BFD9823B"><enum>(D)</enum><text display-inline="yes-display-inline">Significant exposure to radon, asbestos,
				beryllium, uranium, second hand smoke, or other known carcinogens.</text>
							</subparagraph><subparagraph id="H7B4856FC24084FADBC8389ABEA1576A4"><enum>(E)</enum><text display-inline="yes-display-inline">Previous lung disease.</text>
							</subparagraph></paragraph><paragraph id="H530F6E8E37324F89B500E9C4D6C1CCF" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall establish standards, in
				consultation with appropriate organizations, regarding the frequency of
				coverage of lung cancer screening tests under this
				title.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF61FE11FA7D74F8A84E327550318C00"><enum>(c)</enum><header>Frequency</header><text display-inline="yes-display-inline">Section 1862(a)(1) of such Act (42 U.S.C.
			 1395y(a)(1)) is amended—</text>
				<paragraph id="H522DBA9A60444327861FBA701230B343"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (M);</text>
				</paragraph><paragraph id="H9F400B68C2ED42DE995E00352C34A560"><enum>(2)</enum><text>by striking the
			 semicolon at the end of subparagraph (N) and inserting <quote>, and</quote>;
			 and</text>
				</paragraph><paragraph id="H8D23156FA25E4BA5B57E29737E9C429E"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H53EAF7F6C716408FAEA38F36417634F3" style="OLC">
						<subparagraph id="H60B462109C3D434DA228E3E52E646283" indent="up1"><enum>(O)</enum><text>in the case of lung cancer screening
				tests (as defined in section 1861(ccc)(1)), which are performed more frequently
				than is covered under section
				1861(ccc)(3);</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HAFFE390C5D684CF19870FFA13EA888E7"><enum>(d)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to tests furnished on or after January 1, 2007.</text>
