<subsection id="H12F0DBFD786C43CDB3753D71A2A83F1"><enum>(a)</enum><header>In general</header><text>Title II of the Social Security Act is amended—</text> 
<paragraph id="H65866EEC2F554D47874CF05C0095CD9D"><enum>(1)</enum><text>by inserting before section 201 the following:</text>

<part id="H2DEFFDC33E0842288E945D21F8FC2857"><enum>A</enum><header>Insurance benefits</header></part><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H17B03C532624461AB7A0DD136E717BD4"><enum>(2)</enum><text>by adding at the end the following new part:</text>

<part id="H3EF536D189E94417B0848095B1EA655E"><enum>B</enum><header>Individual Social Security Investment Program</header> 
<section id="H7AB6C37C24134998A0C4C00C0E2AEA7"><enum>251.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this part—</text> 
<paragraph id="H81E1CC47D7F44B788DD00026B490D49B"><enum>(1)</enum><header>Participant</header><text>The term <term>participant</term> means—</text> 
<subparagraph id="H3AA820169E374D72BBF0004EADA386BA" commented="no"><enum>(A)</enum><text>any individual who is born on or after January 1, 1984, and—</text> 
<clause id="HDC03BC95248A400C00F33131CD91C57" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text>receives wages in any calendar year after December 31, 2005, on which there is imposed a tax under <external-xref legal-doc="usc" parsable-cite="usc/26/3101">section 3101(a)</external-xref> of the Internal Revenue Code of 1986, or</text></clause> 
<clause id="H52430C5DD2C34DA88BF62F4365C004D" commented="no"><enum>(ii)</enum><text>derives self-employment income for a taxable year beginning after December 31, 2005, on which there is imposed a tax under <external-xref legal-doc="usc" parsable-cite="usc/26/1401">section 1401(a)</external-xref> of the Internal Revenue Code of 1986, and</text></clause></subparagraph> 
<subparagraph id="HACF5CAE656EF4CCAB4FF472319E5DDE5"><enum>(B)</enum><text>any individual who is born on or after January 1, 1951, and before January 1, 1984, and who, pursuant to an election filed in accordance with section 259, is treated under such section as a participant under this part.</text></subparagraph></paragraph> 
<paragraph id="HC7DFA8004DA64F2B87C8E9E0AC573EA1"><enum>(2)</enum><header>Board</header><text>The term <term>Board</term> means the Individual Investment Board established under section 261.</text></paragraph> 
<paragraph id="H11E57E56C19547EAADFCF6A3DFED03EC"><enum>(3)</enum><header>Executive Director</header><text>The term <term>Executive Director</term> means the Executive Director appointed under section 262.</text></paragraph> 
<paragraph id="HD42B43E68C7B4940A75952943DDC96AB"><enum>(4)</enum><header>Part B totalization account</header><text>The term <term>part B totalization account</term> means an account established for a participant under section 252(d).</text></paragraph> 
<paragraph id="HDBEA7098DD59435088C0C493754284A8"><enum>(5)</enum><header>Tier I Investment Fund</header><text>The term <term>Tier I Investment Fund</term> means the trust fund created under section 253.</text></paragraph> 
<paragraph id="HA4D7221C74624E40B18DD3DEE2DB98F"><enum>(6)</enum><header>Tier II Investment Fund</header><text>The term <term>Tier II Investment Fund</term> means the trust fund created under section 254.</text></paragraph> 
<paragraph id="HD0F85B6B6C67429000CA4D26DE2EED38"><enum>(7)</enum><header>Tier III investment account</header><text>The term <term>Tier III investment account</term> means a trust established pursuant to section 255.</text></paragraph></section> 
<section id="H672A4B50F92F44B799567400EB6FF67B" display-inline="no-display-inline" section-type="subsequent-section"><enum>252.</enum><header>Individual investment of social security contributions; part B totalization accounts</header> 
<subsection id="H5F4D74C8AB6A4D1BAB4DC92739EED66D"><enum>(a)</enum><header>Payments into Tier I Investment Fund</header> 
<paragraph id="H3DA65FD59BCA4F338883E01B0617F530"><enum>(1)</enum><header>In general</header><text>During each calendar year, the Secretary of the Treasury shall deposit into the Tier I Investment Fund (established under section 253), from amounts held in the Federal Old-Age and Survivors Insurance Trust Fund, a total amount equal, in the aggregate, to 100 percent of the redirected social security contribution for such calendar year of each individual who is a participant for such calendar year.</text></paragraph> 
<paragraph id="H7BD47346F4B8401692E585409B77D442" display-inline="no-display-inline"><enum>(2)</enum><header>Redirected social security contributions</header><text>For purposes of paragraph (1) the term <term>redirected social security contributions</term> of a participant for a calendar year means the product derived by multiplying—</text> 
<subparagraph id="H2BD1DCD7D1F94AEBAD00345CD3760950"><enum>(A)</enum><text>the sum of the total wages paid to, and self-employment income derived by, the participant during such calendar year (taking into account limits imposed by the contribution and benefit base under section 230), by</text></subparagraph> 
<subparagraph id="H3890330AE5A8477DB6027E2E8692E253"><enum>(B)</enum><text>6.2 percent.</text></subparagraph></paragraph> 
<paragraph id="H856647993DE447F98C1D8F25234283CA"><enum>(3)</enum><header>Transfers based on estimates</header><text>The amounts deposited pursuant to paragraph (1) shall be transferred in at least monthly payments from the Federal Old-Age and Survivors Insurance Trust Fund to the Tier I Investment Fund, such amounts to be determined on the basis of estimates, by the Commissioner of Social Security and certified to the Secretary of the Treasury under part A, of the wages paid to, and self-employment income derived by, participants, and proper adjustments shall be made in amounts subsequently transferred to the extent prior estimates were in excess of or were less than actual amounts.</text></paragraph> 
<paragraph id="H642D44ADBE014A0DA7D5F4DFAF008F31"><enum>(4)</enum><header>Separate accounting and crediting</header><text></text> 
<subparagraph id="HCB3EE7E1B1624DCBBFBCCDBEFA3927AD"><enum>(A)</enum><header>In general</header><text>Subject to this paragraph, the Board shall provide, after the close of each calendar year, for prompt accounting of the amounts deposited in the Tier I Investment Fund with respect to each participant during such calendar year to such individual’s part B totalization account (established under subsection (d)), together with properly allocated increases and decreases in such amounts reflecting the net returns from investment of the balance of the Fund during such year under section 253. For purposes of determining such increases and decreases in such amounts for each calendar year, the amounts deposited into the Fund in connection with any participant during such calendar year shall be deemed to have been deposited on June 30 of such year.</text></subparagraph> 
<subparagraph id="HFA77FDD5A85B4968A81D12EC1CA5007D" display-inline="no-display-inline"><enum>(B)</enum><header>Crediting</header><text>Under such accounting, amounts deposited into the Fund during each calendar year with respect to the redirected social security taxes of each participant (including net returns and losses from the investment Fund attributed to such amounts under this paragraph) shall be credited to such participant’s part B totalization account not later than the end of the succeeding calendar year.</text></subparagraph></paragraph> 
<paragraph id="H5E490888D43F435CB1A4D0BBC27476F0"><enum>(5)</enum><header>Treatment of married individuals</header> 
<subparagraph id="HEB95096474E44ED4A3634B914361F2CA"><enum>(A)</enum><header>In general</header><text>If, as of the end of a calendar year in which the amounts to be credited were deposited into the Fund, the participant is married and his or her spouse is a participant—</text> 
<clause id="H2CD1FC4698BA43279EB38FAD1DBBB71F"><enum>(i)</enum><text>the amounts credited to the part B totalization account of the participant shall be limited to 50 percent of the amount of the redirected social security contributions of the participant for such year, and</text></clause> 
<clause id="H2B5D3C02B7D84711AE9C8FC795431821"><enum>(ii)</enum><text>the part B totalization account of such spouse shall be credited with 50 percent of the amount of such redirected social security contributions.</text></clause></subparagraph> 
<subparagraph id="H1C75CCE2526C45A3B9685600C6E661E3"><enum>(B)</enum><header>Reporting requirements</header><text>The Board may prescribe such reporting requirements applicable to participants regarding marital status as the Board considers necessary to carry out the provisions of subparagraph (A).</text></subparagraph></paragraph></subsection> 
<subsection id="H72541C7BDBFA4467A556B142342477E6" display-inline="no-display-inline"><enum>(b)</enum><header>Transfers into Tier II Investment Fund</header> 
<paragraph id="H743A44B5501049309E7DF175ECE9AE08"><enum>(1)</enum><header>In general</header><text>Upon the crediting to a participant’s part B totalization account of any amount held in the Tier I Investment Fund for any calendar year, the Board shall (except as provided in section 260(a)(2)) transfer the amount so credited to such account from the Tier I Investment Fund into the Tier II Investment Fund (established under section 254).</text></paragraph> 
<paragraph id="H0242EDB9F0AB42B3816663744932C91F"><enum>(2)</enum><header>Separate accounting and crediting</header><text>Subject to this paragraph, the Board shall provide for ongoing separate accounting in the participant’s part B totalization account of the amounts deposited in the Tier II Investment Fund with respect to such participant during each calendar year, together with any increases or decreases therein for such year so as to reflect the net returns and losses from investment thereof under section 254 while held in the Tier II Investment Fund during such year.</text></paragraph></subsection> 
<subsection id="H22613E4FE9CE4233B06D58A0DD3B114B" display-inline="no-display-inline"><enum>(c)</enum><header>Deposits to Tier III investment accounts</header><text></text> 
<paragraph id="H440A3520783D4CD8A956382C6D13051B"><enum>(1)</enum><header>In general</header><text>In any case in which, as of the end of any calendar year, the total balance in the Tier II Investment Fund credited to the participant’s part B totalization account exceeds for the first time the minimum deposit balance, the Board shall, by regulation, provide for an opportunity for the participant to make, at any time thereafter, the participant’s first election of a Tier III investment account for investment of an amount credited to the participant’s part B totalization account. Such election may be in lieu of or in addition to investment in any option available with respect to the Tier II Investment Fund.</text></paragraph> 
<paragraph id="HCA94D6877FD04F4C96047B7BFE6B001D"><enum>(2)</enum><header>Minimum deposit balance</header> 
<subparagraph id="HD19B6DE8E6C1471A003FDA7FA4D6FF36"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term `minimum deposit balance' means an amount equal to $10,000.</text></subparagraph> 
<subparagraph id="H4AB23238958B44B38CFC4F91A0A724C1"><enum>(B)</enum><header>Adjustments</header><text>The Board shall adjust annually (effective for years after December 2006) the dollar amount set forth in subparagraph (A) under procedures providing for adjustments in the same manner and to the same extent as adjustments are provided for under the procedures used to adjust benefit amounts under section 215(i)(2)(A), except that any amount so adjusted that is not a multiple of $1.00 shall be rounded to the nearest multiple of $1.00.</text></subparagraph></paragraph> 
<paragraph id="H8CDAC2610B524E39B85FD18EFC4350B4"><enum>(3)</enum><header>Subsequent investment</header><text>At any time after a participant’s first election of a Tier III investment account pursuant to paragraph (1), the participant may invest any portion of the balance credited to the participant’s part B totalization account in a Tier III investment account, the Tier II Investment Fund, or any combination thereof, as elected by the participant from time to time in accordance with regulations of the Board under this part.</text></paragraph></subsection> 
<subsection id="H4F2B64D4FE6D444085D26DFBF99326AC" display-inline="no-display-inline"><enum>(d)</enum><header>Accounting for total invested amounts by means of part B totalization accounts</header> 
<paragraph id="HBB670233DFB245A1002C24005C98DD09"><enum>(1)</enum><header>Establishment of accounts</header><text display-inline="yes-display-inline">As soon as practicable after the later of January 1, 2006, or the date on which an individual becomes a participant under this part, the Executive Director shall establish and maintain a part B totalization account for the participant. Such account shall be the means by which amounts held in the Tier I Investment Fund, the Tier II Investment Fund, and any Tier III investment account of such participant are credited to such participant under this part, under procedures which shall be established by the Board by regulation. The part B totalization account of a participant shall be identified to such participant by means of the participant’s social security account number.</text></paragraph> 
<paragraph id="H017700765A394EACB69F983D10B999D7"><enum>(2)</enum><header>Account balance</header><text display-inline="yes-display-inline">The balance in a participant’s part B totalization account at any time is the sum of—</text> 
<subparagraph id="HC37282C9B2AA4DB6A339BF93F400F925"><enum>(A)</enum><text>any balance in the Tier I Investment Fund credited to such participant’s part B totalization account prior to transfer to the Tier II Investment Fund under section 252(b)(1); plus</text></subparagraph> 
<subparagraph id="H9BAB4DB48E084082B48E2E7992909C9F"><enum>(B)</enum><text>the excess of—</text> 
