Such responsibilities shall include the following:</text> <paragraph id="H31DCE4B0D75F4F5BB761C9791644DE40"><enum>(1)</enum><text>Serving as the Secretary’s principal advisor on emergency preparedness, mitigation, response, and recovery issues.</text></paragraph> <paragraph id="H445B7D451C3F4BB6AEF6FB2C2D7FB0AA" display-inline="no-display-inline"><enum>(2)</enum><text>Carrying out all functions and authorities prescribed by the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></paragraph> <paragraph id="HB80D72B24BB8490B00C1832094C7784C" display-inline="no-display-inline"><enum>(3)</enum><text>Coordinating the Federal response to acts of terrorism, natural disasters, or other emergencies, including coordination of—</text> <subparagraph id="H1E0EECE9E4A04B06891DAF29A47C91F6"><enum>(A)</enum><text>the National Emergency Response Team;</text></subparagraph> <subparagraph id="H6D45A4D4CD6D4B8A9C1DB58DAE8942E1"><enum>(B)</enum><text>the deployment of the Strategic National Stockpile;</text></subparagraph> <subparagraph id="HBE7BE692F9434DE0ADA7FBC46DCA8B70"><enum>(C)</enum><text>the National Disaster Medical System;</text></subparagraph> <subparagraph id="H36EE1BDF59D7453F99B5AAE4609855C"><enum>(D)</enum><text>the Nuclear Incident Response Team (when operating as an organizational unit of the Department pursuant to this title);</text></subparagraph> <subparagraph id="HF2C6C23E9A7741EEAAF98683BF3C676D"><enum>(E)</enum><text>the Metropolitan Medical Response System;</text></subparagraph> <subparagraph id="H529C4F766D9C4E25B38BB98B47DFB094"><enum>(F)</enum><text>the Urban Search and Rescue System;</text></subparagraph> <subparagraph id="HC5B70D844DC14E60B8D111B4A63C1103"><enum>(G)</enum><text>Federal Incident Response Support Teams;</text></subparagraph> <subparagraph id="HBB500A70DE7D470EAF64438C61008EB1"><enum>(H)</enum><text>Management Support Teams; and</text></subparagraph> <subparagraph id="HDE8A5F6C76E44BEDA8FC7C6E67698CD4"><enum>(I)</enum><text>the Mobile Emergency Response System.</text></subparagraph></paragraph> <paragraph id="HA724665680674F5A889DE2BB406C295E"><enum>(4)</enum><text>Overseeing and directing all of the activities of the Directorate.</text></paragraph> <paragraph id="HD99E485855AB40239B581B53C2C5F366"><enum>(5)</enum><text>Develop for each fiscal year, and submit directly to the President, a prepared budget for the Directorate.</text></paragraph> <paragraph id="H4E3C04B432694458902695181DBCBB01"><enum>(6)</enum><text>Coordinating emergency preparedness, mitigation, response, and recovery activities throughout the Department.</text></paragraph> <paragraph id="H7A2A0168C56244188429AD38C63A295"><enum>(7)</enum><text>Leading the development of an integrated national emergency management system.</text></paragraph> <paragraph id="HBCB95B07CC844CF2BEACF7487C38A1FD"><enum>(8)</enum><text display-inline="yes-display-inline">Coordinating preparedness, mitigation, response, and recovery efforts at the Federal level.</text></paragraph> <paragraph id="HC2ED52E19D54413A9C2BC13369F8116"><enum>(9)</enum><text>Working with all State, local, tribal, and private sector emergency response providers and emergency response support providers on all matters pertaining to acts of terrorism, natural disasters, and other emergencies, including training, exercises, and lessons learned.</text></paragraph> <paragraph id="H6335DF00463046ECB0606E8B24432EFC"><enum>(10)</enum><text>Implementing national strategies and policies in all matters pertaining to emergency management and the protection of critical infrastructure.</text></paragraph> <paragraph id="H72CDF37DB80244F3BBB44B2900B6BBE9"><enum>(11)</enum><text>Establishing priorities for directing, funding, and conducting national preparedness programs, activities, and services for preventing, protecting against, mitigating against, responding to, and recovering from acts of terrorism, natural disasters, and other emergencies.</text></paragraph> <paragraph id="HF4BECA8620D44C4DB9F545FB7EDE59C8"><enum>(12)</enum><text>Coordinating communications and systems of communications relating to homeland security by and between all levels of government.</text></paragraph> <paragraph id="H2F1611DECFAF4A13BA472056C9B8652C"><enum>(13)</enum><text display-inline="yes-display-inline">Directing and supervising homeland security financial assistance awarded by the Department to State, local, and tribal governments.</text></paragraph> <paragraph id="H924E775850604098B19501882362AD03"><enum>(14)</enum><text>Serving as an advocate for emergency preparedness across all government sectors, the private sector, and the public.</text></paragraph> <paragraph id="H6B1815ECEC574C7BBE728BEBBB9575BF"><enum>(15)</enum><text>Helping to ensure the acquisition of operable and interoperable communications capabilities by Federal, State, and local governments and emergency response providers.</text></paragraph> <paragraph id="H9A9B0926EC6141B591A4E2DE3774D4C1"><enum>(16)</enum><text>Aiding the recovery from acts of terrorism, natural disasters, and other emergencies.</text></paragraph> <paragraph id="H95D4150DEBA24DB3828B552892BE3C22"><enum>(17)</enum><text>Minimizing, to the extent practicable, overlapping planning and reporting requirements applicable to State, local, and tribal governments.</text></paragraph> <paragraph id="H0B380E59BA4B490A93057EBA7967B051"><enum>(18)</enum><text>Performing such other duties relating to such responsibilities as the Secretary may require.</text></paragraph> </subsection> <subsection id="H912F3038243445AC9E9C306BCF71622D"><enum>(b)</enum><header>Functions transferred</header> <paragraph id="HC52C1B1D55EE4FE48E5C9109EA5D8230"><enum>(1)</enum><header>Transfer</header><text>There are transferred to the Under Secretary for Emergency Management—</text> <subparagraph id="H4948F59892A4423A8859D598BACCB602"><enum>(A)</enum><text>the functions, personnel, assets, and liabilities of the Federal Emergency Management Agency; and</text></subparagraph> <subparagraph id="HE531F12B94194573B629F1E59BF976CE"><enum>(B)</enum><text>the functions, personnel, assets, and liabilities of the Directorate of Preparedness.</text></subparagraph></paragraph> <paragraph id="H432E94C21720406AAEDC67F84CB76427"><enum>(2)</enum><header>Responsibilities</header><text>The Under Secretary shall carry out the responsibilities of the Director of the Federal Emergency Management Agency and the responsibilities of the Under Secretary for Preparedness.</text></paragraph></subsection> <subsection id="H900B10905D6B46DD8227491B74C2B061"><enum>(c)</enum><header>Performance of previously transferred functions</header><text>The Secretary shall perform the functions of the following entities through the Under Secretary for Emergency Management:</text> <paragraph id="H50C104A4538641D3ACF00791DA026D"> <enum>(1)</enum> <text>The Integrated Hazard Information System (which the Secretary shall rename <quote>FIRESAT</quote>) of the National Oceanic and Atmospheric Administration.</text> </paragraph> <paragraph id="H1BC20D299F844114A9264223B0E611C5"> <enum>(2)</enum> <text>The National Domestic Preparedness Office of the Federal Bureau of Investigation, including the functions of the Attorney General relating thereto.</text> </paragraph> <paragraph id="H446A2CF2DD754ED8000054F7DB004EDE"> <enum>(3)</enum> <text>The Domestic Emergency Response Teams of the Department of Justice, including the functions of the Attorney General relating thereto.</text> </paragraph> <paragraph id="H4C8C72797C2A42DBA7D96F79E300584E"> <enum>(4)</enum> <text>The Office of Emergency Preparedness, the National Disaster Medical System, and the Metropolitan Medical Response System of the Department of Health and Human Services, including the functions of the Secretary of Health and Human Services and the Assistant Secretary for Public Health Emergency Preparedness relating thereto.</text></paragraph> <paragraph id="H63CE413CA6F34D7095912F9CFF60A00"><enum>(5)</enum><text>The United States Fire Administration and the United States Fire Academy.</text> </paragraph></subsection> <subsection id="H1AB3901BD082443CA6F3E7FE68BA5F8F" commented="no"><enum>(d)</enum><header>Reprogramming</header><text>The Secretary may not reprogram any funds allocated to the Directorate of Emergency Management without approval by the Congress.</text></subsection> <subsection id="HFAFC56B3FAAB448BA09D231E4D6BE0EB"><enum>(e)</enum><header>Sufficiency of resources</header><text>The Secretary shall provide to the Under Secretary for Emergency Management the resources and staff necessary to carry out the responsibilities of the Directorate of Emergency Management under this section.</text></subsection></section> <section id="HBB59C4FC992F407DBB1272E549A2C827"><enum>503.</enum><header>Principal advisor on emergency management</header> <subsection id="H30B5594161444EE99448651F48018052"><enum>(a)</enum><header>In general</header><text>The Under Secretary for Emergency Management shall serve as the principal advisor to the President for all matters pertaining to emergency management in the United States.</text></subsection> <subsection id="H1E109420D2BC49A4950466C11BFCEB83"><enum>(b)</enum><header>Cabinet status</header><text display-inline="yes-display-inline">During the effective period of an Incident of National Significance declared by the Secretary under the National Response Plan, the Under Secretary for Emergency Management shall serve as a Cabinet Officer for the duration of such Incident of National Significance.</text></subsection> <subsection id="H43684D11599D4540ABE04900CC509C09"><enum>(c)</enum><header>Retention of authority</header><text>Nothing in this section shall be construed as affecting the authority of the Secretary under this Act.</text></subsection></section> <section id="H9985C4F25B934E2BA3C92C4088117354"><enum>504.</enum><header>Regional offices</header> <subsection id="HA729EB6FC1784169B1A86BF123575961"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In accordance with section 706, there is in the Directorate a Regional Office of Emergency Management for each region of the United States.</text></subsection> <subsection id="HB79672367DFE45BD873F5FA9149FCB9"><enum>(b)</enum><header>Management of Regional Offices</header> <paragraph id="HB1C3B4FA8FCF47B4B64F7BBF54115918"><enum>(1)</enum><header>Regional Director</header><text>Each Regional Office shall be headed by a Regional Director for Emergency Management, who shall be appointed by the Secretary, in consultation with State, local, and tribal governments in the region. Except as provided in subsection (c)(3), each Regional Director for Emergency Management shall report directly to the Under Secretary for Emergency Management.</text></paragraph> <paragraph id="H6F87086D78D642DCB9189B835DEE9F6E"><enum>(2)</enum><header>Deputy Regional Director</header><text display-inline="yes-display-inline">There shall be in each Regional Office a Deputy Regional Director for Emergency Management, who shall be appointed by the Secretary, in consultation with State, local, and tribal governments in the region. The Deputy Regional Director for Emergency Management for a Regional Office shall report directly to the Regional Director for Emergency Management for that Regional Office.</text></paragraph> <paragraph id="HC14B9EBB35BA47DCB078B7962E9714ED"><enum>(3)</enum><header>Qualifications</header><text>Each individual appointed as Regional Director or Deputy Regional Director for Emergency Management must possess a demonstrated ability in and knowledge of emergency management and possess familiarity with the geographical area served by the Regional Office.</text></paragraph> </subsection> <subsection id="HC041076B02CE4D23BCC4AF6281A72B47"><enum>(c)</enum><header>Responsibilities</header> <paragraph id="H8758EBE77FF740569E923F4D01F549C2"><enum>(1)</enum><header>In general</header><text>Subject to the direction and control of the Secretary and in consultation with the Regional Advisory Council on Emergency Management under subsection (e), each Regional Director for Emergency Management shall work in partnership with State, local, and tribal governments, emergency managers, emergency response providers, emergency response support providers, the private sector, non-governmental organizations, multi-jurisdictional councils of governments, and regional planning commissions and organizations in the geographical area served by the Regional Office to carry out the responsibilities under this section.</text></paragraph> <paragraph id="H8422E497D6204A6D989C30E1113C6C71"><enum>(2)</enum><header>Ordinary responsibilities</header><text>The ordinary responsibilities of each Regional Director are as follows:</text> <subparagraph id="H43901DE008D0403EAACB2B82B2AADE00"><enum>(A)</enum><text>Ensuring coordination and integration of regional preparedness, mitigation, response, and recovery activities and programs, including planning, training, exercises, and professional development.</text></subparagraph> <subparagraph id="HAF92E243C750489C895EA1CEA009CF65"><enum>(B)</enum><text>Participating in regional emergency management activities.</text></subparagraph> <subparagraph id="HE6ED7B60BA7B4D0881F1CDA62C0AF99"><enum>(C)</enum><text>Identifying critical gaps in preparedness and reporting such gaps to the Assistant Secretary for Grants and Planning.</text></subparagraph> <subparagraph id="H9044F7FF4D124B9197DFB13796DB20F1"><enum>(D)</enum><text display-inline="yes-display-inline">Identifying critical gaps in critical infrastructure and reporting such gaps to the Assistant Secretary for Infrastructure Protection. </text></subparagraph> <subparagraph id="H8A324A66FFE340D9ACA6007C3E007C9F"><enum>(E)</enum><text>Organizing, in consultation with the Assistant Secretary for Training and Exercises, regional training and exercise programs.</text></subparagraph> <subparagraph id="HAE2F4E447E8448318EBB9D00009FA02F"><enum>(F)</enum><text>Facilitating the dissemination and implementation of lessons learned and best practices.</text></subparagraph> <subparagraph id="H217756FBFEE94188A4DB3B7ECC313260"><enum>(G)</enum><text>Improving general information sharing and other forms of coordination.</text></subparagraph> <subparagraph id="H7B94F7642F5E4A38B25DE04884524323"><enum>(H)</enum><text>Encouraging, in coordination with the Director of the Office of Public and Community Preparedness, public and community preparedness efforts.</text></subparagraph> <subparagraph id="H77628808926948AA98C6B6B76B5D6F70"><enum>(I)</enum><text>Assisting in the development of regional capabilities needed for a national catastrophic response system.</text></subparagraph> <subparagraph id="H33C3B76E620E41D88E375E731DF6BA55"><enum>(J)</enum><text>Monitoring, in coordination with the Assistant Secretary for Grants and Planning, the use of Federal homeland security assistance awarded by the Department to State, local, and tribal governments.</text></subparagraph> <subparagraph id="HEDC3B90BD47747A89D54B0E59BBC9E3E"><enum>(K)</enum><text>Pre-identifying Joint Field Office locations in areas with large populations or in areas at high risk to acts of terrorism, natural disasters, or other emergencies.</text></subparagraph> <subparagraph id="HA5B6909B9AAB4A738972BBC75B073DA8"><enum>(L)</enum><text>Fostering the development of mutual aid and other cooperative agreements pertaining to emergency management.</text></subparagraph> <subparagraph id="H1F05341F5E1E4C0192CD15FF02D61BB6"><enum>(M)</enum><text>Performing such other duties relating to such responsibilities as the Secretary may require.</text></subparagraph></paragraph> <paragraph id="H8514A8E1DD7F4F969E42C8990712935"><enum>(3)</enum><header>Incidents of National significance</header> <subparagraph id="HF5315484D1C845220007337635A61E87"><enum>(A)</enum><header>Appointment of Regional Director As Principal Federal Official or Federal Coordinating Officer</header><text>During the effective period of an Incident of National Significance declared by the Secretary under the National Response Plan, if the Regional Director is appointed Principal Federal Official or Federal Coordinating Officer, the Deputy Regional Director shall assume the responsibilities of the Regional Director during such incident.</text></subparagraph> <subparagraph id="HA467B6BBB8CF4C6F9227ECBE373C2500"><enum>(B)</enum><header>Responsibilities of Principal Federal Official</header><text>In addition to the responsibilities of the Principal Federal Official under the National Response Plan, such Official shall, with respect to the Incident of National Significance—</text> <clause id="H469E3D8A55F244EEA3773B049F18D963"><enum>(i)</enum><text>establish and direct a Joint Field Office and any other coordination structure that is needed for such incident;</text></clause> <clause id="H0A05042E797A475C8769C6FD2C7E2E84"><enum>(ii)</enum><text display-inline="yes-display-inline">possess the authority to make any necessary operational decisions, in accordance with existing Federal law, without obtaining approval from the Secretary;</text></clause> <clause id="HF02039D87D0D417BBFCD90C3E0723CC"><enum>(iii)</enum><text>coordinate and direct, as appropriate, Federal response assets deployed within the operational area;</text></clause> <clause id="H7276E623DB614D71B07BF70014039928"><enum>(iv)</enum><text>serve as the primary point of contact between the Department, the Department of Defense, and States for contingency planning; and</text></clause> <clause id="HFAE925A6252B4D30A8CFA08439007C8C"><enum>(v)</enum><text>act as the primary point of contact and situational awareness locally for the Secretary of Homeland Security.</text></clause></subparagraph></paragraph></subsection> <subsection id="HD55B24985AC146AC85E600434E0482D8"><enum>(d)</enum><header>Training and exercise requirements</header> <paragraph id="HCC877233CFB6440B8487779FEB63524B"><enum>(1)</enum><header>Training</header><text>The Secretary shall require each Regional Director and Deputy Regional Director for Emergency Management to complete Principal Federal Officer training not later than 60 days after the date on which the Regional Director or Deputy Regional Director is appointed. In addition, the Secretary shall require each Regional Director and Deputy Regional Director to periodically, but not less than annually, undergo specific training to complement the qualifications of the Regional Director or Deputy Regional Director. Such training shall include training with respect to the National Incident Management System, the National Response Plan, and such other subjects as determined by the Secretary.</text></paragraph> <paragraph id="HA6CBB65F1F9B467DAA5879ECA200C6BD"><enum>(2)</enum><header>Exercises</header><text display-inline="yes-display-inline">The Secretary shall require each Regional Director and Deputy Regional Director for Emergency Management to regularly participate in regional or national exercises.</text></paragraph></subsection> <subsection id="HF5EA8A06342F481ABB3622AD8012D148"><enum>(e)</enum><header>Regional Advisory Councils on Emergency Management</header> <paragraph id="H594CFA16B69E4E378F4E149DAC579314"><enum>(1)</enum><header>Establishment</header><text>There is in each Regional Office a Regional Advisory Council on Emergency Management. Each Advisory Council shall report to the Regional Director of the Regional Office.</text> </paragraph> <paragraph id="H2D0C1C05F7C7421CA4EF48870047D9EE" commented="no"><enum>(2)</enum><header>Membership</header> <subparagraph id="HE0126454374F4C669517F89385F8C400" commented="no"><enum>(A)</enum><text>The Regional Director shall appoint the following members to the Advisory Council of that Regional Director’s Regional Office—</text> <clause id="H737EEA3422074E428911CEB09EE38968"><enum>(i)</enum><text>subject matter experts from across the Federal Government, including representatives from the Departments of Defense, Energy, Health and Human Services, and Transportation;</text></clause> <clause id="H196B70392CC44636ABFC9273AEE79CCB"><enum>(ii)</enum><text display-inline="yes-display-inline">subject matter experts from components of the Directorate, including the Offices of Grants and Planning, Training and Exercises, Public and Community Preparedness, Infrastructure Protection, Response, and Recovery;</text></clause> <clause id="H58814FCD9E6D4A3900C4B3943B336CC4" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">subject matter experts from other components of the Department, including the Coast Guard, United States Customs and Border Protection, Immigration and Customs Enforcement, the Transportation Security Administration, and the United States Secret Service;</text></clause> <clause id="H42B3A8EBB6AD49E59EC73785E4765502" commented="no"><enum>(iv)</enum><text>subject matter experts representing emergency response providers and emergency response support providers; and</text></clause> <clause id="HCC7943FB59AB43FD91B94F59237E8DD"><enum>(v)</enum><text>subject matter experts from the private sector.</text></clause></subparagraph> <subparagraph id="H7EE4E306949A4F018FB7F3827CE88FE9" commented="no"><enum>(B)</enum><text>State, local, and tribal governments within the geographic area served by the Regional Office shall appoint officials, including Adjutants General and emergency managers, as members of the Advisory Council.</text></subparagraph> </paragraph> <paragraph id="H6A5C261286034DCD8CE6B50AC2153F8"><enum>(3)</enum><header>Terms of office</header> <subparagraph id="HB378A6EB2184432286D7DD42FBB7C200"><enum>(A)</enum><header>In general</header><text>The term of office of each member of the Advisory Council shall be 3 years.</text></subparagraph> <subparagraph id="H46D541EA03154512B29326B200FEFF6C"><enum>(B)</enum><header>Initial appointments</header><text>Of the members initially appointed to the Advisory Council—</text> <clause id="HFB46BE3CB38B44018EFC88440751F8A1"><enum>(i)</enum><text>one third shall be appointed for a term of 1 year; and</text></clause> <clause id="HD846E8C988E94A3D82AF74682B46485B"><enum>(ii)</enum><text>one third shall be appointed for a term of 2 years.</text></clause></subparagraph></paragraph> <paragraph id="H9C1156089B6F42A88DBB24226DDAAAB"><enum>(4)</enum><header>Chair</header><text>At the first meeting of the Advisory Council, the members of the Advisory Council appointed under paragraph (2) shall elect a chair of the Advisory Council.</text></paragraph> <paragraph id="H95B1CA21B661401CA053231744A7E400"><enum>(5)</enum><header>Meetings</header><text>The Advisory Council shall meet at least biennially at the call of the chair. Each member shall be given appropriate notice of the call of each meeting, whenever possible not less than 15 days before the meeting.</text></paragraph> <paragraph id="H36FD6DD5AFB74D03B69EDE3DD993DD64"><enum>(6)</enum><header>Regional factors</header><text>The size and composition of each Advisory Council shall be determined by—</text> <subparagraph id="HFCD26038DE6E48A9877E00CD48899CFA"><enum>(A)</enum><text>the size of the region associated with the Advisory Council;</text></subparagraph> <subparagraph id="HD780FDBD8DB84A25AC889F2936F098C8"><enum>(B)</enum><text>the propensity of that region to experience natural disasters and other emergencies;</text></subparagraph> <subparagraph id="H6DB31067543D459FA9D555C0B7C88D49"><enum>(C)</enum><text>the risk of acts of terrorism within the region; and</text></subparagraph> <subparagraph id="H35FBF8A167E842F4A978435C60F81F2F"><enum>(D)</enum><text>State, local, and tribal preparedness, as measured against the National Preparedness Goal.</text></subparagraph></paragraph> <paragraph id="H63188A3340214100A0D5C144240447A4"><enum>(7)</enum><header>Responsibilities</header><text>The Advisory Council shall carry out the following responsibilities:</text> <subparagraph id="H889AE9B0F8E24E9400931206B3CA7D1C"><enum>(A)</enum><text>Advise the Regional Director on emergency management issues specific to that region.</text></subparagraph> <subparagraph id="H7DCCFD26E63B43B488EC91E3302290E6"><enum>(B)</enum><text>Identify any geographic, demographic, or other characteristics peculiar to any State, local, or tribal government within the region that might make preparedness, mitigation, response, or recovery more complicated or difficult.</text></subparagraph> <subparagraph id="H30528DB5ECAC4E8CAC40FE9395756700"><enum>(C)</enum><text>Advise the Regional Director on developing a process of peer review for catastrophic emergency plans submitted under section 524.</text></subparagraph> <subparagraph id="HFADD3611B64B49EFB140E18DAE754194"><enum>(D)</enum><text>Advise the Regional Director of any weaknesses or deficiencies in preparedness, mitigation, response, and recovery for any State, local, or tribal government within the region of which the Advisory Council is aware.</text></subparagraph> <subparagraph id="H7FB19CB280334E1D98477EB0A14269DE"><enum>(E)</enum><text>Provide recommendations on other matters pertaining to emergency management.</text></subparagraph> <subparagraph id="H6616870F73DE446EAAEF3D6C8D7D4CA4"><enum>(F)</enum><text>Provide such advice as the Regional Director requests.</text></subparagraph></paragraph></subsection> <subsection id="HA1D719D9F2A8490799BF0100EB17AA34"><enum>(f)</enum><header>Coordination</header><text>Each Regional Director for Emergency Management shall coordinate all activities conducted under this section with other Federal departments and agencies, and shall not have authority over other agencies of the Department, including the Coast Guard, the United States Customs and Border Protection, Immigration and Customs Enforcement, the Transportation Security Administration, or the United States Secret Service.</text></subsection> <subsection id="H145A76EB1ED74ADA9B949D23404600D2"><enum>(g)</enum><header>Retention of authorities</header> <paragraph id="H94724BA5E05C4055B15510E69467682E"><enum>(1)</enum><header>Federal Coordinating Officer</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as affecting any authority of the Federal Coordinating Officer under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5201">42 U.S.C. 5201 et seq.</external-xref>).</text></paragraph> <paragraph id="HE9AB76E46DD94B16B9D734A5B50A1BC"><enum>(2)</enum><header>State, local, and tribal governments</header><text>Nothing in this section shall be construed as limiting the power of State, local, and tribal governments.</text></paragraph></subsection> <subsection id="H84216D9B9B0149FB936E7852F96B44BB" display-inline="no-display-inline"><enum>(h)</enum><header>Deadline and use of existing offices</header> <paragraph id="H15708FE941E84F1B8F92373E95E3D2C3"><enum>(1)</enum><header>Deadline</header><text>The Secretary shall establish the Regional Offices required under this section not later than one year after the date of the enactment of <short-title>National Emergency Management Reform and Enhancement Act of 2006</short-title>.