		<section id="HAA80236177744FF6B4227364F185D4B4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Natural Disaster Housing Reform Act of
			 2006</short-title></quote>.</text>
		</section><section id="H660F89BFAE4648A9AFA80192BB173EF7"><enum>2.</enum><header>HUD as lead
			 agency in cases of disasters resulting in long-term housing needs</header>
			<subsection id="H1EA15F2A3A434162BACEBB7709688075"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">It is the policy of
			 the United States that the Department of Housing and Urban Development shall be
			 primary Federal agency responsible for coordinating and administering housing
			 assistance in connection with any major disaster (as such term is defined in
			 section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)) for any area that, pursuant to section 408(b)(2) of such
			 Act, is determined to be an area for which such disaster will result in
			 long-term housing needs.</text>
			</subsection><subsection id="H51E7FCE48129482181AC3E266FA329C"><enum>(b)</enum><header>Consultation</header><text>The
			 Secretary of Housing and Urban Development shall, in coordinating and
			 administering housing assistance pursuant to subsection (a), consult with the
			 Secretary of Homeland Security, the Director of the Federal Emergency
			 Management Agency, and such other heads of Federal agencies as may be
			 appropriate.</text>
			</subsection><subsection id="H623D18AA916746918571ADA926F70022"><enum>(c)</enum><header>Use of regional
			 and local offices</header><text>In coordinating and administering housing
			 assistance pursuant to subsection (a), the Secretary of Housing and Urban
			 Development shall utilize staff and other resources of appropriate regional,
			 field, and area offices of the Department and consult and coordinate with
			 appropriate State and local housing agencies.</text>
			</subsection><subsection id="H8D25183B193A4FA8A9181308002F1EB2"><enum>(d)</enum><header>Preparedness</header><text>The
			 Secretary of Housing and Urban Development shall take such actions as may be
			 necessary to ensure that officers and staff of the Department at headquarters,
			 regional, field, and area offices at all times have the capability, capacity,
			 training, and resources necessary to carry out the responsibilities under
			 subsection (a).</text>
			</subsection><subsection id="HF54F405749104F56A4790000EDB1B42B"><enum>(e)</enum><header>Housing
			 assistance</header><text>For purposes of this section, the term <quote>housing
			 assistance</quote> means any assistance that is provided to individuals,
			 families, or households to respond to disaster-related housing needs of
			 individuals, families, or households who are displaced from their predisaster
			 primary residences or whose predisaster primary residences are rendered
			 uninhabitable as a result of damage caused by a major disaster pursuant
			 to—</text>
				<paragraph id="H6AA0D25C182340F4ACFEBF77B5483C"><enum>(1)</enum><text>the
			 Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121
			 et seq.)); or</text>
				</paragraph><paragraph id="HBAB8E104FC5C46669EE7F4996920A1CB"><enum>(2)</enum><text>any other
			 provision of law specifically providing funds or assistance in connection with
			 a major disaster.</text>
				</paragraph><continuation-text continuation-text-level="subsection">Such term
			 includes financial assistance, the provision of temporary, transitional, and
			 permanent housing units, assistance for repair, replacement, and construction
			 of housing units, technical assistance, and any other form or type of housing
			 assistance.</continuation-text></subsection><subsection id="H2E17764F0F41487FB38FDAA7E7C3A068"><enum>(f)</enum><header>Determination of
			 long-term housing needs</header><text>Section 408(b) of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>) is
			 amended—</text>
				<paragraph id="HD4A8583FC2CB423C92BB00045900294"><enum>(1)</enum><text>by
			 redesignating paragraph (2) as paragraph (3); and</text>
				</paragraph><paragraph id="H7C63D709A45E4188B438DB310816D413"><enum>(2)</enum><text>by inserting after
			 paragraph (1) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H97B9946CF4C74B449636578023BBEE5B" style="OLC">
