<section id="H3ADD1ABE4ED842F10025BC415FA7DF82" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Senior Citizen’s Improved Quality of Life Act</short-title></quote>.</text></section> 
<section id="HBDEAFB7A14CF4FEABFD6C0A122F2486" section-type="subsequent-section"><enum>2.</enum><header>Preservation of Social Security</header> 
<subsection id="H0829DEBEEE9D4CD796C8305034DE2163"><enum>(a)</enum><header>Investment of the Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund</header> 
<paragraph id="HE2EE9861F657455CB543F62F308BE615"><enum>(1)</enum><header>In general</header><text>Section 201(d) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401(d)</external-xref>) is amended—</text> 
<subparagraph id="HE67A335D3252460891F523932013F7CB"><enum>(A)</enum><text>by inserting <quote>(1)</quote> after <quote>(d)</quote>;</text></subparagraph> 
<subparagraph id="H1147643EED0A4001BDF62845D2651F2F"><enum>(B)</enum><text>by striking <quote>Such investments may be made only</quote> and inserting the following: <quote>Except as provided in paragraph (2), such investments may be made only</quote>;</text></subparagraph> 
<subparagraph id="HD74A7561C8734FE78094013289947100"><enum>(C)</enum><text>by striking the last sentence; and</text></subparagraph> 
<subparagraph id="HF78D070F590442BC9E73F526BAAFCE40"><enum>(D)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H5FF8285AF76543ACA5A73D11ED673F79" indent="up1"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="H97E4C2E3D9C8498C8DBCE5E7E65B704"><enum>(A)</enum><text>The Managing Trustee shall determine the annual surplus (as defined in subparagraph (B)) for each of the Trust Funds as of the end of each fiscal year. The Managing Trustee shall ensure that such annual surplus is invested, throughout the next following fiscal year, in—</text> 
<clause id="H11BA3225C88A495093F7CD29A4DC16C6" indent="up1"><enum>(i)</enum><text>marketable interest-bearing obligations of the United States or obligations guaranteed as to both principal and interest by the United States, purchased on original issue or at the market price, or</text></clause> 
<clause id="HCD8200EDB58F42BBA7DE1741CF2CD910" indent="up1"><enum>(ii)</enum><text>certificates of deposit in insured depository institutions (as defined in section 3(c)(2) of the <act-name parsable-cite="FDIA">Federal Deposit Insurance Act</act-name>).</text></clause></subparagraph> 
<subparagraph id="H471720B3C663416BA5E574CFF1280077" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph, the <quote>annual surplus</quote> for either of the Trust Funds as of the end of a fiscal year is the excess (if any) of—</text> 
<clause id="H64F5156572B34F3FAF5514F36DABD43"><enum>(i)</enum><text>the sum of—</text> 
<subclause id="HF0525DBA75C24540ADEB7258DEAD2731"><enum>(I)</enum><text>in the case of the Federal Old-Age and Survivors Insurance Trust Fund, the amounts appropriated to such Trust Fund under paragraphs (3) and (4) of subsection (a) for the fiscal year,</text></subclause> 
<subclause id="H0C2D18F3A00D47DC95A2E971E11BB1E4"><enum>(II)</enum><text>in the case of the Federal Disability Insurance Trust Fund, the amounts appropriated to such Trust Fund under paragraphs (1) and (2) of subsection (b) for the fiscal year, and</text></subclause> 
<subclause id="H2BFF9E5A1A3D478500E43C207E207E8D"><enum>(III)</enum><text>in either case, the amount appropriated to such Trust Fund under section 121(e) of the Social Security Amendments of 1983 for the fiscal year, and any amounts otherwise credited to or deposited in such Trust Fund under this title for the fiscal year, over</text></subclause></clause> 
<clause id="H811E035AD05F4C2C8701816CA5BDE9BC"><enum>(ii)</enum><text>the amounts paid or transferred from such Trust Fund during the fiscal year.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H9AE32703A5D44A19AFF2585120DFACC"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply with respect to annual surpluses as of the end of fiscal years beginning on or after October 1, 2005.</text></paragraph></subsection> 
<subsection id="HBDF532D30F924DAE00D3412909733B01"><enum>(b)</enum><header>Protection of the Social Security Trust Funds from the public debt limit</header> 
