<section section-type="section-one" id="H39DDBE1596804C8EB9D7D510C8662626" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Atchafalaya National Heritage Area Act</short-title></quote>.</text></section>
<section id="HC2A339BA89074A69A2CA8EACD3A8D9AB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="H36642C11D68A4706B66CB3CD5114AA00"><enum>(1)</enum><text>The Atchafalaya Basin area of Louisiana, designated by the Louisiana Legislature as the <quote>Atchafalaya Trace State Heritage Area</quote> and consisting of the area described in section 5(b), is an area in which natural, scenic, cultural, and historic resources form a cohesive and nationally distinctive landscape arising from patterns of human activity shaped by geography.</text></paragraph>
<paragraph id="HB6FD553E66F244498471000074773BE"><enum>(2)</enum><text>The significance of the area is enhanced by the continued use of the area by people whose traditions have helped shape the landscape.</text></paragraph>
<paragraph id="H80423F5FC25C4188B800046D5FF8003C"><enum>(3)</enum><text>There is a national interest in conserving, restoring, promoting, and interpreting the benefits of the area for the residents of, and visitors to, the area.</text></paragraph>
<paragraph id="H82991E64E8B24A87941488CA29441012"><enum>(4)</enum><text>The area represents an assemblage of rich and varied resources forming a unique aspect of the heritage of the United States.</text></paragraph>
<paragraph id="HE81173CFF0814A0A0070069DD8D1A0EE"><enum>(5)</enum><text>The area reflects a complex mixture of people and their origins, traditions, customs, beliefs, and folkways of interest to the public.</text></paragraph>
<paragraph id="H6897F924BD0746AAAA7488A558F1C87C"><enum>(6)</enum><text>The land and water of the area offer outstanding recreational opportunities, educational experiences, and potential for interpretation and scientific research.</text></paragraph>
<paragraph id="H946BD38E814847FFBD27CEF7F157D2E"><enum>(7)</enum><text>Local governments of the area support the establishment of a national heritage area.</text></paragraph></section>
<section id="H4E942B0E3A3F42BE96C13FC0CA35A43F"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
<paragraph id="HCC39A1E287CA4D729D3D13009347F8E6"><enum>(1)</enum><text>to conserve, restore, promote, and interpret the significant resource values and functions of the Atchafalaya Basin area and advance sustainable economic development of the area;</text></paragraph>
<paragraph id="HB2930AC3F2EC4720B5EBF8C4D81CD181"><enum>(2)</enum><text>to foster a close working relationship with all levels of government, the private sector, and the local communities in the area so as to enable those communities to conserve their heritage while continuing to pursue economic opportunities; and</text></paragraph>
<paragraph id="H65F4E486E0C543A0816B009E62B01F14"><enum>(3)</enum><text>to establish, in partnership with the State, local communities, preservation organizations, private corporations, and landowners in the Heritage Area, the Atchafalaya Trace State Heritage Area, as eligible parishes designated by the Louisiana Legislature, as the Atchafalaya National Heritage Area.</text></paragraph></section>
<section id="HBE15F3CDB40C457B9DE71EEC73FA46BB"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H686734197E984C39947B4F05EA274772"><enum>(1)</enum><header>Heritage Area</header><text>The term <term>Heritage Area</term> means the Atchafalaya National Heritage Area established by section 5(a).</text></paragraph>
<paragraph id="H4922A91C4E9A4FB894239097633B1EC1"><enum>(2)</enum><header>Local coordinating entity</header><text>The term <term>local coordinating entity</term> means the local coordinating entity for the Heritage Area designated by section 5(c).</text></paragraph>
<paragraph id="H549854D906634569A3C8E8082C089709"><enum>(3)</enum><header>Management plan</header><text>The term <term>management plan</term> means the management plan for the Heritage Area developed under section 7.</text></paragraph>