</text></paragraph> <paragraph id="H2D0DA00579F348F6B4C840E572828468"><enum>(2)</enum><header>Use of existing field offices</header><text display-inline="yes-display-inline">In establishing the Regional Offices required under this section, the Secretary shall, to the extent practicable, co-locate and consolidate field offices of the Department that are in existence as of the date of the enactment of such Act and use the regional offices of the Federal Emergency Management Agency that are in existence as of that date as the foundation for the Regional Offices required under this section. </text></paragraph></subsection> </section> <section id="H1F00C97B3F2349A0B3B453CB7F89BC69" display-inline="no-display-inline"><enum>505.</enum><header>Chief Medical Officer</header> <subsection id="HFD12F4913DCE4E37BFCF64A84DC456EE"><enum>(a)</enum><header>In general</header><text>There is in the Department a Chief Medical Officer, who shall be appointed by the President, by and with the advice and consent of the Senate. The Chief Medical Officer shall report directly to the Under Secretary for Emergency Management.</text></subsection> <subsection id="H9AC1D71A4AFC416300FB38626DAA0866"><enum>(b)</enum><header>Responsibilities</header><text>The Chief Medical Officer shall have the primary responsibility within the Department for medical issues related to acts of terrorism, natural disasters, and other emergencies, including the following:</text> <paragraph id="HBAD777158EA94ADA864585A4A5C7231"><enum>(1)</enum><text>Serving as the Secretary's principal advisor on medical and public health issues.</text></paragraph> <paragraph id="H112B5DD9A6C74DAAB1212647FF7EDD2F"><enum>(2)</enum><text>Coordinating the biosurveillance and detection activities of the Department.</text></paragraph> <paragraph id="H5FE73F63EC244F989353201B36F1CA2E"><enum>(3)</enum><text>Ensuring that decision support tools link biosurveillance and detection information to near real-time response actions at the State, local, and tribal level.</text></paragraph> <paragraph id="H22B186F35E3B466C8D699469C39C834C"><enum>(4)</enum><text>Ensuring internal and external coordination of all medical preparedness and response activities of the Department, including training, exercises, and equipment support.</text></paragraph> <paragraph id="H9FF483EC1DE04F9A00CFE5F30881C323"><enum>(5)</enum><text>Serving as the Department's primary point of contact with the Departments of Agriculture, Defense, Health and Human Services, Transportation, and Veterans Affairs, and other Federal departments or agencies, on medical and public health issues.</text></paragraph> <paragraph id="H90FAF06D4B6B47A884CCC66E2992782B"><enum>(6)</enum><text>Serving as the Department’s primary point of contact with respect to medical and public health matters.</text></paragraph> <paragraph id="H940DD12F18504A39A9B858DEF2FF742F"><enum>(7)</enum><text>Discharging, in coordination with the Under Secretary for Science and Technology, responsibilities of the Department related to Project Bioshield.</text></paragraph> <paragraph id="H3164BDD3366249899B6C7453355300F"><enum>(8)</enum><text>Establishing doctrine and priorities for the National Disaster Medical System and supervising its medical components, consistent with the National Response Plan and the National Incident Management System.</text></paragraph> <paragraph id="H44BD339B44F74F0E90D35B4E338EDE2F"><enum>(9)</enum><text>Establishing doctrine and priorities for the Metropolitan Medical Response System, consistent with the National Response Plan and the National Incident Management System.</text></paragraph> <paragraph id="HCD6E59D81F89478298F992E9B0D85DE"><enum>(10)</enum><text>Assessing and monitoring long-term health issues of emergency response providers and emergency response support providers.</text></paragraph> <paragraph id="HC1C17A63008C40EDBBA3CF5020B94DB0"><enum>(11)</enum><text>Developing and updating guidelines for State, local, and tribal governments for medical response plans for chemical, biological, radiological, nuclear, or explosive weapon attacks.</text></paragraph> <paragraph id="H9F10421BBC5A4454BD5932604FEDF843"><enum>(12)</enum><text>Identifying, in consultation with the Secretary of Health and Human Services, appropriate medical equipment and supplies for inclusion in the force packages under the Prepositioned Equipment Program under section 581.</text></paragraph> <paragraph id="HDDEE4A0606FD4A4AB7BECE87CF365F56"><enum>(13)</enum><text>Performing such other duties relating to such responsibilities as the Secretary may require.</text></paragraph></subsection> <subsection id="H715073E0FC444362ADD725D448629D37"><enum>(c)</enum><header>Deputy</header><text>There is in the Department a Deputy Chief Medical Officer, who shall be appointed by the Secretary and who shall assist the Chief Medical Officer in carrying out the responsibilities under subsection (b).</text></subsection> <subsection id="HA8184102F97643778DD87C9164CA42CE"><enum>(d)</enum><header>Long-term health assessment program</header> <paragraph id="H23A91D494CDD44C98B318F40A21E3356"><enum>(1)</enum><header>In general</header><text>The Chief Medical Officer, in consultation with the Director of the National Institute for Occupational Safety and Health, shall establish a program to assess, monitor, and study the health and safety of emergency response providers and emergency response support providers following Incidents of National Significance declared by the Secretary under the National Response Plan.</text></paragraph> <paragraph id="H9E16B5758554448600E0CCC81FB9F390"><enum>(2)</enum><header>Cooperative agreements</header><text>In carrying out the program under this subsection, the Chief Medical Officer shall enter into cooperative agreements, as necessary, with medical institutions in the areas affected by such Incidents of National Significance.</text></paragraph></subsection></section> <section id="HF88528CCB1A04C50A850F25F31BD9485"><enum>506.</enum><header>Office of State, Local, and Tribal Government Coordination</header> <subsection id="HE5D51BC5396143BF9E79D85C357094A"> <enum>(a)</enum> <header>Establishment</header> <text>There is in the Directorate of Emergency Management an Office of State, Local, and Tribal Government Coordination to oversee and coordinate programs of the Directorate for and relationships with national organizations representing State, local, and tribal governments.</text></subsection> <subsection id="H05E713A66FD54CF3AA96B4897DA86F4C"><enum>(b)</enum><header>Director</header><text>The Office shall be headed by a Director, who shall be appointed by the Secretary.</text> </subsection> <subsection id="H8CC6CB557E60402C86AEA9CE32786156"> <enum>(c)</enum> <header>Responsibilities</header> <text display-inline="yes-display-inline">The Director of the Office of State, Local, and Tribal Government Coordination shall, in consultation with the Regional Directors for Emergency Management appointed under section 504(b), carry out the following responsibilities:</text> <paragraph id="H425172505FB044788FBA82973FD09472"> <enum>(1)</enum> <text>Coordinating the activities of the Directorate relating to State, local, and tribal government.</text> </paragraph> <paragraph id="H9DEAED78AA8C4F7EA53F6F7697CD4DDC"> <enum>(2)</enum> <text display-inline="yes-display-inline">Assessing and advocating for the resources needed by State, local, and tribal governments to prevent, prepare for, respond to, mitigate against, and recover from acts of terrorism, natural disasters, and other emergencies.</text> </paragraph> <paragraph id="HB86012FDA7194D1C9CA5007DA1FAC699"> <enum>(3)</enum> <text display-inline="yes-display-inline">Providing State, local, and tribal governments with regular information, research, and technical support to assist local efforts in securing the homeland.</text> </paragraph> <paragraph id="H8B6050C3070E42C3A3007DD9B7F5F8D"> <enum>(4)</enum> <text display-inline="yes-display-inline">Developing a process for receiving meaningful and timely consultation from State, local, and tribal governments to assist in the development of an integrated national emergency management system.</text></paragraph> <paragraph id="H68AEE70F88C14579A8A31F59F6FEC04"><enum>(5)</enum><text>Scheduling regular meetings with representatives selected by State, local, and tribal governments.</text></paragraph> <paragraph id="H23EF45558E874552807181265F000032"><enum>(6)</enum><text>Ensuring the coordination of the planning and reporting requirements imposed on State, local, and tribal governments by the Directorate.</text> </paragraph> </subsection></section> <section id="H9B8F4DCE3290471200BBDB686231FB86" display-inline="no-display-inline" section-type="subsequent-section"><enum>507.</enum><header>Office of National Capital Region Coordination</header> <subsection id="H5DEFF0365FA048D4AF946F0315A5C05E"> <enum>(a)</enum> <header>Establishment</header> <paragraph id="H118D309A8454480F8EADE24C018781C8"> <enum>(1)</enum> <header>In general</header> <text>There is in the Directorate of Emergency Management the Office of National Capital Region Coordination, to oversee and coordinate Federal programs for and relationships with State, local, and regional authorities in the National Capital Region, as defined under <external-xref legal-doc="usc" parsable-cite="usc/10/2674">section 2674(f)(2)</external-xref> of title 10, United States Code.</text> </paragraph> <paragraph id="HA48A64DC285B49B9803CADFD3760C504"> <enum>(2)</enum> <header>Director</header> <text>The Office shall be headed by a Director, who shall be appointed by the Secretary. The Director shall report directly to the Under Secretary for Emergency Management.</text> </paragraph> <paragraph id="H688ACE4D0DED40FE9540F77E134E5732"> <enum>(3)</enum> <header>Cooperation</header> <text>The Secretary shall cooperate with the Mayor of the District of Columbia, the Governors of Maryland and Virginia, and other State, local, and regional officers in the National Capital Region to integrate the District of Columbia, Maryland, and Virginia into the planning, coordination, and execution of the activities of the Federal Government for the enhancement of domestic preparedness for acts of terrorism, natural disasters, and other emergencies.</text> </paragraph> </subsection> <subsection id="H030D355245D04C768D3FCC2BD43E1E81"> <enum>(b)</enum> <header>Responsibilities</header> <text>The Director of the Office of National Capital Region Coordination shall carry out the following responsibilities:</text> <paragraph id="H6F7A2A27F8A843989CC18B8DA93C1DC2"> <enum>(1)</enum> <text>Overseeing and coordinating the activities of the Department relating to the National Capital Region, including cooperation with the Office for State, Local, and Tribal Government Coordination.</text> </paragraph> <paragraph id="H635BC1C4DBD04C2B9206AB6ECA325DBB"> <enum>(2)</enum> <text>Assessing and advocating for the resources needed by State, local, and regional authorities in the National Capital Region to implement efforts to secure the homeland.</text> </paragraph> <paragraph id="H34997C5A0B0F40848971A951E107725E"> <enum>(3)</enum> <text>Providing State, local, and regional authorities in the National Capital Region with regular information, research, and technical support to assist the efforts of State, local, and regional authorities in the National Capital Region in securing the homeland.</text> </paragraph> <paragraph id="H7B2CCB7AD8A6481E962FB100F3F42E13"> <enum>(4)</enum> <text>Developing a process for receiving meaningful input from State, local, and regional authorities and the private sector in the National Capital Region to assist in the development of the homeland security plans and activities of the Federal Government.</text> </paragraph> <paragraph id="H9BE2B0FF2B7045138F97BB70B16E00DC"> <enum>(5)</enum> <text>Coordinating with Federal agencies in the National Capital Region on emergency preparedness to ensure adequate planning, information sharing, training, and execution of the Federal role in domestic preparedness activities.</text> </paragraph> <paragraph id="HEC4A9EFAAA92409FADC4212B4CCE3D19"> <enum>(6)</enum> <text>Coordinating with Federal, State, local, and regional agencies and private sector entities in the National Capital Region on emergency preparedness to ensure adequate planning, information sharing, training, and execution of domestic preparedness activities among such agencies and entities.</text> </paragraph> <paragraph id="H32E8E4926CE5472682DB23D9F77BFF5E"> <enum>(7)</enum> <text>Serving as a liaison between the Federal Government and State, local, and regional authorities and private sector entities in the National Capital Region to facilitate access to Federal grants and other programs.</text> </paragraph> </subsection> <subsection id="HFB2ECB4D2CD04A39AF9D1DAA64CDA34E"> <enum>(c)</enum> <header>Annual Report</header> <text>The Director shall submit to Congress an annual report that includes the following:</text> <paragraph id="H29F5A1E1D6F74B2FB17436657EC97C02"> <enum>(1)</enum> <text>The identification of any resources required to fully implement homeland security efforts in the National Capital Region.</text> </paragraph> <paragraph id="HFFD32E9B14D842A486006C950297EEBE"> <enum>(2)</enum> <text>An assessment of the progress made by the National Capital Region in implementing homeland security efforts.</text> </paragraph> <paragraph id="HD863E0A226F5440B99D4F95C118FBDAE"> <enum>(3)</enum> <text>The recommendations of the Director with respect any additional resources needed to fully implement homeland security efforts in the National Capital Region.</text> </paragraph> </subsection> <subsection id="H0D65A87D945B4532A17FA18B51EFFBAA"> <enum>(d)</enum> <header>Limitation</header> <text>Nothing in this section shall be construed as limiting the power of any State, local, or tribal government.</text></subsection></section> <section id="H2E9C54BD760F41CD8E66E17DE03BAB"><enum>508.</enum><header>National Advisory Council on Emergency Management</header> <subsection id="H664D05E76F8247EC96C2E103E4961200"><enum>(a)</enum><header>Establishment</header><text>Not later than 60 days after the date of the enactment of this section, the Secretary shall establish an advisory body pursuant to section 871(a), to be known as the National Advisory Council on Emergency Management.</text></subsection> <subsection id="H395569D470D648A4A8C7D6419BAC47ED"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Advisory Council shall assist the Secretary in implementing subsection (c).</text></subsection> <subsection id="HC0D69057554D4037B678EF16122CB33"><enum>(c)</enum><header>Requirement to review, revise, or replace certain documents</header><text display-inline="yes-display-inline">The Secretary shall periodically, but not less than biennially, review, revise, or replace—</text> <paragraph id="HE6DF272DD5614DDAB335CA3ACBA0084"><enum>(1)</enum><text>the National Response Plan;</text></paragraph> <paragraph id="HEEBAECDC69BE4E3AB9F65FE2FEBE1486"><enum>(2)</enum><text>the National Incident Management System;</text></paragraph> <paragraph id="HE01DE4B269CE43D596CEB8FD4DD34100"><enum>(3)</enum><text>the National Preparedness Guidance;</text></paragraph> <paragraph id="H71B3524338494792A9C78B0090DE24A1"><enum>(4)</enum><text>the National Preparedness Goal;</text></paragraph> <paragraph id="H3873D9F12882413D854006D695F3DA2B"><enum>(5)</enum><text>the Targeted Capabilities List;</text></paragraph> <paragraph id="HCBCA5EDA86844F6E8CDB7F14E61C499F"><enum>(6)</enum><text>the Universal Task List;</text></paragraph> <paragraph id="HA6D17E885FAD412C9217052E52BCEF03"><enum>(7)</enum><text>the National Infrastructure Protection Plan;</text></paragraph> <paragraph id="H1D81610D92DB4D149235885CB452ED30"><enum>(8)</enum><text>the National Planning Scenarios;</text></paragraph> <paragraph id="H580C635C081B4A539BB8BEA6943B1E9"><enum>(9)</enum><text>any successor to any document under any of paragraphs (1) through (8); and</text></paragraph> <paragraph id="H59F7907FD90245CE8C749E6419E295B"><enum>(10)</enum><text>any other national initiatives on acts of terrorism, natural disasters, and other emergencies that affects emergency response providers and emergency response support providers as necessary.</text></paragraph></subsection> <subsection id="H3C3389D0F9FC4CAEAE44DEF0ABCCB23"><enum>(d)</enum><header>Report</header> <paragraph id="H9F8C3036D1EA4764BB6665C4924B85B2"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which the Advisory Council is established under subsection (a), and not later than every 2 years thereafter, the Advisory Council shall submit to the Secretary a report on the recommendations of the Advisory Council for reviewing, revising, or replacing such national initiatives.</text></paragraph> <paragraph id="HD72820CB48C747E1A18CE2165B3E2ECA"><enum>(2)</enum><header>Contents</header><text>Each report shall—</text> <subparagraph id="HD6861A53A4FB4C7CABC0AE36A53EF4E0"><enum>(A)</enum><text>include a priority ranking of essential capabilities for emergency preparedness in order to provide guidance to the Secretary and to the Congress on determining the appropriate allocation of, and funding levels for, the needs of emergency response providers;</text></subparagraph> <subparagraph id="H692EEA0787FC461C9870317B87C7D13D"><enum>(B)</enum><text display-inline="yes-display-inline">set forth a methodology by which any State, local, or tribal government will be able to determine the extent to which it possesses or has access to the essential capabilities that State, local, and tribal governments having similar risks should obtain;</text></subparagraph> <subparagraph id="H89AE56593B6444BFB3B547658BF02BA5"><enum>(C)</enum><text>describe the availability of national voluntary consensus standards, and whether there is a need for new national voluntary consensus standards, with respect to training and equipment for emergency response providers;</text></subparagraph> <subparagraph id="HA8075BD0E36944DEA230A445193DF300"><enum>(D)</enum><text>include such additional matters as the Secretary may specify in order to further the emergency preparedness capabilities of emergency response providers; and</text></subparagraph> <subparagraph id="H19E0BDA7171047408BBD5E9D04C3B8"><enum>(E)</enum><text display-inline="yes-display-inline">include such revisions to the contents of previous reports as are necessary to take into account changes in the most current risk assessment prepared by and available from the Chief Intelligence Officer and the Assistant Secretary for Infrastructure Protection or other relevant information as determined by the Secretary.</text> </subparagraph></paragraph> <paragraph id="HFE4AAA58E48145ACB6E4635EEF84E0C2"><enum>(3)</enum><header>Consistency with Federal working group</header><text>The Advisory Council shall ensure that its recommendations for essential capabilities for emergency preparedness are, to the extent feasible, consistent with any preparedness goals or recommendations of the Federal working group established under section 319F(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6">42 U.S.C. 247d–6(a)</external-xref>).</text></paragraph> </subsection> <subsection id="H47C03B392F8B4FD9B49546EDC9F6D81E" display-inline="no-display-inline"><enum>(e)</enum><header>Membership</header> <paragraph id="H553EAE0B267A4668A09C586DF327E3AF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Advisory Council shall consist of 30 members appointed by the Secretary, and shall, to the extent practicable, represent a geographic (including urban and rural) and substantive cross section of emergency managers, emergency response providers, and emergency response support providers from State, local, and tribal governments, including as appropriate—</text> <subparagraph id="H9E7E94CEB8F44F6E9B23002B712B0259"><enum>(A)</enum><text>members selected from the emergency management and response fields, including fire service, law enforcement, hazardous materials response, emergency medical services, and emergency management personnel;</text></subparagraph> <subparagraph id="H383F32B6151B4B7D8BBA47D333756592"><enum>(B)</enum><text>health scientists, emergency and inpatient medical providers, and public health professionals, including—</text> <clause id="HF255FA7076DD4A0EA8CDC5ADB4009D54"><enum>(i)</enum><text>experts in emergency health care response to chemical, biological, radiological, and nuclear terrorism;</text></clause> <clause id="H69CF94866D5B4A3DA654542938872756"><enum>(ii)</enum><text>experts in providing mental health care during emergency response operations; and</text></clause> <clause id="HD6BD830E86C14DEEA8F2BDFBAD889447"><enum>(iii)</enum><text>experts in stockpiling medical equipment and supplies and medical logistics;</text></clause></subparagraph> <subparagraph id="H53BDECE6CB6A4E838D8FE14B797D417F"><enum>(C)</enum><text>experts from Federal, State, and local governments, and the private sector, representing standards-setting organizations, including representation from the voluntary consensus codes and standards development community, particularly those with expertise in the emergency preparedness and response field;</text></subparagraph> <subparagraph id="HA133C2FAA0F54D1BA9546200DC36C772"><enum>(D)</enum><text>State and local officials with expertise in terrorism preparedness and emergency management, including Adjutants General, subject to the condition that if any such official is an elected official representing one of the two major political parties, an equal number of elected officials shall be selected from each such party; and</text></subparagraph> <subparagraph id="H7D053A2E45E044418D83B865E9F8F062"><enum>(E)</enum><text>members selected from the emergency response support field, including public works, utilities, and transportation personnel who are routinely engaged in emergency response.</text></subparagraph></paragraph> <paragraph id="H3DB5836334A84E13899DC99F6FE4B218"><enum>(2)</enum><header>Coordination with the Departments of Health and Human Services and Transportation</header><text>In the selection of members of the Advisory Council who are health or emergency medical services professionals, the Secretary shall coordinate such selection with the Secretaries of Health and Human Services and Transportation.</text></paragraph> <paragraph id="H56D16A06227E43C893681627D19EB7D0"><enum>(3)</enum><header>Ex officio members</header><text>The Secretary and the Secretary of Health and Human Services shall each designate one or more officers of their respective Department to serve as ex officio members of the Advisory Council. One of the ex officio members from the Department of Homeland Security shall be the designated officer of the Federal Government for purposes of subsection (e) of <external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /10">section 10</external-xref> of the Federal Advisory Committee Act (5 App. U.S.C.).</text></paragraph> <paragraph id="H476AC22740584954B268DE7F54183F89"><enum>(4)</enum><header>Terms of office</header> <subparagraph id="H33B9C499E6D54880966D1594BDAC12E"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term of office of each member of the Advisory Council shall be 3 years.</text></subparagraph> <subparagraph id="H641D0102357F4496B08CE86F143D2EEB"><enum>(B)</enum><header>Initial appointments</header><text>Of the members initially appointed to the Advisory Council——</text> <clause id="H8C45A6E30100474386C925F88E556859"><enum>(i)</enum><text>one third shall be appointed for a term of 1 year; and</text></clause> <clause id="H7538F882C6D64E7785A747A4B7ACFF1D"><enum>(ii)</enum><text>one third shall be appointed for a term of 2 years.</text></clause></subparagraph></paragraph></subsection> <subsection id="H21217FD9FAF143D08F7FBDD46CC3668" display-inline="no-display-inline"><enum>(f)</enum><header>Applicability of Federal Advisory Committee Act</header> <paragraph id="HAA3A565BDD6A4820867001667D4D8EBF"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 871(a) and subject to paragraph (2), the Federal Advisory Committee Act (5 U.S.C. App.), including subsections (a), (b), and (d) of section 10 of such Act, and <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b(c)</external-xref> of title 5, United States Code, shall apply to the Advisory Council.</text></paragraph> <paragraph id="H4FB9F80046654360839F0322511F4E74"><enum>(2)</enum><header>Termination</header><text>Section 14(a)(2)(B) of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Council.</text></paragraph></subsection></section> <section id="H4245332C86FC4C62A1D4E91329048F00"><enum>509.</enum><header>Reorganization of Directorate</header><text display-inline="no-display-inline">The Secretary may not allocate or reallocate functions among the officers of the Directorate of Emergency Management or establish, consolidate, alter, or discontinue organizational units within the Directorate of Emergency Management under the authority of section 872 until the date that is 120 days after the date on which the Secretary submits to Congress a report describing the proposed allocation, reallocation, establishment, consolidation, alteration or discontinuance.</text> </section></subtitle> <subtitle id="HB16F55385874438182F2062F67DA08A7"><enum>B</enum><header>Emergency Preparedness</header> <section id="H18560CF8BA5A4E8299F2E3FD618B70E7"><enum>521.</enum><header>Office of Grants and Planning</header> <subsection id="HC4AAD6D60C6E4DFFAEFCC384C9068663"><enum>(a)</enum><header>In general</header><text>There is in the Department an Office of Grants and Planning under the authority of the Under Secretary for Emergency Management.</text></subsection> <subsection id="HBFBE0E1E014C4B97B44F7500E1FDE7B"><enum>(b)</enum><header>Assistant Secretary</header><text>The head of the office shall be the Assistant Secretary for Grants and Planning.</text></subsection> <subsection id="H51ECF67EC592469189D16FC9647FF66F"><enum>(c)</enum><header>Responsibilities</header><text>The Assistant Secretary for Grants and Planning shall carry out the following responsibilities:</text> <paragraph id="H60B4904D13D0467EAB2C26819DDC121B"><enum>(1)</enum><text display-inline="yes-display-inline">Administering Department grant programs that enhance the capacity of State, regional, local, and tribal governments to prevent, prepare for, mitigate against, respond to, and recover from acts of terrorism, natural disasters, and other emergencies.</text></paragraph> <paragraph id="HE326A8F17AED4079A4C5C1A588D02711"><enum>(2)</enum><text>Ensuring coordination of the homeland security assistance programs of the Federal Government.</text></paragraph> <paragraph id="H0323A39D1E2D4F488D68755361051391"><enum>(3)</enum><text>Establishing incentives for the efficient administration of Federal homeland security assistance.</text></paragraph> <paragraph id="H4FE91D6E313F4CA48B45C700A7E209F5"><enum>(4)</enum><text>Evaluating the effectiveness of funded Department programs and disseminating lessons learned, as appropriate.