<paragraph id="HAAD380E70A32415992721C5976786CF8"><enum>(1)</enum><header>Protection of Trust Funds</header><text>Notwithstanding any other provision of law—</text> 
<subparagraph id="HD16F3CB79888422E00B39FB5E6954F00"><enum>(A)</enum><text>no officer or employee of the United States may—</text> 
<clause id="H1DA43BD72FF84F69990158CF002F68E1"><enum>(i)</enum><text>delay the deposit of any amount into (or delay the credit of any amount to) the Federal Old-Age and Survivors Insurance Trust Fund or the Federal Disability Insurance Trust Fund or otherwise vary from the normal terms, procedures, or timing for making such deposits or credits, or</text></clause> 
<clause id="HD36F7E2A60F04C42BAD63C43E5172D70"><enum>(ii)</enum><text>refrain from the investment in public debt obligations of amounts in either of such Trust Funds, if a purpose of such action or inaction is to not increase the amount of outstanding public debt obligations, and</text></clause></subparagraph> 
<subparagraph id="H723969E32CEA438ABD14344E9D789B3F"><enum>(B)</enum><text>no officer or employee of the United States may disinvest amounts in either of such Trust Funds which are invested in public debt obligations if a purpose of the disinvestment is to reduce the amount of outstanding public debt obligations.</text></subparagraph></paragraph> 
<paragraph id="HF0FD6076683B4F6389D809FF0069D03E"><enum>(2)</enum><header>Protection of benefits and expenditures for administrative expenses</header> 
<subparagraph id="H7D875027C9634039A6AB1FA52E87A94E"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraph (1), during any period for which cash benefits or administrative expenses would not otherwise be payable from the Federal Old-Age and Survivors Insurance Trust Fund or the Federal Disability Insurance Trust Fund by reason of an inability to issue further public debt obligations because of the applicable public debt limit, public debt obligations held by such Trust Fund shall be sold or redeemed only for the purpose of making payment of such benefits or administrative expenses and only to the extent cash assets of such Trust Fund are not available from month to month for making payment of such benefits or administrative expenses.</text></subparagraph> 
<subparagraph id="HEA19303C96F64ABD8BC2C08DF6089120"><enum>(B)</enum><header>Issuance of corresponding debt</header><text>For purposes of undertaking the sale or redemption of public debt obligations held by the Federal Old-Age and Survivors Insurance Trust Fund or the Federal Disability Insurance Trust Fund pursuant to subparagraph (A), the Secretary of the Treasury may issue corresponding public debt obligations to the public, in order to obtain the cash necessary for payment of benefits or administrative expenses from such Trust Fund, notwithstanding the public debt limit.</text></subparagraph> 
<subparagraph id="H60D5D360A6AF441B94CE5B13ABD335EC"><enum>(C)</enum><header>Advance notice of sale or redemption</header><text>Not less than 3 days prior to the date on which, by reason of the public debt limit, the Secretary of the Treasury expects to undertake a sale or redemption authorized under subparagraph (A), the Secretary of the Treasury shall report to each House of the Congress and to the Comptroller General of the United States regarding the expected sale or redemption. Upon receipt of such report, the Comptroller General shall review the extent of compliance with paragraph (1) and subparagraphs (A) and (B) of this paragraph and shall issue such findings and recommendations to each House of the Congress as the Comptroller General considers necessary and appropriate.</text></subparagraph></paragraph> 
<paragraph id="H47905C143F0741489B376EE2002B5C9C"><enum>(3)</enum><header>Public debt obligation</header><text>For purposes of this subsection, the term <term>public debt obligation</term> means any obligation subject to the public debt limit established under <external-xref legal-doc="usc" parsable-cite="usc/31/3101">section 3101</external-xref> of title 31, United States Code.</text></paragraph></subsection></section> 
<section id="HFCD36F03E6524FCD8E19F30180D52BF8"><enum>3.</enum><header>Social Security for Americans only</header> 
