Title II—Trade provisions relating to small business
Sec. 201. Establishment of Associate Administrator for International Trade in Small Business Administration.
2.Congress finds the following:
(1)As the world’s largest economy, the United States has an enormous stake in the future of the global trading system.
(2)Exports are a crucial force driving the United States economy and job creation.
(3)While nearly 97 percent of United States exporters are small and medium enterprises (SMEs), SMEs account for just over one-fourth of exports, leaving much room for growth.
(4)Two-thirds of United States exporters have fewer than 20 employees and sell to just one foreign market.
(5)Manufacturers account for 61 percent of total United States exports with small manufacturers accounting for approximately 15 percent of total United States exports. Thirty percent of small manufacturers do not currently export but would consider doing so if they had more help in securing vital information on foreign markets, customers, and export procedures.
(6)United States small and medium enterprises face tough competition from trading partners of the United States that aggressively undertake export promotion programs that directly support and underwrite the expanded growth in trade of their small and medium enterprises.
(7)United States trade promotion is carried out in part by 21 departments and agencies of the Federal Government. Representatives from these Federal departments and agencies are members of the Trade Promotion Coordinating Committee (TPCC), a Federal committee that has not lived up to congressional intent to provide a seamless offering of export promotion products and services due in part to the inadequate allocation of resources and a lack of ultimate decision making budget input authority to ensure effective results are achieved for the invested resources.
(8)United States small and medium enterprises lack an effective voice in trade policy formulation, implementation, and promotion due in part to inadequate resource distribution by the Small Business Administration that would aggressively champion trade issues for small and medium enterprises in all fora.
3.The purpose of this Act and the amendments made by this Act is to improve the performance and results of trade promotion policies and programs of the Federal Government in accordance with the Government Performance and Results Act of 1993 (Public Law 103–62).

<section id="H56DD92615CEB47E6BAE57F2F00344162"><enum>101.</enum><header>Establishment and purpose</header> <text display-inline="no-display-inline">Section 2312 of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727</external-xref>) is amended—</text>

<section id="H9B5580E5098745698B02F00731E879B"><enum>102.</enum><header>Duties</header> <text display-inline="no-display-inline">Section 2312(b) of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727(b)</external-xref>) is amended—</text>
<paragraph id="H3D6B607CEB80495A9BDD4FA5208EE506"><enum>(1)</enum><text>by redesignating paragraphs (1) through (6) as paragraphs (2) through (7), respectively;</text></paragraph>
<paragraph id="H73638CEB85874AF48BB97C43612B4564"><enum>(2)</enum><text>by inserting before paragraph (2) (as redesignated) the following new paragraph:</text>

<subparagraph id="H293E05D67B9C4E6D99182EE00378057"><enum>(A)</enum><text>by striking <quote>and explain</quote> and inserting <quote>, explain</quote>; and</text></subparagraph>

<section id="H16036630FDB84D62A7E8075F8D9B5B26"><enum>104.</enum><header>Director and Associate Directors</header> <text display-inline="no-display-inline">Section 2312 of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727</external-xref>) is amended by striking subsection (d) and inserting the following new subsection:</text>

