		<section id="H04B8EC506F924847A715D400FFC75822" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Prevent
			 Unfair Manipulation of Prices Act of 2006</quote>.</text>
		</section><section id="HF63B3A1859AE4F31B0E846FBB02279D9"><enum>2.</enum><header>Over-the-counter
			 transactions in energy commodities</header>
			<subsection id="H31503A6125464E1B9B55609BB24EBE5"><enum>(a)</enum><header>Definitions</header><text>Section
			 1a of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a</external-xref>) is amended by adding at the end
			 the following:</text>
				<quoted-block id="H0E354B332D39459DAD68460059D6D33" style="OLC">
					<paragraph id="HFC639273D2A44E2EBD3BDFF3009D9D29"><enum>(34)</enum><header>Included energy
				transaction</header><text>The term <quote>included energy transaction</quote>
				means a contract, agreement, or transaction in an energy commodity that
				is—</text>
						<subparagraph id="H56431AF4A0DE4D96B4E33023635EA12E"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HE0955164A5164EB4955580806462D2F7"><enum>(i)</enum><text>executed or traded on an
				electronic trading facility; and</text>
							</clause><clause id="HE207169B1E7F42319CF7C6D1308D0000" indent="up1"><enum>(ii)</enum><text>entered into on a
				principal-to-principal basis solely between persons that are eligible
				commercial entities at the time the persons enter into the agreement, contract,
				or transaction; or</text>
							</clause></subparagraph><subparagraph id="HE80A02A32F6E42DDBC28BEF99E1DC748"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H4B6EDC7881DA4DC4B18E7400D7B0B373"><enum>(i)</enum><text>executed or traded not
				on or through a trading facility; and</text>
							</clause><clause id="H7C0E9711167F4EA000CAF92855EEA789" indent="up1"><enum>(ii)</enum><text>entered into solely between
				persons that are eligible contract participants at the time the persons enter
				into the agreement, contract, or transaction, regardless of the means of
				execution of the agreement, contract, or transaction.</text>
							</clause></subparagraph></paragraph><paragraph id="H66F3F954CB29466D0071F7209E2D30FF"><enum>(35)</enum><header>Energy
				commodity</header>
						<subparagraph id="HE86D8753860B4C26BA2242929220D300"><enum>(A)</enum><header>In
				general</header><text>The term <quote>energy commodity</quote> means a
				commodity (other than an excluded commodity, a metal, or an agricultural
				commodity) that is used as a source of energy.</text>
						</subparagraph><subparagraph id="HBACBCD10CDEC4213A78327D004FFD862"><enum>(B)</enum><header>Inclusions</header><text>The
				term <quote>energy commodity</quote> includes—</text>
							<clause id="HF0DB7BDCB91A43C7AD9EA58E54DF005E"><enum>(i)</enum><text>coal;</text>
							</clause><clause id="H6904FB064D684CBE97518FD35700C5FB"><enum>(ii)</enum><text>crude oil,
				gasoline, diesel fuel, heating oil, and propane;</text>
							</clause><clause id="HA822A0233AAA4314BB78B5896325EAC7"><enum>(iii)</enum><text>electricity;
				and</text>
							</clause><clause id="H680A94DB440E40518676261C03C900C8"><enum>(iv)</enum><text>natural
				gas.</text>
							</clause></subparagraph></paragraph><paragraph id="H45452DF17E5741C0AD0766529256009D"><enum>(36)</enum><header>Electronic
				energy trading facility</header><text>The term <quote>electronic energy trading
				facility</quote> means an electronic trading facility on or through which
				included energy transactions are traded or
				executed.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0449B1D1294B4BA6B89FF2D88D99A421"><enum>(b)</enum><header>Off-exchange
			 transactions in energy commodities</header><text>Section 2(g) of the Commodity
			 Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2">7 U.S.C. 2(g)</external-xref>) is amended—</text>
				<paragraph id="HDA473149989E4EEDBEC3DD6CDD4BEEED"><enum>(1)</enum><text>by inserting
			 <quote>or an energy commodity</quote> after <quote>agricultural
			 commodity</quote>;</text>
				</paragraph><paragraph id="H1FFF17AB8B354EDC00C141218991AA4D"><enum>(2)</enum><text>by redesignating
