<section id="HABD09204364A442CA0564C2BDD77B264"><enum>2.</enum><header>Findings and purposes</header> 
<subsection id="H4FDA8C5A97F44DD896D43E7665C7ACA7"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> 
<paragraph id="H8FA1A217EFFB40B99C57B3B71DCA4EAE"><enum>(1)</enum><text>The right of all eligible citizens to vote and have their vote counted is the cornerstone of a democratic form of government and the core precondition of government of the people, by the people, and for the people.</text></paragraph> 
<paragraph id="H41CF5D7B0A1F41D7ADF8E41D1EDA2FD0"><enum>(2)</enum><text>The right of citizens of the United States to vote is a fundamental civil right guaranteed under the United States Constitution.</text></paragraph> 
<paragraph id="H681ED894CD2C46EA95223558EC7300DF"><enum>(3)</enum><text>Congress has an obligation to reaffirm the right of each American to have an equal opportunity to vote and have that vote counted in Federal elections, regardless of color, ethnicity, disability, language, or the resources of the community in which they live.</text></paragraph> 
<paragraph id="H32EB8782CACE4D36B52F698D283CA078"><enum>(4)</enum><text>Congress has an obligation to ensure the uniform and nondiscriminatory exercise of that right by removing barriers in the form of election administration procedures and technology and insufficient and unequal resources of State and local governments.</text></paragraph></subsection> 
<subsection id="HBC5482E221E44A0496E919F7936639CA"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are as follows:</text> 
<paragraph id="HA7E70228CDA94077BEA1119574E5C507"><enum>(1)</enum><text>To secure the opportunity to participate in democracy for all eligible American citizens by establishing a national Federal write-in absentee ballot for Federal elections.</text></paragraph> 
<paragraph id="H9981EFEBDC684393B28D03324023FB49"><enum>(2)</enum><text>To expand and establish uniform and nondiscriminatory requirements and standards to remove administrative procedural barriers and technological obstacles to casting a vote and having that vote counted in Federal elections.</text></paragraph> 
<paragraph id="H3696F88BBA604005B496374DB122244F"><enum>(3)</enum><text>To expand and establish uniform and nondiscriminatory requirements and standards to provide for the accessibility, accuracy, verifiability, privacy, and security of all voting systems and technology used in Federal elections.</text></paragraph> 
<paragraph id="H3A55936B9FE54C82B2D391008037DD6F"><enum>(4)</enum><text>To provide a Federal funding mechanism for the States to implement the requirements and standards to preserve and protect voting rights and the integrity of Federal elections in the United States.</text></paragraph></subsection></section> 
<section id="HF39EF029EA504E2999B609FC581E4FEE" section-type="subsequent-section" display-inline="no-display-inline"><enum>3.</enum><header> Enhanced protections against voter intimidation, threats, coercion, and deception</header> 
<subsection id="HCBE516490369472E83D9BE642DB18E1C"><enum>(a)</enum><header>Prohibiting Unfair and Deceptive Acts and Practices Affecting Voting in Federal Elections</header> 
<paragraph id="H1D53A4B5C362464EBF69A717B93ED448"><enum>(1)</enum><header>Declaration of unlawfulness; power to prohibit unfair practices</header> 
<subparagraph id="H70AC08DE753F4B35A1BEEEA254BE9978"><enum>(A)</enum><header>In general</header><text>It shall be unlawful for any person to engage in unfair or deceptive acts or practices in or affecting voting in Federal elections, and the Attorney General is hereby empowered and directed to prevent persons, partnerships, or corporations from using unfair or deceptive acts or practices in or affecting voting in Federal elections.</text></subparagraph> 