<clause id="H1F9042F53EC34925BA7BC44866AECC14"><enum>(i)</enum><text display-inline="yes-display-inline">all deposits in the Tier II Investment Fund credited to such participant’s part B totalization account under subsection (a) (including the proceeds of any sale by such participant, as provided in section 257(e), of any recognition bond issued in the name of the participant under section 257(b)), subject to such increases and reductions as may result from allocations made to and reductions made in the account pursuant to paragraph (3)(A) with respect to amounts in the Tier II Investment Fund; over</text></clause> 
<clause id="H10F4402850994AECB2886005211E8366"><enum>(ii)</enum><text display-inline="yes-display-inline">amounts credited to such participant’s part B totalization account under subsection (a) paid out of the Tier II Investment Fund under this part; plus</text></clause></subparagraph> 
<subparagraph id="HF13052AAAD884A20A81D3897151C678E"><enum>(C)</enum><text>the excess of—</text> 
<clause id="HB6CE1525019147A5ABD9B17563BE81D4"><enum>(i)</enum><text display-inline="yes-display-inline">the deposits to any Tier III investment account of such participant, subject to such increases and reductions as may result from allocations made to and reductions made in the Tier III investment account pursuant to paragraph (3)(B); over</text></clause> 
<clause id="H9E2A5B2B798240F1B85EDA2ECD485279"><enum>(ii)</enum><text display-inline="yes-display-inline">amounts paid out of such participant’s Tier III investment account under this part. </text></clause></subparagraph></paragraph> 
<paragraph id="H94141CB5D03E431BAC2CE2E71F435DD2"><enum>(3)</enum><header>Allocation of earnings and losses</header><text display-inline="yes-display-inline">Pursuant to regulations which shall be prescribed by the Board, the Executive Director shall allocate to the part B totalization account of each participant—</text> 
<subparagraph id="HBD26A5AEB555491B83C400F64D050321"><enum>(A)</enum><text>the net earnings and net losses from each investment of sums in the Tier II Investment Fund which are attributable to sums credited to such participant’s part B totalization account, and reductions equal to an appropriate share of the administrative expenses of the Tier II Investment Fund, as determined by the Executive Director; and</text></subparagraph> 
<subparagraph id="H4EE98E9FC9FF4330BFF730A2DED745D8"><enum>(B)</enum><text display-inline="yes-display-inline">the net earnings and net losses from each investment of sums in any Tier III investment account of such participant, and reductions equal to the administrative expenses in connection with the Tier III investment account.</text></subparagraph></paragraph></subsection> 
<subsection id="H688C1C79F8A64C248864B5506DC53E35"><enum>(e)</enum><header>Treatment of transfers</header><text display-inline="yes-display-inline">Transfers from the Federal Old-Age and Survivors Insurance Trust Fund to the Tier I Investment Fund and transfers among the Tier I Investment Fund, Tier II Investment Fund, and Tier III investment accounts under this part shall not be included in the totals of the budget of the United States Government as submitted by the President or of the congressional budget and shall be exempt from any general budget limitation imposed by statute on budget outlays of the United States Government.</text></subsection></section> 
<section id="H9DA5E2E90E954CCD9C3B19AA00E5C85B"><enum>253.</enum><header>Tier I Investment Fund</header> 
<subsection id="H9BCFEED16EA04174BC35B23C138D1F89"><enum>(a)</enum><header>Establishment of Tier I Investment Fund</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>Tier I Investment Fund</quote>. The Board shall serve as trustees of such Fund. The Fund consists of all amounts derived from payments into the Fund under section 252(a) and remaining after investment of such amounts under subsection (b) of this section, including additional amounts derived as income from such investments. The amounts held in the Fund are appropriated and shall remain available without fiscal year limitation—</text> 
<paragraph id="H70C75699356E4827B5ABDA00ADDC9CE"><enum>(1)</enum><text>to be held for investment on behalf of participants under subsection (b),</text></paragraph> 
<paragraph id="H16B3E32746C14AFBB500691B932B52E3"><enum>(2)</enum><text>to pay the administrative expenses related to the Fund and to investment under subsection (b),</text></paragraph> 
<paragraph id="HE6F1779600F94A78A9649744B0FE0300"><enum>(3)</enum><text>to make transfers to the Tier II Investment Fund under section 252(b) or to Tier III investment accounts under section 252(c),</text></paragraph> 
<paragraph id="H63AA26F01D944E2CB2D24416B1C463C5"><enum>(4)</enum><text>to make payments under section 260(a)(2), and</text></paragraph> 
<paragraph id="H3EBB791639AF4D35A4D4A7497F60963E"><enum>(5)</enum><text>to make lump sum distributions under subsections (d) and (e).</text></paragraph></subsection> 
<subsection id="H7CB4E016478D45F2837219EBEEA90057"><enum>(b)</enum><header>Investment of Fund balance</header><text display-inline="yes-display-inline">For purposes of investment of the Tier I Investment Fund, the Board shall contract with appropriate professional asset managers selected for investment of amounts held in the Fund, so as to provide for investment of the balance of the Fund, in a manner providing broad diversification in accordance with regulations of the Board, in certificates of deposit or other instruments or obligations selected by such asset managers, which return the amount invested and pay interest, at a specified rate or rates, on that amount during a specified period of time.</text></subsection> 
<subsection id="HA52D48E965CC4A62B2A4147183C2FFFE"><enum>(c)</enum><header>Treatment of amounts held in Tier I Investment Fund</header><text></text> 
<paragraph id="H1C4A5E96D6A84D4A8BC183C682650A6"><enum>(1)</enum><header>In general</header><text>Subject to this part—</text> 
<subparagraph id="H534B95597E9E45458DCA9EFEF3899FB0"><enum>(A)</enum><text>until amounts deposited into the Tier I Investment Fund during any calendar year are credited to part B totalization accounts, such amounts shall be treated as the unallocated property of all participants with respect to whom amounts were deposited in the Fund during such year, jointly held in trust for such participants in the Fund, and</text></subparagraph> 
<subparagraph id="H70CFBA5451334546AEEDE4B9E54E3CE"><enum>(B)</enum><text>amounts deposited into the Fund which are credited to a participant’s part B totalization account shall be treated as property of such participant, held in trust for such participant in the Fund.</text></subparagraph></paragraph> 
<paragraph id="HC1EB8D0E3DFA4A0DAC12CF584790A603" display-inline="no-display-inline"><enum>(2)</enum><header>Limitations on use of funds</header><text></text> 
<subparagraph id="H422D42AA4E794761A7D711FB73AC38C"><enum>(A)</enum><header>In general</header><text>Sums in the Tier I Investment Fund credited to a participant’s part B totalization account may not be used for, or diverted to, purposes other than for the exclusive benefit of the participant or the participant’s beneficiaries under this part.</text></subparagraph> 
<subparagraph id="H29FFDCDC71F64DCF9EC23B0061002DC"><enum>(B)</enum><header>Assignments and alienation</header><text>Sums in the Fund may not be assigned or alienated and are not subject to execution, levy, attachment, garnishment, or other legal process.</text></subparagraph></paragraph></subsection> 
<subsection id="H140194E0D629459AA28BEB2968B89E53"><enum>(d)</enum><header>Retirement distribution</header><text>As soon as practicable after the commencement of the distribution under section 256 of assets credited to a participant’s part B totalization account, the amount of any assets in the Tier I Investment Fund credited to such account shall be distributed to such participant in a lump sum, under rules established by the Board. </text></subsection> 
<subsection id="H5113A36AAC2F46E286CCACF5A1E4B068"><enum>(e)</enum><header>Lump sum payment to estate upon death of participant</header><text>Upon the death of a participant, the amount of any assets in the Tier I Investment Fund credited to such participant’s part B totalization account shall be transferred in a lump sum, under rules established by the Board—</text> 
<paragraph id="H257A5A2013974716A81DE5CE00FD00D"><enum>(1)</enum><text display-inline="yes-display-inline">in any case in which one or more beneficiaries have been designated in advance, in accordance with regulations which shall be prescribed by the Board, to such beneficiaries in accordance with such designation as provided in such regulations, and</text></paragraph> 
<paragraph id="H0CC3E2642CCE4AC881C4F483C939B98"><enum>(2)</enum><text>in the case of any amount not distributed as described in paragraph (1), to such participant’s estate.</text></paragraph></subsection></section> 
<section id="HBFC39F9D134647A3B7B240B95F51E8B"><enum>254.</enum><header>Tier II Investment Fund</header> 
<subsection id="H068CB4EC762048C2A70810E17005A981"><enum>(a)</enum><header>Establishment of Tier II Investment Fund</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>Tier II Investment Fund</quote>. The Board shall serve as trustees of such Fund. The Fund consists of all amounts derived from payments into the Fund under section 252(b)(1) and remaining after investment of such amounts under subsection (b) of this section, including additional amounts derived as income from such investments. The amounts held in the Fund are appropriated and shall remain available without fiscal year limitation—</text> 
<paragraph id="HDF10A69E747549C2A8CA37376B26E0F9"><enum>(1)</enum><text>to be held for investment under subsection (b),</text></paragraph> 
<paragraph id="HEAB8352DE51E45B6AE507F45109DBAD4"><enum>(2)</enum><text>to pay the administrative expenses related to the Fund and to investment under subsection (b),</text></paragraph> 
<paragraph id="H4128DDAD0B654CD4B4BE02CAAF99EF53"><enum>(3)</enum><text>to make transfers to Tier III investment accounts under section 252(c)(1),</text></paragraph> 
<paragraph id="H2BFD07C851B94A22A648A854A270D04F"><enum>(4)</enum><text>to make retirement distributions in accordance with section 256, and</text></paragraph> 
<paragraph id="HE4B6285D9D304A6CB8FBAC78B9F72CD0"><enum>(5)</enum><text>to make lump sum distributions under section 256 and subsection (e) of this section.</text></paragraph></subsection> 
<subsection id="HD14F4131670E41D9A31696D5F5B710A2"><enum>(b)</enum><header>Investment in equities and fixed income instruments in management accounts</header><text></text> 
<paragraph id="HDBFD4749AD4D4392BEFFF9665542ABCA"><enum>(1)</enum><header>In general</header><text>For purposes of investment of the Tier II Investment Fund, the Board shall divide the Fund into multiple management accounts. Such accounts shall consist of the 60/40 management account and 2 or more additional management accounts providing for investment in each account in a combination of equities and fixed income instruments in accordance with prescribed percentages, as provided in paragraph (2). The Board shall contract with appropriate investment managers selected for investment of amounts held in each management account.</text></paragraph> 
<paragraph id="H0EEDF5E49E4D495F004E170600BCC55F"><enum>(2)</enum><header>Rules relating to management accounts</header> 
<subparagraph id="H73A38B4A2B1D41FCA0BAFD09AD68E0A7"><enum>(A)</enum><header>In general</header><text>The investment manager selected for investment of amounts held in each management account referred to in paragraph (1) shall invest such amounts under regulations which shall be prescribed by the Board so as to ensure, to the maximum extent practicable, that, of the total balance in the Fund credited to such account and available for investment (after allowing for administrative expenses)—</text> 
<clause id="HDD32C13CDEED4739ACFC69FCF34F77A0"><enum>(i)</enum><text>the prescribed equities percentage is invested in equities in accordance with paragraph (4), and</text></clause> 
<clause id="HA8F81914C62C49A3ACF1FFAC198CEB86"><enum>(ii)</enum><text>the prescribed fixed income instrument percentage is invested in fixed income instruments in accordance with paragraph (5).</text></clause></subparagraph> 
<subparagraph id="HB02BB5522C174BBAB07C3BF58BAC519"><enum>(B)</enum><header>Prescribed percentages</header><text>For purposes of subparagraph (A)—</text> 
<clause id="H636B458203C748659207339575A3189F"><enum>(i)</enum><header>The 60/40 management account</header><text>In the case of the 60/40 management account—</text> 
<subclause id="H89C62457A0154007BB933241A0DC0000"><enum>(I)</enum><text>the prescribed equities percentage is 60 percent, and</text></subclause> 
<subclause id="HCE601E7951484588BB73C736F788DE53"><enum>(II)</enum><text>the prescribed fixed income instrument percentage is 40 percent.</text></subclause></clause> 
<clause id="H2E808AA3D2A64394BFD182BB088B6907" display-inline="no-display-inline"><enum>(ii)</enum><header>Other management accounts</header><text>In the case of any other management account—</text> 
<subclause id="H132A5C26A5DC4E818BC1C317579424A7"><enum>(I)</enum><text>the prescribed equities percentage is a prescribed percentage not in excess of 80 percent, and</text></subclause> 
<subclause id="HCD440FAAAA5941849E98D5E553787400"><enum>(II)</enum><text>the prescribed fixed income instrument percentage is the remaining percentage of the amount invested in the management account.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H647E65C1260644A08E149D8B1F9C64DC"><enum>(3)</enum><header>Election of management accounts</header> 
<subparagraph id="HBEF3FA5CAD764F7E9BF93F144D13E3E8"><enum>(A)</enum><header>Default management account</header><text>Except as provided in an election in effect under subparagraph (B), amounts held in the Tier II Investment Fund shall be credited to the 60/40 management account. </text></subparagraph> 
<subparagraph id="H944B54473BB34079BA9BF3FE01D1992D"><enum>(B)</enum><header>Election of transfers between management accounts</header><text>Pursuant to the written election, filed in accordance with regulations of the Board and received by the Secretary of the Treasury during an applicable election month by a participant who has an amount credited to such participant’s part B totalization account invested in any of the management accounts in the Tier II Investment Fund, the Secretary of the Treasury shall transfer such amount from such account to any of the other management accounts in the Tier II Investment Fund (whichever is designated in such election).</text></subparagraph> 