<subsection id="H649C567D2178491EB66C26CC4ECBB2C3"><enum>(a)</enum><header>Limitations on coverage of individuals based on earnings of individuals who are not citizens or nationals of the United States</header><text>Section 215(e) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(e)</external-xref>) is amended—</text> 
<paragraph id="HA3D5F1D4953E4837BFC6BB85B849CAA"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text></paragraph> 
<paragraph id="H82370A915B6E43F882E4C4EB5C758B14"><enum>(2)</enum><text>by inserting <quote>(1)</quote> after <quote>(e)</quote>; and</text></paragraph> 
<paragraph id="HCE9B36F7FCAA4249B58B5BE2BC0941E8"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="H6B1C3D6422FE4B8DAF1C00F2091B95F"> 
<paragraph id="HEA4C8B05D3DD42F387113942FC674185" indent="up1"><enum>(2)</enum><text>For purposes of subsections (b) and (d), in computing an individual’s average indexed monthly earnings, or in the case of an individual whose primary insurance amount is computed under section 215(a) as in effect prior to January 1979, average monthly wage, such individual shall not be credited with—</text> 
<subparagraph id="H79B84BBCFE064C2AA72C12CC31E61B51"><enum>(A)</enum><text>any wages paid to such individual after December 31, 2006, while such individual is not a citizen or national of the United States, or</text></subparagraph> 
<subparagraph id="H8114DCAD6BE34DEB9F5B189554F34701"><enum>(B)</enum><text>any self-employment income derived by such individual during any taxable year beginning after December 31, 2006, while such individual is not a citizen or national of the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HA0711C7302A14813A874CE00AAD45345"><enum>(b)</enum><header>Revision of authorization for totalization agreements</header> 
<paragraph id="H046D2F2B96F54B70B086F7781518F52"><enum>(1)</enum><header>In general</header><text>Section 233 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/433">42 U.S.C. 433</external-xref>) is amended to read as follows:</text> 
<quoted-block style="traditional" act-name="Social Security Act" id="HB35DDC7F500040649F2E78ADB51967DF"> 
<section id="H82022C1850C34CBCBACB1C2800CF09"><enum>233.</enum><header>International agreements</header><text display-inline="yes-display-inline">The President is authorized to enter into agreements (subject to the other provisions of this title and of chapters 2 and 21 of the Internal Revenue Code of 1986) establishing arrangements between the United States and any foreign country for the purpose of resolving questions of entitlement to, and participation in, the social security system established by this title and the social security system of such foreign country. Any such agreement shall take into account the limitations on the crediting of wages and self-employment income under section 215(e)(2).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF2B6CEB1A8E1422586D9A24C026FF195"><enum>(2)</enum><header>Effective date; termination of existing agreements</header><text>The amendment made by paragraph (1) shall apply with respect to agreements taking effect after the date of the enactment of this Act. Any agreement in effect on such date which was entered into under section 233 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (as in effect immediately before such date of enactment) shall terminate on December 31, 2006 (or as provided in such agreement, if earlier).</text></paragraph></subsection></section> 
<section id="HF3E7189503B7431D83343FFD2756C9E"><enum>4.</enum><header>Seniors’ health care freedom</header> 
<subsection id="HB5A5EB2FE4C94BFB86ABAAF15C65A37F" display-inline="no-display-inline"><enum>(a)</enum><header>Facilitating the use of private contracts under the medicare program</header><text>Section 1802(b) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395a">42 U.S.C. 1395a(b)</external-xref>) is amended by striking paragraph (3) and by redesignating paragraphs (4) and (5) as paragraphs (3) and (4), respectively.</text></subsection> 
<subsection id="H8218A9BAC5434B53B19F7CA3852C5988"><enum>(b)</enum><header>No eligibility condition based on refusal to participate in a government program</header><text>No persons otherwise eligible for old-age benefits under Social Security shall be denied such benefits because of their voluntary refusal to participate in any part of the Medicare program.</text></subsection></section> 
