<official-title>To direct the Secretary of Commerce to provide emergency disaster assistance to mitigate the economic losses caused by declining Klamath River salmon and to develop and implement a research and recovery plan for Klamath River salmon, and for other purposes.</official-title>

<section id="HBF44B032FAAD4E00876F7B3CC8EC5E69" section-type="section-one"><enum>1.</enum><header>Implementation of Klamath River salmon protection measures and disaster assistance</header> 
<subsection id="HE13F4968D0E04E12BBB9D3E7D69014C6"><enum>(a)</enum><header>Klamath River Fall Chinook and Coho salmon protection measures</header> 
<paragraph id="H1B71768BBEB846C3B156A27E28F66D50"><enum>(1)</enum><header>In general</header><text>The Secretary of Commerce shall develop and implement a coordinated, comprehensive research and recovery program for Klamath River Fall Chinook salmon and Klamath River Fall Coho salmon.</text></paragraph> 
<paragraph id="H8D8B43ECABA14E569B91D00000FF4466"><enum>(2)</enum><header>Program features</header><text>The program shall be designed to study or implement—</text> 
<subparagraph id="H54FC54E5024F414485CAAA5C75EE5CA0"><enum>(A)</enum><text>in-river monitoring of Ceratomyxa Shasta and Parvicapsula minibicornus, and implementation of any immediate protective measures against such pathogens;</text></subparagraph> 
<subparagraph id="H08D051A334D14DF3A845F7F100C1ABD7"><enum>(B)</enum><text display-inline="yes-display-inline">additional ocean and in-river fisheries population monitoring;</text></subparagraph> 
<subparagraph id="H8550A3E70EE24BBAB4B4B4CAF5CF22BD"><enum>(C)</enum><text>completion of a recovery plan for Coho salmon on the Klamath River;</text></subparagraph> 
<subparagraph id="H2220F1D3AC7D4CEFB82069E580598DDC"><enum>(D)</enum><text>operation and maintenance of stream gauges for flow monitoring on the Klamath River and its tributaries, including the Shasta, Scott, Salmon and Trinity Rivers;</text></subparagraph> 
<subparagraph id="HF3CD3D17BF504BCD92001424A5AA0428"><enum>(E)</enum><text>fish passage in the Klamath National Forest, and Six Rivers National Forest; and</text></subparagraph> 
<subparagraph id="H17065A3E18DE498A828CF4F479F8FD7E"><enum>(F)</enum><text>restoration of aquatic habitats in the Klamath River basin with emphasis on the Klamath and its tributaries below Iron Gate Dam.</text></subparagraph></paragraph> 
<paragraph id="H99FCF4EA8E0E4804BF53583CAA3B00C9"><enum>(3)</enum><header>Deadline for issuance of recovery plan</header><text>The Secretary shall issue a recovery plan for Coho salmon on the Klamath River for purposes of paragraph (2)(C) by not later than 6 months after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="H84A4BEC1B8FB4BC9AC232C3E18EE8C4B"><enum>(4)</enum><header>Appropriation</header> 
<subparagraph id="HB383CABB6A6147B8BD503BB562AFECC"><enum>(A)</enum><header>In general</header><text>To implement out the program developed under this subsection, there is appropriated to the Secretary of Commerce $45,000,000, which shall remain available until expended.</text> </subparagraph> 
<subparagraph id="H3631D634759D443F839684008BA04F48"><enum>(B)</enum><header>Limitation on use of funds</header><text>None of the amounts appropriated under this paragraph may be distributed before the date the Secretary issues a salmon recovery plan under paragraph (3).</text></subparagraph></paragraph></subsection> 
<subsection id="HBA88231ACE554DF49C16C05247E24902"><enum>(b)</enum><header>Emergency disaster assistance</header> 
<paragraph id="H9FBC0D51A6FE47C5B8928CD54EA086B6"><enum>(1)</enum><header>Authorization of payment</header><text>The Secretary of Commerce shall make a direct payment to the Pacific States Marine Fisheries Commission to distribute to fishing communities, Indian tribes, businesses, holders of community development quotas issued under the Magnuson-Stevens Fishery Conservation and Management Act, individuals, and other entities as emergency disaster assistance to mitigate the economic losses caused by declining Klamath River Fall Chinook salmon.</text></paragraph> 
<paragraph id="H677993DEAB7F45E398B2008C7F25B931"><enum>(2)</enum><header>Payment recipient reports</header><text display-inline="yes-display-inline">The Secretary of Commerce shall require that the Pacific States Marine Fisheries Commission shall, within 6 months after receiving a payment under this subsection, submit to the Secretary of Commerce and the Committee on Appropriations of the House of Representatives and the Senate a report describing the persons to whom the payment was distributed and the rationale for such distributions.</text></paragraph> 
<paragraph id="HE426A9CAC9774CEA910000EFFEE76CD1"><enum>(3)</enum><header>Exclusion of payments from gross income</header><text>For purposes of the Internal Revenue Code of 1986—</text> 
<subparagraph id="H5234C48075EC4033B4C19FB445001304"><enum>(A)</enum><header>Exclusion</header><text>Gross income shall not include any amount received as a payment or distribution under paragraph (1).</text></subparagraph> 
<subparagraph id="H0F0029DB61CB45C39884EEDF54EED100"><enum>(B)</enum><header>Denial of double benefit</header><text>Rules similar to the rules of subsections (g)(3) and (h) of section 139 of such Code shall apply with respect to any amount excluded under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H73ED2873F0DC4F7490EF5615AA1C00D4"><enum>(4)</enum><header>Appropriation</header><text>There is appropriated to the Secretary of Commerce $81,000,000 to make payments under this subsection. Any amount appropriated pursuant to this subsection that is not used or otherwise obligated shall be returned to the fund of the Treasury.</text> </paragraph> </subsection> 
<subsection id="H3AD83721DBB6456C967D63F182F401C5"><enum>(c)</enum><header>Reports by Secretaries</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, and annually thereafter, the Secretary of Commerce shall report to the Congress on progress in implementing subsection (a) and specifically note how projects under subsection (a) have increased water quantity, improved water quality, increased salmon populations, and specifically benefited salmon spawning habitat.</text></subsection></section>
