<legis-type>A BILL</legis-type> 
<official-title>To establish an Unsolved Crimes Section in the Civil Rights Division of the Department of Justice, and an Unsolved Civil Rights Crime Investigative Office in the Civil Rights Unit of the Federal Bureau of Investigation, and for other purposes.</official-title> 
</form> 
<legis-body id="H5C88DA91582541CC9300A80393B6FF65" style="OLC"> 
<section id="H9B663BC738924DFEA08D258950B8522B" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unsolved Civil Rights Crime Act</short-title></quote>.</text></section> 
<section id="H498918654E374A4081AF5FE3C5B6E59D"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that all authorities with jurisdiction, including the Federal Bureau of Investigation and other entities within the Department of Justice, should—</text> 
<paragraph id="HC044F42AEAED4A27BEBF30EF63F27683"><enum>(1)</enum><text>expeditiously investigate unsolved civil rights murders, due to the amount of time that has passed since the murders and the age of potential witnesses; and</text></paragraph> 
<paragraph id="H06D4E7C773684D859758BBDDF4B98D3C"><enum>(2)</enum><text>provide all the resources necessary to ensure timely and thorough investigations in the cases involved.</text></paragraph></section> 
<section id="H432D4739B5E745A1B37EC6DF68050036"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H7969EBBF54034B738265064054CFBBB"><enum>(1)</enum><header>Chief</header><text>The term <term>Chief</term> means the Chief of the Section.</text></paragraph> 
<paragraph id="HDC69314EBA8E467C9809FF040092AAB8"><enum>(2)</enum><header>Chief investigator</header><text>The term <term>Chief Investigator</term> means the Chief Investigator of the Office.</text></paragraph> 
<paragraph id="H2339086EBDC4432C9E7899FE9C5B5DE2"><enum>(3)</enum><header>Criminal civil rights statutes</header><text>The term <term>criminal civil rights statutes</term> means—</text> 
<subparagraph id="H7A9BE3E26F6343BDA3EE87C62A8FB3C"><enum>(A)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/241">section 241</external-xref> of title 18, United States Code (relating to conspiracy against rights);</text></subparagraph> 
<subparagraph id="HE37EC6FEFF364F8FBADA5EDBB06727"><enum>(B)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/242">section 242</external-xref> of title 18, United States Code (relating to deprivation of rights under color of law);</text></subparagraph> 
<subparagraph id="HA52CADC2A10F498A8956EC6F28B363D4"><enum>(C)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/245">section 245</external-xref> of title 18, United States Code (relating to federally protected activities);</text></subparagraph> 
<subparagraph id="H10A2D91361254422A36222B9090544D"><enum>(D)</enum><text>sections 1581 and 1584 of title 18, United States Code (relating to involuntary servitude and peonage);</text></subparagraph> 
<subparagraph id="H97B2E4722D4E424CA9E8E6ED646ED1AE"><enum>(E)</enum><text>section 901 of the <act-name parsable-cite="FHA">Fair Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>); and</text></subparagraph> 
<subparagraph id="H6A8412B282744FCF9562EEEC106F564B"><enum>(F)</enum><text>any other Federal law that—</text> 
<clause id="H4CFA4F35D31249A4B1441378193219E8"><enum>(i)</enum><text>was in effect on or before December 31, 1969; and</text></clause> 
<clause id="HC6D9D0940E654B749BA3B3B8F4C1B281"><enum>(ii)</enum><text>the Criminal Section of the Civil Rights Division of the Department of Justice enforced, prior to the date of enactment of this Act.</text></clause></subparagraph></paragraph> 
<paragraph id="HA36FD119E6D14E0596AED481A8232D42"><enum>(4)</enum><header>Office</header><text>The term <term>Office</term> means the Unsolved Civil Rights Crime Investigative Office established under section 5.</text></paragraph> 
<paragraph id="H289C19AC06224D77B33CAB2B4D008504"><enum>(5)</enum><header>Section</header><text>The term <term>Section</term> (except when used as part of the term <term>Criminal Section</term>) means the Unsolved Crimes Section established under section 4.</text></paragraph></section> 
<section id="H108B195BB025474190AC5BC339F17C7E"><enum>4.</enum><header>Establishment of Section in Civil Rights Division</header> 
