<section id="HEE6C0920B63247F289D3676EE9573F09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Section 8 Voucher Reform Act of 2006</short-title></quote>.</text></section> 
<section id="H96D72462E9C94C510000002ED8F857F" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Inspection of dwelling units</header><text display-inline="no-display-inline">Section 8(o)(8) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(8)</external-xref>) is amended—</text> 
<paragraph id="H9A005310EB4C4B73001EC661EC1BCE70"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>subparagraph (D) of this paragraph and</quote> before <quote>paragraph (11)</quote>; </text></paragraph> 
<paragraph id="H800C824262E44176B25206003B04DC01"><enum>(2)</enum><text>by redesignating subparagraphs (D) and (E) as subparagraphs (E) and (F), respectively;</text></paragraph> 
<paragraph id="HC267C83FA59B4316A445853E53413D43"><enum>(3)</enum><text>by inserting after subparagraph (C) the following new subparagraph:</text> 
<quoted-block style="OLC" id="HD08D029E525245B3BFA3551DCD1D9B7E" display-inline="no-display-inline"> 
<subparagraph id="H9BB16D9CECD34187A02C8251DC0494FC"><enum>(D)</enum><header>Exceptions to initial inspection requirement prior to occupancy</header> 
<clause id="H549C61DDA81840A9A1C9AA51223274"><enum>(i)</enum><header>Recent inspection under housing choice voucher program</header><text>In the case of any dwelling unit that, within the 30-day period ending upon initial occupancy by a family assisted under this subsection, was occupied by another family so assisted, an inspection pursuant to subparagraph (A) shall not be required if such unit was inspected during the 12-month period ending upon such initial occupancy and was determined to comply with the housing quality standards under subparagraph (B).</text></clause> 
<clause id="HA988FA88B0B842FF8C206F8D81756633"><enum>(ii)</enum><header>Recent inspection under other programs</header><text display-inline="yes-display-inline">In the case of any dwelling unit that, during the 12-month period ending upon such initial occupancy, was inspected pursuant to requirements under a Federal, State, or local housing assistance program (including the HOME investment partnerships program under title II of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12721">42 U.S.C. 12721 et seq.</external-xref>)), an inspection pursuant to subparagraph (A) shall not be required if—</text> 
<subclause id="H8BA8D509A38D4A77A91B90E2E9C8AE7B"><enum>(I)</enum><text display-inline="yes-display-inline">pursuant to such inspection, the dwelling unit was determined to meet the standards or requirements regarding housing quality or safety applicable to units assisted under such program; and</text></subclause> 
<subclause id="HD17CD0DED6FA4611837B99AE387FB1E5"><enum>(II)</enum><text>the public housing agency certifies to the Secretary that such standards or requirements provide the same protection to occupants of dwelling units meeting such standards or requirements as, or greater protection than, the housing quality standards under subparagraph (B).</text></subclause></clause> 
<clause id="H68B97987CC5A440AB4607411463654BC"><enum>(iii)</enum><header>Correction of non-life threatening conditions</header><text display-inline="yes-display-inline">In the case of any dwelling unit that is determined, pursuant to an inspection under subparagraph (A), not to meet the housing quality standards under subparagraph (B), assistance payments may be made for the unit notwithstanding subparagraph (C) if failure to meet such standards is a result only of non-life threatening conditions. A public housing agency making assistance payments pursuant to this clause for a dwelling unit shall, upon the expiration of the 30-day period beginning upon commencement of the period for which such payments are made, suspend any assistance payments for the unit if any deficiency resulting in noncompliance with the housing quality standards has not been corrected by such time, and may not resume such payments until each such deficiency has been corrected.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF671C1578AD2406C9715126C2600F0C4"><enum>(4)</enum><text>in subparagraph (E), as so redesignated by paragraph (2) of this section—</text> 
<subparagraph id="HB65B764E8C2F4C16AAE8EEE014B3DF36"><enum>(A)</enum><text>by striking <quote><header-in-text level="subparagraph" style="OLC">Annual inspections</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">Biennial inspections</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="H486B973A48424120BBC43CC13B9F7DBC"><enum>(B)</enum><text>by striking <quote>shall make an annual inspection of each assisted dwelling unit during the term of the housing assistance payments contract for the unit</quote> and inserting <quote>shall, for each assisted dwelling unit, make biennial inspections during the term of the housing assistance payments contract for the unit</quote>; and</text></subparagraph> 
<subparagraph id="H850E1E43B7904192A116EF1B7855EE80"><enum>(C)</enum><text>by inserting after the period at the end of the first sentence the following: <quote>In the case of a dwelling unit described in clause (i) or (ii) of subparagraph (D), the first such annual inspection shall take place during the 2-year period beginning upon the most recent inspection conducted with respect to the occupancy of the unit by the family previously residing in the unit.</quote>.</text></subparagraph></paragraph></section> 
<section id="H3896885FA40E43608BB0A2F3D0F532BE" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Rent reform and income reviews</header> 
<subsection id="H9791A0252250478895788E31178BCD67"><enum>(a)</enum><header>Rent for public housing and section 8 programs</header><text display-inline="yes-display-inline">Section 3 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(a)</external-xref>) is amended—</text> 
<paragraph id="HADD6E7EFBE92478F96290095AFFC7E41"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H9D5DD6638F1E4FDAB223ADC2DFF45BF4"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="H7A11784F9894433A9B7266D4D1A3848F"><enum>(i)</enum><text>by inserting <quote><header-in-text level="paragraph" style="OLC">Low-income occupancy requirement and rental payments</header-in-text>.—</quote> after <quote>(1)</quote>; </text></clause> 
<clause id="HC23FD4D6AF474F08A321A7B6E6EA4019"><enum>(ii)</enum><text>by striking the second sentence;</text></clause> 
<clause id="H0ACA7BA1EE9E42BDAF2CF0178700208F"><enum>(iii)</enum><text>in subparagraph (A), by inserting <quote>or</quote> after the semicolon </text></clause> 