			 paragraphs (1) through (3) as subparagraphs (A) through (C),
			 respectively;</text>
				</paragraph><paragraph id="H9C285887754E423B9E5900CC9122060"><enum>(3)</enum><text>by
			 striking <quote>No provision</quote> and inserting the following:</text>
					<quoted-block id="H4291A8AB2DBB47D8AD9FD4B538E07FCD" style="OLC">
						<paragraph id="HE6FF6C4B36154E4400DBC000B035812"><enum>(1)</enum><header>In
				general</header><text>No provision</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1FA78BF8AFDF45B59F4DFE6620F0930"><enum>(4)</enum><text>by
			 adding at the end the following:</text>
					<quoted-block id="HBF7D1E88E0024ED2B2D68164BBA7622" style="OLC">
						<paragraph id="H06FC03CC33E94008A5D9637D9C445B69"><enum>(2)</enum><header>Transactions in
				energy commodities</header>
							<subparagraph id="H48298550EE904E6497B00F98DB1CFDC"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraphs (B) and (C) and
				subsection (h)(7), nothing in this Act applies to an included energy
				transaction.</text>
							</subparagraph><subparagraph id="H2C0C6BAA66574AB89DB05C63835B9EF2"><enum>(B)</enum><header>Prohibited
				conduct</header>
								<clause id="H503379E7F07146A884CB916F9DD0E540"><enum>(i)</enum><header>In
				general</header><text>An included energy transaction shall be subject
				to—</text>
									<subclause id="H6CD502B375764476BD512E41C3BC6C37"><enum>(I)</enum><text>sections 5b,
				12(e)(2)(B), and 22(a)(4); and</text>
									</subclause><subclause id="H51AB9B495B6B44DD9EE39BDE7D289BE7"><enum>(II)</enum><text>the prohibitions
				in sections 4b, 4c(a), 4c(b), 4o, 6(c), 6(d), 6c, 6d, 8a, and 9(a)(2).</text>
									</subclause></clause><clause id="H237A26B6E98F47048CED60F700A08627"><enum>(ii)</enum><header>Transactions
				exempted by commission action</header><text>Notwithstanding any exemption by
				the Commission under section 4(c), an included energy transaction shall be
				subject to the sections specified in clause (i) of this subparagraph,
				subparagraph (C), and subsection (h)(7).</text>
								</clause></subparagraph><subparagraph id="HEEB2953CE5DC4D34A00014F62B2EED9D"><enum>(C)</enum><header>Reporting and
				recordkeeping requirements</header>
								<clause id="H32F5EC305E674E12BB41E16211AD3DC8"><enum>(i)</enum><header>In
				general</header><text>An eligible contract participant that enters into or
				executes an included energy transaction that performs, or together with other
				such transactions performs, a significant price discovery function in the cash
				market for an energy commodity or in any other market for agreements,
				contracts, or transactions relating to an energy commodity, and an eligible
				commercial entity that enters into or executes an included energy transaction
				described in section 1a(34)(A) shall—</text>
									<subclause id="H165951F2DEF54CB8B6F3DAC9B18631F4"><enum>(I)</enum><text>provide to the
				Commission on a timely basis the information required under clause (ii);
				and</text>
									</subclause><subclause id="HBEA202A799F440EE8781EC1B3BEAC449"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="H8A1AB98044A445E8ADD682ACABF311B0"><enum>(aa)</enum><text>consistent with section
				4i, maintain books and records relating to each included energy transaction,
				for a period of at least 5 years after the date of the transaction, in such
				form as the Commission shall require; and</text>
										</item><item id="H0EA5B47A043D4195AE5939C5BABDD5EF" indent="up1"><enum>(bb)</enum><text>keep the books and records open to
				inspection by any representative of the Commission or the Attorney
				General.</text>
										</item></subclause></clause><clause id="H116F56F8862C43E39D4BD5B6A56D1431"><enum>(ii)</enum><header>Required
				information</header>
									<subclause id="HA89E366DA2E14EA688EB76FE00D9DF49"><enum>(I)</enum><header>In
				general</header><text>The Commission shall require that such information
				regarding included energy transactions be provided to the Commission as the
				Commission considers necessary to assist in detecting and preventing price
				manipulation.</text>