						<paragraph id="H751D41511E4849549E2C7900ADAA6544"><enum>(2)</enum><header>Determination of
				areas for which disaster results in long-term housing needs</header>
							<subparagraph id="H0A6461AEEDC443F482014697DF8EF0C2"><enum>(A)</enum><header>State
				request</header><text>After the occurrence and declaration of a major disaster,
				the Governor of a State containing any area that is subject to the declaration
				by the President of such major disaster may request the President to determine,
				for all or any part of such area in the State, that the disaster will result in
				long-term housing needs.</text>
							</subparagraph><subparagraph id="HE8A308566AC6403BB7608B284268CC39"><enum>(B)</enum><header>Standard</header><text display-inline="yes-display-inline">Upon a request pursuant to subparagraph
				(A), the President shall determine whether to grant such request. The President
				shall grant such a request and determine that the major disaster will result in
				long-term housing needs with respect to an area if the President finds that the
				disaster will displace individuals or households in the area from their
				predisaster primary residences, or will render such predisaster primary
				residences in the area uninhabitable, for a period of 30 days or
				more.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H55EBA4B40EA64459BD5E68DDAC47FC00"><enum>(g)</enum><header>Conforming
			 amendment</header><text>Section 408(b) of the Robert T. Stafford Disaster
			 Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>), as amended by subsection
			 (f) of this section, is further amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H7DF65899E2CF49F7A8F7EE401405FD0" style="OLC">
					<paragraph id="H0C9565FA91D3416F9F004FCBAF7884E8"><enum>(4)</enum><header>HUD
				administration</header><text display-inline="yes-display-inline">In accordance
				with section 2 of the <short-title>Natural Disaster
				Housing Reform Act of 2006</short-title>, in the case of any area for which any
				major disaster is determined, pursuant to paragraph (2), to result in long-term
				housing needs, the President shall carry out the functions under this section
				relating to housing assistance, including this subsection and subsections (c)
				and (d), acting through the Secretary of Housing and Urban
				Development.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1C05BE9C357A47E78812005992EC631D"><enum>(h)</enum><header>Savings
			 provision</header><text>This section and the amendments made by this section
			 may not be construed to affect, alter, limit, or decrease the authority of the
			 Director of the Federal Emergency Management Agency for the overall
			 coordination of assistance and relief with respect to a major disaster.</text>
			</subsection></section><section id="H205432292A384E41B26238E897A3D319" section-type="subsequent-section"><enum>3.</enum><header>Federal assistance to
			 individuals and households</header><text display-inline="no-display-inline">Section 408 of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>) is
			 amended—</text>
			<paragraph id="H888F4CE3510F4550BFB430D805CF023D"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H3BECACA646F04390B6EAF9B38BB30020"><enum>(A)</enum><text>in paragraph (3)
			 (as so redesignated by section 2(f)(1) of this Act), by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H5FF0C3A0A58A40D0B03470645B9BBE27" style="OLC">
						<subparagraph id="H5E14798BF6544A2294C171B9F030DBBE"><enum>(C)</enum><header>Manufactured
				modular housing</header><text>In making any determination of cost effectiveness
				under subparagraph (A), the President shall consider whether or not
				manufactured modular housing can be provided to an individual or household at a
				cost to the Government that is less than the same cost necessary to provide
				other readily fabricated dwellings.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HB440A4BF692D45F69899F402F4BB969"><enum>(B)</enum><text>by adding at the
			 end the following new paragraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H5B2F712287CD42CFB020DEDFBE144FE4" style="OLC">