<clause id="H1209EAB890D547859D04AB8554700105"><enum>(iv)</enum><text>by striking subparagraph (B); and</text></clause> 
<clause id="HA4730F19C2604503BC19313C32CE6620"><enum>(v)</enum><text>by redesignating subparagraph (C) as subparagraph (B); and</text></clause></subparagraph> 
<subparagraph id="H44CA3CE59DA545F0853C4DCD9BBF00C7"><enum>(B)</enum><text>by adding at the end the following new paragraphs:</text> 
<quoted-block style="OLC" id="H8666B59793AE4FBCABE47825F7C8855E" display-inline="no-display-inline"> 
<paragraph id="H255F44D5EFD94A9FBFD7EA6D1651DB1C"><enum>(6)</enum><header>Reviews of family income</header> 
<subparagraph id="H67D21136FBFA41858900DCB600A6A15"><enum>(A)</enum><header>Frequency</header><text>Reviews of family income for purposes of this section shall be made—</text> 
<clause id="HD50A87D3372546508428604B749F00E0"><enum>(i)</enum><text>in the case of all families, upon the initial provision of housing assistance for the family;</text></clause> 
<clause id="HB0FF7BD5C97F41B5ACF0F1C86FB853BA"><enum>(ii)</enum><text display-inline="yes-display-inline">annually thereafter, except as provided in subparagraph (B)(i);</text></clause> 
<clause id="H9D773C3D627A4571A97111B000A589EF"><enum>(iii)</enum><text>upon the request of the family, at any time the annual income of the family decreases by $1,500 or more; and</text></clause> 
<clause id="H23284701B9E442C3BCFBC39DE8800E7"><enum>(iv)</enum><text>at any time the annual income of the family increases by $1,500 or more, except that any increase in the earned income of a family shall not be considered for purposes of this clause.</text></clause></subparagraph> 
<subparagraph id="H1B9CE200825D439DBDDF4432982C71AC" display-inline="no-display-inline"><enum>(B)</enum><header>Fixed-income families</header> 
<clause id="H33B3FB9B544F4A689B400020E2FA005D"><enum>(i)</enum><header>Self certification and 3-year review</header><text display-inline="yes-display-inline">In the case of any family described in clause (ii), after the initial review of the family’s income pursuant to subparagraph (A)(i), the public housing agency shall not be required to conduct a review of the family’s income pursuant to subparagraph (A)(ii) for any year for which such family certifies, in accordance with such requirements as the Secretary shall establish, that the income of the family meets the requirements of clause (ii) of this subparagraph, except that the public housing agency shall conduct a review of each such family’s income not less than once every 3 years.</text></clause> 
<clause id="H2571E9EE1F764C3BB65D17AF34CE15AD"><enum>(ii)</enum><header>Eligible families</header><text>A family described in this clause is a family who has an income, as of the most recent review pursuant to subparagraph (A) or clause (i) of this subparagraph, of which 90 percent or more consists of fixed income, as such term is defined in clause (ii).</text></clause> 
<clause id="H9E2E38EFE7D54A07970077DA3FBF5531"><enum>(iii)</enum><header>Fixed income</header><text>For purposes of this subparagraph, the term <quote>fixed income</quote> includes income from—</text> 
<subclause id="H71F946AD56B648CB00B13E1311B4853F"><enum>(I)</enum><text>the supplemental security income program under title XVI of the Social Security Act, including supplementary payments pursuant to an agreement for Federal administration under section 1616(a) of the Social Security Act and payments pursuant to an agreement entered into under section 212(b) of <external-xref legal-doc="public-law" parsable-cite="pl/93/66">Public Law 93–66</external-xref>;</text></subclause> 
<subclause id="H0F173A67DCC14F45BADD023C0028EBD1"><enum>(II)</enum><text>Social Security payments;</text></subclause> 
<subclause id="HF101E863FD644FEBA5A5A71E07A24763"><enum>(III)</enum><text>Federal, State, local and private pension plans; and</text></subclause> 
<subclause id="H193185E685CD49D29F31FB80477562C4"><enum>(IV)</enum><text>other periodic payments received from annuities, insurance policies, retirement funds, disability or death benefits, and other similar types of periodic receipts. </text></subclause></clause> </subparagraph> 
<subparagraph id="HC230C0E0B20A400AA9BB1EB63448CBA3"><enum>(C)</enum><header> In general</header><text display-inline="yes-display-inline">Reviews of family income for purposes of this section shall be subject to the provisions of section 904 of the Stewart B. McKinney Homeless Assistance Amendments Act of 1988.</text></subparagraph></paragraph> 
<paragraph id="H0704EED20E534F11889200002EF0E6F8"><enum>(7)</enum><header>Calculation of income</header> 
<subparagraph id="H8CEB380F5E6641579D24800054D44F8E"><enum>(A)</enum><header>Use of prior year’s income</header><text display-inline="yes-display-inline">Except as otherwise provided in this paragraph, in determining the income of a family for a year, a public housing agency may use the income of the family as determined by the agency for the prior year, taking into consideration any redetermination of income during such prior year pursuant to clause (iii) or (iv) of paragraph (6)(A).</text></subparagraph> 
<subparagraph id="H500DF973A5CE4A63A0BD94BE6C90D6B0"><enum>(B)</enum><header>Earned income</header><text display-inline="yes-display-inline">For purposes of this section, the earned income of a family for a year shall be the amount of earned income of the family in the prior year minus an amount equal to 10 percent of such prior year’s earned income, except that the income of a family for purposes of section 16 (relating to eligibility for assisted housing and income mix) shall be determined without regard to any reduction under this subparagraph.</text></subparagraph> 
<subparagraph id="HFA3288601CEA4F9C8416C98719D74DB1" display-inline="no-display-inline"><enum>(C)</enum><header>Inflationary adjustment for fixed income families</header><text display-inline="yes-display-inline">If, for any year, a public housing agency determines the income for any family described in paragraph (6)(ii), or the amount of fixed income of any other family, based on the prior year’s income or fixed income, respectively, pursuant to subparagraph (A), such prior year’s income or fixed income, respectively, shall be adjusted by applying an inflationary factor as the Secretary shall, by regulation, establish.</text></subparagraph> 
<subparagraph id="H478434A9564A49368BAF37C808490033"><enum>(D)</enum><header>Other income</header><text display-inline="yes-display-inline">If, for any year, a public housing agency determines the income for any family based on the prior year’s income, with respect to prior year calculations of types of income not subject to subparagraph (B), a public housing agency may make other adjustments as it considers appropriate to reflect current income.</text></subparagraph> 