<subparagraph id="HA71B64C4F0BD42D3B1FFE7B790673200"><enum>(C)</enum><header>Applicable election month</header><text>For purposes of subparagraph (B), the term <term>applicable election month</term>, in connection with a participant, means—</text> 
<clause id="HEBFC4BFE901A471795C699F69007DFA6"><enum>(i)</enum><text>the calendar month in which occurs the anniversary of such participant’s birth, and</text></clause> 
<clause id="H9EFE3BF6EA804641895E9ECB7824EC75"><enum>(ii)</enum><text> the 6th calendar month following such month.</text></clause></subparagraph></paragraph> 
<paragraph id="H1609C85361DB43EC8B7E27F94E1E6DFC"><enum>(4)</enum><header>Investment in equities</header><text>In accordance with regulations which shall be prescribed by the Board, the Board shall establish standards which must be met by equities selected for investment of amounts in any management account in the Tier II Investment Fund pursuant to paragraph (2)(A)(i). In conformity with such standards, the Board shall select, for purposes of such investment, indices which are comprised of equities the aggregate market value of which is, in each case, a reasonably broad representation of companies whose shares are traded on the equity markets. Amounts invested in equities by each investment manager shall be held in a portfolio designed to replicate the performance of one or more of such indices.</text></paragraph> 
<paragraph id="H54D8D8A5678A408E857C6D89F7BA080"><enum>(5)</enum><header>Investment in fixed income instruments</header><text>In accordance with regulations which shall be prescribed by the Board, the Board shall establish standards which must be met by fixed income instruments selected for investment of amounts in any management account in the Tier II Investment Fund pursuant to paragraph (2)(A)(ii). Such standards shall take into account the competing considerations of risk and return. Amounts invested in fixed income instruments by each investment manager shall be held in a portfolio which shall consist of a diverse range of fixed income instruments, taking into full account the opposing considerations of risk and maximization of return.</text></paragraph></subsection> 
<subsection id="H44ED877294A64B309D1B2C1BDE000078" display-inline="no-display-inline"><enum>(c)</enum><header>Periodic reports by Board</header> 
<paragraph id="HC44B19CC517041ECA2E6809BDD573800"><enum>(1)</enum><header>In general</header><text>The Board shall make periodic reports concerning the status of the investment in the Tier II Investment Fund of amounts credited to each participant’s part B totalization account. Each periodic report shall be furnished to the participant on at least a semiannual basis on or before the 60th day following the period for which the report is required.</text></paragraph> 
<paragraph id="H8FEC58552F02409293D7A4008482DCC4"><enum>(2)</enum><header>Information required to be included</header><text>The periodic report shall contain the following information for transactions occurring during the period for which the report is provided:</text> 
<subparagraph id="HACFFB19BC2BB419EB8CA24DC323DB27F"><enum>(A)</enum><text>The balance in the Tier II Investment Fund credited to the participant’s part B totalization account.</text></subparagraph> 
<subparagraph id="H61DBEDCCF62B4DA69BA4FB7E4E6BED82"><enum>(B)</enum><text>The rate of return on such balance for the period covered, set forth separately for each management account in the case of an investment in 2 or more management accounts during the period.</text></subparagraph> 
<subparagraph id="H03A07D5FA8F0477D80E500F92DDCCDAE"><enum>(C)</enum><text>The amount of authorized contributions made to the Tier II management account and credited to the participant’s part B totalization account.</text></subparagraph> 
<subparagraph id="HAE3D6F29FAEB4C51AE2113FD314782B8"><enum>(D)</enum><text>The name and address of the Board.</text></subparagraph> 
<subparagraph id="HE37E5084BAEF46ED8CE6ED87C227EB05"><enum>(E)</enum><text>Commission fees and fees for administrative expenses charged in connection with the investment in the Tier II Investment Fund during the period.</text></subparagraph> 
<subparagraph id="H8170DF285B714FB78F18796E747D68CB"><enum>(F)</enum><text>Other information which may be required from time to time by the Board.</text></subparagraph><continuation-text continuation-text-level="paragraph">The language of the report shall be written in a form so as to be understood by the average participant.</continuation-text></paragraph></subsection> 
<subsection id="HFA2232DEABBA4B2F8F00F768859E00E7" display-inline="no-display-inline"><enum>(d)</enum><header>Treatment of amounts held in Tier II Investment Fund</header> 
<paragraph id="HAFF91241ABE24BE6BE87B92D99A5FBAF"><enum>(1)</enum><header>In general</header><text>Subject to this part, amounts deposited into the Tier II Investment Fund which are credited to a participant’s part B totalization account shall be treated as property of such participant, held in trust for such participant in the Fund.</text></paragraph> 
<paragraph id="H11CBE3499D29456A9F1D5B7BA09B08F8"><enum>(2)</enum><header>Limitations on use of funds</header><text></text> 
<subparagraph id="HC8B353847AD441BA87D7E5154BB148E"><enum>(A)</enum><header>In general</header><text>Sums in the Tier II Investment Fund credited to a participants part B totalization account may not be used for, or diverted to, purposes other than for the exclusive benefit of the participant or the participant’s beneficiaries under this part.</text></subparagraph> 
<subparagraph id="H3187D03FF2564BFA881FA7556C992902"><enum>(B)</enum><header>Assignments and alienation</header><text>Sums in the Fund may not be assigned or alienated and are not subject to execution, levy, attachment, garnishment, or other legal process.</text></subparagraph></paragraph></subsection> 
<subsection id="H2D434F47451C4E7B8203B6B2E4726DC9" display-inline="no-display-inline"><enum>(e)</enum><header>Lump sum payment to estate upon death of participant</header><text>Upon the death of a participant, the amount of any assets in the Tier II Investment Fund credited to such participant’s part B totalization account shall be transferred in a lump sum, under rules established by the Board—</text> 
<paragraph id="HD089B0016CBE49D9A27B1B79A665CB9B"><enum>(1)</enum><text display-inline="yes-display-inline">in any case in which one or more beneficiaries have been designated in advance, in accordance with regulations which shall be prescribed by the Board, to such beneficiaries in accordance with such designation as provided in such regulations, and</text></paragraph> 
<paragraph id="HEF2CF1B3A9B941AFBDE69F5B78310203"><enum>(2)</enum><text>in the case of any amount not distributed as described in paragraph (1), to such individual's estate.</text></paragraph></subsection></section> 
<section id="H9FEC83596FC34C2581587C0293F62E40"><enum>255.</enum><header>Tier III investment accounts</header> 
<subsection id="H44493CFB366C4B64A69B630345CDA17C"><enum>(a)</enum><header>Designation of Tier II investment accounts</header><text>Under regulations prescribed by the Board, a participant, upon the initial attainment of a minimum deposit balance in amounts in the Tier II Investment Fund credited to the participant’s part B totalization account, as described in section 252(c), may designate to the Board, in such form and manner as shall be prescribed in such regulations, a Tier III investment account to which deposits with respect to the individual are to be made under section 252(c). The individual may designate another Tier III investment account in lieu of any account previously designated, in accordance with regulations of the Board.</text></subsection> 
<subsection id="H930DFA51D8D442889DF3A43D13349EF"><enum>(b)</enum><header>Definition</header><text>For purposes of this part, the term <term>Tier III investment account</term> means a trust created or organized in the United States for the exclusive benefit of a participant or his beneficiaries, but only if the written governing instrument creating the trust meets the following requirements:</text> 
<paragraph id="H6BAE4D0A7D1B405682862F1D84C20906"><enum>(1)</enum><header>Restricted contributions</header><text>No contribution will be accepted unless it is in the form of a deposit to the account pursuant to section 252(c)(1).</text></paragraph> 
<paragraph id="H51A78368460E45388291F83EC6BD200"><enum>(2)</enum><header>Trustee requirements</header><text>The trustee is—</text> 
<subparagraph id="HD8988A0030B24D28BB406EB3A86FCA0"><enum>(A)</enum><text>a bank (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/581">section 581</external-xref> of the Internal Revenue Code of 1986),</text></subparagraph> 
<subparagraph id="HB1854D6585464EE6B1FFC313805B24E8"><enum>(B)</enum><text>an insured credit union (as defined in section 101(6) of the Federal Credit Union Act),</text></subparagraph> 
<subparagraph id="H580B267064614D6E89CD9384DD83039E"><enum>(C)</enum><text>a corporation which, under the laws of the State of its incorporation, is subject to supervision and examination by the Commissioner of Banking or other officer of such State in charge of the administration of the banking laws of such State,</text></subparagraph> 
<subparagraph id="HD6C543308D8D4AC0A31300CB8415D4C"><enum>(D)</enum><text>a regulated investment company (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/851">section 851</external-xref> of the Internal Revenue Code of 1986) for which an election is in effect under section 851(b)(1) of such Code, or</text></subparagraph> 
<subparagraph id="H0B8A4A45E5B04D8C00C06F934F1F69C6"><enum>(E)</enum><text>any other person designated by the Board under regulations prescribed under this paragraph,</text></subparagraph><continuation-text continuation-text-level="paragraph">but only if the trustee demonstrates to the satisfaction of the Board that its portfolio assets either replicate the assets of a broad-based index of equities or fixed income instruments which is approved by the Board or are of a type that the Board has determined not to involve high risks for the investor, and that the manner in which it will administer the trust will be consistent with the requirements of this section.</continuation-text></paragraph> 
<paragraph id="H22553EFC4D514578B08061E369209D1F"><enum>(3)</enum><header>Nonforfeitability</header><text>The interest of an individual in the balance of his account is nonforfeitable.</text></paragraph> 
<paragraph id="H9E38CF023176430987A4DC16BACB85F"><enum>(4)</enum><header>Diversification</header><text>The investment options made available to participants by the trustee include reasonably diversified options of equities, fixed income instruments, or a combination of both. </text></paragraph> 
<paragraph id="HEC59F667D1EA403199B5747B75CA35F"><enum>(5)</enum><header>Separation of assets</header><text>The assets of the trust will not be commingled with other property except in a common trust fund or common investment fund.</text></paragraph> </subsection> 
<subsection id="H72D37273C83145C28E8ECE008EDE7195"><enum>(c)</enum><header>Investment standards</header><text>The trustee of a Tier III investment account shall invest amounts credited to the part B totalization account of a participant which are held in such account in accordance with standards which shall be prescribed by the Board by regulation. Such standards shall ensure that investments made available to participants by the trustee are reasonably diversified, that assets held in a Tier III investment account are nonforfeitable, and that the trustee complies with applicable fiduciary requirements.</text></subsection> 
<subsection id="HD463DCA951234C2EA666E3EF2D32C9E6" display-inline="no-display-inline"><enum>(d)</enum><header>Treatment of amounts held in Tier III investment accounts</header> 
<paragraph id="HD65DB3E4AEFB4C2B9E37FB6F7585FA96"><enum>(1)</enum><header>In general</header><text>Subject to this part, amounts deposited into a participant’s Tier III investment account are the property of such participant, held in trust for such participant by the trustee of such account.</text></paragraph> 
<paragraph id="H7968AC77D2C143DC8B5BE6DD67D335F6"><enum>(2)</enum><header>Assignments and alienation</header><text>Sums in, and payments from, the account may not be assigned or alienated and are not subject to execution, levy, attachment, garnishment, or other legal process.</text></paragraph></subsection> 
<subsection id="HC2597A3EE54F4C029101902130C74E67"><enum>(e)</enum><header>Periodic reports by account trustee</header> 
<paragraph id="H93603B4D83974702988FAD006C5D9557"><enum>(1)</enum><header>In general</header><text>The trustee of a participant’s Tier III investment account shall, in accordance with regulations of the Board, make periodic reports concerning the status of the account which shall meet the requirements of this section. Each periodic report shall be furnished to the participant on at least a semiannual basis on or before the 60th day following the period for which the report is required.</text></paragraph> 
<paragraph id="H3A560C6111CA4E2ABAAB1538A1C20045"><enum>(2)</enum><header>Information required to be included</header><text>The periodic report shall contain the following information for transactions occurring during the period for which the report is provided:</text> 
<subparagraph id="H72A021211A244C6C984CB1009551431E"><enum>(A)</enum><text>The balance in the Tier III investment account.</text></subparagraph> 
<subparagraph id="H678F23B2646A4D0D95C5D502C03FE5C9"><enum>(B)</enum><text>The rate of return for the period covered.</text></subparagraph> 
<subparagraph id="H5C4227FD6E7A4FD28164CF75EE78BB4"><enum>(C)</enum><text>The amount of authorized account contributions.</text></subparagraph> 