<paragraph id="H685B14FF594F4A38A1C097AE801020F5"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph>
<paragraph id="HD68F86DE5298442A00DB8EE86796C67D"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means the State of Louisiana.</text></paragraph></section>
<section id="H6B0536F8445843CFAE11AD75000662CA"><enum>5.</enum><header>Atchafalaya National Heritage Area</header>
<subsection id="HE91F919E18A245BEA900E072C993D8BA"><enum>(a)</enum><header>Establishment</header><text>There is established in the State the Atchafalaya National Heritage Area.</text></subsection>
<subsection id="H58928790B1584F2F852DB4F03F2B1D68"><enum>(b)</enum><header>Boundaries</header><text>The Heritage Area shall consist of parishes that are consistent with the tradition, purposes, goals, and culture of the Heritage Area as determined by the Secretary in consultation with the State. The Secretary shall give priority consideration to those parishes in Atchafalaya State Heritage Area.</text></subsection>
<subsection id="H53CAAD4A09354952A373EA2EB22D3E9D"><enum>(c)</enum><header>Local coordinating entity</header>
<paragraph id="H84A0F82EBC78405A8E669197E1AF213E"><enum>(1)</enum><header>In general</header><text>The Atchafalaya Trace Commission shall be the local coordinating entity for the Heritage Area.</text></paragraph>
<paragraph id="H0516C84647524117AB94EC2F40438FEB"><enum>(2)</enum><header>Composition</header><text>The local coordinating entity shall be composed of 1 member appointed by the governing authority of each parish within the Heritage Area.</text></paragraph></subsection></section>
<section id="H43A6272DB7A346929C4645AD5671AD55"><enum>6.</enum><header>Authorities and duties of the local coordinating entity</header>
<subsection id="HAA6ED74EEFF34E39B8D923E2FC7D3CAB"><enum>(a)</enum><header>Authorities</header><text>For the purposes of developing and implementing the management plan approved by the Secretary, the local coordinating entity may—</text>
<paragraph id="H6D99EC540A1F4F979B8F3E315BAC1EBD"><enum>(1)</enum><text>make grants to, and enter into cooperative agreements with, the State, units of local government, and private organizations;</text></paragraph>
<paragraph id="H34DB6E6A51B442749911A43E956990F9"><enum>(2)</enum><text>hire and compensate staff; and</text></paragraph>
<paragraph id="HE992CEB61986447599A00016755807E4"><enum>(3)</enum><text>enter into contracts for goods and services.</text></paragraph></subsection>
<subsection id="HD4C54D393F994910BBF2EDD49913517C"><enum>(b)</enum><header>Duties</header><text>The local coordinating entity shall—</text>
<paragraph id="H246D2779044D4019A98B35D9DCFB8D57"><enum>(1)</enum><text>submit to the Secretary for approval a management plan;</text></paragraph>
<paragraph id="H2913E6B569B3448AA5CD122C007F8BED"><enum>(2)</enum><text>implement the management plan, including providing assistance to units of government and others in—</text>
<subparagraph id="H3B08C15EA3104C4C9F9D3819007D144E"><enum>(A)</enum><text>carrying out programs that recognize important resource values within the Heritage Area;</text></subparagraph>
<subparagraph id="HDD6739621C9046C7985CA7CADDB4A436"><enum>(B)</enum><text>encouraging sustainable economic development within the Heritage Area;</text></subparagraph>
<subparagraph id="H0565A9D50661456B9D87F9C5BAF5DF35"><enum>(C)</enum><text>establishing and maintaining interpretive sites within the Heritage Area; and</text></subparagraph>
<subparagraph id="HA329F6AB0FE246358CCCE227FF7CD4A2"><enum>(D)</enum><text>increasing public awareness and appreciation for the natural, historic, and cultural resources of the Heritage Area;</text></subparagraph></paragraph>
<paragraph id="H524ACE35052F404AA006D29189BB9C24"><enum>(3)</enum><text>adopt bylaws governing the conduct of the local coordinating entity; and</text></paragraph>