<section id="H66E3DBF4D783405384627C001F76241E"><enum>5.</enum><header>Repeal of inclusion in gross income of Social Security benefits</header> 
<subsection id="H1529B1183DD94609A900A46577A8462"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/86">Section 86</external-xref> of the Internal Revenue Code of 1986 (relating to social security benefits) is amended by adding at the end the following new subsection:</text> 
<quoted-block id="H0D4E1412A10046BCA6F4E7355BF177C3"> 
<subsection id="HE892B2D365D04F33B267FBAC00B9502C"><enum>(g)</enum><header>Termination</header><text>This section shall not apply to any taxable year beginning after the date of the enactment of this subsection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H507DA9FD34354570ADD5DAA200BDD0D4"><enum>(b)</enum><header>Social Security trust funds held harmless</header> 
<paragraph id="H97B8B7242CFD44E985C229449517F981"><enum>(1)</enum><header>In general</header><text>There are hereby appropriated (out of any money in the Treasury not otherwise appropriated) for each fiscal year to each fund under the <act-name parsable-cite="SSA">Social Security Act</act-name> or the Railroad Retirement Act of 1974 an amount equal to the reduction in the transfers to such fund for such fiscal year by reason of <external-xref legal-doc="usc" parsable-cite="usc/26/86">section 86(g)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph> 
<paragraph id="H4FA5D6A001844EC08FB6C4DBD7BE6386"><enum>(2)</enum><header>No tax increases</header><text>It is the sense of the Congress that tax increases will not be used to provide the revenue necessary to carry out paragraph (1).</text></paragraph></subsection></section> 
<section id="H6882008D51E74F9BAA23C4F6915EA403"><enum>6.</enum><header>Income tax credit for prescription drugs purchased by individuals who have attained retirement age</header> 
<subsection id="H5349C68908AB469B8853007B739691C5"><enum>(a)</enum><header>In general</header><text>Subpart A of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to nonrefundable personal credits) is amended by inserting after section 25D the following new section:</text> 
<quoted-block id="H6A4BF097276246C5BBC7FB14002BAD25"> 
<section id="HC5A9B2F75C944A819088E6851CC63E08"><enum>25E.</enum><header>Prescription drugs purchased by individuals who have attained social security retirement age</header> 
<subsection id="HE7F1770385014E59892DBC2EE8D90672"><enum>(a)</enum><header>In general</header><text>In the case of an individual who has attained social security retirement age, there shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal to 80 percent of the amount paid by the taxpayer during the taxable year (and not compensated for by insurance or otherwise) for any prescribed drug (as defined in section 213(d)(3)) for use by such individual.</text></subsection> 
<subsection id="HB5E2BB9CAD744CDA99E88CAC91DFE2B6"><enum>(b)</enum><header>Social security retirement age</header><text>For purposes of this section, the term <term>social security retirement age</term> means retirement age (as defined in section 216(l)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name>).</text></subsection> 
<subsection id="H3EC5342A073F4241B55B435FCCE50072"><enum>(c)</enum><header>Denial of double benefit</header> 
<paragraph id="H7606E8DF831D4C80B6DAB64DBF1566B1"><enum>(1)</enum><header>Coordination with medical expense deduction</header><text>The amount which would (but for this subsection) be taken into account by the taxpayer under section 213 for the taxable year shall be reduced by the credit (if any) allowed by this section to the taxpayer for such year.</text></paragraph> 
<paragraph id="HE1A100E43C7A4A0EA4A118BC3F4B25D"><enum>(2)</enum><header>Coordination with medical and health savings accounts</header><text>No credit shall be allowed under this section for amounts paid from any Archer MSA (as defined in section 220(d)) or any health savings account (as defined in section 223(d)).</text></paragraph></subsection> 