<subparagraph id="H74A3AFD2A7594D4E8282E7C91DCE9100"><enum>(D)</enum><text>The name and address of the trustee.</text></subparagraph> 
<subparagraph id="H745146A2743D468DA1887B8272004586"><enum>(E)</enum><text>Commission fees and fees for administrative expenses charged in connection with the account.</text></subparagraph> 
<subparagraph id="HF01AE213696E4F729519E05800440234"><enum>(F)</enum><text>Other information which may be required from time to time by the Board.</text></subparagraph><continuation-text continuation-text-level="paragraph">The language of the report shall be written in a form so as to be understood by the average participant.</continuation-text></paragraph> 
<paragraph id="H1FF5971E9EF54FF58B10CF236E08529F"><enum>(3)</enum><header>Reports to Board</header><text>The Board may require the periodic report to be filed with the Board at such time as the Board may specify in regulations under this section, except that at least 1 periodic report filed annually with Board shall provide information with respect to the account as of December 31 preceding the date of the issuance of the report.</text></paragraph> 
<paragraph id="HEA209D92E5B441CEA5F035E91933C9F8"><enum>(4)</enum><header>Failure by trustee to make timely periodic reports</header><text></text> 
<subparagraph id="H4723BAF6B77A4F12BEEBC5F04D10000"><enum>(A)</enum><header>In general</header><text>The trustee of a Tier III investment account shall be subject to a civil penalty of not to exceed $100 a day from the date of such trustee's failure or refusal to furnish the periodic report required to be furnished by the trustee under this subsection until the date on which such report is furnished.</text></subparagraph> 
<subparagraph id="H6B7B0D45164148F288EFD7BCFA19FB67"><enum>(B)</enum><header>Penalties assessed by Board</header><text>Any civil penalty assessed by this paragraph shall be imposed by the Board and collected in a civil action. The Board may compromise the amount of any civil penalty imposed by this paragraph. The Board may waive the application of this paragraph with respect to any failure if the Board determines that such failure is due to reasonable cause and not to intentional disregard of rules and regulations.</text></subparagraph></paragraph></subsection> 
<subsection id="H665B180CD89E4CAFB4E038FEB9C29B8B"><enum>(f)</enum><header>Lump sum payment to estate upon death of account holder</header><text>Upon the death of a participant who has an amount credited to such participant’s part B totalization account invested in a Tier III investment account, such amount shall be distributed in a lump sum distribution, under rules established by the Board—</text> 
<paragraph id="H5BCC5F7EB7434F7A915217D454047C34"><enum>(1)</enum><text display-inline="yes-display-inline">in any case in which one or more beneficiaries have been designated in advance, in accordance with regulations which shall be prescribed by the Board, to such beneficiaries in accordance with such designation as provided in such regulations, and </text></paragraph> 
<paragraph id="HF5453BE2032445DDAFA7F93221923E00"><enum>(2)</enum><text>in the case of any amount not distributed as described in paragraph (1), to the participant’s estate.</text></paragraph></subsection></section> 
<section id="H902D7FA8E2A54983AB89530300F6BF91" display-inline="no-display-inline"><enum>256.</enum><header>Retirement distributions</header> 
<subsection id="H8AAABD18EFB6453C813F76384C02B044"><enum>(a)</enum><header>In general</header><text>Except as provided in this section, amounts credited to a participant’s part B totalization account may be distributed to the participant only on and after the participant’s retirement date. Such distribution shall be in the form of—</text> 
<paragraph id="HD4BE74AADD2644C7AAE389CBF6759CBF"><enum>(1)</enum><text>an individual social security annuity meeting the requirements of subsection (c),</text></paragraph> 
<paragraph id="H6CDEBF0DF34B4AA2B67B3F9821D7F821"><enum>(2)</enum><text>a programmed withdrawal meeting the requirements of subsection (d), or</text></paragraph> 
<paragraph id="H6A21D494E6ED45C2AF7BB3D80036C43F"><enum>(3)</enum><text>a combination, meeting the requirements of subsection (e), of an individual social security annuity (meeting the requirements of subsection (b)) and a lump sum distribution.</text></paragraph><continuation-text continuation-text-level="subsection">Not later than the date on which the participant attains age 62, and at any other time upon the request of the participant, the Board shall notify the participant of the most recent listing of forms of distribution approved under this section and the entitlement (if any) of the participant to such a distribution.</continuation-text></subsection> 
<subsection id="H7C6EA9317138434FAD3ED39011196B61"><enum>(b)</enum><header>Retirement date</header><text>For purposes of this section, the term <term>retirement date</term>, in connection with a participant, means the earlier of—</text> 
<paragraph id="H153E63B404F3485C852313523C4CC82C"><enum>(1)</enum><text>any date as of which the participant has attained retirement age (as defined in section 216(l)(1)), or</text></paragraph> 
<paragraph id="HFE501093DE8C46268C6CBB00EAF3B45F"><enum>(2)</enum><text>the date designated for distribution of the balance in the participant’s part B totalization account pursuant to section 260.</text></paragraph></subsection> 
<subsection id="HCF22EF7DA1A448FE85DCC3811DFBBC23"><enum>(c)</enum><header>Purchase of annuities</header> 
<paragraph id="H8982F44FFE0D4A0A918D2CFEE3E0008D"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H867C64D88DFF43579BF373B87D30C320"><enum>(A)</enum><header>Selection of annuity</header><text display-inline="yes-display-inline">On the participant’s retirement date, the participant may purchase an individual social security annuity selected from among the annuities approved by the Board under paragraph (2).</text></subparagraph> 
<subparagraph id="H1B5E204855EA434CA66F04F476AA59CF"><enum>(B)</enum><header>Transfer of assets</header><text>Upon the selection by a participant under subparagraph (A), the Board shall provide for the transfer of all assets credited to the participant’s part B totalization account and determined under regulations of the Board to be available for distribution to purchase the annuity selected by the individual.</text></subparagraph></paragraph> 
<paragraph id="H283F1471C9C84254989C0042AE4BE724"><enum>(2)</enum><header>Approval of individual social security annuities</header> 
<subparagraph id="H8C2C678DB1D345EFB7C1B200CEB7A142"><enum>(A)</enum><header>Certification of issuers</header> 
<clause id="H9070DEDAF57B4FFBAA6925778CF6318"><enum>(i)</enum><header>In general</header><text>The Board shall certify issuers eligible to enter into annuity contracts with participants under this subsection.</text></clause> 
<clause id="HBF86F7B76FDB42949D9B49778B008E92"><enum>(ii)</enum><header>Application</header><text>Any issuer that desires to be certified by the Board to issue an individual social security annuity shall submit an application to the Board at such time, in such manner, and containing such information as the Board may require.</text></clause> 
<clause id="H802ABED00DEA411DB33C57946C8E4682"><enum>(iii)</enum><header>Separation from other operations</header><text>As a condition of certification under this subparagraph, each issuer shall maintain each individual social security annuity issued by such issuer separate from all other operations of the issuer.</text></clause> 
<clause id="H351E1BAFFC2C4F97A1524C545CA642D1"><enum>(iv)</enum><header>Exemption from third party claims</header><text>Each individual social security annuity shall be exempt from any and all third party claims against the issuer.</text></clause></subparagraph> 
<subparagraph id="H3968BCD2F93A46148100237E2DE78E9E"><enum>(B)</enum><header>Approval of individual social security annuities</header> 
<clause id="H1D3D742E4A744F1B9EAACCD13C8B210"><enum>(i)</enum><header>In general</header><text>No funds may be transferred into an individual social security annuity unless the Board has approved an application submitted under clause (ii) with respect to the annuity.</text></clause> 
<clause id="H384329B4FB4F48149CB070B513BF4887"><enum>(ii)</enum><header>Application</header><text>With respect to each individual social security annuity that an issuer certified under subparagraph (A)(i) seeks to issue, such issuer shall submit an application to the Board at such time, in such manner, and containing such information as the Board may require.</text></clause> 
<clause id="HAAB67338FD814FC98931C7B06514C406"><enum>(iii)</enum><header>Qualifications for approval</header> 
<subclause id="HE0706AA72CCA42DCBDE200530040EBA2"><enum>(I)</enum><header>In general</header><text>The Board may not approve an application under clause (i) unless the individual social security annuity that is the subject of the application meets qualifications which shall be specified in regulations of the Board. Such qualifications shall include the safety and soundness of the annuity, the experience and record of performance of the issuer issuing the annuity, and such other factors as the Board may determine appropriate.</text></subclause> 
<subclause id="HB85591697FFE4AB688791E523E7CA06B"><enum>(II)</enum><header>Cost-of-living adjustments</header><text display-inline="yes-display-inline">The Board may not approve an application under clause (i) unless the terms of the annuity include procedures providing for adjustments in the amount of the monthly payments in the same manner and to the same extent as adjustments are provided for under the procedures used to adjust benefit amounts under section 215(i)(2)(A). Nothing in this subclause shall be construed to preclude the terms governing such an annuity from providing for adjustments in the amount of monthly payments resulting in a payment for any month greater than the payment for that month that would result from adjustments required under the preceding sentence.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="HB2BA2D3FB86D476BBD9CCE6BAF2F26E"><enum>(d)</enum><header>Programmed withdrawal</header> 
<paragraph id="HA263CC43332149EB9E345D7090CF1904"><enum>(1)</enum><header>In general</header><text>On the participant’s retirement date, the participant may elect distribution under this section of the balance credited to the participant’s part B totalization account as provided in this subsection. Such distribution shall be in the form of a combination of—</text> 
<subparagraph id="H8A9F59B976C44B049EE414D3804CD8C4"><enum>(A)</enum><text>equal annual or more frequent periodic installments of the principal portion of the balance over twice his or her life expectancy (subject to adjustments under paragraph (2)), and</text></subparagraph> 
<subparagraph id="H3F41021029F0467292C9F91108C2BA99"><enum>(B)</enum><text>any distribution of any remaining balance in accordance with this section.</text></subparagraph></paragraph> 
<paragraph id="HBD6F9CBF82B24618A78E3431D0F776BE"><enum>(2)</enum><header>Cost-of-living adjustments</header><text display-inline="yes-display-inline">Any distribution under paragraph (1)(A) shall, in accordance with regulations which shall be prescribed by the Board, provide for adjustments in the periodic payments in the same manner and to the same extent as adjustments are provided for under the procedures used to adjust benefit amounts under section 215(i)(2)(A). Nothing in this paragraph shall be construed to preclude the terms governing such distribution from providing for adjustments in the amount of monthly payments resulting in a payment for any month greater than the payment for that month that would result from adjustments required under the preceding sentence.</text></paragraph> 
<paragraph id="H560EE1A2F42449F7BB00B7C18439E65E"><enum>(3)</enum><header>Limitation</header><text display-inline="yes-display-inline">Any distribution described in paragraph (1)(B) shall be limited to the extent necessary to ensure that remaining funds credited to the account are sufficient to provide periodic installments under paragraph (1) at least, on an annual basis, equal to (determined under reasonable actuarial assumptions) 100 percent of the poverty line for an individual (determined under the poverty guidelines of the Department of Health and Human Services issued under sections 652 and 673(2) of the Omnibus Budget Reconciliation Act of 1981). </text></paragraph></subsection> 
<subsection id="HBE8EA9F9ECFB4D6A9E6E90FB2F5C6906"><enum>(e)</enum><header>Combination of lump sum payment and annuity</header><text display-inline="yes-display-inline">On the participant’s retirement date, the participant may elect distribution under this section of the balance credited to the participant’s part B totalization account as provided in this subsection. Such distribution shall be in the form of a combination of a lump sum payment and an annuity approved under subsection (c). Any such lump sum payment shall be limited to the extent necessary to ensure that remaining funds credited to the account are sufficient to provide, through the purchase of such an annuity, a monthly payment over the life expectancy of the participant (determined under reasonable actuarial assumptions) which is at least, on an annual basis, equal to 100 percent of the poverty line for an individual (determined under the poverty guidelines of the Department of Health and Human Services issued under sections 652 and 673(2) of the Omnibus Budget Reconciliation Act of 1981). </text></subsection> 
<subsection id="H815E5638D9D54D0B8BA0F203815B730"><enum>(f)</enum><header>Lump sum distributions of de minimis amounts</header><text>In any case in which, as of the date on which the participant attains retirement age (as defined in section 216(l)(1)), a distribution under this section has not commenced, and the total amount of the assets credited to the participant’s part B totalization account is less than the minimum deposit balance (as defined in section 252(c)(2)), the preceding provisions of this section shall not apply, and such assets shall be distributed to the participant in a lump sum upon the request of the participant, under rules established by the Board. </text></subsection> 