<subparagraph id="H57FCBB7FD02A40B199DD5CAEC1D1849"><enum>(B)</enum><header>Proceeding by attorney general</header><text display-inline="yes-display-inline">Whenever the Attorney General shall have reason to believe that any such person, partnership, or corporation has been or is using any unfair or deceptive act or practice in or affecting voting, he shall issue and serve upon such person, partnership, or corporation a complaint stating its charges in that respect and containing a notice of a hearing upon a day and at a place therein fixed at least 7 days after the service of said complaint. The person, partnership, or corporation so complained of shall have the right to appear at the place and time so fixed and show cause why an order should not be entered by the Attorney General requiring such person, partnership, or corporation to cease and desist from the violation of the law so charged in said complaint. If upon such hearing the Attorney General shall be of the opinion that the method of competition or the act or practice in question is prohibited by this subchapter, it shall make a report in writing in which it shall state its findings as to the facts and shall issue and cause to be served on such person, partnership, or corporation an order requiring such person, partnership, or corporation to cease and desist from using such method of competition or such act or practice.</text></subparagraph> 
<subparagraph id="H16B9F278CDCE4C96A98CC8A0A5003B6E"><enum>(C)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any person, partnership, or corporation who violates an order of the Attorney General under this paragraph after it has become final, and while such order is in effect, shall be fined in accordance with title 18, United States Code. Each separate violation of such an order shall be a separate offense.</text></subparagraph> 
<subparagraph id="HEF1883EEB73B45BB9954EEAD46B5D965"><enum>(D)</enum><header>Civil action by aggrieved person</header><text display-inline="yes-display-inline">A person who is aggrieved by a violation of this section may, in a civil action, obtain declaratory and injunctive relief with respect to the violation. The court in an action under this subsection may award the prevailing party (other than the United States) reasonable attorneys fees, including litigation expenses and expert witness fees, as part of the costs; fees may be awarded to a prevailing defendant only when a plaintiff’s civil action is shown to be frivolous, unreasonable, or without foundation. The Attorney General may intervene as a party in a civil action brought under this subsection.</text></subparagraph></paragraph> 
<paragraph id="HFA3C3BE639E24924BBD7FED0001DEB45"><enum>(2)</enum><header>Documentary evidence; subpoena power</header> 
<subparagraph id="HC45E729F70B142D99481DB700852FB1"><enum>(A)</enum><header>In general</header><text>For the purposes of this subsection the Attorney General shall at all reasonable times have access to, for the purpose of examination, and the right to copy any documentary evidence of any person, partnership, or corporation being investigated or proceeded against; and the Attorney General shall have power to require by subpoena the attendance and testimony of witnesses and the production of all such documentary evidence relating to any matter under investigation.</text></subparagraph> 
<subparagraph id="H715C106A9049404993C9036EFE113E36"><enum>(B)</enum><header>Penalties</header><text display-inline="yes-display-inline">Any person who shall neglect or refuse to attend and testify, or to answer any lawful inquiry or to produce any documentary evidence under this subsection, if in his power to do so, in obedience to an order of a District Court of the United States directing compliance with the subpoena or lawful requirement of the Attorney General shall be guilty of an offense and upon conviction thereof by a court of competent jurisdiction shall be fined in accordance with title 18, United States Code, or imprisoned for not more than one year, or both.</text></subparagraph></paragraph> 
<paragraph id="HD9D55C8643DE4B68BFF2868D865E6191"><enum>(3)</enum><header>Unfair or deceptive acts or practices rulemaking proceedings</header><text display-inline="yes-display-inline">The Attorney General shall—</text> 
<subparagraph id="HA0D0BAAD821E4E6D9DF434E9004F67CC"><enum>(A)</enum><text display-inline="yes-display-inline">review information and receive complaints alleging unfair or deceptive acts or practices in or affecting voting in Federal elections; </text></subparagraph> 
<subparagraph id="H3DBD6A1E5B3340ADADD8DD945103B3DD"><enum>(B)</enum><text>make public through the Internet, radio, television, and newspaper advertisements information on the responsibilities, contact information and complaint procedures of the Attorney General under this section; </text></subparagraph> 