<paragraph id="HE9B975A89C7B440FAA7F78053586CAB2"><enum>(4)</enum><text>for any year for which Federal funds are received under this Act, submit to the Secretary a report that describes, for the year—</text>
<subparagraph id="H21EF244050694A4B83BF009E68714273"><enum>(A)</enum><text>the accomplishments of the local coordinating entity; and</text></subparagraph>
<subparagraph id="H5DE9E46CE9B84E0A8E097802E0E781B4"><enum>(B)</enum><text>the expenses and income of the local coordinating entity.</text></subparagraph></paragraph></subsection>
<subsection id="H06E5F300AB9E4E63BDA4AC3237E7003B"><enum>(c)</enum><header>Acquisition of real property</header><text>No Federal funds authorized under this Act may be used to acquire real property or any interest in real property.</text></subsection>
<subsection id="HBA81F48E30E54E609955D2EBB445AB52"><enum>(d)</enum><header>Public meetings</header><text>The local coordinating entity shall conduct public meetings at least quarterly.</text></subsection></section>
<section id="H26B15EA65D5B45E08B7200F2A4FA4D2C"><enum>7.</enum><header>Management plan</header>
<subsection id="HBD40422C4B4D4DF390C5D5A1FB35D082"><enum>(a)</enum><header>In general</header><text>The local coordinating entity shall develop a management plan for the Heritage Area that incorporates an integrated and cooperative approach to conserve, interpret, and enhance the natural, scenic, cultural, historic, and recreational resources of the Heritage Area consistent with local, State and Federal land use laws and compatible with the economic viability of the Heritage Area.</text></subsection>
<subsection id="HEE6536218CA546BA85FB5CD7F50FB45"><enum>(b)</enum><header>Consideration of other plans and actions</header><text>In developing the management plan, the local coordinating entity shall—</text>
<paragraph id="HC35E3604CAAE4A14B0B023073E84B3F0"><enum>(1)</enum><text>take into consideration Federal, State, and local plans land use, laws, and plans; and</text></paragraph>
<paragraph id="HAC9ED383941944F09894ECE04BD1E802"><enum>(2)</enum><text>invite the participation of residents, public agencies, and private organizations in the Heritage Area.</text></paragraph></subsection>
<subsection id="H7E65F577FFBE47BEA22E161C2237B2AC"><enum>(c)</enum><header>Contents</header><text>The management plan shall include—</text>
<paragraph id="H4E8ADF37A9C54F3F952DBBC4A7B2215B"><enum>(1)</enum><text>an inventory of the resources in the Heritage Area, including—</text>
<subparagraph id="H2B4F888C9E2041FF8DA85CFBB05EC3D6"><enum>(A)</enum><text>a list of property in the Heritage Area that—</text>
<clause id="H01E48ABA6AE7442EB8F9C626DD6327D2"><enum>(i)</enum><text>relates to the purposes of the Heritage Area; and</text></clause>
<clause id="H1A45765C6ED649DE967BAF97C0FF684B"><enum>(ii)</enum><text>should be preserved, restored, managed, or maintained because of the significance of the property; and</text></clause></subparagraph>
<subparagraph id="H25D84933E3DE4E3B8862CC40004D7C40"><enum>(B)</enum><text>an assessment of cultural landscapes within the Heritage Area;</text></subparagraph></paragraph>
<paragraph id="H16E1AEF19AED4F2BBDFD320208D400E9"><enum>(2)</enum><text>provisions for the conservation, interpretation, and enjoyment of the resources of the Heritage Area identified in the management plan and found by the Secretary to be consistent with this Act and consistent with economic viability of the Heritage Area;</text></paragraph>
<paragraph id="H289BBDEA6B2B4B4284B4CC2213833139"><enum>(3)</enum><text>an interpretation plan for the Heritage Area; and</text></paragraph>
<paragraph id="H43BD23A48C5C4D0BA2A9C1496392BCC"><enum>(4)</enum><text>a program for implementation of the management plan that includes—</text>
<subparagraph id="HDF6CF958977045349323C4A1E21A983"><enum>(A)</enum><text>actions that may be carried out by units of government, private organizations, and public-private partnerships to protect the resources of the Heritage Area; and</text></subparagraph>