<subsection id="H6ACBDAAB0BD24D9FBD896EE335A289FB"><enum>(a)</enum><header>In general</header><text>There is established in the Civil Rights Division of the Department of Justice an Unsolved Crimes Section. The Section shall be headed by a Chief of the Section.</text></subsection> 
<subsection id="HAF240097386B4F37AB5D18CFF998B6F"><enum>(b)</enum><header>Responsibility</header> 
<paragraph id="H2A2849C6E4394F3A87983EB08D7E6B2D"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of Federal law, and except as provided in section 5, the Chief shall be responsible for investigating and prosecuting violations of criminal civil rights statutes, in cases in which a complaint alleges that such a violation—</text> 
<subparagraph id="H3E182CD78C6A4AFFAEE09BEEB0C59BD9"><enum>(A)</enum><text>occurred not later than December 31, 1969; and</text></subparagraph> 
<subparagraph id="H52514CD778014DC2AF6245577C06FE56"><enum>(B)</enum><text>resulted in a death.</text></subparagraph></paragraph> 
<paragraph id="H09CB1A6E00604BC6AAA1D4A0845EC062"><enum>(2)</enum><header>Coordination</header> 
<subparagraph id="H48B3D38E5F3E434D86E1F630CF604494"><enum>(A)</enum><header>Investigative activities</header><text>In investigating a complaint under paragraph (1), the Chief shall coordinate investigative activities with State and local law enforcement officials.</text></subparagraph> 
<subparagraph id="H2BD8BD80BF034A54BD9D50CF3D70C120"><enum>(B)</enum><header>Venue</header><text>After investigating a complaint under paragraph (1), or receiving a report of an investigation conducted under section 5, if the Chief determines that an alleged practice that is a violation of a criminal civil rights statute occurred in a State, or political subdivision of a State, that has a State or local law prohibiting the practice alleged and establishing or authorizing a State or local law enforcement official to grant or seek relief from such practice or to institute criminal proceedings with respect to the practice on receiving notice of the practice, the Chief shall consult with the official regarding the appropriate venue for the case involved.</text></subparagraph></paragraph> 
<paragraph id="HC0C6E305BDEA4185A6453DC234AE25B"><enum>(3)</enum><header>Referral</header><text>After investigating a complaint under paragraph (1), or receiving a report of an investigation conducted under section 5, the Chief shall refer the complaint to the Criminal Section of the Civil Rights Division, if the Chief determines that the subject of the complaint has violated a criminal civil rights statute in the case involved but the violation does not meet the requirements of subparagraph (A) or (B) of paragraph (1).</text></paragraph></subsection> 
<subsection id="HBFB597A50925467EB26D41F4FDB4B275"><enum>(c)</enum><header>Study and report</header> 
<paragraph id="H0618624E14794025809ED44FC17F865E"><enum>(1)</enum><header>Study</header><text>The Chief shall annually conduct a study of the cases under the jurisdiction of the Chief or under the jurisdiction of the Chief Investigator and, in conducting the study, shall determine the cases—</text> 
<subparagraph id="H2F01A608969D420BB3430046B4A309B"><enum>(A)</enum><text>for which the Chief has sufficient evidence to prosecute violations of criminal civil rights statutes; and</text></subparagraph> 
<subparagraph id="H1E80433EBF4F4EE1823431A9D8432E7F"><enum>(B)</enum><text>for which the Chief has insufficient evidence to prosecute those violations.</text></subparagraph></paragraph> 
<paragraph id="HB02EF2FED4174E45B2EB7496D00B9D"><enum>(2)</enum><header>Report</header><text>Not later than September 30 of 2006 and of each subsequent year, the Chief shall prepare and submit to Congress a report containing the results of the study conducted under paragraph (1), including a description of the cases described in paragraph (1)(B).</text></paragraph></subsection> 
<subsection id="HE7D8B30F67B145F9B600F903A821065B"><enum>(d)</enum><header>Authorization of appropriations</header> 
<paragraph id="HC0F4F02FCA8D4D858D00A00784E2D4F1"><enum>(1)</enum><header>Authorization</header><text>There is authorized to be appropriated to carry out this section $5,000,000 for fiscal year 2007 and each subsequent fiscal year.</text></paragraph> 