									</subclause><subclause id="HB8944483D0A4478EB3A5F7ED0932AF26"><enum>(II)</enum><header>Information to
				be included</header><text>Such information shall include information regarding
				large trading positions obtained through 1 or more included energy transactions
				that involve—</text>
										<item id="H82C18C5239F24606A8B5D5045492D4A7"><enum>(aa)</enum><text>substantial
				quantities of the commodity in the cash market; or</text>
										</item><item id="H138353220AAC42A99C60B086AC055213"><enum>(bb)</enum><text>substantial
				positions, investments, or trades in agreements or contracts related to energy
				commodities.</text>
										</item></subclause><subclause id="H5A8DF914979E46A8B536BF47B94E2684"><enum>(III)</enum><header>Manner of
				compliance</header><text>The Commission shall specify when and how such
				information shall be provided and maintained by eligible contract participants
				and eligible commercial entities.</text>
									</subclause><subclause id="H966CECBE6D46476D9C7E8CF15DE3E150"><enum>(IV)</enum><header>Price discovery
				transactions</header>
										<item id="H5A8B5B0D886445838206B8B3B241D7E9"><enum>(aa)</enum><header>In
				general</header><text>In specifying the information to be provided under this
				paragraph, the Commission shall identify the transactions or class of
				transactions that the Commission considers to perform a significant price
				discovery function.</text>
										</item><item id="H1501C200752343F99FF12DCEB57279F2"><enum>(bb)</enum><header>Considerations</header><text>In
				determining which included energy transactions perform a significant price
				discovery function, the Commission shall consider the extent to which—</text>
											<subitem id="H1432DFE1C3814AD1BF79D4FEC325F13B"><enum>(AA)</enum><text>standardized
				agreements are used to execute the transactions;</text>
											</subitem><subitem id="H7482DCBFA35B4972B34642E89FD698E"><enum>(BB)</enum><text>the transactions
				involve standardized types or measures of a commodity;</text>
											</subitem><subitem id="HB9A604ED235845CAB2A561AFF82363D5"><enum>(CC)</enum><text>the prices of the
				transactions are reported to third parties, published, or disseminated;</text>
											</subitem><subitem id="HFDFCCE149D0A402C99DFFCE71087C21D"><enum>(DD)</enum><text>the prices of the
				transactions are referenced in other transactions; and</text>
											</subitem><subitem id="H52395641FB3F458A83CB00E955597069"><enum>(EE)</enum><text>other factors
				considered appropriate by the Commission.</text>
											</subitem></item></subclause><subclause id="H20DE0C80F86045F3B45D04A7D2E514B9"><enum>(V)</enum><header>Persons
				filing</header>
										<item id="H359B1A0BF8CA43A5AFE13773E79BD7C4"><enum>(aa)</enum><header>In
				general</header><text>The Commission, in its discretion, may allow large trader
				position reports required to be provided by an eligible commercial entity to be
				provided by an electronic energy trading facility if the eligible commercial
				entity authorizes the facility to provide such information on its
				behalf.</text>
										</item><item id="H420CBBFC8E3E4E6B8FA7AD7665BF4636"><enum>(bb)</enum><header>Information and
				enforcement</header><text>Nothing in an authorization under item (aa) shall
				impair the ability of the Commission to obtain information from an eligible
				commercial entity or otherwise enforce this Act.</text>
										</item></subclause><subclause id="H2216D49A53C94603B4CF73E5DC5E2FD8"><enum>(VI)</enum><header>Regulations</header><text>Not
				later than 180 days after the date of enactment of this paragraph, the
				Commission shall issue a notice of proposed rulemaking, and not later than 1
				year after the date of enactment of this paragraph, the Commission shall
				promulgate final regulations, specifying the information to be provided and
				maintained under this
				subparagraph.</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H2881603FA69D4BEE95BCD5B700CF1699"><enum>3.</enum><header>Electronic