						<paragraph id="H76459360517F43AA94178541CBB836D9"><enum>(5)</enum><header>Consent of
				owner</header>
							<subparagraph id="H9A8DF07D780E42B3AB7022F74C06C4D0"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding paragraph (2), the President shall seek
				the consent of each individual or household prior to providing such individual
				or household with manufactured modular housing assistance.</text>
							</subparagraph><subparagraph id="H4F73656404DC43529DB322306CE04662"><enum>(B)</enum><header>rejection of
				manufactured modular housing assistance</header><text>If an individual or
				household does not provide consent under subparagraph (A), such individual or
				household shall remain eligible for any other assistance available under this
				section.</text>
							</subparagraph></paragraph><paragraph id="H3CA7CBC001F34F23B908CD5B3C58254D"><enum>(6)</enum><header>Owner
				contribution</header><text>Nothing in this section shall be construed to
				prevent an individual or household from contributing, in addition to any
				assistance provided under this section, such sums as are necessary in order to
				obtain manufactured modular housing that is of greater size or quality than
				that provided by the President under this
				section.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H350D5B953AA74D8690069E2898D0147B"><enum>(2)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="HDBF71AD6414C47E19395A1CCC6B27212"><enum>(A)</enum><text>in paragraph
			 (1)(A)(ii), by inserting <quote>the amount of any security deposit for the
			 accomodation, the amount of any utility fees associated with the accomodation,
			 and</quote> after <quote>plus</quote>;</text>
				</subparagraph><subparagraph id="HD89817BA47ED4EEDB4C67BA6A6702DBB"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
					<clause id="H19EE34A025A6481689E992EFD538F1A2"><enum>(i)</enum><text>in
			 subparagraph (A)—</text>
						<subclause id="H7C6742DD17EC488FBF00F81455CD0000"><enum>(I)</enum><text>in clause (i), by
			 striking <quote>(i)</quote> and inserting <quote>(i)(I)</quote>;</text>
						</subclause><subclause id="H8AC788D44376486BBE31DED0C6EAC2F"><enum>(II)</enum><text>by redesignating
			 clause (ii) as subparagraph (II); and</text>
						</subclause><subclause id="H86596D24EA124301B96C17F7F534C616"><enum>(III)</enum><text>by adding at the
			 end the following new clause:</text>
							<quoted-block display-inline="no-display-inline" id="HF060D484BD5C4573A2E5E14E6398D33D" style="OLC">
								<clause id="H04612119C222465A861B16D42F1D9C1B"><enum>(ii)</enum><text display-inline="yes-display-inline">the repair, to a safe and sanitary living
				or functioning condition, of existing rental units that, upon such repair, will
				be used as alternate housing accomodations for individuals or households
				described in paragraph
				(1).</text>
								</clause><after-quoted-block>;</after-quoted-block></quoted-block>
						</subclause></clause><clause id="HC5FC10139B4E46C694655861D61C2E11"><enum>(ii)</enum><text>in
			 subparagraph (B)—</text>
						<subclause id="H6A4F4B74A11F488EAA00933CE46B04A3"><enum>(I)</enum><text>by striking
			 <quote>this paragraph</quote> and inserting <quote>subparagraph (A)(i)</quote>;
			 and</text>
						</subclause><subclause id="HD379EC864C044660A3658035972E2440"><enum>(II)</enum><text>by inserting
			 <quote>not</quote> after <quote>can</quote>; and</text>
						</subclause></clause><clause commented="no" id="H182E09FC05934097846625FC29C49703"><enum>(iii)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking
			 <quote>this paragraph</quote> and inserting <quote>subparagraph (A)(i)</quote>;
			 and</text>
					</clause></subparagraph><subparagraph id="HCA8DB27820F4434AB043CF97EB951059"><enum>(C)</enum><text>in paragraph
			 (4)—</text>
					<clause id="H29B1F2AB8AF34ADB9E2B99D55D29FACC"><enum>(i)</enum><text>in
			 the paragraph heading, by inserting <quote><header-in-text level="paragraph" style="OLC">or semi-permanent</header-in-text></quote> after
			 <quote><header-in-text level="paragraph" style="OLC">Permanent</header-in-text></quote>;</text>
					</clause><clause id="HB52ADCF296754945821DCF1165FACCBF"><enum>(ii)</enum><text>by
			 inserting <quote>or semi-permanent</quote> after