<subparagraph id="HF28F4EA986D84E558B5D2380FCD2FC94"><enum>(C)</enum><text>prescribe interpretive rules and general statements of policy with respect to unfair or deceptive acts or practices in or affecting voting; and</text></subparagraph> 
<subparagraph id="HAD038D11FBF945F3AE38C9B2A492A6C4"><enum>(D)</enum><text>prescribe rules which define with specificity acts or practices which are unfair or deceptive acts or practices in or affecting voting (within the meaning of paragraph (1)), including but not limited to so-called <quote>caging</quote> or selective use of poll and registration challenges. Rules under this subsection shall include requirements prescribed for the purpose of preventing such acts or practices on a proactive basis.</text></subparagraph></paragraph> 
<paragraph id="HFC9C699031824C898255147769C93FED"><enum>(4)</enum><header>Civil actions for violations of rules and cease and desist orders respecting unfair or deceptive acts or practices</header> 
<subparagraph id="HC245A8B2FFCD498D8F4C80007745003F"><enum>(A)</enum><header>Suits against persons, partnerships, or corporations; jurisdiction; relief for dishonest or fraudulent acts</header> 
<clause id="H65DC0BA768554C8FAEE35F0D6B3B2F1"><enum>(i)</enum><text display-inline="yes-display-inline"> If any person, partnership, or corporation violates any rule under this subchapter respecting unfair or deceptive acts or practices (within the meaning of paragraph (1)), then the Attorney General may commence a civil action against such person, partnership, or corporation for relief under this subsection in a United States District Court or in any court of competent jurisdiction of a State.</text></clause> 
<clause id="H3290B94ECF0F46A48DBF09DDB41FE12F"><enum>(ii)</enum><text display-inline="yes-display-inline">If any person, partnership, or corporation engages in any unfair or deceptive act or practice (within the meaning of paragraph (1)) with respect to which the Attorney General has issued a final cease and desist order which is applicable to such person, partnership, or corporation, then the Attorney General may commence a civil action against such person, partnership, or corporation in a United States District Court or in any court of competent jurisdiction of a State.</text></clause></subparagraph> 
<subparagraph id="H49048A4E6ACF491200D56787FF15B6E2"><enum>(B)</enum><header>Nature of relief available</header><text display-inline="yes-display-inline">The court in an action under subparagraph (A) shall have jurisdiction to grant such relief as the court finds necessary to redress injury to voters or other persons, partnerships, and corporations resulting from the rule violation or the unfair or deceptive act or practice, as the case may be. Such relief may include, but shall not be limited to, rescission or reformation of contracts, the refund of money or return of property, the payment of damages, and public notification respecting the rule violation or the unfair or deceptive act or practice, as the case may be, including exemplary or punitive damages.</text></subparagraph></paragraph> 
<paragraph id="HA3867B9F7B2349F6BD74006D6DA17DD9"><enum>(5)</enum><header>Relationship to Other Laws</header> 
<subparagraph id="H5362FB9E57A848379115A664EB5D38E5"><enum>(A)</enum><header>In general</header><text>Nothing in this subsection may be construed to authorize or require conduct prohibited under the following laws, or supersede, restrict, or limit—</text> 
<clause id="HBC17C77DA0A6403C8BB9BC9DB65F1C3"><enum>(i)</enum><text display-inline="yes-display-inline">the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg">42 U.S.C. 1973gg et seq.</external-xref>); or</text></clause> 
<clause id="H61D3A7EF02E040D500FC1C7DF581F216"><enum>(ii)</enum><text>the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973aa">42 U.S.C. 1973aa et seq.</external-xref>). </text></clause></subparagraph> 
<subparagraph id="HAAB9783CBB284D508C8F100614DE4E76"><enum>(B)</enum><header>No effect on preclearance or other requirements under voting rights act</header><text>Any action taken by the Attorney General or a State under this subsection may not be considered to have any effect on requirements for preclearance under section 5 of the Voting Rights Act of 1965 or any other requirements of such Act.</text></subparagraph></paragraph></subsection> 