</text></paragraph> <paragraph id="H309D4B8863544320B692070068AF2AC"><enum>(5)</enum><text>Reviewing and revising, in consultation with the NIC (as that term is used in section 541) and the National Advisory Council on Emergency Management, on a periodic basis, but not less than biennially, preparedness documents and capabilities-based planning tools, related to catastrophic acts of terrorism, natural disasters, and other emergencies, including—</text> <subparagraph id="HE9C70E2169924D12B955D55CA47800EC"><enum>(A)</enum><text>the National Preparedness Goal;</text></subparagraph> <subparagraph id="H3284E8265B4C4E529DC856C4AAEC3F00"><enum>(B)</enum><text>the Targeted Capabilities List;</text></subparagraph> <subparagraph id="H4A77309D79264F8C8662007F976F8B45"><enum>(C)</enum><text>the Universal Task List;</text></subparagraph> <subparagraph id="H207A1F8209924D548C9C9361C3A0F1EF"><enum>(D)</enum><text>the National Planning Scenarios; and</text></subparagraph> <subparagraph id="H960379E788A84684B02B96C2F9E1F1E"><enum>(E)</enum><text>any other document or tool in support of Homeland Security Presidential Directive 8 or any other Homeland Security Presidential Directive related to the national emergency management system.</text></subparagraph></paragraph> <paragraph id="H8B8086FBCD1E4B259985D1D1E1B6D500"><enum>(6)</enum><text>Establishing, in coordination with State, local, and tribal governments, a clear and accountable process for achieving, maintaining, and enhancing national preparedness for catastrophic acts of terrorism, natural disasters, and other emergencies.</text></paragraph> <paragraph id="H019C76EA6A10499BA716DC27B405C220"><enum>(7)</enum><text>Providing technical assistance to State, local, and tribal governments on catastrophic planning and preparedness.</text></paragraph> <paragraph id="HAAF79CA700354CD28240A07F9F33D1B1"><enum>(8)</enum><text>Developing performance measures and metrics for assessing national preparedness.</text></paragraph> <paragraph id="HD1B5879E754645FCAEC86B69ED0245A7"><enum>(9)</enum><text>Assessing, on a periodic basis, but not less than annually, the effectiveness of preparedness capabilities at the Federal, State, local, and tribal levels.</text></paragraph> <paragraph id="H74F357F3E9954AB987AA398CA53EB0E9"><enum>(10)</enum><text>Developing priorities for Federal homeland security assistance to State, local, and tribal governments on the basis of such periodic assessments.</text></paragraph> <paragraph id="HCFABCA0AF3404C98A300FBFE753B42"><enum>(11)</enum><text>Implementing a shared resource planning system to facilitate collaborative plan development.</text></paragraph> <paragraph id="HC309062241564AC7B6CFFEF4EDC9202"><enum>(12)</enum><text>Reviewing, in coordination with appropriate Federal departments and agencies, all Federal preparedness activities.</text></paragraph> <paragraph id="H9C1849E0D81443C896576D6CEF905720"><enum>(13)</enum><text>Performing such other duties relating to such responsibilities as the Secretary may require.</text></paragraph></subsection> <subsection id="H66834694C1F642E7B1556F279D6DE7CA"><enum>(d)</enum><header>Annual status reports</header><text>Not later than 60 days after the last day of each fiscal year, the Secretary shall provide to Congress a status report on the Nation’s level of preparedness during that fiscal year, including State, local, and tribal capabilities, the readiness of Federal response assets, the utilization of mutual aid, and an assessment of how the Federal homeland security assistance programs support the National Preparedness Goal.</text></subsection></section> <section id="HBB3076CD5922478D95EDB8BE95F30916"><enum>522.</enum><header>Office of Training and Exercises</header> <subsection id="HE92969BFD1204F7F9F72179C67471443"><enum>(a)</enum><header>In general</header><text>There is in the Department an Office of Training and Exercises under the authority of the Under Secretary for Emergency Management.</text></subsection> <subsection id="H2C789F5E19EA4B3AA372C8EBC2551BB"><enum>(b)</enum><header>Assistant Secretary</header><text>The head of the office shall be the Assistant Secretary for Training and Exercises.</text></subsection> <subsection id="HF768E75D58FB456800F9BD7C366F1B4E"><enum>(c)</enum><header>Responsibilities</header><text>The Assistant Secretary for Training and Exercises shall—</text> <paragraph id="HA0C3CB1E05294477AC54514620B18C29"><enum>(1)</enum><text>establish specific requirements for training programs and exercises for Federal, State, regional, local, and tribal government officials, emergency response providers, emergency response support providers, and other entities as appropriate;</text></paragraph> <paragraph id="H1035F6E53ADF4AB6BB6393ADC0D6AEA4"><enum>(2)</enum><text>design, develop, perform, and evaluate training programs and exercises at all levels of government to enhance and test the Nation’s capability to prevent, prepare for, mitigate against, respond to, and recover from threatened or actual acts of terrorism, natural disasters, and other emergencies;</text></paragraph> <paragraph id="H001A77D35047436BACED902DD208EF30"><enum>(3)</enum><text>establish common supporting methodology for training programs and exercises;</text></paragraph> <paragraph id="H4080CD320D6A451FBAF6D8C9276867FA"><enum>(4)</enum><text>define and implement performance measures for training programs and exercises;</text></paragraph> <paragraph id="H5D6612F62C324E04B746908FAF60926C"><enum>(5)</enum><text>coordinate the training and exercise activities of the Department;</text></paragraph> <paragraph id="H2A59D300DC634D1BBED08DF8642B717D"><enum>(6)</enum><text>serve as the primary point of contact in the Department for homeland security training and exercises for other Federal departments and agencies;</text></paragraph> <paragraph id="H28326AE8A5E14E06B425C9B6182F49B7"><enum>(7)</enum><text>identify, analyze, and monitor the implementation of best practices and lessons learned with respect to training and exercises;</text></paragraph> <paragraph id="HF11DB587311D49B89B927F2BCF935180"><enum>(8)</enum><text>establish a comprehensive program for the professional development and education of homeland security personnel at all levels of government, nongovernmental organizations, and emergency management personnel in the private sector; and</text></paragraph> <paragraph id="H8A4C39A484664D2F81524000003B2BC"><enum>(9)</enum><text>perform such other duties relating to such responsibilities as the Secretary may require.</text></paragraph></subsection> <subsection id="H66B1B42AA66F47E08F54EF597E7F1533"><enum>(d)</enum><header>Transfer</header><text>The Assistant Secretary for Training and Exercises shall have authority over the following:</text> <paragraph id="HC1E8033D22B04D4900752817F3098D09"><enum>(1)</enum><text>The Noble Training Center.</text></paragraph> <paragraph id="H53D5D0F8CA4448248D1C085BCC151DFF"><enum>(2)</enum><text>The Center for Domestic Preparedness.</text></paragraph> <paragraph id="H66DE3AADE2DF481E82BD9C3C914E62DC"><enum>(3)</enum><text>The National Emergency Training Center.</text></paragraph> <paragraph id="H984D7A0A51CC4289B15EECAA3DC3228E"><enum>(4)</enum><text>The National Exercise and Evaluation Program.</text></paragraph> </subsection> <subsection id="HC784394EF232431E8981CB3C27B2B7B"><enum>(e)</enum><header>National exercise program</header> <paragraph id="H271105AFEA5D4EA1A5C0F693D7B700CD"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Assistant Secretary for Training and Exercises, shall carry out a National Exercise Program for the purpose of testing, evaluating, and enhancing the capabilities of Federal, State, regional, local, and tribal government entities to prevent, prepare for, respond to, mitigate against, and recover from threatened or actual acts of terrorism, natural disasters, and other emergencies.</text></paragraph> <paragraph id="H9EF171E25F734D2BBCB51197127ED1"><enum>(2)</enum><header>Contents of Program</header><text>The National Exercise Program—</text> <subparagraph id="H35FBD96CBE2D4E24B0EA9694466C9252"><enum>(A)</enum><text>shall enhance coordination for preparedness between all levels of government, emergency response providers, emergency response support providers, nongovernmental organizations, international governments and organizations, and the private sector;</text></subparagraph> <subparagraph id="HCB4E02B5475B48FC92A26C4F9B2D12D4"><enum>(B)</enum><text>shall be—</text> <clause id="H24049E86E3BA4673A4C214397100B02F"><enum>(i)</enum><text>multi disciplinary in nature, including, as appropriate, information analysis and cybersecurity components;</text></clause> <clause id="H6FB65DF511214AD1AF9C916175B04061"><enum>(ii)</enum><text>as realistic as practicable and based on current risk assessments, including credible threats, vulnerabilities, and consequences;</text></clause> <clause id="H4FC7DF3F85A74C3F9F759BE947DF68C0"><enum>(iii)</enum><text>carried out with the minimum degree of notice to involved parties regarding the timing and details of such exercises, consistent with safety considerations;</text></clause> <clause id="H450B11BC8DFB452DA7EEBBC417E0AC72"><enum>(iv)</enum><text>evaluated against performance measures and followed by corrective action to solve identified deficiencies; and</text></clause> <clause id="H64D11057F12A4B209FDB3C2D05EDA3F0"><enum>(v)</enum><text>assessed to learn best practices, which the Secretary shall share with appropriate Federal, State, regional, local, and tribal personnel, authorities, and training institutions for emergency response providers and emergency response support providers; and</text></clause></subparagraph> <subparagraph id="HF340E78B0C9D45298548B127B69B60A"><enum>(C)</enum><text>shall provide assistance to State, regional, local, and tribal governments with the design, implementation, and evaluation of exercises that—</text> <clause id="H86FEDA86531A473995E4FBE08DC5558C"><enum>(i)</enum><text>conform to the requirements under subparagraph (B);</text></clause> <clause id="H31B4A87F06624DC5A8F71836AE667861"><enum>(ii)</enum><text>are consistent with any applicable State or urban area homeland security strategy or plan;</text></clause> <clause id="H78060F620452400DBE156F73EBB56DCB"><enum>(iii)</enum><text>support implementation of—</text> <subclause id="H39D909B77C9B46F8803F74F056814D86"><enum>(I)</enum><text>the National Incident Management System;</text></subclause> <subclause id="H7C7AC89FD1894DBD8C77C95393FAD1DA"><enum>(II)</enum><text>the National Response Plan;</text></subclause> <subclause id="H142EDFE043BF4FBCB947BF7EFC5EE363"><enum>(III)</enum><text>the National Preparedness Goal;</text></subclause> <subclause id="HF8B4031A3DF1405A8C764913882F5623"><enum>(IV)</enum><text>the National Preparedness Guidance;</text></subclause> <subclause id="HB3311A80BAD24D3CBECAA86CB1F64D1D"><enum>(V)</enum><text>the National Infrastructure Protection Plan; and</text></subclause> <subclause id="HBBF102B2340642F5903271CD77E5825"><enum>(VI)</enum><text>any other similar national initiatives; and</text></subclause></clause> <clause id="HD03733A3D08E4CC2A562017390A1C576"><enum>(iv)</enum><text>provide for systematic evaluation of readiness.</text></clause></subparagraph></paragraph> <paragraph id="H6CB56CCFEE994A2CA950311D8124D65F"><enum>(3)</enum><header>National level exercises</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary for Training and Exercises, shall periodically but not less than biennially, perform national exercises for the following purposes:</text> <subparagraph id="H99B9983CD1AC4276B07B40FFF5542977"><enum>(A)</enum><text>To involve in national exercises high-ranking officials from—</text> <clause id="H115B768445B74875B957001742D35013"><enum>(i)</enum><text>Federal, State, local, tribal, and international governments;</text></clause> <clause id="H76BAFCFE46FD48EBACA3D4795C92E5D4"><enum>(ii)</enum><text>nongovernmental organizations, including faith-based organizations;</text></clause> <clause id="H897239F7F30F454F82AF56E879B57824"><enum>(ii)</enum><text>the private sector; and</text></clause> <clause id="H3536B52B91D742299909ECF5E846615"><enum>(iv)</enum><text>others as the Secretary considers appropriate.</text></clause></subparagraph> <subparagraph id="H06BF905B9DDF470DB0457D5106DA1769"><enum>(B)</enum><text>To test and evaluate, in coordination with the Attorney General and the Secretary of Defense, the capability of Federal, State, local, and tribal government entities to detect, disrupt, and prevent threatened or actual catastrophic acts of terrorism, especially those involving weapons of mass destruction;</text></subparagraph> <subparagraph id="HE0319EDE5E2A46FF937BFB9D4895903E"><enum>(C)</enum><text display-inline="yes-display-inline">To test and evaluate the readiness of Federal, State, local, and tribal government entities to respond in a coordinated and unified manner to catastrophic acts of terrorism, natural disasters, and other emergencies; and</text></subparagraph> <subparagraph id="H9216F71F116B41B191395BEBE9B125AE"><enum>(D)</enum><text display-inline="yes-display-inline">To test and evaluate the readiness of Federal, State, local, and tribal government entities to recover from catastrophic acts of terrorism, natural disasters, and other emergencies.</text></subparagraph></paragraph> <paragraph id="H8594D2A252244EF290492625CA63E098"><enum>(4)</enum><header>Coordination and consultation</header><text>In carrying out the National Exercise Program, the Secretary shall—</text> <subparagraph id="HC15EEC1656EE41CFAAE2736A46ECEA7"><enum>(A)</enum><text>coordinate with—</text> <clause id="HDB08899B16B34B6DA026FF671CD91C00"><enum>(i)</enum><text>components of the Department that have expertise in exercises, including the Coast Guard, the United States Secret Service, United States Customs and Border Protection, and United States Immigration and Customs Enforcement; and</text></clause> <clause id="H448D620A2A774E04BD6CB0088211D586"><enum>(ii)</enum><text>such other Federal departments and agencies as the Secretary determines are appropriate; and</text></clause></subparagraph> <subparagraph id="H70FB93C8F6534257A28D14864F763190"><enum>(B)</enum><text>consult regularly with—</text> <clause id="H99DE441647474DF7B0569E3B291D2859"><enum>(i)</enum><text>a geographic and substantive cross section of emergency response providers and emergency response support providers (including such providers located in both urban and rural areas);</text> </clause> <clause id="H155E43FFC96E4924ABA6077FECB382"><enum>(ii)</enum><text>Federal, State, and local training institutions for emergency response providers and emergency response support providers; and</text></clause> <clause id="H1AD36D0638E84F34AB4B93317C76D700"><enum>(iii)</enum><text>State and local officials, including Adjutant Generals, with expertise in terrorism preparedness and emergency management.</text></clause></subparagraph> </paragraph> <paragraph id="H6C66F8C6805E40508CF930C407A5C4BE"><enum>(5)</enum><header>Top official prevention exercises</header><text>No later than one year after the date of enactment of the <short-title>National Emergency Management Reform and Enhancement Act of 2006</short-title>, the Secretary, acting through the Assistant Secretary for Training and Exercises, shall establish a program through which the Secretary carries out periodically but not less than biennially a national terrorism prevention exercise for the purposes of—</text> <subparagraph id="HB76836CDEEE64789AE64F1764FB19872"><enum>(A)</enum><text>involving in national exercises high-ranking officials from Federal, State, local, tribal, and international governments, as the Secretary considers appropriate; and</text></subparagraph> <subparagraph id="H2FB9604A10FF461FA67EE66327C1CED"><enum>(B)</enum><text display-inline="yes-display-inline">testing and evaluating, in coordination with the Attorney General and the Secretary of Defense, the capability of Federal, State, local, and tribal government entities to detect, disrupt, and prevent threatened or actual catastrophic acts of terrorism.</text></subparagraph></paragraph> <paragraph id="H4BF6E5C102994E4585DF5D12B1EA62E"><enum>(6)</enum><header>National exercise strategy</header><text>The Secretary, acting through the Assistant Secretary for Training and Exercises, shall develop a multi-year national homeland security exercise plan and submit the plan to the Homeland Security Council for review and approval.</text></paragraph></subsection> <subsection id="H1A8DFAF383E241ECB5B5C6AC272383B4"><enum>(f)</enum><header>National Training Program</header> <paragraph id="H822A66149D6345859E22865852AA07FC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary for Training and Exercises, shall carry out a National Training Program for the purpose of enhancing the capabilities of the Nation’s emergency response providers to prevent, prepare for, respond to, mitigate against, and recover from threatened or actual acts of terrorism, natural disasters, and other emergencies.</text></paragraph> <paragraph id="H7796801A56FE41ECA2E465B8ED55A742"><enum>(2)</enum><header>Requirements</header><text>The National Training Program shall provide training that—</text> <subparagraph id="HC1B2992ACF3A47988E7953A7276723D4"><enum>(A)</enum><text>reaches multiple disciplines, including Federal, State, and local government officials, emergency response providers, emergency response support providers, the private sector, international governments and organizations, and other entities as the Secretary considers appropriate;</text></subparagraph> <subparagraph id="HEFCC93356B3549A18E2340CDC48E8C0"><enum>(B)</enum><text>provides training at the awareness, performance, and management and planning levels;</text></subparagraph> <subparagraph id="H530D547EBDD944CAB4DA459CDFD456CF"><enum>(C)</enum><text>utilizes multiple training mediums and methods, including—</text> <clause id="H29C95DB04DA444798B55B857111FA98C"><enum>(i)</enum><text>direct delivery;</text></clause> <clause id="H38B68709991245D9B93720A796443411"><enum>(ii)</enum><text>train-the-trainer;</text></clause> <clause id="HCD04845FD58843F0B3447F6DE604B119"><enum>(iii)</enum><text>computer-based training;</text></clause> <clause id="H53D13086C10C42F58EFCCD09C779F1FA"><enum>(iv)</enum><text>web-based training; and</text></clause> <clause id="H8B988EB3352E446CB59B535877BBDA00"><enum>(v)</enum><text>video teleconferencing;</text></clause></subparagraph> <subparagraph id="H20B1EC63B21C4ED19BDA59F219D705F6"><enum>(D)</enum><text>is consistent with any applicable State or urban area homeland security strategy or plan;</text></subparagraph> <subparagraph id="H2154DEC651DB4222A6D0AFD257355506"><enum>(E)</enum><text>is consistent with, and supports implementation of, the National Incident Management System, the National Response Plan, the National Preparedness Goal, the National Preparedness Guidance, the National Infrastructure Protection Plan, and other such national initiatives;</text></subparagraph> <subparagraph id="H9CF5ACFCC22341E981FB35CC72E4D22E"><enum>(F)</enum><text>is evaluated against clear and consistent performance measures; and</text></subparagraph> <subparagraph id="HE51017BBEB5C4C1E9FF0F7216BF6162E"><enum>(G)</enum><text>to the greatest extent practicable, utilizes State, regional, and tribal training institutions.</text></subparagraph></paragraph> <paragraph id="HD6223E224FDE47AB86EE781541813D7C"><enum>(3)</enum><header>National voluntary consensus standards</header><text>The Secretary shall—</text> <subparagraph id="H7E9F0EF88FD94591A00069E0F2C467CE"><enum>(A)</enum><text>support the development, promulgation, and regular updating as necessary of national voluntary consensus standards for training; and</text></subparagraph> <subparagraph id="HF483F82B781A4D52BD1FCF963F403FE2"><enum>(B)</enum><text>ensure that the training provided under the National Training Program is consistent with such standards.</text></subparagraph></paragraph> <paragraph id="H8A3172EDE43C4EC29FAC1EBEEC6D705"><enum>(4)</enum><header>Training partners</header><text>In developing and delivering training under the National Training Program, the Secretary shall—</text> <subparagraph id="H5B04C2FA87B242C68D45A1C208E9328D"><enum>(A)</enum><text>work with government training facilities, academic institutions, private organizations, and other entities that provide specialized, state-of-the-art training for emergency responder providers or emergency response support providers; and</text></subparagraph> <subparagraph id="H39F50EC06AD1479A002C1423A85116A"><enum>(B)</enum><text>utilize, as appropriate, training courses provided by community colleges, State and local public safety academies, State and private universities, and other facilities.</text></subparagraph></paragraph> <paragraph id="HF6E790CAB2F9471E9CBA7EDE653D2FD"><enum>(5)</enum><header>Coordination and consultation</header><text display-inline="yes-display-inline">In carrying out the National Training Program, the Secretary shall—</text> <subparagraph id="HDF1280C946124156BD9658BB5C2FAA41"><enum>(A)</enum><text>coordinate with—</text> <clause id="HC39DC4A1CD834A419C6D18F72F61165E"><enum>(i)</enum><text>components of the Department that have expertise in training, including the Coast Guard, the United States Secret Service, the United States Fire Administration, and the Federal Law Enforcement Training Center; and</text></clause> <clause id="H261AEB564DB94CAC8499BE99DA1C0090"><enum>(ii)</enum><text>such other Federal departments and agencies as the Secretary determines are appropriate; and</text></clause></subparagraph> <subparagraph id="HB97020C501F649979773E72E8D1BC5A6"><enum>(B)</enum><text>consult regularly with—</text> <clause id="H3AABBCB057B64C4084B4ADB9AE00202B"><enum>(i)</enum><text>a geographic and substantive cross section of emergency response providers and emergency response support providers (including such providers located in both urban and rural areas); and</text></clause> <clause id="H76FFE2EB8FCE48B4A266F66F70767D00"><enum>(ii)</enum><text>State and local officials, including Adjutants General, with expertise in terrorism preparedness and emergency management.</text></clause></subparagraph></paragraph></subsection> <subsection id="HF1555F7EDE3B49099FAFAAC0B7388F91"><enum>(g)</enum><header>Remedial Action Management Program</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary for Training and Exercises, shall establish a Remedial Action Management Program to—</text> <paragraph id="H5813B0965A3C43C8A24F5841C9CC3F18"><enum>(1)</enum><text>identify and analyze training, exercises, and real-world events for lessons learned and best practices;</text></paragraph> <paragraph id="HCA3AA3E172874155A99FFBAD8B62EC14"><enum>(2)</enum><text>generate after action reports for Incidents of National Significance as declared by the Secretary under the National Response Plan;</text></paragraph> <paragraph id="H16EAB72F069C4AC7A5935DBE54AA61EF"><enum>(3)</enum><text>disseminate lessons learned and best practices;</text></paragraph> <paragraph id="H44EA4F60F7CC474CACF600595EC79D6D"><enum>(4)</enum><text>monitor the implementation of lessons learned and best practices;</text></paragraph> <paragraph id="HD59E3FFCC1B24C7EB6CADC6BF7AEC90"><enum>(5)</enum><text>conduct remedial action tracking and long-term trend analysis; and</text></paragraph> <paragraph id="HBA61A458FED24DB9B9F501CC985D1E5F"><enum>(6)</enum><text>certify that—</text> <subparagraph id="H5CB8F28EC020471FA98C007E7607D4B9"><enum>(A)</enum><text>recipients of Federal homeland security assistance have implemented lessons learned and best practices, as appropriate; and</text></subparagraph> <subparagraph id="HAD5C3E119E8D47C49048C023B11F0300"><enum>(B)</enum><text>ensure that no recipient uses any Federal homeland security assistance without such certification.</text></subparagraph></paragraph></subsection> <subsection id="HCFB5DF2868A14ADAB20017D18B1E2D11"><enum>(h)</enum><header>National domestic preparedness consortium</header><text>There is in the Department a National Domestic Preparedness Consortium that—</text> <paragraph id="H8CED44F2A5AF4A4E8F7BED418DFB695C"><enum>(1)</enum><text>includes as members—</text> <subparagraph id="H065EED03DE204916B3C6C362C3A69F8E"><enum>(A)</enum><text>the Center for Domestic Preparedness;</text></subparagraph> <subparagraph id="HFA53055E95E245ED9B9D00256178D408"><enum>(B)</enum><text>the New Mexico Institute of Mining and Technology;</text></subparagraph> <subparagraph id="H873F1637BFA24F7DB674D654159EC268"><enum>(C)</enum><text>Louisiana State University;</text></subparagraph> <subparagraph id="HACC2854787234DA4978F3C02DCD4EA49"><enum>(D)</enum><text>Texas A&M University; and</text></subparagraph> <subparagraph id="H7D1E72AE9CF6404B95AA47C414CC397C"><enum>(E)</enum><text>the Nevada Test Site of the Department of Energy.</text></subparagraph></paragraph> <paragraph id="H681118F900864CCB8780ED0057FA5C4C"><enum>(2)</enum><text>identifies, develops, tests, and delivers training to State, local, and tribal emergency response providers;</text></paragraph> <paragraph id="H73A4A4786351438DAFAD228B38683C75"><enum>(3)</enum><text>provides on-site training at the performance and management and planning levels; and</text></paragraph> <paragraph id="HD27A2C35113343C98193FB9E7F1E1F95"><enum>(4)</enum><text>facilitates the delivery of awareness level training by the training partners of the Department.</text></paragraph></subsection> <subsection id="HFE819B50008D4E38BA50B2AC0038E48D"><enum>(i)</enum><header>National exercise simulation center</header><text>There is in the Department a National Exercise Simulation Center that uses a mix of live, virtual, and constructive simulations to—</text> <paragraph id="H164DD800494A47C586AA6BFFE615F00"><enum>(1)</enum><text>prepare elected officials and emergency response providers at all levels of Government to operate cohesively;</text></paragraph> <paragraph id="H29922EC925CA41FBB0A7B784947DEBE5"><enum>(2)</enum><text>provide a learning environment for the homeland security personnel of all Federal departments and agencies;</text></paragraph> <paragraph id="H7ED0494C793C4A5FBB543CC6417D6274"><enum>(3)</enum><text>assist in the development of operational procedures and exercises, particularly those based on catastrophic incidents; and</text></paragraph> <paragraph id="HA3083C60358047A48479EA3F2669A633"><enum>(4)</enum><text>allow incident commanders to exercise decision-making in a simulated environment.</text></paragraph></subsection> </section> <section id="HBC85238E8858470F98D660C9BB689471"><enum>523.</enum><header>Essential capabilities</header> <subsection id="H4DF2394900924E43BA3DBB7BB8EE61"><enum>(a)</enum><header>Establishment of essential capabilities</header> <paragraph id="H2E73436A7E134E7FB93717C400AB4744"><enum>(1)</enum><header>In general</header><text>Building upon the National Preparedness Goal, the Secretary, acting through the Assistant Secretary for Grants and Planning, shall regularly update, revise, or replace essential capabilities for State, local, and tribal government emergency preparedness, in consultation with the following:</text> <subparagraph id="H035781D6C3594421A617CBE9D3167552"><enum>(A)</enum><text>The National Advisory Council on Emergency Management under section 508.