				the range of publicly-supported long-term care programs for which they may be

						</subparagraph><subparagraph id="HCC8E122CDC64496D81CCDF5C62D61B7"><enum>(C)</enum><text>not furnished to
				prevent, diagnose, treat, or cure a medical disease or
				condition.</text>
						</subparagraph></paragraph><after-quoted-block>,</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="HE59D791D5A9E49EDB4E97300EF1B8807" reported-display-style="italic"><enum>(13)</enum><text>by inserting after

				means an approach to providing services (including programs, benefits,
				supports, and technology) under this Act intended to an older individual to
				assist such individual with activities of daily living, in which</text>
						<subparagraph id="H6C501C84AFCC4D039EC7B8BC93B477D0"><enum>(A)</enum><text display-inline="yes-display-inline">such services (including the amount,
				duration, scope, provider, and location of such services) are planned,
				budgeted, and purchased under the direction and control of such
				individual;</text>
						</subparagraph><subparagraph id="HFE5A42FA9ECB47FCB3003C6C00019CA2"><enum>(B)</enum><text>such individual is
				provided with such information and assistance as necessary and appropriate to
				enable such individual to make informed decisions about his or her care
				options;</text>
						</subparagraph><subparagraph id="H8F2A1B298BB442E3B640B1C862D0080"><enum>(C)</enum><text>the needs,
				capabilities, and preferences of such individual with respect to such services,
				and such individual’s ability to direct and control his or her receipt of such
				services, are assessed by the area agency on aging (or other agency designated
				by the area agency on aging);</text>
						</subparagraph><subparagraph id="H24E2B3DEEB03458AB1F082453D79F84D"><enum>(D)</enum><text display-inline="yes-display-inline">based on the assessment made under
				subparagraph (C), the area agency on aging (or other agency designated by the
				area agency on aging) develops together with such individual and his or her
				family, caregiver, or legal representative—</text>
							<clause id="H480777461CF14FED8B27013FDA974FAC"><enum>(i)</enum><text>a
				plan of services for such individual that specifies which services such
				individual will be responsible for directing;</text>
							</clause><clause id="HFA6F108FB7BC4E4793EA7DC064270218"><enum>(ii)</enum><text>a
				determination of the role of family members (and others whose participation is
				sought by such individual) in providing services under such plan; and</text>
							</clause><clause id="HE2ED5F0618AF4EBFA0F33BA201896C4"><enum>(iii)</enum><text>a
				budget for such services; and</text>
							</clause></subparagraph><subparagraph id="H32391BBF47AF44FA9156F7E0EF3DD473"><enum>(E)</enum><text>the area agency on
				aging or State agency provides for oversight of such individual’s self-directed
				receipt of services, including steps to ensure the quality of services provided
				and the appropriate use of funds under this Act.</text>
						</subparagraph></paragraph><paragraph id="HE98A34A02E1E4099944DE74E3C43AC5E"><enum>(45)</enum><text>The term
				<quote>self-neglect</quote> means an adult’s inability, due to physical or
				mental impairment or diminished capacity, to perform essential self-care tasks
				including—</text>
						<subparagraph id="HC2ABEF0CEE194F10B38DB433E26F3BB9"><enum>(A)</enum><text>obtaining
				essential food, clothing, shelter, and medical care;</text>
						</subparagraph><subparagraph id="H625F3233B7124E8E9FB378E61B780024"><enum>(B)</enum><text>obtaining goods
				and services necessary to maintain physical health, mental health, or general
				safety; or</text>
						</subparagraph><subparagraph id="HD63C4090A9EE47BCBFB54FAC00004095"><enum>(C)</enum><text>managing one’s own
				financial affairs.</text>
						</subparagraph></paragraph><after-quoted-block>,
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="H4B393B30DEDF4ABD832F22F0CBADD17C" reported-display-style="italic"><enum>(15)</enum><text>by inserting after

			</paragraph></section><section changed="added" display-inline="no-display-inline" id="H965C75A7A3244604B392BCD1FEB21444" reported-display-style="italic" section-type="subsequent-section"><enum>3.</enum><header>Establishment of
			 administration on aging</header><text display-inline="no-display-inline">Section 201 of the Older Americans Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H9823281430084190B57CC6AE93993BD" style="traditional">
				<subsection id="H83DCFE02E6DC4B07002EF2D6C4988004"><enum>(e)(</enum><paragraph commented="no" display-inline="yes-display-inline" id="H5148B7B7413E415BA0C8C600F06CAFB2"><enum>1)</enum><text>The Assistant Secretary
				may designate within the Administration responsibility for elder abuse
				prevention and services.</text>
					</paragraph><paragraph id="H2C75B5F032BB4279BDE1F373981AC97" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">It shall be the duty of the assistant
				secretary, acting through the person designated with responsibility for elder
				abuse prevention and services, to develop objectives, priorities, policy, and a
				long-term plan for—</text>
						<subparagraph id="H1EE9417810D74EB4A264DEE13851DB05"><enum>(A) </enum><text display-inline="yes-display-inline">carrying out elder justice programs and
				activities relating to—</text>
							<clause id="HFFB50DF58BCE44F6A8BC8800DA00BD82"><enum>(i)</enum><text>elder abuse prevention, detection,
				treatment, and intervention, and response;</text>
							</clause><clause id="HF1989DF749174E3A98965C006D00FA24"><enum>(ii)</enum><text>training of individuals regarding
				the matters described in clause (i); and</text>
							</clause><clause id="H7470CCA59EC7492B90D6601073871B00"><enum>(iii)</enum><text>the improvement of the elder
				justice system in the United States;</text>
							</clause></subparagraph><subparagraph id="H17D81FB23B2F44DE812BB676E4008000"><enum>(B)</enum><text>collecting and disseminating data
				relating to the abuse, neglect, and exploitation of older individuals;</text>
						</subparagraph><subparagraph id="H19B912C9EBBE443286F6D0E207AFEF80"><enum>(C)</enum><text>disseminating information concerning
				best practices regarding, and providing training on, carrying out activities
				related to abuse, neglect, and exploitation of older individuals;</text>
						</subparagraph><subparagraph id="H875A020AF14943F6B1B9705E4004BF6D"><enum>(D)</enum><text>conducting research related to abuse,
				neglect, and exploitation of older individuals;</text>
						</subparagraph><subparagraph id="H9FC5CA48E5A74D4D88CA015EE5F4A8C5"><enum>(E)</enum><text>providing technical assistance to
				States and other eligible entities under title VII;</text>
						</subparagraph><subparagraph id="HB5FEC9A6B5914BCBAB69E5D3F111BB21"><enum>(F)</enum><text>assisting States and other eligible
				entities under title VII to develop strategic plans to better coordinate elder
				justice activities, research, and training; and</text>
						</subparagraph><subparagraph id="H0FD61AB3C3764108A36F8E005427FA36"><enum>(G)</enum><text>promoting collaborative efforts and
				diminishing duplicative efforts in the development and carrying out of elder
				justice programs at the Federal, State, and local
				levels.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				web-based decision supports and enrollment tools and integrated,
				person-centered systems designed to inform older individuals about the full
				range of benefits for which they may be eligible;</text>
								</clause><clause id="H40A8D33BE3834ADFA103F5CAAC755CE"><enum>(ii)</enum><text>utilize strategies to find and
				enroll those with greatest economic need;</text>
								</clause><clause id="HE3D60C4772D24ED99F4CD331E2001384"><enum>(iii)</enum><text>create and support efforts for
				Aging and Disability Resource Centers, and other public and private state and
				community-based organizations, including faith-based organizations, to serve as
				enrollment benefit centers;</text>
								</clause><clause id="HF5FC3FD8A5B64CE5AD00DDD068C9FC9"><enum>(iv)</enum><text>develop and maintain an
				information clearinghouse on best practices and cost-effective methods for
				enrolling limited income older Americans in benefits for which they are
				eligible; and</text>
								</clause><clause id="H946F81128CC440B2ABAF5CCFFF003B5B"><enum>(v)</enum><text>provide, in collaboration with
				Federal partners administering programs, training and technical assistance on
				effective outreach, screening, enrollment and follow-up
				strategies.</text>

				implementation of comprehensive, coordinated systems at Federal, State, and
				local levels for providing long-term care in home and community-based settings,
				in a manner responsive to the needs and preferences of older individuals and
				their family caregivers, the Assistant Secretary shall, consistent with the
				applicable provisions of this title—</text>
						<paragraph id="H495BE5872D89440497B326B4C1649796"><enum>(1)</enum><text>collaborate,
				coordinate, and consult with other Federal agencies and departments responsible
				for formulating and implementing programs, benefits, and services related to
				providing long-term care, and may make grants, contracts, and cooperative
				agreements with funds received from other Federal entities;</text>
						</paragraph><paragraph id="H12E659204C6C4CC3B2D7ACAE04ED133"><enum>(2)</enum><text>conduct research
				and demonstration projects to identify innovative, cost-effective strategies
				for modifying State systems of long-term care to—</text>
							<subparagraph id="H29EFCF515A884AE792F1E0848356B75B"><enum>(A)</enum><text>respond to the
				needs and preferences of older individuals and family caregivers; and</text>
							</subparagraph><subparagraph id="HCD07D6F924F740B388F38B3CF1570396"><enum>(B)</enum><text>target services to
				individuals at risk for institutional placement, to permit such individuals to
				remain in home and community-based care settings;</text>
							</subparagraph></paragraph><paragraph id="H533C33ABF1FC43569B37B313EBA9139D"><enum>(3)</enum><text>establish criteria
				and promote the implementation (through area agencies on aging, service
				providers, and such other entities as the Assistant Secretary determines to be
				appropriate) of evidence-based programs to assist older individuals and their
				family caregivers in learning about and making behavioral changes intended to
				reduce the risk of injury, disease, and disability among older
				individuals;</text>
						</paragraph><paragraph display-inline="no-display-inline" id="HA55E1BBBE5D24AAE86DBC0CBA13BF136"><enum>(4)</enum><text display-inline="yes-display-inline">facilitate, in coordination with the
				Centers for Medicare &amp; Medicaid Services, the provision of long-term care
				in home and community-based settings, including the provision of self-directed
				care models that—</text>
							<subparagraph id="H5815E9CB24584B7B99B7BF44ECAB5D9B"><enum>(A)</enum><text>provide for the
				assessment of the needs and preferences of an individual at risk for
				institutional placement to help such individual avoid unnecessary nursing home
				placement and depletion of income and assets to qualify for Medicaid
				eligibility;</text>
							</subparagraph><subparagraph id="H3364C0EEFA834B87A8009595C16224F8"><enum>(B)</enum><text>respond to the
				needs and preferences of such individual and provide the option for the
				individual (or representative, as appropriate) to direct and control the
				receipt of support services provided;</text>
							</subparagraph><subparagraph id="H18CF2F64AB1E441E97743EF3C5DD395E"><enum>(C)</enum><text>assist an older
				individual (or a representative, as appropriate) develop a plan for long-term
				support, including the selecting, budgeting, and purchasing of home and
				community-based long-term care and supportive services;</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">(for
				purposes of this paragraph, the term <quote>representative</quote> means a
				person appointed by the eligible individual, or legally acting on the
				individual's behalf, to represent or advise the individual in financial or
				service coordination matters);</continuation-text></paragraph><paragraph id="H396E38773F5B4DB08938D912966514CA"><enum>(5)</enum><text>provide for the
				Administration to play a lead role with respect to issues concerning home and
				community-based long-term care, including—</text>
							<subparagraph id="HDF9FCD374C9F4EA0B6D9E6446089ADD3"><enum>(A)</enum><text display-inline="yes-display-inline">directing (as the Secretary or the
				President determines to be appropriate) or otherwise participating in
				departmental and interdepartmental activities concerning long-term care;</text>
							</subparagraph><subparagraph id="H4A9BADC6DD464FDEACA81D7F00FFEE51"><enum>(B)</enum><text>reviewing and
				commenting on departmental rules, regulations, and policies related to
				providing long-term care; and</text>
							</subparagraph><subparagraph id="HF7E6B862BFAE4FD9A6111999094EC6E"><enum>(C)</enum><text>making
				recommendations to the Secretary with respect to home and community-based
				long-term care, including recommendations based on findings made through
				projects conducted under paragraph (2);</text>
							</subparagraph></paragraph><paragraph id="H3DF2A1594DF24AAEBB283153E700E683"><enum>(6)</enum><text>promote, in
				coordination with other appropriate Federal agencies, enhanced awareness by the
				public of the importance of planning in advance for long-term care and the
				availability of information and resources to assist in such planning;</text>
						</paragraph><paragraph display-inline="no-display-inline" id="H896476F515C74F5B863798CE0004E4D"><enum>(7)</enum><text>implement in all
				states Aging and Disability Resource Centers—</text>
							<subparagraph id="H80DB8D8B72824E409B625007F012B856"><enum>(A)</enum><text>to serve as
				visible and trusted sources of information on the full range of long-term care
				options that are available in the community, including both institutional and
				home and community-based care;</text>
							</subparagraph><subparagraph id="HEB5A16FD82DC424DA487F5FCC933B35F"><enum>(B)</enum><text>to provide
				personalized and consumer friendly assistance to empower people to make
				informed decisions about their care options;</text>
							</subparagraph><subparagraph id="H0F6E72C047F24CFD8C139652F5C7EA5D"><enum>(C)</enum><text>to provide
				coordinated and streamlined access to all publicly supported long-term care
				options so that consumers can obtain the care they need though a single intake,
				assessment and eligibility determination process;</text>
							</subparagraph><subparagraph id="HF7270DC8685B4673BA5291DC18F048B8"><enum>(D)</enum><text>to help people to
				plan ahead for their future long-term care needs; and</text>
							</subparagraph><subparagraph id="HF4F62E5C2C2646368641A4CA734BF753"><enum>(E)</enum><text>to assist, in
				coordination with the State Health Insurance Assistance Program, Medicare
				beneficiaries in understanding and accessing the Prescription Drug Coverage and
				preventative health benefits available under the Medicare Modernization
				Act;</text>
							</subparagraph></paragraph><paragraph id="HE361EE061F754E3CB9B2C4D100B9D827"><enum>(8)</enum><text>establish, either
				directly or through grants or contracts, a national technical assistance
				program to assist State agencies, area agencies on aging, and community-based
				service providers funded under this Act in implementing such home and
				community-based long-term care systems including evidence-based
				programs;</text>
						</paragraph><paragraph id="HBAEB05E43132427E8CC67CAE579D8650"><enum>(9)</enum><text>develop, in
				collaboration with the Administrator of the Centers for Medicare &amp; Medicaid
				Services, performance standards and measures for use by States to determine the
				extent to which their systems of long-term care fulfill the objectives
				described in this subsection; and</text>
						</paragraph><paragraph id="H069477F871914301937790481EB6003E"><enum>(10)</enum><text>conduct such
				other activities as the Assistant Secretary determines to be
				appropriate.</text>
						</paragraph></subsection><subsection id="HC7FD01DBCAF4438CBD7100C84FA142F6"><enum>(c)</enum><text display-inline="yes-display-inline">The Assistant Secretary, in consultation
				with the Corporation for National and Community Service, shall—</text>
						<paragraph id="H580C4D308D984C4DAA82A680DA68E1C9"><enum>(1)</enum><text>encourage and
				permit voluntary groups active in supportive services, including youth
				organizations active at the secondary or postsecondary levels, to participate
				and be involved individually or through representative groups, in such programs
				or activities to the maximum extent feasible;</text>
						</paragraph><paragraph id="H0DF590D92BD948F6964FFC69097DA03F"><enum>(2)</enum><text>develop a
				comprehensive strategy for utilizing older individuals to address critical
				local needs of national concern; and</text>
						</paragraph><paragraph id="HE9D6A3C0863B42F7ACCFE8BDC536DCF"><enum>(3)</enum><text display-inline="yes-display-inline">encourage other community capacity building
				initiatives involving older

