<official-title>To amend the Internal Revenue Code of 1986 to provide a tax credit for professional school personnel in grades kindergarten through grade 12 and to amend title II of the Social Security Act to replace the 60-month period of employment requirement for application of the Government pension offset exemption with the rule that last applied before section 418 of the Social Security Protection Act of 2004 was enacted.</official-title>

<section section-type="section-one" id="HD7F087A0C9E4483784B9045F50DC2817" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Professional Educators Tax Relief Act of 2006</short-title></quote>.</text></section> 
<section id="H62097EDFD66D441FB9FA72DC635D083B"><enum>2.</enum><header>Tax credit for professional school personnel in grades K–12</header> 
<subsection id="H23F679ED2D174AF5006C4E80DB7634FF"><enum>(a)</enum><header>In general</header><text>Subpart A of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to nonrefundable personal credits) is amended by inserting after section 25D the following new section:</text>

<section id="HBAB48D035C7C4C109E91418B56286787"><enum>25E.</enum><header>Professional school personnel in grades K–12</header> 
<subsection id="H3B8AC1440C3E45E300A9EF4FDAF858A"><enum>(a)</enum><header>Allowance of credit</header><text>In the case of an eligible individual, there shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal to $1,000.</text></subsection> 
<subsection id="H08D6E7596A4F4DBBB5668E065F4EBFB3"><enum>(b)</enum><header>Eligible individual</header><text>For purposes of this section, the term <term>eligible individual</term> means any individual who—</text> 
<paragraph id="HC4A09C0F7D144D1F90FEAFBC8B88D4B6"><enum>(1)</enum><text>is employed—</text> 
<subparagraph id="H3B57095489A64A979066A86449CDA430"><enum>(A)</enum><text>as a teacher in any of the grades kindergarten through grade 12, or</text></subparagraph> 
<subparagraph id="H02D47785528B41FA82C8E3824E7100FA"><enum>(B)</enum><text display-inline="yes-display-inline">in another capacity (including librarians) in any of the grades kindergarten through grade 12, or in a position which involves regular contact with students in any of such grades, and whose position involves the formulation or implementation of the academic program for any of the grades kindergarten through 12, and</text></subparagraph></paragraph> 
<paragraph id="H72D3DAD708814A55948DDAF7E58D8257"><enum>(2)</enum><text>is employed on a full-time basis for an academic year that ends during the taxable year.</text></paragraph> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD81D22BA21F34A3AB3F6EEED503C8176"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subpart A of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 25D the following new item:</text>

<subsection id="HA80ED8B9D4F1423BAA8868CF14F4468D"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2006.</text></subsection></section> 
<section id="H7AF816CD63C247E3BABCDF8100808771"><enum>3.</enum><header>Restoration of earlier rule for application of Government pension offset exemption</header> 
<subsection id="H591598DFC418407D8E46619B849EC006"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202(k)(5)(A) of the Social Security Act is amended (in the matter before clause (i)) by striking <quote>during any portion of the last 60 months of such service ending with</quote> and inserting <quote>on</quote>.</text></subsection> 
<subsection id="HEC22C8BA3EDB4F3AAB29D320BCC17D99"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to applications for benefits under title II of the Social Security Act filed on or after the first day of the first month that begins after the date of the enactment of this Act.</text></subsection></section>
