		<section display-inline="no-display-inline" id="H88FE1577164E449D85F1A5708C91AD73" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Los Angeles River Revitalization
			 Act</short-title></quote>.</text>
		</section><section id="HD4090B80FBF94463BE4903BEB3297CEC"><enum>2.</enum><header>Los Angeles River
			 revitalization, California</header>
			<subsection id="HD74B5B47A54B4388B48E60B0044B78E4"><enum>(a)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph id="H14089ECA42EB42A5A41DDC90D1BDFFB7"><enum>(1)</enum><header>City</header><text>The
			 term <term>City</term> means the city of Los Angeles, California.</text>
				</paragraph><paragraph id="HECF93E28EBE3486DB73B3B2BAE24B79"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Army.</text>
				</paragraph></subsection><subsection id="HCF91532FB317447EBF88BB6818859215"><enum>(b)</enum><header>Revitalization
			 plan</header>
				<paragraph id="H5CFDD70E3EE44D289F86536102D04272"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, in coordination with the City and in
			 consultation with appropriate Federal, State, regional, and local agencies,
			 shall—</text>
					<subparagraph id="H45AF04F8A3E9498BA51D25B64C4F421F"><enum>(A)</enum><text>prepare a
			 project-specific plan for the revitalization of the Los Angeles River that is
			 consistent with the goals of the Los Angeles River Revitalization Master Plan
			 published by the City; and</text>
					</subparagraph><subparagraph id="H5EEE8F725FFC4222AB072FBC1D9E36A4"><enum>(B)</enum><text>submit the plan to
			 Congress by not later than 3 years after the date on which funds are
			 appropriated to carry out this subsection.</text>
					</subparagraph></paragraph><paragraph id="H979476361BBC4B01BBB614F806ACEAD2"><enum>(2)</enum><header>Contents</header><text>The
			 plan under paragraph (1) shall—</text>
					<subparagraph id="H0F8916094C5D46D78D9BB17DD753F4DF"><enum>(A)</enum><text>address
			 environmental restoration, recreational, water conservation, flood control,
			 economic development, and other uses of the Los Angeles River; and</text>
					</subparagraph><subparagraph id="H0F43DE07323F4F28B0D6C86FF95021"><enum>(B)</enum><text>include—</text>
						<clause id="H50F0A913C454411C9717ACA4F4A1A6E4"><enum>(i)</enum><text>a
			 feasibility report with respect to the implementation of the plan; and</text>
						</clause><clause id="HED2D08A2D9F142CE92EF7C00004462DC"><enum>(ii)</enum><text>a
			 project-specific environmental impact statement or similar analysis required
			 under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>)
			 relating to each proposed Federal action under the plan.</text>
						</clause></subparagraph></paragraph><paragraph id="HF0C6F1DCB636498BB400F16C019D6FCC"><enum>(3)</enum><header>Use of existing
			 information and measures</header><text>In preparing and implementing the plan
			 under paragraph (1), the Secretary shall use, to the maximum extent
			 practicable—</text>
					<subparagraph id="HC9C4E1A679894380BE06B8007484ADF4"><enum>(A)</enum><text>information that
			 is available as of the date of enactment of this Act;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD46873F17BD45228532521D48EFA894"><enum>(B)</enum><text>information
			 developed under the pilot projects under subsection (c); and</text>
					</subparagraph><subparagraph id="HE1E7A57CF20C42C98819705C014CAC3E"><enum>(C)</enum><text>any measure being
			 carried out as of the date of enactment of this Act by a participating
			 agency.</text>
					</subparagraph></paragraph><paragraph id="H36D168C6A6F243A0002B61CBB5ED9C00"><enum>(4)</enum><header>Agreement</header>
					<subparagraph id="HBB6D34924D4548AEB350232CC9B4E6FC"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall offer to enter into a binding
			 agreement with the City and any other non-Federal sponsor to carry out the plan
			 under paragraph (1).</text>
					</subparagraph><subparagraph id="HAABD684EA9C247488CE301B1917B9729"><enum>(B)</enum><header>Non-Federal
			 share</header>
						<clause id="H03F5CE6A801C4C8BB48666CDC709E200"><enum>(i)</enum><header>In
			 general</header><text>The agreement under subparagraph (A) shall include