</text></subparagraph> <subparagraph id="HF2AA99D6F3E94B81916F18606B620039"><enum>(B)</enum><text>Components of the Department, including the Under Secretary for Science and Technology, the Chief Intelligence Officer, the Director for Operations Coordination, the Assistant Secretary for Policy, the Assistant Secretary for Transportation Security, the Assistant Secretary for Infrastructure Protection, the Assistant Secretary for Cybersecurity and Telecommunications, the Commissioner of United States Customs and Border Protection, and the Commandant of the Coast Guard.</text></subparagraph> <subparagraph id="H6B2BEED60BC44779B652A05F81CB851"><enum>(C)</enum><text>The Secretary of Health and Human Services.</text></subparagraph> <subparagraph id="HE953B95FFAB141DF006DC4F593009FAC"><enum>(D)</enum><text>Other appropriate Federal departments and agencies.</text></subparagraph> <subparagraph id="H05C8A3B186A44D2FA7B7B70940410007"><enum>(E)</enum><text>State, local, and tribal emergency response providers.</text></subparagraph> <subparagraph id="H89108A1C09704A15A78466703F14EABE"><enum>(F)</enum><text display-inline="yes-display-inline">State, local, and tribal emergency response support providers.</text></subparagraph> <subparagraph id="H2C47EC8C08AB4060805EE66CF88FC584"><enum>(G)</enum><text>State, local, and tribal prevention and emergency management officials, including Adjutant Generals.</text></subparagraph> <subparagraph id="H3CB3068B351A4F44B46512BB1BADA8CC"><enum>(H)</enum><text>Consensus-based standardmaking organizations responsible for setting standards relevant to emergency response providers and emergency response support providers.</text></subparagraph></paragraph> <paragraph id="H126C60847E994D9D80CBACCBD7417191"><enum>(2)</enum><header>Deadlines</header><text>The Secretary shall update, revise, or replace the essential capabilities under paragraph (1) not later than 30 days after receiving the report submitted by the National Advisory Council on Emergency Management under section 508(d).</text> </paragraph> <paragraph id="HE90759BD395D459DA8E56400A31D301E"><enum>(3)</enum><header>Report on provision of essential capabilities</header><text>The Secretary shall ensure that a report containing a detailed description of the essential capabilities is provided promptly to State and tribal governments and to Congress. The States shall make the description of the essential capabilities available as appropriate to local governments within their jurisdictions.</text></paragraph></subsection> <subsection id="H6E94E45D283F4A96BEAFFADC9962BB00"><enum>(b)</enum><header>Objectives</header><text>The Secretary shall ensure that essential capabilities meet the following objectives:</text> <paragraph id="HB62B2C2EF213439B9643A02BB3B15F00"><enum>(1)</enum><text display-inline="yes-display-inline">Essential capabilities shall describe specifically the planning, personnel, equipment, training, and exercises that State, local, or tribal governments should possess or have access to for purposes of the Department’s goals for emergency preparedness based on—</text> <subparagraph id="H3C5B3D9E8FAC4969B182F6A9117DD9D6"><enum>(A)</enum><text>the National Preparedness Goal and supporting directives, policies, and guidelines;</text></subparagraph> <subparagraph id="H92D2F580F0764AB18B48DBA7402F633C"><enum>(B)</enum><text>the most current risk assessment available from the Chief Intelligence Officer of the threats of terrorism against the United States;</text></subparagraph> <subparagraph id="HA22B9E3D8AAE4CDEB71082DE48D5B7F2"><enum>(C)</enum><text>the risks faced by different types of communities, including communities of various sizes, geographies, and other distinguishing characteristics; and</text></subparagraph> <subparagraph id="H69929FE7B2984BA99242358E6986007E"><enum>(D)</enum><text>the principles of regional coordination and mutual aid among State, local, and tribal governments.</text></subparagraph></paragraph> <paragraph id="H8D62881CD7F14D82A539333C29ED33DC"><enum>(2)</enum><text>Essential capabilities shall be sufficiently flexible so as to allow State, local, and tribal government officials to establish priorities based on local or regional needs while reaching nationally determined emergency preparedness levels within a specified time period.</text></paragraph> <paragraph id="H750079E76469450BAABA02BA66D5EC11"><enum>(3)</enum><text>Essential capabilities shall be designed to enable the measurement of progress toward specific emergency preparedness goals.</text></paragraph></subsection> <subsection id="HB055E30DE25248CFA94CA72C11417358"><enum>(c)</enum><header>Factors to be considered</header> <paragraph id="H3FAFE1BEB74E462DBFF2F9D65DAE7B19"><enum>(1)</enum><header>In general</header><text>In updating, revising, or replacing essential capabilities for State, local, or tribal governments under subsection (a)(1), the Secretary specifically shall consider the variables of threat, vulnerability, and consequences with respect to population (including transient commuting and tourist populations), areas of high population density, critical infrastructure, coastline, and international borders.</text></paragraph> <paragraph id="HF3E951A5D7874D14B111E1A9C00000BA"><enum>(2)</enum><header>Basis for consideration</header><text>Such consideration shall be based upon the most current risk assessment available from the Chief Intelligence Officer and the Assistant Secretary for Infrastructure Protection of the threats of terrorism against the United States and the needs described in the National Preparedness Goal and the directives, policies, and guidelines supporting the National Preparedness Goal.</text></paragraph></subsection></section> <section id="HAD51009E32954F698F9FB6E0C8DD62FD"><enum>524.</enum><header>Catastrophic planning</header> <subsection id="H77073DF701104FA487C4939B62E9DF7"><enum>(a)</enum><header>Catastrophic emergency plans required</header><text>The Secretary, acting through the Assistant Secretary for Grants and Planning and in consultation with the Assistant Secretary for Training and Exercises, shall require any State or urban area that submits an application to the Secretary for Federal homeland security financial assistance administered by the Department to maintain a catastrophic emergency plan to be implemented in the event of an act of terrorism, natural disaster, or other emergency. The Secretary shall require the State or urban area to update, implement, and exercise the catastrophic emergency plan as necessary.</text></subsection> <subsection id="HDC7DA0701A31418793E937863FCA292C"><enum>(b)</enum><header>Requirements</header><text>Each catastrophic emergency plan required under this section, with respect to a State or urban area, shall include—</text> <paragraph id="H34547B681730460BAB464B8EEDB2E461"><enum>(1)</enum><text>evacuation and sheltering in place procedures for the general population of the State or urban area;</text></paragraph> <paragraph id="H69A81125A1CD4E9D919B06FFE4B5AA39"><enum>(2)</enum><text>the procedures in place to address the pre-positioning of food, medical and fuel supplies;</text></paragraph> <paragraph id="H205BD112264A4B24A0F6D800E7508098"><enum>(3)</enum><text>the evacuation and sheltering in place procedures for populations with special needs, including persons with disabilities, health problems, language barriers, and income barriers, the elderly, children, and individuals with pets, service animals, or farm animals;</text></paragraph> <paragraph id="H74040AA04FB442BD96EA0669A1D24299"><enum>(4)</enum><text>sheltering options for displaced populations;</text></paragraph> <paragraph id="HCCED47296BC2424193A54CB500CC392C"><enum>(5)</enum><text>the augmentation of response resources;</text></paragraph> <paragraph id="H6024E24EC7274764AC004BC75DAB45CC"><enum>(6)</enum><text>regional planning, mutual aid agreements, and requests for assistance that can meet urgent needs;</text></paragraph> <paragraph id="H9217697C91074EA4A170F171BE8D7E84"><enum>(7)</enum><text>the adequacy of delivery networks for critical services and supplies;</text></paragraph> <paragraph id="HC980C4C355F147BF9DFB600C19B2119"><enum>(8)</enum><text>the degree to which the plan is mutually supportive among contiguous jurisdictions and States;</text></paragraph> <paragraph id="HD6636B63779D46A5948B20B561CC911E"><enum>(9)</enum><text>the use of all available and appropriate transportation modes and resources, including the identification of routes of egress and ingress, and destinations;</text></paragraph> <paragraph id="H66CC1DA7D4E94361BC003227E2C88E86"><enum>(10)</enum><text>the changes in authorities or regulations which may be necessary for the plan to meet the demands of a catastrophic event;</text></paragraph> <paragraph id="HDC1FF0CD47B84C989453583541A2EAD2"><enum>(11)</enum><text>contingency plans for the survivability, sustainability, and interoperability of emergency communications systems;</text></paragraph> <paragraph id="HC76DB1A86FA542D09117D800A3C9868"><enum>(12)</enum><text>procedures for disseminating timely and accurate public alerts and warnings;</text></paragraph> <paragraph id="H934533B6F32241A4896B443F1FCFE5D5"><enum>(13)</enum><text>procedures and policies for the continuity of operations for government and other essential services; and</text></paragraph> <paragraph id="HB5BBDD383BA14776B000192006DBFC14"><enum>(14)</enum><text>search and rescue procedures for populations with special needs, including persons with disabilities, health problems, language barriers, and income barriers, the elderly, children, and individuals with pets, service animals, or farm animals.</text></paragraph></subsection> <subsection id="HDC6E02A007C84B230067BA03D6FCF590"><enum>(c)</enum><header>Consistency</header><text>A catastrophic emergency plan required under this section shall be consistent with, and support the implementation of—</text> <paragraph id="H07794027BB4C4C4B9D02ACEFF6B1100"><enum>(1)</enum><text>any applicable State or urban area homeland security strategy or plan; and</text></paragraph> <paragraph id="H5DB98A0AE9224476BA88D33EF2C036FC"><enum>(2)</enum><text>the National Incident Management System, the National Response Plan, the National Preparedness Goal, the National Preparedness Guidance, the National Infrastructure Protection Plan, and other such national initiatives as may be determined by the Secretary.</text></paragraph></subsection> <subsection id="HB8AF9A999F9C4A7583B9D4C329EFF4E6"><enum>(d)</enum><header>Peer review certification</header> <paragraph id="H43F435F2F3C645A9A1D443FBD0C9187E"><enum>(1)</enum><header>Development of regional plans</header><text>Each Regional Director for Emergency Management under section 504, in coordination with the Assistant Secretary for Grants and Planning, shall develop a process of peer review for any catastrophic emergency plan submitted under subsection (a) by a State or urban area in the geographical area in which the Regional Office directed by that Regional Director for Emergency Management is located.</text></paragraph> <paragraph id="H3F3B6D41178D48568E2548B922C00B4"><enum>(2)</enum><header>Deadline for submission of plans</header><text>Not later than one year after the date of the enactment of the <short-title>National Emergency Management Reform and Enhancement Act of 2006</short-title>, each Regional Director for Emergency Management shall submit a plan to the National Advisory Council on Emergency Management describing the peer review process developed by the Regional Director for Emergency Management. The National Advisory Council on Emergency Management shall review and approve or disapprove each such plan.</text></paragraph></subsection> <subsection id="HD8E2D26F63D54D5FB9ECDF677079D74E"><enum>(e)</enum><header>Remedial action</header><text>Not later than 90 days after completion of exercises under subsection (a), the Secretary, in consultation with the Assistant Secretary for Training and Exercises, shall develop a lessons learned and remedial action strategy for catastrophic planning.</text></subsection> <subsection id="HAE59BB6186FA463C92C10A13C9DB959"><enum>(f)</enum><header>Consultation</header><text>In developing the catastrophic emergency plan required under this section, a State or urban area shall consult with and seek appropriate comments from—</text> <paragraph id="H8F5272496A1F4B6383869CBC008F528C"><enum>(1)</enum><text>local governments within the urban area or State;</text></paragraph> <paragraph id="HEC058B55551143C183DAE679EF2EE03"><enum>(2)</enum><text>a geographic and substantive cross section of emergency response providers and emergency response support providers within the urban area or State (including, in the case of a State, such providers from both urban and rural areas within the State); and</text></paragraph> <paragraph id="H7ACBEE2E649343148B345766384FE706"><enum>(3)</enum><text>locally-governed multi-jurisdictional councils of governments and regional planning commissions responsible for implementing and coordinating local emergency response plans.</text></paragraph></subsection></section> <section id="H26D0104F9C644C06AE63146319E26E27"><enum>525.</enum><header>System assessment and validation for emergency responders program</header> <subsection id="H5E31107AE4014A258679CB92B8457E26"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Under Secretary for Emergency Management, shall establish a System Assessment and Validation for Emergency Responders Program to provide high quality, impartial, and operationally relevant evaluations and validations of critical emergency response provider-related equipment and systems and provide such evaluations and validations to emergency response providers in an operationally useful form.</text></subsection> <subsection id="HF1375C7BF0DD48FAB9ACBCBC35D110C7"><enum>(b)</enum><header>Requirements</header><text>The program established under subsection (a) shall—</text> <paragraph id="HB2FC5DD8899642FE88ED765B9800FF4F"><enum>(1)</enum><text>provide impartial, practitioner relevant, and operationally oriented assessments and validations of emergency response provider equipment and systems, including—</text> <subparagraph id="H72498F89762546C6864CF758B7A4C152"><enum>(A)</enum><text>commercial, off-the-shelf emergency response provider equipment and systems in all equipment list categories of the Interagency Board for Equipment Standardization and Interoperability; and</text></subparagraph> <subparagraph id="H981067ABED6147BB9007D5A955403EFA"><enum>(B)</enum><text>such other equipment or systems as the Secretary determines are appropriate.</text></subparagraph></paragraph> <paragraph id="H4839FA6AB1F44709A6BFB837648F002B"><enum>(2)</enum><text>provide information that enables decision-makers and emergency response providers to better select, procure, use, and maintain emergency response provider equipment or systems;</text></paragraph> <paragraph id="H12991F8AE3B54F779BE9DA17778B8E02"><enum>(3)</enum><text>assess and validate the performance of products within a system and systems within systems; and</text></paragraph> <paragraph id="H285E48DB36D64DA29C15EB395D388B97"><enum>(4)</enum><text>provide information and feedback to emergency response providers through a well-maintained, Internet-accessible database.</text></paragraph></subsection> <subsection id="HCD571BD6C56E4C9F91A955140694310"><enum>(c)</enum><header>Assessment and validation process</header><text>The assessment and validation of emergency response provider equipment and systems shall utilize multiple evaluation techniques, including</text> <paragraph id="H99022145ED424BE2BACC5FB33E5CCB49"><enum>(1)</enum><text>operational assessments of equipment performance on vehicle platforms;</text></paragraph> <paragraph id="H2FE84C030CEA4F44A91C89BEFA20EA2F"><enum>(2)</enum><text>technical assessments on a comparative basis of system component performance across makes and models under controlled conditions; and</text></paragraph> <paragraph id="HC5CA80446C8C45C586BB03F78DDD8C71"><enum>(3)</enum><text>integrative assessments on an individual basis of system component interoperability and compatibility with other system components.</text></paragraph></subsection></section> <section id="H4B50398B2F8645F8A0A7409597C5B962"><enum>526.</enum><header>Homeland Security Education Program</header> <subsection id="H99DCF84A628349E9AEF0046FB3BAFE21"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Assistant Secretary for Training and Exercises, shall establish a graduate-level Homeland Security Education Program in the National Capital Region to provide educational opportunities to senior Federal officials and selected State and local officials with homeland security and emergency management responsibilities.</text></subsection> <subsection id="H4C2682C6A33844F991B3EA932086C2F9"><enum>(b)</enum><header>Leveraging of existing resources</header><text display-inline="yes-display-inline">To maximize efficiency and effectiveness in carrying out the Program, the Secretary shall use existing Department-reviewed Master's Degree curricula in homeland security, including curricula pending accreditation, together with associated learning materials, quality assessment tools, digital libraries, exercise systems and other curriculum components already being delivered by Federal, State, and private universities and educational facilities, including the National Domestic Preparedness Consortium.</text></subsection> <subsection id="H4AC31D3AD68643798BC7C7B8168E3095"><enum>(c)</enum><header>Student enrollment</header> <paragraph id="HF2690A2523994B7B94B6F00452416B9"><enum>(1)</enum><header>Sources</header><text display-inline="yes-display-inline">The student body of the Program shall include officials from Federal, State, tribal, and local governments, and from other sources designated by the Under Secretary for Emergency Management.</text></paragraph> <paragraph id="H0742C5BCC9904341B2CBDF5FFF5BD6CA"><enum>(2)</enum><header>Enrollment priorities and selection criteria</header><text>The Under Secretary for Emergency Management shall establish policies governing student enrollment priorities and selection criteria that are consistent with the mission of the Program.</text></paragraph> <paragraph id="H44051D898F39484F927800C27A1534C"><enum>(3)</enum><header>Diversity</header><text>The Secretary shall take reasonable steps to ensure that the student body represents racial, gender, and ethnic diversity.</text></paragraph></subsection> <subsection id="H5891BA10460D48D2AC099CB32D966539"><enum>(d)</enum><header>Service Commitment</header> <paragraph id="H7814B481804649C682BABEEA1ED18292"><enum>(1)</enum><header>In general</header><text>Before any employee selected for the Program may be assigned to such education, the employee shall agree in writing to—</text> <subparagraph id="H2ECE4DEE49724A72AEF2BDAFFE4041A0"><enum>(A)</enum><text>continue in the service of the agency sponsoring the employee during the two-year period beginning on the date on which the employee completes the program, unless the employee is involuntarily separated from the service of that agency for reasons other than reduction in force; and</text></subparagraph> <subparagraph id="H99F3A3A843FE493199FB15574DE12E3"><enum>(B)</enum><text>pay to the Government the amount of the additional expenses incurred by the Government in connection with the employee’s education if the employee is voluntarily separated from the service to the agency before the end of the period described in subparagraph (A).</text></subparagraph></paragraph> <paragraph id="H3F8F9602DDE44A22B3F14BF20195E4FB"><enum>(2)</enum><header>Payment of expenses</header> <subparagraph id="H14A3444EBC7045D1A1D2440062245F2F"><enum>(A)</enum><header>Exemption</header><text>An employee who leaves the service of the sponsoring agency to enter into the service of another agency in any branch of the Government shall not be required to make a payment under paragraph (1)(B), unless the head of the agency that sponsored the education of the employee notifies the employee before the date on which the employee enters the service of the other agency that payment is be required under that paragraph.</text></subparagraph> <subparagraph id="H8DE9D49E55C74F2B9B15A8C2106BBB21"><enum>(B)</enum><header>Amount of payment</header><text display-inline="yes-display-inline">If an employee is required to make a payment under paragraph (1)(B), the agency that sponsored the education of the employee shall determine the amount of the payment, except that such amount may not exceed the pro rata share of the expenses incurred for the time remaining in the two-year period. </text></subparagraph></paragraph> <paragraph id="HD3724C16C7924794B9629F06FDF99280"><enum>(3)</enum><header>Recovery of payment</header><text>If an employee who is required to make a payment under this subsection does not make the payment, a sum equal to the amount of the expenses incurred by the Government for the education of that employee is recoverable by the Government from the employee or his estate by—</text> <subparagraph id="H9A483E731DD94437A1ADA2B2E6C86A2"><enum>(A)</enum><text>setoff against accrued pay, compensation, amount of retirement credit, or other amount due the employee from the Government; or</text></subparagraph> <subparagraph id="H1392A26DCDE4447DB2BFF04F571C9F8D"><enum>(B)</enum><text>such other method as is provided by law for the recovery of amounts owing to the Government.</text></subparagraph></paragraph></subsection></section> <section id="HC9865C1442E6401BB5857469FA639EED" display-inline="no-display-inline" section-type="subsequent-section"><enum>527.</enum><header>Office of Public and Community Preparedness</header> <subsection id="HD46A9980986141D58E945BACC518148"><enum>(a)</enum><header>In general</header><text>There is in the Directorate of Emergency Management an Office of Public and Community Preparedness.</text></subsection> <subsection id="H617C194889B44D0D97B9AC20FDA26BEA"><enum>(b)</enum><header>Director</header><text>The Office shall be headed by a Director, who shall be appointed by the Secretary. The Director shall report directly to the Assistant Secretary for Grants and Planning.</text></subsection> <subsection id="HC251EE1D22B245D9B18CAFDE4BDD2550"><enum>(c)</enum><header>Components</header><text>The Office of Public and Community Preparedness shall consist of the following:</text> <paragraph id="HF59BD572A5F843489DFB70131D214B4C"><enum>(1)</enum><text>The various component programs of the Citizen Corps, including Community Emergency Response Teams, Fire Corps, Volunteers in Police Service, USA on Watch, and the Medical Reserve Corps.</text></paragraph> <paragraph id="H531CACE8979043A38B2E950018D4A2F"><enum>(2)</enum><text>The Internet website known as Ready.gov and the components of that website, including Ready Businesses, Ready Kids, and Listo.</text></paragraph> <paragraph id="HD4E6C82AA4B64FAA913839A6CAF45833"><enum>(3)</enum><text>Such other duties relating to community, public, and citizen preparedness as the Secretary may provide.</text></paragraph></subsection> <subsection id="HF995B58DF6F14EE9BB4F3302FA9D014F"><enum>(d)</enum><header>Responsibilities</header><text>The Director of the Office of Public and Community Preparedness, in coordination with and support of the Regional Directors of Emergency Management under section 504, shall have the primary responsibility within the Department for assisting the efforts of State, local, and tribal governments in preparing citizens and communities in the United States for acts of terrorism, natural disasters, and other emergencies, including primary responsibility for each of the following:</text> <paragraph id="H5BAA386AD2BC405DB3A312A7E2DAEC17"><enum>(1)</enum><text>Coordinating and supporting public and community preparedness efforts at all levels of Government.</text></paragraph> <paragraph id="H60E7A949C7184A27A491B1465847CF3F"><enum>(2)</enum><text>Serving as the principal advisor to the Secretary on public and community preparedness issues.</text></paragraph> <paragraph id="H11E9BBAF1B0341349D69F0F398BFF18C"><enum>(3)</enum><text>Developing guidance on citizen preparedness for grants to State, local, and tribal governments.</text></paragraph> <paragraph id="H30709AFD22D24330863FEC9F999158A9"><enum>(4)</enum><text>Providing, through the Regional Offices under section 504, State, local, and tribal Citizen Corps Councils with tools, information, and technical assistance to connect local and national citizen preparedness efforts.</text></paragraph> <paragraph id="H75AF59F7E90A4F728C740100C0D9F7FC"><enum>(5)</enum><text>Directing, managing, and implementing all programs associated with the entities under subsection (c).</text></paragraph> <paragraph id="HB2F18F100BBF463984B2997E99563954"><enum>(6)</enum><text>Establishing specialized preparedness programs for at-risk communities under subsection (e).</text></paragraph> <paragraph id="HB19D177BDCFB4116BB29C0C5586CDF9E"><enum>(7)</enum><text>Ensuring coordination with private sector entities, faith-based groups, other nongovernmental organizations, special needs groups, emergency response provider organizations, emergency response support provider organizations, and international organizations, in order to promote citizen preparedness and participation.</text></paragraph> <paragraph id="H5C575B57E3CE44B7851032B5BE10A0AE"><enum>(8)</enum><text>Developing a comprehensive program of public service announcements for use on a national basis or, in consultation with State, local, or tribal governments, on a regional, State, or local basis.</text></paragraph> <paragraph id="H8168112E632241D398A500BD87EC3473"><enum>(9)</enum><text>Assisting in the implementation of national strategies for public and community preparedness, including the development of individual preparedness skills and capabilities, including assembling preparedness kits, developing emergency communications plans, training in basic fist aid, and learning how to react to a variety of emergencies.</text></paragraph></subsection> <subsection id="H7E6F139DE5F54463AD56A66FC9C637F"><enum>(e)</enum><header>At-risk communities</header><text>In carrying out the responsibilities under this section, the Director shall consider the unique preparedness challenges faced by persons with disabilities, health problems, language barriers, and income barriers, the elderly, children, and individuals with pets, service animals, or farm animals.</text></subsection> <subsection id="HB4B9DEE76A49474ABC4058ADCBF51C8"><enum>(f)</enum><header>National Citizen Corps Council</header> <paragraph id="H3EAAE6E74BD54B06B4CC01B06D963800"><enum>(1)</enum><header>In general</header><text>There is in the Directorate a National Citizen Corps Council. The Under Secretary for Emergency Management or a designee shall serve as chair of the Council.</text></paragraph> <paragraph id="H3523475DBA9D43328F21F699047EE10"><enum>(2)</enum><header>Membership</header><text>The Council shall consist of national leaders of organizations and associations representing at risk communities described under subsection (e), emergency response providers, emergency response support providers, community and volunteer service providers, government, and the private sector.