<subparagraph id="HCAEA8BE0075545ACB96CC254BC18BE0"><enum>(E)</enum><header>Safe harbor</header><text>A public housing agency may, to the extent such information is available to the public housing agency, determine the family’s income for purposes of this section based on timely income determinations made for purposes of other means-tested Federal public assistance programs (including the program for block grants to States for temporary assistance for needy families under part A of title IV of the Social Security Act, a program for medicaid assistance under a State plan approved under title XIX of the Social Security Act, and the food stamp program as defined in section 3(h) of the Food Stamp Act of 1977).</text></subparagraph> 
<subparagraph id="H560411ABB76C4FC18F00DE590044BB55"><enum>(F)</enum><header>PHA compliance</header><text display-inline="yes-display-inline">A public housing agency may not be considered to fail to comply with this paragraph or paragraph (6) due solely to any de minimus errors made by the agency in calculating family incomes.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H3951B0D3226242E384CA7F2071E45B98"><enum>(2)</enum><text>by striking subsections (d) and (e); and</text></paragraph> 
<paragraph id="H4183DF179A6742059B53B3E684E803FD"><enum>(3)</enum><text>by redesignating subsection (f) as subsection (d).</text></paragraph></subsection> 
<subsection id="HC256213F99FF421E9C78DEDD2D463040"><enum>(b)</enum><header>Income</header><text display-inline="yes-display-inline">Section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>) is amended—</text> 
<paragraph id="H8C45E683D743422AA3E7D42FA4DC08B"><enum>(1)</enum><text>by striking paragraph (4) and inserting the following new paragraph:</text> 
<quoted-block style="OLC" id="H05F1BF3887BC4D29849FB7D525285E5E" display-inline="no-display-inline"> 
<paragraph id="HBE821D8FA4144814A6D57717E809A4F1"><enum>(4)</enum><header>Income</header><text display-inline="yes-display-inline">The term <quote>income</quote> means, with respect to a family, income received from all sources by each member of the household who is 18 years of age or older, as determined in accordance with criteria prescribed by the Secretary, in consultation with the Secretary of Agriculture, subject to the following requirements:</text> 
<subparagraph id="HEF287E7BE3B247F3A9C7A663EE4CD0B0"><enum>(A)</enum><header>Included amounts</header><text>Such term includes recurring gifts and receipts, actual income from assets, and profit or loss from a business.</text></subparagraph> 
<subparagraph id="H9F9BBC01604D488483A0ABD1CBBADEF1"><enum>(B)</enum><header>Excluded amounts</header><text>Such term does not include any imputed return on assets.</text></subparagraph> 
<subparagraph id="H3472D4F6750C4A01AB5B0008EEF06FB0"><enum>(C)</enum><header>Earned income of students</header><text>Such term does not include earned income of any dependent earned during any period that such dependent is attending school on a full-time basis.</text></subparagraph> 
<subparagraph id="HB6FAC33C796C4DACBE00CE3FD82FBD53"><enum>(D)</enum><header>Other exclusions</header><text display-inline="yes-display-inline">Such term shall not include other exclusions from income as are established by the Secretary or any amount required by Federal law to be excluded from consideration as income. The Secretary may not require a public housing agency to maintain records of any amounts excluded from income pursuant to this subparagraph.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HEE23E5A2FBAA4CEA8615EFDF959ED064"><enum>(2)</enum><text>in paragraph (5)—</text> 
<subparagraph id="HCBAE91BEDFC24D25A1EE85482FEF1530"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>income exclusions</quote> and inserting <quote>deductions from income</quote>; and</text></subparagraph> 
<subparagraph id="H7954AE35A40745D1B17837BD1B9CA01B"><enum>(B)</enum><text>by striking subparagraphs (A) and (B) and inserting the following:</text> 
<quoted-block style="OLC" id="HD9187F6F610C42D3BFCD207D55943D50" display-inline="no-display-inline"> 
<subparagraph id="H01243F25FBA942FBA200009D39071990"><enum>(A)</enum><header>Elderly and disabled families</header><text display-inline="yes-display-inline">$750 in the case of any family that is an elderly family or a disabled family.</text></subparagraph> 
<subparagraph id="H39FDF0C514C3499DBE00EB6052D524DB"><enum>(B)</enum><header>Dependents</header><text display-inline="yes-display-inline">In the case of any family that includes a member or members who are dependents (as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/26/152">section 152</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/152">26 U.S.C. 152</external-xref>)) and resides in the household, $500 for each such member.</text></subparagraph> 
<subparagraph id="HEBDF685DE56B42568650559FCE00D95C"><enum>(C)</enum><header>Health and medical expenses</header><text display-inline="yes-display-inline">In the case of any elderly or disabled family, the amount, if any, by which the sum of any unreimbursed medical and health care expenses and reasonable attendant care and auxiliary apparatus expenses for any person with disabilities exceeds 10 percent of the family’s income.</text></subparagraph> 
<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">The Secretary shall annually adjust the amounts of the exclusions under subparagraphs (A) and (B), as such amounts may have been previously adjusted, by applying an inflationary factor as the Secretary shall, by regulation, establish. If the dollar amount of any such exclusion determined for any year by applying such inflationary factor is not a multiple of $25, the Secretary shall round such amount to the next lowest multiple of $25.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="HE9D361A3FBAF406DAC73857F931BE518" display-inline="no-display-inline"><enum>(c)</enum><header>Housing choice voucher program</header><text>Section 8(o)(2) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(2)</external-xref>) is amended—</text> 
<paragraph id="HB10925A36EFC43339532CC8EAD755DE5"><enum>(1)</enum><text>in subparagraph (A)—</text> 
<subparagraph id="H3DC7F79BFC8E40D881B132AC9B729795"><enum>(A)</enum><text>by striking clause (ii); and</text></subparagraph> 
<subparagraph id="H040E05E32A6B4007A0D8E5B6F58D41D1"><enum>(B)</enum><text>by redesignating clause (iii) as clause (ii); and</text></subparagraph></paragraph> 