<subsection id="H7BCA67564086449700FB901FD0A8F3B4"><enum>(b)</enum><header>Revisions to Current Protections</header> 
<paragraph id="H86FAA4E0801344728809AACF14947F95"><enum>(1)</enum><header>Section 2004 of the Revised Statutes</header><text>Section 2004(b) of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1971">42 U.S.C. 1971(b)</external-xref>) is amended—</text> 
<subparagraph id="H5E9F3B5739444D10879B0431C5E9D0D"><enum>(A)</enum><text>by inserting after <quote>coerce,</quote> the following: <quote>knowingly deceive,</quote>; and</text></subparagraph> 
<subparagraph id="H6E0F17CC0B03471180A6DEA72C786C8C"><enum>(B)</enum><text>by striking <quote>or coerce</quote> and inserting <quote>coerce, or knowingly deceive</quote>.</text></subparagraph></paragraph> 
<paragraph id="H30B70E161C204361A3D888611FFB7E96" display-inline="no-display-inline"><enum>(2)</enum><header>Title 18, United States Code</header> 
<subparagraph id="H35FC8ED216F049A382E8A6C960C120D9"><enum>(A)</enum><header>Section 245</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/245">Section 245</external-xref> of title 18, United States Code, is amended by adding at the end the following new subsection:</text> 
<quoted-block style="USC" display-inline="no-display-inline" id="HEAD9D5362DDB4B7FB8E1B9DD24A3ED30"> 
<subsection id="H65C170D81841479C94DB8437CFD8C66D"><enum>(e)</enum><text>Whoever, whether or not acting under color of law, knowingly deceives or attempts to knowingly deceive any person because he is or has been, or in order to intimidate such person or any other person or class of persons from carrying out an activity specified in subparagraph (A) of subsection (b)(1), shall be punished as provided for a violation of subsection (b)(1)(A).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HB03853A9B8EC438CBA90B32C6E636BD9"><enum>(B)</enum><header>Section 241</header><text>Section 241 of such title is amended by striking <quote>or intimidate</quote> and inserting <quote>intimidate, or knowingly deceive</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H5995C4ACA1934D3D9651DD23C78B59B4"><enum>(c)</enum><header>Enhanced System for Tracking, Documenting, and Monitoring Election Irregularities</header> 
<paragraph id="HFDCEE5BDF95B47F8A200052639F1E05"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">The Attorney General shall direct the Assistant Attorney General for the Civil Rights Division and the Chief of the Voting Section to—</text> 
<subparagraph id="HCDEEF152AA174A47A19B5EC2613883B0"><enum>(A)</enum><text display-inline="yes-display-inline">develop and implement procedures to ensure that the Voting Section has a reliable method of tracking and documenting allegations of voting irregularities and actions taken to address them, including establishing precise categories for recording types of allegations and actions taken, development of instructions on completing the telephone logs, and development and implementation of training for contractors; and</text></subparagraph> 
<subparagraph id="H938C2071644D464C86F7F9F1027C32ED"><enum>(B)</enum><text display-inline="yes-display-inline">implement a method to track and report on election monitoring program activities in the Interactive Case Management System.</text></subparagraph></paragraph> 
<paragraph id="H9999EE80E47249879C585460CB2608F3" display-inline="no-display-inline"><enum>(2)</enum><header>Annual Reports</header><text display-inline="yes-display-inline">The Attorney General shall submit annual reports to Congress detailing the implementation of this subsection, including a summary of the tracking and election monitoring activities and a documentation of allegations of voting irregularities.</text></paragraph></subsection></section> 
<section id="H519AC7D756204CFC915957DFA229247B"><enum>4.</enum><header>National Federal write-in absentee ballot</header> 
<subsection id="H99B46E8FD8CC4E0385A2C2D3FC99B22D"><enum>(a)</enum><header>In general</header> 
<paragraph id="HB854F661618446E692E4C824B295A9BF"><enum>(1)</enum><header>In general</header><text>Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>) is amended by adding at the end the following new subtitle:</text>