</text></paragraph> <paragraph id="H4F4D6C84107B4ADC001D80EF2DAD9FE5"><enum>(3)</enum><header>Responsibilities</header><text>The responsibilities of the Council are as follows:</text> <subparagraph id="H37E579E21AAA48A69EF8B54B10D3351B"><enum>(A)</enum><text>To work together at the national level and encourage members of the Council at the State, local, and tribal level to collaborate in support of the Citizen Corps.</text></subparagraph> <subparagraph id="H8BCB669C0B22479BBE5F83E607955767"><enum>(B)</enum><text>To identify opportunities for Federal, State, local, and tribal organizations to collaborate to accomplish the shared goals of the Citizen Corps programs.</text></subparagraph> <subparagraph id="H8FB10ABF4B9046A30059B5040068718D"><enum>(C)</enum><text>To encourage the development and support of local Citizen Corps Councils and to advance the Citizen Corps mission across the country.</text></subparagraph> <subparagraph id="HEE89BD5F529141B7BF92C534FECB97D6"><enum>(D)</enum><text>To exchange facts and information on programs to promote public awareness, training, safety, and volunteer service opportunities and on safety and preparedness messages to be conveyed to the public.</text></subparagraph> <subparagraph id="H2EB560A5CCD24F90B4EF51C283E87E6"><enum>(E)</enum><text>To develop and disseminate messages on safety and emergency preparedness that will be effective in engaging communities and individuals in the Citizen Corps.</text></subparagraph> <subparagraph id="HE3FC0667D3E44B9C89B420F2077F2C00"><enum>(F)</enum><text>To serve as the catalyst for engaging others within their areas of expertise to promote the Citizen Corps mission.</text></subparagraph></paragraph> <paragraph id="H3AAF715E5CB542549F87A26B57156E8"><enum>(4)</enum><header>Meetings</header><text>The Under Secretary for Emergency Management or a designee shall convene meetings of the National Citizen Corps Council at the discretion of the Under Secretary or at the direction of the Secretary.</text></paragraph></subsection> <subsection id="H32822C4611B14B6FBCA912395D5767D6"><enum>(g)</enum><header>Coordination</header><text>The Director shall—</text> <paragraph id="H2D92C3E0CDC642B386EF43610DEDD89"><enum>(1)</enum><text>coordinate with other Federal entities, as appropriate, including the Departments of Health and Human Services, Justice, Commerce, and Education, the Environmental Protection Agency, and the Corporation for National and Community Service, to enhance public and community preparedness;</text></paragraph> <paragraph id="HDAC60AEB04EB4DF780A1C963631C9F72"><enum>(2)</enum><text>coordinate with State, local, and tribal governments; and</text></paragraph> <paragraph id="HF67BBAF3653742FF93F3848B199C80C"><enum>(3)</enum><text>subject to the availability of appropriations, make grants and enter into contracts and cooperative agreements with other Federal agencies and nongovernmental organizations, as may be necessary and proper to carry out the responsibilities of the Director under this section.</text></paragraph></subsection></section></subtitle> <subtitle id="HFAD36128026D4E838CC829B005B07169"><enum>C</enum><header>Emergency Response</header> <section id="H3B2C39F3078E41788DF937C9EF0F1A6"><enum>541.</enum><header>National incident management system and national response plan integration center</header> <subsection id="HF9BC322D51D1436AAA7EA3004EF7A1F0"><enum>(a)</enum><header>In general</header><text>There is in the Directorate of Emergency Management a National Incident Management System and National Response Plan Integration Center (referred to in this section as the <quote>NIC</quote>).</text></subsection> <subsection id="HA058FB709A204DE08D2094AB6F13473F"><enum>(b)</enum><header>Director</header><text>The NIC shall be headed by a Director, who shall be appointed by the Secretary. The Director shall report directly to the Deputy Under Secretary for Response and Recovery.</text></subsection> <subsection id="H5B84BDA0BDB84A8294EFA579FAA17800"><enum>(c)</enum><header>Responsibilities</header><text>The Director, in consultation with the Assistant Secretary for Grants and Planning and the heads of other appropriate Federal departments and agencies, and the National Advisory Council on Emergency Management under section 508, shall establish a mechanism for ensuring ongoing management and maintenance of the National Incident Management System (NIMS), the National Response Plan (NRP), any other document or tool in support of Homeland Security Presidential Directive 5, or any other Homeland Security Presidential Directive related to incident management and response. The responsibilities of the Director shall include the following:</text> <paragraph id="H5E03A2A4746943B488BD284537E2C0C7"><enum>(1)</enum><text>Revising, as appropriate, the NIMS and the NRP not later than 90 days after the enactment of this section with respect to—</text> <subparagraph id="HB784D6EC27BD43EA944098D2BE70211C"><enum>(A)</enum><text>clarifying the roles and responsibilities of the Principal Federal Official, the Federal Coordinating Officer, the Federal Resource Coordinator, and the Disaster Recovery Manager;</text></subparagraph> <subparagraph id="H8B60604012BA479DB5FB5D9FD959FA01"><enum>(B)</enum><text>developing procedures for the timely activation of each such role;</text></subparagraph> <subparagraph id="H70BF05E2663D4003AE99BE8100F33257"><enum>(C)</enum><text>establishing as part of the NRP an emergency support function with respect to volunteers and donations;</text></subparagraph> <subparagraph id="H23FFAA73325B43E0873885FBB6F4CB4E"><enum>(D)</enum><text>realigning the emergency support functions of the NRP so as to be consistent with the NIMS; </text></subparagraph> <subparagraph id="H4A7B44E1239C4F319B5F927E28B19F7D"><enum>(E)</enum><text>developing doctrine and procedures relating to the management of acts of terrorism, natural disasters, and other emergencies affecting multiple State;</text></subparagraph> <subparagraph id="HBF732A7EDE8D43C1B5372FCEEAF53916"><enum>(F)</enum><text>improving the utilization of Federal, State, local, and tribal resources, including the deployment of emergency response providers, specialized equipment, and supplies;</text></subparagraph> <subparagraph id="H2BD1F9D49F6242C5A59FD4DA049FFB51"><enum>(G)</enum><text>finalizing and releasing the Catastrophic Incident Supplement to the NRP;</text></subparagraph> <subparagraph id="H8008DAD857E6416EBDF731102E86F292"><enum>(H)</enum><text>ensuring the effective use of emergency response providers at emergency scenes; and</text></subparagraph> <subparagraph id="H2030B7EA89054B60B83C28D7878EF1E1"><enum>(I)</enum><text>reviewing other matters pertaining to the NIMS and the NRP as the Secretary may require.</text></subparagraph></paragraph> <paragraph id="HA59770F9284B4DCFAF2662A3A1AD66F4"><enum>(2)</enum><text>Developing a national program for NIMS and NRP education and awareness, including specific instruction on the purposes of the NIMS and the NRP and responsibilities of the NIC.</text></paragraph> <paragraph id="H54E2B8D687894DD5A388C3D584A34FEF"><enum>(3)</enum><text>Promoting the compatibility between national voluntary consensus standards for the NIMS and the NRP and such standards developed by other public, private, or professional groups.</text></paragraph> <paragraph id="HAF6DA97AB58B4B0696EEA98E5329E7F1"><enum>(4)</enum><text>Facilitating the development and publication of materials and standardized templates to support the implementation and continuous refinement of the NIMS and the NRP.</text></paragraph> <paragraph id="H4889150237754E3992E925C63DFA7DF0"><enum>(5)</enum><text>Developing performance measures and assessment criteria for the various components of the NIMS and the NRP and compliance requirements and compliance timelines for implementation by Federal, State, local, and tribal entities.</text></paragraph> <paragraph id="H674E7D9BCDD94A5DACAD21FE49C4A3F2"><enum>(6)</enum><text>Establishing a peer review process for NIMS compliance certifications that verifies the satisfaction of training, planning, exercising, and other activities.</text></paragraph> <paragraph id="H802550C94C8E45AEB7D81DC189681E16"><enum>(7)</enum><text>Defining, in consultation with the Assistant Secretary for Training and Exercises, the general training requirements and the national training standards and course curricula associated with the NIMS and the NRP.</text></paragraph> <paragraph id="H5E1D995CD1324232B76989FBC76B479D"><enum>(8)</enum><text>Facilitating the development of national voluntary consensus standards, guidelines, and protocols for incident management training and exercises, including consideration of existing exercise and training programs at all levels of government.</text></paragraph> <paragraph id="HD2C437DA1E5749A582119B6FDDEE3D44"><enum>(9)</enum><text>Facilitating the establishment and maintenance of a publication management system for documents supporting the NIMS and the NRP and other related publications and materials related to the NIMS and the NRP, including the development or coordination of general publications.</text></paragraph> <paragraph id="H8A299F4658494EF09D8EC20058467DED"><enum>(10)</enum><text>Reviewing and certifying, in coordination with accrediting organizations and in consultation with Federal, State, local, tribal, private-sector, and nongovernmental entities, the discipline-specific publication management requirements submitted by professional organizations and associations.</text></paragraph> <paragraph id="H2FB5B51A8039429A9E03F118555585B1"><enum>(11)</enum><text>Facilitating the development and publication of national voluntary consensus standards, guidelines, and protocols for the qualification and certification of emergency response providers and incident management personnel, as appropriate.</text></paragraph> <paragraph id="H181683E8DAE049FB9FC8B303FC49809"><enum>(12)</enum><text>Reviewing and approving, in coordination with appropriate national professional organizations and with input from Federal, State, local, tribal, private-sector, and other nongovernmental entities, the discipline-specific qualification and certification requirements submitted by emergency responder and incident management organizations and associations.</text></paragraph> <paragraph id="H59FD30D6ACBF46579F035724C6D1F626"><enum>(13)</enum><text>Facilitating the establishment and maintenance of a documentation and database system related to qualification, certification, and credentialing of incident management personnel and organizations, including reviewing and approving, in coordination with appropriate national professional organizations and with input from the Federal, State, local, tribal, private-sector and nongovernmental entities, of the discipline-specific requirements submitted by functionally oriented incident management organizations and associations.</text></paragraph> <paragraph id="H6688714DEF8D45EA897CEFEF8FBEF49B"><enum>(14)</enum><text>Establishing a data maintenance system to provide incident managers with the detailed qualification, experience, and training information needed to credential personnel for prescribed national incident management positions.</text></paragraph> <paragraph id="HE6A5674D823947ACA8C188DF15B9496F"><enum>(15)</enum><text>Coordinating minimum professional certification standards and facilitation of the design and implementation of a credentialing system that can be used nationwide.</text></paragraph> <paragraph id="HEE16C38DDB3F40C70054CBFE109CB68C"><enum>(16)</enum><text>Facilitating the development and issuance of national standards for the typing of resources.</text></paragraph> <paragraph id="HEA8D34D27B4F4EDBB8F6654DC2E3C34E"><enum>(17)</enum><text>Facilitating the definition and maintenance of the information framework required to guide the development of NIMS information systems, including the development of data standards for—</text> <subparagraph id="H6C240CE37AA74B06A05066E8A6CCA5AE"><enum>(A)</enum><text>incident notification and situation reports;</text></subparagraph> <subparagraph id="H6366A52F291443DD9125FE19E7958D43"><enum>(B)</enum><text>status reporting;</text></subparagraph> <subparagraph id="H8B865CA9E5B84613939BB3F100AE627F"><enum>(C)</enum><text>analytical data;</text></subparagraph> <subparagraph id="H4D23030A157145CDBD43C77D5D39093F"><enum>(D)</enum><text>geospatial information;</text></subparagraph> <subparagraph id="HC03C112AED4D4C73A59E8D2DB0F731D5"><enum>(E)</enum><text>wireless communications;</text></subparagraph> <subparagraph id="H8FF58BDD8DA84894AB8F8E969400EDFB"><enum>(F)</enum><text>identification and authentication; and</text></subparagraph> <subparagraph id="HD690FE4D59AC4E07B7A31439F0EC1114"><enum>(G)</enum><text> incident reports, including lessons learned reports.</text></subparagraph></paragraph> <paragraph id="H21B7371DCAC74571A8B43EC6F75459FA"><enum>(18)</enum><text>Performing such other duties relating to such responsibilities as the Secretary may require.</text></paragraph></subsection></section> <section id="H55C6C435AA1A4DDFA47DD19B8F1E8481"><enum>542.</enum><header>Use of national private sector networks in emergency response</header><text display-inline="no-display-inline">To the maximum extent practicable, the Secretary, acting through the Under Secretary for Emergency Management, shall use national private sector networks and infrastructure for emergency response to acts of terrorism, natural disasters, and other emergencies.</text></section> <section id="H5588EC7355E147339172AE1B405BE972"><enum>543.</enum><header>Nuclear incident response</header> <subsection id="H0C9AF28DD313426FA4F83FFBBE97B175"><enum>(a)</enum><header>Nuclear Incident Response Team</header><text>In connection with actual or threatened acts of terrorism, natural disasters, or other emergencies in the United States—</text> <paragraph id="H70F426ADF9C942F59000A189D3523D6C"><enum>(1)</enum><text>the Nuclear Incident Response Team shall operate as an organizational unit of the Department; and</text></paragraph> <paragraph id="H17CD6F2075234A0A00E2C4BF2C006BA4"><enum>(2)</enum><text>while so operating, the Secretary shall have direction, authority, and control of the Nuclear Incident Response Team.</text></paragraph> </subsection> <subsection id="H09A208BA5CF94489A39DB7E871B321FD"><enum>(b)</enum><header>Responsibilities</header><text>In addition to the authority under subsection (a), the Secretary, acting through the Under Secretary for Emergency Management, shall at all times carry out the following responsibilities:</text> <paragraph id="H52A8A4E5E47D4735A237053E011E3095"><enum>(1)</enum><text>Establishing standards for performance of the Nuclear Incident Response Team and, when such standards have been met, certifying that they have been met.</text></paragraph> <paragraph id="HA9293A856FA84F1F9D01780022CE253C"><enum>(2)</enum><text>Conducting joint and other exercises and training and evaluating performance.</text></paragraph> <paragraph id="H52FE2F27D3B54B0FAD14AEADB86C35C4"><enum>(3)</enum><text>Providing funds to the Department of Energy and the Environmental Protection Agency, as appropriate, for homeland security planning, exercises and training, and equipment.</text></paragraph></subsection> <subsection id="H90577A26EF154D4698DBBBBEDD58A780"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to limit the responsibility of the Secretary of Energy and the Administrator of the Environmental Protection Agency for organizing, training, equipping, and utilizing their respective entities that participate in the Nuclear Incident Response Team, or (subject this section) from exercising direction, authority, and control over such entities when they are not operating as a unit of the Department.</text></subsection> <subsection id="H3980F2DC612E42449DE3DE3EC8D1012"><enum>(d)</enum><header>Definition</header><text>In this section, the term <quote>Nuclear Incident Response Team</quote> means a resource that includes—</text> <paragraph id="H590D7F5F82A74791B43FC234E4CED06"><enum>(1)</enum><text>those entities of the Department of Energy that perform nuclear or radiological emergency support functions (including accident response, search response, advisory, and technical operations functions), radiation exposure functions at the medical assistance facility known as the Radiation Emergency Assistance Center/Training Site (REAC/TS), radiological assistance functions, and related functions; and</text></paragraph> <paragraph id="H7AC6AA2B79F64D36A13B9CB95FC262BE"><enum>(2)</enum><text>those entities of the Environmental Protection Agency that perform such support functions (including radiological emergency response functions) and related functions.</text></paragraph></subsection></section> <section id="HE8A1A161AB1042B6B813C5BA7B9C6FF"><enum>544.</enum><header>National urban search and rescue response system</header> <subsection id="H0FA7EF2CE738466896D843978CF98FC8"><enum>(a)</enum><header>National urban search and rescue response system</header><text>There is in the Directorate of Emergency Management an emergency response system known as the National Urban Search and Rescue Response System that provides a national network of standardized search and rescue resources to assist State, local, and tribal governments in responding to acts of terrorism, natural disasters, and other emergencies.</text></subsection> <subsection id="H4C9809D134CE4EE78300C1B1DA6CC38D"><enum>(b)</enum><header>Administration of the system</header> <paragraph id="H5DAB81E7BE084899A52C19B4D5001951"><enum>(1)</enum><header>Task force participation</header><text display-inline="yes-display-inline">The Under Secretary for Emergency Management shall select eligible urban search and rescue teams that are sponsored by State and local government entities to participate as task forces in the System. The Under Secretary shall determine the criteria for such participation.</text></paragraph> <paragraph id="H6DEE727746EC4E089FCAF8CCD2522FA1"><enum>(2)</enum><header>Agreements with sponsoring agencies</header><text display-inline="yes-display-inline">The Under Secretary shall enter into an agreement with the State or local government entity that sponsors each search and rescue team selected under paragraph (1) with respect the team’s participation as a task force in the System.</text></paragraph> <paragraph id="HACBBB6C896E5411CB0FEEBBD967CE900"><enum>(3)</enum><header>Urban search and rescue team personnel</header><text>Personnel of an urban search and rescue team that participates as a task force under this section may be—</text> <subparagraph id="H6DDA095F8F3248E7829E08B05CDA5324"><enum>(A)</enum><text>personnel of the State or local government sponsor; or</text></subparagraph> <subparagraph id="HD8BEEA037DB64F00BEC2DD0696CC7300"><enum>(B)</enum><text>personnel of any other Federal, State, or local government entity that enters into a participation agency agreement with the State or local government sponsor of the team.</text></subparagraph></paragraph> <paragraph id="HA67E80545B1C4A75AEB82FBFC335300"><enum>(4)</enum><header>Management and technical teams</header><text display-inline="yes-display-inline">The Under Secretary shall maintain such management and other technical teams as are necessary to administer the System.</text></paragraph></subsection> <subsection id="HB44FAF2A004443B0B43F53AEEED4F4E"><enum>(c)</enum><header>Advisory committee</header><text></text> <paragraph id="H6113B52C4F2D42618DDC7B43CAADFBB3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Under Secretary shall establish and maintain an advisory committee to provide expert recommendations to the Under Secretary with respect to administering the System.</text></paragraph> <paragraph id="H9AA559923BC447FF9720A84E07FDE800"><enum>(2)</enum><header>Composition</header><text>The advisory committee shall be geographically diverse, and shall include, at a minimum—</text> <subparagraph id="HFADEC72A6789449388EA154EDB4E48AD"><enum>(A)</enum><text display-inline="yes-display-inline">the chief officer or senior executive from each of at least three State or local governments that sponsor urban search and rescue teams selected to participate in the System as task forces;</text></subparagraph> <subparagraph id="HA83D650342CB468E84D7B3FD6C32BE4F"><enum>(B)</enum><text display-inline="yes-display-inline">the senior emergency manager from each of at least two States in which such local governments are located; and</text></subparagraph> <subparagraph id="HA1EF739159884D0DA3317B15292DA900"><enum>(C)</enum><text>at least one representative selected by the leaders of the task forces.</text></subparagraph></paragraph> <paragraph id="H887192C222924E9FB94DD9353CF8E424"><enum>(3)</enum><header>Termination</header><text>The advisory committee shall terminate on the date that is two years after the date of the enactment of the <short-title>National Emergency Management Reform and Enhancement Act of 2006</short-title>.</text></paragraph></subsection> </section> <section id="H7BFB060538C74D81A7AD9E1E5566B4E3" section-type="subsequent-section" display-inline="no-display-inline"><enum>545.</enum><header>Metropolitan Medical Response System</header> <subsection id="HA1AEA9673FBF4E33B9DF74EA64EA5027"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is in the Department a Metropolitan Medical Response System. Under the System, the Assistant Secretary for Grants and Planning shall administer grants to develop, maintain, and enhance medical preparedness systems that are capable of responding effectively during the initial hours of a public health crisis or mass-casualty event caused by an act of terrorism, natural disaster, or other emergency.</text></subsection> <subsection id="HAF34D6324C5F4725AD726224B03E10E0"><enum>(b)</enum><header>Use of funds</header><text>The Metropolitan Medical Response System shall make grants to local governments to enhance any of the following activities:</text> <paragraph id="HC5688E3DC0484F9E82E3448975ABF763"><enum>(1)</enum><text>Medical surge capacity.</text></paragraph> <paragraph id="HA372FEC32743496884E696C841D8E305"><enum>(2)</enum><text>Mass prophylaxis.</text></paragraph> <paragraph id="H33310F19B8604BADA84139154684F89E"><enum>(3)</enum><text>Chemical, biological, radiological, nuclear, and explosive detection, response, and decontamination capabilities.</text></paragraph> <paragraph id="HE2C99543F259418DB7F5A39DB384EC3"><enum>(4)</enum><text>Emergency communications capabilities.</text></paragraph> <paragraph id="H0C92932BE4F448FB8EFED0008278BB52"><enum>(5)</enum><text>Information sharing and collaboration capabilities.</text></paragraph> <paragraph id="H49D7FDE8B9DD4608B7284F5877351B80"><enum>(6)</enum><text>Regional collaboration.</text></paragraph> <paragraph id="H4B0EB9F8D6734020B1AF6823BADDBDAD"><enum>(7)</enum><text>Triage and pre-hospital treatment.</text></paragraph> <paragraph id="HA39D696CFC964B5AA7BD179C06D600B4"><enum>(8)</enum><text>Medical supply management and distribution.</text></paragraph> <paragraph id="H645DC5887AAA4BA4B004FF1E80804301"><enum>(9)</enum><text>Fatality management.</text></paragraph> <paragraph id="H2F6DCEFB2F144ACA9FCAE15086B808C1"><enum>(10)</enum><text>Such other activities as the Secretary may provide.</text></paragraph></subsection> <subsection id="H8989C44AAB644376BACC82333654C380"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary for each of the fiscal years 2007 through 2010.</text></subsection></section> <section id="H5956556BB0624081BB8F92EB65F57F11"><enum>546.</enum><header>Emergency Management Assistance Compact authorization</header> <subsection id="H80EDE302F670495F9BFAF0C268DC56C5"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Under Secretary for Emergency Management, may make grants for the purposes of administering the Emergency Management Assistance Compact consented to by <external-xref legal-doc="public-law" parsable-cite="pl/104/321">Public Law 104–321</external-xref>.</text></subsection> <subsection id="H230D138F733F4029A76CFC04F6A2ACFB"><enum>(b)</enum><header>Uses</header><text>A grant under this section shall be used—</text> <paragraph id="HFA50AB3476D04B2FA33D61ACB441B125"><enum>(1)</enum><text>to carry out recommendations identified in after-action reports for the 2004 and 2005 hurricane season issued under the Emergency Management Assistance Compact;</text></paragraph> <paragraph id="H4AD78B088FA94BB8897BB36647ABFA04"><enum>(2)</enum><text>to coordinate with the Department and other Federal Government agencies; or</text></paragraph> <paragraph id="HC6BC6083142446179178BA9BEB19F2"><enum>(3)</enum><text>to coordinate with State and local government entities and their respective national associations.</text></paragraph></subsection> <subsection id="HDE546AE0AE254A15B25171C77EB0844B"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $4,000,000 for each fiscal year. Amounts appropriated under this section shall remain available for 3 fiscal years.</text></subsection></section></subtitle> <subtitle id="H024688BCAC0D4484A900164CC088003C"><enum>D</enum><header>Emergency Communications</header> <section id="H7ED0A0FAB6CC4911BEFBF8C0FC10EB68"><enum>561.</enum><header>Office of Emergency Communications</header> <subsection id="H428B88EC4C7145828BAE00F43F490176"><enum>(a)</enum><header>In general</header><text>There is in the Department an Office of Emergency Communications, which shall be under the authority of the Under Secretary for Emergency Management.</text></subsection> <subsection id="H260B940C5FDC4860BD727029B074B7F6"><enum>(b)</enum><header>Assistant Secretary</header><text>The head of the office shall be the Assistant Secretary for Emergency Communications.