<paragraph id="HD6D2F2E7EBB94684B13E62C471AE8B37"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>, (ii), and (iii)</quote> and inserting <quote>and (ii)</quote>.</text></paragraph> </subsection> 
<subsection id="H1682B031853040D598F7073B6DE44656"><enum>(d)</enum><header>Enhanced voucher program</header><text>Section 8(t)(1)(D) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(t)(1)(D)</external-xref>) is amended by striking <quote>income</quote> and inserting <quote>annual adjusted income</quote>.</text></subsection> 
<subsection id="H908AE60E2D214C24A3CD43AE2C20195D" display-inline="no-display-inline"><enum>(e)</enum><header>Homeownership program</header><text>Section 8(y)(2) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(y)(2)</external-xref>) is amended—</text> 
<paragraph id="H545C65A92D51429E982C4E4FE5DF13B"><enum>(1)</enum><text>in subparagraph (A)—</text> 
<subparagraph id="HD3C0E9646C5C43B082D2DA6B3008F12E"><enum>(A)</enum><text>by striking clause (ii); and</text></subparagraph> 
<subparagraph id="H4C7F080DADAF484FAABD6807A3CC545"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating clause (iii) as clause (ii); and</text></subparagraph></paragraph> 
<paragraph id="H75BC1B5393B34896899DEB81C789362"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>, (ii), and (iii)</quote> and inserting <quote>and (ii)</quote>.</text></paragraph></subsection> 
<subsection id="HEDA3DF8FAACC42FD833BAB6FEC5D8651"><enum>(f)</enum><header>Effective date and transition</header><text>The amendments made by this section shall apply with respect to fiscal year 2008 and fiscal years thereafter.</text></subsection> </section> 
<section id="HA20385C2AFDD4514ACD76B48F556BF0"><enum>4.</enum><header>Targeting vouchers to low-income working families</header><text display-inline="no-display-inline">Section 16(b)(1) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437n">42 U.S.C. 1437n(b)(1)</external-xref>) is amended by inserting after <quote>do not exceed</quote> the following: <quote>the higher of (A) the poverty line (as such term is defined in section 673 of the Omnibus Budget Reconciliation Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>), including any revision required by such section) applicable to a family of the size involved, or (B)</quote>.</text></section> 
<section id="H3467B9463C0842AC83C97FAE7F90D813" display-inline="no-display-inline"><enum>5.</enum><header>Moving to work program</header> 
<subsection id="HCA28FD3CB686490581C1BA8F78CF77B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H28E4ACA9E651489EB2B0914760F09C08"><enum>36.</enum><header>Moving to work program</header> 
<subsection id="HF4AA38202ED847D99D1568CDEDCFC964"><enum>(a)</enum><header>Purposes</header><text>The purposes of the program established under this section are—</text> 
<paragraph id="HEC5DACD4C4784140BA619461CF171718"><enum>(1)</enum><text>to give incentives to families to become self-sufficient;</text></paragraph> 
<paragraph id="HF03386AAE49D457588A7D719B2C40010"><enum>(2)</enum><text>to give public housing agencies and the Secretary flexibility to develop approaches for providing and administering housing assistance that achieve greater cost-effectiveness in Federal expenditures;</text></paragraph> 
<paragraph id="H130F44340088458E9207EF679DFAF600"><enum>(3)</enum><text>to increase housing opportunities for low-income families;</text></paragraph> 
<paragraph id="H5362352A5EBB49F38CE305F48613DEED"><enum>(4)</enum><text>to reduce administrative burdens on public housing agencies in providing housing assistance; and</text></paragraph> 
<paragraph id="H6A32A01EAE74465DAEC2F0C7D720BA52"><enum>(5)</enum><text>to allow Federal resources to be more effectively utilized at the local level.</text></paragraph></subsection> 
<subsection id="H1CA1F0C1F72C44BF00C987B287A39FB9"><enum>(b)</enum><header>Program authority</header> 
<paragraph id="HDD258379769B4644B79F6E8597C283C9"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out a Moving to Work Program (in this section referred to as the <quote>program</quote>), in which public housing agencies selected under subsection (c) may participate.</text></paragraph> 
<paragraph id="HBB043191555D4B4BB8B1173B56A15623"><enum>(2)</enum><header>Use of assistance</header><text>Under the program, a public housing agency—</text> 
<subparagraph id="H3A56B83B0A3D49A5912625E4B0DDF1FB"><enum>(A)</enum><text>may combine operating assistance provided under section 9(e), modernization assistance provided under section 9(d), and assistance provided under section 8 for voucher program, to provide housing assistance for low-income families, and services to facilitate the transition to work; and</text></subparagraph> 
<subparagraph id="HA46380A370CF43AE8C84D9C424436B95"><enum>(B)</enum><text>shall continue to assist substantially the same total number of eligible low-income families as would have been served had the amounts not be combined.</text></subparagraph></paragraph> 
<paragraph id="HE737F26CB3BB4AE2BC8EE0F135BF544D"><enum>(3)</enum><header>Authority of Secretary</header> 
<subparagraph id="HF140BDB78F9F4DF6B689FBAF96006335"><enum>(A)</enum><header>Waiver</header><text>Notwithstanding any other provision of law, except as provided in subsection (f), the Secretary may waive any provision of this Act with respect to assistance under the program.</text></subparagraph> 
<subparagraph id="HA540A6557DAC485B8851B631667D64A3"><enum>(B)</enum><header>Additional powers</header><text>The Secretary may, as the Secretary determines appropriate to further the purposes of this section—</text> 
<clause id="HCB81DC8543314BD7AA76159D7E49779B"><enum>(i)</enum><text>provide streamlined procedures including procurement procedures; and</text></clause> 
<clause id="H4F1A3917684045AA98BA603F84054E07"><enum>(ii)</enum><text>subject to paragraph (2), provide for immediate implementation of such procedures.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HCEC404E19407455BA8AB1E1EACE27787"><enum>(c)</enum><header>Selection</header> 
<paragraph id="H04BAE004E7304F03B184A7CCB6565B18"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall select public housing agencies to participate in the program. The Secretary shall provide for agencies to submit applications, in such form as prescribed by the Secretary, for selection for participation in the program.</text></paragraph> 
<paragraph id="H09C7D427D68242CCBE58E44809BE30C0"><enum>(2)</enum><header>Selection criteria</header><text display-inline="yes-display-inline">In selecting among applications by public housing agencies to participate in the program, the Secretary shall take into consideration the extent to which such public housing agency meets such criteria as the Secretary shall establish, including—</text> 