			 cost-sharing provisions under which the City and any other non-Federal sponsor
			 shall pay not less than 50 percent of the total costs of carrying out the plan
			 under paragraph (1).</text>
						</clause><clause id="HB036CA9DFF1D4207AFFF64E2E4B27155"><enum>(ii)</enum><header>Form</header><text>The
			 non-Federal share under clause (i) may be provided in cash or in-kind.</text>
						</clause><clause id="H8462821841CB431F86B5B74115774B1"><enum>(iii)</enum><header>Credit for
			 previously developed information</header><text>In calculating the non-Federal
			 share under clause (i), the Secretary shall provide to the City a credit in the
			 amount of the cost of developing any information used under paragraph
			 (3)(A).</text>
						</clause></subparagraph></paragraph><paragraph id="HAE67C81B19FF43CAAAB3DEF269F665C"><enum>(5)</enum><header>Alternatives</header>
					<subparagraph id="HF33D9F8A93A642038060AE678948BB80"><enum>(A)</enum><header>In
			 general</header><text>The Secretary, in coordination with the City, may
			 recommend, through a full and open evaluation process, any locally-preferred
			 project as an alternative to a measure proposed in the plan under paragraph
			 (1).</text>
					</subparagraph><subparagraph id="HF2D927B558544AFA005CC57C60C50758"><enum>(B)</enum><header>Inclusion in
			 feasibility report and EIS</header><text>Each recommended locally-preferred
			 project under subparagraph (A) shall be included in the feasibility report or
			 an environmental impact statement or analysis, as appropriate, under paragraph
			 (2)(B).</text>
					</subparagraph></paragraph><paragraph id="H50842EB2704A4B65B1BFB53264D4D600"><enum>(6)</enum><header>Report to
			 Congress</header><text>The Secretary shall submit to Congress a report
			 describing the implementation and results of the plan under paragraph (1) as
			 soon as practicable after the date on which the plan is carried out.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4162529A7B14402C8E843B609276E0B0"><enum>(7)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this subsection $4,000,000.</text>
				</paragraph></subsection><subsection id="HB348D253C0584698ADC6A7A7BDA5339"><enum>(c)</enum><header>Pilot
			 projects</header>
				<paragraph id="H373061BAF0704954B31CCAE474C96D8C"><enum>(1)</enum><header>In
			 general</header><text>The Secretary is authorized to construct, at any time,
			 any pilot project described in paragraph (2) in order to provide information to
			 develop, or to carry out, the revitalization plan under subsection
			 (b)(1).</text>
				</paragraph><paragraph id="H43613BEF593540B7B3E88D57544FC496"><enum>(2)</enum><header>Description of
			 projects</header><text>A pilot project referred to in paragraph (1) is a pilot
			 project for the revitalization of the Los Angeles River, including—</text>
					<subparagraph id="H01EDCE53865E4100A05EDB48CAB9C568"><enum>(A)</enum><text>a channel wall
			 texturing or other aesthetic treatment construction project;</text>
					</subparagraph><subparagraph id="HCAC393F353624CE789DA552E7B6D8EB"><enum>(B)</enum><text>a flood control
			 system that incorporates an in-channel temporary dam to pond water for
			 environmental or aesthetic purposes;</text>
					</subparagraph><subparagraph id="HBAAE6820C0354F6FA17385F13765009C"><enum>(C)</enum><text>a graffiti removal
			 or control construction project; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H25A823A63C6447AEBBC099CD884E6BED"><enum>(D)</enum><text>a wetlands or
			 riparian habitat restoration demonstration project.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCA37523EFCFE4484A64942D6647C62B3"><enum>(3)</enum><header>Agreements</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H4F00194994D34ED2B0AFD0A5A4E97264"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall offer to enter into a binding
			 agreement with the City and any other non-Federal sponsor to carry out each
			 pilot project under paragraph (1) under which the City and any other
			 non-Federal sponsor shall agree—</text>
						<clause id="H471137DA22454D6A916553AB93C97B02"><enum>(i)</enum><text>to
			 pay at least 35 percent of the total costs of the pilot project;</text>