</text></subsection> <subsection id="H364020AA7788474BA345A89DC83FBC3"><enum>(c)</enum><header>Responsibilities</header><text>The Assistant Secretary for Emergency Communications shall—</text> <paragraph id="H8E3004E71C6D45BC88F189CCE47047B7"><enum>(1)</enum><text>assist the Secretary in developing and implementing the program described in section 7303(a)(1) of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/6/194">6 U.S.C. 194(a)(1)</external-xref>), except as provided in section 5 of the National Emergency Management Reform and Enhancement Act of 2006;</text></paragraph> <paragraph id="H0E2A7AE7DF4E495EBEAAFBAA34E748A4"><enum>(2)</enum><text>administer the Department’s responsibilities and authorities relating to the SAFECOM Program;</text></paragraph> <paragraph id="H9C523F6C9AE9457685363EF37947F471"><enum>(3)</enum><text>administer the Department’s responsibilities and authorities relating to the Integrated Wireless Network program;</text></paragraph> <paragraph id="H2E637A759E564F058B6FE428F6F7AEC"><enum>(4)</enum><text display-inline="yes-display-inline">coordinate, as appropriate, with the Assistant Secretary for Cybersecurity and Telecommunications, regarding the administration of the National Communications System;</text></paragraph> <paragraph id="H74C2A20B44994A04A35DF45880269D66"><enum>(5)</enum><text>conduct extensive, nationwide outreach and foster the development of interoperable emergency communications capabilities by State, regional, local, and tribal governments and public safety agencies;</text></paragraph> <paragraph id="H1BB28A1202FA444DBD1F57ADB7CF00"><enum>(6)</enum><text>provide technical assistance to State, regional, local, and tribal officials with respect to use of interoperable emergency communications capabilities;</text></paragraph> <paragraph id="HCC3EDC6F3224442E95ECDB480271FA6F"><enum>(7)</enum><text>facilitate the creation of Regional Emergency Communications Coordination Working Groups under section 565;</text></paragraph> <paragraph id="H14E7A81569884EC99F683700732358DD"><enum>(8)</enum><text>promote the development of standard operating procedures with respect to use of interoperable emergency communications capabilities for incident response and facilitate the sharing of information on best practices (including from governments abroad) for achieving, maintaining, and enhancing interoperable emergency communications capabilities for such response;</text></paragraph> <paragraph id="HB580808165F44B990017BC470143BC"><enum>(9)</enum><text>coordinate the establishment of a national response capability with initial and ongoing planning, implementation, and training for the deployment of backup communications services in the event of a catastrophic loss of local and regional emergency communications services;</text></paragraph> <paragraph id="H87FEC15ED0BD4476A795FCBDA21C3464"><enum>(10)</enum><text>assist the President, the National Security Council, the Homeland Security Council, the Director of the Office of Science and Technology Policy, and the Director of the Office of Management and Budget in ensuring the operability of the telecommunications functions and responsibilities of the Federal Government;</text> </paragraph> <paragraph id="HBEC9D81B59BB4D80A1CAA771F59F0588"><enum>(11)</enum><text>establish requirements for total and nonproprietary interoperable emergency communications capabilities for all public safety radio and data communications systems and equipment;</text></paragraph> <paragraph id="HE997A572CEB645BCA23CAA88175E2CDE"><enum>(12)</enum><text display-inline="yes-display-inline">help to establish an integrated national public alert and warning system that incorporates legacy systems; and</text></paragraph> <paragraph id="H0215875B3CC34677803505792EF3A420"><enum>(13)</enum><text>review, in consultation with Assistant Secretary for Grants and Planning, all interoperable emergency communications plans of Federal, State, local, and tribal governments, including Statewide and tactical interoperability plans.</text> </paragraph></subsection> <subsection id="HA60467F429864DD08C2315B2DAC55C95"><enum>(d)</enum><header>Performance of previously transferred functions</header><text>There is transferred to the Secretary the authority to administer, through the Assistant Secretary for Emergency Communications, the following:</text> <paragraph id="H2DEF741597E547F687E9ECA497C7AC00"><enum>(1)</enum><text>The SAFECOM Program.</text></paragraph> <paragraph id="H23725BC63DB94DAAA0B489FF6E583D96"><enum>(2)</enum><text display-inline="yes-display-inline">The responsibilities of the Chief Information Officer related to the implementation of the Integrated Wireless Network.</text></paragraph> <paragraph id="H214150FE652E4FB2BA10C258C77924C1"><enum>(3)</enum><text>The Interoperable Communications Technical Assistance Program.</text></paragraph> </subsection> <subsection id="H6776C93D1B4A4D92A380B92B4425FCC8"><enum>(e)</enum><header>Coordination</header><text>The Assistant Secretary shall coordinate, as appropriate, with the Director of the Office for Interoperability and Compatibility the responsibilities described in section 104 of the National Emergency Management Reform and Enhancement Act of 2006.</text> </subsection> <subsection id="H78393E49610B4BF7A2CBB8CB31272ED9"><enum>(f)</enum><header>Sufficiency of resources</header><text>The Secretary shall provide the Office of Emergency Communications the resources and staff necessary to carry out the responsibilities under this section.</text></subsection></section> <section id="HA14D34B2FC984B41BD9B99974B4468F" display-inline="no-display-inline" section-type="subsequent-section"><enum>562.</enum><header>National emergency communications strategy</header> <subsection id="H0ADE630480F849C8894B85B7EB0313A5"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Assistant Secretary for Emergency Communications, shall, not later than one year after the completion of the baseline assessment under section 563, and in cooperation with State, local, and tribal governments, Federal departments and agencies, emergency response providers, emergency response support responders, and the private sector, develop a National Emergency Communication Strategy to achieve interoperable emergency communications.</text></subsection> <subsection id="H941C869B35204CB0934234C18356E241"><enum>(b)</enum><header>Contents</header><text>The national strategy shall—</text> <paragraph id="H48EDCCC17E52445CA8E6ADC9B6835981"><enum>(1)</enum><text>include a national interoperable emergency communication inventory that—</text> <subparagraph id="H20A6F9E8C9234332A0DB546D7B982F49"><enum>(A)</enum><text display-inline="yes-display-inline">identifies for each Federal department and agency—</text> <clause id="H1E627F1AD04A4A82B584A1DB00E5D45C"><enum>(i)</enum><text>the channels and frequencies used;</text></clause> <clause id="H9DEFF494EC84420E89DA412D185177A1"><enum>(ii)</enum><text>the nomenclature used to refer to each channel or frequency used; and</text></clause> <clause id="H1A1D811AA33845F4BBFE864BF004EFC5"><enum>(iii)</enum><text>the types of communications system and equipment used;</text></clause></subparagraph> <subparagraph id="HE4555FCDBDE64007A652AFE7D9B65446"><enum>(B)</enum><text>identifies the interoperable emergency communication systems in use for public safety systems in the United States; and</text></subparagraph> <subparagraph id="H057A8AA78BB34A6F98AA32F000528C23"><enum>(C)</enum><text>provides a listing of public safety mutual aid channels in operation and their ability to connect to an interoperable communications system;</text> </subparagraph></paragraph> <paragraph id="H9F29F7A9D79E49FF9EA5B5001602D5FB"><enum>(2)</enum><text>include, in consultation with the National Institute of Standards and Technology, a process for expediting national voluntary consensus-based emergency communications equipment standards for the purchase and use by public safety agencies of interoperable emergency communications equipment and technologies;</text></paragraph> <paragraph id="H410E5163EA6440DC82D202E5A3C7ABFA"><enum>(3)</enum><text>identify the appropriate interoperable emergency communications capabilities necessary for Federal, State, local, and tribal governments to operate at all threat levels;</text></paragraph> <paragraph id="HC4787EC6AF8044D6B05D25D0010881A3"><enum>(4)</enum><text>address both short-term and long-term solutions to achieving Federal, State, local, and tribal interoperable emergency communications systems, including provision of commercially available equipment that facilitates operability, interoperability, coordination, and integration among existing emergency communications systems;</text></paragraph> <paragraph id="HDDBE2CD4226A4D5C886C00679DDA41B1"><enum>(5)</enum><text>identify how Federal Government departments and agencies that respond to acts of terrorism, natural disasters, and other emergencies can work effectively with State, local, and tribal governments, in all States, and such other entities as are necessary to implement the strategy;</text></paragraph> <paragraph id="H2F3EB32BC84745929B550530A2481FD8"><enum>(6)</enum><text>include measures to identify and overcome all obstacles to achieving interoperable emergency communications; and</text></paragraph> <paragraph id="HBA0D475C649F4AE78D148EA07D555755"><enum>(7)</enum><text>set goals and establish timeframes for the achievement of an emergency, command-level communication system based on existing equipment across the United States and develop a timetable for a nationwide interoperable emergency communications system.</text></paragraph></subsection></section> <section id="HD179F6B1DDE44802B62817A0A4E76FD3" display-inline="no-display-inline" section-type="subsequent-section"><enum>563.</enum><header>Assessments and reports</header> <subsection id="H61A2E8D9BBA541F5BB86FD6BEEB88D2F"><enum>(a)</enum><header>Baseline operability and interoperability assessment</header><text>The Secretary, acting through the Assistant Secretary for Emergency Communications, shall periodically, but not less than every 5 years, conduct an assessment of Federal, State, local, and tribal governments, to—</text> <paragraph id="HE90E32F0019044F099A538F716ABCF7"><enum>(1)</enum><text>define the range of operable and interoperable emergency communications capabilities needed for specific events;</text></paragraph> <paragraph id="HABF2FF3AA8914B748D625299A185DD28"><enum>(2)</enum><text>assess the current capabilities to meet such communications needs;</text></paragraph> <paragraph id="H10857F7268CC48B3BD4EC749F200EE3C"><enum>(3)</enum><text>identify the gap between such current capabilities and defined requirements;</text></paragraph> <paragraph id="H3E74641F9F3B41FB9E3914F17F66B5E7"><enum>(4)</enum><text>determine the degree to which interoperable emergency communications has been achieved to date and ascertain the needs that remain for interoperability to be achieved;</text></paragraph> <paragraph id="H2EEC9055174B48ECA9873200777FCEE"><enum>(5)</enum><text display-inline="yes-display-inline">assess the ability of communities to provide and maintain interoperable emergency communications among emergency response providers, emergency response support providers, and government officials in the event of acts of terrorism, natural disasters, or other emergencies, including Incidents of National Significance declared by the Secretary under the National Response Plan, and where there is substantial damage to ordinary communications infrastructure or sustained loss of electricity; </text> </paragraph> <paragraph id="H815FA2F845F747A2A05BD670CB609CA4"><enum>(6)</enum><text>compile a list of best practices among communities for providing and maintaining interoperable emergency communications in the event of acts of terrorism, natural disasters, or other emergencies; and</text></paragraph> <paragraph id="HBB269BF74FF04253B026BBECBF00E923"><enum>(7)</enum><text>evaluate the feasibility and desirability of the Department developing, on its own or in conjunction with the Department of Defense, a mobile communications capability, modeled on the Army Signal Corps, that could be deployed to support emergency communications at the site of acts of terrorism, natural disasters, or other emergencies.</text></paragraph></subsection> <subsection id="H656409AFE4E346B8B60902DD475B3E2E"><enum>(b)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of this section, and annually thereafter, the Secretary, acting through the Assistant Secretary for Emergency Communications, shall submit to Congress a report on the Department’s progress in implementing and achieving the goals of this section, including a description of the findings of the nationwide assessment conducted under subsection (a).</text> </subsection></section> <section id="H9B8CD2A550AE41C983468D61BFD8E5EA"><enum>564.</enum><header>Coordination of Federal emergency communications grant programs</header> <subsection id="H81777BDAA73F42F6A441519751AA8443"><enum>(a)</enum><header>Assessment of grants and standards programs</header><text>The Secretary, acting through Assistant Secretary for Emergency Communications, shall assess Federal grants and standards programs managed by other Federal departments and agencies to—</text> <paragraph id="H349A64E70FD44D5F8DAF37CADABEF1F"><enum>(1)</enum><text>integrate and coordinate Federal grant guidelines for the use of Federal homeland security assistance relating to interoperable emergency communications;</text></paragraph> <paragraph id="HBCB1A826AEF745C6BFEDE1596642C381"><enum>(2)</enum><text>assess and make recommendations to ensure that such guidelines are consistent with the mission of the Office of Emergency Communications; and</text></paragraph> <paragraph id="H24B93D088AC84EE09BAECCFF87D4BA95"><enum>(3)</enum><text>assess and make recommendations to ensure conformity with the goals and objectives identified in the National Emergency Communications Strategy.</text></paragraph></subsection> <subsection id="H1EA653BC1458422EAF1EC57FE2EF0013"><enum>(b)</enum><header>Denial of eligibility for grants</header> <paragraph id="HAF66296E678C4A169CF0901B7E136598"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through Assistant Secretary for Grants and Planning, and in consultation with the Assistant Secretary for Emergency Communications, may prohibit any State, local, or tribal government from using Federal homeland security assistance administered by the Department to achieve, maintain, or enhance interoperable emergency communications capabilities, if—</text> <subparagraph id="H0725FCA1D9CD4D6DBAB8A1F0029A534"><enum>(A)</enum><text>such government has not complied with the requirement to submit a Statewide Interoperable Communications Plans as required by section 7303(f) of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/6/194">6 U.S.C. 194(f)</external-xref>); and</text></subparagraph> <subparagraph id="H43D6EA7CC157415992A8EB58A16201C8"><enum>(B)</enum><text>within three years after the date of the enactment of this section, national voluntary consensus standards for interoperable emergency communications capabilities have not been developed and promulgated.</text></subparagraph></paragraph> <paragraph id="H87A09F7260484F5793B647D9023DD91"><enum>(2)</enum><header>Standards</header><text>The Secretary, in coordination with other Federal departments and agencies with responsibility for standards shall develop, promulgate, and revise national voluntary consensus standards on interoperable emergency communications within 4 years after the date of the enactment of this section, if the requirements of paragraph (1)(B) have not been satisfied.</text></paragraph></subsection> <subsection id="H3C701F38D6AF41FAAE11D7CC337E42C2"><enum>(c)</enum><header>Transfer of functions</header><text>Not later than 60 days after the date of the enactment of this subsection, the President shall transfer to the Assistant Secretary for Emergency Communications the functions authorized by section 3006 of the Deficit Reduction Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/71">Public Law 109–71</external-xref>; 120 Stat. 24), including the authority to borrow under 3006(b) of that Act.</text></subsection></section> <section id="H78D8329D742248E99CB3BA0043605810"><enum>565.</enum><header>Regional emergency communications coordination</header> <subsection id="HC96B774EC7214127BF396421DD00F8BF"><enum>(a)</enum><header>In general</header><text>There is in each Regional Office under section 504 a Regional Emergency Communications Coordination Working Group (in this section referred to as an <quote>RECC Working Group</quote>).</text></subsection> <subsection id="HCB9DE57B23A24BBCA1FDD357EA473B83"><enum>(b)</enum><header>Subject matter experts</header><text>The RECC Working Group shall consist of the following:</text> <paragraph id="H16C5B134921B45D0A98494FFD800F5C"><enum>(1)</enum><header>Non-Federal</header><text>Organizations representing the interests of the following:</text> <subparagraph id="HB5CB39FC61BF42608308375B79E3FDE4"><enum>(A)</enum><text>State officials.</text></subparagraph> <subparagraph id="H192595325BCF46BCA61318A62EDEA0CC"><enum>(B)</enum><text>Local elected officials.</text></subparagraph> <subparagraph id="HB7B60A0582BE4C108427246685E7064F"><enum>(C)</enum><text>State police departments.</text></subparagraph> <subparagraph id="HE4734AD9978743AF87AF7DB2D8DC000"><enum>(D)</enum><text>Local police departments.</text></subparagraph> <subparagraph id="HDBEFEC52416F4264000365D036416401"><enum>(E)</enum><text>Local fire departments.</text></subparagraph> <subparagraph id="HE1AD6F70ECF54E9C91043D545599936F"><enum>(F)</enum><text>Public safety answering points (9–1–1 services).</text></subparagraph> <subparagraph id="H854BA28B7273462A8068F11005E6E57"><enum>(G)</enum><text>Communications equipment vendors (including broadband data service providers).</text></subparagraph> <subparagraph id="H1589687461C54DB99283EFF6C0E79422"><enum>(H)</enum><text>Hospitals.</text></subparagraph> <subparagraph id="H3A8FA82ED1A44DF4BB00216C51D427F"><enum>(I)</enum><text>Public utility services.</text></subparagraph> <subparagraph id="HDF1C1072F242437D922EE9CD4513B300"><enum>(J)</enum><text>Local exchange carriers.</text></subparagraph> <subparagraph id="H2AB455148FF444A1805DC0B65800AF08"><enum>(K)</enum><text>Local broadcast media.</text></subparagraph> <subparagraph id="HA353A04B9D4A45B39FA7A0E704A501E4"><enum>(L)</enum><text>Wireless carriers.</text></subparagraph> <subparagraph id="H5B5B5EAB0C6E49CDA8ADA91459334C9"><enum>(M)</enum><text>Satellite communications services.</text></subparagraph> <subparagraph id="H933C240FB6824E2FAED3727BDCD879CE"><enum>(N)</enum><text>Emergency evacuation transit services.</text></subparagraph> <subparagraph id="H88CD4F0315E442CAAB7CCBD9FA33359B"><enum>(O)</enum><text>Ambulance services.</text></subparagraph> <subparagraph id="HE03A6D9C8C8F4D8F98F9F98E348021E0"><enum>(P)</enum><text>HAM and amateur radio operators.</text></subparagraph> <subparagraph id="HB2CC4D98F354428F9561D5C203E54225"><enum>(Q)</enum><text>Emergency Managers, Homeland Security Directors, or representatives of State Administrative Agencies.</text></subparagraph> <subparagraph id="H1C08BC6E488149B79434DA554F94CB62"><enum>(R)</enum><text>Other emergency response providers or emergency support providers as deemed appropriate.</text></subparagraph></paragraph> <paragraph id="H863003A5289D414C876E57EA0B170AD"><enum>(2)</enum><header>Federal</header><text>Representatives from the Department and other Federal departments and agencies with responsibility for coordinating interoperable emergency communications with or providing emergency support services to State, local, and tribal governments.</text></paragraph> </subsection> <subsection id="H84B43FF94F134DDABB358F5C86A26FE4"><enum>(c)</enum><header>Duties</header><text>The duties of each RECC Working Group shall include—</text> <paragraph id="H6D9507548A7E48D487F0E0874820515D"><enum>(1)</enum><text>assessing the survivability, sustainability, and interoperability of local emergency communications systems to meet the goals of the National Emergency Communications Strategy;</text></paragraph> <paragraph id="H1DF3CB35CEF84546B243DC06B2062924"><enum>(2)</enum><text>reporting annually to the Assistant Secretary for Emergency Communications on the status of its region in building a robust and sustainable interoperable voice and data emergency communications network and on the progress of the region in meeting the goals of the National Emergency Communications Strategy under section 562 when such Strategy in complete;</text></paragraph> <paragraph id="H551EBF399DCC4CC58D2C15389900C4AE"><enum>(3)</enum><text>coordinating the establishment of an effective multi-jurisdictional, multi-agency emergency communications network for use during acts of terrorism, natural disasters, and other emergencies through the expanded use of emergency management and public safety communications mutual aid agreements; and</text></paragraph> <paragraph id="HED65BDE688F140A4B6638B5C83B16DE"><enum>(4)</enum><text display-inline="yes-display-inline">coordinating the establishment of Federal, State, local, and tribal support services and networks designed to address the immediate and critical human needs in responding to acts of terrorism, natural disasters, and other emergencies.</text></paragraph></subsection> </section> <section id="H98BB995B39E44912A3F50077677BE1CE" display-inline="no-display-inline" section-type="subsequent-section"><enum>566.</enum><header>Emergency Communications Preparedness Center</header> <subsection id="HFDDFE886FA89421FBB9D5BF2C0ED99F0"><enum>(a)</enum><header>Establishment</header><text>There is established the Emergency Communications Preparedness Center (in this section referred to as the <quote>Center</quote>).</text></subsection> <subsection id="HA40B0552B5974C59BD99DE5DC87800C6"><enum>(b)</enum><header>Operation</header> <paragraph id="HEBE96D2DBEF74370B548BC8645B349F2"><enum>(1)</enum><header>In general</header><text>The Secretary, the Chairman of the Federal Communication Commission, the Secretary of Defense, the Secretary of Commerce, the Attorney General, and the heads of other Federal departments and agencies or their designees shall jointly operate the Center in accordance with the Memorandum of Understanding entitled, <quote>Emergency Communications Preparedness Center (ECPC) Charter</quote>.</text></paragraph> <paragraph id="H1DA5F5553CF64C30AABD8E004B759F18"><enum>(2)</enum><header>Chair</header><text>The Secretary shall be the Chair of the Center.</text> </paragraph></subsection> <subsection id="H2F8A1B13EA30450C8B00A972987019E7"><enum>(c)</enum><header>Functions</header><text>The Center shall—</text> <paragraph id="H62B84894893E4DA28552DD8F6FE7176"><enum>(1)</enum><text>serve as the focal point for interagency efforts to address operable and interoperable communications;</text></paragraph> <paragraph id="HD5FE2E456D834B72AA143F443404779D"><enum>(2)</enum><text>serve as a clearinghouse with respect to all relevant information regarding intergovernmental efforts to achieve nationwide interoperable emergency communications capabilities;</text></paragraph> <paragraph id="H9205CD689E464344A081C98DAC8D6205"><enum>(3)</enum><text>ensure cooperation among the relevant Federal Government departments and agencies to improve effectiveness in the communication and implementation of the goals of the National Emergency Communications Strategy, including specifically by working to avoid duplication, hindrances, and counteractive efforts among the participating Federal departments and agencies; </text></paragraph> <paragraph id="HAC34DF28D5A34B24BC62F14C25337B9C"><enum>(4)</enum><text>prepare and submit to Congress, on an annual basis, a strategic assessment regarding the efforts of Federal departments and agencies to implement the National Emergency Communications Strategy; and </text> </paragraph> <paragraph id="H4AAD7338B25649A9B6C4241ED7EF9333"><enum>(5)</enum><text>perform such other functions as the President may assign.</text></paragraph></subsection> <subsection id="HB95384DD27DE417196754325B2503671"><enum>(d)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this section, the President shall transmit to the Congress a report regarding the implementation of this section, including a description of the staffing and resource needs of the Center.</text></subsection></section> <section id="HFB4D001F80AA4230BEB8A547E5FF3081"><enum>567.</enum><header>Urban and other high risk area communications capabilities</header> <subsection id="HDB167D88706347EFB4EC6BA2FC344DB2"><enum>(a)</enum><header>In general</header><text>The Secretary, in consultation with the Chairman of the Federal Communications Commission and the Secretary of Defense, and with appropriate State, local, and tribal government officials, shall provide technical guidance, training, and other assistance, as appropriate, to support the rapid establishment of consistent, secure, and effective interoperable emergency communications capabilities in the event of an emergency in urban and other areas determined by the Secretary to be at consistently high levels of risk from terrorist attack.</text></subsection> <subsection id="HF1C7A1CA86554611843117202DC011FA"><enum>(b)</enum><header>Minimum capabilities</header><text>The interoperable emergency communications capabilities established under subsection (a) shall ensure the ability of all levels of government, emergency response providers, emergency response support providers, the private sector, and other organizations with emergency response capabilities—</text> <paragraph id="H874B592323F24EAA92FD17F09F40A600"><enum>(1)</enum><text>to communicate with each other in the event of an emergency;</text></paragraph> <paragraph id="HCFA1A69E55014319A1B815F5F5A5AB94"><enum>(2)</enum><text>to have appropriate and timely access to the Information Sharing Environment described in section 1016 of the National Security Intelligence Reform Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/6/321">6 U.S.C. 321</external-xref>); and</text></paragraph> <paragraph id="H173EE89DEE504DA89F2F03CA25BCC6C8"><enum>(3)</enum><text>to be consistent with any applicable State or Urban Area homeland strategy or plan. </text></paragraph></subsection></section> <section id="HE91A16568545431DACBCA310ECE29546"><enum>568.</enum><header>Integrated national alert and warning system</header> <subsection id="H5247ACF1BDA0415C8938EAC50023CFB1"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Assistant Secretary for Emergency Communications, and in coordination with the head of any Federal department or agency that possesses or acquires alert and warning capabilities, including the Departments of Commerce and Defense and the Federal Communications Commission, shall develop, manage, operate, and coordinate an integrated national public alert and warning system that incorporates legacy systems.