<subparagraph id="H1A48338AAA7A483700FD39DC25F2F15F"><enum>(B)</enum><text>the identification of existing and potential sources of funding for implementing the plan.</text></subparagraph></paragraph></subsection>
<subsection id="H6B33191A6DD240178016D130A8F2DB8"><enum>(d)</enum><header>Submission to Secretary for approval</header>
<paragraph id="H97F6EFDF94C04B4D93EA1FF211FB477F"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of the enactment of this Act, the local coordinating entity shall submit the management plan to the Secretary for approval.</text></paragraph>
<paragraph id="H6CCC3202902E405600ABC68965B57CCE"><enum>(2)</enum><header>Effect of failure to submit</header><text>If a management plan is not submitted to the Secretary by the date specified in paragraph (1), the Secretary shall not provide any additional funding under this Act until a management plan for the Heritage Area is submitted to the Secretary.</text></paragraph></subsection>
<subsection id="H0A12CFC6A8A143DB90AC9F4045973EA"><enum>(e)</enum><header>Approval</header>
<paragraph id="H05933535E85A4FF18FA0F3CABA43759"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after receiving the management plan submitted under subsection (d)(1), the Secretary, in consultation with the State, shall approve or disapprove the management plan.</text></paragraph>
<paragraph id="H107A1B2112464611B24E6002699546AD"><enum>(2)</enum><header>Action following disapproval</header>
<subparagraph id="H43AC615CAA224C70B0069FAB6BACF1"><enum>(A)</enum><header>In general</header><text>If the Secretary disapproves a management plan under paragraph (1), the Secretary shall—</text>
<clause id="H02C981170FBB45A6A4FC2DBAA2E76A0"><enum>(i)</enum><text>advise the local coordinating entity in writing of the reasons for the disapproval;</text></clause>
<clause id="H34D64C8CEC804353B6DCDCADFC163476"><enum>(ii)</enum><text>make recommendations for revisions to the management plan; and</text></clause>
<clause id="HF73B786EF55C4EE4B5AD65C1102B01FA"><enum>(iii)</enum><text>allow the local coordinating entity to submit to the Secretary revisions to the management plan.</text></clause></subparagraph>
<subparagraph id="H985EF14A78F54FDDB1B6CA42F823BF4"><enum>(B)</enum><header>Deadline for approval of revision</header><text>Not later than 90 days after the date on which a revision is submitted under subparagraph (A)(iii), the Secretary shall approve or disapprove the revision.</text></subparagraph></paragraph></subsection>
<subsection id="H183C92213AFC46318DB837C18D6E5687"><enum>(f)</enum><header>Revision</header>
<paragraph id="H559976AE49844060837B309C3B2BF33F"><enum>(1)</enum><header>In general</header><text>After approval by the Secretary of a management plan, the local coordinating entity shall periodically—</text>
<subparagraph id="HFB2561C82A1A4502A263D73E21852FD0"><enum>(A)</enum><text>review the management plan; and</text></subparagraph>
<subparagraph id="HF5BC62EC1EBE420EB12BEAB293EB7C"><enum>(B)</enum><text>submit to the Secretary, for review and approval by the Secretary, the recommendations of the local coordinating entity for any revisions to the management plan that the local coordinating entity considers to be appropriate.</text></subparagraph></paragraph>
<paragraph id="H32E5FBC85E624DC6A724D4D5C1BE23B8"><enum>(2)</enum><header>Expenditure of funds</header><text>Funds made available under this Act shall be used only to implement the approved management plan.</text></paragraph></subsection></section>
<section id="H70DFB7D3EDE94730816048B152596237"><enum>8.</enum><header>Requirements for inclusion of private property</header>
<subsection id="HB8151B4851E94728A6BD42E8BB95622F"><enum>(a)</enum><header>Notification and consent of property owners required</header><text>No privately owned property shall be preserved, conserved, or promoted by the management plan for the Heritage Area until the owner of that private property has been notified in writing by the management entity and has given written consent to the management entity for such preservation, conservation, or promotion.</text></subsection>