						</clause><clause id="H27A6923AAD114B1E857E4687211780C7"><enum>(ii)</enum><text>to
			 acquire any land, easement, right-of-way, relocation, or dredged material
			 disposal area required to carry out the pilot project; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HBB4A679E13F240F6821FB45B19B66F14"><enum>(iii)</enum><text>to hold the
			 United States harmless for any claim or damage that arises in carrying out the
			 pilot project, except for a claim or damage arising from the negligence of an
			 officer or contractor of the United States.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB98AC893F9CC41D7B1A29B1DEA225F62"><enum>(B)</enum><header>Non-Federal
			 share</header>
						<clause commented="no" display-inline="no-display-inline" id="H95104419CDFA4548A3339344B5B8086F"><enum>(i)</enum><header>Form</header><text>The
			 non-Federal share under subparagraph (A)(i) may be provided in cash or
			 in-kind.</text>
						</clause><clause id="HD5856B6A2A2A4AA4BD976D004D3FF4F1"><enum>(ii)</enum><header>Credits</header>
							<subclause id="H61250633DE89433397B4A0EC3B7CE346"><enum>(I)</enum><header>In
			 general</header><text>In calculating the non-Federal share under clause (i),
			 the Secretary shall provide to the City and any other non-Federal sponsor a
			 credit (including an in-kind credit) in an amount that reflects—</text>
								<item id="HA1DEECB9B239487B8DE0C3495BF0B639"><enum>(aa)</enum><text>the
			 value of any land, easement, right-of-way, relocation, or dredged material
			 disposal area provided by the City and any other non-Federal sponsor in
			 carrying out the applicable pilot project; and</text>
								</item><item id="HEB9B46A8737348669B26E42E46DFAB09"><enum>(bb)</enum><text>the
			 reasonable cost of any work performed in connection with a study,
			 preconstruction engineering and design project, or construction project
			 required to carry out the revitalization plan under subsection (b)(1).</text>
								</item></subclause><subclause id="H0A439AD828384CF5A6F800D2D6B37E8D"><enum>(II)</enum><header>Use</header><text>A
			 credit provided under this clause may be used for any pilot project under this
			 subsection.</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC5029FEA22C3496C926790E7DC76B747"><enum>(4)</enum><header>Priority</header><text>The
			 Secretary, in consultation with the City, shall assign a priority to each pilot
			 project under this subsection.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H62343A50BF6245938824A7994E3FE4F1"><enum>(5)</enum><header>Federal
			 share</header><text>Subject to subsection (e), the Federal share of a pilot
			 project under this subsection shall not exceed $5,000,000.</text>
				</paragraph><paragraph id="HF77FE644F9D14F7188F1B4CE9664DC25"><enum>(6)</enum><header>Report to
			 Congress</header><text>The Secretary shall submit to Congress a report
			 describing each pilot project carried out under this subsection as soon as
			 practicable after the date on which the pilot project is completed.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD045A91BD71944AABDE84B3BF6637034"><enum>(7)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this subsection $35,000,000.</text>
				</paragraph></subsection><subsection id="H2932593E1E204BEA00316569ACD78409"><enum>(d)</enum><header>Water reuse
			 project</header><text>Section 219(f) of the Water Resources Development Act of
			 1992 (106 Stat. 4835; 117 Stat. 1836, 1838, 1841, 1844; 119 Stat. 2255) is
			 amended—</text>
				<paragraph id="H815049B2AFF84DC5A117AC063BEC7C"><enum>(1)</enum><text>by
			 striking <quote><header-in-text level="paragraph" style="OLC">Charleston, South
			 Carolina</header-in-text>.—$5,000,000</quote> and inserting the
			 following:</text>

			 (as redesignated by paragraph (2))—</text>

				</paragraph></subsection><subsection id="HDC00D8873F7C4555B874F13FBB1896C7"><enum>(e)</enum><header>Maximum cost of
			 projects</header><text>Each project carried out under the revitalization plan
			 under subsection (b), and each pilot project carried out under subsection (c),
			 shall be subject to section 902 of the Water Resources Development Act of 1986
			 (100 Stat. 4183).</text>