<paragraph id="HE821FF699BF14D4CA13B053E44DBA5B6"><enum>(2)</enum><header>Additional appropriations</header><text>Any funds appropriated under this subsection shall consist of additional appropriations for the activities described in this section, rather than funds made available through reductions in the appropriations authorized for other enforcement activities of the Department of Justice.</text></paragraph></subsection></section> 
<section id="H942CEF7B08204F999221262E996BAC22"><enum>5.</enum><header>Establishment of Office in Federal Bureau of Investigation</header> 
<subsection id="H0E75201D205B48C186A9541D21002B2E"><enum>(a)</enum><header>In general</header><text>There is established in the Civil Rights Unit of the Federal Bureau of Investigation of the Department of Justice an Unsolved Civil Rights Crime Investigative Office. The Office shall be headed by a Chief Investigator.</text></subsection> 
<subsection id="HF89C2AF4F26D4673867D1B1B3F526EBA"><enum>(b)</enum><header>Responsibility</header> 
<paragraph id="H549B0BF10B4F45C88C8DF7672FCC90FF"><enum>(1)</enum><header>In general</header><text>In accordance with an agreement established between the Chief Investigator and the Chief, the Chief Investigator shall be responsible for investigating violations of criminal civil rights statutes, in cases described in section 4(b).</text></paragraph> 
<paragraph id="H0D1FC016A3E7404690BA9C7849AE3DDD"><enum>(2)</enum><header>Coordination</header> 
<subparagraph id="H1A9EEA9C4D104CAD9B801F216C9CF2BF"><enum>(A)</enum><header>Investigative activities</header><text>In investigating a complaint under paragraph (1), the Chief Investigator shall coordinate the investigative activities with State and local law enforcement officials.</text></subparagraph> 
<subparagraph id="H4073EB84B26D47F884C7AD24F32F961F"><enum>(B)</enum><header>Referral</header><text>After investigating a complaint under paragraph (1), the Chief Investigator shall—</text> 
<clause id="HD02768AE8EEF41809FD135036F16ED15"><enum>(i)</enum><text>determine whether the subject of the complaint has violated a criminal rights statute in the case involved; and</text></clause> 
<clause id="H4EA5AF842DBF47FAAEC11DDCC2907DDF"><enum>(ii)</enum><text>refer the complaint to the Chief, together with a report containing the determination and the results of the investigation.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HE39DE8FDCA884779B8A68646D837B095"><enum>(c)</enum><header>Authorization of appropriations</header> 
<paragraph id="HFB629EFFA35844F5AD291E89F8CB4C75"><enum>(1)</enum><header>Authorization</header><text>There is authorized to be appropriated to carry out this section $5,000,000 for fiscal year 2007 and each subsequent fiscal year.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H46F9766DBB4E46FF9B940877CEF6FF6F"><enum>(2)</enum><header>Additional appropriations</header><text>Any funds appropriated under this subsection shall consist of additional appropriations for the activities described in this section, rather than funds made available through reductions in the appropriations authorized for other enforcement activities of the Department of Justice.</text></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H69B78F00BA394DD68867D765FD480085"><enum>6.</enum><header>Community Relations Service of the Department of Justice</header><text display-inline="no-display-inline">In addition to any amounts authorized to be appropriated under title XI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000h">42 U.S.C. 2000h et seq.</external-xref>), there are authorized to be appropriated to the Community Relations Service of the Department of Justice $1,500,000 for fiscal year 2007 and each subsequent fiscal year, to enable the Service (in carrying out the functions described in title X of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000g">42 U.S.C. 2000g et seq.</external-xref>)) to provide technical assistance by bringing together law enforcement agencies and communities in the investigation of violations of criminal civil rights statutes, in cases described in section 4(b).</text></section>