				organization;</text>
							</paragraph><paragraph id="H1C926C01236047F0B92C059310D654FB"><enum>(2)</enum><text>under which funds
				provided under such grant or contract are used to pay part or all of a cost
				(including an administrative cost) incurred by such recipient to carry out a
				contract or commercial relationship for the benefit of older individuals or
				their family caregivers, whether such relationship is carried out to implement
				a provision of this Act or to conduct activities inherently associated with
				implementing such provision; or</text>
							</paragraph><paragraph id="HC9D96DDFFE75464FADF857941DD0E634"><enum>(3)</enum><text>under which any
				individual, regardless of age or income (including the family caregiver of such
				individual), who seeks to receive 1 or more services pays, at their own private
				expense, to receive such services based on the fair market value of such
				services.</text>
							</paragraph></subsection><subsection id="HBC7F30012CD34005A48B526444651595"><enum>(b)</enum><header>Ensuring
				appropriate use of funds</header><text>An agreement described under subsection
				(a) may not—</text>
							<paragraph id="H71184A8E180C45D4BB653E3E93B509ED"><enum>(1)</enum><text>be made without
				the prior approval of the State agency (or, in the case of a grantee under
				title VI, without the prior recommendation of the Director of the Office for
				American Indian, Alaska Native, and Native Hawaiian Aging and the prior
				approval of the Assistant Secretary);</text>
							</paragraph><paragraph id="H0D838BAB99C64A2CB732E7E24D8F24F5"><enum>(2)</enum><text>directly or
				indirectly provide for, or have the effect of, paying, reimbursing, or
				otherwise compensating an entity under such agreement in an amount that exceeds
				the fair market value of the goods or services furnished by such entity under
				such agreement;</text>
							</paragraph><paragraph id="HEB310ED795F4453BBD396B183595D685"><enum>(3)</enum><text>result in the
				displacement of services otherwise available to an older individual with the
				greatest social need, an older individual with greatest economic need, or an
				older individual who is at risk for institutional placement; or</text>
							</paragraph><paragraph id="H90C437ACCBA04BEF8D56CF33BF9C9E60"><enum>(4)</enum><text>in any other way
				compromise, undermine, or be inconsistent with the objective of serving the
				needs of older individuals, as determined by the Assistant
				Secretary.</text>

				(including information on optimal nutrient intake) through education and

						</subparagraph><subparagraph id="H0F692C32BCFC41938F8102FFD34F3640"><enum>(B)</enum><text>participating in
				any State government activities concerning long-term care, including reviewing
				and commenting on any State rules, regulations, and policies related
				thereto;</text>
						</subparagraph><subparagraph id="HBB6AA851FE2043288B6D01983C85E842"><enum>(C)</enum><text display-inline="yes-display-inline">conducting analyses, making
				recommendations, and implementing programs and strategies to modify the State’s
				system of long-term care to better—</text>
							<clause id="H8F3808AB68E34B099B09F000911659CD"><enum>(i)</enum><text>respond to the
				needs and preferences of older individuals and family caregivers;</text>
							</clause><clause id="HA55DE29C0930401CB54144F233A7E5C"><enum>(ii)</enum><text>facilitate the
				provision of long-term care in home and community-based settings through
				service providers;</text>
							</clause><clause id="HD685CD2DEE7E46E59960BD33007DD8EF"><enum>(iii)</enum><text>target services
				to individuals at risk for institutional placement, to permit such individuals
				to remain in home and community-based care settings; and</text>
							</clause><clause id="H93FB9BFC234D4320844C0099148D2807"><enum>(iv)</enum><text>implement
				(through area agencies on aging, service providers, and such other entities as
				the State determines to be appropriate) evidence-based programs to assist older
				individuals and their family caregivers in learning about and making behavioral
				changes intended to reduce the risk of injury, disease, and disability among
				older individuals; and</text>
							</clause></subparagraph><subparagraph id="H06522BD09AC54CB0A009103898A6D23B"><enum>(D)</enum><text display-inline="yes-display-inline">providing for the availability and
				distribution (through public education campaigns, aging and disability resource
				centers, area agencies on aging, and other appropriate means) of information
				relating to—</text>

								<clause id="HBB90D071AB474F77A315B08F64DF66B4"><enum>(i)</enum><text>respond to the
				needs and preferences of older individuals and family caregivers;</text>
								</clause><clause id="HA17EE43E6F594628990058AB123D19F6"><enum>(ii)</enum><text>facilitate the
				provision, through service providers, of long-term care in home and
				community-based settings; and</text>
								</clause><clause id="HE9E3A39B04FF4945BA095E9EDB005900"><enum>(iii)</enum><text>target services
				to older individuals at risk for institutional placement, to permit such
				individuals to remain in home and community-based care settings;</text>

				the agency or service providers, evidence-based programs to assist older
				individuals and their family caregivers in learning about and making behavioral
				changes intended to reduce the risk of injury, disease, and disability among

							</subparagraph><subparagraph id="HCE6B0441FFE84FB4A383556C8C1DFA2D"><enum>(D)</enum><text>provide for the
				availability and distribution (through public education campaigns, aging and

				in advance for long-term care; and</text>

				older individuals in the planning and service area;</text>
							</subparagraph><subparagraph id="HCD21782200924FB5A9823FD9008C803E" indent="up1"><enum>(B)</enum><text>an analysis of how such change may
				affect such individuals, including such individuals with low incomes, such
				individuals with greatest economic need, minority older individuals, older
				individuals residing in rural areas, and older individuals with limited English
				proficiency;</text>
							</subparagraph><subparagraph id="HFA2E80410FB14EA7863DEE9ECC91B4BC" indent="up1"><enum>(C)</enum><text>an analysis of how the programs,
				policies, and services provided in the planning and service area can be
				improved, and how resource levels can be adjusted, to meet the needs of the
				changing population of older individuals in such area; and</text>
							</subparagraph><subparagraph id="H588DEA7B60C64136A294FE1FBDBC3739" indent="up1"><enum>(D)</enum><text>an analysis of how the change in the
				number of individuals 85 years of age and older is expected to affect the need
				for supportive services.</text>
							</subparagraph></paragraph><paragraph id="HC6CFC1A3F6F04D8B00E6DFC02DECF6E7" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">An area agency on aging, in cooperation
				with government officials, State agencies, tribal organizations, or local
				entities, may make recommendations to government officials in the planning and
				service area and the State, on actions determined by the area agency to build
				the capacity in the planning and service area to meet the needs of older
				individuals for—</text>
							<subparagraph id="H71C851B57E0C402AB3CC9C20318715EA"><enum>(A)</enum><text>health and human services;</text>
							</subparagraph><subparagraph id="HF1A08C40C3AC4F7E85E891FFE9EBA21B"><enum>(B)</enum><text>land use;</text>
							</subparagraph><subparagraph id="HD53520B6D7D34C8BBDCE8278DEA9454"><enum>(C)</enum><text>housing;</text>
							</subparagraph><subparagraph id="H70DE9B45D6354F2B9E80E4F2374C775B"><enum>(D)</enum><text>transportation;</text>
							</subparagraph><subparagraph id="HCFEC3075C0544555AED1D0F26D00799F"><enum>(E)</enum><text>public safety;</text>
							</subparagraph><subparagraph id="H86A7C19D0C9147D294079400F1458210"><enum>(F)</enum><text>workforce and economic
				development;</text>
							</subparagraph><subparagraph id="HA38C9ED342D647DB8315DBFCDB06353E"><enum>(G)</enum><text>recreation;</text>
							</subparagraph><subparagraph id="H2A60ABC3B2C44EF0923B2D30F6FA1EC6"><enum>(H)</enum><text>education;</text>
							</subparagraph><subparagraph id="HD9604AA56AE149C6B0432C067BD84CE"><enum>(I)</enum><text>civic engagement; and</text>
							</subparagraph><subparagraph id="H958D95C2182A444ABB8540643D10463C"><enum>(J)</enum><text>any other service as determined by
				such
				agency.</text>

				the State’s statewide service delivery model, for a change in the number of
				older individuals during the 10-year period following the fiscal year for which
				the plan is submitted.</text>
						</subparagraph><subparagraph id="H939A73FB3BF049DEAE686642966B0006" indent="up1"><enum>(B)</enum><text>Such assessment may include—</text>
							<clause id="HA4C3F3E17F2F48F493DDF0D2E74CC406"><enum>(i)</enum><text>the projected change in the number
				of older individuals in the State;</text>
							</clause><clause id="HBB94F124757E4247AE22773000556749"><enum>(ii)</enum><text>an analysis of how such change may
				affect such individuals, including individuals with low incomes, individuals
				with great economic need, minority older individuals, older individuals
				residing in rural areas, and older individuals with limited English
				proficiency;</text>
							</clause><clause id="H0D9A2F0E725F455B8736F1DCB8920039"><enum>(iii)</enum><text>an analysis of how the programs,
				policies, and services provided by the State can be improved, including
				coordinating with area agencies on aging, and how resource levels can be

				donation of commodities under this

				shall be available only for the purchase by such entities of United States
				agricultural commodities and other foods for their respective nutrition
				projects, subject to paragraph (2).</text>
							</paragraph><paragraph id="HD29791E1053444C58039F8301CF5FD38" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Part or all of the amounts received by an
				entity specified in paragraph (1) may be used to pay a school food authority
				(as referred to under the Richard B. Russell National School Lunch Act (42
				U.S.C.1751 et seq.) to obtain United States agricultural commodities for such
				entity’s nutrition projects, in accordance with an agreement between the entity
				and the school food authority, under which such payments—</text>
								<subparagraph id="HF2AB1592252345728BC54160C14CFF41"><enum>(A)</enum><text>shall cover the cost of such
				commodities; and</text>
								</subparagraph><subparagraph id="H9769BD0FF91F40ACB0405FE6E17847C4"><enum>(B)</enum><text>may cover related expenses incurred by
				the school food authority, including the cost of transporting, distributing,
				processing, storing, and handling such
				commodities.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>,</after-quoted-block></quoted-block>
				</paragraph><paragraph changed="added" id="H5F49C5A003664EF394495E05402286E5" reported-display-style="italic"><enum>(4)</enum><text>in subsection (e) by

			 the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3030c-2">42 U.S.C. 3030c–2</external-xref>) is amended-—</text>

			 program</header><text display-inline="no-display-inline">Section 331 of the
			 Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3030e">42 U.S.C. 3030e</external-xref>) is amended—</text>

			 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3030f">42 U.S.C. 3030f</external-xref>) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="H4ABC2F0AD3B04334AECB9DBCE16D45E3" style="OLC">
				<section id="HBAEADAD6B1154199007922FC09CBBFE0"><enum>336.</enum><header>Program
				authorized</header><text display-inline="no-display-inline">The Assistant
				Secretary shall establish and carry out a program to make grants to States
				under State plans approved under section 307 for the establishment and
				operation of nutrition projects for older individuals which provide, on 5 or
				more days a week (except in a rural area where such frequency is not feasible
				(as defined by the Assistant Secretary by rule) and a lesser frequency is
				approved by the State agency)—</text>
					<paragraph id="HD1F4100E882B492BBCA1005FAADD00C4"><enum>(1)</enum><text>at least 1 home
				delivered meal per day consisting of hot, cold, frozen, dried, canned, fresh,
				or supplemental foods and any additional meals that the recipient of a grant or
				contract under this subpart elects to provide; and</text>
					</paragraph><paragraph id="HEF586CAA9C514539ADF7433632DE8576"><enum>(2)</enum><text>nutrition
				education, nutrition counseling, and other nutrition services as appropriate,
				based on the needs of meal
				recipients.</text>
					</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" id="HD9FDDFB266A24191B92D48EE17AFF644" reported-display-style="italic"><enum>25.</enum><header>Criteria</header><text display-inline="no-display-inline">Section 337 of the Older Americans Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3030g">42 U.S.C. 3030g</external-xref>) is amended to read as follows:</text>

				nutrition assistance under subpart 2 to provide information to homebound
				seniors on how to get an influenza vaccination in their local
				areas.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section changed="added" display-inline="no-display-inline" id="H527C6F2FE4194DC0A1A092D6006962C8" reported-display-style="italic" section-type="subsequent-section"><enum>27.</enum><header>Evaluation of
			 nutrition projects</header>
			<subsection changed="added" id="H0E134FBEB6844B3787FF188F25D427CA" reported-display-style="italic"><enum>(a)</enum><header>Study</header><text>The
			 Assistant Secretary for Aging shall use funds allocated in section 206(g) of
			 the Older Americans Act of 1965 to enter into a contract with the Food and
			 Nutrition Board of the Institute of Medicine, for the purpose of establishing
			 an independent panel of experts that will conduct an evidence-based evaluation
			 of the nutrition projects authorized in such Act. Such study shall, to the
			 extent data are available, include—</text>
				<paragraph changed="added" id="H7CD50D840B674F3BB0FF4FB54DC0F815" reported-display-style="italic"><enum>(1)</enum><text>an evaluation of the
			 effect of nutrition projects authorized by such Act on—</text>
					<subparagraph changed="added" id="H15D5C5034601498D8878A54EE645BCEB" reported-display-style="italic"><enum>(A)</enum><text>health status of
			 participants, including nutritional status,</text>
					</subparagraph><subparagraph changed="added" id="H1B7B68EE31C54C75ABFF51F651E53788" reported-display-style="italic"><enum>(B)</enum><text>prevention of participant
			 hunger and food insecurity, and</text>
					</subparagraph><subparagraph changed="added" id="H4B059616F2304508BA9083BE4E697917" reported-display-style="italic"><enum>(C)</enum><text>ability of participants
			 to remain living independently,</text>
					</subparagraph></paragraph><paragraph changed="added" id="H2F93B28ADD7B4F2AA0B3133814370051" reported-display-style="italic"><enum>(2)</enum><text>a cost-benefit analysis
			 of nutrition projects authorized by such Act, including the potential to affect
			 costs of Federal programs under title XIX of the Social Security Act,
			 and</text>
				</paragraph><paragraph changed="added" id="H97C9E902725442CC847958CD816B5452" reported-display-style="italic"><enum>(3)</enum><text>recommendations for how
			 nutrition projects authorized by such Act may be modified to improve the
			 outcomes described in paragraph (1), including recommendations for improving
			 the nutritional quality of meals and other potential strategies to improve the
			 nutritional status of participants, including vitamin-mineral
			 supplementation.</text>
				</paragraph></subsection><subsection changed="added" id="H77309861FA8E49AF8BB6711E27F74E24" reported-display-style="italic"><enum>(b)</enum><header>Timing</header><text>The
			 Institute of Medicine shall establish an independent panel of experts not later
			 than 90 days after the date of the enactment of this Act. The panel shall
			 submit to the Assistant Secretary the report described in subsection (a) not
			 later than 24 months after the date of the enactment of this Act. The Assistant
			 Secretary shall submit a report on the findings of the evidence-based study
			 described in such subsection to the Committee on Education and the Workforce of
			 the House of Representatives and the Committee on Health, Education, Labor and
			 Pensions of the Senate.</text>
			</subsection></section><section changed="added" display-inline="no-display-inline" id="H755394AD3665430DA1D32F37BA66D74F" reported-display-style="italic" section-type="subsequent-section"><enum>28.</enum><header>Improving indoor air
			 quality in buildings where seniors congregate</header><text display-inline="no-display-inline">Section 361 of the Older Americans Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3030m">42 U.S.C. 3030m</external-xref>) is amended by adding at the end the following:</text>