<subsection id="H9F6B60A99EA84EE28117E972BBD55E34"><enum>(g)</enum><header>Protection from assignment or alienation</header><text>Distributions under this section may not be assigned or alienated and are not subject to execution, levy, attachment, garnishment, or other legal process.</text></subsection></section> 
<section id="H78BE2B5EB35C4F049689C982D4F8B945" display-inline="no-display-inline" section-type="subsequent-section"><enum>257.</enum><header>Recognition bonds</header> 
<subsection id="HBC6EB6B43C8644CAA0BDE60E8F5CCF9"><enum>(a)</enum><header>Certification of credited wages and self-employment income</header><text>Not later than July 1 following the effective date of an election to become a participant filed by an individual under section 259, the Commissioner of Social Security shall certify to the Secretary of the Treasury whether such individual was, as of immediately before such effective date, credited with wages and self-employment income under part A.</text></subsection> 
<subsection id="H9D531AC69F9D42309C598B00C88611EB"><enum>(b)</enum><header>Issuance of bond</header><text>Immediately upon receipt of certification under subsection (a) that an individual is credited with wages and self-employment income under part A, the Secretary of the Treasury shall issue a recognition bond in the name of such individual as an obligation of the United States, which shall be deposited in the Tier II Investment Fund and held in such Fund for such individual together with such individual’s part B totalization account. The purposes for which obligations of the United States may be issued under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/31">chapter 31</external-xref> of title 31, United States Code, are hereby extended to authorize the issuance of public debt obligations consisting of recognition bonds issued under this paragraph. Each such obligation shall be evidenced by a paper instrument issued by the Secretary of the Treasury setting forth the terms specified in this section, and stating on its face that the obligation shall be incontestable in the hands of the bearer, that the obligation is supported by the full faith and credit of the United States, and that the United States is pledged to the payment of the obligation, in accordance with the provisions of this section.</text></subsection> 
<subsection id="H20909C63551247D08241DEC4E8707739"><enum>(c)</enum><header>Calculation of face value</header> 
<paragraph id="H371F7D4287664B7BA23D27C935818467"><enum>(1)</enum><header>In general</header><text>The face value of a recognition bond issued in the name of an individual under this section shall be the actuarial present value of the future monthly insurance benefits under part A to which such individual would have been entitled, and to which other individuals would have been entitled under part A based on such individual’s wages and self-employment income, determined under then current law but as if section 215(j) did not apply and subject to paragraph (2) of this subsection.</text></paragraph> 
<paragraph id="HA223D5B4FCED4AA986ABBF00B938F926"><enum>(2)</enum><header>Assumptions</header><text>The actuarial present value determined under paragraph (1) shall be determined—</text> 
<subparagraph id="H2140C1EADFC94394A67C7E466DDC7D65"><enum>(A)</enum><text>taking into account solely wages and self-employment income credited to such individual as of the effective date of the election referred to in subsection (a),</text></subparagraph> 
<subparagraph id="H065FDAA6A380498E945E52791E041C7C"><enum>(B)</enum><text>assuming that such individual would become entitled to disability insurance benefits under section 223 (in lieu of old-age insurance benefits under section 202(a)) on the day such individual would attain retirement age (as defined in section 216(l)), except that, in computing average indexed monthly earnings under section 215(b), the number of such individual’s benefit computation years shall be determined without regard to any reduction in the number of elapsed years under section 215(b)(2)(A), and</text></subparagraph> 
<subparagraph id="H1C39BE971D3B47B1A364B12C00AEC07"><enum>(C)</enum><text>using reasonable actuarial assumptions, including reasonable current age-specific and gender-specific expected mortality rates.</text></subparagraph></paragraph></subsection> 
<subsection id="HA286B20F20AC48749696E5B410E0C4AF"><enum>(d)</enum><header>Redemption</header><text>A bond issued in the name of any participant under this section shall be redeemable (by the participant or other person bearing the bond after sale or resale pursuant to subsection (e)) on or after the date on which such participant would attain retirement age (as defined in section 216(l)(1)), for the amount of the face value.</text></subsection> 
<subsection id="HB880388D6D144F6EB9B14100D83BEE00"><enum>(e)</enum><header>Negotiability and crediting of proceeds to part B totalization account</header><text display-inline="yes-display-inline">A recognition bond issued in the name of a participant under this section shall not be taken into account in determining the amount credited to the participant’s part B totalization account. Such bond shall be fully tradable on the secondary markets under such procedures as may be provided in regulations of the Board, and any amount derived by the participant from the sale of such bond shall be deposited in the Tier II Investment Fund and shall be included in the total amount credited to such participant’s part B totalization account. </text></subsection></section> 
<section id="H43A459D519334D0499009ED4C646C8D1"><enum>258.</enum><header>Supplemental minimum benefit payments</header> 
<subsection id="H2380B394ADDD4200816CBDF100C28C14"><enum>(a)</enum><header>In general</header><text>In any case in which—</text> 
<paragraph id="H7C30708BA2054E57B9302FC5CA177F86"><enum>(1)</enum><text>a participant attains retirement age (as defined in section 216(l)(1)),</text></paragraph> 
<paragraph id="HDB4B92E024804CC9BA6CDE0033EB1029"><enum>(2)</enum><text>as of the date such participant attains such age, no distribution from amounts credited to the participant’s part B totalization account has been made to the participant under section 260, and</text></paragraph> 
<paragraph id="H27C4365F3AF847DCB0EFAED708FC1716"><enum>(3)</enum><text>as of such date, the balance in the participant’s part B totalization account (subject to subsection (e)) is less than the minimum annuity amount,</text></paragraph><continuation-text continuation-text-level="subsection">the Board shall promptly notify the participant of the participant’s eligibility for a supplemental minimum benefit payment under this section. The participant, upon application to the Board filed by the participant on or after such date and in such form and manner as shall be prescribed by the Board, shall be entitled to a supplemental minimum benefit payment either to the Tier II Investment Fund (to the credit of the participant’s part B totalization account) or to the participant’s Tier III investment account, as may be specified by the participant in such application. Upon receipt of such application, the Board shall certify to the Secretary of the Treasury the amount of such payment, and such Secretary shall pay the amount of such payment to such Fund or such Tier III investment account in accordance with such certification from funds otherwise available in the general fund of the Treasury.</continuation-text></subsection> 
<subsection id="HE8D3DD9F7A124FA793FAFF3CB0C20649"><enum>(b)</enum><header>Amount of supplemental minimum benefit payment</header><text>The amount of a supplemental minimum benefit payment payable with respect to a participant under subsection (a) is, subject to subsection (d), the excess (if any) of—</text> 
<paragraph id="H0A652E3F251F40BA9325106063A52BB8"><enum>(1)</enum><text>the minimum annuity amount as of the date described in subsection (a), over</text></paragraph> 
<paragraph id="HCB56120046B44D35B3E9527CD2238B6"><enum>(2)</enum><text>the amount credited to the participant’s part B totalization account, (subject to subsection (e)).</text></paragraph></subsection> 
<subsection id="HFC1763ECAD314A378FC06600A23D12D5"><enum>(c)</enum><header>Minimum annuity amount</header> 
<paragraph id="H8A97BB803E0347C38C00C65841D5CAEF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>minimum annuity amount</term> means an amount, determined as of the date described in subsection (a), necessary to purchase an immediate life annuity which provides for monthly payments which are, on an annual basis, at least equal to the applicable percentage of the poverty line as of such date for an individual (determined under the poverty guidelines of the Department of Health and Human Services issued under sections 652 and 673(2) of the Omnibus Budget Reconciliation Act of 1981).</text></paragraph> 
<paragraph id="HE9AAC44102414A50A5C3ADAED3BF9241"><enum>(2)</enum><header>Applicable percentage</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the applicable percentage, in connection a participant, shall be the excess of—</text> 
<subparagraph id="HB5F3A8D13FFC4738A12F00A2F6085CB4"><enum>(A)</enum><text>100 percent, over</text></subparagraph> 
<subparagraph id="H80C740F6C6D94582B13643A858DAEF4"><enum>(B)</enum><text>the product derived by multiplying—</text> 
<clause id="HF3461F64818943CEA6F68ED57BAA277E"><enum>(i)</enum><text>1.0 percentage point, by</text></clause> 
<clause id="H29C92FC8839C4CECB83826FA5B006E8E"><enum>(ii)</enum><text>the excess (not less than zero) of—</text> 
<subclause id="H12114E22CCDA4014ABD17751F75E2B4B"><enum>(I)</enum><text>140, over</text></subclause> 
<subclause id="H50B4B83672A0435EAA3024BBEE5E003C"><enum>(II)</enum><text>the number of such participant’s quarters of coverage under part A of this title.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H9386552124FA484F8FFC63AAE1B2F85C" display-inline="no-display-inline"><enum>(3)</enum><header>Immediate life annuity</header><text>For purposes of paragraph (1), the term <term>immediate life annuity</term> means an annuity—</text> 
<subparagraph id="H80AC7DD8E2514CF39F861B53F3E39E82"><enum>(A)</enum><text>the annuity starting date (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/72">section 72(c)(4)</external-xref> of the Internal Revenue Code of 1986) of which commences with the first month following the date described in subsection (a), and</text></subparagraph> 
<subparagraph id="H2F45364D9215438CB1DDEB857D002799"><enum>(B)</enum><text>which provides for a series of substantial equal annual payments over the life expectancy of the participant.</text></subparagraph></paragraph> 
<paragraph id="H1E2A33669506402C8B12246800868969" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Assumptions</header><text>Determinations of the minimum annuity amount under this subsection shall be based on reasonable actuarial assumptions which shall be prescribed by the Board (including among such assumptions reasonable charges for administrative costs).</text></paragraph></subsection> 
<subsection id="HF9DE3EF82AFC4E958BB011B805786F3"><enum>(d)</enum><header>Need-based cash benefits taken into account</header> 
<paragraph id="H74D023C9097A4488AEE79EB3E1FDCBA5"><enum>(1)</enum><header>In general</header><text>Under regulations which shall be prescribed by the Board, in any case in which a participant is entitled to, or eligible for, need-based cash benefits for any month, the supplemental minimum benefit payments otherwise payable to such participant for such month, as determined under subsection (a), shall be reduced by the total amount of such recognized governmental cash benefits for such month.</text></paragraph> 
<paragraph id="H600C0B9CD5CC495FA9EB7AD60381275"><enum>(2)</enum><header>Need-based cash benefits</header><text>For purposes of paragraph (1), the term <term>need-based cash benefit</term> for any month means—</text> 
<subparagraph id="HBDB8083EDD724B72B400FD00DEE3F90"><enum>(A)</enum><text>a supplemental security income benefit under title XVI for such month, and</text></subparagraph> 
<subparagraph id="H4C3D6FDF0AD04CC48B441B888799B91"><enum>(B)</enum><text>a monthly cash benefit payable to such participant for such month under any other need-based assistance program of the United States or of any State (or political subdivision thereof, as defined in section 218(b)(2)).</text></subparagraph></paragraph> 
<paragraph id="HDAEF7BFCC42F4C0DAA8E99ED71684193"><enum>(3)</enum><header>Conversion to monthly benefits</header><text>For purposes of this subsection, any periodic benefit which otherwise is described in paragraph (2)(B), but which is paid on other than a monthly basis, shall be allocated on a basis equivalent to a monthly benefit (as determined by the Board), and such equivalent monthly benefit shall constitute a monthly cash benefit for purposes of paragraph (2)(B). For purposes of this paragraph, the term <term>periodic benefit</term> includes a benefit payable in a lump sum if it is a commutation of, or a substitute for, periodic payments.</text></paragraph> 
<paragraph id="H3117924DEF5A4920B1809CA1002924F3"><enum>(4)</enum><header>Affect on other laws</header><text>To the extent that any provision of law of the United States or of any State (or political subdivision thereof, as defined in section 218(b)(2)) providing for need-based cash benefits takes into account supplemental minimum benefit payments under this section in determining eligibility for such need-based benefits or the amount thereof, this section supersedes such provision and such provision shall be null and void as against public policy.</text></paragraph></subsection> 
<subsection id="H0C07899C8A914778BF9F85B9BEBCA4C4" display-inline="no-display-inline"><enum>(e)</enum><header>Treatment of periodic payments based on noncovered governmental service</header> 
