		<section display-inline="no-display-inline" id="HDDE00A6F120546628B9DC76500D48BF8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Judicial Transparency and Ethics
			 Enhancement Act of 2006</short-title></quote>.</text>
		</section><section id="HBC366A43E7D64BA2A200B63FD66C42AD"><enum>2.</enum><header>Inspector General
			 for the Judicial Branch</header>
			<subsection id="H1C8A745DE5CB4813A041270487D79792"><enum>(a)</enum><header>Creation and
			 duties</header><text>Part III of title 28, United States Code, is amended by
			 adding at the end the following:</text>

				for the Judicial Branch</header>

						<section id="HB31D4EC1F132420682D0B914A890C7CC"><enum>1021.
				</enum><header>Establishment</header><text display-inline="no-display-inline">There is established for the judicial branch
				of the Government the Office of Inspector General for the Judicial Branch
				(hereinafter in this chapter referred to as the <quote>Office</quote>).</text>
						</section><section id="HFBD7E466BDB0493587D03B9804B29E70"><enum>1022.</enum><header>Appointment of
				Inspector General</header><text display-inline="no-display-inline">The head of
				the Office shall be the Inspector General, who shall be appointed by the Chief
				Justice of the United States after consultation with the majority and minority
				leaders of the Senate and the Speaker and minority leader of the House of
				Representatives.</text>
						</section><section id="H5ADAF4B6035147D982A479BA8EDAC553"><enum>1023.</enum><header>Duties</header><text display-inline="no-display-inline">With respect to the Judicial Branch, other
				than the United States Supreme Court, the Office shall—</text>
							<paragraph id="H338DEB4856CE483995C353637EFCC500"><enum>(1)</enum><text display-inline="yes-display-inline">conduct investigations of matters
				pertaining to the Judicial Branch, including possible misconduct in office of
				judges and proceedings under chapter 16 of this title, that may require
				oversight or other action within the Judicial Branch or by Congress;</text>
							</paragraph><paragraph id="H7DE133FA70D244DE9FFA980035034986"><enum>(2)</enum><text display-inline="yes-display-inline">conduct and supervise audits and
				investigations;</text>
							</paragraph><paragraph id="HC42F7348872744908CEAD82E64CDD104"><enum>(3)</enum><text display-inline="yes-display-inline">prevent and detect waste, fraud, and abuse;
				and</text>
							</paragraph><paragraph id="HC623C9E1FC21487A92654D01145026C7"><enum>(4)</enum><text display-inline="yes-display-inline">recommend changes in laws or regulations
				governing the Judicial Branch.</text>
							</paragraph></section><section id="HF9149AE8DC3D4FEEA3D212F6B9CEA5E5"><enum>1024.</enum><header>Powers</header><text display-inline="no-display-inline">In carrying out the duties of the Office,
				the Inspector General shall have the power—</text>
							<paragraph id="HA1A208EDF63E4D93AD060123D2018BEE"><enum>(1)</enum><text>to make
				investigations and reports;</text>
							</paragraph><paragraph id="HC8EF9D08B77D44309BD7C3DFAD70D119"><enum>(2)</enum><text>to obtain
				information or assistance from any Federal, State, or local governmental
				agency, or other entity, or unit thereof, including all information kept in the
				course of business by the Judicial Conference of the United States, the
				judicial councils of circuits, the Administrative Office of the United States
				Courts, and the United States Sentencing Commission;</text>
							</paragraph><paragraph id="H52D0C74A1ADC4A8900D00246036DA041"><enum>(3)</enum><text>to require, by
				subpoena or otherwise, the attendance and testimony of such witnesses, and the
				production of such books, records, correspondence memoranda, papers, and
				documents, which subpoena, in the case of contumacy or refusal to obey, shall
				be enforceable by civil action;</text>
							</paragraph><paragraph id="H6BFF8E5278FD4616A88C1D45AB205D67"><enum>(4)</enum><text>to administer to
				or take from any person an oath, affirmation, or affidavit;</text>