</text></subsection> <subsection id="HACEFAF6E3BFA4103B1AF614900F53F5E"><enum>(b)</enum><header>Requirements</header><text>Such system shall—</text> <paragraph id="HCA206621D1E24EFBA1CC79002D6C84CD"><enum>(1)</enum><text>be operational within 3 years of the date of enactment of this section;</text></paragraph> <paragraph id="H980997B1878D4CD78372BBD4553EB9E4"><enum>(2)</enum><text>ensure effective collaboration with State, local, and tribal governments;</text></paragraph> <paragraph id="H7A7AACDF28524FA0B58E27CFEB2661E1"><enum>(3)</enum><text>complement and provide interoperability with State, local, and tribal public alert and warning systems;</text></paragraph> <paragraph id="H518109094BC0487ABEF5172FA4AD2EFE"><enum>(4)</enum><text>ensure the interoperability of commercially available equipment for radio and data communications systems;</text></paragraph> <paragraph id="HCB021245DC5140C0A76FD7F4AF153E"><enum>(5)</enum><text>carry alert and warning messages for acts of terrorism, natural disasters, and other emergencies;</text></paragraph> <paragraph id="H067B554FD1A946168B63BA9FD7022EE5"><enum>(6)</enum><text>conduct regular internal training and exercises on generating and disseminating public alert and warning messages;</text></paragraph> <paragraph id="H61B69DDB27A04EA5A391D61622C5A64"><enum>(7)</enum><text>support public education and outreach to increase community awareness of the integrated national alert and warning system;</text></paragraph> <paragraph id="HA827B51D28C64D5EA423D3A366C1316F"><enum>(8)</enum><text>incorporate, to the maximum extent possible, technologies and systems that warn and support the unique needs faced by persons with disabilities or language barriers;</text></paragraph> <paragraph id="HA536BC67773D4150B4D6A10E427FF5B"><enum>(9)</enum><text>develop public–private partnerships to—</text> <subparagraph id="HD8A05B22CD9B422F8634846E74FFE68D"><enum>(A)</enum><text>leverage government and industry needs, capabilities, and resources necessary to delivery effective disaster warnings;</text></subparagraph> <subparagraph id="H080515D2D5FB4AB28D1E9588372D81EA"><enum>(B)</enum><text>facilitate the development, promulgation, and regular updating of national voluntary consensus standards for public alert and warning technologies;</text></subparagraph> <subparagraph id="HCD4C7BE3FF344BADAE237238DEFB2E36"><enum>(C)</enum><text display-inline="yes-display-inline">identify, in consultation with the Assistant Secretary for Infrastructure Protection and the Assistant Secretary for Cybersecurity and Telecommunications, critical infrastructure and key resources necessary to provide accurate, survivable, and sustainable public alerts and warnings; </text></subparagraph> <subparagraph id="H09AED0614C8B4D0282612BDC3DFFCE2E"><enum>(D)</enum><text>incorporate private sector threat information sharing into Federal, State, and local alert and warning systems; and</text></subparagraph> <subparagraph id="H493F17FDEF8545429016F07E5BAF8D17" commented="no"><enum>(E)</enum><text>ensure continuity of operations plans are in place to minimize the disruption to communications infrastructure used for the dissemination of public alerts and warnings;</text></subparagraph></paragraph> <paragraph id="HB5156A526EC04D1E9E899BF5B561D23"><enum>(10)</enum><text>promulgate standard operating procedures and protocols for the integrated national public alert and warning system; and</text></paragraph> <paragraph id="H119D636993D548F0A3F3A995234838D3"><enum>(11)</enum><text>identify and incorporate existing, new, and emerging technologies, including the utilization of both satellite and ground based alert and warning distribution networks to provide redundant, timely, and accurate public alerts and warnings.</text></paragraph> </subsection> <subsection id="HF4D4210D689C4BFCA9A786083B04D16C"><enum>(c)</enum><header>Implementation plan</header><text>The Secretary, acting through the Assistant Secretary for Emergency Communications, shall develop an implementation plan for this section within 180 days after the enactment of this section.</text></subsection></section></subtitle> <subtitle id="HA04B58AF3DDA43BFB6BC88A700BDF8D1"><enum>E</enum><header>Emergency Logistics</header> <section id="HE2485EEFE1964E6F9FF96780F1583FD5"><enum>581.</enum><header>Prepositioned equipment program</header> <subsection id="HB063617FC1FD46E8A5AE9517F5D2E0F1"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Under Secretary for Emergency Management, shall establish a Prepositioned Equipment Program to preposition standardized emergency equipment in selected geographic areas to sustain and replenish critical assets used by State, local, or tribal governments in response to, or rendered inoperable by the effects of, acts of terrorism, natural disasters, or other emergencies.</text></subsection> <subsection id="H5D27CADD1FF1453994DA48F4A9482301"><enum>(b)</enum><header>Force packages</header><text>As part of the Program, the Secretary shall establish a number of force packages. Each force package shall—</text> <paragraph id="HD2B7A247BF4D41BAAF47B921DF6EB828"><enum>(1)</enum><text>contain preposition-standardized equipment and frequently used off-the-shelf items;</text></paragraph> <paragraph id="H417D07D1E26046DE9FB4056001E5C823"><enum>(2)</enum><text>be strategically located and maintained at logistics centers in no less than 11 regions and, to the extent practicable, co-located with the push packages of the Strategic National Stockpile;</text></paragraph> <paragraph id="HB04FEA71B34C4771A8CE00B6A30078BD"><enum>(3)</enum><text>be rapidly deployable to any major population area within at least 12 hours; and</text></paragraph> <paragraph id="H7281A1F32E824B80B39C7939AA9F20F"><enum>(4)</enum><text>be easily transportable by air, land, or water.</text></paragraph></subsection> <subsection id="H5EE823A72D944334BEFF98C5B516BA39"><enum>(c)</enum><header>Types of equipment included</header><text>Each force package shall include—</text> <paragraph id="H08B661BE50964019B2E5002E962C2B01"><enum>(1)</enum><text>personal protective equipment;</text></paragraph> <paragraph id="H502532D99E2D4C33AC0738D53841A800"><enum>(2)</enum><text>detection equipment;</text></paragraph> <paragraph id="HDA5B37F5FCD14C4D924C5D601BEECEFB"><enum>(3)</enum><text>decontamination equipment;</text></paragraph> <paragraph id="HA2D49803B3DC4C8A9DE3C426CE3E46FB"><enum>(2)</enum><text>search and rescue equipment;</text></paragraph> <paragraph id="H9E5F9CC194C943288FFAA174B6E13D10"><enum>(3)</enum><text>medical equipment and supplies;</text></paragraph> <paragraph id="HDF9C63841CC34542BA1209E6C215A3F0"><enum>(4)</enum><text>communications equipment; and</text></paragraph> <paragraph id="HAEAE2EBCF931429986632D1C15616CB8"><enum>(5)</enum><text>any additional devices, tools, supplies, and material most likely needed by initial on-scene emergency response providers.</text></paragraph></subsection> <subsection id="HC9B6DA0CC282429EAE707EFD4B689E2F"><enum>(d)</enum><header>Support teams</header><text display-inline="yes-display-inline">Each force package shall be staffed by qualified and trained personnel who reside in the region. Such personnel shall—</text> <paragraph id="H50009F05BC4646AB9D4B2D62D6F9A49"><enum>(1)</enum><text>be available to respond to emergencies when necessary;</text></paragraph> <paragraph id="HD285968351BD4E21997019F386D95D8D"><enum>(2)</enum><text>provide life-cycle management and maintenance of equipment; and</text></paragraph> <paragraph id="H414ABCFD8C4C4089BD2DBC6BB759BFB8"><enum>(3)</enum><text>perform associated logistics, including equipment maintenance and calibration.</text></paragraph></subsection> <subsection id="HAE2C59400E3941B2B53B5DE32F9D97A9"><enum>(e)</enum><header>Procedures for deployment of force packages</header><text>The Secretary, acting through the Under Secretary, shall deploy force packages to State, local, and tribal officials when—</text> <paragraph id="H7D7C98C3D09D441F9E0118D618803B00"><enum>(1)</enum><text>a State or local government entity, through the Governor of the State, or a tribal government entity, makes a request for the transfer deployment of a force package; and</text></paragraph> <paragraph id="HD587571B782A42C8BCD62FB73CF97E2C"><enum>(2)</enum><text>the Under Secretary approves such request.</text></paragraph></subsection> <subsection id="H10638E2B452642909C04A518F2302377"><enum>(f)</enum><header>Coordination</header><text>In carrying out the Prepositioned Equipment Program under this section, the Secretary shall coordinate with the Secretaries of Defense and Health and Human Services and with the heads of such other Federal departments and agencies as the Secretary determines are appropriate.</text></subsection></section> <section id="H3CB9C5A9452D47F700968ECBB7FB20A6"><enum>582.</enum><header>National Asset Inventory Program</header> <subsection id="H4E035409DB814B24BBFAEAB73399D700"><enum>(a)</enum><header>Establishment</header><text>The Secretary, acting through the Under Secretary for Emergency Management and in coordination with the heads of other appropriate Federal departments and agencies, shall establish a National Asset Inventory Program for the purpose of managing and deploying Federal capabilities in response to acts of terrorism, natural disasters, and other emergencies.</text></subsection> <subsection id="HB0809B3BA50C4493B9BCC58CA2BD41B8"><enum>(b)</enum><header>Inventory</header><text display-inline="yes-display-inline">In accordance with the requirements of section 611(h)(1)(C) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5196">42 U.S.C. 5196(h)(1)(C)</external-xref>), the National Asset Inventory Program shall develop and maintain an inventory of Federal response capabilities and corresponding assets and resources. Such inventory shall include—</text> <paragraph id="H8F21E2659B0B439683733E59C6A5E2F1"><enum>(1)</enum><text>the performance parameters of each capability;</text></paragraph> <paragraph id="HDE9872ADBA354C728C872885414FB5F0"><enum>(2)</enum><text>the time frame within which each capability can be available for deployment to an incident;</text></paragraph> <paragraph id="H231299DD0B7445029FB6CDACCE00FDBB"><enum>(3)</enum><text>the readiness of each capability to respond to domestic incidents; and</text></paragraph> <paragraph id="HCB0F5F9F8CBF4905A1CC7421B49BBC"><enum>(4)</enum><text>the availability of such capability.</text></paragraph></subsection> <subsection id="H73E1D28067094B29A81B002499492DD4"><enum>(c)</enum><header>Military capabilities</header><text>The Secretary of Defense shall provide to the Secretary a description of the functions and capabilities of any entity of the Department of Defense that may be used to provide support to civil authorities in responding to acts of terrorism, natural disasters, or other emergencies.</text></subsection> <subsection id="HD36FD296AA0E42E5A251962CB1470003"><enum>(d)</enum><header>Database</header><text>The Secretary, acting through the Under Secretary for Emergency Management, shall establish an inventory database to allow—</text> <paragraph id="HD2265F55836C4ED199BAB71F21B7A0B2"><enum>(1)</enum><text>real-time exchange of information regarding capabilities, assets, and resources, readiness, or the compatibility of equipment;</text></paragraph> <paragraph id="H2895B9F7929643D7B040241776102D8D"><enum>(2)</enum><text>easy identification and rapid deployment during an incident; and</text></paragraph> <paragraph id="H00EE14A1CA804FCE9BD221EC1EB257DA"><enum>(3)</enum><text>the sharing of inventories across jurisdictions.</text></paragraph></subsection> <subsection id="HFE35C4910FF44D898D2626AD8DC5AFAE"><enum>(e)</enum><header>Force packages</header><text>The Secretary, acting though the Under Secretary for Emergency Management, shall certify on an annual basis that Federal departments and agencies with primary or supporting agency responsibilities under an emergency support function of the National Response Plan have developed and maintained force packages of rapidly deployable Federal capabilities.</text></subsection> <subsection id="HA483E6973FDA4AD2B8414CBC1D26FCB5"><enum>(f)</enum><header>Logistics support centers</header><text>The Secretary, acting through the Under Secretary and in coordination with other Federal departments and agencies and State, local, and tribal governments, shall identify physical locations in selected geographic areas that could be used as logistics support centers for receiving, staging, and integrating Federal capabilities in the event of acts of terrorism, natural disasters, and other emergencies.</text></subsection> <subsection id="H1ADD21C7502E4AECB29E862E7D60739C"><enum>(g)</enum><header>Coordination</header><text>In carrying out the activities of the program under this section, the Under Secretary shall consult with the Administrator of the Emergency Management Assistance Compact to ensure effective coordination of efforts in responding to requests for assistance.</text></subsection></section> <section id="H476E2462B591448F8F888B13A89CA352" display-inline="no-display-inline"><enum>583.</enum><header>Small business database for Federal contracting related to major disasters and emergency assistance activities</header> <subsection id="H6E4390D0F7D84591BE42C7D5A8B0CA9E"><enum>(a)</enum><header>Establishment of database</header><text display-inline="yes-display-inline">The Secretary, acting through the Under Secretary for Emergency Management and in coordination with the Regional Directors under section 504, shall establish and maintain a database that contains information about small business entities for purposes of Federal contracting related to assistance activities conducted in response to and recovery from acts of terrorism, natural disasters, and other emergencies.</text></subsection> <subsection id="HDC6FC8B5642C4BA692BBEF59F415C002"><enum>(b)</enum><header>Included information</header><text>The database under subsection (a) shall include the following information about each small business entity included in the database:</text> <paragraph id="HF46B343EF5E6486E88877321F64F85A3"><enum>(1)</enum><text>The name of the small business entity.</text></paragraph> <paragraph id="H8A951E051E664DA6AA6D934EC600349C"><enum>(2)</enum><text>The location of the small business entity.</text></paragraph> <paragraph id="HCA76156A0ECF4B7BB9721D36A827F424"><enum>(3)</enum><text>The area served by the small business entity.</text></paragraph> <paragraph id="H7DDC45DEF3074C7596358356754D1766"><enum>(4)</enum><text>The type of good or service provided by the small business entity.</text></paragraph> <paragraph id="H677A52D5AED24209ADA70500328FB2EC"><enum>(5)</enum><text>Whether the small business entity is—</text> <subparagraph id="HEB44681805244BDD9000C9457064F581"><enum>(A)</enum><text>a small business entity owned and controlled by socially and economically disadvantaged individuals;</text></subparagraph> <subparagraph id="HF56DA8341A024D9299555198CFD3ABBE"><enum>(B)</enum><text>a small business entity owned and controlled by women; or</text></subparagraph> <subparagraph id="HA39A8800676545C1AA4F73378D02DE14"><enum>(C)</enum><text>a small business entity owned and controlled by service-disabled veterans.</text></subparagraph></paragraph></subsection> <subsection id="HD06A7058945F410000B7979D09CFA89B"><enum>(c)</enum><header>Source of information</header> <paragraph id="H0603EFEB5A3C40169E13CFA0FF8C28CB"><enum>(1)</enum><header>Submission</header><text>The database may only contain such information about a small business entity as is submitted by the small business entity.</text></paragraph> <paragraph id="H7CC061FBEA564EFC95934B00E458FF00"><enum>(2)</enum><header>Attestation</header><text>Each small business entity submitting information to the database shall submit—</text> <subparagraph id="H756AA5095BE349B1889FDCA23E367339"><enum>(A)</enum><text>an attestation that the information submitted is true; and</text></subparagraph> <subparagraph id="HDF21680845E9407200052CB2B907AFD3"><enum>(B)</enum><text>documentation supporting such attestation.</text></subparagraph></paragraph> <paragraph id="HA84091D575624C769D8398DB00289851"><enum>(3)</enum><header>Verification</header><text>The Secretary shall verify only that the documentation submitted by each small business entity supports the information submitted by that small business entity.</text></paragraph> </subsection> <subsection id="HA7CE8D610AA240BCAFDB6CCF41942D3"><enum>(d)</enum><header>Availability of database</header><text>The Secretary shall make the database generally available on the Internet website of the Department.</text></subsection> <subsection id="HD810885299A843339DB8F700CA646061"><enum>(e)</enum><header>Consultation of database</header><text>Before awarding a Federal contract for a disaster-related activity, a component of the Department shall consult the database established under this section.</text></subsection> <subsection id="HBA422A3589B64CD18C45766C83172842"><enum>(f)</enum><header>Database integration</header><text>The Secretary shall integrate the database established under this section into any other procurement-related database maintained by the Secretary.</text> </subsection> <subsection id="H67D22DDD3A7544B08D0060D885963358"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section, the terms <quote>small business entity</quote>, <quote>small business entity owned and controlled by socially and economically disadvantaged individuals</quote>, <quote>small business entity owned and controlled by women</quote>, and <quote>small business entity owned and controlled by service-disabled veterans</quote> shall have the meanings given the terms <quote>small business concern</quote>, <quote>small business concern owned and controlled by socially and economically disadvantaged individuals</quote>, <quote>small business concern owned and controlled by women</quote>, and <quote>small business concern owned and controlled by service-disabled veterans</quote> respectively under the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>).</text></subsection></section> <section id="H6033F98BDABB4486AAEF47625956ECB1"><enum>584.</enum><header>Fraud prevention training program</header> <subsection id="H293C058EACE345FABF7BDA97FBCCFC00"><enum>(a)</enum><header>Training program required</header><text display-inline="yes-display-inline">The Secretary, acting through the Under Secretary for Emergency Management, shall develop and implement a program to provide training on the prevention of waste, fraud, and abuse of Federal assistance funds and services during the response to or recovery from acts of terrorism, natural disasters, or other emergencies and ways to identify such potential waste, fraud, and abuse.</text></subsection> <subsection id="H5ADDDF0B7AEA472EB3069309C7D427B2"><enum>(b)</enum><header>Individuals eligible for training</header><text>Under the training program required under subsection (a), the Secretary may provide training to—</text> <paragraph id="H7352D288510B4ADE8240EC70C0F09541"><enum>(1)</enum><text>employees, contractors, and volunteers of the Federal Government;</text></paragraph> <paragraph id="HABB71D3DBE1E4C848D92ACB0C67DFBC1"><enum>(2)</enum><text>employees and volunteers of any State, local, or tribal government entity; and</text></paragraph> <paragraph id="H6CD2BFC8AF344BB98610F09311C6DDB0"><enum>(3)</enum><text>employees and volunteers of non-profit organizations that assist in the administration of Federal assistance funds and services provided in response to acts of terrorism, natural disasters, or other national emergencies. </text></paragraph></subsection> <subsection id="HAE903144EBF645CC95C5E90773F6E5D"><enum>(c)</enum><header>Information sharing</header><text>Any State, local, or tribal government entity or non-profit entity that provides Federal assistance funds or services to individuals affected by acts of terrorism, natural disasters, or other emergencies may share information with the Federal Government, in a manner consistent with Federal Privacy Act protections, about any recipient of such assistance, at the request of the head of a Federal department or agency, for the purpose of preventing fraud and abuse of Federal assistance.</text></subsection></section> </subtitle> <subtitle id="H5708D907FD3B46F6AC894BCC1B60892E"><enum>F</enum><header>Infrastructure Protection and Cybersecurity</header> <section id="H8BB56761786F438D8BFFE89374532894"><enum>591.</enum><header>Office of Infrastructure Protection</header> <subsection id="H0CEBA8A38F644D61962D691191DCC31"><enum>(a)</enum><header>In general</header><text>There is in the Department an Office of Infrastructure Protection under the authority of the Under Secretary for Emergency Management.</text></subsection> <subsection id="HF1D9B3939C6046AF83BC4D72B273D4A6"><enum>(b)</enum><header>Assistant Secretary for Infrastructure Protection</header><text>The head of the Office shall be the Assistant Secretary for Infrastructure Protection. The Assistant Secretary shall report directly to the Under Secretary for Emergency Management.</text></subsection> <subsection id="HB70DCE41EBF8449581378CA521C4DCBA"><enum>(c)</enum><header>Responsibilities of the Assistant Secretary</header><text>The Assistant Secretary shall carry out the responsibilities of the Department regarding infrastructure protection. Such responsibilities shall include the following:</text> <paragraph id="HDAE44320E48B41C988B5640099E55EF0"><enum>(1)</enum><text>To identify and carry out comprehensive risk assessments of key resources and critical infrastructure of the United States, to determine the risks posed by particular types of terrorist attacks within the United States (including an assessment of the probability of success of such attacks and the feasibility and potential efficacy of various countermeasures to such attacks).</text></paragraph> <paragraph id="HFEFBB0F47AA04EEFBDBB197900D04D33"><enum>(2)</enum><text>To develop and maintain a comprehensive national plan for securing the key resources and critical infrastructure of the United States, in accordance with Homeland Security Presidential Directive 7.</text></paragraph> <paragraph id="H71DAF0816D594E01BBADA0D0BAB4CFB"><enum>(3)</enum><text>To recommend measures necessary to protect the key resources and critical infrastructure of the United States in coordination with other Federal Departments and agencies and in consultation with State, local, and tribal government agencies and authorities, and the private sector.</text></paragraph> <paragraph id="HC0BDB4750EDD4843B8F400F7F64F6BD7"><enum>(4)</enum><text>To coordinate and implement, as appropriate, preparedness efforts to ensure that critical infrastructure and key resources efforts are fully integrated and coordinated with the response and recovery activities of the Department.</text></paragraph> <paragraph id="H841E5C6791DE44C0B9394953340639D0"><enum>(5)</enum><text>To establish and maintain partnerships and information sharing processes with Federal, State, local, and tribal governments, the private sector, and international governments and organizations to enhance coordination of critical infrastructure and key resource efforts.</text></paragraph> <paragraph id="H94C2F191FA164C91B7BC984CF5B18BDA"><enum>(6)</enum><text>To coordinate with the Under Secretary for Intelligence and Analysis and elements of the intelligence community and with Federal, State, local, and tribal law enforcement agencies, and the private sector, as appropriate.</text></paragraph> <paragraph id="H9491EBF141954CE794D1F417256966E5"><enum>(7)</enum><text>To provide the Secretary with an annual summary of national critical infrastructure protection efforts and priorities and to provide, in consultation with the Assistant Secretary for Grants and Planning, recommendations for Federal critical infrastructure protection funding.</text></paragraph> <paragraph id="H80ADC73E65F24ACE9BCC9651D906F6BB"><enum>(8)</enum><text>In carrying out responsibilities under paragraphs (1) and (2), to consult with other Federal, State, local, and tribal government agencies and authorities as appropriate.</text></paragraph> <paragraph id="H571B2B6E1AB14A3FB170145B2EEFD298"><enum>(9)</enum><text>To perform other such duties relating to such responsibilities as the Secretary may provide.</text></paragraph></subsection> <subsection id="HE7D5058501E546E590B67BF8DAC1C101"><enum>(d)</enum><header>Integration Center</header> <paragraph id="H864E8F1902CE454C82955D14E16C32E0"><enum>(1)</enum><header>In general</header><text>There is an Integration Center in the Office of Infrastructure Protection, which shall be staffed by the Office of Infrastructure Protection, the Office of Cybersecurity and Telecommunications, and the Office of Intelligence and Analysis.</text></paragraph> <paragraph id="H08EB443D53134B3FB0D43700C46300B6"><enum>(2)</enum><header>Responsibilities</header><text>The Integration Center shall—</text> <subparagraph id="H61BC5657CD6B402096A4674C25426472"><enum>(A)</enum><text>be responsible for the integration of relevant threat, consequence, and vulnerability information, analysis, and assessments (whether such information, analysis, or assessments are provided or produced by the Department or others) in order to identify priorities for protective and support measures by the Department, other Federal departments and agencies, State, local, and tribal government agencies and authorities, the private sector, and other entities; Gulf Coast Long-Term Recovery Office
(a)
Establishment
The Secretary of Homeland Security shall establish in the Department of Homeland Security a Gulf Coast Long-Term Recovery Office to administer amounts available to the Department for providing assistance to the residents of the Gulf Coast region for recovering from Hurricanes Katrina and Rita. (b)
Director
The Office shall be headed by a Director, who shall be appointed by the Secretary of Homeland Security. (c)
Responsibilities
The Director of the Gulf Coast Long-Term Recovery Office shall work with State, local, and tribal governments, the private sector, and nongovernmental organizations, including faith-based and other community humanitarian relief entities, to provide assistance to residents of the Gulf Coast region for recovering from Hurricanes Katrina and Rita, including the following: (1)To assess the social and economic consequences in the areas affected by Hurricanes Katrina and Rita and coordinate Federal efforts to address long-term community recovery issues. (2)To advise the Secretary of Homeland Security on the long-term community recovery implications of response activities. (3)To conduct comprehensive market disruption and loss analysis and develop a forward looking market-based comprehensive long-term recovery plan for the affected areas. (4)To identify appropriate Federal programs and agencies to support the implementation of the long-term community recovery plan, to ensure coordination across appropriate Federal departments and agencies, and to identify any gaps in the available resources. (5)To avoid duplication of assistance, to coordinate, to the extent possible, program application processes and planning requirements in order to streamline assistance, and to identify and coordinate the resolution of policy and program issues. (6)To determine responsibilities for recovery activities, to provide a method of maintaining continuity in the delivery of assistance under programs administered by various Federal departments and agencies, and to oversee coordination with State, local, and tribal governments and other involved parties, to ensure follow-through of recovery and hazard mitigation efforts. National Disaster Medical System
(a)
Authorization of appropriations
Section 2811 of the Public Health Service Act (42 U.S.C. 300hh–11), as added by section 102 of the Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (116 Stat. 599), is amended in subsection (h) by striking such sums and all that follows and inserting $85,000,000 for each of the fiscal years 2007 through 2010.. (b)
Report
Not later than 9 months after the date of the enactment of this Act, the Chief Medical Officer of the Department of Homeland Security, in consultation with the Under Secretary for Emergency Management, shall submit to Congress a report that provides— (1)an assessment of the need to expand the National Disaster Medical System, including an examination of the feasibility of maintaining a full time, non-volunteer operational unit or units; (2)an evaluation of the relationship between the National Disaster Medical System and the Metropolitan Medical Response System; (3)an assessment of the coordination between the Department and the Department of Health and Human Services during deployment; and (4)an evaluation of whether the National Disaster Medical System should remain in the Department and, if not, which Department should have responsibility.

