		<section id="H30F188A0BD8D4122B5504D19C8A2DE05" section-type="section-one"><enum>1.</enum><header>Refineries</header><text display-inline="no-display-inline">Title I of the Energy Policy and
			 Conservation Act is amended by adding at the end the following new part:</text>

				<part id="H3436818173694989848305EFEB469D1"><enum>V</enum><header>Refineries</header>
					<section id="HEA7F8FE82B82465581F629351B08FAB1"><enum>191.</enum><header>Strategic
				Refinery Reserve</header>
						<subsection id="H4DDB953F0283488287B2B298C9608D94"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary shall establish and operate a Strategic Refinery Reserve in the
				United States. The Secretary may design and construct new refineries, or
				acquire closed refineries and reopen them, to carry out this section.</text>
						</subsection><subsection id="HE1AE5F96B73B4AFDA5F4BE37BB4195ED"><enum>(b)</enum><header>Operation</header><text>The
				Secretary shall operate refineries in the Strategic Refinery Reserve for the
				following purposes:</text>
							<paragraph id="H3209F89D8C894BDEA6F1E3F8B72B1400"><enum>(1)</enum><text display-inline="yes-display-inline">During any period described in subsection
				(c), to provide petroleum products to the general public.</text>
							</paragraph><paragraph id="H233E0B1C432840F7964EAF00FFABB2F9"><enum>(2)</enum><text display-inline="yes-display-inline">To provide petroleum products to the
				Federal Government, including the Department of Defense, as well as State
				governments and political subdivisions thereof who choose to purchase refined
				petroleum products from the Strategic Refinery Reserve.</text>
							</paragraph></subsection><subsection id="H594C85DF20A84B4A96B9773C42B62908"><enum>(c)</enum><header>Emergency
				periods</header><text display-inline="yes-display-inline">The Secretary shall
				make petroleum products from the Strategic Refinery Reserve available under
				subsection (b)(1) only—</text>
							<paragraph id="H6055CD9CE54044D2A3DAB50303D600B2"><enum>(1)</enum><text>during a severe
				energy supply interruption, within the meaning of such term under part B;
				or</text>
							</paragraph><paragraph id="HF3E9165F606D43770044EAB9BC8E8C72"><enum>(2)</enum><text display-inline="yes-display-inline">if the President determines that there is a
				regional petroleum product supply shortage of significant scope and duration
				and that action taken under subsection (b)(1) would assist directly and
				significantly in reducing the adverse impact of such shortage.</text>
							</paragraph></subsection><subsection id="H93713E544340476EB0E76CB54FF2FEC7"><enum>(d)</enum><header>Locations</header><text>In
				determining the location of a refinery for the Strategic Refinery Reserve, the
				Secretary shall take into account the following factors:</text>
							<paragraph id="H1566559FFECB4EBCA18D25DFCC3D9F1"><enum>(1)</enum><text display-inline="yes-display-inline">Impact on the local community (determined
				after requesting and receiving comments from State, county or parish, and
				municipal governments, and the public).</text>
							</paragraph><paragraph id="HCF923E0B053B4CF384F0519975824CCF"><enum>(2)</enum><text>Regional
				vulnerability to a natural disaster.</text>
							</paragraph><paragraph id="H3E2A46E5949B48B29F5BF9A6D77C61A8"><enum>(3)</enum><text>Regional
				vulnerability to terrorist attacks.</text>
							</paragraph><paragraph id="HAB4C0C59ED174957A0F087A36BFB229"><enum>(4)</enum><text>Proximity to the
				Strategic Petroleum Reserve.</text>
							</paragraph><paragraph id="HB92E6E282D8643C9BC8FE449BB3D90"><enum>(5)</enum><text>Accessibility to
				energy infrastructure.</text>
							</paragraph><paragraph id="H29141D36F4E74A77BC86C917E357BD22"><enum>(6)</enum><text>The need to
				minimize adverse public health and environmental impacts.</text>
							</paragraph><paragraph id="H0612BD48548E435F00F4AB502FDF2535"><enum>(7)</enum><text>The energy needs
				of the Federal Government, including the Department of Defense.</text>
							</paragraph></subsection><subsection id="H1A4203A4413E45CA924E82E049BADC74"><enum>(e)</enum><header>Increased
				capacity</header><text>The Secretary shall ensure that refineries in the
				Strategic Refinery Reserve are designed to enable a rapid increase in
				production capacity during periods described in subsection (c).</text>
						</subsection><subsection id="H2F516F4444C0441EA2A6B516E4EE63E3"><enum>(f)</enum><header>Implementation
				plan</header><text display-inline="yes-display-inline">Not later than 6 months
				after the date of enactment of this section, the Secretary shall transmit to
				the Congress a plan for the establishment and operation of the Strategic
				Refinery Reserve under this section. Such plan shall provide for establishing,
				within 2 years after the date of enactment of this section, and maintaining a
				capacity for the Reserve equal to 5 percent of the total United States daily
				demand for gasoline, home heating oil, and other refined petroleum products. If
				the Secretary finds that achieving such capacity within 2 years is not
				feasible, the Secretary shall explain in the plan the reasons therefor, and
				shall include provisions for achieving such capacity as soon as practicable.
				Such plan shall also provide for adequate delivery systems capable of providing
				Strategic Refinery Reserve product to the entities described in subsection
				(b)(2).</text>
						</subsection><subsection id="H8879D4D6EFB24B12839F13A774A41F69"><enum>(g)</enum><header>Compliance with
				Federal environmental requirements</header><text>Nothing in this section shall
				affect any requirement to comply with Federal or State environmental or other
				law.</text>
						</subsection></section><section id="HF65ABC9F20D14712B55D62EA19D0A3F8"><enum>192.</enum><header>Refinery
				closing reports</header>
						<subsection id="H8631566BFB28468289193729C456C57"><enum>(a)</enum><header>Closing
				reports</header><text display-inline="yes-display-inline">The owner or operator
				of a refinery in the United States shall notify the Secretary at least 6 months
				in advance of permanently closing the refinery, and shall include in such
				notice an explanation of the reasons for the proposed closing.</text>
						</subsection><subsection id="HDB81C252AA7F4BD6993000A90031A94F"><enum>(b)</enum><header>Reports to
				Congress</header><text display-inline="yes-display-inline">The Secretary, in
				consultation with the Federal Trade Commission, shall promptly report to the
				Congress any report received under subsection (a), along with an analysis of
				the effects the proposed closing would have on petroleum product prices,
				competition in the refining industry, the national economy, regional economies
				and regional supplies of refined petroleum products, and United States energy
				security.</text>
						</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