			 amended—</text>

				as the <quote>Older American Community Service Employment-Based Training
				Act</quote>.</text>
					</section><section id="H40D296E48FF5415297107B00B0ECEE55"><enum>502.</enum><header>Older american
				community service employment-based training program</header>
						<subsection id="HC10E9C56A31543C9B4AB2E697E59ED2"><enum>(a)</enum><text display-inline="yes-display-inline">To foster individual economic
				self-sufficiency and to increase the number of individuals who may enjoy the
				benefits of unsubsidized employment in both the public and private sectors, the
				Secretary of Labor (hereafter in this title referred to as the
				<quote>Secretary</quote>) may establish an older American community service
				employment-based training program to foster and promote useful part-time public
				and private-sector employment-based training opportunities for unemployed
				low-income eligible individuals who have poor employment prospects and to
				provide vital social and human services to communities by providing work
				experience to eligible individuals in public agencies, community-based and
				faith-based organizations.</text>
						</subsection><subsection commented="no" id="H28908CA416894CC3BFCAC4A546000057"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H9F64DDCD8792456B90B233CBD663D3C"><enum>(1)</enum><text>To carry out this title,
				the Secretary may make grants to public and nonprofit agencies and
				organizations, agencies of a State, and tribal organizations to carry out the
				program established under subsection (a). Such grants may provide for the
				payment of costs, as provided in subsection (c), of projects developed by such
				organizations and agencies in cooperation with the Secretary in order to make
				such program effective or to supplement such program. No payment shall be made
				by the Secretary toward the cost of any project established or administered by
				any organization or agency unless the Secretary determines that such
				project—</text>
								<subparagraph commented="no" id="HB8499C348CE140D184171C4915FCACAE" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">shall provide authorized activities only
				for eligible individuals, and that not less than 50 percent of hours worked (in
				the aggregate) shall be in community service employment-based training provided
				by a grantee in a program year;</text>
								</subparagraph><subparagraph commented="no" id="HDADD59FD159E44A5B81CEB30D000CFFE" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H2387041A5B694DCBBC13C0007B22D05F"><enum>(i)</enum><text display-inline="yes-display-inline">shall provide authorized activities for
				eligible individuals in the community in which such individuals reside, or in
				nearby communities, and that not less than 50 percent of hours worked (in the
				aggregate) shall be in community service employment-based training provided by
				a grantee in a program year; or</text>
									</clause><clause commented="no" id="H13F94AEEDDC241918447034EA258BE38" indent="up1"><enum>(ii)</enum><text>if such project is carried out by a
				tribal organization that receives a grant under this subsection or receives
				assistance from a State that receives a grant under this subsection, will
				provide authorized activities, including community service employment-based
				training for such individuals, including those who are Indians residing on an
				Indian reservation, as defined in section 2601(2) of the Energy Policy Act of
				1992 (<external-xref legal-doc="usc" parsable-cite="usc/25/3501">25 U.S.C. 3501(2)</external-xref>);</text>
									</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H8CD1A8E93AA443AF00F6E9A959DBFF69" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">together with all the projects carried out
				under this title in each program year by a grantee, will not provide for
				participation under this title by eligible individuals (in the aggregate) for
				an average period per capita that exceeds 24 months (whether or not
				consecutive) during the period including the program year for which the
				determination under this subparagraph is made and the previous program years in
				which such grantee carried out projects under this title;</text>
								</subparagraph><subparagraph commented="no" id="H43C3404DE1ED4F0E949D319079FEC8E1" indent="up1"><enum>(D)</enum><text>will provide employment-based training
				to eligible individuals in service related to publicly owned and operated
				facilities and projects, or projects sponsored by profitmaking or nonprofit
				organizations (excluding political parties exempt from taxation under section
				501(c)(3) of the Internal Revenue Code of 1986), but excluding projects
				involving the construction, operation, or maintenance of any facility used or
				to be used as a place for sectarian religious instruction or worship;</text>
								</subparagraph><subparagraph commented="no" id="H75A2CB075E9F4E0DA436FC1449E51669" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">will contribute to the general welfare of
				the community, which may include support for children, youth, and
				families;</text>
								</subparagraph><subparagraph commented="no" id="H815CD13D2A5F4B79AEEA43B7A59C2492" indent="up1"><enum>(F)</enum><text>is intended to result in unsubsidized
				employment for eligible individuals after completion of such program;</text>
								</subparagraph><subparagraph commented="no" id="H1635DBD5A0D8498393CA49B98EC1265D" indent="up1"><enum>(G)</enum><clause commented="no" display-inline="yes-display-inline" id="HF3212B324F954D758B1E44CBEF1D7456"><enum>(i)</enum><text>will not reduce the
				number of job opportunities or vacancies that would otherwise be available to
				individuals not participating in such program;</text>
									</clause><clause commented="no" id="HA7FFF6FB4B964DC5899CE3863225B618" indent="up1"><enum>(ii)</enum><text>will not displace currently employed
				workers (including partial displacement, such as a reduction in the hours of
				non-overtime work, wages, or employment benefits);</text>
									</clause><clause commented="no" id="H6565434A04EC46778003618805F96551" indent="up1"><enum>(iii)</enum><text>will not impair existing contracts
				or result in the substitution of Federal funds for other funds in connection
				with work that would otherwise be performed; and</text>
									</clause><clause commented="no" id="H092E7C2190B24D1F8C45F2C0F459295C" indent="up1"><enum>(iv)</enum><text>will not place an eligible individual
				in employment-based training to perform work the same or substantially the same
				work as that performed by any other individual who is on layoff;</text>
									</clause></subparagraph><subparagraph commented="no" id="H0B5B5C3FAC4F4B1382A5BA8278157544" indent="up1"><enum>(H)</enum><text>will coordinate with training and
				other services provided under title I of the Workforce Investment Act,
				including utilizing the One-Stop delivery system to recruit eligible
				individuals to ensure that the maximum number of eligible individuals will have
				an opportunity to participate in the project;</text>
								</subparagraph><subparagraph commented="no" id="H0E1204BB3CCB4FE8BF45A89DE2EB3F04" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">will include such training (such as
				community service employment-based training, work experience, on-the-job
				training, and classroom training) as may be necessary to make the most
				effective use of the skills and talents of those individuals who are
				participating;</text>
								</subparagraph><subparagraph commented="no" id="H438D410EC488498BA229F6AED443E82" indent="up1"><enum>(J)</enum><text>will ensure that safe and healthy
				conditions of the employment-based training facility or other training facility
				will be provided, and will ensure that individuals employed in community
				service and other jobs assisted under this title shall be paid wages that shall
				not be lower than whichever is the highest of—</text>
									<clause commented="no" id="H5E799218B0494C0000C630F82D058D00"><enum>(i)</enum><text>the minimum wage that would be
				applicable to the employee under the Fair Labor Standards Act of 1938, if
				section 6(a)(1) of such Act applied to the participant and if the participant
				were not exempt under section 13 thereof;</text>
									</clause><clause commented="no" id="H3D5EE78BE16D497A9BC58E46E54963CD"><enum>(ii)</enum><text>the State or local minimum wage
				for the most nearly comparable covered employment; or</text>
									</clause><clause commented="no" id="H3EC8BBEE312D4644BAAFC3B66BB14224"><enum>(iii)</enum><text>the prevailing rates of pay for
				individuals employed in similar occupations by the same employer;</text>
									</clause></subparagraph><subparagraph commented="no" id="H9C1773D769A04B7989D076E0C517118E" indent="up1"><enum>(K)</enum><text>will be established or administered
				with the advice of persons competent in the field of service in which job
				training is being provided, and of persons who are knowledgeable about the
				needs of older individuals;</text>
								</subparagraph><subparagraph commented="no" id="HD03B5452066442B995A0A7496A6BF29" indent="up1"><enum>(L)</enum><text>will authorize payment for necessary
				supportive services costs, (including transportation costs) of eligible
				individuals that may be incurred in training in any project funded under this
				title, in accordance with rules issued by the Secretary;</text>
								</subparagraph><subparagraph commented="no" id="H7D56ABB3B2A9456884D854F875A41188" indent="up1"><enum>(M)</enum><text display-inline="yes-display-inline">will ensure that, to the extent feasible,
				such project will serve the needs of minority, limited English-speaking, and
				Indian eligible individuals, and eligible individuals who have the greatest
				economic need, at least in proportion to their numbers in the State and take
				into consideration their rates of poverty and unemployment;</text>
								</subparagraph><subparagraph commented="no" id="HA1C1241504E848C3813F008700A00064" indent="up1"><enum>(N)</enum><clause commented="no" display-inline="yes-display-inline" id="HF4605C16ED4D44319FFA7C50027EDF5E"><enum>(i)</enum><text>will prepare an
				assessment of the participants’ skills and talents and their needs for
				services, except to the extent such project has, for the participant involved,
				recently prepared an assessment of such skills and talents, and such needs,
				pursuant to another employment or training program (such as a program under the
				Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801 et seq.</external-xref>), the Carl D. Perkins
				Vocational and Technical Education Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301 et seq.</external-xref>), or
				part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>));</text>
									</clause><clause commented="no" id="HFBB81E0A8EFD4CD2932815F9F7106300" indent="up1"><enum>(ii)</enum><text>will provide training and employment
				counseling to eligible individuals based on strategies that identify
				appropriate employment objectives and the need for supportive services,
				developed as a result of the assessment and service strategy provided for in
				clause (i), and provide other appropriate information regarding such program;
				and</text>
									</clause><clause commented="no" id="H93215DA0D950428A812E1218E785255" indent="up1"><enum>(iii)</enum><text>will provide counseling to
				participants on their progress in meeting such objectives and satisfying their
				need for supportive services;</text>
									</clause></subparagraph><subparagraph commented="no" id="HF019D4E563F1460A9E9EE073C3A68354" indent="up1"><enum>(O)</enum><text>will provide appropriate services for
				participants through the One-Stop delivery system as established under section
				134(c) of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2864">29 U.S.C. 2864(c)</external-xref>), and will be
				involved in the planning and operations of such system pursuant to a memorandum
				of understanding with the local workforce investment board in accordance with
				section 121(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2841">29 U.S.C. 2841(c)</external-xref>);</text>
								</subparagraph><subparagraph commented="no" id="H1EDD8DB5086B431C97F9DBF1C6104E43" indent="up1"><enum>(P)</enum><text>will post in such project workplace a
				notice, and will make available to each person associated with such project a
				written explanation—</text>
									<clause id="H1A76D8B529FD42AD9516007E9EA555D2"><enum>(i)</enum><text display-inline="yes-display-inline">clarifying the law with respect to
				political activities allowable and unallowable under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/15">chapter 15</external-xref> of title 5,
				United States Code, applicable to the project and to each category of
				individuals associated with such project; and</text>
									</clause><clause id="H7B8AC0293AE74A6A8DAAD32F3539C020"><enum>(ii)</enum><text>containing the address and
				telephone number of the Inspector General of the Department of Labor, to whom
				questions regarding the application of such chapter may be addressed;</text>
									</clause></subparagraph><subparagraph commented="no" id="H912D2C6CA9C54D00B85E23C28B79004D" indent="up1"><enum>(Q)</enum><text>will provide to the Secretary the
				description and information described in—</text>
									<clause id="H76AA4546CD7D402CAB46FC5B659032D9"><enum>(i)</enum><text>paragraph (8), relating to
				coordination with other Federal programs, of section 112(b) of the Workforce
				and Investment Act of 1998; and</text>
									</clause><clause id="H20B140564E2D4315B73413B02100CB62"><enum>(ii)</enum><text>paragraph (14), relating to
				implementation of One-Stop delivery systems, of section 112(b) of the Workforce
				Investment Act of 1998; and</text>
									</clause></subparagraph><subparagraph commented="no" id="H22045C387BC64EDCB87DD56701B1ADDD" indent="up1"><enum>(R)</enum><text>will ensure that entities that carry
				out activities under the project (including State agencies, local entities,
				subgrantees, subcontractors) and affiliates of such entities receive an amount
				of the administrative cost allocation determined by the Secretary to be
				sufficient.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40DA456816E54FC8B8A4D57CA564BEA7" indent="up1"><enum>(2)</enum><text>The Secretary may establish, issue,
				and amend such regulations as may be necessary to effectively carry out this
				title.</text>
							</paragraph><paragraph commented="no" id="HBA33A02FCDC94D3DA9E8689FD5ED00CB" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H6A7CF97019A04374B600BB8C5DBCD2A1"><enum>(A)</enum><text>An assessment and
				service strategy required by paragraph (1) to be prepared for an eligible
				individual shall satisfy any condition for an assessment and service strategy
				or individual employment plan for an adult participant under subtitle B of
				title I of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2811">29 U.S.C. 2811 et seq.</external-xref>), in
				order to determine whether such eligible individual also qualifies for
				intensive or training services described in section 134(d) of such Act (29
				U.S.C. 2864(d)).</text>
								</subparagraph><subparagraph commented="no" id="HD9B55935E68846568DE9F3009C08F762" indent="up1"><enum>(B)</enum><text>An assessment and service strategy or
				individual employment plan prepared under subtitle B of title I of the
				Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2811">29 U.S.C. 2811 et seq.</external-xref>) for an eligible
				individual may be used to comply with the requirement specified in subparagraph
				(A).</text>
								</subparagraph></paragraph></subsection><subsection id="HBAF00B9622CD45F88500DE6255E0A3F0"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H599F84946D894572B5B98EBD4114CDA6"><enum>(1)</enum><text>The Secretary may pay a
				share not to exceed 90 percent of the cost of any project for which a grant is
				made under subsection (b), except that the Secretary may pay all of such cost
				if such project is—</text>