(a)
Clarification of responsibilities
The Director of the Office of Interoperability and Compatibility shall— (1)assist the Secretary in developing and implementing the science and technology aspects of the program described in subparagraphs (D), (E), (F), and (G) of section 7303(a)(1) of the Intelligence Reform and Terrorism Prevention Act of 2004 (6 U.S.C. 194(a)(1)); (2)support the creation of national voluntary consensus standards for interoperable emergency communications; (3)establish a comprehensive research, development, testing, and evaluation program for improving interoperable emergency communications; (4)establish requirements for total and nonproprietary interoperable emergency communications capabilities for all public safety radio and data communications systems and equipment; (5)evaluate and validate new technology concepts in real-world environments to achieve interoperable emergency communications capabilities; (6)encourage more efficient use of existing resources, including equipment and spectrum, to achieve interoperable emergency communications capabilities; (7)test and deploy public safety communications systems that are less prone to failure, support new nonvoice services, consume less spectrum, and cost less than existing systems; and (8)work with the private sector to develop solutions to improve emergency communications capabilities and achieve interoperable emergency communications capabilities. (b)
Coordination
The Director shall coordinate with the Assistant Secretary for Emergency Communications with respect to the SAFECOM program. (c)
Sufficiency of resources
The Secretary shall provide the Office for Interoperability and Compatibility the resources and staff necessary to carry out the responsibilities under this section.

Intelligence analysts
(a)
In general
Financial assistance provided to State, local, and tribal governments by the Secretary of Homeland Security for prevention activities may be used by the State, local, or tribal government to hire new staff and contractors to serve as intelligence analysts to facilitate information and intelligence sharing activities. (b)
Qualifications
An individual shall successfully complete training to ensure baseline proficiency in intelligence analysis and production before the individual may serve as an intelligence analyst or as a staff intelligence employee or contractor. (c)
Effective date
The requirements under subsection (b) shall apply with respect to an individual hired after the date of the enactment of this Act.

National Academy of Public Administration study on implementation of organizational reforms
(a)
Study required
Subject to the availability of appropriations, the Secretary of Homeland Security shall enter into an arrangement with the National Academy of Public Administration to conduct a study of the implementation of the organizational changes to the Department of Homeland Security made by this Act and the amendments made by this Act. Under the arrangement, the Academy shall provide assistance in the creation and implementation of the Directorate of Emergency Management. (b)
Deadline for beginning of study
The study required under this section shall begin not later than two months after the date of the enactment of this Act. (c)
Termination
The study required under this section shall end not later than the date that is one year after the date of the enactment of this Act.

GAO reports on an inventory and status of homeland security training
(a)
Initial report required
Not later than 60 days after the date of the enactment of this Act, the Comptroller General shall submit to Congress an initial report on the overall inventory and status of training programs for emergency response providers in the Department of Homeland Security and other Federal departments and agencies and the extent to which such programs are coordinated. (b)
Final report required
Not later than 120 days after the date of the enactment of this Act, the Comptroller General shall submit to Congress a final report on homeland security training that includes the following: (1)An assessment of the effectiveness of the structure and organization of training programs for emergency response providers in the Department of Homeland Security and other Federal departments and agencies. (2)Recommendations to— (A)improve the coordination, structure, and organization of such training programs; and (B)increase the availability of training to emergency response providers who are not able to attend centralized training programs. (3)A description of the structure and organizational effectiveness of such programs for emergency response providers in rural communities. (4)An identification of any duplication or redundancy among such programs. (5)A description of the use of State and local training institutions, universities, centers, the National Domestic Preparedness Consortium, and other national training programs funded by the Department of Homeland Security, in designing and providing training. (6)A cost-benefit analysis of the costs and time required for emergency response providers to participate in training courses at Federal institutions. (7)An assessment of the approval process for certifying training courses that are not administered by the Department of Homeland Security and that are useful for anti-terrorism purposes and eligible for grants awarded by the Department. (8)A description of the use of Department of Homeland Security grant funds by State, local, and tribal governments to acquire training. (9)An analysis of the feasibility of Federal, State, local, and tribal government personnel receiving the training that is necessary to adopt the National Response Plan and the National Incident Management System of the Department of Homeland Security. (10)A description of the role of each training institution within the Department of Homeland Security in the design and implementation of emergency preparedness and related training courses for emergency response providers.

(18)The term prevention means any activity undertaken to avoid, prevent, or stop a threatened or actual act of terrorism. and</text></paragraph> <paragraph id="H4942FF123A624BA191B4890662F4ACEA"><enum>(2)</enum><text>report the findings of such assessment to Congress by not later than one year after the date of enactment of this Act.</text></paragraph></subsection> <subsection id="H76D6E1904FFB4CF994F69C42385D5269"><enum>(b)</enum><header>Utilization of IPSIGs to monitor and provide greater accountability</header><text>Such assessment shall include examination of how IPSIGs may be utilized to monitor and provide greater accountability for contracts using Federal funding provided in response to a terrorist attack, natural disaster, or other national emergency, including contracts for debris removal and the repair or reconstruction of damaged infrastructure.</text></subsection></section> <section id="HB46D8AFBA05D4EB39BB4F0BE58CD249C"><enum>203.</enum><header>Enhanced accountability for Federal assistance</header><text display-inline="yes-display-inline"></text> <subsection id="H2D6A950E5A7E43B9BEFB9CEFDED8D5CC"><enum>(a)</enum><header>In general</header><text>The Homeland Security Act of 2002 is amended by inserting after section 856 (<external-xref legal-doc="usc" parsable-cite="usc/6/426">6 U.S.C. 426</external-xref>) the following:</text> <quoted-block style="OLC" id="H2B1BDC0FC52C441A92E746A2A2C493BA" display-inline="no-display-inline"> <section id="HFA9C3D44E8EC435D85FC2D38941E55F4"><enum>856a.</enum><header>Enhanced accountability for Federal assistance</header><text display-inline="yes-display-inline"></text> <subsection id="H7F040F66D3924AF896A9F41B6BE73E98"><enum>(a)</enum><header>Recipients of Federal assistance</header> <paragraph id="HE84E503FBEB342FB85508EE810D197CB"><enum>(1)</enum><header>In general</header><text>Each State, local, tribal, and non-profit entity that receives Federal assistance funds in response to acts of terrorism, natural disasters, or other emergencies shall report to the pertinent Federal agency six months after the initial disbursement of resources regarding the expenditure of such funds.</text></paragraph> <paragraph id="H7C92C420D7BB4F9191289D42AC5C0151"><enum>(2)</enum><header>Contents</header><text>The report shall include a description of—</text> <subparagraph id="H8D28A6E7696D43CB8BF72E11EAE94A2"><enum>(A)</enum><text>the projects or programs that received Federal assistance;</text></subparagraph> <subparagraph id="H3E7D8030EEF34A6EA9CC56D85845552"><enum>(B)</enum><text>the entity administering the program or project; and</text></subparagraph> <subparagraph id="HC2640063FF9344ABBADB06DDA936909"><enum>(C)</enum><text>the dates and amounts disbursed, allocated, and expended.</text></subparagraph></paragraph></subsection> <subsection id="HEF986F96212945D096FAAB117E297B81"><enum>(b)</enum><header>Federal assistance disbursing agencies</header> <paragraph id="HC78B48FCF6F94EF2BAA9C8C668F7F0D"><enum>(1)</enum><header>In general</header><text>Each Federal agency that disburses Federal assistance funds in response to an act of terrorism, a natural disaster, or another emergency shall report to the Inspector General of the Department, acting in the Inspector General’s role as chairman of the President’s Council on Integrity and Efficiency Homeland Security Roundtable, regarding the expenditure of such funds.</text></paragraph> <paragraph id="H168FEBAE88F54EFF8200B4AC00D28FA4"><enum>(2)</enum><header>Contents</header><text>The report shall include—</text> <subparagraph id="HB024B319523F4157B731A815407EF65F"><enum>(A)</enum><text>names and addresses of recipient agencies;</text></subparagraph> <subparagraph id="H8D927BF1A99945C4A9559B2F111F9217"><enum>(B)</enum><text>the purpose for which resources were provided;</text></subparagraph> <subparagraph id="H453E004E6C494E1DB358A640B7A4EE5F"><enum>(C)</enum><text>the amounts disbursed, allocated, and expended; Enhanced information sharing among Federal agencies to prevent fraud, waste, and abuse. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="HB12C21EC06854D8BB00946D6B526E9BA"><enum>205.</enum><header>Deputy Inspector General for Response and Recovery</header><text display-inline="yes-display-inline"></text> <subsection id="H75C6B27758934AA284535B07F52799B2"><enum>(a)</enum><header>In general</header><text>Subtitle B of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/371">6 U.S.C. 371</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H38DBEF6DF1F94F49A78700CF3038295B" display-inline="no-display-inline"> <section id="H918EFBF1A789435FA381D1D0255D7836"><enum>813.</enum><header>Deputy Inspector General for Response and Recovery</header><text display-inline="yes-display-inline"></text> <subsection id="H53CD15FAD6454CE6926300F5AEA9A040"><enum>(a)</enum><header>Establishment</header><text>There is established the position of Deputy Inspector General for Response and Recovery within the Office of the Inspector General of the Department.</text></subsection> <subsection id="HB227F6C151F64B1D9EEE86E54870FAF9"><enum>(b)</enum><header>Appointment</header><text>The Deputy Inspector General shall be appointed—</text> <paragraph id="H26AAA46553584A64BA27B17DB6EA41DE"><enum>(1)</enum><text>by the Inspector General of the Department; and</text></paragraph> <paragraph id="HF6C755A61B4F44669491028106D62E13"><enum>(2)</enum><text>solely on the basis of integrity and demonstrated ability in accounting, auditing, financial analysis, law, management analysis, public administration, or investigations.</text></paragraph></subsection> <subsection id="HC04D91D8DB66481287577CE41FE28727"><enum>(c)</enum><header>Reporting and status as SES position</header><text>The Deputy Inspector General—</text> <paragraph id="H5C354FF1E9DF48D685F9639411ED8B27"><enum>(1)</enum><text>shall report to, and be under the direct authority and supervision of, the Inspector General; and</text></paragraph> <paragraph id="H725F86B5EF264D379890C7409EA76410"><enum>(2)</enum><text>the Deputy Inspector General shall serve as a career member of the Senior Executive Service.</text></paragraph></subsection> <subsection id="H52BFC0E335D94ED3B7146124E19CDFE5"><enum>(d)</enum><header>Duties</header> <paragraph id="HCDD0643CE1AF401D86AD5CC2DEBFADA"><enum>(1)</enum><header>Audits and investigations</header><text>The deputy Inspector General shall, in coordination with inspectors general of other departments, as appropriate, conduct, supervise, and coordinate audits and investigations of the treatment, handling, and expenditure of amounts appropriated or otherwise made available for response to and recovery from an act of terrorism, natural disaster, or other emergency by the Federal Government, and of the programs, operations, and contracts carried out utilizing such funds, including—</text> <subparagraph id="HBB4FB4046D7440050098543824007629"><enum>(A)</enum><text>the oversight and accounting of the obligation and expenditure of such funds;</text></subparagraph> <subparagraph id="HE020F696EE04469A94BCB51984A15EB1"><enum>(B)</enum><text>the monitoring and review of reconstruction activities funded by such funds;</text></subparagraph> <subparagraph id="H622F962C4CC94CF787C000A8948FA9E1"><enum>(C)</enum><text>the monitoring and review of contracts by such funds;</text></subparagraph> <subparagraph id="HFC271DC961B444E6828800A774A1638B"><enum>(D)</enum><text>the monitoring and review of the transfer of such funds and associated information between and among departments, agencies, and entities of the United States, and private nongovernmental entities; and</text></subparagraph> <subparagraph id="HF27BC2094E5D47D19D025991025C7960"><enum>(E)</enum><text>the maintenance of records on the use of such funds to facilitate future audits and investigations of such funds.</text></subparagraph></paragraph> <paragraph id="H40EE247756BF48F2AE48E9988379AB1B"><enum>(2)</enum><header>Fraud tip line</header><text>The Deputy Inspector General shall ensure that not more than 48 hours after a terrorist attack, natural disaster, or other national emergency, the Office of the Inspector General institutes and publicizes a Fraud Tip Line to facilitate the collection of allegations of waste, fraud, and abuse of Federal assistance funds.</text></paragraph> <paragraph id="HE83A66B28AEF4A079837858FF00839BA"><enum>(3)</enum><header>Avoidance of duplication</header><text>The Deputy Inspector General shall ensure, to the greatest extent possible, that the activities of the Deputy Inspector General do not duplicate audits and investigations of Inspectors General and other auditors of Federal departments and agencies, and State and local government entities.</text></paragraph> <paragraph id="HD38B143530974DEFA1D33516C3A00A7"><enum>(4)</enum><header>Coordination with FBI</header><text>The Deputy Inspector General shall ensure that investigative activities under this section are coordinated with the Federal Bureau of Investigation.</text></paragraph></subsection> <subsection id="HD2756AE33393491AB0075CA4D8C48B88"><enum>(e)</enum><header>Financial management matters</header><text>In order to assist the Deputy Inspector General for the purposes of carrying out this section, all agencies receiving or distributing Federal funds to respond to acts of terrorism, natural disasters, or other emergencies shall establish and maintain budgetary procedures to distinguish funds related to response and relief efforts from other agency funds.</text></subsection> <subsection id="H639C9C85F4154F4FA671FE1D1E41789D"><enum>(f)</enum><header>Funding</header><text>There is authorized to be appropriated for operations of the Office of the Deputy Inspector General $11,000,000 for each fiscal year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H51EC63249B4D4CC9A3DAF8355690008"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of such Act is further amended by inserting after the item related to section 812 the following:</text> <quoted-block style="OLC" id="HD061CB7D19A448B897CDAA2B9B6CB394" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 813. Deputy Inspector General for Response and Recovery.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HE13BBFA3BD8F4EE099DE6D65D028678"><enum>(c)</enum><header>Deadline for appointment</header><text display-inline="yes-display-inline">The Inspector General of the Department of Homeland Security shall appoint the Deputy Inspector General under this section not later than 60 days after the date of enactment of this Act.</text></subsection></section> <section id="H03FC9B780E6242370014C96CA3C7CF35"><enum>206.</enum><header>Protection of Department of Homeland Security official seal and insignia</header><text display-inline="no-display-inline"> Section 875 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/455">6 U.S.C. 455</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block id="H0EFF40B84A514A999E9BC03D6DA3C1B0" style="OLC"> <subsection id="H6536DDA812B9419DB66D15D8C686E62E"><enum>(d)</enum><header>Protection of name, initials, insignia, and seal</header> <paragraph id="H18F82FAD4CB1430FB47BCA266893E"><enum>(1)</enum><header>In general</header><text>Except with the written permission of the Secretary, no person may knowingly use, in connection with any advertisement, commercial activity, audiovisual production (including film or television production), impersonation, Internet domain name, Internet e-mail address, or Internet web site, merchandise, retail product, or solicitation in a manner reasonably calculated to convey the impression that the Department or any organizational element of the Department has approved, endorsed, or authorized such use, any of the following (or any colorable imitation thereof):</text> <subparagraph id="HC5292AD5976A4F999BAD55C3F0AEFE82"><enum>(A)</enum><text>The words <quote>Department of Homeland Security</quote>, the initials <quote>DHS</quote>, the insignia or seal of the Department, or the title <quote>Secretary of Homeland Security</quote>.</text></subparagraph> <subparagraph id="H39B40EB2BA7B4CFD00D3A7BFE89118AD"><enum>(B)</enum><text>The name, initials, insignia, or seal of any organizational element (including any former such element) of the Department, or the title of any other officer or employee of the Department, notice of which has been published by the Secretary of Homeland Security in accordance with paragraph (3).</text></subparagraph></paragraph> <paragraph id="H2D0E5A6C58884A6082C4DFEB7B2DB814"><enum>(2)</enum><header>Civil action</header><text>Whenever it appears to the Attorney General that any person is engaged or is about to engage in an act or practice that constitutes or will constitute conduct prohibited by subsection (d)(1), the Attorney General may initiate a civil proceeding in a district court of the United States to enjoin such act or practice. Such court shall proceed as soon as practicable to the hearing and determination of such action and may, at any time before final determination, enter such restraining orders or prohibitions, or take such other actions as is warranted, to prevent injury to the United States or to any person or class of persons for whose protection the action is brought.</text></paragraph> <paragraph id="H73E87FE7C5DE497480221598DAC5BABF"><enum>(3)</enum><header>Notice and publication</header><text>The notice and publication to which paragraph (1)(B) refers is a notice published in the Federal Register including the name, initials, seal or class of titles protected under paragraph (1)(B) and a statement that they are protected under that provision. The Secretary may amend such notices from time to time as the Secretary determines appropriate in the public interest and shall publish such amendments in the Federal Register.</text></paragraph> <paragraph id="H77BE204CE09041BD9ED0CDAE3634992C"><enum>(4)</enum><header>Audiovisual production</header><text>For the purpose of this subsection, the term <quote>audiovisual production</quote> means the production of a work that consists of a series of related images that are intrinsically intended to be shown by the use of machines or devices such as projectors, viewers, or electronic equipment, together with accompanying sounds, if any, regardless of the nature of the material objects, such as films or tapes, in which the work is embodied.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