<subtitle id="HA7A195C2436942CF98C37DBFA5B1E70"><enum>C</enum><header>Additional requirements</header> 
<section id="H1C51E14486BC47B2AA48EC09C3598D26"><enum>321.</enum><header>Use of National Federal write-in absentee ballot</header> 
<subsection id="H3ABFABF62D3C45A5B8B9024B2D600B1"><enum>(a)</enum><header>In general</header><text>Any person who is otherwise qualified to vote in a Federal election in a State shall be permitted to use the national Federal write-in absentee ballot prescribed by the Election Assistance Commission under section 297 to cast a vote in an election for Federal office.</text></subsection> 
<subsection id="HAE01A238A5EE4D2E84FA9002411D7AF"><enum>(b)</enum><header>Submission and processing</header> 
<paragraph id="H720042FA0A4C44EC8BE53DA3F7D55C81"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this section, a national Federal write-in absentee ballot shall be submitted and processed in the manner provided under the standards prescribed by the Commission under section 297(b).</text></paragraph> 
<paragraph id="HC0023481F656451C008F6441991C4BC2"><enum>(2)</enum><header>Deadline</header><text>An otherwise eligible national Federal write-in absentee ballot shall be counted if postmarked or signed before the close of the polls on election day and received by the appropriate State election official on or before the date which is 10 days after the date of the election or the date provided for receipt of absentee ballots under State law, whichever is later.</text></paragraph></subsection> 
<subsection id="H0C62392933BF47B085606EBCF1CF3DE7"><enum>(c)</enum><header>Special rules</header><text>The following rules shall apply with respect to national Federal write-in absentee ballots:</text> 
<paragraph id="HEA0674A2A1C5456D939DB79E114EC360"><enum>(1)</enum><text>In completing the ballot, the voter may designate a candidate by writing in the name of the candidate or by writing in the name of a political party (in which case the ballot shall be counted for the candidate of that political party).</text></paragraph> 
<paragraph id="H2466FEA593F646C690CB34549C103F47"><enum>(2)</enum><text>In the case of the offices of President and Vice President, a vote for a named candidate or a vote by writing in the name of a political party shall be counted as a vote for the electors supporting the candidate involved.</text></paragraph> 
<paragraph id="H68CE0B3D085042D5B85C73DDAAFB837"><enum>(3)</enum><text>Any abbreviation, misspelling, or other minor variation in the form of the name of a candidate or a political party shall be disregarded in determining the validity of the ballot.</text></paragraph></subsection> 
<subsection id="H84D9FAB00286420AAE153D32F548154B"><enum>(d)</enum><header>Effective date</header><text>Each State shall be required to comply with the requirements of this section on and after January 1, 2007.</text></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph id="HFF944FE102314B53A30042C4184B3E2B"><enum>(2)</enum><header>Definitions</header><text>The terms <term>absent uniformed service voter</term> and <term>overseas voter</term> shall have the meanings given such terms by section 107 of the Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-6">42 U.S.C. 1973gg–6</external-xref>).</text></paragraph></subsection></section>

<subparagraph id="HA66B4EFF4CA84356813B6FC382ED4D5"><enum>(B)</enum><text>A means of voter verification meets the requirements of this subparagraph if the voting system allows the voter to choose from one of the following options to verify the voter’s vote selection:</text> 
<clause id="HB6FABADBB1D846979E97FE50F3001EE5"><enum>(i)</enum><text>A paper record.</text></clause> 
<clause id="H668734404A15479698D494D1817E2093"><enum>(ii)</enum><text>An audio record.</text></clause> 
<clause id="H269FB720447F4A800013FD9C2D914F3D"><enum>(iii)</enum><text>A pictorial record.</text></clause> 
<clause id="H8E9B372EB49A4983B70298404CDBCED6"><enum>(iv)</enum><text>An electronic record or other means that provides for voter verification that is accessible for individuals with disabilities, including nonvisual accessibility for the blind and visually impaired, in a manner that provides privacy and independence equal to that provided for other voters.</text></clause></subparagraph> 