								<subparagraph id="H5A6A1E7993EB4FDBBF008270EA53DA77" indent="up1"><enum>(A)</enum><text>an emergency or disaster project;
				or</text>
								</subparagraph><subparagraph id="H616E81AFE6194AA5A2408C6BC00022A5" indent="up1"><enum>(B)</enum><text>a project located in an economically
				depressed area, as determined by the Secretary in consultation with the
				Secretary of Commerce and the Secretary of Health and Human Services.</text>
								</subparagraph></paragraph><paragraph id="HD71ED8909CEA4CFC8D3BBEC6566B9085" indent="up1"><enum>(2)</enum><text>The non-Federal share shall be in
				cash or in kind. In determining the amount of the non-Federal share, the
				Secretary may attribute fair market value to services and facilities
				contributed from non-Federal sources.</text>
							</paragraph><paragraph id="H0040355B6FDC48F5A299B10DB955783" indent="up1"><enum>(3)</enum><text>Of the amount to be paid under this
				subsection by the Secretary for a project, not to exceed 13.5 percent shall be
				available for any fiscal year to pay the administrative costs of such project,
				except that—</text>
								<subparagraph id="HA7471F1E2A2A487DA7611F3681E92E8D"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary may increase the amount
				available to pay administrative costs to an amount not to exceed 15 percent of
				the cost of such project if the Secretary determines, based on information
				submitted by the grantee under subsection (b), that such increase is necessary
				to carry out such project; and</text>
								</subparagraph><subparagraph id="H8DB6617B371642AA8002C0251F54F7CF"><enum>(B)</enum><text>if the grantee under subsection (b)
				demonstrates to the Secretary that—</text>
									<clause id="HA1E9DF6BD7C14AEE982C3DF6443EB25"><enum>(i)</enum><text>major administrative cost increases
				are being incurred in necessary program components, including liability
				insurance, payments for workers’ compensation, costs associated with achieving
				unsubsidized placement goals, and other operation requirements imposed by the
				Secretary;</text>
									</clause><clause id="HEA1C3C7BFFF944248469756652BCD19C"><enum>(ii)</enum><text>the number of positions in the
				project or the number of minority eligible individuals participating in the
				project will decline if the amount available to pay administrative costs is not
				increased; or</text>
									</clause><clause id="H1F0A7C9FCECC4B30AEDC93E514A70494"><enum>(iii)</enum><text>the size of the project is so
				small that the amount of administrative costs incurred to carry out the project
				necessarily exceeds 13.5 percent of the cost of such project;</text>
									</clause><continuation-text continuation-text-level="subparagraph">the
				Secretary shall increase the amount available for such fiscal year to pay
				administrative costs to an amount not to exceed 15 percent of the cost of such
				project.</continuation-text></subparagraph></paragraph><paragraph id="H9F183D5CF219425A8648B027C8C33700" indent="up1"><enum>(4)</enum><text>Administrative costs are the costs,
				both personnel and non-personnel and both direct and indirect, associated with
				the following:</text>
								<subparagraph id="H54D61F8A7F254C658D9049F8FBCDB3A"><enum>(A)</enum><text>The costs of performing general
				administrative functions and of providing for the coordination of functions,
				such as—</text>
									<clause id="H2A2896A6969444869B23C4B9F0E713B1"><enum>(i)</enum><text>accounting, budgeting, financial,
				cash management and related data processing;</text>
									</clause><clause id="HA02940648B4D4F5DA87172E161D36429"><enum>(ii)</enum><text>quality assurance;</text>
									</clause><clause id="HC69C9DB193024BE4A2CEAABB737A360"><enum>(iii)</enum><text>preparing program plans;</text>
									</clause><clause id="H07D30C68946A4903A8474320FAB418FE"><enum>(iv)</enum><text>procurement and purchasing;</text>
									</clause><clause id="HA1A120D2A8474C708CC538EB18DC53D0"><enum>(v)</enum><text>property management;</text>
									</clause><clause id="H6F4CBFA3F0434DFB9CE07B0074EAA200"><enum>(vi)</enum><text>personnel management, including
				personnel administration, administration of affirmative action plans, and
				training and staff development;</text>
									</clause><clause id="H272D2D4B50B34FAB9329747BD1004031"><enum>(vii)</enum><text>administrative salaries,
				including clerical and other support staff salaries;</text>
									</clause><clause id="H6DBD1C9823F94ED600202DD192B9DAA6"><enum>(viii)</enum><text>payroll functions;</text>
									</clause><clause id="HD54A478A8A2A4AA3B489E9782120CCCA"><enum>(ix)</enum><text>coordinating the resolution of
				findings arising from audits, reviews, investigations, and incident
				reports;</text>
									</clause><clause id="H51D9775BEF0248B482812430204B71C5"><enum>(x)</enum><text>audit;</text>
									</clause><clause id="H0DA57815A4EA497AB32DC6C947DA3700"><enum>(xi)</enum><text>general legal services;</text>
									</clause><clause id="HC64B44F144BF423EB4594B078D1BDFE4"><enum>(xii)</enum><text>developing systems and
				procedures, including information systems, required for administrative
				functions;</text>
									</clause><clause id="HE7E02B0E92BC4F5CA4300635E7799D6F"><enum>(xiii)</enum><text>preparing reports; and</text>
									</clause><clause id="HA5F3B48E71874AA594154C772000F329"><enum>(xiv)</enum><text>other activities necessary for
				the general administration of government funds and associated programs.</text>
									</clause></subparagraph><subparagraph id="H32026C1F03D3442DB845431762A5D050"><enum>(B)</enum><text>The costs of performing oversight and
				monitoring responsibilities.</text>
								</subparagraph><subparagraph id="H9846810C2C694F4400050102962C3DDF"><enum>(C)</enum><text>The costs of goods and services
				required for administrative functions of such program, including goods and
				services such as rental or purchase of equipment, utilities, office supplies,
				postage, and rental and maintenance of office space.</text>
								</subparagraph><subparagraph id="H01FE99D05EF143AE9D7760622BBB81C7"><enum>(D)</enum><text>The travel costs incurred for official
				business in carrying out such program, excluding travel costs related to
				providing services.</text>
								</subparagraph><subparagraph id="HB3DA51984FCF4F45B402141DE8DAE27"><enum>(E)</enum><text>The costs of information systems
				related to personnel, procurement, purchasing, property management, accounting,
				and payroll systems), including the purchase, systems development, and
				operating costs of such systems.</text>
								</subparagraph><subparagraph id="H66C21807186E4E839715AF7665935F8D"><enum>(F)</enum><text>The costs of technical assistance,
				professional organization membership dues, removal of architectural barriers,
				operating and maintaining assistive technology, and evaluating program results
				against stated objectives.</text>
								</subparagraph></paragraph><paragraph id="HE2BA301D21D649F5BF10E9DB37057448" indent="up1"><enum>(5)</enum><text>To the extent practicable, an entity
				that carries out a project under this title shall provide for the payment of
				the expenses described in paragraph (4) from non-Federal sources.</text>
							</paragraph><paragraph id="H2555FDB0D50B46E0BBD3016EFCD4BD3" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0D0DD0D95CEA41DCBEC930C0D8120375"><enum>(A)</enum><text>Amounts made available
				for a project under this title that are not used to pay for the administrative
				costs shall be used to pay for the costs of programmatic activities,
				including—</text>
									<clause id="H6FAA7058F82A4B1EA8C4864D88B5BE00" indent="up1"><enum>(i)</enum><text>participant wages, such benefits as
				are required by law (such as workers compensation or unemployment compensation)
				the costs of physical examinations, compensation for scheduled work hours
				during which an employer is closed for a Federal holiday, and necessary sick
				leave that is not part of an accumulated sick leave program, except that no
				amounts provided under this title may be used to pay the cost of pension
				benefits, annual leave, accumulated sick leave, or bonuses;</text>
									</clause><clause id="H3702974CF6AC4E37BC004987AC302029" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">participant training (including the payment
				of reasonable costs of instructors, classroom rental, training supplies,
				materials, equipment, and tuition) which may be provided prior to or subsequent
				to placement and which may be provided on the job, in a classroom setting or
				pursuant to other appropriate arrangements;</text>
									</clause><clause id="H6E88A1F435FB4D16B99414B25BF97DC" indent="up1"><enum>(iii)</enum><text>job placement assistance, including
				job development and job search assistance;</text>
									</clause><clause id="HFCB6416BBDAB43FB9E7E146E67FF9657" indent="up1"><enum>(iv)</enum><text>participant supportive services to
				enable a participant to successfully participate in a project under this title,
				which may include the payment of reasonable costs of transportation, special
				job-related or personal counseling, incidentals (such as work shoes, badges,
				uniforms, eyeglasses, and tools), child and adult care, temporary shelter, and
				follow-up services; and</text>
									</clause><clause id="H0DDF00A820F44FCDA2BB376B4075BE1E" indent="up1"><enum>(v)</enum><text>outreach, recruitment, and selection,
				intake, orientation, and assessments.</text>
									</clause></subparagraph><subparagraph id="HD2E4EC2016664440AFF5FC7BDBF982CD" indent="up1"><enum>(B)</enum><text>Not less than 65 percent of the funds
				made available under a grant made under this title (excluding a grant made
				under subsection (d)) shall be used to pay wages and benefits for eligible
				individuals who are employed under projects carried out under this
				title.</text>
								</subparagraph></paragraph></subsection><subsection id="H8A38BCAA060E4F8883546E5817371033"><enum>(d)</enum><header>Pilot,
				demonstration, and evaluation projects</header><text display-inline="yes-display-inline">The Secretary shall use funds reserved
				under section 506(a)(1) to carry out demonstration projects, pilot projects,
				and evaluation projects, for the purpose of developing and implementing
				techniques and approaches, and demonstrating the effectiveness of the
				specialized methods, in addressing the employment and training needs of
				eligible individuals. Such projects may include—</text>
							<paragraph id="H09F241C760DA44FC8EB238F14FB6EA88"><enum>(1)</enum><text>activities linking
				businesses and eligible individuals, including assistance to participants
				transitioning from subsidized activities to private-sector employment;
				and</text>
							</paragraph><paragraph id="H6B8C86515EE84D8BB43D6DC86D1FA58E"><enum>(2)</enum><text>demonstration
				projects and pilot projects designed to—</text>
								<subparagraph id="H32D0CB3F608C4FD9A575E677AAA9CCAB"><enum>(A)</enum><text>attract more
				eligible individuals into the labor force;</text>
								</subparagraph><subparagraph id="HE4C1887ECFE2465F895CD69B9DE9FEAC"><enum>(B)</enum><text>improve the
				provision of services to eligible individuals under the One-Stop delivery
				system established in accordance with title I of the Workforce Investment Act
				of 1998;</text>
								</subparagraph><subparagraph id="H88497D2F4D0A487DA35B008B14F3DF4E"><enum>(C)</enum><text>enhance the
				technological skills of eligible individuals; and</text>
								</subparagraph><subparagraph id="H3375169DD6664E7DABF37DFDF0A73050"><enum>(D)</enum><text display-inline="yes-display-inline">provide incentives to grantees under this
				title for exemplary performance and incentives to businesses to promote their
				participation in the program under this title;</text>
								</subparagraph></paragraph><paragraph id="H8D164C66D0AA4128B7E21117000489C5"><enum>(3)</enum><text display-inline="yes-display-inline">demonstration projects and pilot projects,
				as described in paragraph (2), for older workers only if such demonstration
				projects and pilot projects are designed to assist in developing and
				implementing techniques and approaches in addressing the employment and
				training needs of eligible individuals;</text>
							</paragraph><paragraph id="H0593C4F226AA4E5493056CF181EF95D8"><enum>(4)</enum><text>training and
				technical assistance to support any project funded under this title;</text>
							</paragraph><paragraph id="H10D38512867C47B0A8B585F45B5E0812"><enum>(5)</enum><text>dissemination of
				best practices; and</text>
							</paragraph><paragraph id="H1A041D961B5644819BD9300180005AE"><enum>(6)</enum><text>evaluation of the
				activities authorized under this title.</text>
							</paragraph></subsection></section><section id="HD7B1B73B08594FA88457CDE504FD5889"><enum>503.</enum><header>Administration</header>
						<subsection id="H424ED90057EB4B31BC71E787B9B8E3F"><enum>(a)</enum><header>State
				plan</header>
							<paragraph id="HB3DBB0BB61C249168424F915167FAB0"><enum>(1)</enum><header>Chief executive
				officer submits plan</header><text>For a State to be eligible to receive an
				allotment under section, 506, the chief executive officer of the State shall
				submit to the Secretary for consideration and approval, a single State plan
				(referred to in this title as the <quote>State plan</quote>) that outlines a
				3-year strategy for the statewide provision of training and related activities
				for eligible individuals under this title. The plan shall contain such
				provisions as the Secretary may require, consistent with this title, including
				a description of the process used to ensure the participation of individuals
				described in paragraph (2).</text>
							</paragraph><paragraph id="HB3CB4A6C4A4D4C0DA13C88FA96E2E2E4"><enum>(2)</enum><header>Recommendations</header><text>In
				developing the State plan prior to its submission to the Secretary, the chief
				executive officer of the State shall seek the advice and recommendations
				of—</text>
								<subparagraph id="H2977B100A924411A97F56C38A00B87E"><enum>(A)</enum><text>individuals
				representing the State agency and the area agencies on aging in the State, and
				the State and local workforce investment boards established under title I of
				the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801 et seq.</external-xref>);</text>
								</subparagraph><subparagraph id="HB9C51FCA2C424BE88F1746731F093FD5"><enum>(B)</enum><text>individuals
				representing public and nonprofit private agencies and organizations providing
				employment services, including each grantee operating a project under this
				title in the State; and</text>
								</subparagraph><subparagraph id="H2283C4BB331447E49EB773B8E331801B"><enum>(C)</enum><text>individuals
				representing social service organizations providing services to older
				individuals, grantees under title III of this Act, affected communities,
				unemployed older individuals, community-based organizations serving the needs
				of older individuals, business organizations, and labor organizations.</text>
								</subparagraph></paragraph><paragraph id="H3522EBBD0A6643BD8532A284E4431BD9"><enum>(3)</enum><header>Comments</header><text>Any
				State plan submitted by the chief executive officer in accordance with
				paragraph (1) shall be accompanied by copies of public comments relating to the
				plan received pursuant to paragraph (4) and a summary thereof.</text>
							</paragraph><paragraph id="H20B601564A594BCF8DD59F174F3D6275"><enum>(4)</enum><header>Plan
				provisions</header><text>The State plan shall identify and address—</text>
								<subparagraph id="H3D7B760C44454FE9AFFA62B22535FBAF"><enum>(A)</enum><text>the relationship
				that the number of eligible individuals in each area bears to the total number
				of eligible individuals, respectively, in the State;</text>
								</subparagraph><subparagraph id="H577F8D9C088742BABB06C6CBDC932DB9"><enum>(B)</enum><text>the relative
				distribution of eligible individuals residing in rural and urban areas in the
				State; and</text>
								</subparagraph><subparagraph id="H09E3C1072EA74AABB0122ECE28D8B124"><enum>(C)</enum><text>the relative
				distribution of—</text>
