		<official-title>To amend the Clayton Act with respect to competitive and
		  nondiscriminatory access to the Internet.</official-title>

		<section id="H5E4BD2EE51D646F2B2F599CB3947BBE8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Internet Freedom and Nondiscrimination
			 Act of 2006</short-title></quote>.</text>
		</section><section id="HFD75D728092842A6AD39E300F18543FC"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to promote
			 competition, to facilitate trade, and to ensure competitive and
			 nondiscriminatory access to the Internet.</text>
		</section><section id="H525E12CC3BF444EEBE7C5C788E4B9298"><enum>3.</enum><header>Amendments to the
			 clayton act</header><text display-inline="no-display-inline">The Clayton Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/12">15 U.S.C. 12 et seq.</external-xref>) is amended—</text>
			<paragraph id="HA5CF9BFBBA3F4AA48D78764937004FDA"><enum>(1)</enum><text>by redesignating
			 section 28 as section 29,</text>
			</paragraph><paragraph id="H5A41D349A3A5489CA2C4CF69DF166D7B"><enum>(2)</enum><text>by inserting after section 27 the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE7F01ABB0BC546C2995097E79BD0D55F" style="traditional">
					<section id="HC7617B58D42A4FE1B7ABB417004B3F50"><enum>28.</enum><header>discrimination by broadband network
		  providers</header><subsection commented="no" display-inline="yes-display-inline" id="H594C57EB19EC4DEF827C24E64F4DC5FE"><enum>(a)</enum><text display-inline="yes-display-inline">It shall be unlawful for any broadband
				network provider—</text>
							<paragraph id="H97C35AA9B02A4D608BAFCDAF41A1A3C2"><enum>(1)</enum><text>to fail to provide
				its broadband network services on reasonable and nondiscriminatory terms and
				conditions such that any person can offer or provide content, applications, or
				services to or over the network in a manner that is at least equal to the
				manner in which the provider or its affiliates offer content, applications, and
				services, free of any surcharge on the basis of the content, application, or
				service;</text>
							</paragraph><paragraph id="HA567620A7EC94253AD0853012F65CD38"><enum>(2)</enum><text>to refuse to
				interconnect its facilities with the facilities of another provider of
				broadband network services on reasonable and nondiscriminatory terms or
				conditions;</text>
							</paragraph><paragraph id="HCB8AD684A2B44373ACB2D6770026B920"><enum>(3)(A)
				</enum><text display-inline="yes-display-inline">to block, to impair, to
				discriminate against, or to interfere with the ability of any person to use a
				broadband network service to access, to use, to send, to receive, or to offer
				lawful content, applications or services over the Internet; or</text>
								<subparagraph id="HFB6C9C76E2EE4D48AD7573C0F02FAE4B" indent="up1"><enum>(B)</enum><text>to impose an additional charge to
				avoid any conduct that is prohibited by this subsection;</text>
								</subparagraph></paragraph><paragraph id="H4DBD4BB65040407E9688E3EA52E9EFB"><enum>(4)</enum><text>to prohibit a user
				from attaching or using a device on the provider’s network that does not
				physically damage or materially degrade other users’ utilization of the
				network; or</text>
							</paragraph><paragraph id="H064909923EE64F31BA432386717E00CE"><enum>(5)</enum><text>to fail to clearly
				and conspicuously disclose to users, in plain language, accurate information
				concerning any terms, conditions, or limitations on the broadband network
				service.</text>
							</paragraph></subsection><subsection id="HE1AA21074C1D41C283B7EBC96C924327"><enum>(b)</enum><text>If a broadband
				network provider prioritizes or offers enhanced quality of service to data of a
				particular type, it must prioritize or offer enhanced quality of service to all
				data of that type (regardless of the origin or ownership of such data) without
				imposing a surcharge or other consideration for such prioritization or enhanced
				quality of service.</text>
						</subsection><subsection id="H2A2F7B0003FF455B97F012264FB466DB"><enum>(c)</enum><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to prevent a broadband network provider from taking reasonable and
				nondiscriminatory measures—</text>
							<paragraph id="HC8E875B7BF144FFCA6A8FE2E9502029B"><enum>(1)</enum><text>to manage the
				functioning of its network to protect the security of such network and
				broadband network services if such management does not result in discrimination
				among the content, applications, or services on the network;</text>
							</paragraph><paragraph id="H7B4829AD846F412BA4B7153F9745D2EC"><enum>(2)</enum><text>to give priority
				to emergency communications; or</text>
							</paragraph><paragraph id="HB47BFF22F66B45DE82E900AD03CE4FEB"><enum>(3)</enum><text>to prevent a
				violation of a Federal or State law, or to comply with an order of a court to
				enforce such law.</text>
							</paragraph></subsection><subsection id="H5519F50B5657446BA2A1D7A1E70737F2"><enum>(d)</enum><text display-inline="yes-display-inline">For purposes of this section—</text>
							<paragraph id="HE1727419CCD54169A46C9CF00550652C"><enum>(1)</enum><text>the term
				<quote>affiliate</quote> means—</text>
								<subparagraph id="HE1F5F61006F14FD0A3FE224B00EF9C64"><enum>(A)</enum><text>a person that
				directly or indirectly owns, controls, is owned or controlled by, or is under
				the common ownership or control with another person; or</text>
								</subparagraph><subparagraph id="HBBAD132CA8324D49A864F167401F674C"><enum>(B)</enum><text>a person that has
				a contract or other arrangement with a content or service provider concerning
				access to, or distribution of, such content or such service;</text>
								</subparagraph></paragraph><paragraph id="H15CCE49E11EE4D1BB3D071BFE3AA8C00"><enum>(2)</enum><text>the term
				<quote>broadband network provider</quote> means a person engaged in commerce
				that owns, controls, operates, or resells any facility used to provide
				broadband network service to the public, by whatever technology and without
				regard to whether provided for a fee, in exchange for an explicit benefit, or
				for free;</text>
							</paragraph><paragraph id="HD8DBCA96C3D3447596912CBF922025D4"><enum>(3)</enum><text>the term
				<quote>broadband network service</quote> means a 2-way transmission service
				that connects to the Internet and transmits information at an average rate of
				at least 200 kilobits per second in at least one direction, irrespective of
				whether such transmission is provided separately or as a component of another
				service; and</text>
							</paragraph><paragraph id="HD7C7A13C7E0A4B6FAD37CB8D98B6D1D8"><enum>(4)</enum><text>the term
				<quote>user</quote> means a person who takes and uses broadband network
				service, whether provided for a fee, in exchange for an explicit benefit, or
				for free.</text>
							</paragraph></subsection></section><after-quoted-block>,
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H5C35752843704DF683EC7E80738E8252"><enum>(3)</enum><text display-inline="yes-display-inline">by amending subsection (a) and the 1st
			 sentence of subsection (b) of section 11 by striking <quote>and 8</quote> and
			 inserting <quote>8, and 29</quote>.</text>