<paragraph id="HD018F83725C2485E8008B7DE332F34EE"><enum>(1)</enum><header>In general</header><text>In any case in which a participant is eligible for a periodic payment which is based in whole or in part on the participant’s earnings for noncovered governmental service, for purposes of subsection (b)(2), the amount credited to such participant’s part B totalization account shall be deemed to be equal to the amount derived by multiplying—</text> 
<subparagraph id="HFE3945A63BF44757B9D21C26EA1B6A4"><enum>(A)</enum><text>the amount credited to such participant’s part B totalization account (as determined without regard to this subsection), by</text></subparagraph> 
<subparagraph id="HF3F196BE46C94DBAB14EB23BE57E43DE"><enum>(B)</enum><text>a fraction—</text> 
<clause id="H3FF97F0C4FA84B3E877C00C8B1B67692"><enum>(i)</enum><text>the numerator of which is an amount equal to the individual’s adjusted average indexed monthly earnings (as determined under paragraph (3)), and</text></clause> 
<clause id="H2223FA008BCE46338289225C000195E8"><enum>(ii)</enum><text>the denominator of which is the individual’s average indexed monthly earnings (determined on 215(b) without regard to paragraph (3)),</text></clause></subparagraph><continuation-text continuation-text-level="paragraph">rounded, if not a multiple of $0.10, to the next lower multiple of $0.10.</continuation-text></paragraph> 
<paragraph id="H926363F0F2B247AF00D400DE00BF581F" display-inline="no-display-inline"><enum>(2)</enum><header>Noncovered governmental service</header><text>For purposes of this subsection, the term <term>noncovered governmental service</term> means service for the Federal Government or for a State (or political subdivision thereof, as defined in section 218(b)(2)) which does not constitute <quote>employment</quote> as defined in section 210, except that such term does not include service as a member of a uniformed service (as defined in section 210(m)).</text></paragraph> 
<paragraph id="H8881089BC43B4AFFAF72F0CB736B5011"><enum>(3)</enum><header>Adjusted average indexed monthly earnings</header><text></text> 
<subparagraph id="H433CBD5ABE3B46C4AABA88AD8139BD1E" display-inline="no-display-inline"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1)(B)(i), the adjusted average indexed monthly earnings of a participant is the amount of the participant’s average indexed monthly earnings (determined under section 215(b)), adjusted by treating all noncovered governmental service performed after 1950 on which a periodic benefit referred to in paragraph (1) is based as <quote>employment</quote> as defined in section 210 for purposes of this title (together with all other service performed by such individual consisting of <quote>employment</quote> as so defined).</text></subparagraph> 
<subparagraph id="HFF7A7F4A869D46A590F014CF07EB927"><enum>(B)</enum><header>Methodology</header><text>For purposes of determining average indexed monthly earnings as described in subparagraph (A), the Commissioner of Social Security shall provide by regulation for a method for determining the amount of wages derived from service performed after 1950 and which is to be treated as <quote>employment</quote> solely for purposes of subparagraph (A). Such method shall provide for reliance on employment records which are provided to the Commissioner and which constitute a reasonable basis for treatment of service as <quote>employment</quote> for such purposes, together with such other information received by the Commissioner as the Commissioner may consider appropriate as a reasonable basis for treatment of service as <quote>employment</quote> for such purposes.</text></subparagraph></paragraph> 
<paragraph id="HA2AAC5BD460745469CFF44AFDB43D9A8"><enum>(4)</enum><header>Cooperation by Commissioner</header><text>The Commissioner of Social Security shall provide to the Board such assistance and information as the Board may require for purposes of this subsection.</text></paragraph></subsection> 
<subsection id="H42BCA5A48CEE4F43A27D00EA98F90F8" display-inline="no-display-inline"><enum>(f)</enum><header>Married couples</header><text>In the case of any 2 participants who are married, subsection (a) shall apply with respect to each such participant, upon the joint written request of such participants, by totalling the balances in the accounts referred to in subsection (a) of both such individuals.</text></subsection> 
<subsection id="HE5334EE0C6F942E8935F496FD5B9C9ED"><enum>(g)</enum><header>Protection from assignment or alienation</header><text>Any supplemental minimum benefit payment under this section may not be assigned or alienated.</text></subsection></section> 
<section id="HA6E7BCD025F44E3D9F7816603F2BC2CC"><enum>259.</enum><header>Election for participation</header> 
<subsection id="H7796BB04832B47739CB1424FF8F098F6"><enum>(a)</enum><header>In general</header><text>Any individual who—</text> 
<paragraph id="H8B5E8A20A38B47FEA4F271AB008937F9"><enum>(1)</enum><text>is born on or after January 1, 1951, and before January 1, 1984,</text></paragraph> 
<paragraph id="H274AAEEB7940418AB1BAB52D097968CA"><enum>(2)</enum><text>has not attained retirement age (as defined in section 216(l)(1)), and</text></paragraph> 
<paragraph id="H8507B6AF7B9C4699AA2905CA6DDA4884"><enum>(3)</enum><text>has not become entitled to old-age insurance benefits under section 202(a),</text></paragraph><continuation-text continuation-text-level="subsection">may file with the Board under this section, in such form and manner as shall be prescribed in regulations of the Board, a written form electing the status of <quote>participant</quote> for purposes of this part. On and after the effective date of the election, such individual shall be treated as a participant under this part with respect to wages received in any calendar year beginning on or after such date and self-employment income for any taxable year beginning on or after such effective date.</continuation-text></subsection> 
<subsection id="H755AF91F8F1B412900B09998C179894"><enum>(b)</enum><header>Effective date of election</header><text>An election under this section shall take effect on January 1 of the first calendar year beginning after 60 days after the date of the filing of the election in accordance with subsection (a).</text></subsection> 
<subsection id="H38657B5D55004F97B56BAF7BCDE3F00"><enum>(c)</enum><header>Irrevocability</header><text>Any election under this section shall be irrevocable.</text></subsection></section> 
<section id="H7B5FE295916041D8B7C5B6005B4399BE" display-inline="no-display-inline"><enum>260.</enum><header>Early distribution and termination of participation in program</header> 
<subsection id="H5B929D99CD1245DCBC333448D12E26FF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which the amount credited to a participant’s part B totalization account as of any date prior to the date on which the participant attains retirement age (as defined in section 216(l)(1)) accrues to a level equal to at least the amount necessary to purchase under section 256(c) (as if such date were the participant’s retirement date) an immediate life annuity which provides for payments which are, on an annual basis, at least equal to 100 percent of the poverty line as of such date for an individual (determined under the poverty guidelines of the Department of Health and Human Services issued under sections 652 and 673(2) of the Omnibus Budget Reconciliation Act of 1981), the Board shall promptly so inform the participant, and, upon application of the participant filed with the Board under this section in accordance with regulations of the Board—</text> 
<paragraph id="H04EDC81644824FFF9B80C95647ED14E6"><enum>(1)</enum><text>the Board shall, at the election of the participant, either—</text> 
<subparagraph id="HD223E1D46C4B4E79BB73F5BF4655C087"><enum>(A)</enum><text>commence distribution of the total amount credited to such participant’s part B totalization account in the form of an annuity purchased under section 256(c), or</text></subparagraph> 
<subparagraph id="HEBF5EE963DA24C9099BA71005FF57D43"><enum>(B)</enum><text>provide for consolidation of the total amount credited to such account in the Tier II Investment Fund and investment of such amount in fixed-income instruments meeting the requirements of section 254(c), until distribution of such amount is made under subparagraph (A) or section 256, and</text></subparagraph></paragraph> 
<paragraph id="H3722DE3BA728400E9E6000006400B0C"><enum>(2)</enum><text>in lieu of the transfer, from the Tier I Investment Fund to the Tier II Investment Fund or a Tier III investment account, of any remaining amount credited to such participant’s part B totalization account after the date of the distribution or consolidation under paragraph (1), the Board shall provide for the direct payment of such remaining credited amount to the participant.</text></paragraph></subsection> 
<subsection id="H3EE29D1700634B57AC2CFE39CDB7A772"><enum>(b)</enum><header>Immediate life annuity</header><text>For purposes of subsection (a), the term <term>immediate life annuity</term> means an annuity—</text> 
<paragraph id="HF10304F3C96242CCB3D3628E0815B337"><enum>(1)</enum><text>the annuity starting date (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/72">section 72(c)(4)</external-xref> of the Internal Revenue Code of 1986) of which commences with the first month following the date referred to in subsection (a), and</text></paragraph> 
<paragraph id="HEA70825E508F436A89BADBD2F3E10CF"><enum>(2)</enum><text>which provides for a series of substantially equal annual payments over the life expectancy of the participant.</text></paragraph></subsection> 
<subsection id="H0311FABAFCB9446193F0D600D3AE48CF" display-inline="no-display-inline"><enum>(c)</enum><header>Married couples</header><text>In the case of any 2 participants who are married, subsection (a) shall apply with respect to each such participant, upon the joint written request of such participants, by totalling the balances in the accounts referred to in subsection (a) of both such individuals.</text></subsection> 
<subsection id="H7857D226F63B41CF84188512B5264CF4"><enum>(d)</enum><header>Treatment of periodic payments based on governmental service</header><text>Section 258(e) shall apply for purposes of this section in determining the amount credited to a participant’s part B totalization account.</text></subsection></section> 
<section id="H91CD74ECECA04DE0B1F4DA07D101C6A9"><enum>261.</enum><header>Individual Investment Board</header> 
<subsection id="H7DFED866E532442D8E15F064EAE83345"><enum>(a)</enum><header>Establishment</header><text>There is established in the executive branch of the Government an Individual Investment Board.</text></subsection> 
<subsection id="HC831A5525D1B46F6B52E484D16ECEA16"><enum>(b)</enum><header>Composition</header><text>The Board shall be composed of—</text> 
<paragraph id="HA4AA1C4E5B7A4941AD86BD46F31BF721"><enum>(1)</enum><text>3 members appointed by the President, of whom 1 shall be designated by the President as Chairman; and</text></paragraph> 
<paragraph id="H514E60ADE9704820A4DE684127693998"><enum>(2)</enum><text>2 members appointed by the President, of whom—</text> 
<subparagraph id="H4B9C422B79A8458BB0C199D43585CE94"><enum>(A)</enum><text>1 shall be appointed by the President after taking into consideration the recommendation made by the Speaker of the House of Representatives in consultation with the Minority Leader of the House of Representatives; and</text></subparagraph> 
<subparagraph id="HDEC19D8E5D694CBEA59EC86399122200"><enum>(B)</enum><text>1 shall be appointed by the President after taking into consideration the recommendation made by the Majority Leader of the Senate in consultation with the Minority Leader of the Senate.</text></subparagraph></paragraph></subsection> 
<subsection id="H82689AAA314343A898E65D81CB8BBFB4"><enum>(c)</enum><header>Advice and consent</header><text>Appointments under subsection (b) shall be made by and with the advice and consent of the Senate.</text></subsection> 
<subsection id="H6EFA959A82C648E7B3834B2D17309EA5"><enum>(d)</enum><header>Membership requirements</header><text>Members of the Board shall have substantial experience, training, and expertise in the management of financial investments and pension benefit plans.</text></subsection> 
<subsection id="H105E0F5AC45B40D0A064CDC4AFBE5692"><enum>(e)</enum><header>Length of appointments</header> 
<paragraph id="HFC5BF914FCB74E52BE1FD9492806B219"><enum>(1)</enum><header>Terms</header><text>A member of the Board shall be appointed for a term of 4 years, except that of the members first appointed under subsection (b)—</text> 
<subparagraph id="HF7A0C935701A4493AB2ED714A9382D50"><enum>(A)</enum><text>the Chairman shall be appointed for a term of 4 years;</text></subparagraph> 
<subparagraph id="H096D005C93CA419E8724AE2D92784390"><enum>(B)</enum><text>the members appointed under subsection (b)(2) shall be appointed for terms of 3 years; and</text></subparagraph> 
<subparagraph id="H8596E010896C4C45AB4B05101C65EE63"><enum>(C)</enum><text>the remaining members shall be appointed for terms of 2 years.</text></subparagraph></paragraph> 
<paragraph id="H9EBBDE699B2B4786AAB6B0521371FA3E"><enum>(2)</enum><header>Vacancies</header> 
<subparagraph id="H94E4513D49714336889D63687BEB2763"><enum>(A)</enum><header>In general</header><text>A vacancy on the Board shall be filled in the manner in which the original appointment was made and shall be subject to any conditions that applied with respect to the original appointment.</text></subparagraph> 
<subparagraph id="HB8B771FB41484BDE99B52DCFA38A24"><enum>(B)</enum><header>Completion of term</header><text>An individual chosen to fill a vacancy shall be appointed for the unexpired term of the member replaced.</text></subparagraph></paragraph> 
<paragraph id="H7F7A2E13678B4B8BB2B706A8D05172A8"><enum>(3)</enum><header>Expiration</header><text>The term of any member shall not expire before the date on which the member's successor takes office.</text></paragraph></subsection> 
<subsection id="HEB771DF7434343738365E4EB742D91D"><enum>(f)</enum><header>Duties</header><text>The Board shall—</text> 
<paragraph id="H744E47145FD14AA4B93C9B01F7A36012"><enum>(1)</enum><text>administer the program established under this part;</text></paragraph> 