<subsection id="H4A717A2ED2924A949FBCD30030B6F685"><enum>(d)</enum><header>Director and Associate Directors</header>
<paragraph id="H7231965C3DC84598A0579B4466985DC5"><enum>(1)</enum><header>Director</header><text>There shall be at the head of the Office a Director of the Office of Trade Promotion, who shall—</text>
<subparagraph id="H9BE5D14B9D4045378920928ED30985FE"><enum>(A)</enum><text>be appointed by the President, by and with the advice and consent of the Senate; and</text></subparagraph>
<subparagraph id="H96756D63AA5A41C29718CD11753CEE01"><enum>(B)</enum><text>be compensated at a rate consistent with the compensation of the directors of other offices within the Executive Office of the President.</text></subparagraph></paragraph>
<paragraph id="H1653D55B073E49058F7CF36342001586"><enum>(2)</enum><header>Associate directors</header><text>The President may appoint not more than two Associate Directors of the Office of Trade Promotion, by and with the advice and consent of the Senate, who shall each—</text>
<subparagraph id="H14F89EEE67634E888B177D31C9DC76DC"><enum>(A)</enum><text>be compensated at a rate not to exceed the rate provided for other associate directors of offices within the Executive Office of the President; and</text></subparagraph>
<subparagraph id="H1139CF600BB64AC3B1ACC10E446AC32"><enum>(B)</enum><text>perform such functions as the Director may prescribe.</text></subparagraph></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H44D867C4DB114FAA874C85569F385224"><enum>105.</enum><header>Staff; experts and consultants</header> <text display-inline="no-display-inline">Section 2312 of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727</external-xref>) is amended by striking subsection (e) and inserting the following new subsection:</text>

<subparagraph id="HA7D3C96449714AE2A8630935ACF87CC6"><enum>(A)</enum><header>In general</header><text>The Director of the Office may appoint and fix the pay of additional personnel as the Director considers appropriate.</text></subparagraph>
<subparagraph id="HAACD1DBBF5B3452E9D58450047C6DFD9"><enum>(B)</enum><header>Staff of federal agencies</header><text>Upon request of the Director, the head of any Federal department or agency that is represented on the Advisory Board on Trade Promotion established pursuant to subsection (f) may detail any of the personnel of that department or agency to the Office to assist it in carrying out its duties under this section.</text></subparagraph></paragraph>
<paragraph id="HE2028175E8944EAEB9B49D82AA439992"><enum>(2)</enum><header>Experts and consultants</header><text>The Director of the Office may procure temporary and intermittent services under <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109(b)</external-xref> of title 5, United States Code, but at rates for individuals not to exceed the daily equivalent of the maximum annual rate of basic pay for GS-15 of the General Schedule.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HE2EAB6EA0CF1420DAFA585BF6700FD40"><enum>106.</enum><header>Advisory Board on Trade Promotion</header>
<subsection id="HC83E77B5217647C594136662FEEC3D6B"><enum>(a)</enum><header>Advisory Board on Trade Promotion</header><text display-inline="yes-display-inline">Section 2312 of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727</external-xref>) is amended—</text>
<paragraph id="HE2635DCEED8E46F7A7EDDF6F52E4CC97"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph>
<paragraph id="H3E7A754CF2F54CA7B49246F42BC781CC"><enum>(2)</enum><text>by inserting after subsection (e) the following new subsection:</text>

<paragraph id="H3813A7FC77084DB781A2DE42A9290982"><enum>(1)</enum><header>Establishment and purpose</header><text>The President shall establish the Advisory Board on Trade Promotion (hereafter in this subsection referred to as the <quote>Advisory Board</quote>). The purpose of the Advisory Board shall be to advise the Director of the Office in carrying out the duties of the Office under this section and section 6 of the Export Enhancement Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727a">15 U.S.C. 4727a</external-xref>).</text></paragraph>
<paragraph id="H0CA00ECD05344AE7AB7E7718CAE87F00"><enum>(2)</enum><header>Membership</header>
<subparagraph id="H1CF18591FE444B169D6BA3DC15AE82B9"><enum>(A)</enum><header>In general</header><text>Members of the Advisory Board shall include representatives from—</text>