<subparagraph id="H8CA244E52F824A92A39D63ECA2BA00C5"><enum>(A)</enum><text>a demonstrated capacity by the public housing agency to develop and manage a successful program;</text></subparagraph> 
<subparagraph id="H2BEF57142E764DE995F58CB04E0C9DB"><enum>(B)</enum><text>demonstrated compliance by the agency with statutes and regulations applicable to Department of Housing and Urban Development programs in which the public housing agency participates or has participated;</text></subparagraph> 
<subparagraph id="HDEB0BCA931FB426FA4109B54FCFE002E"><enum>(C)</enum><text>commitment by the agency of non-Federal resources, including resources from the local community; and</text></subparagraph> 
<subparagraph id="HBD64E3F7341E4BE6ADE3BD4B8C94C8C"><enum>(D)</enum><text>demonstrated commitment, by units of local government serving the areas within which the public housing agency administers its program, on removing regulatory barriers to affordable housing.</text></subparagraph></paragraph> 
<paragraph id="HD7461C0F53924E4AAB5B10AA8D853DBD"><enum>(3)</enum><header>Limitation on total number of agencies participating</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the aggregate number of public housing agencies participating, at any single time, in the program under this section or in the moving to work demonstration program under section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) (in this subsection referred to as the <quote>demonstration program</quote>) may not exceed 40.</text></paragraph> 
<paragraph id="H1BFAC6701FB54E1AB014BBDFA732AA87"><enum>(4)</enum><header>Term of participation</header> 
<subparagraph id="HC7B34005ADE94A8B9DAEABCC5F4F3749"><enum>(A)</enum><header>3-year term</header><text>A public housing agency may participate in the program for a period of 3 years pursuant to selection by the Secretary.</text></subparagraph> 
<subparagraph id="HF7D479DF7B31443FADA45C3590B5BA1F"><enum>(B)</enum><header>Reapplication for continued participation</header><text display-inline="yes-display-inline"> Upon the expiration (pursuant to initial selection or reapplication under this subparagraph) of the period of participation of an agency in the program, the agency may reapply for selection for participation in the program and the Secretary shall select such agency for an additional 3-year period unless such agency fails to comply with the performance standards established by the Secretary pursuant to subsection (h)(3).</text></subparagraph></paragraph> 
<paragraph id="H6AB29E87A00F4B92B1CA1602638D87C6"><enum>(5)</enum><header>Effect on agencies currently participating in demonstration program</header><text>Subject to such procedures and requirements as the Secretary may establish, a public housing agency that, as on the date of the enactment of this Act, is participating in the demonstration program—</text> 
<subparagraph id="H21E9BC678E104CE0B7C282CFBB8E12BB"><enum>(A)</enum><text>may apply, in accordance with the requirements of this section, for participation in program under this section—</text> 
<clause id="H4AE964D50A5F406DB9006C712FF86BC6"><enum>(i)</enum><text>at any time before the expiration of the period of its participation in such demonstration, if the agency opts out of the demonstration program; or </text></clause> 
<clause id="HBE096E6D58F2407A8C8F5E118F283DD2"><enum>(ii)</enum><text>upon the expiration of the period of participation of such agency in the demonstration program; and</text></clause></subparagraph> 
<subparagraph id="HF6BBEAD68F6F4818A918FA54E040700"><enum>(B)</enum><text display-inline="yes-display-inline">upon such application, shall be treated, for purposes of selection for participation, as an agency reapplying under paragraph (4)(B).</text></subparagraph> </paragraph></subsection> 
<subsection id="H60887C369A38408E9B19B3AD00D9EADD"><enum>(d)</enum><header>Eligibility for selection</header><text>A public housing agency shall be eligible for selection to participate in the program only if such public housing agency—</text> 
<paragraph id="HE52055F9DA1E47F29CBC111718009260"><enum>(1)</enum><text>is designated, at the time of submission of an application for participation, as a high performer under the applicable assessment systems that evaluate the performance of a public housing agency, if any, with respect to its public housing and voucher programs; and</text></paragraph> 
<paragraph id="HCB75DE59118641938DFE3E983C85B75C"><enum>(2)</enum> 
<subparagraph id="HDEDF52D3466146B286A7AA00C11B06DA" display-inline="yes-display-inline"><enum>(A)</enum><text>manages at least 500 units of public housing pursuant to contracts for annual contributions; or</text></subparagraph> 
<subparagraph id="HB35F3C7C51CA425C8084595B2D4DF7C5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">administers at least 500 vouchers for assistance under section 8.</text></subparagraph></paragraph> </subsection> 
<subsection id="HAF4C3AAF2769417C9CBB70BF52DECF1E"><enum>(e)</enum><header>Program requirements</header><text>A public housing agency that is administering a program pursuant to this section shall, as a condition of continued participation in the program—</text> 
<paragraph id="HB839B011D0D449A0AC11A1CA04219C1D"><enum>(1)</enum><text>consult with representatives of the community that represent a broad range of the various interests that are affected by the program;</text></paragraph> 
<paragraph id="H6C475FC29A9F401B8B3E00AD43267686"><enum>(2)</enum><text>target, for purposes of the program, not fewer than 90 percent of families authorized in the program under this section to receive assistance, who have gross incomes that do not exceed 60 percent of the median income for the area, as determined by the Secretary, with adjustments for smaller or larger families;</text></paragraph> 
<paragraph id="HFB2F86CDC36F453F894176EB46002F00"><enum>(3)</enum><text>establish a reasonable rent policy which is designed to encourage employment and self-sufficiency by participating families;</text></paragraph> 
<paragraph id="H73E90A09F0A6414DB374006674772985"><enum>(4)</enum><text>provide such assurances, as the Secretary shall require, that housing assisted under the program meets housing standards established or approved by the Secretary; and</text></paragraph> 
<paragraph id="HA8011FC5C9C4471DB9D654AF019CA302"><enum>(5)</enum><text>provide such additional information as determined by the Secretary.</text></paragraph></subsection> 
<subsection id="H43495F8047FA4859955C50B99CA1B0F2"><enum>(f)</enum><header>Applicability of section 18 provisions</header><text>Section 18 shall continue to apply to public housing notwithstanding any use of the housing under the program.</text></subsection> 
