		<section id="H05B48BDDBA4E486AA1F466226E65006F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans Identity Security Act of
			 2006</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HFFA8788EF9CE4A8C80FB6E3FFDE42EC2" section-type="subsequent-section"><enum>2.</enum><header>Criminal penalties for
			 unauthorized disclosure of records about veterans</header>
			<subsection display-inline="no-display-inline" id="H03047B47F9EE42F09E12CADB8077D1C8"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/57">Chapter 57</external-xref> of title 38, United States Code, is amended by
			 inserting after section 5705 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HDAC624A3280F4AAEA2618265018E86E" style="USC">
					<section id="H83783F7A0823450FAD7270F480941563"><enum>5706.</enum><header>Unauthorized
				disclosure of records containing personal information about veterans</header>
						<subsection id="H011C233D43AE4F1BA900A3ABA5A594BA"><enum>(a)</enum><header>Offense</header><paragraph commented="no" display-inline="yes-display-inline" id="H0697ACAE9231455B91F0AF9FAE2D8B48"><enum>(1)</enum><text>Any person described in
				subsection (b) who other than as authorized by section 5901 of this title or as
				otherwise authorized by law knowingly discloses, or causes the disclosure of,
				records specified in subsection (c) with intent to sell, transfer, or use
				personal information contained in the disclosed records for commercial
				advantage, personal gain, or malicious harm shall be fined as provided in title
				18, imprisoned not more than 10 years, or both.</text>
							</paragraph><paragraph id="H36E729B4D74E46438B00D3300081AB3E" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Any person described in subsection (b) who
				other than as authorized by section 5901 of this title or as otherwise
				authorized by law knowingly discloses, or causes the disclosure of, records
				specified in subsection (c) in a case not covered by paragraph (1) shall be
				fined as provided in title 18, imprisoned not more than one year, or
				both.</text>
							</paragraph></subsection><subsection id="H49B4F8795480428F9503A58BA5B35C15"><enum>(b)</enum><header>Covered
				persons</header><text>A person described in this subsection is any of the
				following:</text>
							<paragraph id="H77900566C4FF4F45B23D281E3517AE3B"><enum>(1)</enum><text>An officer or
				employee of the Department.</text>
							</paragraph><paragraph id="H58FC0EE008504BA3A4FC4F9F2D6B443"><enum>(2)</enum><text>A contractor or
				employee of a contractor of the Department.</text>
							</paragraph><paragraph id="H550A6569AA9A45458D005D68223BD9CA"><enum>(3)</enum><text>A volunteer of the
				Department.</text>
							</paragraph></subsection><subsection id="H1FE66B413305426900F5DED45691A181"><enum>(c)</enum><header>Specified
				records</header><text display-inline="yes-display-inline">Records specified in
				this subsection are records of the Department that are covered by section
				5701(a) of this title and that contain personal information about a veteran or
				any other person receiving benefits, or applying for benefits, under laws
				administered by the Secretary.</text>
						</subsection><subsection id="H8E47604067E84BE6BB7CEF96C15660A6"><enum>(d)</enum><header>Personal
				information defined</header><text>In this section, the term <term>personal
				information</term> means one or more of the following: name, date of birth,
				address, phone number, Social Security number, and (if applicable) disability
				rating.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3EC7B35040CA480A8C2D20A0FF0018CA"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 5705 the following
			 new item:</text>
