		<official-title>To amend the automobile fuel economy provisions of title
		  49, United States Code, to authorize the Secretary of Transportation to set
		  fuel economy standards for passenger automobiles based on one or more vehicle
		  attributes.</official-title>

		<section display-inline="no-display-inline" id="H87013B95B45743CA94AFCFCD41F6E398" section-type="section-one"><enum>1.</enum><header>CAFE standards for passenger
			 automobiles</header>
			<subsection id="HA15AC35CC31047AE9E92B5AF39F2C77B"><enum>(a)</enum><header>Average fuel
			 economy standards for passenger automobiles</header><text>Section 32902 of
			 title 49, United States Code, is amended—</text>
				<paragraph id="HDA552B4CA7F94644972F1C3F41B6575C"><enum>(1)</enum><text>by amending
			 subsection (c) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HACAC3201E7A14F66007500AC7FCAB550" style="USC">
						<subsection id="H92C8E8A35F914D46ADB3B3C1C3000D6"><enum>(c)</enum><header>Amending
				passenger automobile standards</header>
							<paragraph id="H2886DF66F48340CEBC6534CD0720A288"><enum>(1)</enum><header>regulations</header><text display-inline="yes-display-inline">The Secretary of Transportation may
				prescribe regulations amending the standard under subsection (b) of this
				section for a model year. If the Secretary does not prescribe regulations under
				this subsection for a given model year, the standard in effect for the
				preceding model year shall apply to such model year and each model year
				thereafter.</text>
							</paragraph><paragraph id="H98E5E526ABCA4887A88EF9230012511C"><enum>(2)</enum><header>maximum feasible
				average fuel economy</header><text display-inline="yes-display-inline">The
				standard prescribed under this subsection shall be the maximum feasible average
				fuel economy level that the Secretary decides the manufacturers can achieve in
				that model year. In amending such standard for a model year, the Secretary,
				consistent with the Secretary’s authority under this section for prescribing
				standards, may establish a standard based on one or more vehicle attributes
				related to fuel economy.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H795BE522003C4F939FA5819B247822C9"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g)(2), by striking
			 <quote>(and submit the amendment to Congress when required under subsection
			 (c)(2) of this section)</quote>.</text>
				</paragraph></subsection><subsection id="HC02A787C803D4241968900B776745C04"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall be effective on the date of enactment of this Act. The
			 Secretary of Transportation shall prescribe regulations under section 32902(c)
			 of title 49, United States Code, not later than December 30, 2008. Such
			 regulations shall take into consideration standard automobile industry design
			 and production processes.</text>
			</subsection><subsection id="HDF43383B589A49C8832E3B63EE69838C"><enum>(c)</enum><header>Study of
			 requirement of separate calculations for domestic and foreign fleets</header>
				<paragraph id="HB704F79B0A924E6AA31334BE8CB35300"><enum>(1)</enum><header>Study</header><text>The
			 Administrator of the National Highway Traffic Safety Administration shall
			 conduct a study on the requirement of separate fuel economy calculations for
			 automobiles manufactured domestically and not domestically contained in section
			 32904(b) of title 49, United States Code. Such study shall—</text>
					<subparagraph id="H1FE80F749DEA471CA4C2C13EA87AAC6"><enum>(A)</enum><text>assess the effects
			 of such requirement on employment within the automobile industry in the United
			 States;</text>
					</subparagraph><subparagraph id="H859CD9D285944255B6AB08C5D5E9232"><enum>(B)</enum><text>assess the effects
			 of such requirement on overall passenger automobile fuel economy;</text>
					</subparagraph><subparagraph id="HBF2C2AC538D847D391DD48B48468DD3E"><enum>(C)</enum><text>determine the
			 degree to which such requirement encourages manufacturers to alter their
			 automobiles in order to meet automobile fuel efficiency standards for both
			 domestic and foreign manufactured automobiles;</text>
					</subparagraph><subparagraph id="HD103F08C177140D9A68CF2E32EE37A4"><enum>(D)</enum><text>examine the effect
			 of requirements of the North American Free Trade Agreement on the operation of
			 such requirement;</text>
					</subparagraph><subparagraph id="H06076ACCE22C4D8DB67CE36F37E281C7"><enum>(E)</enum><text>determine whether
			 such requirement has resulted in additional costs to automobile consumers;
			 and</text>
					</subparagraph><subparagraph id="H8003B80817AE4E40A51401F760DDF398"><enum>(F)</enum><text>determine whether
			 such requirement has promoted increased manufacturing of smaller, more
			 fuel-efficient cars in the United States.</text>
					</subparagraph></paragraph><paragraph id="HAD063F31E0AB4F97B8A529D9641989B0"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Administrator of the National Highway Traffic Safety
			 Administration shall transmit a report to Congress and to the Administrator of
			 the Environmental Protection Agency on the conclusions of the study.</text>
				</paragraph></subsection></section></legis-body>