									<clause id="HD4B3A49EF5F1499188002D48BAA07E8C"><enum>(i)</enum><text>eligible
				individuals who are individuals with greatest economic need;</text>
									</clause><clause id="HCB8F40BBF1F54BCB828FA0BEFEADD98D"><enum>(ii)</enum><text>eligible
				individuals who are minority individuals, including individuals who are limited
				English proficient; and</text>
									</clause><clause id="HBACD99234F34451000ECE7185057D9EF"><enum>(iii)</enum><text>eligible
				individuals who are individuals with greatest social need;</text>
									</clause></subparagraph><subparagraph id="H2EABF7C64DCA4BD7BABAC05C79A95455"><enum>(D)</enum><text>the current and
				projected employment opportunities in the State, by occupation, and the type of
				skills possessed by local eligible individuals;</text>
								</subparagraph><subparagraph id="H96D035C9191A4B11BB75F04076489CD6"><enum>(E)</enum><text>the localities and
				populations for which projects of the type authorized by this title are most
				needed; and</text>
								</subparagraph><subparagraph id="H1B2F7BFC2F4C4002B136F9765B42E5B5"><enum>(F)</enum><text>plans for
				facilitating the coordination of activities of grantees in the State under this
				title with activities carried out in the State under title I of the Workforce
				Investment Act of 1998.</text>
								</subparagraph></paragraph><paragraph id="H19471C1FD27748F1A299699ED8AD45E4"><enum>(5)</enum><header>Chief executive
				officer’s recommendations on grant proposals</header><text>Before a proposal
				for a grant under this title for any fiscal year is submitted to the Secretary,
				the chief executive officer of each State in which projects are proposed to be
				conducted under such grant shall be afforded a reasonable opportunity to submit
				recommendations to the Secretary—</text>
								<subparagraph id="HB27F18A7F3574D4B9D08805EEBAEB3C9"><enum>(A)</enum><text>regarding the
				anticipated effect of each such proposal upon the overall distribution of
				enrollment positions under this title in the State (including such distribution
				among urban and rural areas), taking into account the total number of positions
				to be provided by all grantees in the State;</text>
								</subparagraph><subparagraph id="HD95BB88AC664421800007DAEBBFFDC9"><enum>(B)</enum><text>any recommendations
				for redistribution of positions to under served areas as vacancies occur in
				previously encumbered positions in other areas; and</text>
								</subparagraph><subparagraph id="HCABF6F12F1794C66BE0026D6EBF579EF"><enum>(C)</enum><text>in the case of any
				increase in funding that may be available for use in the State under this title
				for any fiscal year, any recommendations for distribution of newly available
				positions in excess of those available during the preceding year to underserved
				areas.</text>
								</subparagraph></paragraph><paragraph id="H87BA4F72A013456A8B20A55E2F852162"><enum>(6)</enum><header>Disruptions</header><text>In
				developing plans and considering recommendations under this subsection,
				disruptions in the provision of services for current participants shall be
				avoided to the greatest possible extent.</text>
							</paragraph><paragraph id="HE92F804C513A4E97005CCABE00DB4142"><enum>(7)</enum><header>Determination;
				review</header>
								<subparagraph id="HCF10626B00C34849B5F4329358DBB493"><enum>(A)</enum><header>Determination</header><text>In
				order to effectively carry out this title, each State shall make the State plan
				available for public comment. The Secretary, in consultation with the Assistant
				Secretary, shall review the plan and make a written determination with findings
				and a decision regarding the plan.</text>
								</subparagraph><subparagraph id="HE986C6FC246B4946B4B7E6476C7BEF54"><enum>(B)</enum><header>Review</header><text>The
				Secretary may review, on the Secretary’s own initiative or at the request of
				any public or private agency or organization or of any agency of the State, the
				distribution of projects and services under this title in the State including
				the distribution between urban and rural areas in the State. For each proposed
				reallocation of projects or services in a State, the Secretary shall give
				notice and opportunity for public comment.</text>
								</subparagraph></paragraph><paragraph id="HC036045242E242089DD7FF794D1C97A1"><enum>(8)</enum><header>Exemption</header><text>The
				grantees that serve eligible individuals who are older Indians with funds
				reserved under section 506(a)(3) may not be required to participate in the
				State planning processes described in this section but will collaborate with
				the Secretary to develop a plan for projects and services to eligible
				individuals who are Indians.</text>
							</paragraph></subsection><subsection id="HB8B171DAD2FB44F6B23810B8A1BF83D"><enum>(b)</enum><header>Coordination with
				other federal programs</header>
							<paragraph id="H7EF15E4DA5B84E1AAAE7A7CB17F9DE79"><enum>(1)</enum><text>The Secretary and
				the Assistant Secretary shall coordinate the program carried out under this
				title with programs carried out under other titles of this Act, to increase job
				opportunities available to older individuals.</text>
							</paragraph><paragraph id="HEB6A197A11F644C983FBD8232F650061"><enum>(2)</enum><text>The Secretary
				shall coordinate programs carried out under this title with the program carried
				out under the Workforce Investment Act of 1998, the Community Services Block
				Grant Act, the Rehabilitation Act of 1973, the Carl D. Perkins Vocational and
				Technical Education Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301 et seq.</external-xref>), the National and
				Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12501">42 U.S.C. 12501 et seq.</external-xref>), and the Domestic
				Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4950">42 U.S.C. 4950 et seq.</external-xref>). The Secretary shall
				coordinate the administration of this title with the administration of other
				titles of this Act by the Assistant Secretary to increase the likelihood that
				eligible individuals for whom employment opportunities under this title are
				available and who need services under such titles receive such services. Funds
				appropriated to carry out this title may not be used to carry out any program
				under the Workforce Investment Act of 1998, the Community Services Block Grant
				Act, the Rehabilitation Act of 1973, the Carl D. Perkins Vocational and
				Technical Education Act of 1998, the National and Community Service Act of
				1990, or the Domestic Volunteer Service Act of 1973. The preceding sentence
				shall not be construed to prohibit carrying out projects under this title
				jointly with programs, projects, or activities under any Act specified in such
				sentence, or from carrying out section 512.</text>
							</paragraph><paragraph id="HA9A10AFF300B4D99A181F89EADDD93F4"><enum>(3)</enum><text>The Secretary
				shall distribute to grantees under this title, for distribution to program
				participants, and at no cost to grantees or participants, informational
				materials developed and supplied by the Equal Employment Opportunity Commission
				and other appropriate Federal agencies that the Secretary determines are
				designed to help participants identify age discrimination and to understand
				their rights under the Age Discrimination in Employment Act of 1967.</text>
							</paragraph></subsection><subsection id="H8BADEFE937D74C83A0EFB3406000ACFA"><enum>(c)</enum><text>In carrying out
				this title, the Secretary may use, with their consent, the services, equipment,
				personnel, and facilities of Federal and other agencies with or without
				reimbursement, and on a similar basis to cooperate with other public and
				private agencies and instrumentalities in the use of services, equipment, and
				facilities.</text>
						</subsection><subsection id="HF498902C152345AB8BCEB6B47243D4ED"><enum>(d)</enum><text>Payments under
				this title may be made in advance or by way of reimbursement and in such
				installments as the Secretary may determine.</text>
						</subsection><subsection id="H1E3A6E3D0F87461688FF74BF728E4919"><enum>(e)</enum><text>The Secretary
				shall not delegate any function of the Secretary under this title to any other
				Federal officer or entity.</text>
						</subsection><subsection id="H337F8221A33943C4A1337690D92F111E"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF0ED08DAF1954B79B37C476627128DCE"><enum>(1)</enum><text>The Secretary shall
				monitor projects for which grants are made under this title to determine
				whether the grantees are complying with rules and regulations issued to carry
				out this title (including the statewide planning, consultation, and
				coordination requirements of this title).</text>
							</paragraph><paragraph id="H8A2C3657654C4B3191778D178BCB0662" indent="up1"><enum>(2)</enum><text>Each grantee that receives funds
				under this title shall comply with the applicable uniform cost principles and
				appropriate administrative requirements for grants and contracts that are
				applicable to the type of entity that receives funds, as issued as circulars or
				rules of the Office of Management and Budget.</text>
							</paragraph><paragraph id="H90807C838F1A43AD978C73005388AC37" indent="up1"><enum>(3)</enum><text>Each grantee described in paragraph
				(2) shall prepare and submit a report in such manner and containing such
				information as the Secretary may require regarding activities carried out under
				this title.</text>
							</paragraph><paragraph id="H5D2EB51B5E4C4AB69BC4B013009155D5" indent="up1"><enum>(4)</enum><text>Each grantee described in paragraph
				(2) shall keep records that—</text>
								<subparagraph id="H04DF6E405F9941BD93E5568F33176B20"><enum>(A)</enum><text>are sufficient to permit the
				preparation of reports required by this title;</text>
								</subparagraph><subparagraph id="H780C31B3B9394BB7923FBCA8C45FE705"><enum>(B)</enum><text>are sufficient to permit the tracing
				of funds to a level of expenditure adequate to ensure that the funds have not
				been spent unlawfully; and</text>
								</subparagraph><subparagraph id="H4910A9C7322D43DC947C79A72B1EA9D"><enum>(C)</enum><text>contain any other information that the
				Secretary determines to be appropriate.</text>
								</subparagraph></paragraph></subsection><subsection id="HFAD2EF6C4B1945878D0073BB90BE04A9"><enum>(g)</enum><text>The Secretary
				shall establish by rule and implement a process to evaluate, in accordance with
				section 513, the performance of projects and services carried out under this
				title. The Secretary shall report to the Congress, and make available to the
				public, the results of each such evaluation and shall use such evaluation to
				improve services delivered by, or the operation of, projects carried out under
				this title.</text>
						</subsection></section><section id="H6F4BDB23D53B4D79B9D7704C22E94F9"><enum>504.</enum><header>Participants not
				federal employees</header>
						<subsection id="HFAF262DBE5C0457591885E846BA04DF6"><enum>(a)</enum><text>Eligible
				individuals who are participants in authorized activities in any project funded
				under this title shall not be considered to be Federal employees as a result of
				such participation and shall not be subject to part III of title 5, United
				States Code.</text>
						</subsection><subsection id="H9100CCA8E6A0410DB8E0490498B11C31"><enum>(b)</enum><text>No grant,
				subgrant, contract or subcontract shall be entered into under this title with
				an entity who is, or whose employees are, under State law, exempted from
				operation of the State workers’ compensation law, generally applicable to
				employees unless the entity shall undertake to provide either through insurance
				by a recognized carrier or by self-insurance, as authorized by State law, that
				the persons employed under the grant, contract, subgrant, or subcontract shall
				enjoy workers’ compensation coverage equal to that provided by law for covered
				employment.</text>
						</subsection></section><section id="HDB5A84A379394B3CBDA4C004D5798CFC"><enum>505.</enum><header>Interagency
				cooperation</header>
						<subsection id="HD3C178B6804145A8AE1782C715713881"><enum>(a)</enum><text>The Secretary
				shall consult with and obtain the written views of the Assistant Secretary
				before issuing rules and before establishing general policy in the
				administration of this title.</text>
						</subsection><subsection id="H614B47A7025F4DE9BF00D85650EA335C"><enum>(b)</enum><text>The Secretary
				shall consult and cooperate with the Director of the Office of Community
				Services, the Secretary of Health and Human Services, and the heads of other
				Federal agencies that carry out related programs, in order to achieve optimal
				coordination with such other programs. In carrying out this section, the
				Secretary shall promote programs or projects of a similar nature. Each Federal
				agency shall cooperate with the Secretary in disseminating information relating
				to the availability of assistance under this title and in promoting the
				identification and interests of individuals eligible for employment in projects
				assisted under this title.</text>
						</subsection><subsection id="HA2B345965B804977AB813810A47316BC"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HC496F66A3383446D9D28BBFE0AE226B"><enum>(1)</enum><text>The Secretary shall
				promote and coordinate carrying out projects under this title jointly with
				programs, projects, or activities carried out under other Acts, especially
				activities provided under the Workforce Investment Act of 1998 (29 U.S.C. 2801
				et seq.), including activities provided through One-Stop delivery systems
				established under section 134(c)) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2864">29 U.S.C. 2864(c)</external-xref>), that provide
				training and employment opportunities to eligible individuals.</text>
							</paragraph><paragraph id="HEC35F538F63F42019C32425646E582AC" indent="up1"><enum>(2)</enum><text>The Secretary shall consult with the
				Secretary of Education to promote and coordinate carrying out projects under
				this title jointly with workforce investment activities in which eligible
				individuals may participate that are carried out under the Carl D. Perkins
				Vocational and Technical Education Act of 1998.</text>
							</paragraph></subsection></section><section id="HA756C78EFE224AE7843CEE008299D53D"><enum>506.</enum><header>Distribution of
				assistance</header>
						<subsection id="H91C1217DEF2C48DCB0274E80CB98DA39"><enum>(a)</enum><header>Reservations</header>
							<paragraph id="HEC8F2052FA944B7AA76BE3EC6E9F9312"><enum>(1)</enum><header>Reservation for
				national activities</header><text>Of the funds appropriated to carry out this
				title for each fiscal year, the Secretary may first reserve up to 1.5 percent
				to carry out demonstration projects, pilot projects, and evaluation projects
				under section 502(d).</text>
							</paragraph><paragraph id="H486229BEC62E47D4B624FEC59B05FB7C"><enum>(2)</enum><header>Reservation for
				territories</header><text display-inline="yes-display-inline">Of the funds
				appropriated to carry out this title for each fiscal year, the Secretary shall
				reserve up to 0.75 percent, of which—</text>
								<subparagraph id="H0DEE90EC341F48BEB1B6C9F6B6616422"><enum>(A)</enum><text>Guam, American
				Samoa, and the United States Virgin Islands shall each receive 30 percent of
				the funds so reserved; and</text>
								</subparagraph><subparagraph id="HAD8D1BB7CC8842D6BA9000527FBC1FE1"><enum>(B)</enum><text>the Commonwealth
				of the Northern Mariana Islands shall receive 10 percent of the funds so
				reserved.</text>
								</subparagraph></paragraph><paragraph id="H1F37BCEB4580453EAA00382189C5EEBB"><enum>(3)</enum><header>Reservation for
				organizations</header><text display-inline="yes-display-inline">Of the funds
				appropriated to carry out this title for each fiscal year, the Secretary shall
				reserve such amount as may be necessary to make national grants to public or
				nonprofit national Indian aging organizations with the ability to provide
