<official-title>To limit Federal court jurisdiction over certain suits pertaining to the application of a price threshold in determining the volume for which suspension of royalties applies to certain offshore oil and gas leases.</official-title>

<section id="H6164E61AF51A40618BEA9686B6752B06" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deep Water Royalty Jurisdiction Act</short-title></quote>.</text></section> 
<section id="H0FCADB78702D4308B239AA11DE57DF24"><enum>2.</enum><header>Limitation on Federal court jurisdiction over questions pertaining to royalties under certain offshore oil and gas leases</header> 
<subsection id="H11B5BDBCC7904FEB897FE6436C2DED3"><enum>(a)</enum><header>Limitation on certain jurisdiction</header><text display-inline="yes-display-inline">In any case brought by any person other than a department, agency, or instrumentality of the United States, no court created by Act of Congress shall have any jurisdiction, and the Supreme Court shall have no appellate jurisdiction, to hear or decide any question pertaining to—</text> 
<paragraph id="H4B6B11DB50F840868990D6E339CD8A3"><enum>(1)</enum><text>the application of a price threshold in determining the volume for which suspension of royalties applies under section 8(a)(1)(H) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(a)(1)(H)</external-xref>) and section 304 of <external-xref legal-doc="public-law" parsable-cite="pl/104/58">Public Law 104–58</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337</external-xref> note) with respect to leases awarded in the 5-year period beginning on November 28, 1995; or</text></paragraph> 
<paragraph id="HF9809B39B4284C58ADB42C09CD3418C1"><enum>(2)</enum><text>the interpretation of, or the validity under the Constitution of, this section.</text></paragraph></subsection> 
<subsection id="H6DF42252F83E4DCFBE1197ABBC0567AD"><enum>(b)</enum><header>Certain defenses not available</header><text>In any case brought by a department, agency, or instrumentality of the United States against any person to recover royalties under the Outer Continental Shelf Lands Act, no legal or equitable defense shall be available to the defendant regarding the matters referred to in paragraph (1) or (2) of subsection (a).</text></subsection></section>