			 trading facilities for energy commodities</header><text display-inline="no-display-inline">Section 2(h) of the Commodity Exchange Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/2">7 U.S.C. 2(h)</external-xref>) is amended—</text>
			<paragraph id="H961910938A2E4ACF96F2E6F712F73694"><enum>(1)</enum><text>in paragraph (1),
			 by inserting after <quote>an exempt commodity</quote> the following: <quote>,
			 other than an energy commodity,</quote>;</text>
			</paragraph><paragraph id="H8D476E22ABD44ED68434690022608B4F"><enum>(2)</enum><text>in paragraph (3),
			 by inserting after <quote>an exempt commodity</quote> the following: <quote>,
			 other than an energy commodity,</quote>; and</text>
			</paragraph><paragraph id="H023DA752482E4375995130C39E276E2"><enum>(3)</enum><text>by
			 adding at the end the following:</text>
				<quoted-block id="HF13A0C8B9B344AB69F4341E7FF8E46ED" style="OLC">
					<paragraph id="H073E50834D4345C3BB197823769F3821"><enum>(7)</enum><header>Energy
				transactions</header>
						<subparagraph id="H0A64426ED4554938BC53FAF2128EF550"><enum>(A)</enum><header>In
				general</header><text>To the extent that the Commission determines to be
				appropriate under subparagraph (C), an electronic energy trading facility
				shall—</text>
							<clause id="H1D68C21E3A5F476AB6609052FAAC2B8C"><enum>(i)</enum><text>be
				subject to the requirements of section 5a, to the extent provided in sections
				5a(g) and 5d;</text>
							</clause><clause id="H381719BE9F43499700D714ADDEF247FA"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H64D7EE4A05FB490AB88DE3D56D1BA41D"><enum>(I)</enum><text>consistent with section
				4i, maintain books and records relating to the business of the electronic
				energy trading facility, including books and records relating to each
				transaction in such form as the Commission may require; and</text>
								</subclause><subclause id="H1EB61DE08F2A4BB88085998ECD095CD0" indent="up1"><enum>(II)</enum><text>make the books and records required
				under this section available to representatives of the Commission and the
				Attorney General for inspection for a period of at least 5 years after the date
				of each included energy transaction;</text>
								</subclause></clause><clause id="HF55B163AF1C840C3BE02999DF910502D"><enum>(iii)</enum><text>make available
				to the public information on trading volumes, settlement prices, open interest
				(where applicable), and opening and closing ranges (or daily highs and lows, as
				appropriate) for included energy transactions; and</text>
							</clause><clause id="H307EC0E8E93743A3986CB057A301AC10"><enum>(iv)</enum><text>provide the
				information to the Commission in such form and at such times as the Commission
				may require.</text>
							</clause></subparagraph><subparagraph id="H15372B83E2E140DBA865FA2385DB4721"><enum>(B)</enum><header>Applicability of
				other provisions</header>
							<clause id="HCCBD78847549428E9F165800E9CD1C2D"><enum>(i)</enum><header>Paragraph
				(5)</header><text>An electronic energy trading facility shall comply with
				paragraph (5).</text>
							</clause><clause id="HB910228838AE4B8FA9CC1E1631CD97CD"><enum>(ii)</enum><header>Paragraph
				(6)</header><text>Paragraph (6) shall apply with respect to a subpoena issued
				to any foreign person that the Commission believes is conducting or has
				conducted transactions on or through an electronic energy trading
				facility.</text>
							</clause></subparagraph><subparagraph id="H77793F7DDF7242C986FBF199533E16E0"><enum>(C)</enum><header>Regulations</header><text>Not
				later than 180 days after the date of enactment of this paragraph, the
				Commission shall issue a notice of proposed rulemaking, and not later than 1
				year after the date of enactment of this paragraph, the Commission shall
				promulgate final regulations, specifying the information to be provided,
				maintained, or made available to the public under subparagraphs (A) and
				(B).</text>
						</subparagraph></paragraph><paragraph id="HBEB18DFF065E4CAAB0794167902CA6FD"><enum>(8)</enum><header>Nondisclosure of