<subsection id="H048F6EBA9B0645ABAD567FA4281FE211"><enum>(g)</enum><header>Effect on section 8 and operating subsidies allocations</header><text>The amount of assistance received under section 8 or section 9 by a public housing agency participating in the program shall, subject to appropriations, not be affected by its participation in the program.</text></subsection> 
<subsection id="HB0FB4607752A4B40A508F88D8729D7FD"><enum>(h)</enum><header>Evaluation of Performance</header> 
<paragraph id="H1031C84BE18942BF887800D0F5EAD208" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct detailed evaluations of all public housing agencies participating in the program under this section and all agencies participating in the moving to work demonstration referred to in subsection (c)(3)—</text> 
<subparagraph id="HD0A5912743C8434584B500A02F1D1244"><enum>(A)</enum><text>to determine the level of success of each public housing agency in achieving the purposes of the program under subsection (a); and</text></subparagraph> 
<subparagraph id="H312DB3C63FB249FFAD77EFE5D0521DE"><enum>(B)</enum><text>to identify program models that can be replicated by other agencies to achieve such success.</text></subparagraph></paragraph> 
<paragraph id="H72109B80408A4AA88519FCE3EA9C1C8C"><enum>(2)</enum><header>In general</header><text>The Secretary shall assess the performance of a public housing agency in the program under this section and in the moving to work demonstration program referred to in subsection (c)(3). Subject to paragraph (3) of this subsection, such assessment—</text> 
<subparagraph id="H586E6EF47CC34D6698E0391D820912A3"><enum>(A)</enum><text display-inline="yes-display-inline">may be conducted, only during the period ending January 1, 2008, using the applicable assessment systems that evaluate the performance of a public housing agency with respect to its public housing and voucher programs, including section 6(j); or</text></subparagraph> 
<subparagraph id="HC182B84F99014F619C43FC17667DA795"><enum>(B)</enum><text>except as provided in subparagraph (A), shall be conducted under such assessment systems as shall be designed by the Secretary to evaluate the program under this section.</text></subparagraph></paragraph> 
<paragraph id="H29A1FDC4353A4893B063383D1168AA73"><enum>(3)</enum><header>Performance standards</header> 
<subparagraph id="H9653805CD97B4DCEBE3371002D75FA09"><enum>(A)</enum><header>Issuance of rules</header><text display-inline="yes-display-inline">The Secretary shall, for the purposes of designing and implementing performance standards for public housing agencies participating in the program under this section and agencies participating in the moving to work demonstration program referred to in subsection (c)(3), issue a proposed rule and a final rule implementing performance standards under this section.</text></subparagraph> 
<subparagraph id="H056B7C5A37634DB29C284659CD7878C"><enum>(B)</enum><header>Timing</header><text>The final rule required under subparagraph (A) shall be issued not later than 24 months after the date of enactment of the <short-title>Section 8 Voucher Reform Act of 2006</short-title>.</text></subparagraph> 
<subparagraph id="H81A6E79E57F8437BB94D36399B697890"><enum>(C)</enum><header>Standards</header><text>Performance standards issued by the Secretary under subparagraph (A) may include—</text> 
<clause id="H1F4A85B2A6174200BF68C18B008CE16D"><enum>(i)</enum><text>a baseline performance level against which public housing agencies may be rated; and</text></clause> 
<clause id="HF5C289D442114B649E566762684BB5B8"><enum>(ii)</enum><text>standards for—</text> 
<subclause id="HC90A6E7A667745A3A5FB857C6BCA32F7"><enum>(I)</enum><text>moving assisted low-income families to economic self-sufficiency;</text></subclause> 
<subclause id="H42453435A9E545CD81CDAA0014DB36E7"><enum>(II)</enum><text>reducing the per-family cost of providing housing assistance;</text></subclause> 
<subclause id="HD7A8C8C287954BF38914999BD6782D47"><enum>(III)</enum><text>expanding housing choices for low-income families;</text></subclause> 
<subclause id="HF7697E7F38E44A44004E6CFF92398002"><enum>(IV)</enum><text>improving program management;</text></subclause> 
<subclause id="HDCE54B0984114A53A070AEBBE00A667"><enum>(V)</enum><text>increasing the number of homeownership opportunities and affordable rental housing opportunities, for low-income families; and</text></subclause> 
<subclause id="HDFD9B94411784CF493783D44F039144B"><enum>(VI)</enum><text>any other performance goals that the Secretary may establish.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="H900F8ED9FA95410BADBF39CBF1CA3097"><enum>(i)</enum><header>Recordkeeping, reports, and audits</header> 
<paragraph id="H899549582DC54F37B042F402241EAD3"><enum>(1)</enum><header>Recordkeeping</header><text>Each public housing agency participating in the program shall keep such records as the Secretary may prescribe as reasonably necessary to disclose the amounts and the disposition of amounts under the program, to ensure compliance with the requirements of this section, and to measure performance.</text></paragraph> 
<paragraph id="H3FACC1749DD94E7786288D36E19F11CE"><enum>(2)</enum><header>Reports</header><text>Each such agency participating in the program shall submit to the Secretary a report, or series of reports, in a form and at a time specified by the Secretary.</text></paragraph> 
<paragraph id="H34AD1723300A4CFD00E7C7C7052B100"><enum>(3)</enum><header>Access to documents by secretary</header><text>The Secretary shall have access for the purpose of audit and examination to any books, documents, papers, and records that are pertinent to assistance in connection with, and the requirements of, this section.</text></paragraph> 
<paragraph id="HCFB27E05C4FB486300DC244EB79EE76"><enum>(4)</enum><header>Access to documents by the Comptroller General</header><text display-inline="yes-display-inline">The Comptroller General of the United States, or any of the duly authorized representatives of the Comptroller General, shall have access for the purpose of audit and examination to any books, documents, papers, and records that are pertinent to assistance in connection with, and the requirements of, this section.</text></paragraph> 
<paragraph id="HEC47E6B22C8D49BF9E074FAC60D0621C"><enum>(5)</enum><header>Reports regarding evaluations</header> 