				authorized activities for eligible individuals who are Indians and to national
				public or nonprofit Pacific Island and Asian American aging organizations with
				the ability to provide authorized activities for eligible individuals who are
				Pacific Island and Asian Americans.</text>
							</paragraph></subsection><subsection id="HBE1139A0CBD84360AE4818576D1E932B"><enum>(b)</enum><header>State
				allotments</header><text>The allotment for each State shall be the sum of the
				amounts allotted for national grants in such State under subsection (d) and for
				the grant to such State under subsection (e).</text>
						</subsection><subsection id="H224AF8A97831424BBB3601F91C432D5C"><enum>(c)</enum><header>Division between
				national grants and grants to states</header><text>The funds appropriated to
				carry out this title for any fiscal year that remain after amounts are reserved
				under paragraphs (1), (2), and (3) of subsection (a), shall be divided by the
				Secretary between national grants and grants to States as follows:</text>
							<paragraph id="H4D30F7811F444C91B44D1400CD17B97B"><enum>(1)</enum><header>Reservation of
				funds for fiscal year 2006 level of activities</header>
								<subparagraph id="H4327867177774CBBBB8DA1E88CF79DCE"><enum>(A)</enum><text>The Secretary
				shall reserve the amount of funds necessary to maintain the fiscal year 2006
				level of activities supported by grantees that operate under this title under
				national grants from the Secretary, and the fiscal year 2006 level of
				activities supported by State grantees under this title, in proportion to their
				respective fiscal year 2006 levels of activities.</text>
								</subparagraph><subparagraph id="H1646CEB0F30446528D24AE7219A8FD71"><enum>(B)</enum><text>If in any fiscal
				year for which the funds appropriated to carry out this title are insufficient
				to satisfy the requirement specified in subparagraph (A), then the amount
				described in subparagraph (A) shall be reduced proportionally.</text>
								</subparagraph></paragraph><paragraph id="HC31AC38BE7B243E7852BA961E74FA00"><enum>(2)</enum><header>Funding in excess
				of fiscal year 2006 level of activities</header>
								<subparagraph id="H712738D32BCF4347B2D26C2000FF498E"><enum>(A)</enum><header>Up to
				$35,000,000</header><text>The amount of funds remaining after the application
				of paragraph (1), but not to exceed $35,000,000, shall be divided so that 75
				percent shall be provided to State grantees and 25 percent shall be provided to
				grantees that operate under this title under national grants from the
				Secretary.</text>
								</subparagraph><subparagraph id="H5B2D7CC4A6B740359F3B7DB53205CD83"><enum>(B)</enum><header>Over
				$35,000,000</header><text>The amount of funds remaining (if any) after the
				application of subparagraph (A) shall be divided so that 50 percent shall be
				provided to State grantees and 50 percent shall be provided to grantees that
				operate under this title under national grants from the Secretary.</text>
								</subparagraph></paragraph></subsection><subsection id="H6B15E584411740B9985CEC02C4F41598"><enum>(d)</enum><header>Allotments for
				national grants</header><text display-inline="yes-display-inline">From funds
				available under subsection (c) for national grants, the Secretary shall allot
				for public and nonprofit private agency and organization grantees that operate
				under this title under national grants from the Secretary in each State, an
				amount that bears the same ratio to such funds as the product of the number of
				individuals 55 years of age or older in the State and the allotment percentage
				of such State bears to the sum of the corresponding products for all States,
				except as follows:</text>
							<paragraph id="HE9934E4B153B4AC49599BB1D68F82C9F"><enum>(1)</enum><header>Minimum
				allotment</header><text display-inline="yes-display-inline">No State shall be
				provided an amount under this subsection that is less than ½ of 1 percent of
				the amount provided under subsection (c) for public and nonprofit private
				agency and organization grantees that operate under this title under national
				grants from the Secretary in all of the States.</text>
							</paragraph><paragraph id="H0179B9596A084966A1E961F5059069C"><enum>(2)</enum><header>Hold
				harmless</header><text>If the amount provided under subsection (c) is—</text>
								<subparagraph id="H28E7F1B4A28342D69192ABEC847150FD"><enum>(A)</enum><text>equal to or less
				than the amount necessary to maintain the fiscal year 2006 level of activities,
				allotments for grantees that operate under this title under national grants
				from the Secretary in each State shall be proportional to their fiscal year
				2006 level of activities; or</text>
								</subparagraph><subparagraph id="H91F366A51D4A443DA1A361CB91321EBD"><enum>(B)</enum><text display-inline="yes-display-inline">greater than the amount necessary to
				maintain the fiscal year 2006 level of activities, no State shall be provided a
				percentage increase above the fiscal year 2006 level of activities for grantees
				that operate under this title under national grants from the Secretary in the
				State that is less than 30 percent of such percentage increase above the fiscal
				year 2006 level of activities for public and nonprofit private agency and
				organization grantees that operate under this title under national grants from
				the Secretary in all of the States.</text>
								</subparagraph></paragraph><paragraph id="HBAF904B053634A1E9D9C678737DE1DBB"><enum>(3)</enum><header>Reduction</header><text>Allotments
				for States not affected by paragraphs (1) and (2)(B) of this subsection shall
				be reduced proportionally to satisfy the conditions in such paragraphs.</text>
							</paragraph></subsection><subsection id="HCE814EC9A3114F98BDB200D0ABD2D735"><enum>(e)</enum><header>Allotments for
				grants to states</header><text>From the amount provided for grants to States
				under subsection (c), the Secretary shall allot for the State grantee in each
				State an amount that bears the same ratio to such amount as the product of the
				number of individuals 55 years of age or older in the State and the allotment
				percentage of such State bears to the sum of the corresponding product for all
				States, except as follows:</text>
							<paragraph id="H7EA05B94EAD04721B9CDD286E0AF9BFC"><enum>(1)</enum><header>Minimum
				allotment</header><text>No State shall be provided an amount under this
				subsection that is less than ½ of 1 percent of the amount provided under
				subsection (c) for State grantees in all of the States.</text>
							</paragraph><paragraph id="H86227ED8A9CA4C5ABA46FEDAB900A3A2"><enum>(2)</enum><header>Hold
				harmless</header><text>If the amount provided under subsection (c) is—</text>
								<subparagraph id="H8C233E510497442285D0B2969EAC2F2D"><enum>(A)</enum><text>equal to or less
				than the amount necessary to maintain the fiscal year 2006 level of activities,
				allotments for State grantees in each State shall be proportional to their
				fiscal year 2006 level of activities; or</text>
								</subparagraph><subparagraph id="H40875D16A34A4FAC93A8FC9417CDECEF"><enum>(B)</enum><text>greater than the
				amount necessary to maintain the fiscal year 2006 level of activities, no State
				shall be provided a percentage increase above the fiscal year 2006 level of
				activities for State grantees in the State that is less than 30 percent of such
				percentage increase above the fiscal year 2006 level of activities for State
				grantees in all of the States.</text>
								</subparagraph></paragraph><paragraph id="HB5C80CE860844172BEB0C4F661A3F950"><enum>(3)</enum><header>Reduction</header><text>Allotments
				for States not affected by paragraphs (1) and (2)(B) of this subsection shall
				be reduced proportionally to satisfy the conditions in such paragraphs.</text>
							</paragraph></subsection><subsection id="H5D10BD8B148F45E5A68B643DDE08FAF7"><enum>(f)</enum><header>Allotment
				percentage</header><text>For purposes of subsections (d) and (e)—</text>
							<paragraph id="H9CE377D386C04267A755BDC9272CC401"><enum>(1)</enum><text>the allotment
				percentage of each State shall be 100 percent less that percentage that bears
				the same ratio to 50 percent as the per capita income of such State bears to
				the per capita income of the United States, except that—</text>
								<subparagraph id="HCE5E573163CF4899B9CCBD7C5D4E7F6E"><enum>(A)</enum><text>the allotment
				percentage shall be not more than 75 percent and not less than 33 percent;
				and</text>
								</subparagraph><subparagraph id="HE1E7EE55338B42F400A993DCFA118334"><enum>(B)</enum><text>the allotment
				percentage for the District of Columbia and the Commonwealth of Puerto Rico
				shall be 75 percent;</text>
								</subparagraph></paragraph><paragraph id="HAFA876885AFF40218BD7320478F979C"><enum>(2)</enum><text>the number of
				individuals 55 years of age or older in any State and in all States, and the
				per capita income in any State and in all States, shall be determined by the
				Secretary on the basis of the most satisfactory data available to the
				Secretary; and</text>
							</paragraph><paragraph id="HFFFEAE49CB3D48959500A300C8F2F3A6"><enum>(3)</enum><text>for the purpose of
				determining the allotment percentage, the term <quote>United States</quote>
				means the 50 States and the District of Columbia.</text>
							</paragraph></subsection><subsection id="H068B71FED2BC42D09C4BD050BC7D9CC2"><enum>(g)</enum><header>Definitions</header><text>For
				purposes of this section:</text>
							<paragraph id="HBB2E82039E0649079D553B1700C45E69"><enum>(1)</enum><header>Cost per
				authorized position</header><text>The term <quote>cost per authorized
				position</quote> means the sum of—</text>
								<subparagraph id="HD4A5AF01AD5B4818A6868567AB0352C"><enum>(A)</enum><text>the hourly minimum
				wage rate specified in section 6(a)(1) of the Fair Labor Standards Act of 1938
				(<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>), multiplied by the number of hours equal to the product
				of 21 hours and 52 weeks;</text>
								</subparagraph><subparagraph id="H0DF57C3515574E8EAC092C788414C3E7"><enum>(B)</enum><text>an amount equal to
				11 percent of the amount specified under subparagraph (A), for the purpose of
				covering Federal payments for fringe benefits; and</text>
								</subparagraph><subparagraph id="HBC183C80438A4166A7A2EC51FB73D864"><enum>(C)</enum><text>an amount
				determined by the Secretary, for the purpose of covering Federal payments for
				the remainder of all other program and administrative costs.</text>
								</subparagraph></paragraph><paragraph id="HE16A4CAAAD2E47EFA617B28CB20061B8"><enum>(2)</enum><header>Fiscal year 2006
				level of activities</header><text>The term <quote>fiscal year 2006 level of
				activities</quote> means—</text>
								<subparagraph id="HB665257750444B1994D6CBA8A512B258"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to public and nonprofit
				private agency and organization grantees that operate under this title under
				national grants from the Secretary, their level of activities for fiscal year
				2006; and</text>
								</subparagraph><subparagraph id="HE51233F79DA04DF093C5DECDD59DB2D5"><enum>(B)</enum><text>with respect to
				State grantees, their level of activities for fiscal year 2006.</text>
								</subparagraph></paragraph><paragraph id="H10B12E46136A4C8C87004B8B89FDC2DF"><enum>(3)</enum><header>Grants to
				states</header><text display-inline="yes-display-inline">The term <quote>grants
				to States</quote> means grants made under this title by the Secretary to the
				States.</text>
							</paragraph><paragraph id="HD491AF1EB8994A63AE37EBB15652632E"><enum>(4)</enum><header>Level of
				activities</header><text>The term <quote>level of activities</quote> means the
				number of authorized positions multiplied by the cost per authorized
				position.</text>
							</paragraph><paragraph id="HBFCC01A738F648BCA55736C0E9D8F2EC"><enum>(5)</enum><header>National
				grants</header><text display-inline="yes-display-inline">The term
				<quote>national grants</quote> means grants made under this title by the
				Secretary to public and nonprofit private agency and organization grantees that
				operate under this title under national grants from the Secretary.</text>
							</paragraph><paragraph id="H2731B263A4B34D37BFC11293038C72C5"><enum>(6)</enum><header>State</header><text>The
				term <quote>State</quote> does not include Guam, American Samoa, the
				Commonwealth of the Northern Mariana Islands, and the United States Virgin
				Islands.</text>
							</paragraph></subsection></section><section id="H72171D8606F9400600CAE7BD1B534ED0"><enum>507.</enum><header>Equitable
				distribution</header>
						<subsection id="HE07228CDCAB54044B752F4A46DE0AAC6"><enum>(a)</enum><header>Interstate
				allocation</header><text>In making grants under section 506, the Secretary
				shall ensure, to the extent feasible, an equitable distribution of activities
				under such grants, in the aggregate, among the States, taking into account the
				needs of underserved States.</text>
						</subsection><subsection id="HC3FA00ADB36E4FC3A2D7EB474EBA2269"><enum>(b)</enum><header>Intrastate
				allocation</header><text>The amount allocated for projects within each State
				under section 506 shall be allocated among areas in the State in an equitable
				manner, taking into consideration the State priorities set out in the State
				plan in effect under section 503(a).</text>
						</subsection></section><section id="HE06B181F70874FC0B30096011BD4E4EC"><enum>508.</enum><header>Report</header><text display-inline="no-display-inline">To carry out the Secretary’s
				responsibilities for reporting in section 503(g), the Secretary shall require
				the State agency for each State that receives funds under this title to prepare
				and submit a report at the beginning of each fiscal year on such State’s
				compliance with section 507(b). Such report shall include the names and
				geographic location of all projects assisted under this title and carried out
				in the State and the amount allocated to each such project under section
				506.</text>
					</section><section id="HF9FA2A7FC2664C658273B3E9AA4945CE"><enum>509.</enum><header>Employment
				assistance and federal housing and food stamp programs</header><text display-inline="no-display-inline">Funds received by eligible individuals from
				projects carried out under the program established in this title shall not be
				considered to be income of such individuals for purposes of determining the
				eligibility of such individuals, or of any other individuals, to participate in
				any housing program for which Federal funds may be available or for any income
				determination under the Food Stamp Act of 1977.</text>
					</section><section id="HAC0811BBA6F448EF964746EE0448E78D"><enum>510.</enum><header>Eligibility for
				workforce investment activities</header><text display-inline="no-display-inline">Eligible individuals under this title may be
				considered by local workforce investment boards established under title I of
				the Workforce Investment Act of 1998 to satisfy the requirements for receiving
				services under such title I that are applicable to adults.</text>
					</section><section id="H235C12B663F04E849E171023CF987FB"><enum>511.</enum><header>Treatment of
				assistance</header><text display-inline="no-display-inline">Assistance provided
				under this title shall not be considered to be financial assistance described
				in section 245A(h)(1)(A) of the Immigration and Nationality Act (8 U.S.C.
				1255A(h)(1)(A)).</text>
					</section><section id="HA24D2DAD5D0D4637B98773CC201009F"><enum>512.</enum><header>Coordination
				with the workforce investment act of 1998</header>
						<subsection id="H1C983C5C0469490FA37C12746E3C08B2"><enum>(a)</enum><header>Partners</header><text>Grantees
				under this title shall be One-Stop partners as described in subparagraphs (A)
				and (B)(vi) of section 121(b)(1) of the Workforce Investment Act of 1998 (29
				U.S.C. 2841(b)(1)) in the One-Stop delivery system established under section
