		<section commented="no" display-inline="no-display-inline" id="H5BD41728A4BF4DCC8D9FD7F0453D7FD4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Alternative Energy Refueling System
			 Act of 2006</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HF8ED1C16D6BB43909FAB00E83E697680" section-type="subsequent-section"><enum>2.</enum><header>Alternative energy
			 refueling systems</header>
			<subsection commented="no" display-inline="no-display-inline" id="HD0EFDFBBF87C4716824D46E48093844B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 9003(h) of
			 the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6991b">42 U.S.C. 6991b(h)</external-xref>) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA39DC59A8F7348689274CB2089E77270" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="HB05D08CFF3EB48ADAE274F8FF49DD290"><enum>(13)</enum><header>Alternative
				energy refueling systems</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="HAC314B90FE464121AFF692060ECE411"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text>
							<clause commented="no" display-inline="no-display-inline" id="HA6D1F02C5A864618B681AF6435B00AC"><enum>(i)</enum><header>Alternative
				energy refueling system</header><text display-inline="yes-display-inline">The
				term <term>alternative energy refueling system</term> means a system composed
				of 1 or more underground storage tanks, pumps, and pump fittings or other
				related infrastructure that is used to refuel motor vehicles with—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H1165A7684EEE49B69CBB756437F2E8EA"><enum>(I)</enum><text display-inline="yes-display-inline">compressed natural gas;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H9F55EFF32E924AF9A68049205B055F49"><enum>(II)</enum><text display-inline="yes-display-inline">E–85 ethanol;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H1CD2D767A02A4AE29DD70829C1320328"><enum>(III)</enum><text display-inline="yes-display-inline">a fuel described in section 30C(c)(1) of
				the Internal Revenue Code of 1986; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="HBB7DE68FDA7046F1ABB46972C7C222C"><enum>(IV)</enum><text display-inline="yes-display-inline">any other alternative fuel, as determined
				by the Administrator.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HB583BB946C694289B260D20040F98353"><enum>(ii)</enum><header>Eligible
				entity</header><text display-inline="yes-display-inline">The term
				<term>eligible entity</term> means a refueling vendor or other person that is
				an owner or operator of a service station or other facility at which an
				alternative energy refueling system is located or proposed to be
				located.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H21E467DCAF8D427C825F9CF01E5BCB01"><enum>(B)</enum><header>Reimbursement
				program</header>
							<clause commented="no" display-inline="no-display-inline" id="H4A2AF98D8BF94C7D8D93CD00C7006DF0"><enum>(i)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish a program
				to provide to eligible entities, for each of the fiscal years 2007 through
				2011, reimbursement from the Trust Fund of a portion of the costs of purchasing
				and installing 1 or more alternative energy refueling systems, including any
				alternative energy refueling system intended to replace a petroleum refueling
				tank or system.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HDC16A825E6884C6AA925A8EDB9A7973B"><enum>(ii)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity that seeks to receive
				reimbursement described in clause (i) shall submit to the Administrator an
				application by such time, in such form, and containing such information as the
				Administrator shall prescribe.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H927C9E61F231423ABD8F70CC9CDFF1AE"><enum>(iii)</enum><header>Timing of
				reimbursement</header><text display-inline="yes-display-inline">Not later than
				30 days after the date on which the Administrator, in consultation with the
				appropriate State agency, verifies that an alternative energy refueling system
				for which reimbursement is requested by an eligible entity under this paragraph
				has been installed and is operational, the Administrator shall provide the
				reimbursement to the eligible entity.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HC8D3992BF2AB44E5A9B6F77800049203"><enum>(iv)</enum><header>Limitations</header>
								<subclause commented="no" display-inline="no-display-inline" id="HDD6DCFF8501B456C82A7434B5B258FFA"><enum>(I)</enum><header>Prohibition on
				receipt of dual benefits</header><text display-inline="yes-display-inline">An
				eligible entity that receives a tax credit under section 30C of the Internal
				Revenue Code of 1986 for placing in service a qualified alternative fuel
				vehicle refueling property (as defined in that section) may not receive any
				reimbursement under this paragraph for an alternative energy refueling system
				on the property if the cost of the alternative energy refueling system was
				taken into consideration in calculating the tax credit.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H07BAEC63A91C4D8796D935F8717855B1"><enum>(II)</enum><header>Number of
				systems</header><text display-inline="yes-display-inline">An eligible entity
				may not receive reimbursement under this paragraph for more than 2 alternative
				energy refueling systems for each facility owned or operated by the eligible
				entity.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H0E8B58E9C442405BAC44EE5736835374"><enum>(III)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of reimbursement provided for an
				alternative energy refueling system under this paragraph shall not exceed the
				lesser of—</text>
									<item commented="no" display-inline="no-display-inline" id="H8CE065145D874B90A6E2FBEBA718AE1B"><enum>(aa)</enum><text display-inline="yes-display-inline">the amount that is 30 percent of the cost
				of the alternative energy refueling system; or</text>
									</item><item commented="no" display-inline="no-display-inline" id="HD7D1FA26BC274708B642D71FC77928B8"><enum>(bb)</enum><text display-inline="yes-display-inline">$30,000.</text>
									</item></subclause><subclause id="HD29DC8AC641840889FD21CE558C8DA1E"><enum>(IV)</enum><header>Aggregate
				amount from trust fund</header><text>The Administrator shall use to provide
				reimbursements under this paragraph an aggregate amount from the Trust Fund for
				a fiscal year that does not exceed the lesser of—</text>
									<item id="H8AE87F91AA0945AEB9076F2CE2D13692"><enum>(aa)</enum><text display-inline="yes-display-inline">$70,000,000; or</text>
									</item><item id="H7EDDCCC448D24943BE00083432D7BC09"><enum>(bb)</enum><text display-inline="yes-display-inline">the amount of interest generated on amounts
				in the Trust Fund for the fiscal year.</text>
									</item></subclause><subclause id="H705C370A7A9D430682DC5EEB8819CAC2"><enum>(V)</enum><header>Further
				Appropriation</header><text display-inline="yes-display-inline">Reimbursement
				authorized under this paragraph shall be provided by the Administrator without
				further appropriation.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFF16F35AF8314898B6AAE72173100AD"><enum>(C)</enum><header>No effect on
				other trust fund projects, activities, or responsibilities</header>
							<clause commented="no" display-inline="no-display-inline" id="HEFFA1B55BD3746D19124F8AE01A253D4"><enum>(i)</enum><header>Other trust fund
				projects and activities</header><text display-inline="yes-display-inline">In
				carrying out this paragraph, the Administrator shall not use funds from the
				Trust Fund that are obligated for, or otherwise required to carry out, other
				projects and activities under this subsection.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H74F89BD9AD4144A1AFF38EA267004079"><enum>(ii)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">Nothing in this paragraph affects any
				obligation of an owner or operator to comply with other provisions of this
				subtitle.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H1C3975E9F7754131832D510078DD4235"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 9508(c) of
			 the Internal Revenue Code of 1986 is amended by striking <quote>as in effect
			 on</quote> and all that follows through the end of the subsection and inserting
			 <quote>as amended by the Superfund Amendments and Reauthorization Act of 1986
			 and the Alternative Energy Refueling System Act of 2006</quote>.</text>
			</subsection></section></legis-body>