<subsection id="H0D3D6F9BD97F4DD6BD4F62CBF18411D"><enum>(d)</enum><header>Election not to have credit apply</header><text>This section shall not apply to a taxpayer for a taxable year if the taxpayer elects not to have this section apply for such year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD8B3EFF35BDE4FCA8F90E78F6143B608"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subpart A of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 25D the following new item:</text>

<toc-entry level="section">Sec. 25E. Prescription drugs purchased by individuals who have attained social security retirement age</toc-entry></toc><after-quoted-block></after-quoted-block></quoted-block></subsection> 
<subsection id="HDC69E063A87744649F67BE00E1A64DAF"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning more than 1 year after the date of the enactment of this Act.</text></subsection></section> 
<section id="HB520BF0209E84F8A97A696EFF35770A7"><enum>7.</enum><header>Facilitation of importation of drugs approved by food and drug administration and Internet sales of prescription drugs</header> 
<subsection id="H516830D051E94FE5A80086ABDBF593DB"><enum>(a)</enum><header>Facilitation of importation of drugs approved by food and drug administration</header><text>Chapter VIII of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381 et seq.</external-xref>) is amended—</text> 
<paragraph id="H9D4236A753DC4521B7B010E9EDF71DA8"><enum>(1)</enum><text>by striking section 804; and</text></paragraph> 
<paragraph id="HD293F597296E43E0A06CE456076332B0"><enum>(2)</enum><text>in section 801(d)—</text> 
<subparagraph id="H2F252311E60147FE8DB905003D359DCA"><enum>(A)</enum><text>by striking paragraph (2); and</text></subparagraph> 
<subparagraph id="H82CA7012C00E4E038541A30124B439E"><enum>(B)</enum><text>by striking <quote>(d)(1)</quote> and all that follows through the end of paragraph (1) and inserting the following:</text>

<subsection id="H322840A0C8214DB798E617D45BE53EA"><enum>(d)</enum> 
<paragraph display-inline="yes-display-inline" id="H378C3C29CD9843DDBDDEF5C41D4D7500"><enum>(1)</enum> 
<subparagraph display-inline="yes-display-inline" id="H4FD68C01D0E749AD00242987B6FD4B3D"><enum>(A)</enum><text>A person who meets applicable legal requirements to be an importer of drugs described in subparagraph (B) may import such a drug (without regard to whether the person is a manufacturer of the drug) if the person submits to the Secretary an application to import the drug and the Secretary approves the application.</text></subparagraph> 
<subparagraph indent="up2" id="HE7E6AF5129754E20B2AC6F00961CAE7C"><enum>(B)</enum><text>For purposes of subparagraph (A), the drugs described in this subparagraph are drugs that are subject to section 503(b)(1) or that are composed wholly or partly of insulin.</text></subparagraph> 
<subparagraph indent="up2" id="HE30B994EE44C4F08BDBDDA07FAAEFD8"><enum>(C)</enum><text>The Secretary shall approve an application under subparagraph (A) if the application demonstrates that the drug to be imported meets all requirements under this Act for the admission of the drug into the United States, including demonstrating that—</text> 
<clause id="HC7190C39B4FD4B5181FE36532707A236"><enum>(i)</enum><text>an application for the drug has been approved under section 505, or as applicable, under section 351 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>; and</text></clause> 
<clause id="H51D74780644E4810006EB0CDF7C57548"><enum>(ii)</enum><text>the drug is not adulterated or misbranded.</text></clause></subparagraph> 
<subparagraph indent="up2" id="HAE9F62721FC341B9AE2BF6E5AFB7051E"><enum>(D)</enum><text>Not later than 60 days after the date on which an application under subparagraph (A) is submitted to the Secretary, the Secretary shall—</text> 
<clause id="H000FF1C1856A447585C85FF765ABCE28"><enum>(i)</enum><text>approve the application; or</text></clause> 
<clause id="H9296B1DCF52E4F329939C2FB05DC8840"><enum>(ii)</enum><text>refuse to approve the application and provide to the person who submitted the application the reason for such refusal.</text></clause></subparagraph> 