				134(c)) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2864">29 U.S.C. 2864(c)</external-xref>)) for the appropriate local workforce
				investment areas, and shall carry out the responsibilities relating to such
				partners.</text>
						</subsection><subsection id="H7EE9B9C17FB44F2C9BEBC600B9FD7320"><enum>(b)</enum><header>Coordination</header><text>In
				local workforce investment areas where more than 1 grantee under this title
				provides services, the grantees shall—</text>
							<paragraph id="H7B2EA701847C4529B0F252D25F029E92"><enum>(1)</enum><text>coordinate their
				activities related to the One-Stop delivery system; and</text>
							</paragraph><paragraph id="H070BAD31E1264CCEBAF6D057D37420DC"><enum>(2)</enum><text>shall be
				signatories of the memorandum of understanding established under section 121(c)
				of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2841">29 U.S.C. 2841(c)</external-xref>).</text>
							</paragraph></subsection></section><section id="HB6BB0B35BA7244079F0352CDEC8CDD2D"><enum>513.</enum><header>Performance</header>
						<subsection id="H8F54F2415A7246FCA376389D4D61E341"><enum>(a)</enum><header>Measures</header>
							<paragraph id="H6F0A7CA410184A6A85D6665707004E8C"><enum>(1)</enum><header>Establishment of
				measures</header><text>The Secretary shall establish, in consultation with
				grantees, subgrantees, and host agencies under this title, States, older
				individuals, area agencies on aging, and other organizations serving older
				individuals, performance measures for each grantee for projects and services
				carried out under this title.</text>
							</paragraph><paragraph id="HBD49DD10D27748218BDB8C35006EB53D"><enum>(2)</enum><header>Content</header>
								<subparagraph id="H308C3B51BD4B4312B213E4DFA824FC50"><enum>(A)</enum><header>Composition of
				measures</header><text>The performance measures established by the Secretary in
				accordance with paragraph (1) shall consist of—</text>
									<clause id="HF84AF1FEE9584B48BE90E98259B018CD"><enum>(i)</enum><text>core indicators of
				performance specified in subsection (b)(1) and the expected levels of
				performance applicable to each core indicator of performance, and</text>
									</clause><clause id="H4EE6889C609140C98B4B17F3F3252736"><enum>(ii)</enum><text>additional
				indicators of performance specified in subsection (b)(2)</text>
									</clause></subparagraph><subparagraph id="H8EACCB086E414ABB961FE252C16FCEA1"><enum>(B)</enum><header>Continuous
				improvement</header><text>The measures described in subparagraph (A)(i) shall
				be designed to promote continuous improvement in performance.</text>
								</subparagraph><subparagraph id="H47B36DB6DF8247B786C300CF335949E9"><enum>(C)</enum><header>Expected levels
				of performance</header><text>The Secretary and each grantee shall reach
				agreement on the expected levels of performance for each program year for each
				of the core indicators of performance specified in subsection (b)(1). The
				agreement shall take into account the factors described in subparagraphs (B)
				and (D) and other appropriate factors as determined by the Secretary, and shall
				be consistent with the requirements of subparagraph (E). Funds under the grant
				may not be awarded until such agreement is reached.</text>
								</subparagraph><subparagraph id="HBE06BF8503394B9CB22059C76832293F"><enum>(D)</enum><header>Adjustment</header><text>The
				expected levels of performance described in subparagraph (C) applicable to a
				grantee shall be adjusted after the agreement under subparagraph (C) has been
				reached only with respect to the following factors:</text>
									<clause id="H200459AE940548D889274D2500ECD9D2"><enum>(i)</enum><text>High rates of
				unemployment or of poverty or welfare participation, in the areas served by a
				grantee, relative to other areas of the State or Nation.</text>
									</clause><clause id="HE96D049D7FFD49F69DD467E39C944614"><enum>(ii)</enum><text>Significant
				downturns in the areas served by the grantee or in the national economy.</text>
									</clause><clause id="H3EADAAAC5A0442388115E6DA55DCB0C3"><enum>(iii)</enum><text>Significant
				numbers or proportions of participants with 1 or more barriers to employment
				served by a grantee relative to grantees serving other areas of the State or
				Nation.</text>
									</clause><clause id="H21B6357F421248F083DBCFDE92D55EFA"><enum>(iv)</enum><text>Changes in
				Federal, State, or local minimum wage requirements.</text>
									</clause></subparagraph><subparagraph id="H40BCAD9C6C1E4F87B93E8210EF3D1590"><enum>(E)</enum><header>Placement</header>
									<clause id="H6EFEEF9990B54D8E81B634A852192200"><enum>(i)</enum><header>Level of
				performance</header><text>For all grantees, the Secretary shall establish a
				level of performance of not less than the percentage specified in clause (ii)
				(adjusted in accordance with subparagraph (D)) for the entry into unsubsidized
				employment core indicator of performance described in subsection (b)(1)(A). If
				a grantee achieved a level of performance less than the percentage specified in
				such clause for the preceding fiscal year for which results are available
				before the enactment of the <short-title>Senior
				Independence Act of 2006</short-title>, the Secretary shall provide technical
				assistance to assist such grantee to achieve the applicable percentage
				specified in such clause.</text>
									</clause><clause id="HA4DF5D325F9742959F61E91490A1EEF5"><enum>(ii)</enum><header>Required
				placement percentages</header><text display-inline="yes-display-inline">The
				minimum percentage for the entry into unsubsidized employment described in
				subsection (b)(1)(A) is—</text>
										<subclause id="H2DA0A902AB084F009823CE150007596E"><enum>(I)</enum><text>22 percent in
				fiscal year 2007;</text>
										</subclause><subclause id="HC38325A4471845FA9FFDA4DEA5A4FFC"><enum>(II)</enum><text>24 percent in
				fiscal year 2008;</text>
										</subclause><subclause id="H0C942670EAFB4C3C8D5687B0EE59B452"><enum>(III)</enum><text>26 percent in
				fiscal year 2009;</text>
										</subclause><subclause id="HAF366AC624754525A1D0B7A90016CFE2"><enum>(IV)</enum><text>28 percent in
				fiscal year 2010; and</text>
										</subclause><subclause id="H6A1543DD06244CD593B2BDE4605C2842"><enum>(V)</enum><text>30 percent in
				fiscal year 2011.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="HAACC82EDEB614D629BBD704FFAFAA404"><enum>(3)</enum><header>Performance
				evaluation of grantees</header><text>The Secretary shall annually establish
				national performance measures for each grantee under this title, which shall be
				applicable to the grantee without regard to whether such grantee operates such
				program directly or through contracts, grants, or agreements with other
				entities. The measures shall include the core indicators of performance and
				expected level of performance for each such indicator, and the additional
				indicators of performance. In addition, the Secretary shall annually publish
				the actual performance of each grantee with respect to—</text>
								<subparagraph id="H9A77E478BBEA48AEB1883C11D519F8BF"><enum>(A)</enum><text>the levels
				achieved for each of the core indicators of performance, compared to expected
				levels of performance under paragraph (2)(C) (including any adjustments to such
				levels made in accordance with to paragraph (2)(D)); and</text>
								</subparagraph><subparagraph id="H3BC0806C47A146D69343DB70CFE4D10"><enum>(B)</enum><text>the levels achieved
				for each of the additional indicators of performance.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H89D6D1612BBE401A82E5E1EA00007502"><enum>(4)</enum><header>Limitation</header><text>An
				agreement to be evaluated on the performance measures shall be a requirement
				for application for, and a condition of, all grants authorized by this
				title.</text>
							</paragraph></subsection><subsection id="H298000BD448F475D00F1AA3479D625B1"><enum>(b)</enum><header>Indicators of
				performance</header>
							<paragraph id="HA58828FAD22243358503EFB68DDDC95"><enum>(1)</enum><header>Core
				indicators</header><text>The core indicators of performance described in
				subsection (a)(2)(A)(i) shall consist of—</text>
								<subparagraph id="HC1A8047A744A45FFBDD953697864BE22"><enum>(A)</enum><text>entry into
				unsubsidized employment;</text>
								</subparagraph><subparagraph id="H4A342745815C44C58CE84FB807B4D9C1"><enum>(B)</enum><text>retention in
				unsubsidized employment for 6 months;</text>
								</subparagraph><subparagraph id="HA9F70BBA106A4FEC9EA5348F52DC7386"><enum>(C)</enum><text>earnings;
				and</text>
								</subparagraph><subparagraph id="H39E407203BE34B69992048DB41F17B31"><enum>(D)</enum><text>hours (in the
				aggregate) of community service employment-based training pursuant to
				subparagraphs (A) and (B)(I) of section 502(b)(1); and</text>
								</subparagraph></paragraph><paragraph id="H4098F9C3CBD24C33AA3F8F0044150466"><enum>(2)</enum><header>Additional
				indicators</header><text>The additional indicators of performance described in
				subsection (a)(2)(A)(ii) shall consist of—</text>
								<subparagraph id="H7E375135FB744309AA15972FB8DF29A3"><enum>(A)</enum><text>retention in
				unsubsidized employment for 1 year;</text>
								</subparagraph><subparagraph id="H85699D7983914DD78D8518B768516648"><enum>(B)</enum><text display-inline="yes-display-inline">the number of eligible individuals served,
				including the number of participating individuals described in section
				516(2)(A)(ii), and</text>
								</subparagraph><subparagraph id="HC8E04582B2374C618E00CCF8C09E7200"><enum>(C)</enum><text>any other
				indicators of performance that the Secretary determines to be appropriate to
				evaluate services and performance.</text>
								</subparagraph></paragraph></subsection><subsection id="H0C6CB7589FF44DD0948096B8B3EFD438"><enum>(c)</enum><header>Definitions of
				indicators</header><text>The Secretary, after consultation with national and
				State grantees, representatives of business and labor organizations, and
				providers of services, shall issue rules that define the indicators of
				performance described in subsection (b).</text>
						</subsection><subsection id="H8AEA96FD297A4B858F83C0C12BA0070"><enum>(d)</enum><header>Corrective
				efforts</header>
							<paragraph id="H760343CB94A54F599C5E19B9ED646D63"><enum>(1)</enum><header>National
				grantees</header>
								<subparagraph id="H58397D0BC7C043E993A3A3E0220406D"><enum>(A)</enum><header>In
				general</header><text>Not later than 120 days after the end of each program
				year, the Secretary shall determine if a national grantee awarded a grant under
				section 514 has met the expected levels of performance established under
				subsection (a)(2)(c) (including any adjustments to such levels made in
				accordance with to subsection (a)(2)(D)) for the core indicators of performance
				described in subsection (b)(1).</text>
								</subparagraph><subparagraph id="H25471B4B8A3D4D8A89BCDB6E7B93F54C"><enum>(B)</enum><header>Technical
				assistance and corrective action plan</header>
									<clause id="H1D18F9FABD8F46BB943EE900B5800777"><enum>(i)</enum><header>In
				general</header><text>If the Secretary determines that a grantee fails to meet
				the expected levels of performance described in paragraph (1), the Secretary
				shall provide technical assistance and require such grantee to submit a
				corrective action plan not later than 160 days after the end of the program
				year.</text>
									</clause><clause id="H491F7BBCA81149DB93FA9F8908C36E28"><enum>(ii)</enum><header>Content</header><text>The
				plan submitted under subparagraph (A) shall detail the steps the grantee will
				take to meet the national performance measures in the next program year.</text>
									</clause></subparagraph></paragraph><paragraph id="H9A7D8F8C13C94FB7BBDD127D194B8F05"><enum>(2)</enum><header>State
				grantees</header>
								<subparagraph id="H63DB8D7F447B4E7B9BD297195031679F"><enum>(A)</enum><header>In
				general</header><text>Not later than 120 days after the end of the program
				year, the Secretary shall determine if a State grantee allotted funds under
				section 506(e) has met the expected levels of performance established under
				subsection (a)(2)(C) (including any adjustments to such levels made in
				accordance with to subsection (a)(2)(D)) for the core indicators of performance
				described in subsection (b)(1).</text>
								</subparagraph><subparagraph id="HEA92CD58F6744D7195F060E7C49587E4"><enum>(B)</enum><header>Technical
				assistance and corrective action plan</header><text>If a State fails to meet
				the levels of performance described in subparagraph (A), the Secretary shall
				provide technical assistance and require the State to submit a corrective
				action plan not later than 160 days after the end of the program year.</text>
								</subparagraph><subparagraph id="HE3AED72D933048158773B3333FBDC0A3"><enum>(C)</enum><header>Content</header><text>The
				plan described in subparagraph (B) shall detail the steps the State will take
				to meet the standards.</text>
								</subparagraph><subparagraph id="H4D514A94651F42009E396C17C88CA65E"><enum>(D)</enum><header>Failure to meet
				performance measures for second and third years</header>
									<clause id="H4644280CD9EE46E488A326E78737FFD9"><enum>(i)</enum><header>After second
				year of failure</header><text>If a State fails to meet the levels of
				performance described in subparagraph (A) for a second consecutive program
				year, the Secretary shall provide for the conduct by the State of a competition
				to award, for the first full program year following the determination
				(minimizing, to the extent possible, the disruption of services provided to
				participants), an amount equal to 25 percent of the funds available to the
				State for such year.</text>
									</clause><clause id="HF608CFC7B7C74BE0AB740015C7F94226"><enum>(ii)</enum><header>After third
				year of failure</header><text>If the State fails to meet the levels of
				performance described in subparagraph (A) for a third consecutive program year,
				the Secretary shall provide for the conduct by the State of a competition to
				award the funds allocated to the State for the first full program year
				following the Secretary’s determination that the State has not met the
				performance measures.</text>
									</clause></subparagraph></paragraph></subsection></section><section id="H0C264A3C4527445E927832F3AADFBD4D"><enum>514.</enum><header>Competitive
				requirements relating to grant awards</header>
						<subsection id="HA4C1C28DF1B04FF29DA1649D10D5DB76"><enum>(a)</enum><header>Program
				authorized</header><text>From the funds available for national grants under
				section 506(d), the Secretary shall award grants to eligible applicants to
				carry out projects under this title through a competitive process that is
				conducted every 3 years.</text>
						</subsection><subsection id="HFB7930213AF241869B8CB2CCE0BF234C"><enum>(b)</enum><header>Eligible
				applicants</header><text>An applicant shall be eligible to receive a grant
				under subsection (a) in accordance with section 502(b)(1), and subsections (c)
				and (d).</text>
						</subsection><subsection id="HFD30A933D6AA4413AC45F0FF502E9E00"><enum>(c)</enum><header>Criteria</header><text>The
				Secretary shall select the eligible applicants to receive grants under
				subsection (a) based on the following:</text>
							<paragraph id="H23090AB035984224B8ACBDE3A6E0B7C3"><enum>(1)</enum><text>The applicant’s
				ability to administer a program that serves the greatest number of eligible
				individuals, giving particular consideration to individuals with greatest
				economic need, greatest social need, poor employment history or prospects, and
				over the age of 65.</text>
							</paragraph><paragraph id="H1CFBB454C3194BBB80ACB577CB58A87B"><enum>(2)</enum><text>The applicant’s
				ability to administer a program that provides employment for eligible
				individuals in the communities in which such individuals reside, or in nearby
				communities, that will contribute to the general welfare of the
				community.</text>
