<official-title>To amend the Animal Welfare Act to ensure that all dogs and cats used by research facilities are obtained legally.</official-title>

<section commented="no" display-inline="no-display-inline" id="H6D1A48FA50FE4DB3A47689CAFFCDE1B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pet Safety and Protection Act of 2005</short-title></quote>.</text></section>
<section commented="no" display-inline="no-display-inline" id="HB99512EE6D20446CB3081D036032ADF9" section-type="subsequent-section"><enum>2.</enum><header>Protection of pets</header>
<subsection commented="no" display-inline="no-display-inline" id="HDE67943BF54D4312A5EC79C77B9C7FA"><enum>(a)</enum><header>Research facilities</header><text display-inline="yes-display-inline">Section 7 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2137">7 U.S.C. 2137</external-xref>) is amended to read as follows:</text>

<section commented="no" display-inline="no-display-inline" id="H3301107EED384B6CB996E33FF38464D" section-type="subsequent-section"><enum>7.</enum><header>Sources of dogs and cats for research facilities</header>
<subsection commented="no" display-inline="no-display-inline" id="H8F27020EBF764D559B84FB00EE2FD841"><enum>(a)</enum><header>Definition of person</header><text display-inline="yes-display-inline">In this section, the term <term>person</term> means any individual, partnership, firm, joint stock company, corporation, association, trust, estate, pound, shelter, or other legal entity.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H35B5500C6ED64C5FB8082100F72B5296"><enum>(b)</enum><header>Use of dogs and cats</header><text display-inline="yes-display-inline">No research facility or Federal research facility may use a dog or cat for research or educational purposes if the dog or cat was obtained from a person other than a person described in subsection (d).</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HA93F88E609B54068A4577FD42120C402"><enum>(c)</enum><header>Selling, donating, or offering dogs and cats</header><text display-inline="yes-display-inline">No person, other than a person described in subsection (d), may sell, donate, or offer a dog or cat to any research facility or Federal research facility.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H15D6FED892A149E3A7E5F14A5F9E62E"><enum>(d)</enum><header>Permissible sources</header><text display-inline="yes-display-inline">A person from whom a research facility or a Federal research facility may obtain a dog or cat for research or educational purposes under subsection (b), and a person who may sell, donate, or offer a dog or cat to a research facility or a Federal research facility under subsection (c), shall be—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H925103A1B6074D07A0D6FC185D23F207"><enum>(1)</enum><text display-inline="yes-display-inline">a dealer licensed under section 3 that has bred and raised the dog or cat;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HCBA6A7AE58CB4A29AA00D6BE6900FDDB"><enum>(2)</enum><text display-inline="yes-display-inline">a publicly owned and operated pound or shelter that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H43F82D5B6CA04C73B2A6BB6E21B6BD95"><enum>(A)</enum><text display-inline="yes-display-inline">is registered with the Secretary;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9633676438F6466E94C8D632CE34323F"><enum>(B)</enum><text display-inline="yes-display-inline">is in compliance with section 28(a)(1) and with the requirements for dealers in subsections (b) and (c) of section 28; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HBA6FECA39C654DBC8D2BD802FCC08274"><enum>(C)</enum><text display-inline="yes-display-inline">obtained the dog or cat from its legal owner, other than a pound or shelter;</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H81E7DAEC42154A89A61B9D46419EA0B"><enum>(3)</enum><text display-inline="yes-display-inline">a person that is donating the dog or cat and that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HF27224394C714D8EBC07B49E84B73BB9"><enum>(A)</enum><text display-inline="yes-display-inline">bred and raised the dog or cat; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB148360E93174680ADB89C0B8C8AC5F"><enum>(B)</enum><text display-inline="yes-display-inline">owned the dog or cat for not less than 1 year immediately preceding the donation;</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4B45F17E59B94F5F8088A110C2005B17"><enum>(4)</enum><text display-inline="yes-display-inline">a research facility licensed by the Secretary; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H2D1BB59FE4BC4844AFC5BF7260AE1268"><enum>(5)</enum><text display-inline="yes-display-inline">a Federal research facility licensed by the Secretary.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H2E056ABC9C63445A9B0041565D9733DA"><enum>(e)</enum><header>Penalties</header>
<paragraph commented="no" display-inline="no-display-inline" id="HEB3925CAC75841A5B4CA58AC2D23A7F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A person that violates this section shall be fined $1,000 for each violation.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD055325B5A7B48F5BA5BACE650014CE"><enum>(2)</enum><header>Additional penalty</header><text display-inline="yes-display-inline">A penalty under this subsection shall be in addition to any other applicable penalty.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H1C07E11FF9384756A57BD61FE1170553"><enum>(f)</enum><header>No required sale or donation</header><text display-inline="yes-display-inline">Nothing in this section requires a pound or shelter to sell, donate, or offer a dog or cat to a research facility or Federal research facility.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HE5B5D0CA73264F67900006EE008CA0EE"><enum>(b)</enum><header>Federal research facilities</header><text display-inline="yes-display-inline">Section 8 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2138">7 U.S.C. 2138</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HED01F06CACBB4C27917D5EABBEE692AD"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Sec. 8. No department</quote> and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="H774A18446B01458596F9213E32C95900" style="OLC">
<section commented="no" display-inline="no-display-inline" id="HF1184038F4E34FE48B61DDBF4ECF5C17" section-type="subsequent-section"><enum>8.</enum><header>Federal research facilities</header><text display-inline="no-display-inline">Except as provided in section 7, no department</text></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBAAC831AB45B459BA61C3D0335001711"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>research or experimentation or</quote>; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H86328564BC224C1CBA11A68FCC4DA622"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>such purposes</quote> and inserting <quote>that purpose</quote>.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H4B53450C70D14EAABA2D376E8FB44FD6"><enum>(c)</enum><header>Certification</header><text display-inline="yes-display-inline">Section 28(b)(1) of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2158">7 U.S.C. 2158(b)(1)</external-xref>) is amended by striking <quote>individual or entity</quote> and inserting <quote>research facility or Federal research facility</quote>.</text></subsection></section>
<section changed="not-changed" commented="no" display-inline="no-display-inline" id="H643D96726674413BB9F6893F8D6CD01E" section-type="subsequent-section"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by section 2 take effect on the date that is 90 days after the date of enactment of this Act.</text></section>