			 <quote>permanent</quote>;</text>
					</clause><clause id="HCA4DD5B0B5984D6EBD1BFD953B093EC6"><enum>(iii)</enum><text>by
			 striking <quote>in insular areas</quote> and inserting the following:
			 “in—</text>
						<quoted-block display-inline="no-display-inline" id="H94D039ED56B04F03886D22ABAFC3DB" style="OLC">
							<subparagraph id="H0A14548F8DE448CD97E3DC74BF09FE08"><enum>(A)</enum><text>insular
				areas</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause><clause id="H08E4289805334F388F5968C9C1FA2FC5"><enum>(iv)</enum><text>by
			 striking <quote>(A) no alternative</quote> and inserting <quote>(i) no
			 alternative</quote> and adjusting the margin accordingly;</text>
					</clause><clause id="H3D2FEAFD3DC442828D7DEA4B8C6F4435"><enum>(v)</enum><text>by
			 striking <quote>(B)</quote> and inserting <quote>(ii)</quote> and adjusting the
			 margin accordingly;</text>
					</clause><clause id="H70BD3E01A66B4C9882E4A32CBD914F29"><enum>(vi)</enum><text>by
			 striking the period at the end and inserting <quote>; and</quote>; and</text>
					</clause><clause id="HE60F76304CEF46C7B159C306130080B9"><enum>(vii)</enum><text>by
			 adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H9F2086A57BE04FCDB0F7CC81BC9EF6DD" style="OLC">
							<subparagraph id="HBF34D0DFF830492CB3DABC1279173CBC"><enum>(B)</enum><text>any area in which
				the President declared a major disaster or emergency in connection with
				Hurricane Katrina of 2005 during the period beginning on August 28, 2005, and
				ending on December 31,
				2007.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause></subparagraph></paragraph><paragraph id="HA9DA2565E8BB49A0B9AD98CB06137EDF"><enum>(3)</enum><text>in subsection
			 (d)(1), by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9E884B01249F41BA0064128E2FF6B8A8" style="OLC">
					<subparagraph id="H61177DA128334FFB00B395565F1094C6"><enum>(C)</enum><header>Sites located in
				a floodplain</header><text>Notwithstanding any other provision of law,
				including <external-xref legal-doc="regulation" parsable-cite="cfr/44/9">section 9</external-xref> of title 44, Code of Federal Regulations (or any
				corresponding similar regulation or ruling), any permanent, semi-permanent, or
				temporary housing provided under this section, including any readily fabricated
				dwelling, manufactured housing, or manufactured modular housing, may be located
				in any area identified by the Director as an area having special flood hazards
				under section 102 of the Flood Disaster Protection Act of 1973 (42 U.S.C.
				4012a)).</text>
					</subparagraph><subparagraph id="H1F98026D010C4CD4839352B84BB8317"><enum>(D)</enum><header>Individual sites
				for manufactured modular housing</header><text>Manufactured modular housing
				made available under this section—</text>
						<clause id="H9130E94C6E9E4509AA00B965B37023F"><enum>(i)</enum><text>shall, whenever
				practicable, be located on a site that is a discrete and separate parcel of
				land; and</text>
						</clause><clause id="H207A4A992F634F98AEEDBB3C5DAC7E65"><enum>(ii)</enum><text>may not be
				located on a site that—</text>
							<subclause id="HA41BFBEAF5ED4651AC51D2673D9C19BE"><enum>(I)</enum><text>is managed by the
				Director; and</text>
							</subclause><subclause id="H52C106866F324ADCAFFA7352BA5E418F"><enum>(II)</enum><text>contains 3 or
				more other manufactured modular housing
				units.</text>
							</subclause></clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HF2DAD4624A804C8F8B9596D3CEBCD5F1"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDCDE066E5DC44167AE101074FE928477" style="OLC">
					<subsection id="H4A322DDEB7E84B97834F48CF93FE315F"><enum>(j)</enum><header>Evacuation
				plans</header><text>The Director, in consultation with the Governor of each
				State and the heads of such units of local government as the Director may
				determine, shall develop and maintain detailed and comprehensive mass
				evacuation plans for individuals or households receiving assistance under this
				section for the 18-month period beginning on the date of the declaration of the
				disaster for which such assistance is
				provided.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