<subparagraph id="HB08EFAC732AA4A2092FEB8B8F2746EF7"><enum>(C)</enum><text>Any means of verification described in clause (ii), (iii), or (iv) of subparagraph (B) must provide verification which is equal or superior to verification through the use of a paper record.</text></subparagraph> 
<subparagraph id="H284A4B2CFDCD4181B649EFB52F40F415"><enum>(D)</enum><text>None of the means of verification under this paragraph may employ cryptography in the record.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<subsection id="H0B63EFEC964E44BAAA2F3E8988FD002C"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">The standards described in subsection (a) shall provide for a uniform and nondiscriminatory geographic distribution of such systems and workers, based on a ratio of the number of systems and workers per voter, taking into account voter registration statistics for the precinct, the most recent available census data regarding the number of individuals residing within the precinct who are eligible to register to vote, and the level of voter turnout during previous elections held in the precinct.</text></subsection> 
<subsection id="HA842A7393E2C45D0B415DC5109923B13"><enum>(c)</enum><header>Deviation</header><text>The standards described in subsection (a) shall permit States, upon providing adequate public notice, to deviate from any allocation requirements in the case of unforeseen circumstances such as a natural disaster, terrorist attack, or a change in voter turnout.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph id="HE1E187D29589495BA6E924EE00E89F00"><enum>(1)</enum><header>Registration</header><text>Notwithstanding section 8(a)(1)(D) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-6">42 U.S.C. 1973gg–6</external-xref>), each State shall permit any individual on the day of a Federal election—</text> 
<subparagraph id="H4631CC55945D4683AC405E875BAD0080"><enum>(A)</enum><text>to register to vote in such election at the polling place using the form established by the Election Assistance Commission pursuant to section 297; and</text></subparagraph> 
<subparagraph id="HBF76FB36183D488395F1FBFFF51DE1B3"><enum>(B)</enum><text>to cast a vote in such election.</text></subparagraph></paragraph> 
<paragraph id="H69E285B38BF14D15AEF7F86029B24FE"><enum>(2)</enum><header>Exception</header><text>The requirements under paragraph (1) shall not apply to a State in which, under a State law in effect continuously on and after the date of the enactment of this Act, there is no voter registration requirement for individuals in the State with respect to elections for Federal office.</text></paragraph></subsection>

<subsection id="HE37E79D413194E8585AA3EC776B65DA"><enum>(b)</enum><header>Minimum early voting requirements</header><text>Each polling place which allows voting prior to the day of a Federal election pursuant to subsection (a) shall—</text> 
<paragraph id="HAD013EAE21CC4AC58B7C725E578939B0"><enum>(1)</enum><text>allow such voting for no less than 4 hours on each day (other than Sunday); and</text></paragraph> 
<paragraph id="H95F77EA3B2184904B541139D3CECD530"><enum>(2)</enum><text>have uniform hours each day for which such voting occurs.</text></paragraph></subsection> 
<subsection id="H89501A0B9FD94523B05216AB4B8FAE43"><enum>(c)</enum><header>Application of Election Day Registration to Early Voting</header><text>A State shall permit individuals to register to vote at each polling place which allows voting prior to the day of a Federal election pursuant to subsection (a) in the same manner as the State is required to permit individuals to register to vote and vote on the day of the election under section 323.</text></subsection>

Such standards shall include the nondiscriminatory geographic placement of polling places at which such voting occurs.</text></subsection> 