<subparagraph indent="up2" id="H7B384374C65A4748A28C7236D486CC4D"><enum>(E)</enum><text>This paragraph may not be construed as affecting any right secured by patent.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="HAB02E86F02B54D8F84F2318BF9B168E3"><enum>(b)</enum><header>Internet sales of prescription drugs</header><text>Section 503(b) of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(b)</external-xref>) is amended by adding at the end the following paragraph:</text>

<paragraph indent="up1" id="HE9ECBC2781154BDA809BC0C02D2759D5"><enum>(6)</enum> 
<subparagraph display-inline="yes-display-inline" id="H8A7BD5DD328F4680A3C6F00E6A1003C"><enum>(A)</enum><text>With respect to the interstate sale of a prescription drug through an Internet site, the Secretary may not with respect to such sale take any action under this Act against any of the persons involved if—</text> 
<clause indent="up1" id="H8EAADBBB14284CA5A25E5BE34413FAE2"><enum>(i)</enum><text>the sale was made in compliance with this Act and with State laws that are applicable to the sale of the drug; and</text></clause> 
<clause indent="up1" id="HE152FA937E2F48A584E9B8E54541F9A1"><enum>(ii)</enum><text>accurate information regarding compliance with this Act and such State laws is posted on the Internet site.</text></clause></subparagraph> 
<subparagraph indent="up1" id="HED3806C73522424686A777001F269031"><enum>(B)</enum><text>For purposes of subparagraph (A), the sale of a prescription drug by a person shall be considered to be an interstate sale of the drug through an Internet site if—</text> 
<clause id="HA2961B7656174B46BE323CBB1F7D9200"><enum>(i)</enum><text>the purchaser of the drug submits the purchase order for the drug, or conducts any other part of the sales transaction for the drug, through an Internet site; and</text></clause> 
<clause id="HB8A76D0BB41249A985C7E6E338FB9968"><enum>(ii)</enum><text>pursuant to such sale, the person introduces the drug into interstate commerce or delivers the drug for introduction into such commerce.</text></clause></subparagraph> 
<subparagraph indent="up1" id="HFAA29C5477724DD5913E08D3344F40FC"><enum>(C)</enum><text>Subparagraph (A) may not be construed as authorizing the Secretary to enforce any violation of State law.</text></subparagraph> 
<subparagraph indent="up1" id="H59E613CDE764422ABABB15FBA90088C7"><enum>(D)</enum><text>For purposes of this paragraph, the term <term>prescription drug</term> means a drug that is subject to paragraph (1).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H438D82B64EC841BFBD7EAAE9C961DCF5"><enum>(c)</enum><header>Conforming amendments</header><text>Section 801(d) of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381(d)</external-xref>) is amended—</text> 
<paragraph id="H102CE4083C36461383634D7BA7F1D57"><enum>(1)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (2) and (3), respectively;</text></paragraph> 
<paragraph id="HF4E94B0B65D3470384DC97553313A5E3"><enum>(2)</enum><text>in subclause (III) of paragraph (2)(A)(i) (as redesignated by this subsection), by striking <quote>paragraph (4)</quote> and inserting <quote>paragraph (3)</quote>; and </text></paragraph> 
<paragraph id="HE9EFEC654AE14454998BECD2C6465740"><enum>(3)</enum><text>in paragraph (3) (as redesignated by this subsection), by striking <quote>paragraph (3)</quote> each place such term appears and inserting <quote>paragraph (2)</quote>.</text></paragraph></subsection> 
<subsection id="HE421E347CE494110ABCCF5F301A6677"><enum>(d)</enum><header>Regulations of Secretary of Health and Human Services; effective date</header> 
<paragraph id="H048E782A999B435E8D4BF9542EEBCC1B"><enum>(1)</enum><header>Regulations</header><text>Before the expiration of the period specified in paragraph (2), the Secretary of Health and Human Services shall promulgate regulations to carry out the amendments to the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> that are made by this section.</text></paragraph> 
<paragraph id="HB8A9B980713245D0A0924B7F4F8DEFEB"><enum>(2)</enum><header>Effective date</header><text>The amendments to the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> that are made by this section take effect upon the expiration of the one-year period beginning on the date of the enactment of this Act, without regard to whether the regulations required in paragraph (1) have been promulgated.</text></paragraph></subsection></section>