<clause id="H2CBD5C6D747B4198B0002DA0B8C1F555"><enum>(xvi)</enum><text>the Trade and Development Agency;</text></clause>
<clause id="HF8FE758C3C9749FBB29454C3D300EAB1"><enum>(xvii)</enum><text>the Office of the United States Trade Representative; and</text></clause>
<clause id="H3EE83A4D4A11412FA25750F155DB83CB"><enum>(xviii)</enum><text>at the discretion of the President, such other departments or agencies as may be necessary.</text></clause></subparagraph>
<subparagraph id="H93F2DF1106AA491489A9757F27D17824"><enum>(B)</enum><header>Chairperson</header><text>The Secretary of Commerce shall serve as the chairperson of the Advisory Board.</text></subparagraph></paragraph>
<paragraph id="H4D9B080DA0E8498000CA501F1029993D"><enum>(3)</enum><header>Member qualifications</header><text>Members of the Advisory Board shall be appointed by the heads of their respective departments or agencies. Such members, as well as alternates designated by any members unable to attend a meeting of the Advisory Board, shall be individuals who exercise significant decisionmaking authority in their respective departments or agencies.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<paragraph id="H6203AD9B798248F8BBE7200318E691D1" commented="no"><enum>(1)</enum><header>Environmental trade working group</header><text>Section 2313(b) of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4728">15 U.S.C. 4728(b)</external-xref>) is amended—</text>

<paragraph id="H7691C564F17E4B69B97C2E19F5CDE989"><enum>(3)</enum><header>International regional environmental initiatives</header><text>Section 2313(h) of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4728">15 U.S.C. 4728(h)</external-xref>) is amended by striking <quote>TPCC</quote> each place it appears and inserting <quote>Office of Trade Promotion</quote>. </text></paragraph> </subsection></section>

<subsection id="HD49C6D0D1D4E4E3DB61D18C4B459556D"><enum>(a)</enum><header>Report to Congress</header><text>Section 2312(g) of the Export Enhancement Act of 1988 (as redesignated by section 106(a)(1) of this subtitle) is amended to read as follows:</text>

<subsection id="H5FB5EE3E9F2A40608375AF6FDE6F1C4"><enum>(g)</enum><header>Report to Congress</header>
<paragraph id="H91E40D7D42D04776B03F3892AFEEE56B"><enum>(1)</enum><header>In general</header><text>The Director of the Office shall prepare and submit to the appropriate congressional committees an annual report that describes the strategic plan developed by the Office pursuant to subsection (c), the implementation of the plan and any revisions thereto, and the extent to which funding for the plan is appropriate.</text></paragraph>
<paragraph id="H7BA24623822C44229E01B274207DE9D0"><enum>(2)</enum><header>Definition</header><text>In this subsection, the term <quote>appropriate congressional committees</quote> means—</text>

<section id="HCC7E4928316B4184BD00C92FC3D0D48B" display-inline="no-display-inline" section-type="subsequent-section"><enum>201.</enum><header>Establishment of Associate Administrator for International Trade in Small Business Administration</header>
<subsection id="H529E9FB482EB4271AEA44C72E8C5D222"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 22(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/649">15 U.S.C. 649(a)</external-xref>) is amended by adding at the end the following: <quote>The head of the Office shall be the Associate Administrator for International Trade, who shall be an employee in the Senior Executive Service and shall be responsible to the Administrator.</quote>.</text></subsection>
<subsection id="H4CC72BD0570045E48B724C0066CCAF00"><enum>(b)</enum><header>Authority for additional Associate Administrator</header><text>Section 4(b)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/633">15 U.S.C. 633(b)(1)</external-xref>) is amended—</text>

<paragraph id="H28E42C2FA7AA47EC8500F51C7CB3C0E4"><enum>(3)</enum><text>the Associate Administrator for International Trade has direct supervision and control over the staff of the Office of International Trade, and over any employee of the Administration whose principal duty station is a United States Export Assistance Center or any successor entity.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H0C632C29B1C84F19826378997422C922"><enum>(d)</enum><header>Role of Associate Administrator in carrying out international trade policy</header><text>Section 2(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631(b)(1)</external-xref>) is amended in the matter preceding subparagraph (A)—</text>

<subsection id="HD89EA70CEC4C46088C63E460660849A8"><enum>(g)</enum><header>Effective date</header><text>The Administrator shall appoint an Associate Administrator for International Trade pursuant to sections 4 and 22 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>) (as amended by this section) not later than 90 days after the date of the enactment of this Act.</text></subsection></section>