<subparagraph id="H94331684D04A4528BFE1A04FB342FF9B"><enum>(A)</enum><header>To secretary</header><text display-inline="yes-display-inline">The Secretary shall require each public housing agency participating in the program under this section and each agency participating in the moving to work demonstration program referred to in subsection (c)(3) to submit annually to the Secretary such information as the Secretary considers appropriate to permit the Secretary to evaluate (pursuant to subsection (h)) the performance and success of the agency in achieving the purposes of the demonstration.</text></subparagraph> 
<subparagraph id="H70BB9665AA9545F4AE779CE002C1DE9"><enum>(B)</enum><header>To congress</header><text display-inline="yes-display-inline">The Secretary shall submit a report to the Congress not less than annually evaluating the programs of all public housing agencies participating in the program under this section and all agencies participating in the moving to work demonstration program referred to in subsection (c)(3). Each such report shall include findings and recommendations for any appropriate legislative action.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5286BAC728DC4C11B70944A5F304ED1"><enum>(b)</enum><header>Prohibition of extension of, and selection of additional agencies for, participation in demonstration program</header><text display-inline="yes-display-inline">Section 204(d) of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended by adding after the period at the end the following: <quote>After the date of the enactment of the <short-title>Section 8 Voucher Reform Act of 2006</short-title>, the Secretary may not extend the period of participation, in effect on such date of enactment, of any public housing agency, or select any public housing agency for participation, in the demonstration under this section.</quote>.</text></subsection> 
<subsection id="HAF70102D05284E3791FEF4D05550FA00"><enum>(c)</enum><header>GAO report</header><text display-inline="yes-display-inline">Not later than 12 months after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to the Congress on the extent to which the public housing agencies participating in the Moving to Work program under section 36 of the United States Housing Act of 1937 and the agencies participating in the moving to work demonstration program under section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996, are meeting the goals and purposes of such programs, including the purposes under subsection (a) of such section 36 and the goals identified in section (h)(3)(C)(ii) of such section 36.</text></subsection></section> 
<section id="H0F2D7AF34FFD4506ADC0C5DB005972E0" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Voucher renewal funding</header> <text display-inline="no-display-inline">Section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) is amended by striking subsection (dd) and inserting the following new subsection:</text> 
<quoted-block style="OLC" id="H6EB527337C8C458D952959A6912449B0" display-inline="no-display-inline"> 
<subsection id="H9525CDC1159F4AF4BB8F7EF04D04C00"><enum>(dd)</enum><header>Tenant-based vouchers</header> 
<paragraph id="H80AB1D8046A14FB986B08D38E8A7F11C"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated, for each of fiscal years 2007 through 2011, such sums as may be necessary for tenant-based assistance under subsection (o) for the following purposes:</text> 
<subparagraph id="HC05138E0C8E94B7AB641CB485335A739"><enum>(A)</enum><text>To renew all expiring annual contributions contracts for tenant-based rental assistance.</text></subparagraph> 
<subparagraph id="H99FC0F9FE4514C08B39867278078DE53"><enum>(B)</enum><text> To provide tenant-based rental assistance for—</text> 
<clause id="HAD7A0705CF5245CDA2FC458B112F001D"><enum>(i)</enum><text>relocation and replacement of housing units that are demolished or disposed of pursuant to the Omnibus Consolidated Rescissions and Appropriations Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/134">Public Law 104–134</external-xref>);</text></clause> 
<clause id="H49749B95D4A8410D006869F677FA4251"><enum>(ii)</enum><text>conversion of section 23 projects to assistance under this section;</text></clause> 
<clause id="HCB27E1D4702A4DEDB30939DDFFAAAD8C"><enum>(iii)</enum><text>the family unification program under subsection (x) of this section;</text></clause> 
<clause id="H2A43A759D2154586AF0037896E7395C5"><enum>(iv)</enum><text>relocation of witnesses in connection with efforts to combat crime in public and assisted housing pursuant to a request from a law enforcement or prosecution agency;</text></clause> 
<clause id="H5E5C3510D20D4056BFB0DBFFE707439C"><enum>(v)</enum><text>enhanced vouchers authorized under subsection (t) of this section;</text></clause> 
<clause id="H31546383601646C6971D497293D27947"><enum>(vi)</enum><text>vouchers in connection with the HOPE VI program under section 24;</text></clause> 
<clause id="HD2C9644348074086BD4800E4DCA7915E"><enum>(vii)</enum><text>demolition or disposition of public housing units pursuant to section 18 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437p">42 U.S.C. 1437p</external-xref>);</text></clause> 
<clause id="H69DF57FA897142B49C3CCB86093B01CC"><enum>(viii)</enum><text>mandatory and voluntary conversions of public housing to vouchers, pursuant to sections 33 and 22 of the United States Housing Act of 1937, respectively (<external-xref legal-doc="usc" parsable-cite="usc/42/1437z-5">42 U.S.C. 1437z–5</external-xref>, 1437t);</text></clause> 
<clause id="H8F2DBAD4B4EF435994D5FC60C683967F"><enum>(ix)</enum><text>vouchers necessary to comply with a consent decree or court order;</text></clause> 
<clause id="H8B80B685617C43F382BED2166624C583"><enum>(x)</enum><text display-inline="yes-display-inline">vouchers transferred from another public housing agency; and</text></clause> 
<clause id="H6B9CF4DD423F488283FDE668DF541F03"><enum>(xi)</enum><text>tenant protection assistance, including replacement and relocation assistance.</text></clause></subparagraph> </paragraph> 
<paragraph id="HC13B5334EC194F95B03424031785CB16"><enum>(2)</enum><header>Allocation of renewal funding among public housing agencies</header> 
<subparagraph id="H9FCCC7CCEA98458E840098F1DEA1FBD1"><enum>(A)</enum><text>From amounts appropriated for each year pursuant to paragraph (1)(A), the Secretary shall provide renewal funding for each public housing agency—</text> 
<clause id="HC31047FA6F704025ADE0159CA05BE9B"><enum>(i)</enum><text>based on leasing and costs from the prior year, as adjusted by an annual adjustment factor to be established by the Secretary;</text></clause> 
<clause id="H536ED941419546F9A682DBD98400ADBB"><enum>(ii)</enum><text>by making any adjustments necessary to provide for the first-time renewal of vouchers funded under paragraph (1)(B); and</text></clause> 