<paragraph id="HDC4C283CF35D4F14B742DAA43D7C5902"><enum>(2)</enum><text>establish policies for the investment and management of the Tier I Investment Fund, the Tier II Investment Fund, and Tier III investment accounts, including policies applicable to the asset managers with responsibility for managing the investment of individual investment account balances, and for the management and operation of individual social security annuities purchased with Tier II Investment Fund assets, which shall provide for—</text> 
<subparagraph id="H5280C89DCAD2412A86DECA5FD008781F"><enum>(A)</enum><text>prudent investments suitable for accumulating funds for payment of retirement income;</text></subparagraph> 
<subparagraph id="HE66833A926E04400B38EBCB1BC7D4912"><enum>(B)</enum><text>sound management practices; and</text></subparagraph> 
<subparagraph id="H83DA39685C1542329EF5B2F626C11D"><enum>(C)</enum><text>low administrative costs;</text></subparagraph></paragraph> 
<paragraph id="H329FFCFFBBBD45DEACE069EF3ED91C87"><enum>(3)</enum><text>review the performance of investments made for the Tier I Investment Fund and the Tier II Investment Fund;</text></paragraph> 
<paragraph id="HF5EE6A2A14D64C7595E5B53977F2B548"><enum>(4)</enum><text>review the management and operation of individual social security annuities purchased with Tier II Investment Fund assets;</text></paragraph> 
<paragraph id="H3A09DE1C33C24FA089BA25D5D687F4D5"><enum>(5)</enum><text>review the performance of investments made under Tier III investment accounts;</text></paragraph> 
<paragraph id="H3F2D871238DF407CA7875D4BA11CDAC"><enum>(6)</enum><text>review and approve the budget of the Board; and</text></paragraph> 
<paragraph id="HA93940B07B4A453188F7C12022945499"><enum>(7)</enum><text>comply with the fiduciary requirements of part 4 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 (relating to fiduciary responsibility) in connection with any exercise of discretion in connection with the assets of the Tier I Investment Fund or the Tier II Investment Fund.</text></paragraph></subsection> 
<subsection id="H780FA9096E4E4801BC58B5E0CC7F3E3"><enum>(g)</enum><header>Administrative provisions</header> 
<paragraph id="H87825D6438D14D8EBB3D2736B008F3D1"><enum>(1)</enum><header>In general</header><text>The Board may—</text> 
<subparagraph id="H7C908AC52FED4F378513CEB9CEB3867"><enum>(A)</enum><text>adopt, alter, and use a seal;</text></subparagraph> 
<subparagraph id="H9D6D9E21B78642CB00508598F76F0313"><enum>(B)</enum><text>except as provided in paragraph (4), direct the Executive Director to take such action as the Board considers appropriate to carry out the provisions of this part and the policies of the Board in accordance with delegations under this part;</text></subparagraph> 
<subparagraph id="H970C762F5F614A8585DCE5C131EA4D90"><enum>(C)</enum><text>upon the concurring votes of 4 members, remove the Executive Director from office for good cause shown;</text></subparagraph> 
<subparagraph id="HE56F51ABCB4742209797587E687C2D00"><enum>(D)</enum><text>provide to the Executive Director such resources as are necessary to carry out the duties of the Executive Director; and</text></subparagraph> 
<subparagraph id="H9E3EA03455A24BAEB88E87441B005C55"><enum>(E)</enum><text>take such other actions as may be necessary to carry out the functions of the Board.</text></subparagraph></paragraph> 
<paragraph id="HF4AF7390F5E04FC388EAA953F3006C08"><enum>(2)</enum><header>Meetings</header><text>The Board shall meet—</text> 
<subparagraph id="H7EB85226872F4375BD491FBB338E1583"><enum>(A)</enum><text>not less than once during each month; and</text></subparagraph> 
<subparagraph id="H65206EFFFD914152AA97E60D4B350C3"><enum>(B)</enum><text>at additional times at the call of the Chairman.</text></subparagraph></paragraph> 
<paragraph id="H968D4266BD7F4FFAA361417D00E9FBBD"><enum>(3)</enum><header>Exercise of powers</header> 
<subparagraph id="HD164BE31C4C743C586368BE61CAD3FCF"><enum>(A)</enum><header>In general</header><text>Except as provided in paragraph (1)(C), the Board shall perform the functions and exercise the powers of the Board on a majority vote of a quorum of the Board. Three members of the Board shall constitute a quorum for the transaction of business.</text></subparagraph> 
<subparagraph id="H6256F109F1C24C07909EA930000042B8"><enum>(B)</enum><header>Vacancies</header><text>A vacancy on the Board shall not impair the authority of a quorum of the Board to perform the functions and exercise the powers of the Board.</text></subparagraph></paragraph> 
<paragraph id="HFD148A9E7E9F428B9102CC13009F3D78"><enum>(4)</enum><header>Limitations on investments</header><text>The Board may not direct any person to invest or to cause to be invested any sums in the Tier II Investment Fund or any Tier III investment account in a specific asset or to dispose of or cause to be disposed of any specific asset of such Fund or any such account.</text></paragraph></subsection> 
<subsection id="HE7B4D412D60E4F8AB6B0005B2927C08E"><enum>(h)</enum><header>Compensation</header><text></text> 
<paragraph id="H8332B7006F684E08B0304579008BCC3E"><enum>(1)</enum><header>In general</header><text>Each member of the Board who is not an officer or employee of the Federal Government shall be compensated at the daily rate of basic pay for level IV of the Executive Schedule for each day during which such member is engaged in performing a function of the Board.</text></paragraph> 
<paragraph id="HDF27FD02702A4301849336BB1DF774C4"><enum>(2)</enum><header>Expenses</header><text>A member of the Board shall be paid travel, per diem, and other necessary expenses under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while traveling away from such member's home or regular place of business in the performance of the duties of the Board.</text></paragraph> 
<paragraph id="H01DFBF1B778B4D738076A19900AE56D9"><enum>(3)</enum><header>Source of funds</header><text>Payments authorized under this subsection shall be paid from the Tier I Investment Fund or the Tier II Investment Fund, as determined appropriate by the Board.</text></paragraph></subsection> 
<subsection id="H672A659B1EA340C29B49BD84B6A4BFD0"><enum>(i)</enum><header>Discharge of responsibilities</header><text>The members of the Board shall discharge their responsibilities solely in the interest of the participants and their beneficiaries under this part.</text></subsection> 
<subsection id="HC74069225E9A4115A7184B7F8EE378F5"><enum>(j)</enum><header>Annual independent audit</header><text>The Board shall annually engage an independent qualified public accountant to audit the activities of the Board.</text></subsection> 
<subsection id="HF0649132D96A44B6836E7F10DE817B51"><enum>(k)</enum><header>Submission of budget to Congress</header><text>The Board shall prepare and submit to the President, and, at the same time, to the appropriate committees of Congress, an annual budget of the expenses and other items relating to the Board which shall be included as a separate item in the budget required to be transmitted to Congress under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="HEF90E177676A4D998B2F163B77899238"><enum>(l)</enum><header>Submission of legislative recommendations</header><text>The Board may submit to the President, and, at the same time, shall submit to each House of Congress, any legislative recommendations of the Board relating to any of its functions under this part or any other provision of law.</text></subsection></section> 
<section id="HB6DE35A5AA484DB6A93228B9664E43CB"><enum>262.</enum><header>Executive Director of the Individual Investment Board</header> 
<subsection id="HA4263E35F5D1429B9DF72C8423389900"><enum>(a)</enum><header>Appointment of Executive Director</header><text>The Board shall appoint, without regard to the provisions of law governing appointments in the competitive service, an Executive Director by action agreed to by a majority of the members of the Board.</text></subsection> 
<subsection id="H7532145B8C834844B6DA31A83592877F"><enum>(b)</enum><header>Duties</header><text>The Executive Director shall, as determined appropriate by the Board—</text> 
<paragraph id="H525E4529924D4B0384C2A1E33D398917"><enum>(1)</enum><text>carry out the policies established by the Board;</text></paragraph> 
<paragraph id="H6F7CE8C6FF76461E944DCEAC9B938B0"><enum>(2)</enum><text>invest and manage the Tier I Investment Fund and the Tier II Investment Fund in accordance with the investment policies and other policies established by the Board;</text></paragraph> 
<paragraph id="H4A1C2DE27DA942D4901821B165E3E1C6"><enum>(3)</enum><text>administer the provisions of this part relating to the Tier I Investment Fund and the Tier II Investment Fund; and</text></paragraph> 
<paragraph id="H9FAE571DEAD547528648216E84396CDE"><enum>(4)</enum><text>prescribe such regulations (other than regulations relating to fiduciary responsibilities) as may be necessary for the administration of this part relating to the Tier I Investment Fund and the Tier II Investment Fund.</text></paragraph></subsection> 
<subsection id="HF76E7BBAC8A442F8B28671C664A6DC03"><enum>(c)</enum><header>Administrative authority</header><text>The Executive Director may, within the scope of the duties of the Executive Director as determined by the Board—</text> 
<paragraph id="HCCEE3029D54141E789008EDAFB5398DC"><enum>(1)</enum><text>appoint such personnel as may be necessary to carry out the provisions of this part relating to the Tier I Investment Fund and the Tier II Investment Fund;</text></paragraph> 
<paragraph id="HFDA99E6C3B784F019BA5009B1DBA1BB1"><enum>(2)</enum><text>subject to approval by the Board, procure the services of experts and consultants under <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code;</text></paragraph> 
<paragraph id="H7CE2E9948DDA461DB970084C3EC552BE"><enum>(3)</enum><text>secure directly from an Executive agency, the United States Postal Service, or the Postal Rate Commission any information necessary to carry out the provisions of this part and the policies of the Board relating to the Tier I Investment Fund and the Tier II Investment Fund;</text></paragraph> 
<paragraph id="H691107D513E14D538FCDCD9BFB87009F"><enum>(4)</enum><text>make such payments out of sums in the Tier I Investment Fund and the Tier II Investment Fund as the Executive Director determines, in accordance with regulations of the Board, are necessary to carry out the provisions of this part and the policies of the Board;</text></paragraph> 
<paragraph id="H91DDA6C4E54742A5A03B38FC008044FD"><enum>(5)</enum><text>pay the compensation, per diem, and travel expenses of individuals appointed under paragraphs (1), (2), and (6) from the Tier I Investment Fund or the Tier II Investment Fund, in accordance with regulations of the Board;</text></paragraph> 
<paragraph id="HCDCEF585D3E4452DA12CC739CE3C1C08"><enum>(6)</enum><text>accept and use the services of individuals employed intermittently in the Government service and reimburse such individuals for travel expenses, authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United States Code, including per diem as authorized by section 5702 of such title;</text></paragraph> 
<paragraph id="HED5769F5F2E64B359E42E2C29100EE91"><enum>(7)</enum><text>except as otherwise expressly prohibited by law or the policies of the Board, delegate any of the Executive Director's functions to such employees under the Board as the Executive Director may designate and authorize such successive redelegations of such functions to such employees under the Board as the Executive Director may consider to be necessary or appropriate; and</text></paragraph> 
<paragraph id="H51B89F4BADA944F2B89EE8DFF8E6E7E"><enum>(8)</enum><text>take such other actions as are appropriate to carry out the functions of the Executive Director.</text></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0FB8BB49A2F144B08700569F049B65CC"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to wages paid after December 31, 2005, for pay periods ending after such date and self-employment income for taxable years beginning after such date.</text></subsection> 
<subsection id="H9F8ECF5CF39343859201B828171E45FB"><enum>(c)</enum><header>Study regarding treatment of spouses where one spouse is not a participant</header><text>As soon as practicable after the date of the enactment of this Act, the Individual Investment Board shall undertake a study of the appropriate treatment of spouses in cases in which both spouses are not participants in the Individual Social Security Investment Program. The Board shall transmit the results of its study to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate not later than 6 months after the first meeting of the Board. Such results shall include such recommendations for legislative changes as the Board determines appropriate.</text></subsection> 
<subsection id="H12189314E20F4842AFF9E841E9FDCB35" commented="no"><enum>(d)</enum><header>Treatment of noncitizens</header><text>Nothing in the amendments made by this section shall be construed to result in the crediting, for any purpose under part B of title II of the Social Security Act, of any amount based on the wages and self-employment income of any individual who is not a citizen or national of the United States in any case in which such wages and self-employment income would not be credited under part A of such title if section 215(j) of such Act did not apply in the case of such individual.</text></subsection></section> 
<section id="H4D2F20406F3849358694DFAC8D80153F" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Tax treatment of Individual Social Security Investment Program</header> 
<subsection id="H97B5F176AD2A448EB1891F00C590C5F0"><enum>(a)</enum><header>Taxation with respect to elements of the program</header> 
<paragraph id="HDBA72A2F762648AB8500FD2E39B7C736"><enum>(1)</enum><header>In general</header><text>Subchapter F of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to exempt organizations) is amended by adding at the end the following new part:</text> 
<quoted-block id="H7CC456A66D444FFD8EA650C608007977">

<section id="HCC3910A81C1A49F8B549E55837CA0058"><enum>530A.</enum><header>Individual Social Security Investment Program</header> 