							</paragraph><paragraph id="H0DA7134065004BA2AD23F2AED56F881F"><enum>(5)</enum><text>to employ such
				officers and employees, subject to the provisions of title 5, United States
				Code, governing appointments in the competitive service, and the provisions of
				chapter 51 and subchapter III of chapter 53 of such title relating to
				classification and General Schedule pay rates;</text>
							</paragraph><paragraph id="H6E9DBCF5CCA14C1F98E4869C91F11E53"><enum>(6)</enum><text>to obtain services
				as authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code, at daily rates
				not to exceed the equivalent rate prescribed for grade GS–18 of the General
				Schedule by <external-xref legal-doc="usc" parsable-cite="usc/5/5332">section 5332</external-xref> of title 5, United States Code; and</text>
							</paragraph><paragraph id="H6BDA537A627049BE99C8B49BCBC4FD00"><enum>(7)</enum><text>to the extent and
				in such amounts as may be provided in advance by appropriations Acts, to enter
				into contracts and other arrangements for audits, studies, analyses, and other
				services with public agencies and with private persons, and to make such
				payments as may be necessary to carry out the duties of the Office.</text>
							</paragraph></section><section id="H00559AD8FEE34CC2BE0041F23F6F6663"><enum>1025.</enum><header>Reports</header>
							<subsection id="H741EAA4F587E4C379B91A4ED61F86D5B"><enum>(a)</enum><header>When to be
				made</header><text>The Inspector General shall—</text>
								<paragraph id="HBAE62D77399F447081E3F506A719ED6"><enum>(1)</enum><text>make an annual
				report to the Chief Justice and to Congress relating to the activities of the
				Office; and</text>
								</paragraph><paragraph id="H8FF478FFA0134227B628105C37857D4E"><enum>(2)</enum><text>make prompt
				reports to the Chief Justice and to Congress on matters that may require action
				by them.</text>
								</paragraph></subsection><subsection id="H8CC94400F4674951857C3D874818E5A2"><enum>(b)</enum><header>Sensitive
				matter</header><text display-inline="yes-display-inline">If a report contains
				sensitive matter, the Inspector General may so indicate and Congress may
				receive that report in closed session.</text>
							</subsection><subsection id="H08334753B281481280FE2E575232EE6E"><enum>(c)</enum><header>Duty to inform
				Attorney General</header><text display-inline="yes-display-inline">In carrying
				out the duties of the Office, the Inspector General shall report expeditiously
				to the Attorney General whenever the Inspector General has reasonable grounds
				to believe there has been a violation of Federal criminal law.</text>
							</subsection></section><section id="HBCEE8C4F9C88491C8D5530983B3B9D33"><enum>1026.</enum><header>Whistleblower
				protection</header>
							<subsection id="HD6E6ED10B9954A218400017008593362"><enum>(a)</enum><header>In
				General</header><text display-inline="yes-display-inline">No officer, employee,
				agent, contractor or subcontractor in the Judicial Branch may discharge,
				demote, threaten, suspend, harass or in any other manner discriminate against
				an employee in the terms and conditions of employment because of any lawful act
				done by the employee to provide information, cause information to be provided,
				or otherwise assist in an investigation regarding any possible violation of
				Federal law or regulation, or misconduct, by a judge or any other employee in
				the Judicial Branch, which may assist the Inspector General in the performance
				of duties under this chapter.</text>
							</subsection><subsection id="H4C089EB0BF39446200EA1B3EB5AC0880"><enum>(b)</enum><header>Civil
				Action</header><text>An employee injured by a violation of subsection (a) may,
				in a civil action, obtain appropriate
				relief.</text>
							</subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF1809937713343C1B82D895FE8F25FC3"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of chapters for part III of title 28, United
			 States Code, is amended by adding at the end the following new item:</text>