<subsection id="H99B90DFED96A4C2B90ADE78B3F5CB6D4"><enum>(b)</enum><header>Landowner withdraw</header><text>Any owner of private property included within the boundary of the Heritage Area shall have that private property immediately removed from the boundary by submitting a written request to the management entity.</text></subsection></section>
<section id="H8ECDA368B59D4524A11E90A900EE8409"><enum>9.</enum><header>Private property protection</header>
<subsection id="HB2F8BBC371C04DBA84AB5CEC87AE5245"><enum>(a)</enum><header>Access to private property</header><text>Nothing in this Act shall be construed to—</text>
<paragraph id="H114B6BC3530A4F21924B1FE748D84903"><enum>(1)</enum><text>require any private property owner to allow public access (including Federal, State, or local government access) to such private property; or</text></paragraph>
<paragraph id="HAC263C305D5C4ED4BA00107E8E3311CC"><enum>(2)</enum><text>modify any provision of Federal, State, or local law with regard to public access to or use of private property.</text></paragraph></subsection>
<subsection id="HCAE9B71540404D5F85D2D7055FEBA102"><enum>(b)</enum><header>Liability</header><text>Designation of the Heritage Area shall not be considered to create any liability, or to have any effect on any liability under any other law, of any private property owner with respect to any persons injured on that private property.</text></subsection>
<subsection id="HB9D52CF753364787BC9369DC454FE00"><enum>(c)</enum><header>Participation of private property owners in Heritage Area</header><text>Nothing in this Act shall be construed to require the owner of any private property located within the boundaries of the Heritage Area to participate in or be associated with the Heritage Area.</text></subsection></section>
<section id="HEB5FF315B81C48A180634836D2DDCA44"><enum>10.</enum><header>Effect of Act</header><text display-inline="no-display-inline">Nothing in this Act—</text>
<paragraph id="HE4E1F96041924FE19059CB32F91BCD37"><enum>(1)</enum><text>grants any Federal agency regulatory authority over any interest in the Heritage Area, unless cooperatively agreed to by all involved parties;</text></paragraph>
<paragraph id="HD9015DC8E1534CBB9976D870E16500A2"><enum>(2)</enum><text>modifies, enlarges, or diminishes any authority of the Federal, or State, or local government to regulate any use of land as provided for by law (including regulations) in existence on the date of the enactment of this Act;</text></paragraph>
<paragraph id="HA923701C26DA4852AB0406AF0453B2EA"><enum>(3)</enum><text>grants any power of zoning or land use to the local coordinating entity;</text></paragraph>
<paragraph id="HBFEACE2DBD1F47748F27F7A6D5875323"><enum>(4)</enum><text>imposes any environmental, occupational, safety, or other rule, standard, or permitting process that is different from those in effect on the date of enactment of this Act that would be applicable had the Heritage Area not been established;</text></paragraph>
<paragraph id="H72FEF9BFA0F0404CB76B79A62C31BDD7"><enum>(5)</enum><text>imposes any change in Federal environmental quality standards;</text></paragraph>
<paragraph id="HB4CA8F974FD74591002200E9ED942920"><enum>(6)</enum><text>abridges, restricts, or alters any applicable rule, standard, or review procedure for permitting of facilities within or adjacent to the Heritage Area; or</text></paragraph>
<paragraph id="H423391EF2CDD4A90AF006E17E2D58375"><enum>(7)</enum><text>affects the continuing use and operation, where located on the date of enactment of this Act, of any public or private facility, including any public utility or common carrier.</text></paragraph></section>
<section id="H33A7AE62151644BA00293F5FBC5B6589"><enum>11.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $10,000,000, of which not more than $1,000,000 shall be made available for any fiscal year.</text></section>