				proprietary information</header><text>In carrying out paragraph (7) and
				subsection (g)(2), the Commission shall not—</text>
						<subparagraph id="H21129873A87C48E2A679EF00E799C0D"><enum>(A)</enum><text>require the
				real-time publication of proprietary information;</text>
						</subparagraph><subparagraph id="HB0EFE493683F4F77AD3C10A915883585"><enum>(B)</enum><text>prohibit the
				commercial sale or licensing of real-time proprietary information; or</text>
						</subparagraph><subparagraph id="HA3CC677041E2432894D305F300475391"><enum>(C)</enum><text>publicly disclose
				information regarding market positions, business transactions, trade secrets,
				or names of customers, except as provided in section
				8.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H14EBB9EEF9D24557A616001DDE8D69D2"><enum>4.</enum><header>No
			 effect on other authority</header>
			<subsection id="H286210373D5F42D7B8EAF20458E1EFB"><enum>(a)</enum><header>No effect on FERC
			 authority</header><text>Nothing contained in this title shall affect the
			 jurisdiction of the Federal Energy Regulatory Commission with respect to the
			 authority of the Federal Energy Regulatory Commission under the Federal Power
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/791a">16 U.S.C. 791a et seq.</external-xref>), the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717">15 U.S.C. 717 et seq.</external-xref>), or
			 other law to obtain information or otherwise carry out the responsibilities of
			 the Federal Energy Regulatory Commission.</text>
			</subsection><subsection id="H722341E042DB483EBB4300D72636102B"><enum>(b)</enum><header>No effect on
			 excluded commodities</header><text>The amendments made by this title have no
			 effect on the regulation of excluded commodities under the Commodity Exchange
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a et seq.</external-xref>).</text>
			</subsection><subsection id="HC01A7D3755DB4C6CAF29D31C512DC910"><enum>(c)</enum><header>No effect on
			 metals</header><text>The amendments made by this title have no effect on the
			 regulation of metals under the Commodity Exchange Act (7 U.S.C. 1a et
			 seq.).</text>
			</subsection></section><section id="H96DEE3793AA640318B157E55A88E61D1"><enum>5.</enum><header>Prohibition of
			 fraudulent transactions</header><text display-inline="no-display-inline">Section 4b of the Commodity Exchange Act (7
			 U.S.C. 6b) is amended by striking subsection (a) and inserting the
			 following:</text>
			<quoted-block id="H716401EBEA774896862624BFBBB1AB81" style="OLC">
				<subsection id="H5503C57C7C8940D8A106091700AB66FD"><enum>(a)</enum><header>Prohibitions</header>
					<paragraph id="H64D35B320F4B46BFAD3F2341C5CC7000"><enum>(1)</enum><header>In
				general</header><text>It shall be unlawful</text><subparagraph commented="no" display-inline="yes-display-inline" id="HD2DED067736A4F22A85BC4ADA78B9708"><enum>(A)</enum><text>for any person, in or in
				connection with any order to make, or the making of, any contract of sale of
				any commodity for future delivery or in interstate commerce, that is made, or
				to be made, on or subject to the rules of a designated contract market, for or
				on behalf of any other person, or</text><clause commented="no" display-inline="yes-display-inline" id="H2733C3A28A79488DA6FCF305FFCA15E7"><enum>(B)</enum><text>for any person, in or in
				connection with any order to make, or the making of, any contract of sale of
				any commodity for future delivery or other agreement, contract or transaction
				subject to paragraphs (1) and (2) of section 5a(g), that is made, or to be
				made, for or on behalf of or with, any other person, other than on or subject
				to the rules of a designated contract market—</text>
							</clause><clause id="H8D36EF3DCD45452DA1CB8D2FF1CB30FD" indent="up1"><enum>(i)</enum><text>to cheat or defraud or attempt to
				cheat or defraud the other person;</text>
							</clause><clause id="H85B680B24FEB4AE6BE009317E362C62B" indent="up1"><enum>(ii)</enum><text>willfully to make or cause to be
				made to such other person any false report or statement or willfully to enter