<clause id="H19CB1DC2A018436D8CDF69DBAF422EE"><enum>(iii)</enum><text>by making such other adjustments as the Secretary considers appropriate.</text></clause></subparagraph> 
<subparagraph id="HB81105552594438E9E8D5C9231902000"><enum>(B)</enum><header>Leasing and cost data</header><text>For purposes of subparagraph (A)(i), leasing and cost data shall be calculated not less often than biennially by using the average for the calendar year that, at the time of such calculation, is the most recently completed calendar year for which the Secretary determines data is available, substantially verifiable, and complete. Such leasing data shall be adjusted to include vouchers that were set aside under a commitment to provide project-based assistance under subsection (o)(13).</text></subparagraph> 
<subparagraph id="H270386A74A5B4DCDAE8030662568003D"><enum>(C)</enum><header>Moving to work</header><text>Notwithstanding subparagraphs (A) and (B), each public housing agency participating at any time in the moving to work demonstration under section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) or in the Moving to Work program under section 36 of this Act shall be funded pursuant to its agreement under such program and shall be subject to any pro rata adjustment made under subparagraph (D).</text></subparagraph> 
<subparagraph id="H56DBBAF0B9F74E6D9676259EF026627D"><enum>(D)</enum><header>Pro rata allocation</header> 
<clause id="HEEC6CEEA5CCC4F29BE767F0075E9BAB5"><enum>(i)</enum><header>Insufficient funds</header><text>To the extent that amounts made available for a fiscal year are not sufficient to provide each public housing agency with the full allocation for the agency determined pursuant to subparagraphs (A) and (C), the Secretary shall reduce such allocation for each agency on a pro rata basis, except that renewal funding of enhanced vouchers under section 8(t) shall not be subject to such proration.</text></clause> 
<clause id="HCF06248AF0854A958900D904B432D29C"><enum>(ii)</enum><header>Excess funds</header><text>To the extent that amounts made available for a fiscal year exceed the amount necessary to provide each housing agency with the full allocation for the agency determined pursuant to subparagraphs (A) and (C), such excess amounts shall be used for the purposes specified in subparagraphs (B) and (C) of paragraph (4).</text></clause></subparagraph></paragraph> 
<paragraph id="HADB75B97734645FC9E6E0264E06DB89"><enum>(3)</enum><header>Advances</header> 
<subparagraph id="HB5F8A18BEB6F45C7912FA97200404112"><enum>(A)</enum><header>Authority</header><text>During the last 3 months of each calendar year, the Secretary shall provide amounts to any public housing agency, at the request of the agency, in an amount up to two percent of the allocation for the agency for such calendar year.</text></subparagraph> 
<subparagraph id="H215220FD3ACF46A498F6BCBCCBAAF07B"><enum>(B)</enum><header>Use</header><text>Amounts advanced under subparagraph (A) may be used to pay for additional voucher costs, including costs related to temporary overleasing.</text></subparagraph> 
<subparagraph id="H3AD50C53EE0646B1AAD3F82E49356BB4"><enum>(C)</enum><header>Repayment</header><text>Amounts advanced under subparagraph (A) in a calendar year shall be repaid to the Secretary in the subsequent calendar year by reducing the amounts made available for such agency for such subsequent calendar year pursuant to allocation under paragraph (2) by an amount equal to the amount so advanced to the agency.</text></subparagraph></paragraph> 
<paragraph id="HBDB03E6274FA48BB8322E60B5882400"><enum>(4)</enum><header>Recapture</header> 
<subparagraph id="H770DB87054C34778A1C5CBD6FABCDBB4"><enum>(A)</enum><header>In general</header><text>The Secretary shall recapture, from amounts provided under the annual contributions contract for a public housing agency for a calendar year, all amounts allocated under paragraph (2) that are unused by the agency at the end of each calendar year.</text></subparagraph> 
<subparagraph id="HB2BCFD96EBBB494FBBBAF3801F1CA27E"><enum>(B)</enum><header>Reallocation</header><text>Not later than May 1 of each calendar year, the Secretary shall—</text> 
<clause id="HDBFDE61D763E4D888905062C184E32DF"><enum>(i)</enum><text>calculate the aggregate unused amounts for the preceding year recaptured pursuant to subparagraph (A);</text></clause> 
<clause id="HCF3A260C48794793BF5C7EADAA92F22D"><enum>(ii)</enum><text>set aside and make available such amounts as the Secretary considers appropriate to reimburse public housing agencies for increased costs related to portability and family self-sufficiency activities during such year; and</text></clause> 
<clause id="HD0E023F10A10445591FD3C7DEB87CF01"><enum>(iii)</enum><text display-inline="yes-display-inline">reallocate all remaining amounts among public housing agencies that, in the preceding year, used at least 99 percent of amounts allocated under paragraph (2) for the agency and leased fewer than the number of vouchers authorized for the agency; except that the Secretary may establish priority for allocation of such amounts to public housing agencies that leased fewer vouchers in such preceding year than in the 12-month period ending April 1, 2004.</text></clause></subparagraph> 
<subparagraph id="H46F320DE05144F4EBAB75E585D7C4967"><enum>(C)</enum><header>Use</header><text display-inline="yes-display-inline">Amounts reallocated to a public housing agency pursuant to subparagraph (B)(iii) may be used only to increase voucher leasing rates to the level authorized for the agency.</text></subparagraph></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HA47F605AD0E449E09C57EA63002296A6"><enum>7.</enum><header>Section 8 homeownership downpayment program</header><text display-inline="no-display-inline">Section 8(y)(7) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(y)(7)</external-xref>) is amended by striking subparagraph (A) and inserting the following new subparagraph: </text>

<subparagraph id="H12295B81CA404413BC9D007605001EB1"><enum>(A)</enum><header>Authority</header><text display-inline="yes-display-inline">A public housing agency may, in lieu of providing monthly assistance payments under this subsection on behalf of a family eligible for such assistance and at the discretion of the public housing agency, provide assistance for the family in the form of a single grant to be used only as a contribution toward the downpayment required in connection with the purchase of a dwelling.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