<subsection id="H3F5E0FA916F14981B61B2697653F4308"><enum>(a)</enum><header>General Rule</header><text>Any fund created, account established, or annuity under part B of title II of the Social Security Act is exempt from taxation under this subtitle. Notwithstanding the preceding sentence, any such fund or account is subject to the taxes imposed by section 511 (relating to imposition of tax on unrelated business income of charitable, etc. organizations).</text></subsection> 
<subsection id="H3B35104CA20F47EB9924F1205BE8488D"><enum>(b)</enum><header>Recognition bonds</header><text>Gross income shall not include—</text> 
<paragraph id="H8A5D4DC1DAC341B6B6B2AA1EF879DF57"><enum>(1)</enum><text>the value of a recognition bond issued to a participant under section 257(b) of the Social Security Act which is deposited in the Tier II Investment Fund and held for such participant under such section, </text></paragraph> 
<paragraph id="H9D0E03A2BD604EA291CF00FDF549BA1B"><enum>(2)</enum><text display-inline="yes-display-inline">proceeds from the sale of a recognition bond of a participant under section 257(e) of the Social Security Act which are deposited in the Tier II Investment Fund and held for such participant under section 257(b) of such Act, and </text></paragraph> 
<paragraph id="H5C8C286D5049407494805E03814F3BA2"><enum>(3)</enum><text>proceeds from the redemption of a recognition bond of a participant under section 257(d) of the Social Security Act deposited in the Tier II Investment Fund to the credit of such participant’s part B totalization account under part B of title II of such Act. </text></paragraph><continuation-text continuation-text-level="subsection">For purposes of this subsection, the term <term>Tier II Investment Fund</term> has the meaning given such term by section 251(6) of the Social Security Act. </continuation-text></subsection> 
<subsection id="HE1E7DAE35F3B4BD481911EFB877D8764" display-inline="no-display-inline"><enum>(c)</enum><header>Distributions</header><text display-inline="yes-display-inline">A distribution from any fund or account, or any annuity payment, under part B of title II of the Social Security Act shall not be included in the gross income of the distributee or payee.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC4FD77CD13D4437E998600B504CA35BE"><enum>(2)</enum><header>Conforming amendment</header><text>Section 86(d)(1)(A) of such Code is amended by inserting <quote>part A of</quote> after <quote>under</quote>.</text></paragraph> 
<paragraph id="H3CB213803A174781875DBB58E081E9D5"><enum>(3)</enum><header>Clerical amendment</header><text>The table of parts for subchapter F of chapter 1 of such Code is amended by adding after the item relating to part VIII the following new item:</text>

<toc-entry level="part">Part IX. Individual Social Security Investment Program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H25A3ACB73852470681FA97AC6B9F026B"><enum>(4)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to taxable years beginning after December 31, 2005.</text></paragraph></subsection> 
<subsection id="HED81204E4D734ADFBC6586DF9E27258B"><enum>(b)</enum><header>Exclusion of Individual Investment Program participants from insurance benefits</header><text>Section 215 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H5071C91EF0A1434C88037100A6D3BCE9"><enum>(j)</enum><header>Exclusion of Individual Investment Program participants</header> 
<paragraph id="H1B34E5FB168F444F919C49A977AE0042" display-inline="yes-display-inline"><enum>(1)</enum><text>Except as provided in paragraph (3), a participant (as defined in section 251(1)) in the Individual Social Security Investment Program under part B shall not be credited with wages or self-employment income under this part for purposes of determining benefits under the old-age, survivors, and disability insurance program under this part.</text></paragraph> 
<paragraph id="H7714ED13C2C347BFB01879F7F0B16230" indent="up1"><enum>(2)</enum><text>In the case of an individual who becomes a participant under part B pursuant to an election filed under section 259, paragraph (1) shall apply with respect to wages paid in calendar years beginning on or after the effective date of the election and with respect to self-employment income derived in taxable years ending after such date.</text></paragraph> 
<paragraph id="HCCCE4D477C31458E84A6147E00DDCD7D" indent="up1"><enum>(3)</enum> 
<subparagraph id="HC1EE4D4652B74476814BFEB8AAABC157" display-inline="yes-display-inline"><enum>(A)</enum><text>Paragraph (1) shall not apply in connection with the determination of any such participant’s entitlement to disability insurance benefits under section 223(a), the determination of such participant’s primary insurance amount in connection with such entitlement, and the determination during such entitlement of benefits based on such participant’s wages and self-employment income.</text></subparagraph> 
<subparagraph id="HF690F13D27384246B71C00CB6D50AEF3" indent="up1"><enum>(B)</enum><text>In any case in which the first month of such participant’s entitlement to old-age insurance benefits under section 202(a) immediately follows the last month of such participant’s entitlement to disability insurance benefits, during such participant’s entitlement to old-age insurance benefits, such participant’s primary insurance amount shall not be less than the excess of—</text> 
<clause id="H476568C7F5B5400C8CBB98AF362700D3"><enum>(i)</enum><text>such participant’s primary insurance amount, determined as if paragraph (1) did not apply, over</text></clause> 
<clause id="H6FF61009FF0B41EEAAC3242C0DFAC29"><enum>(ii)</enum><text>the monthly payment which would be payable to such participant under a life annuity under section 256(c) commencing with such first month of entitlement and providing for a series of substantially equal annual payments over the life expectancy of the participant.</text></clause></subparagraph></paragraph> 
<paragraph id="H0740C0B876784BA4B7EE5381E1CC91A" indent="up1"><enum>(4)</enum><text>Paragraph (1) shall not apply in connection with the determination of child’s insurance benefits under section 202(d) or mother’s or father’s insurance benefits under section 202(g) based on such participant’s wages and self-employment income.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="H7768990BED2D41E585A76C0591098817" display-inline="no-display-inline"><enum>4.</enum><header>CPI-indexed benefits for Part <enum-in-header>A</enum-in-header> beneficiaries other than disability beneficiaries</header> 
<subsection id="H2202304F030C413B93D93E7E46D324BB"><enum>(a)</enum><header>Computation of bend points</header><text>Section 215(a)(1)(B) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(a)(1)(B)</external-xref>) is amended—</text> 
<paragraph id="H92FD79D2E0964855939534AB2EEC9F67"><enum>(1)</enum><text>by redesignating clause (iii) as clause (vi);</text></paragraph> 
<paragraph id="H45AE0196CB534A34AB94945205AF9E9D"><enum>(2)</enum><text>in clause (ii), by striking <quote>For individuals</quote> and inserting <quote>Subject to clause (iii), for individuals</quote>;</text></paragraph> 
<paragraph id="H611F4CD7807347B7B8BEE663FE15309E"><enum>(3)</enum><text>by inserting after clause (ii) the following new clauses:</text>

<clause id="H67C17C08103A4671999C4F2411C91911" indent="up3"><enum>(iii)</enum><text>For individuals who initially become eligible for old-age insurance benefits, or who die (before becoming eligible for such benefits), in any calendar year after 2013, each of the amounts so established under the preceding provisions of this subparagraph shall be equal to the product derived by multiplying such amount (as determined before the application of this clause) by the quotient derived by dividing—</text> 
<subclause id="H4F2E7A48483741898E81259C38B9FB48"><enum>(I)</enum><text>the applicable change in the CPI for the first of the 2 preceding calendar years, by</text></subclause> 
<subclause id="H984388BF453E44D28C918E5C6EB6A750"><enum>(II)</enum><text>applicable change in the national average wage index for the first of the 2 preceding calendar years.</text></subclause></clause> 
<clause id="H974FF3A98A244FDD9DFB28BC237800CF" indent="up3"><enum>(iv)</enum><text>For purposes of clause (iii)(I), the term <term>applicable change in the CPI</term> for a calendar year means the excess of—</text> 
<subclause id="H7B788B8E58E749FF8552FBD56DF559B"><enum>(I)</enum><text>the arithmetical mean of the Consumer Price Index for Urban Wage Earners and Clerical Workers (issued by the Bureau of Labor Statistics) for the 12 months in such calendar year, over</text></subclause> 
<subclause id="HBABB0578DDEF4D7CBDACF0CB2CDB672"><enum>(II)</enum><text>the arithmetical mean of such Consumer Price Index for the 12 months in calendar year 2012.</text></subclause></clause> 
<clause id="HADB8F1B09FE742F8BB08DC9996CB8CC3" indent="up3"><enum>(v)</enum><text>For purposes of clause (iii)(II), the term <term>applicable change in the national average wage index</term> for a calendar year means the excess of—</text> 
<subclause id="H8A635E087CAB4A4FBE3C0500409122F"><enum>(I)</enum><text>the national average wage index (as defined in section 209(k)(1)) for such calendar year, over</text></subclause> 
<subclause id="H9619F37B910A466E9D1C5495EA67F86C"><enum>(II)</enum><text>the national average wage index (as so defined) for calendar year 2012.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HCE66CA9F176A4AC08400CD5888A1886F"><enum>(4)</enum><text>in clause (vi) (as redesignated), by striking <quote>under clause (ii)</quote> and inserting <quote>under the preceding provisions of this subparagraph</quote>.</text></paragraph></subsection> 
<subsection id="H5E78A4308BF9498B93149422335B1C1C"><enum>(b)</enum><header>Substitution of CPI for national average wage index in computing average indexed monthly earnings</header> 
<paragraph id="HB6AABDF3D481481586944DEEFC03A798"><enum>(1)</enum><header>In general</header><text>Section 215(b)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(b)(3)</external-xref>) is amended—</text> 
<subparagraph id="HD96CC5A0D3E743E081E257E6C8535940"><enum>(A)</enum><text>in subparagraph (A)(ii)(I), by striking <quote>national average wage index (as defined in section 209(k)(1))</quote> and inserting <quote>national average wage index (as defined in section 209(k)(1)) (for determinations of disability insurance benefits and other benefits based on the wages and self-employment income of an individual entitled to disability insurance benefits) or the consumer price index (for determinations of other benefits)</quote>;</text></subparagraph> 
<subparagraph id="H3D6CEE5C972C4F1D8364B3FCE7CEE300"><enum>(B)</enum><text>in subparagraph (A)(ii)(II), by striking <quote>national average wage index (as so defined)</quote> and inserting <quote>national average wage index (as so defined) (for determinations of disability insurance benefits and other benefits based on the wages and self-employment income of an individual entitled to disability insurance benefits) or the consumer price index (for determinations of other benefits)</quote>;</text></subparagraph> 
<subparagraph id="HCF7BCC903F2B4D16B55CA7FF7BE32272"><enum>(C)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></subparagraph> 
<subparagraph id="H046845374D474612ADA4AA02FBFEB7E1"><enum>(D)</enum><text>by inserting after subparagraph (A) the following new subparagraph:</text>

<subparagraph id="H401DF555C0814F7F87ABCB3620A5BF50" indent="up2"><enum>(B)</enum><text>For purposes of this paragraph, the term <term>consumer price index</term> for a calendar year means the arithmetical mean of the Consumer Price Index for Urban Wage Earners and Clerical Workers (issued by the Bureau of Labor Statistics) for the 12 months in such calendar year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H3A359B08717240459D7100E3614C4C1F"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply with respect to the average indexed monthly earnings of individuals attaining age 62, or dying before attaining such age, on or after January 1, 2013. </text></paragraph></subsection></section> 
<section id="HC23BBDFC278540798614508DB43C7B12" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header>Maintenance of adequate balances in the Social Security Trust Funds</header> 
<subsection id="HCA26744481D642229C8518B96990195B"><enum>(a)</enum><header>In general</header><text>Section 201 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="traditional" display-inline="no-display-inline" id="H785E248B9D654C6A80C467B02D75C8F9"> 
<subsection id="HF2D2D0A592AA4F10B9225BA9C58191AD" display-inline="no-display-inline"><enum>(o)</enum><text>In addition to amounts otherwise appropriated under the preceding provisions of this section to the Trust Funds established under this section, there is hereby appropriated for each fiscal year to each of such Trust Funds, from amounts in the general fund of the Treasury not otherwise appropriated, such sums as may be necessary from time to time to maintain the balance ratio (as defined in section 709(b)) of such Trust Fund, for the calendar year commencing during such fiscal year, at not less than 100 percent. The sums to be appropriated under the preceding sentence shall be determined by the Commissioner of Social Security and certified by the Commissioner to each House of the Congress not later than October 1 of such fiscal year. In making such determination and certification, the Commissioner shall use the intermediate actuarial assumptions used by the Board of Trustees of the Trust Funds in its most recent annual report to the Congress prepared pursuant to subsection (c)(2). The Commissioner shall also transmit a copy of any such certification to the Secretary of the Treasury, and upon receipt thereof, such Secretary shall promptly take appropriate actions in accordance with the certification.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9E1D97FB59F3490494D1DE87F3F04B00"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to fiscal years beginning after the date of the enactment of this Act.</text></subsection></section>