							</paragraph><paragraph id="HFF93B534EBD344ED8C9B8CB3CA9F835B"><enum>(3)</enum><text>The applicant’s
				ability to administer a program that moves eligible individuals into
				unsubsidized employment.</text>
							</paragraph><paragraph id="H9232B9918F6745ABB5091BCA957D2338"><enum>(4)</enum><text>The applicant’s
				prior performance, if any, in meeting performance measures under this title and
				under other Federal or State programs.</text>
							</paragraph><paragraph id="H47F4CD7588DF4044AFD3373D9F887132"><enum>(5)</enum><text>The applicant’s
				ability to move individuals with multiple barriers to employment into
				unsubsidized employment.</text>
							</paragraph><paragraph id="HAC85F8460D924A4191B8A83E182EFB70"><enum>(6)</enum><text>The applicant’s
				ability to coordinate with other organizations at the State and local
				level.</text>
							</paragraph><paragraph id="H8B725BA8D2D344D58E111D44007DB7BD"><enum>(7)</enum><text>The applicant’s
				plan for fiscal management of the program to be administered with funds
				received under this section.</text>
							</paragraph><paragraph id="H13ECA69E8169448BBA05E467F6C394A2"><enum>(8)</enum><text>Any additional
				criteria that the Secretary considers to be appropriate in order to minimize
				disruption for current participants.</text>
							</paragraph></subsection><subsection id="H7FB84232431547B5B250E917319E1BA9"><enum>(d)</enum><header>Responsibility
				tests</header>
							<paragraph id="H993944D914504187A3098E6D23B3A234"><enum>(1)</enum><header>In
				general</header><text>Before final selection of a grantee, the Secretary shall
				conduct a review of available records to assess the applicant’s overall
				responsibility to administer Federal funds.</text>
							</paragraph><paragraph id="H64A9F6B78388414D8829A37DF4B6B474"><enum>(2)</enum><header>Review</header><text>As
				part of the review described in paragraph (1), the Secretary may consider any
				information, including the organization’s history with regard to the management
				of other grants.</text>
							</paragraph><paragraph id="HC73CF697A54346BAB1C0727C4FF114F4"><enum>(3)</enum><header>Failure to
				satisfy test</header><text>The failure to satisfy any 1 responsibility test
				that is listed in paragraph (4), excluding those listed in subparagraphs (A)
				and (B), does not establish that the organization is not responsible unless
				such failure is substantial or persists for 2 or more consecutive years.</text>
							</paragraph><paragraph id="H64DCE097AAAD429FA202BC23D3A46720"><enum>(4)</enum><header>Test</header><text>The
				responsibility tests include review of the following factors:</text>
								<subparagraph id="HECC19C32EEA442F7A6FC937BEDBABD"><enum>(A)</enum><text>Unsuccessful efforts
				by the organization to recover debts, after 3 demand letters have been sent,
				that are established by final agency action, or a failure to comply with an
				approved repayment plan.</text>
								</subparagraph><subparagraph id="H7DE9E4373C654369BFFE41C19FC4B72D"><enum>(B)</enum><text>Established fraud
				or criminal activity of a significant nature within the organization.</text>
								</subparagraph><subparagraph id="H35BB128BCFE94DDBA7102336D5922C90"><enum>(C)</enum><text>Serious
				administrative deficiencies identified by the Secretary, such as failure to
				maintain a financial management system as required by Federal rules or
				regulations.</text>
								</subparagraph><subparagraph id="HB75479B7BD2A4C43B2B14B14DEC5E531"><enum>(D)</enum><text>Willful
				obstruction of the audit process.</text>
								</subparagraph><subparagraph id="H58D7087CB255482E8C266EC2FA7062F4"><enum>(E)</enum><text>Failure to provide
				services to applicants as agreed to in a current or recent grant or to meet
				applicable performance measures.</text>
								</subparagraph><subparagraph id="HBAA43256E7934D11919BF777BBD8A4E6"><enum>(F)</enum><text>Failure to correct
				deficiencies brought to the grantee’s attention in writing as a result of
				monitoring activities, reviews, assessments, or other activities.</text>
								</subparagraph><subparagraph id="H3AD2495A104F483396BD4CCCA7C03521"><enum>(G)</enum><text>Failure to return
				a grant closeout package or outstanding advances within 90 days of the grant
				expiration date or receipt of closeout package, whichever is later, unless an
				extension has been requested and granted.</text>
								</subparagraph><subparagraph id="H31B52B08A6D34751B956C784533EB3A8"><enum>(H)</enum><text>Failure to submit
				required reports.</text>
								</subparagraph><subparagraph id="HA23C6EA0832744B6974B74DF38D3AEEC"><enum>(I)</enum><text>Failure to
				properly report and dispose of Government property as instructed by the
				Secretary.</text>
								</subparagraph><subparagraph id="HC8A7A925DEBB4357B679CBC7B37E979"><enum>(J)</enum><text>Failure to have
				maintained effective cash management or cost controls resulting in excess cash
				on hand.</text>
								</subparagraph><subparagraph id="H61AAFE9012A74549A8E5B3A0FF2035BC"><enum>(K)</enum><text>Failure to ensure
				that a subrecipient complies with its Office of Management and Budget Circular
				A-133 audit requirements specified at <external-xref legal-doc="usc" parsable-cite="usc/20/667">section 667.200(b)</external-xref> of title 20, Code of
				Federal Regulations.</text>
								</subparagraph><subparagraph id="H7EE36D10B3034F258FFC10FEC3EC8E9"><enum>(L)</enum><text>Failure to audit a
				subrecipient within the required period.</text>
								</subparagraph><subparagraph id="HADF26DD87D8D46E09575B6201287DFE3"><enum>(M)</enum><text>Final disallowed
				costs in excess of 5 percent of the grant or contract award if, in the judgment
				of the grant officer, the disallowances are egregious findings.</text>
								</subparagraph><subparagraph id="H43C6FEF1FA464ED88C00FCD76B9002C3"><enum>(N)</enum><text>Failure to
				establish a mechanism to resolve a subrecipient’s audit in a timely
				fashion.</text>
								</subparagraph></paragraph><paragraph id="HCEC361EFA8014F249FD8D95E1445B4B6"><enum>(5)</enum><header>Determination</header><text>Applicants
				that are determined to be not responsible shall not be selected as
				grantees.</text>
							</paragraph><paragraph id="HC6831CFBBB4140F596DF8D5503CD0622"><enum>(6)</enum><header>Disallowed
				costs</header><text>Interest on disallowed costs shall accrue in accordance
				with the Debt Collection Improvement Act of 1996.</text>
							</paragraph></subsection></section><section id="H8D1DEB102C324D89B45677B8B07ED9DD"><enum>515.</enum><header>Authorization
				of appropriations</header>
						<subsection id="H671547D3F5214A4893D918228FB6A8FE"><enum>(a)</enum><text>There is
				authorized to be appropriated to carry out this title such sums as may be
				necessary for fiscal years 2007, 2008, 2009, 2010, and 2011.</text>
						</subsection><subsection id="H7B084CFA5A5F480D902DC69E3EB289B5"><enum>(b)</enum><text>Amounts
				appropriated under this section for any fiscal year shall be available for
				obligation during the annual period that begins on July 1 of the calendar year
				immediately following the beginning of such fiscal year and that ends on June
				30 of the following calendar year. The Secretary may extend the period during
				which such amounts may be obligated or expended in the case of a particular
				organization or agency that receives funds under this title if the Secretary
				determines that such extension is necessary to ensure the effective use of such
				funds by such organization or agency.</text>
						</subsection><subsection id="H571CA013CEC248FC84954020F1231067"><enum>(c)</enum><text>At the end of the
				program year, the Secretary may recapture any unexpended funds for the program
				year, and reobligate such funds within the 2 succeeding program years
				for—</text>
							<paragraph id="H29FBF3DC335C4722834FAEC8116987E"><enum>(1)</enum><text>technical
				assistance; or</text>
							</paragraph><paragraph id="H952E2FCAB9C94CA600862F055CA3F3CD"><enum>(2)</enum><text>grants or
				contracts for any other program under this title.</text>
							</paragraph></subsection></section><section id="HBE47B2EC60A94E4C0069FF011326C5E0"><enum>516.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this title:</text>
						<paragraph id="H2431C0C97A014EE3AF4800CCD1D9302C"><enum>(1)</enum><header>Community
				service employment-based training</header><text>The term <quote>community
				service employment-based training</quote> means work experience that is related
				to providing social, health, welfare, and educational services (including
				literacy tutoring), legal and other counseling services and assistance,
				including tax counseling and assistance and financial counseling, and library,
				recreational, and other similar services; conservation, maintenance, or
				restoration of natural resources; community betterment or beautification;
				antipollution and environmental quality efforts; weatherization activities;
				economic development; and such other services essential and necessary to the
				community as the Secretary determines by rule.</text>
						</paragraph><paragraph id="H0CFF0774F8F344D9BE00A01650868F00"><enum>(2)</enum><header>Eligible
				individual</header><text display-inline="yes-display-inline">The term
				<quote>eligible individual</quote> means an individual who is 55 years of age
				or older and who has a low income (including any such individual whose income
				is not more that 125 percent of the poverty line), excluding any income that is
				unemployment compensation, benefits received under title XVI of the Social
				Security Act, veterans payments, or 25 percent of the benefits received under
				title II of the Social Security Act, but—</text>
							<subparagraph id="H1AECA3B0B56048699166C58073278F2E"><enum>(A)</enum><text display-inline="yes-display-inline">pursuant to regulations prescribed by the
				Secretary, any such individual who meets one or more of the following criteria
				shall have priority for the work opportunities provided under this
				title—</text>
								<clause id="HAA04766519D14C6FAADF9ED9293F5306"><enum>(i)</enum><text>is
				65 years of age or older; or</text>
								</clause><clause id="H58C8B500DB364A268023D3205084429F"><enum>(ii)</enum><text>has one or more
				of the following barriers to employment:</text>
									<subclause id="H686800900699414C9791FA51A983B16E"><enum>(I)</enum><text>has a
				disability;</text>
									</subclause><subclause id="H53EA25CEF8B84F589B708BBE46E69079"><enum>(II)</enum><text>has limited
				English proficiency or low literacy skills;</text>
									</subclause><subclause id="H146618F6C0D24D1787D530435CB99E80"><enum>(III)</enum><text>resides in a
				rural area;</text>
									</subclause><subclause id="HF73EB41BDD124A1EACD88EC2CADAEBD"><enum>(IV)</enum><text>is a
				veteran;</text>
									</subclause><subclause id="HC7B88E502D3949DABFF856FD592DCA"><enum>(V)</enum><text>has low employment
				prospects; or</text>
									</subclause><subclause id="H7EF25389BA5A45FDBD67E5AECB57B4FD"><enum>(VI)</enum><text>has failed to
				find employment after utilizing services provided under title I of the
				Workforce Investment Act of 1998; and</text>
									</subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H1D3F7555FAD94E3DB0D3BBA67B9938BD"><enum>(B)</enum><text>notwithstanding
				any other provision of this paragraph, excludes—</text>
								<clause id="H482E11F680684375B200AE64CC56703D"><enum>(i)</enum><text display-inline="yes-display-inline">an individual who has participated in
				projects under this title for a period of 48 months in the aggregate (whether
				or not consecutive) after the date of the enactment of the Senior Independence
				Act of 2006; and</text>
								</clause><clause id="HD1BD73C08C114C2E85328F64BE0186A7"><enum>(ii)</enum><text display-inline="yes-display-inline">an individual who has participated in
				projects under this title for a period of 24 months in the aggregate (whether
				or not consecutive) after the date of the enactment of the Senior Independence
				Act of 2006 if such individual participated more than 24 months in the
				aggregate (whether or not consecutive) under title V of this Act, as in effect
				before the date of the enactment of the Senior Independence Act of 2006.</text>
								</clause></subparagraph></paragraph><paragraph id="H1A1F81D376FB4BAD94F962D8A0C09676"><enum>(3)
				</enum><header>Low income</header><text display-inline="yes-display-inline">The
				term `low income' means income received during the 12-month period (or, at the
				option of the grantee involved, the 6-month period that is not multiplied)
				ending on the date an eligible individual submits an application to participate
				in the project carried out under this title by such grantee.</text>
						</paragraph><paragraph id="HDD97706925434C77987776E379C0A767"><enum>(4)</enum><header>Pacific island
				and asian americans</header><text>The term <quote>Pacific Island and Asian
				Americans</quote> means Americans having origins in any of the original peoples
				of the Far East, Southeast Asia, the Indian Subcontinent, or the Pacific
				Islands.</text>
						</paragraph><paragraph id="H7B9912CE692B4692949BE180809DA916"><enum>(5)</enum><header>Program</header><text>The
				term <quote>program</quote> means the older American community service
				employment-based training program established under this title.</text>
						</paragraph><paragraph id="HAC627965511941C2BCBCC53FEADD5BEB"><enum>(6)</enum><header>Supportive
				services</header><text display-inline="yes-display-inline">The term
				<quote>supportive services</quote> means services such as transportation, child
				care, dependent care, housing, and needs-related payments, that are necessary
				to enable an individual to participate in activities authorized under this
				title, consistent with the provisions of this title.</text>
						</paragraph><paragraph id="H66652A80D4DB44FD9BF0B90046FAAA7E"><enum>(7)</enum><header>Unemployed
				individual</header><text display-inline="yes-display-inline">The term
				<quote>unemployed individual</quote> means an individual who is without a job
				and who wants and is available for work, including an individual who may have
				occasional employment that does not result in a constant source of
				income.</text>
						</paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" id="HE961EFDC0F354DDF8B18B1D900A0304E" reported-display-style="italic"><enum>39.</enum><header>Native americans
			 caregiver support program</header><text display-inline="no-display-inline">Section 643 of the Older Americans Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3057n">42 U.S.C. 3057n</external-xref>) is amended by striking <quote>2001</quote> each place it
			 appears and inserting <quote>2007</quote>.</text>
		</section><section changed="added" id="H448B66D0C2CA4E94BBD55263C491C696" reported-display-style="italic"><enum>40.</enum><header>Vulnerable elder rights
			 protection activities</header><text display-inline="no-display-inline">Section
			 702 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058a">42 U.S.C. 3058a</external-xref>) is amended by striking
			 <quote>2001</quote> each place it appears and inserting
			 <quote>2007</quote>.</text>
		</section><section changed="added" id="H4BA4A41A39604D69AB23CC007093A47E" reported-display-style="italic"><enum>41.</enum><header>Native american
			 organization provisions</header><text display-inline="no-display-inline">Section 751(d) of the Older Americans Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058aa">42 U.S.C. 3058aa(b)</external-xref>) is amended by striking <quote>2001</quote> and
			 inserting <quote>2007</quote>.</text>
		</section><section changed="added" id="H63620DA9773E42E6B7ADA57E1E58E1D8" reported-display-style="italic"><enum>42.</enum><header>Elder abuse, neglect,
			 and exploitation prevention</header><text display-inline="no-display-inline">Section 721 (b) of the Older Americans Act
			 of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058i">42 U.S.C. 3058i(b)</external-xref>) is amended—</text>
			<paragraph changed="added" id="H201B4ED2492B4BB2A7E0754489F8E88" reported-display-style="italic"><enum>(1)</enum><text>by inserting after
			 paragraph (1) the following new paragraph:</text>