<subsection id="HBE2316D0F64D480DABD1841844715B25"><enum>(b)</enum><header>Deviation</header><text>The standards described in subsection (a) shall permit States, upon providing adequate public notice, to deviate from any requirement in the case of unforeseen circumstances such as a natural disaster, terrorist attack, or a change in voter turnout.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph id="HE9C0969B4C754E93828C350071EC6927"><enum>(2)</enum><header>Authorization of appropriations</header><text>Of the amount authorized to be appropriated under section 210 for fiscal year 2006, $100,000 shall be authorized solely to carry out the purposes of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H09D3075521634A3587D4E58FC3D91B71"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall take effect on the date of the enactment of this Act.</text></subsection></section>

<subsection id="HC7E381A7180843E6914F8FFE75C2417"><enum>(a)</enum><header>In general</header><text>Subparagraph (B) of section 301(a)(1) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481(a)(1)(B)</external-xref>) is amended by striking <quote>, a punch card voting system, or a central count voting system</quote>.</text></subsection>

<clause id="H67C1B27B86B24C589446C111029F29CE"><enum>(ii)</enum><text>subparagraph (B) shall not apply.</text></clause></subparagraph> 
<subparagraph id="HD40DDCED24B349F0AB5254D120C01D66"><enum>(D)</enum><header>Application to forms developed by States</header><text>For purposes of section 6(a)(2) of the National Voter Registration Act of 1993 (42 U.S.C. 1973gg—4(a)(2)), any form developed and used by a State for the registration of voters in elections for Federal office shall not be considered to meet all of the criteria stated in section 9(b) of such Act unless the form meets the requirements of subparagraph (C).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H86DBDCDBA8F349B19000B01701F89465"><enum>(b)</enum><header>Observers</header> 
<paragraph id="H77CFA35EAC7946679EC382E78D5DE8EA"><enum>(1)</enum><header>In general</header><text>Each State shall allow uniform and nondiscriminatory access to any polling place for purposes of observing a Federal election to—</text> 
<subparagraph id="H823C0CC720FA410EAA6FBDAB11F77F9C"><enum>(A)</enum><text>voting rights and civil rights organizations; and</text></subparagraph> 
<subparagraph id="HF2A0FCA4CFDC40EEA229FF24CB989C9"><enum>(B)</enum><text>nonpartisan domestic observers and international observers.</text></subparagraph></paragraph> 
<paragraph id="HDB21A452D32E4FC1A9A4AA2669F47F52"><enum>(2)</enum><header>Notice of denial of observation request</header><text>Each State shall issue a public notice with respect to any denial of a request by any observer described in paragraph (1) for access to any polling place for purposes of observing a Federal election. Such notice shall be issued not later than 24 hours after such denial.</text></paragraph> 
<paragraph id="HA8334F484C9849ACB4192747CDC0E349"><enum>(3)</enum><header>No interference with election permitted</header><text>Nothing in this subsection may be construed to permit any individual observing a Federal election pursuant to this subsection to engage in campaign activity at a polling place or interfere in any way with the conduct of the election.</text></paragraph></subsection>

<subsection id="HBB8AFA85B2DA42C5A63EE2DDCEE009B"><enum>(b)</enum><header>Requirements For Certification Under Program</header><text>An individual may not be certified as having completed the training program established under this section unless the individual meets the following requirements:</text> 
<paragraph id="H2D5A4D78DC4149F59925775CBD633F7C"><enum>(1)</enum><text>The individual has completed not fewer than 8 hours of training not later than 2 months prior to the date of the election for which the individual will serve as an election official.</text></paragraph> 
<paragraph id="H70D73788E09A4B4D8098D323CB2E22"><enum>(2)</enum><text>If the polling place at which the individual will serve as an election official uses an electronic or electromechanical voting system, the individual has been trained to check the system’s calibration, power status, and other mechanical features affecting the ability of the system to function properly.</text></paragraph>

<section id="H16D9EF289914450A8CA9A1DFD2DF069E"><enum>18.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Subsection (a) of section 257 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15408">42 U.S.C. 15408(a)</external-xref>) is amended by adding at the end the following new paragraphs:</text>