				or cause to be entered for the other person any false record;</text>
							</clause><clause id="H17AD554BA5B44C8189696EC9E75921DB" indent="up1"><enum>(iii)</enum><text>willfully to deceive or attempt
				to deceive the other person by any means whatsoever in regard to any order or
				contract or the disposition or execution of any order or contract, or in regard
				to any act of agency performed, with respect to any order or contract for (or,
				in the case of a contract described in subparagraph (B), with the other person)
				such person; or</text>
							</clause><clause id="H614B94E541EA45A081262CDA49E287ED" indent="up1"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="HBA18FEECEEE7419DA43F4DF4E927BC62"><enum>(I)</enum><text>to bucket an order
				represented by the person as an order to be executed, for or on behalf of the
				other person, on an organized exchange; or</text>
								</subclause><subclause id="H73FBF81C52534922ADA2879DE607AD6B" indent="up1"><enum>(II)</enum><text>to—</text>
									<item id="HC89D30CF1A214FF08E7E9DF9356B1336"><enum>(aa)</enum><text>fill an order by offset against the
				order or orders of the other person; or</text>
									</item><item id="H9DB28A5C3D04428A97D8AFC1DB246BE4"><enum>(bb)</enum><text>willfully and knowingly and without the
				prior consent of the other person, to—</text>
										<subitem id="H7561A2072BCE41A49B5CDFC64375A535"><enum>(AA)</enum><text>become the buyer in respect to any
				selling order of the other person; or</text>
										</subitem><subitem id="H58D84C57D26545569DC0ABB4F2F5930"><enum>(BB)</enum><text>become the seller in respect to any
				buying order of the other person,</text>
										</subitem></item><continuation-text continuation-text-level="subclause">if the
				order is to be executed on or subject to the rules of a designated contract
				market.</continuation-text></subclause></clause></subparagraph></paragraph><paragraph id="HE4D37B13AA1844A6B0846206004BA100"><enum>(2)</enum><header>Limitation</header><text>This
				subsection does not obligate any person, in connection with a transaction in a
				contract of sale of a commodity for future delivery with another person, to
				disclose to any other person nonpublic information that may be material to the
				market price of the commodity or transaction, except as necessary to make any
				statement made to the other person in connection with the transaction not
				misleading in any material
				respect.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC229ED6441694C08B4742185324DB7D4"><enum>6.</enum><header>Criminal and
			 civil penalties</header>
			<subsection id="H371036C21B294B229E2E7342FA9E599D"><enum>(a)</enum><header>Enforcement
			 powers of commission</header><text>Section 6(c) of the Commodity Exchange Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/9">7 U.S.C. 9</external-xref>, 15) is amended in clause (3) of the tenth sentence—</text>
				<paragraph id="H03412AC981364D4EA04B41F6E9533208"><enum>(1)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>assess such person</quote>; and</text>
				</paragraph><paragraph id="H3011EB3409C94272923169111F37421B"><enum>(2)</enum><text>by inserting after
			 <quote>each such violation</quote> the following: <quote>, or (B) in any case
			 of manipulation of, or attempt to manipulate, the price of any commodity, a
			 civil penalty of not more than the greater of $1,000,000 or triple the monetary
			 gain to such person for each such violation,</quote>.</text>
				</paragraph></subsection><subsection id="H626CFF0142BC4A7EAA9D0516E9AB1CB1"><enum>(b)</enum><header>Manipulations
			 and other violations</header><text>Section 6(d) of the Commodity Exchange Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/13b">7 U.S.C. 13b</external-xref>) is amended in the first sentence—</text>
				<paragraph id="H4931F1C5281646968701C57BA21F9DEE"><enum>(1)</enum><text>by striking
			 <quote>paragraph (a) or (b) of section 9 of this Act</quote> and inserting
			 <quote>subsection (a), (b), or (f) of section 9</quote>; and</text>
				</paragraph><paragraph id="H8D2252B640CD45B68B897CF8E0463D1C"><enum>(2)</enum><text>by striking
			 <quote>said paragraph 9(a) or 9(b)</quote> and inserting <quote>subsection (a),
			 (b), or (f) of section 9</quote>.</text>
				</paragraph></subsection><subsection id="H1D6A6B51E28C4B36BBBD8B9F5B667E91"><enum>(c)</enum><header>Nonenforcement
			 of rules of government or other violations</header><text>Section 6b of the
			 Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/13a">7 U.S.C. 13a</external-xref>) is amended—</text>
				<paragraph id="H11FD1E0A759F4DAB941FB85C5D5749A5"><enum>(1)</enum><text>in the first
			 sentence, by inserting before the period at the end the following: <quote>, or,
			 in any case of manipulation of, or an attempt to manipulate, the price of any
			 commodity, a civil penalty of not more than $1,000,000 for each such
			 violation</quote>; and</text>
				</paragraph><paragraph id="H349351AD27C947E98249475351FED0F1"><enum>(2)</enum><text>in the second
			 sentence, by inserting before the period at the end the following: <quote>,
			 except that if the failure or refusal to obey or comply with the order involved
			 any offense under section 9(f), the registered entity, director, officer,
			 agent, or employee shall be guilty of a felony and, on conviction, shall be
			 subject to penalties under section 9(f)</quote>.</text>
				</paragraph></subsection><subsection id="HB2491F9D77CB41C39FCB18BF8DEE0621"><enum>(d)</enum><header>Action to enjoin
			 or restrain violations</header><text>Section 6c(d) of the Commodity Exchange
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/7/13a-1">7 U.S.C. 13a–1(d)</external-xref>) is amended by striking <quote>(d)</quote> and all that
			 follows through the end of paragraph (1) and inserting the following:</text>
				<quoted-block id="HA8F66D59F9D24B849D348154FDA350B8" style="OLC">
					<subsection id="H588775BD32E14EB8803CCF6FE1FFD7A1"><enum>(d)</enum><header>Civil
				penalties</header><paragraph commented="no" display-inline="yes-display-inline" id="H131453BBA2A4468AB8E77D8B5DA00000"><enum>(1)</enum><text>In any action brought
				under this section, the Commission may seek and the court shall have
				jurisdiction to impose, on a proper showing, on any person found in the action
				to have committed any violation—</text>
							<subparagraph id="HCD0F4688C4C848C2B53D43ADC5ED3390" indent="up1"><enum>(A)</enum><text>a civil penalty in the amount of not
				more than the greater of $100,000 or triple the monetary gain to the person for
				each violation; or</text>
							</subparagraph><subparagraph id="H1ED80EA127A64B5188E209D57ECCEFF6" indent="up1"><enum>(B)</enum><text>in any case of manipulation of, or an
				attempt to manipulate, the price of any commodity, a civil penalty in the
				amount of not more than the greater of $1,000,000 or triple the monetary gain
				to the person for each
				violation.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5EEC68BE6CDD4CD1A77525AF1F008C6D"><enum>(e)</enum><header>Violations
			 generally</header><text>Section 9(a) of the Commodity Exchange Act (7 U.S.C.
			 13) is amended—</text>
				<paragraph id="HEAFA3D0BB0644B23A427AAB9DCCD00B9"><enum>(1)</enum><text>by striking
			 <quote>(or $500,000 in the case of a person who is an
			 individual)</quote>;</text>
				</paragraph><paragraph id="H2D123B403ED343BCB4A5517CA29C5400"><enum>(2)</enum><text>by striking
			 <quote>five years</quote> and inserting <quote>10 years</quote>; and</text>
				</paragraph><paragraph id="HD0AA60EB655646979E003C7FCA8FDE3B"><enum>(3)</enum><text>in paragraph (2),
			 by striking <quote>false or misleading or knowingly inaccurate reports</quote>
			 and inserting <quote>knowingly false, misleading, or inaccurate
			 reports</quote>.</text>
				</paragraph></subsection></section><section id="HD54DDC7A22BE4085A638A991DFFA15ED"><enum>7.</enum><header>Conforming
			 amendments</header>
			<subsection id="H4C2C5413B1BB428D94CAA9BF5D6EA48D"><enum>(a)</enum><text>Section 2 of the
			 Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2">7 U.S.C. 2</external-xref>) is amended—</text>
